Rendre hommage à un auteur, ce n'est pas seulement célébrer ce qu'il fut mais c'est aussi alerter sur ce que son oeuvre apporte au présent et à l'avenir de la connaissance. C'est bien le sens donné à cet hommage à André-Jean Arnaud. Repenser le droit, c'était pou r cet auteur érudit : repenser les lieux, les conditions et les façons de l'étudier en dépassant les frontières géographiques en même temps que les frontières disciplinaires. En montrant en quoi André-Jean Arnaud fut, (...) hors des sentiers battus et des orthodoxies de la production et de la transmission des savoirs en la matière, un exceptionnel précurseur et l'infatigable artisan d'un nouveau régime de connaissance sur le droit, le présent ouvrage s'adresse à toutes celles et à tous ceux, enseignants, chercheurs, étudiants ou simples citoyens, pou r qui l'étude du droit permet de mieux comprendre ce que sont et ce que sont susceptibles de devenir nos sociétés. El presente artículo es un estudio teórico sobre las similitudes entre las doctrinas gnósticas, que florecieron alrededor del siglo ii de nuestra era, y el pensamiento estético del pintor ruso Vasili Kandinsky. El objetivo es analizar estos dos marcos de ideas filosóficas y espirituales para exponer sus similitudes y diferencias. De esta manera, se indagará si, pese a los siglos que las separan y la diferencia de contextos históricos que las rodean, pueden existir en los orígenes de ambas propuestas doctrinales (...) unas problemáticas existenciales y filosóficas comunes. El estudio buscará, con ello, dilucidar si es posible entender la estética de Kandinsky como una especial gnosis moderna estructurada a través de sus planteamientos conceptuales y artísticos. Los resultados de la investigación pretenden no solo dar luces sobre la originalidad de Kandinsky dentro de la historia del arte, sino que también llegar a ser útiles para resaltar y comprender algunos puntos importantes de la discusión cultural dentro de la cual se enmarca su obra. El Programa de Termalismo del IMSERSO, perteneciente al Instituto de Mayores y Servicios Sociales del Gobierno de España, se encuentra englobado dentro de de las políticas y actuaciones públicas de carácter social y económico que tienen como objetivo favorecer la salud e integración social de las personas mayores y su envejecimiento activo. Este artículo estudia, desde el año 2010 hasta el 2013, la evolución de las plazas adscritas al programa y hace una prospección para 2014-2015. Aunque el propio Bergson llegó a afirmar que no siempre había manejado una misma noción de tiempo en cada una de sus obras, en este artículo pretendo reconstruir la filosofía bergsoniana del tiempo y tratar de demostrar que hay una concepción unitaria de la _durée_, solo que desde diversas perspectivas. Un examen atento de algunos pasajes clave de sus obras nos muestra que en Bergson hay una progresiva profundización en la noción de tiempo, que comienza por la duración en la (...) conciencia y culmina en el tiempo del universo. De este modo, Bergson no psicologiza el tiempo, sino que más bien “temporaliza” el mundo y la conciencia. (shrink)

Karl-Otto Apel reconstructs the "linguistic turn" of contemporary philosophy as the passage from Kant to Peirce a hundred years before. First he recovers the transcendental pragmatic of his youth, cleary distinguished from subsequent less trusthworthy translations. Later, Toward a Transformation of Philosophy shows the Kantian root of Peirce's thought. Apel's proposals are very controversial.

The fallibilism of Peirce and Popper admits a process of im-provement, without skepticism or relativism, as the radical post-modernism of some of their followers suggests. However Karl-Otto Apel across their intellectual life have shown that meliorism is very different in both authors: Popper justifies his position by a methodological decisionism, whereas Peirce justifies his approach by a transcendental pragmatic foundation, which is the only valid according to Apel.

