Dann wäre auch eine antizipierte Verweigerung künstlicher Ernährung für die Ärzte rechtsverbindlich. Eine Übereinstimmung bezüglich der Akzeptanz einer „mutmaßlichen“ Verweigerung einer Behandlung (bzw. Ernährung) beim Nichteinwilligungsfähigen ist nicht zu erkennen. Die z. Z. herrschende Auffassung, dass die Ablehnung einer lebenserhaltenden Behandlung oder Ernährung durch einen gesetzlichen Vertreter grundsätzlich nur (...) im Einklang mit einem wirksam erklärten (oder zumindest hinreichend dokumentierten) Patientenwillen zulässig ist und daher bei allen anderen „Mutmaßungen“ über den Willen des Patienten dem Lebensschutz Vorrang einzuräumen ist, kann sich auf die verfassungsrechtliche staatliche Schutzpflicht zugunsten des Lebens berufen. In this paper, we present a new semantic framework designed to capture a distinctly cognitive or epistemic notion of meaning akin to Fregean senses. Traditional Carnapian intensions are too coarse-grained for this purpose: they fail to draw semantic distinctions between sentences that, from a Fregean perspective, differ in meaning. This has led some philosophers to introduce more fine-grained hyperintensions that allow us to draw semantic distinctions among co-intensional sentences. But the hyperintensional strategy has a flip-side: it risks drawing semantic distinctions (...) between sentences that, from a Fregean perspective, do not differ in meaning. This is what we call the ‘new problem’ of hyperintensionality to distinguish it from the ‘old problem’ that faced the intensional theory. We show that our semantic framework offers a joint solution to both these problems by virtue of satisfying a version of Frege’s so-called ‘equipollence principle’ for sense individuation. Frege’s principle, we argue, not only captures the semantic intuitions that give rise to the old and the new problem of hyperintensionality, but also points the way to an independently motivated solution to both problems. Yet philosophers have said almost nothing about the virtue of honesty in the past fifty years. This book aims to draw attention to this surprisingly neglected virtue. Part One looks at the concept of honesty. It takes up questions such as what does honesty involve, what are the motives of an honest person, how does (...) practical wisdom relate to honesty, and is there anything that connects all the different sides of honesty, including not lying, not stealing, not breaking promises, not misleading others, and not cheating. A central idea is that the honest person reliably does not intentionally distort the facts as she takes them to be. Part Two looks at the empirical psychology of honesty. It takes up the question of whether most people are honest, dishonest, or somewhere in-between. This book first reviews Miller's theory of Mixed Traits, as developed in his 2013 book Moral Character: An Empirical Theory. It then engages extensively with situations, the CAPS model in social psychology, and the Big Five Model in personality psychology. It ends by taking up implications for his view in meta-ethics (a modified error theory) and normative ethics (a challenge for virtue ethics).

Maurer delves into early-Enlightenment debates on self-love from both famous and lesser known authors, including Lord Shaftesbury, Bernard Mandeville, Francis Hutcheson, Joseph Butler, Archibald Campbell, David Hume and Adam Smith.

Suppose you perform two actions. The first imposes a risk of harm that, on its own, would be excessive; but the second reduces the risk of harm by a corresponding amount. By pairing the two actions together to form a set of actions that is risk-neutral, can you thereby make your overall course of conduct permissible? This question is theoretically interesting, because the answer is apparently: sometimes Yes, sometimes No. It is also practically important, because it bears on the moral (...) status of practices such as offsetting personal greenhouse gas (GHG) emissions. In this article we propose a criterion for distinguishing between cases where pairing risk-increasing and risk-reducing actions makes each action permissible, and those where it does not: the Principle of Aggregate Risk-Imposition. We work towards this by considering a range of examples that illustrate various illegitimate ways of pairing risk-increasing actions with risk-reducing ones, and asking what goes wrong in each case. We then use this criterion to evaluate GHG offsetting. Is offsetting a legitimate way of removing the risk-imposition associated with GHG emissions, or not? Controversially, we argue that this turns out to depend on the form that the offsetting takes. (shrink)

In solving judgment aggregation problems, groups often face constraints. Many decision problems can be modelled in terms the acceptance or rejection of certain propositions in a language, and constraints as propositions that the decisions should be consistent with. For example, court judgments in breach-of-contract cases should be consistent with the constraint that action and obligation are necessary and sufficient for liability; judgments on how to rank several options in an order of preference with the constraint of transitivity; and judgments on (...) budget items with budgetary constraints. Often more or less demanding constraints on decisions are imaginable. For instance, in preference ranking problems, the transitivity constraint is often contrasted with the weaker acyclicity constraint. In this paper, we make constraints explicit in judgment aggregation by relativizing the rationality conditions of consistency and deductive closure to a constraint set, whose variation yields more or less strong notions of rationality. We review several general results on judgment aggregation in light of such constraints. (shrink)

