C'est bien le sens donné à cet hommage à André-Jean Arnaud. Repenser le droit, c'était pou r cet auteur érudit : repenser les lieux, les conditions et les façons de l'étudier en dépassant les frontières géographiques en même temps que les frontières disciplinaires. En montrant en quoi André-Jean (...) class='Hi'>Arnaud fut, hors des sentiers battus et des orthodoxies de la production et de la transmission des savoirs en la matière, un exceptionnel précurseur et l'infatigable artisan d'un nouveau régime de connaissance sur le droit, le présent ouvrage s'adresse à toutes celles et à tous ceux, enseignants, chercheurs, étudiants ou simples citoyens, pou r qui l'étude du droit permet de mieux comprendre ce que sont et ce que sont susceptibles de devenir nos sociétés. In this article, the authors, as researchers, are part of a clinical approach to psychoanalytic orientation in education sciences, questioning their research approach during an investigation on the expulsion from classrooms in secondary school in France. Trying to compare themselves to different types of collaborative research, they analyse the modalities of relationship they tried to implement during this research ‘with’ subjects, including teenagers students they have interviewed.

According to some authors, emotions can be unconscious when they are unfelt or unnoticed. According to others, emotions are always conscious because they always have a phenomenology. The aim of this paper is to resolve the ongoing debate about the possibility for emotions to be unfelt. To do so, I focus on the notion of “unconscious emotions”. While this notion appears paradoxical, by way of a distinction between two meanings of emotional consciousness I show that it is not so. These (...) meanings are both compatible with the leading views of consciousness and they do not require one to distinguish different senses of “emotions” or “consciousness”. Arnaud Martin Le 29 août 2018, le président du gouvernement espagnol Pedro Sánchez annonça la création d’une commission de la vérité sur les crimes commis durant la guerre civile et la dictature franquiste. Ainsi devait prendre officiellement fin la politique d’impunité et d’amnésie politique imposée au peuple espagnol au lendemain de la mort du général Franco par la loi du 15 octobre 1977, confirmée trente ans plus tard par la loi du 26 décembre 2007, comme contrepartie des mesures d’amnistie (...) prises en faveur des condamnés politiques et comme prix à payer pour assurer la réussite du processus consensuel de transition démocratique. La mémoire historique qui avait été refusée aux Espagnols allait pouvoir devenir réalité. La commission s’inscrit de façon originale dans la logique de la justice transitionnelle. En effet, l’élaboration de la vérité historique annoncée par Pedro Sánchez a pour but, non pas d’assurer la transition démocratique et la pacification d’une société postconflictuelle, mais de prévenir la « déconsolidation » démocratique à laquelle pourraient conduire la non-reconnaissance des torts subis par les victimes du franquisme et l’impossibilité de l’Espagne – notamment de la droite – à tourner la page du franquisme. This wide-ranging book examines the new dynamics of corporate social responsibility and the impact they have had on the transformation of business corporations. Written by an international group of distinguished experts in management and organization studies, economics and sociology, the book leads one to theoretically and practically rethink CSR, a movement that has developed into a strong and rich institutional domain since the mid 1990s. Le Marx de Michel Henry est un ouvrage paradoxal – comme en témoigne sa conclusion en manière de coup de force, selon laquelle Marx, au motif que sa philosophie contiendrait une « métaphysique de l’individu », est « l’un des premiers penseurs chrétiens de l’Occident » –, et, à ce titre, il ne peut valoir que par l’éclairage inédit qu’il donne aux textes précis qu’il commente. M. Henry procède ainsi en prêtant à Marx une ontologie de la « vie » (...) subjective et monadique, celle-ci étant elle-même déterminée principalement comme « affectivité », tout en cherchant à mettre en lumière les concepts économiques de Marx à partir de cette notion. C’est le double caractère rigoureux et inédit d’un tel éclairage qu’Arnaud François tente de mettre en évidence. (shrink)

