Hip fractures are common and serious injuries in the geriatric population. Obtaining informed consent for surgery in geriatric patients can be difficult due to the high prevalence of comorbid cognitive impairment. Given that virtually all patients with hip fractures eventually undergo surgery, and given that delays in surgery are associated with increased mortality, we argue that there are select instances in which it may be ethically permissible, and indeed clinically preferable, to initiate surgical treatment in cognitively impaired patients under the (...) doctrine of presumed consent. In this paper, we examine the boundaries of the license granted by presumed consent and use the example of geriatric hip fracture to build an ethical framework for understanding the doctrine of presumed consent. The license to act under presumed consent requires three factors: patient incapacity, clinical urgency and clarity on the correct course of action. All three can apply to geriatric hip fracture. The typical patient frequently lacks capacity. Delays in initiating surgical treatment are associated with markedly increased mortality rates. Last, there appears to be consensus that surgery is the preferred treatment. Nonetheless, because there is a window of safe delay during which treating physicians can stabilize the patient, address reversible causes of cognitive impairment and identify surrogate decision makers, presumed consent should be invoked only as a method of last resort. A medical situation need not be characterized by risk of imminent and certain death for presumed consent to be relevant. Rather, there are two distinct windows that must be considered: the time interval in which action may be delayed without danger, and the time interval needed to obtain a better form of consent. Social exclusion influences how expressions are perceived and the tendency of the perceiver to mimic them. However, less is known about social exclusion’s effect on one’s own facial expressions. The aim of the present study was to identify the effects of social exclusion on Duchenne smiling behaviour, defined as activity of both zygomaticus major and the orbicularis oculi muscles. Utilising a within-subject’s design, participants took part in the Cyberball Task in which they were both included and excluded while facial electromyography (...) was measured. We found that during the active experience of social exclusion, participants showed greater orbicularis oculi activation when compared to the social inclusion condition. Further, we found that across both conditions, participants showed greater zygomaticus major muscle activation the longer they engaged in the Cyberball Task. Order of condition also mattered, with those who experienced social exclusion before social inclusion showing the greatest overall muscle activation. These results are consistent with an affiliative function of smiling, particularly as social exclusion engaged activation of muscles associated with a Duchenne smile. (shrink)

In this essay I identify a type of linguistic phenomenon new to feminist philosophy of language: biased evaluative descriptions. Biased evaluative descriptions are descriptions whose well-intended positive surface meanings are inflected with implicitly biased content. Biased evaluative descriptions are characterized by three main features: (1) they have roots in implicit bias or benevolent sexism, (2) their application is counterfactually unstable across dominant and subordinate social groups, and (3) they encode stereotypes. After giving several different kinds of examples of biased evaluative (...) descriptions, I distinguish them from similar linguistic concepts, including backhanded compliments, slurs, insults, epithets, pejoratives, and dog whistles. I suggest that the traditional framework of Gricean implicature cannot account for biased evaluative descriptions. I discuss some challenges to the distinctiveness and evaluability of biased evaluative descriptions, including intersectional social identities. I conclude by discussing their social significance and moral status. Identifying biased evaluative descriptions is important for a variety of social contexts, from the very general and broad (political speeches) to the very particular and small (bias in academic hiring). We argue against Thomson’s view that abortion is permissible even if fetuses have high moral status. Against this, we argue that, because many mothers are morally responsible for their pregnancies, they have a special obligation to assist. Finally, we address an objection according to which many mothers whose pregnancies are not a product of rape are not morally responsible to a sufficient degree, and so an obligation to assist is not generated. This objection assumes that the force of the mother’s (...) right to bodily integrity is not diminished if she is insufficiently morally responsible. We challenge this assumption. Our complete thesis is as follows: If a mother is morally responsible to a sufficient degree, she acquires an obligation to assist. Patients in a minimally conscious state (MCS) fall into a different diagnostic category than patients in the more familiar vegetative states (VS). Not only are MCS patients conscious in some sense, they have a higher chance for recovery than VS patients. Because of these differences, we ostensibly have reason to provide MCS patients with care that goes beyond what we provide to patients with some VS patients. But how to justify this differential treatment? I argue we can’t justify it solely (...) by looking to MCS patients’ actual levels of consciousness. We must look also to the ways in which these patients are potentially conscious. Specifically, I argue that certain sensible and well-regarded policy recommendations cannot be justified by looking solely to patients’ actual levels of consciousness, but that they can be justified by looking to patients’ potential for consciousness. Insofar then as we have prima facie reason to follow the recommendations, we also have prima facie reason to view the potential for consciousness as morally salient. If that is true, however, several important implications follow: first, if the potential for consciousness is morally salient, this translates into actual and pressing obligations to patients with disorders of consciousness generally. Second, if the potential for consciousness is morally salient, this has implications that go beyond our obligations to patients with disorders of consciousness. Indeed, if the potential for consciousness is morally salient, this adds an important layer of complexity to the normative landscape, a layer we may not have sufficiently noticed before. (shrink)

This paper discusses a puzzling tension in attributions of moral responsibility in cases of resultant moral luck: we seem to hold agents fully morally responsible for unlucky outcomes, but less-than-fully-responsible for unlucky outcomes brought about differently than intended. This tension cannot be easily discharged or explained, but it does shed light on a famous puzzle about causation and responsibility, the Thirsty Traveler.

