Eine juristische Diskussion über Einleitung und Abbruch der künstlichen Ernährung bei einwilligungsunfähigen Patienten ist in Österreich erst in Ansätzen auszumachen. Konsens zeichnet sich ab, eine Patientenvorausverfügung unter bestimmten Kriterien als verbindlich anzunehmen. Dann wäre auch eine antizipierte Verweigerung künstlicher Ernährung für die Ärzte rechtsverbindlich. Eine Übereinstimmung bezüglich der Akzeptanz einer „mutmaßlichen“ Verweigerung einer Behandlung (bzw. Ernährung) beim Nichteinwilligungsfähigen ist nicht zu erkennen. Die z. Z. herrschende Auffassung, dass die Ablehnung einer lebenserhaltenden Behandlung oder Ernährung durch einen gesetzlichen Vertreter grundsätzlich nur (...) im Einklang mit einem wirksam erklärten (oder zumindest hinreichend dokumentierten) Patientenwillen zulässig ist und daher bei allen anderen „Mutmaßungen“ über den Willen des Patienten dem Lebensschutz Vorrang einzuräumen ist, kann sich auf die verfassungsrechtliche staatliche Schutzpflicht zugunsten des Lebens berufen. Current EEG research emphasizes gamma band coherence as a signature of functional integration, that is, the solution to the binding problem. We note that spatial patterns of coherent neural activity are also observed at other EEG frequencies. If these oscillations reflect Nunez's resonant modes, they offer a solution to the binding problem that emerges naturally from the architecture of cortical connections.

Many in the discourse on climate engineering agree that if deployment of solar radiation management (SRM) technologies is ever permissible, then it must be accompanied by far-reaching mitigation of greenhouse gas (GHG) emissions. This raises the question of if and how both strategies interact. Although raised in many publications, there are surprisingly few detailed investigations of this important issue. The paper aims at contributing to closing this research gap by (i) reconstructing moral hazard claims to clarify their aim, (ii) offering (...) one specific normative justification for far-reaching mitigation and (iii) investigating in greater detail different mechanisms that could potentially cause a trade-off between mitigation and SRM. I conclude that the empirical evidence questioning the trade-off hypothesis is inconclusive. Moreover, theoretical reflections as well as economic model studies point to a trade-off. In our current epistemic situation these findings must be taken seriously. They caution against researching and developing SRM technologies before measures to avoid or minimise a trade-off are implemented. (shrink)

Few studies have considered in detail the ethical issues surrounding research in which investigators ask community members to engage in research subject recruitment within their own communities. Peer-driven recruitment and its variants are useful for accessing and including certain populations in research, but also have the potential to undermine the ethical and scientific integrity of community-based research. This paper examines the ethical implications of utilizing community members as recruiters of human subjects in the context of PDR, as well as the (...) authors' experience with a variant of PDR in a research project in South Africa. The importance of situating PDR in a comprehensive community engagement process that is responsive to the constraints of science and local needs and interests is emphasized. The paper will have relevance to bioethicists, health researchers, and research regulators concerned about the appropriate use of peer-driven recruitment strategies in health research. (shrink)

We are living in a time of social and cultural changes. As in other disciplines, the foundations of music education are being increasingly challenged. Thus, it is no longer possible to specify reliably the aims and contents of music education and their implementation in school by simply basing them on lasting musical traditions and changeless forms of life. It has been said that such an assessment leads us to a pluralistic—if not relativistic—view of music education. But it does not help (...) us when we have to make a decision on "What is to be done?" How can we orientate ourselves in our actions and whereupon should we base our judgements when negotiating decisions and trying to convince others? If we are not ready to accept that the decision-making process in the field of music education is just a matter of power, we have to be content with the arguments we can offer. We need to have the courage of independent critical thinking in terms of Didaktik involving all concerned. The situation is similar to that of aesthetic arguing: there is no sure footing; our criteria for evaluation are always up for discussion. (shrink)

If there is a specifically rhetorical approach to argumentation, I believe it is one that studies argumentation that is specifically rhetorical. So if we want to ask, “What is the rhetorical approach to argumentation?” we should first ask, “What is rhetorical argumentation?” It is worthwhile focusing on this question because various misleading definitions of rhetorical argumentation have been in circulation for almost as long as rhetoric has existed. Some misleading definitions see the defining property of rhetorical argumentation in the arguer’s (...) aim. This book presents an analysis of the institutional development of selected social science and humanities disciplines in Argentina, France, Germany, Hungary, Italy, the Netherlands, Sweden and the United Kingdom. Where most narratives of a scholarly past are presented as a succession of ‘ideas,’ research results and theories, this collection highlights the structural shifts in the systems of higher education, as well as institutions of research and innovation within which these disciplines have developed. This institutional perspective will facilitate systematic comparisons between (...) developments in various disciplines and countries. Across eight country studies the book reveals remarkably different dynamics of disciplinary growth between countries, as well as important interdisciplinary differences within countries. In addition, instances of institutional contractions and downturns and veritable breaks of continuity under authoritarian political regimes can be observed, which are almost totally absent from narratives of individual disciplinary histories. This important work will provide a valuable resource to scholars of disciplinary history, the history of ideas, the sociology of education and of scientific knowledge. (shrink)