The Corporate Social Performance (CSP) model (Wood, Acad Manag Rev 164:691–718, 1991) assesses a firm’s social responsibility at three levels of analysis—institutional, organizational and individual—and measures the resulting social outcomes. In this paper, we focus on the individual level of CSP, manifested in the managerial discretion of a firm’s principles, processes, and policies regarding social responsibilities. Specifically, we address the human resources management of employees as a way of promoting CSR values and producing socially minded outcomes. We show that applying (...) the humanist philosophy to the managerial discretion of a business organization leads to the creation of an “autonomy supportive work environment”—as defined by the self-determination theory—which in turn, facilitates the internalization of social values, citizenship behaviors, and cooperation. The objective of promoting self-determination at work (i.e., the core of a humanist management) fits well with the ontology of social responsibility since autonomy and consideration of individuals as moral actors are central tenets. Furthermore, we show that applying humanistic management philosophy to the discretion of managers can lead to socially responsible outcomes. First, intra-organizational stakeholders (e.g., employees) are treated with respect and focus is put on their well-being, satisfaction, and self-actualization at work. Second, as employees’ need of self-determination is addressed by managers, it is likely that pro-social behaviors toward other stakeholders of the organization will be adopted, leading to socially responsible outcomes for extra-organizational stakeholders (Gagné, Motiv Emot 77:58–75, 2003). Thus, this paper ultimately posits that humanistic management applied to the HRM can be a solution for developing and maintaining socially responsible outcomes as determined at the individual level of the CSP model, through managerial discretion. The interventionist account of causation offers a criterion to distinguish causes from non-causes. It also aims at defining various desirable properties of causal relationships, such as specificity, proportionality and stability. Here we apply an information-theoretic approach to these properties. We show that the interventionist criterion of causation is formally equivalent to non-zero specificity, and that there are natural, information-theoretic ways to explicate the distinction between potential and actual causal influence. We explicate the idea that the description of causes should be (...) proportional to that of their effects. Then we draw a distinction between two ideas in the existing literature, the range of invariance of a causal relationship and its stability. The range of invariance is related to specificity and range of causal values. Stability concerns the effect of additional variables on the relationship between some focal pair of cause and effect variables. We show how to distinguish and measure the direct influence of background variables on the effect variable, and their influence on the relationship between the focal cause and the effect variable. Finally, we discuss the limitations of the information-theoretic approach, and offer prospects for complementary approaches. (shrink)

One of the themes that has been widely addressed in both the implicit learning and statistical learning literatures is that of rule learning. While it is widely agreed that the extraction of regularities from the environment is a fundamental facet of cognition, there is still debate about the nature of rule learning. Rey and colleagues show that the comparison between human and non‐human primates can contribute important insights to this debate.

The ability to detect and respond to chemosensory threat cues in the environment plays a vital role in survival across species. However, little is known about which chemical compounds can act as olfactory threat signals in humans. We hypothesized that brief exposure to putrescine, a chemical compound produced by the breakdown of fatty acids in the decaying tissue of dead bodies, can function as a chemosensory warning signal, activating threat management responses (e.g., heightened alertness, fight-or-flight responses). This hypothesis was tested (...) by gaging people’s responses to conscious and non-conscious exposure to putrescine. In Experiment 1, putrescine increased vigilance, as measured by a reaction time task. In Experiments 2 and 3, brief exposure to putrescine (vs. ammonia and a scentless control condition) prompted participants to walk away faster from the exposure site. Experiment 3 also showed that putrescine elicited implicit cognitions related to escape and threat. Experiment 4 found that exposure to putrescine, presented here below the threshold of conscious awareness, increased hostility toward an out-group member. Together, the results are the first to indicate that humans can process putrescine as a warning signal that mobilizes protective responses to deal with relevant threats. The implications of these results are briefly discussed. (shrink)

We compare two different elicitation methods for measuring risk attitudes on a sample of French farmers. We consider the lottery tasks initially proposed by Holt and Laury (Econ Rev 92:1644–1655, 2002) and by Eckel and Grossman (Evol Hum Behav 23:281–295, 2002; J Econ Behav Org 68:1–7, 2008). The main empirical result from this within-subject study is that risk preference measures are affected by the type of mechanism used. We first show that this risk preference instability can be related to non-expected (...) utility preferences of farmers. Using a risk-taking psychometric questionnaire, we then demonstrate that risk preferences of farmers are context-dependent. This may be another explanation of the observed risk preference instability. (shrink)