This paper brings two fresh perspectives on Lewis’s theory of time travel. First: many key aspects and theoretical desiderata of Lewis’s theory can be captured in a framework that does not commit to eternalism about time. Second: implementing aspects of Lewisian time travel in a non-eternalist framework provides theoretical resources for a better treatment of time travel to the future. While time travel to the past has been extensively analyzed, time travel to the future has been comparatively underexplored. I make (...) progress on this topic. Along the way, I discuss Lewis’s lesser-known time travel oeuvre, especially his volume of correspondence and lectures on the topic collected in Beebee and Fisher (2020) and Janssen-Lauret & MacBride (forthcoming). I propose to analyze the concept of basing beliefs on reasons. The concept is an important one in understanamg the so-called "inferential" or "indirect" knowledge. After briefly stating the causal analyses of this concept given by D.M. Armstrong and Marshall Swain I will present two cases which show these analyses to be too strong and too weak. Finally, I will propose an analysis which avoids these twin difficulties.

John Stuart Mill is one of the hallowed figures of the liberal tradition, revered for his defense of liberal principles and expansive personal liberty. By examining Mill's arguments in On Liberty in light of his other writings, however, Joseph Hamburger reveals a Mill very different from the "saint of rationalism" so central to liberal thought. He shows that Mill, far from being an advocate of a maximum degree of liberty, was an advocate of liberty and control--indeed a degree of (...) control ultimately incompatible with liberal ideals.Hamburger offers this powerful challenge to conventional scholarship by presenting Mill's views on liberty in the context of his ideas about, in particular, religion and historical development. In 1908, three years after Einstein first published his special theory of relativity, the mathematician Hermann Minkowski introduced his four-dimensional “spacetime” interpretation of the theory. Einstein initially dismissed Minkowski’s theory, remarking that “since the mathematicians have invaded the theory of relativity I do not understand it myself anymore.” Yet Minkowski’s theory soon found wide acceptance among physicists, including eventually Einstein himself, whose conversion to Minkowski’s way of thinking was engendered by the realization that he could profitably employ it for the (...) formulation of his new theory of gravity. The validity of Minkowski’s mathematical “merging” of space and time has rarely been questioned by either physicists or philosophers since Einstein incorporated it into his theory of gravity. Physicists often employ Minkowski spacetime with little regard to the whether it provides a true account of the physical world as opposed to a useful mathematical tool in the theory of relativity. Philosophers sometimes treat the philosophy of space and time as if it were a mere appendix to Minkowski’s theory. In this critical study, Joseph Cosgrove subjects the concept of spacetime to a comprehensive examination and concludes that Einstein’s initial assessment of Minkowksi was essentially correct. There is a need for empirically based research on social and ethical challenges related to informed consent processes, particularly in studies focusing on adolescent sexual and reproductive health. In a pilot study of a school-based pregnancy prevention intervention in rural Zambia, the majority of the guardians who were asked to consent to their daughters’ participation, refused. In this paper we explore the reasons behind the low participation in the pilot with particular attention to challenges related to the community engagement and (...) informed consent process. The pilot was implemented in two schools and examined the acceptability of a package of interventions including economic support to families to keep their girls in school, pocket money for girls, youth club meetings on reproductive health, and community meetings to sensitize the community. Focus group discussions were conducted with girls who participated in the pilot, boys in their class and with parents. Individual semi-structured interviews were conducted with teachers, peer educators and community health workers involved in the coordination of the intervention as well as with religious and traditional leaders. Data were analyzed through thematic analysis. The findings indicate that inadequate use of recognized community communication channels during the community engagement process and dissemination of information about the pilot resulted in limited understanding of the pilot concept by the community. This surfaced through uncertainty and fear that the intervention may result in loss of control over daughters, worries about why money was provided unconditionally to girls, and suspicion of links to satanism. The sense of insecurity appeared to be exacerbated by low literacy levels, poverty, fear of loss of bride wealth, perceived disregard for local perceptions of social status, and scanty trust in the actors implementing the pilot. Inadequate use of locally appropriate channels in the dissemination of information created room for interpretation and facilitated development of mistrust, undermining the conditions for community engagement and actual informed consent. A key lesson learnt is the importance of taking seriously the complexity of local values and structures that may impact people’s capability to consent or not consent to a study in an informed manner. Although this conference, held at Oxford on September 6–7, 1993, did not completely fulfil the ambitions of its subtitle, it nonetheless provided a stimulating forum for the presentation and exchange of ideas on various topics arising from Hegel’s Phenomenology. In the first paper, “Rupture, Closure, and Dialectic,” Joseph Flay dealt with the Phenomenology in its role as an introduction or beginning to the system. David Duquette then discussed the master/slave dialectic and the political significance of Hegel’s concept of recognition (...) in the Phenomenology. Following this, Jay Bernstein focussed on Hegel’s treatment of conscience and guilt, and related this to his views of ethical action, arguing that Hegel leaves room for moral autonomy and hence tragic suffering even within his conception of Sittlichkeit. In the fourth paper, “The Presence of Aristotle in Hegel’s Phenomenology,” Nicholas Walker analyzed the relation between Hegel and Aristotle, and the complexities of the latter’s influence on the Phenomenology. H.S. Harris then offered a sketch of his own view of the Phenomenology in “Let’s Not ‘Leave out the Ethical’: A ‘Conscientious’ Response to S.K.”, starting from a discussion of Hegel’s theory of truth and how this shapes the structure of this work. Finally, in “The ‘Unhappy Consciousness’ and Conscious Unhappiness,” Simon Jarvis examined Adorno’s critique of Hegel, and emphasized the continuing importance and value of this critique for any truly living contemporary Hegelianism. Most causal discovery algorithms in the literature exploit an assumption usually referred to as the Causal Faithfulness or Stability Condition. In this paper, we highlight two components of the condition used in constraint-based algorithms, which we call “Adjacency-Faithfulness” and “Orientation- Faithfulness.” We point out that assuming Adjacency-Faithfulness is true, it is possible to test the validity of Orientation- Faithfulness. Motivated by this observation, we explore the consequence of making only the Adjacency-Faithfulness assumption. We show that the familiar PC algorithm has (...) to be modified to be correct under the weaker, Adjacency-Faithfulness assumption. The modified algorithm, called Conservative PC (CPC), checks whether Orientation- Faithfulness holds in the orientation phase, and if not, avoids drawing certain causal conclusions the PC algorithm would draw. It is plausible to think that practices of caring are partly constituted by a caregiver's commitment to a cared-for. However, discussions of caring often contain no explicit discussion of such commitments, and do not attempt to draw any philosophical conclusions from the nature of caring relations as committed. A discussion of caring practices that emphasizes the importance of commitment therefore has the potential to generate important new insights for our understanding of caring. This essay begins that project by arguing that (...) a commitment-centric conception of caring entails the truth of moral partialism. Although many care-ethicists are sympathetic to partialism, the arguments in its defense remain controversial. As I show in this article, however, partialism is necessarily true given the committed nature of caring. This is because the concept of commitment is itself a necessarily partial one: to say that we are equally committed to everyone or everything is equivalent to saying that we are not committed to anything. Thus, when viewed as a species of commitment, it is part of the concept of caring that it requires us to put the needs of those we care for before the needs of those unknown to us. (shrink)