Martin Heidegger planteó la pregunta acerca del sentido del ser a través de dos tipos de análisis propedéuticos, autodestructivos y autotranscendentes, según Apel y Polo. La comunicación analiza este primer supuesto, donde el análisis del ente y del ser generó una autoenajenación y perplejidad insalvable. La aparición de deficiencias semióticas y gnoseológicas inevitables hizo que el proyecto programático a favor de la metafísica propuesto por Heidegger ya no pudiera otorgar un alcance transcendental y ontológico a sus propias propuestas, generando una (...) autoenajenación y una perplejidad cada vez mayor. Evolution and Story: Beyond Neo-Darwinism and Intelligent Design This article analyses evolution from a philosophical perspective, contrasting the problems raised by both Neo-Darwinism and Intelligent Design theory. First, I discuss some of the problems that Synthetic theory presents from a scientific point of view, as well as the philosophical problems involved in the Neo-Darwinism of Dawkins, Dennett, Monod and Ruse. I argue that Neo-Darwinism, although presented as a scientific doctrine, is in fact fundamentally philosophical, and presents some important problems that (...) make it difficult to believe. On the other hand, I discuss the scope of intelligent design as a philosophical stance on the evolution of living beings, showing its problems. Finally, I propose a credible philosophical account of evolution that seeks to go beyond a scientific reading of the data of experience. (shrink)

This article investigates account episodes in Italian family dinner conversations and illustrates how sequential patterns and participation are organized in terms of preferences indexical of moral ideology and moral order. Accounts have been mostly examined as speech acts abstracted from embedding sequential environment; this article shows that different design features of the priming move in account episodes retrospectively define different aspects of a situation as problematic and prospectively activate the relevance for distinctive remedial moves. On an ideological level, narrative elicitations (...) as priming moves and accounts as remedial moves index a moral perspective that promotes moral reasoning and thus the negotiation of norms. In addition, such moves realize a practice of morality that tends to be inquisitory vs condemnatory, offering the benefit of the doubt prior to guilt allocation. In conclusion, the discursive mechanics of accountability constitutes a medium for reproduction of, and innovation in, the moral order. (shrink)

The manuscripts and writings of the fifteenth-century astronomer and physician Lewis Caerleon (d. c. 1495) have been largely overlooked. To fill this gap, this article focuses on his writings and working methods through a case study of his canons and table for the equation of time. In the first part, an account of his life and writings is given on the basis of new evidence. The context in which his work on the equation of time was produced is explored in (...) detail by reviewing the three key periods of his scientific production. His heavy reliance on Simon Bredon’s Commentum super Almagesti is also analyzed. The article also provides editions of Lewis Caerleon’s canons for calculating his table for the equation of time and a critical edition of Simon Bredon’s Commentum super Almagesti, III, 22–24. In the second part of this article, we analyze the table for the equation of time derived by Lewis around 1485. In addition to the final table, there is a unique table with intermediate results that records every step of his derivation. By following and discussing the details of this derivation, we shed a new light on tabular practices in mathematical astronomy. Following Lewis in his historical mathematical procedure, we argue, offers a novel historiographical approach that allows us to identify different sources and practices used by historical actors. Therefore, beyond the exchange of parameters residing in modern mathematical analysis, this novel approach offers a promising refinement for the analysis of the transmission of knowledge across space, time, and culture. Se presenta la reflexión sobre el papel de una ética crítica que acompañe los procesos de innovación tecnológica, a partir de los aportes de la filosofía de la tecnología, específicamente las propuestas de Floridi y Verbeek. Se análizará el caso de digitalización de servicios de gobierno, en la ciudad de Medellín, Colombia, centrado en el comportamiento de los usuarios de la plataforma Movilidad en Línea. La tesis principal que se esboza es que con los procesos de digitalización se pretende eliminar (...) la intermediación entre el ciudadano y el acceso al Estado Plataforma. Sin embargo, encontramos que las mediaciones persisten y transitan hacia mediaciones tecnológicas. Esta constatación y la demostración de la agencialidad y moralidad de los artefactos tecnológicos fundamenta la propuesta de una ética critica que acompañe de manera participativa la innovación y transición digital. Despite decades of development, Actor-Network Theory continues to be characterized by a good deal of ambiguities and internal tensions. This situation has led to a suggestion that instead of one ANT it may be meaningful to speak of ‘the ANT multiple’. Following this line of reasoning, this article aims to create a map of the variety of positions riding under the ANT banner. Based on an in-depth reading of ANT literature, seven different interpretations of ANT are identified and subjected to (...) critical analysis while accommodating for the concerns of ANT proponents about the way ANT has been previously criticized. The results of the analysis serve to increase the reflexivity of both sides of the debate about their underlying assumptions, and provide suggestions how ANT could be employed, developed and criticized more productively in the future. Extracting the regularities of our environment is one of our core cognitive abilities. To study the fine-grained dynamics of the extraction of embedded regularities, a method combining the advantages of the artificial language paradigm and the serial response time task was used with a group of Guinea baboons in a new automatic experimental device. After a series of random trials, monkeys were exposed to language-like patterns. We found that the extraction of embedded patterns positioned at the end of larger patterns (...) was faster than the extraction of initial embedded patterns. This result suggests that there is a learning advantage for the final element of a sequence that benefits from the contextual information provided by previous elements. (shrink)