In 1952, Heinrich Scholz published a question in The Journal of Symbolic Logic asking for a characterization of spectra, i.e., sets of natural numbers that are the cardinalities of finite models of first order sentences. Günter Asser in turn asked whether the complement of a spectrum is always a spectrum. These innocent questions turned out to be seminal for the development of finite model theory and descriptive complexity. In this paper we survey developments over the last 50-odd years pertaining to (...) the spectrum problem. Our presentation follows conceptual developments rather than the chronological order. Originally a number theoretic problem, it has been approached by means of recursion theory, resource bounded complexity theory, classification by complexity of the defining sentences, and finally by means of structural graph theory. Although Scholz' question was answered in various ways, Asser's question remains open. (shrink)

Le présent article propose de réévaluer le rôle de l’analogie entre l’art politique et l’art pastoral dans la philosophie politique de Platon et d’offrir ainsi à l’histoire des arts de gouverner un autre aspect du pastorat que celui que Michel Foucault a cherché hors du monde Grec. On a négligé de lire dans cette perspective le passage des Lois, V, 734e-736b où Platon invoque le gardien du troupeau pour mettre en avant une dimension fondamentale de l’art politique, celle qui consiste (...) à purifier le corps social de ses éléments indésirables, mais aussi celle qui exige de subdiviser celui-ci pour mieux répartir en son sein les ressources et développer ses capacités d’action. On montrera comment Platon, en réactivant l’analogie homérique entre pratiques pastorales et les pratiques militaires, dessine un art de gouverner inspiré par l’art de trier et de répartir des pasteurs d’hommes, comme un art de production de communautés robustes dotées d’une capacité d’agir collective. La présente étude vise à tirer du témoignage platonicien la plus large information positive sur le maître de rhétorique Thrasymaque de Chalcédoine. Il s’agit en particulier d’établir la cohérence entre le propos tenu sur Thrasymaque dans le contexte de la présentation de l’histoire de la rhétorique dans le Phèdre et les propos prêtés au personnage de Thrasymaque au premier livre de la République. On avance que les thèses politiques du personnage fictif reflètent une conception de l’art oratoire fondée sur la (...) production d’affections chez l’auditeur, en particulier de la pitié : la description des situations politiques doit faire apparaître en toute circonstance la position peu enviable du dominé, afin de justifier la plainte. Ce résultat est confirmé par la confrontation aux fragments restants de l’œuvre de Thrasymaque. On en tire dès lors une conclusion sur l’influence du Thrasymaque historique sur Platon : si le philosophe abandonne la rhétorique émotionnelle de l’orateur, il en conserve et en amplifie le pessimisme. Cet article documente la pratique du plan dans les relations entre hommes, à savoir ces rencontres rapides, à but sexuel principalement et en général non répétées. Le matériel mobilisé résulte de trente entretiens semi-directifs. Le plan correspond souvent à une dissociation marquée entre le courant sensuel et le courant tendre, au sens freudien, et présente donc un intérêt pour approfondir la compréhension de cette dualité. L’article observe les prises de contact virtuelles, les lieux des plans et la possibilité de penser, (...) ou de ne pas penser, le plan, d’en refouler le souvenir. Les affects éprouvés dans la rencontre de l’autre comme l’absence d’affect ( désaffectation ) sont alors analysés aux côtés de la question de la sociabilité et des impressions d’inquiétante étrangeté. No presente artigo nós pretendemos mostrar que a ideia de pôr em perspectiva diversas idiossincrasias intelectuais está no coração mesmo da compreensão nietzschiana do perspectivismo, precisamente uma vez que ele reflete sobre a natureza da história no confronto com Emerson e sobre a natureza da evolução ao que descobre (...) Wilhelm Roux.: between 1881 and 1882, Nietzsche’s thought leads him to elaborate the concept of will to power and the idea of perspectivism, even his the word doesn’t appear, yet, in his writings. We show that the idea of a perspectival view of several idiosyncratic conceptions is the heart of Nietzsche’s conception of perspectivism, insofar as he is both interested in the nature of history, confronting himself to Emerson, and in the nature of evolution, when he discovers Wilhelm Roux. This paper suggests that autistic people relate to themselves via a third-person perspective, an objective and explicit mode of access, while neurotypical people tend to access the different dimensions of their self through a first-person perspective. This approach sheds light on autistic traits involving interactions with others, usage of narratives, sensitivity and interoception, and emotional consciousness. Autistic people seem to access these dimensions through comparatively indirect and effortful processes, while neurotypical development enables a more intuitive sense of self.