Corporations significantly influence the public and political spheres. In light of this corporate power in society, academics have criticized the lack of legitimization (i.e., the legitimacy gap) and highlighted a potential divergence between corporate resource allocation and the needs and preferences of the public (i.e., the social issues gap). To address these problems, democratizing organizations has been proposed as a potential solution. In line with this, the authors argue that an increase in corporate power outside the economic realm should be (...) counterbalanced by more democratic corporate governance (i.e., an internalization of democracy). While important groundwork exists, academic attention to these topics remains limited. The authors provide an overview of the literature linking corporate power and the claim for democratizing organizations, advocate for legitimization, identify research gaps, and develop a research agenda to inspire and guide future research efforts. The paper's findings suggest the importance of conceptual and empirical research on the micro-, meso-, and macro-levels and the cross-level effects, which is needed to advance this incipient research area. Future research must (1) clearly define corporate power and discuss how democratizing organizations can contribute to more legitimate organizational decisions, (2) unveil novel approaches for more democratic corporate governance, and (3) understand the organizational- and individual-level factors necessary for the successful realization of democratic organizations. Some moral theorists argue that innocent beneficiaries of wrongdoing may have special remedial duties to address the hardships suffered by the victims of the wrongdoing. These arguments generally aim to simply motivate the idea that being a beneficiary can provide an independent ground for charging agents with remedial duties to the victims of wrongdoing. Consequently, they have neglected contexts in which it is implausible to charge beneficiaries with remedial duties to the victims of wrongdoing, thereby failing to explore the limits (...) of the benefiting relation in detail. Our aim in this article is to identify a criterion to distinguish contexts in which innocent beneficiaries plausibly bear remedial duties to the victims of wrongdoing from those in which they do not. We argue that innocent beneficiaries incur special duties to the victims of wrongdoing if and only if receiving and retaining the benefits sustains wrongful harm. We develop this criterion by identifying and explicating two general modes of sustaining wrongful harm. We also show that our criterion offers a general explanation for why some innocent beneficiaries incur a special duty to the victims of wrongdoing while others do not. By sustaining wrongful harm, beneficiaries-with-duties contribute to wrongful harm, and we ordinarily have relatively stringent moral requirements against contributing to wrongful harm. On our account, innocently benefiting from wrongdoing _per se_ does not generate duties to the victims of wrongdoing. Rather, beneficiaries acquire such duties because their receipt and retention of the benefits of wrongdoing contribute to the persistence of the wrongful harm suffered by the victim. We conclude by showing that our proposed criterion also illuminates why there can be reasonable disagreement about whether beneficiaries have a duty to victims in some social contexts. (shrink)

In this essay, we explore an issue of moral uncertainty: what we are permitted to do when we are unsure about which moral principles are correct. We develop a novel approach to this issue that incorporates important insights from previous work on moral uncertainty, while avoiding some of the difficulties that beset existing alternative approaches. Our approach is based on evaluating and choosing between option sets rather than particular conduct options. We show how our approach is particularly well-suited to address (...) this issue of moral uncertainty with respect to agents that have credence in moral theories that are not fully consequentialist. I.J. Good's ``On the Principle of Total Evidence" (1967) looms large in decision theory and Bayesian epistemology. Good proves that in Savage's (1954) decision theory, a coherent agent always prefers to collect, rather than ignore, free evidence. It is now well known that Good's result was prefigured in an unpublished note by Frank Ramsey (Skyrms 2006). The present paper highlights another early forerunner to Good's argument, appearing in Janina Hosiasson's ``Why do We Prefer Probabilities Relative to Many Data?" (1931), that (...) has been neglected in the literature. Section 1 reviews Good's argument and the problem it was meant to resolve; call this the \textit{value of evidence problem}. Section 2 offers a brief history of the value of evidence problem and provides biographical background to contextualize Hosiasson's contribution. Humans and many animals are capable of learning and learning how to learn better. We are concerned here with one way that reinforcement learners might learn how to learn better. In an experiment described by Harlow in (Psychol Rev 56:51–65, 1949) a group of rhesus monkeys learn a new way of learning in the context of a specific type of problem. We will consider how such agents might coevolve a new learning dynamics and new attendant saliences. Globalization arguably generated a governance gap that is being filled by transnational rule-making involving private actors among others. The democratic legitimacy of such new forms of governance beyond nation states is sometimes questioned. Apart from nation-centered democracies, such governance cannot build, for example, on representation and voting procedures to convey legitimacy to the generated rules. Instead, alternative elements of democracy such as deliberation and inclusion require discussion to assess new instruments of governance. The recently published standard ISO 26000 is an (...) interesting example of transnational governance. ISO 26000 was developed in a lengthy multiorganizational process for the purpose of giving guidance on the social responsibility of organizations. By assessing the specific case of ISO 26000, this study sheds light on the question of how legitimacy beyond nation-state democracy is ensured or constricted. Centering on the idea of deliberate democracy and democratic legitimacy, the study offers in-depth insights on the normative legitimacy of the development process of ISO 26000. Positioned on the interface of business studies and public policy, this article contributes to the academic literature on transnational governance and on the role of multistakeholder processes in shaping the role of business in society. The present volume collects essays on the philosophical foundations of quantum theories of gravity, such as loop quantum gravity and string theory. Central for philosophical concerns is quantum gravity's suggestion that space and time, or spacetime, may not exist fundamentally, but instead be a derivative entity emerging from non-spatiotemporal degrees of freedom. In the spirit of naturalised metaphysics, contributions to this volume consider the philosophical implications of this suggestion. In turn, philosophical methods and insights are brought to bear on the (...) foundations of quantum gravity itself. For instance, the idea of functionalism, borrowed from the philosophy of mind and discussed by several essays, exemplifies this mutual interaction the collection seeks to foster. (shrink)