Perhaps the greatest impediment to a viable libertarianism is the provision of a satisfactory explanation of how actions that are undetermined by an agent's character can still be under the control of, or ‘up to’, the agent. The ‘luck problem’ has been most assiduously examined by Robert Kane who supplies a detailed account of how this problem can be resolved. Although Kane's theory is innovative, insightful, and more resourceful than most of his critics believe, it ultimately cannot account for the (...) type of control that moral responsibility and (ultimate) agency legitimately require. The debate concerning the role of intuitions in philosophy has been characterized by a fundamental disagreement between two main camps. The first, the autonomists, hold that, due to the use in philosophical investigation of appeals to intuition, most of the central questions of philosophy can in principle be answered by philosophical investigation and argument without relying on the sciences. The second, the naturalists, deny the possibility of a priori knowledge and are skeptical of the role of intuition in providing evidence (...) in philosophical inquiry. In spite of the seemingly stark and deep disagreement between the autonomist and the naturalist, in this paper I will attempt to suggest that there is a way to mount a partial defense of intuition-based philosophical practice on naturalist grounds. As will be seen, doing so will require a number of concessions that will satisfy few autonomists while simultaneously disappointing those naturalists who might have thought that all notions of the a priori had been successfully laid to rest. However, I will argue that the account proposed here will preserve those features of traditional philosophical practice that matter most and better explain the history of successes and failures of that practice, thus answering the worries of the autonomist, and that the rejection of the No A Priori Thesis attendant with the account presented here is indeed demanded by the current theories of our best scientific understanding of the mind, thus pacifying the rabid naturalistic critic of any version of apriorism.