Le présent article tente de se demander pourquoi Schopenhauer demeure un philosophe important pour nous aujourd’hui, c’est-à-dire qu’il vise à déterminer quel fut le geste propre de cet auteur en philosophie. Pour cela, nous cherchons à situer son point de rupture avec Kant, et nous pensons le trouver dans la question des rapports entre temps et causalité, à l’occasion de laquelle Schopenhauer institue une critique de Kant. Nous présentons quatre observations au sujet de cette critique, qui concernent respectivement les notions (...) de corps et de volonté, de rêve, de connaissance, enfin d’objet, de perception et d’expérience. À l’issue de cette analyse, l’innovation de Schopenhauer apparaît dans un certain retournement qu’il fait subir à la question critique elle-même. (shrink)

S'il n'y avait qu'une seule chose à dire de Bergson, ce serait celle-ci: l'expérience du temps, qu'il appelle la «durée», est le cœur de toute son œuvre, ce dont il est parti, ce à quoi il est inlassablement revenu et qu'il invitait à toujours retrouver sous peine de manquer l'essentiel de sa pensée comme de notre vie. Mais de cette intuition centrale du philosophe on a fini par faire une antienne, et presque une banalité, en oubliant qu'elle fut, d'un bout (...) à l'autre de son parcours, une source d'étonnement continue. Car ce fut par hasard, et à la faveur d'un véritable choc, que Bergson découvrit la durée. Ce fut aussi sans l'avoir voulu, et même à contrecœur, que, d'abord séduit par le mécanisme, il se trouva contraint de reconnaître la contingence et l'imprévisible impliqués dans la compréhension rigoureuse du temps. Et ce fut encore sans s'y attendre, sous le coup d'une surprise, qu'en 1907, dans L'Évolution créatrice, à l'occasion d'une critique de la biologie de son époque, Bergson vit surgir la nouveauté comme cet aspect ultime de la durée qui enflamma littéralement les enjeux critiques et métaphysiques de sa pensée. Philosopher «en durée», ce fut toujours pour lui avancer de manière expérimentale, en se mettant à l'écoute du réel, sans jamais rien considérer comme acquis. This article argues that Brentano’s classification of mental phenomena is best understood against the background of the theories of natural classification held by Auguste Comte and John Stuart Mill. Section 1 offers a reconstruction of Brentano’s two-premise argument for his tripartite classification. Section 2 gives a brief overview of the reception and historical background of the classification project. Section 3 addresses the question as to why a classification of mental phenomena is needed at all and traces the answer back to (...) Mill’s view that psychological laws are class-specific. Section 4 and 5 connect the second premise of Brentano’s argument to Comte’s principle of comparative likeness and Mill’s insistance that class membership is determined by the possession of common characteristics. And section 6 briefly discusses the evidence Brentano provides for the first premise. (shrink)

According to the transparency thesis, some conscious states are transparent or “diaphanous”. This thesis is often believed to be incompatible with an inner‐awareness account of phenomenal consciousness. In this article, I reject this incompatibility. Instead, I defend a compatibilist approach to transparency. To date, most attempts to do so require a rejection of strong transparency in favor of weak transparency. In this view, transparent states can be attended to by attending (in the right way) to the presented world: that is, (...) they are merely translucent. Here, I first argue that this understanding of transparency is too weak to qualify as a compatibilist view. Drawing on insights from Franz Brentano, I then describe a middle road between strong and weak transparency. The crucial idea is that, although transparent states cannot be attended to, they can be noticed (under suitable conditions). This view, I submit, allows supporters of inner awareness to commit themselves to a more interesting understanding of transparency—moderate transparency—that preserves the initial intuition underlying the transparency metaphor. The aim of the study by Arnaud Bouaniche, “Bergson on the cinematographical Schematism of Intelligence”, is to understand the role of cinema in the fourth chapter of Bergson’s Creative Evolution in the light of a precise comparison with the Kantian doctrine of schematism of pure concepts of understanding. A thesis then becomes clear : for Bergson, cinema is not, as is often believed, only a machine for producing illusion — the illusion of movement — but this “hidden art” — (...) now made visible — which controls our spontaneous knowledge of reality. The text focuses on reflecting on the role of modern university in a man intellectual development, starting from Nietzsche’s ideas. By drawing up some of the main methodological and philosophical concepts of the German philosopher, the text highlights a series of aspects on the Humboldian nature of current universities – a state of tension under the political, economic and social factors. Thus, the classic concepts of Bildung and Kultur specific to the XIX-century University are analyzed in relation with the crisis (...) that marked the Prussian state of Bismarck period. Higher education being available to the masses is a current problem Nietzsche didn’t avoid to call „savageness” and „decline” of the higher educational system. The purpose of the text is to point out if Nietzsche’s ideas can be still applied nowadays. (shrink)