Our aim in this brief essay is not to defend a particular policy or attitude toward lockdown measures in the United States or elsewhere, but to consider the scope and limits of different types of arguments that can be offered for them. Understanding the complexity of these issues will, we hope, go some way to helping us understand each other and our attitudes toward state responses to the pandemic.

When can or should citizenship be granted to prospective members of states? When can or should states withdraw citizenship from their existing members? In recent decades, political philosophers have paid considerable attention to the first question, but have generally neglected the second. There are of course good practical reasons for prioritizing the question of when citizenship should be granted—many individuals have a strong interest in acquiring citizenship in particular political communities, while many fewer are at risk of denationalization. Still, loss (...) of membership in a political community is a practice with a long history that continues to take place today. -/- Concerns about national security have recently led several liberal democratic states to pass, strengthen or consider legislation that would empower their governments to denationalize certain persons.] At the international level, formal norms governing denationalization are vague and generally toothless, and there are no international legal norms that restrict denationalization to citizens who hold another citizenship or wish to take up citizenship elsewhere (Worster, 2009). So it is important to determine whether there are conditions under which denationalization can be morally justified and, if so, what those conditions are. We shall argue that while denationalization is ordinarily impermissible, there is a class of crime committed by citizens that may render it not only permissible, but a fitting response on the part of the state. This volume deals with the connection between thinking-and-speaking and our form of life. All contributions engage with Wittgenstein’s approach to this topic. As a whole, the volume takes a stance against both biological and ethnological interpretations of the notion "form of life" and seeks to promote a broadly logico-linguistic understanding instead. The structure of this book is threefold. Part one focuses on lines of thinking that lead from Wittgenstein’s earlier thought to the concept of form of life in his later (...) work. Contributions to part two examine the concrete philosophical function of this notion as well as the ways in which it differs from cognate concepts. Contributions to part three put Wittgenstein’s notion of form of life in perspective by relating it to phenomenology, ordinary language philosophy and problems in contemporary analytic philosophy. Cases involving amoralists who no longer care about the institution of morality, together with cases of depression, listlessness, and exhaustion, have posed trouble in recent years for standard formulations of motivational internalism. In response, though, internalists have been willing to adopt narrower versions of the thesis which restrict it just to the motivational lives of those agents who are said to be in some way normal, practically rational, or virtuous. My goal in this paper is to offer a new set (...) of counterexamples to motivational internalism, examples which are effective both against traditional formulations of the thesis as well as against many of these more recent restricted proposals. Unlike the relativity theory it seeks to replace, causal set theory has been interpreted to leave space for a substantive, though perhaps ‘localized’, form of ‘becoming’. The possibility of fundamental becoming is nourished by the fact that the analogue of Stein’s theorem from special relativity does not hold in causal set theory. Despite this, we find that in many ways, the debate concerning becoming parallels the well-rehearsed lines it follows in the domain of relativity. We present, however, some new twists (...) and challenges. In particular, we show that a novel and exotic notion of becoming is compatible with causal sets. In contrast to the ‘localized’ becoming considered compatible with the dynamics of causal set theory by its advocates, our novel kind of becoming, while not answering to the typical A-theoretic demands, is ‘global’ and objective. This book explores the nature of moral responsibilities of affluent individuals in the developed world, addressing global poverty and arguments that philosophers have offered for having these responsibilities. The first type of argument grounds responsibilities in the ability to avert serious suffering by taking on some cost. The second argument seeks to ground responsibilities in the fact that the affluent are contributing to such poverty. The authors criticise many of the claims advanced by those who seek to ground stringent responsibilities (...) to the poor by invoking these two types of arguments. It does not follow from this that the affluent are meeting responsibilities to the poor. The book argues that while people are not ordinarily required to make large sacrifices in assisting others in severe need, they are required to incur moderate costs to do so. If the affluent fail consistently to meet standards, this fact can substantially increase the costs they are required to bear in order to address it. (shrink)