In order to reason in a non-trivializing way with contradictions, para- consistent logics reject some classically valid inferences. As a way of re- covering some of these inferences, Graham Priest ([Priest, 1991]) proposed to nonmonotonically strengthen the Logic of Paradox by allowing the se- lection of “less inconsistent” models via a comparison of their respective inconsistent parts. This move recaptures a good portion of classical logic in that it does not block, e.g., disjunctive syllogism, unless it is applied to contradictory (...) assumptions. In Priest’s approach the inconsistent parts of models are compared in an extensional way by considering their inconsis- tent objects. This distinguishes his system from the standard format of (inconsistency-)adaptive logics pioneered by Diderik Batens, according to which (atomic) contradictions validated in models form the basis of their comparison. A well-known problem for Priest’s extensional approach is its lack of the Strong Reassurance property, i.e., for specific settings there may be infinitely descending chains of less and less inconsistent models, thus never reaching a minimally inconsistent model. In this paper, we demonstrate that Strong Reassurance holds for the extensional approach under a cardinality-based comparison of the incon- sistent parts of models. Furthermore, we introduce and investigate the metatheory of the class of first-order nonmonotonic inconsistency-tolerant construct over the extensional or quantitative comparisons of their respec- tive models. Core model-theoretic properties for these logics, such as the Löwenheim-Skolem theorems, along with other nonmonotonic properties, are further studied. (shrink)

In this paper, I re-examine Barry Smith’s list of features of Austrian Philosophy in his Austrian philosophy. The legacy of Franz Brentano. Open Court, Chicago, 1994). I claim that the list properly applies only in a somewhat abbreviated form to all significant representatives of Austrian Philosophy. Moreover, Smith’s crucial thesis that the features of Austrian Philosophy are not shared by any German philosopher only holds if we compare Austrian Philosophy to a canonical list of German Philosophy II. This list, however, (...) was established in twentieth century as a result of historical misrepresentations. If we correct these misrepresentations, we obtain another list of hidden representatives called German Philosophy I. German Philosophy I is fundamentally identical to Austrian Philosophy, whereas German Philosophy II is entirely different from both Austrian Philosophy and German Philosophy I. Therefore, a slightly modified version of Smith’s Austrian Philosophy account still makes sense as a tool to position the proscientific and rational currents of Austrian Philosophy and German Philosophy I against the tendentially anti-scientific and irrational current of German Philosophy II. Resumo: Esse ensaio buscará sondar as relações entre filosofia e literatura, no pensamento de Gilles Deleuze, a despeito de sua parceria conjunta com Félix Guattari, atentando tanto para as concepções de escrita expressas ao longo de sua obra quanto para o modo como essas concepções teriam influenciado o estilo de seus escritos filosóficos. Partindo da premissa deleuziana de que a escrita possui um acentuado lastro clínico, sendo a responsável pela elaboração de um diagnóstico das forças capazes de aprisionar ou calar (...) a vida, procurar-se-á esmiuçar as ressonâncias desse lastro clínico, na concepção de filosofia como ato criativo, elaborada pelo autor. Como hipótese a ser aqui trabalhada, defende-se que a escrita deleuziana - compreendida como portadora de uma literalidade, conforme sustenta François Zourabchivili, ou como encrustada de uma poética imanentista, tal qual sugere Anita Costa Malufe - procuraria produzir uma zona de vizinhança ou indiscernibilidade entre a escrita filosófica, de caráter mais exegético, e a escrita literária, mais afectiva, de modo a produzir um deslocamento na relação do leitor com o ato de pensar.: In this essay we pretend to study the relationship between philosophy and literature in Gilles Deleuze’s thought, despite of his partnership with Félix Guattari, mapping the conceptions of writing throughout his work and considering the influence of these conceptions to forge a certain style in his philosophical texts. Starting from the deleuzian premise that writing has a strong clinical backing - being responsible for the elaboration of a diagnosis of the forces liable to imprison or silence life -, we will examine the resonances of this clinical backing in his conception of philosophy as a creative act. Our hypothesis is that the deleuzian writing - having a certain literality, as François Zourabchivili argues, or encrusted with an immanentism poetics, as Anita Costa Malufe suggests - would produce a so-called neighborhood zone or zone of indiscernibility between philosophical writing, with a more exegetical character, and literary writing, which is more affective, in order to produce a shift in the reader’s relationship with the act of thinking. De-domestication is the deliberate establishment of a population of domesticated animals or plants in the wild. In time, the population should be able to reproduce, becoming self-sustainable and incorporating 'wild' animals. Often de-domestication is part of a larger nature restoration scheme, aimed at creating landscapes anew, or re-creating former habitats. De-domestication is taken up in this paper because it both engages and raises questions about the major norms governing animals and nature. The debate here concerns whether animals undergoing de-domestication should (...) be looked upon as wild or non-wild and the effect this has on questions about how they should be treated. It also concerns the value of nature, and the kind and degree of nature management considered appropriate. The paper first describes actual de-domestication practices and considers the character of human duties to animals in process of de-domestication. Secondly, the paper explores the implications of de-domestication for nature management, focusing on notions of naturalness and wildness. Finally, because the current division of ethical topics, with its dependence upon whether animals and nature are domesticated, hampers rather than helps, a new perspective is offered on the issues raised by de-domestication. More 'thinking outside the box' with regard to animals and nature is recommended. (shrink)