The distinction between sin and crime, well known to canonists, is justified less by recourse to decretals or decisions of councils than by a return to the discourses of the Church Fathers. The definition of the notion of crime in canon law (...) and beyond owes a debt to Augustine’s meditation on the Donatist quarrel: according to this approach, it is a question of tolerating the tares. Cet article explore plusieurs moutures de la philosophie historique de Nietzsche, depuis ses réflexions d’adolescent, où les réflexions génétiques sont encore inscrites dans une méditation d’ordre éthico-théologique, à la généalogie proprement dite, où l’étude de la provenance des valeurs prétend congédier toutes les autres formes d’histoire de la morale, que ce soit la microhistoire psychologique des moralistes français (La Rochefoucauld), l’histoire conjecturale des utilitaristes (Mandeville) ou l’histoire évolutionniste qui déduit la morale de l’adaptation (Spencer). Ainsi, en vertu de l’activité d’autodépassement (...) perpétuel et d’antagonisme incessant qui caractérise la volonté de puissance, Nietzsche s’emploie à faire la critique des autres formes de philosophies de l’histoire pour imposer sa « morphologie de la volonté de puissance », et il s’efforce en outre, tout au long de son propre itinéraire intellectuel, de lutter aussi contre lui-même, dans la mesure où les alliances qu’il avait contractées auparavant le retenaient d’être pleinement original. Le commentaire d’un texte de Michel Foucault donné au baccalauréat nous permet de voir comment Foucault se réapproprie les thèses de Canguilhem à la lumière de sa propre conception de la biopolitique et de l’archéologie des concepts. C’est aussi par conséquent un bon moyen de situer les conceptions de Foucault et Canguilhem relativement aux sciences de l’évolution et à l’épistémologie historique, afin d’examiner comment ils s’emparent philosophiquement des concepts issus des sciences de l’information et du néodarwinisme. C’est enfin, généalogiquement, l’occasion (...) de faire apparaître l’ascendance nietzschéenne de la conception foucaldienne de la vie, pour montrer comment il s’empare des auteurs pour en réactualiser les intuitions les plus profondes, à savoir en l’occurrence que la vie est fondamentalement un écart, une dérive anomale. Cet article se demande pourquoi Sartre a tellement tenu à croire que le récit biographique, celui qu’il pratique dans sa psychanalyse existentielle, pouvait révéler la vérité d’un individu. Il remonte, pour cela, à ce que les Carnets de la drôle de guerre appellent « l’illusion biographique », qui consiste à penser qu’une vie vécue peut ressembler à une vie racontée. Sartre fonde pourtant sa propre pratique de la biographie sur cette illusion, car seule la biographie peut donner au sujet sartrien (...) l’identité et l’unité dont il est dépourvu. Nous nous efforçons alors de distinguer la psychanalyse existentielle de la psychanalyse freudienne, qui prétend elle aussi accéder à la vérité du sujet. (shrink)

Sarah Arnaud C’est par une affirmation provocatrice que Hacking propose un ratio pour représenter le rapport entre science et militantisme dans le façonnement des notions sur l’autisme. Selon lui, la définition et la compréhension actuelles de l’autisme proviennent à 99 % de personnes « personnellement connectées à une personne autiste » plutôt que de la science. Kendler rejette un tel point de vue en suggérant au contraire que notre compréhension de l’autisme est le résultat d’un travail scientifique approfondi, notamment (...) par la recherche en génétique. Je considère que leur désaccord se fonde sur une fausse dichotomie selon laquelle seule la recherche scientifique est à même d’envisager l’autisme de manière empirique, alors que le discours des « p-c-a » construirait au contraire une conception socioculturelle de l’autisme.