I first summarize the central issues in the debate about the empirical adequacy of virtue ethics, and then examine the role that social psychologists claim positive and negative mood have in influencing compassionate helping behavior. I argue that this psychological research is compatible with the claim that many people might instantiate certain character traits after all which allow them to help others in a wide variety of circumstances. Unfortunately for the virtue ethicist, however, it turns out that these helping traits (...) fall well short of exhibiting certain central features of compassion. (shrink)

This paper maps out various options for thinking about two issues: the structural relationship between practical wisdom and the moral virtues, and the various functions of practical wisdom. With the help of a case study of the virtue of honesty, three main concerns are raised for what I call the Standard Model of practical wisdom. Two other models, the Socratic Model and the Fragmentation Model, are also critically evaluated. I end by taking seriously an eliminativist approach according to which the (...) trait of practical wisdom does not exist. (shrink)

Artificial intelligence represents a key technology being inbuilt into evermore products. Research investigating attitudes towards artificial intelligence surprisingly is still scarce, although it becomes apparent that artificial intelligence will shape societies around the globe. To better understand individual differences in attitudes towards artificial intelligence, the present study investigated in n = 351 participants associations between the Affective Neuroscience Personality Scales (ANPS) and the Attitudes towards Artificial Intelligence framework (ATAI). It could be observed that in particular higher levels of SADNESS were (...) associated with higher negative attitudes towards AI (fearing AI). The findings are discussed in this work from an evolutionary perspective because primary emotional systems—according to Affective Neuroscience Theory—represent tools for survival, which have been homologously conserved across mammalian species including homo sapiens. In this paper we provide a proof theoretical investigation of logical argumentation, where arguments are represented by sequents, conflicts between arguments are represented by sequent elimination rules, and deductions are made by dynamic proof systems extending standard sequent calculi. The idea is to imitate argumentative movements in which certain claims are introduced or withdrawn in the presence of counter-claims. This is done by a dynamic evaluation of sequences of sequents, in which the latter are considered ‘derived’ or ‘not derived’ according (...) to the content of the sequence. We show that decisive conclusions of such a process correspond to well-accepted consequences of the underlying argumentation framework. The outcome is therefore a general and modular proof-theoretical approach for paraconsistent and non-monotonic reasoning with argumentation systems. (shrink)

The workshop will discuss new insights in the interaction between logic and law, and more precisely the study of different answers to the question: What role does logic play in legal reasoning? It will present both current challenges and historical perspectives in the relation between logic and law. The perspectives to be discussed involve the interface of the following studies.

No one in philosophy has paid much attention to the virtue of honesty in recent years. Here is a trait for which it is easy to find consensus that it is a virtue, and furthermore, a very important virtue. It also has obvious relevance to what we see going on in contemporary politics, for instance, or in sports, the entertainment world, and education. Yet as far as I can tell, only one article in a philosophy journal has appeared in several (...) decades which discusses this virtue at any length. -/- In this chapter I have two central aims: (i) to sketch some of the conceptual parameters of the virtue of honesty in general, as well as its subordinate virtues, and then (ii) to draw on leading work in psychology to determine, at least in a preliminary way, whether we should think that most people instantiate this virtue or not. Most discussions frame the Liar Paradox as a formal logical-linguistic puzzle. Attempts to resolve the paradox have focused very little so far on aspects of cognitive psychology and processing, because semantic and cognitive-psychological issues are generally assumed to be disjunct. I provide a motivation and carry out a cognitive-computational treatment of the liar paradox based on a model of language and conceptual knowledge within the Predictive Processing framework. I suggest that the paradox arises as a failure of synchronization between two (...) ways of generating the liar situation in two different PP sub-models, one corresponding to language processing and the other to the processing of meaning and world-knowledge. In this way, I put forward the claim that the liar sentence is meaningless but has an air of meaningfulness. I address the possible objection that the proposal violates the Principle of Unrestricted Compositionality, which purportedly regulates the conceptual competence of thinkers. (shrink)