With the emergence of participative social media, the ways in which stakeholders may interact with companies are changing. Social media and Web 2.0 technologies change gatekeeping mechanisms and the distribution of information. In consequence, organizations must realize that they are structurally embedded in online networks of interconnected and equitable actors. In this paper, we analyze how this change in today’s information and communication technologies may affect Corporate Social Responsibility action. We utilize social network analysis to investigate the CSR blogs of (...) three IT firms: Google, Hewlett-Packard, and Intel. The analysis reveals that their Internet-enabled social networks exhibit patterns of power law distribution and an uneven distribution of structural social capital among the actors involved, especially on the corporate side, which fails to fully engage with the network. We conclude by indicating the research implications of shifting social capital dynamics and by deriving implications for management and practice. (shrink)

La philosophie du XXe siècle est si riche qu'il est difficile de l'embrasser dans sa dimension internationale. Et ce siècle est lui-même difficile à isoler de ceux qui le précèdent.Il valait pourtant la peine de relever le défi, et de tenter cette expérience inédite, tout au moins sous une forme aussi ambitieuse. En (...) regard de la confusion régnante, il devient d'autant plus urgent de mettre en perspective les débats contemporains. Les philosophes eux-mêmes en ont besoin, le grand public aussi, ainsi que les étudiants. Ce livre n'a pas d'autre ambition que de les y aider, en leur fournissant sous une forme accessible un maximum d'informations.Bien entendu, il ne s'agit pas d'un simple répertoire, d'une collection de dates, d'auteurs et de doctrines (même si, en fait, on y trouve toutes celles qui ont compté). Quelques grands débats ont dominé le siècle : il importe à la fois d'en préciser les thèmes et d'en ressaisir les enjeux. L'auteur a donc pris ses responsabilités. Il a fait des choix. In this paper I examine the relationship between interpreting a fiction and specifying its content. The former plays a major role in literary studies; the latter is of central concern in the philosophical debate on truth in fiction. After elucidating these activities, I argue that they do not coincide but have interesting interdependencies. In particular, I argue that correct interpretations are metaphysically grounded in fictional content. I discuss this claim in detail and show why it is not in tension with (...) the evidential claim that correct interpretations give us epistemic access to fictional content, which I also endorse. À la fin du xvie siècle et au début du xviie, la France sort d’une série de massacres et d’une trentaine d’années de violences extrêmes. Et durant ces Guerres de religion, l’un et l’autre camp se sont référés à la notion d’holocauste, prise au sens religieux et littéral du terme. Si les protestants ont été plus enclins à pratiquer cette référence biblique du point de vue de la victime, les catholiques, en particulier ligueurs, l’ont plutôt employée dans le sens d’un (...) holocauste des réformés. Toujours est-il que les deux camps, réciproquement, se saignent à blanc et font subir à toute une population, impliquée ou non, une horreur qui marque les esprits des « gens d’après ». Si bien que, durant la période de paix intérieure relative qui suit l’accession d’Henri IV au pouvoir, la conscience d’une catastrophe juste passée s’impose, en particulier au théâtre et dans les tragédies. Une catastrophe à laquelle les contemporains se réfèrent comme événement radical du monde d’alors, un pire absolu de ce que l’humanité peut produire d’inhumain, une horreur qu’il faudrait peut-être oublier et/ou sur laquelle il est pourtant nécessaire de faire retour, pour tenter de la penser. Il y a un mystere des rythmes: il est difficile de les decrire et l'on sait a peine les noter. Il en va avec eux comme de la part la plus impartageable de toute experience: elle echappe au discours. Nous ne sommes jamais en face d'un rythme, dit Henri Maldiney, nous sommes impliques en lui. C'est sans doute cet empirisme qui fait de tout rythme plus qu'un agrement, ou une invention heureuse: une epreuve essentielle du vivant en nous-memes et sur (...) nous-memes. Les quinze essais rassembles dans ce volume explorent la puissance vitale du rythme dans toutes les aires de la connaissance: du cote de l'art bien sur, et avant tout de la musique; mais aussi dans le champ des sciences exactes, de la biologie, des sciences sociales... Lindquist et al. provide a compelling summary of the brain bases of the onset of emotion. Their conclusions, however, are constrained by typical fMRI techniques that do not assess a key ingredient in emotional experience – timing. We discuss the importance of timing in theories of emotion as well as the implications of neural temporal dynamics for psychological constructionism.