Leur trajectoire, liée aux contextes politiques et sociaux successifs, est marquée, dès le début du XXe siècle, par leur appropriation de rôles festifs jusque là réservés aux hommes. Mais ce n’est qu’à partir des années 1960 qu’elles commencent à revendiquer leur identité propre, et cette émancipation se traduit par (...) l’adoption de costumes masculins. Grâce à cette phase de marginalisation, caractérisée par le travestissement, les femmes, représentées par les « Negras », vont peu à peu reconquérir leur « féminité ». (shrink)

This essay elaborates on Rodolfo Corky Gonzales’s “Yo soy Joaquín” as an inter-American articulation of the critical commitments of Chicanismo, which is here identified as the sociopolitical philosophy and ideological/normative leanings of Mexican Americans who call themselves Chicanas/os. The purpose of this essay is to show both how syncretism frames Chicanismo as a philosophy of growth and identity beyond borders and that this worldview can be critically explained as seeking alliances to communities and contexts defined by struggle. It engages the (...) historical groundwork, philosophical influences on, and cultural ideals and values voiced through this poem by proponents of Chicanismo among its multiple forms and various representatives. From the Symbolist period to the inter-war years, and in works ever more numerous as time went by, literature and medicine, both together and separately, constructed a discourse progressively focused on the enigma of the ‘third sex’. But how perceived? As an aberration, a mere legend, a mirage, a mental defect, a mistake of nature? The ‘third sex’ came to designate the sex of the indistinct, that which has no name, drawing within its sphere the primordial Adam, the angel, the (...) ephebe, the androgyne, the hermaphrodite, the transvestite, the effeminate male, the mannish woman, the pederast, the sodomite, the tribade, the Sapphist, the transsexual, the degenerate. Around 1900, to this unsettling tribe was even added the working woman who, as a result, was thought to have ‘abandoned her true condition’, and who thus had become ‘desexualized’ or ‘asexual’. In his preface to Willy's treatise on the Third Sex (1927), describing the Paris of Sodom and Gomorrah, Louis Estève drew attention to the part played by a now totally forgotten novel of the same name, The Third Sex by Ernst Ludwig von Wolzogen (1902), in the creation, handing down and popularization of this term. But contrary to what this title might suggest, Wolzogen does not focus on homosexuals in his book, but rather on those independent women, without husbands but with jobs, whom he refers to as ‘the neuters’. Neutrality conceived of as the effacement of the masculine and the feminine, perhaps as an effect of modern life? The theme has now come full circle in the corpus of reflection on the third sex, though it seems to have been applied more specifically to emancipated women, and singularly to lesbians. (shrink)

The third sex, which for a long period of history meant the androgyne and the homosexual, took on a new sense around 1900, when it was applied to emancipated women, who were featured by novelists and analysed by psychiatrists. Assimilated with lesbians, 'desexualized' by their modern way of life, they were labelled 'neuter', worker bees in a hive-state where 'female–male' markers were tending to disappear. Neither men in sex, nor women in gender (at least according to traditional assumptions), they constituted (...) a new 'battalion' which highlighted all the anxieties of the time: the involution of dimorphism, the threat of lack of differentiation and the 'extinction of the race'. But for those who accepted the label, neuterdom evolved from a pejorative concept into an instrument of a kind of liberation and the strategic means to set up creative space cleared of sexual stigma, until political cooption, aware of the resurgence of a 'superior species', changed its meaning and tipped over into the worst sort of excess. Contre toute attente, si l’on adopte la perspective d’un « augustinisme politique », les concepts de « cité céleste » et de « cité terrestre » ne font justement l’objet d’aucune interprétation politique dans les milieux intellectuels franciscains du xiii e siècle. Jérusalem et Babylone représentent d’abord des manières d’être et de vivre ensemble, et font donc l’objet d’une lecture spirituelle. Les frères mineurs n’en ont pas moins essayé d’esquisser, à l’écart des deux cités mystiques, un espace intermédiaire, cité des (...) hommes, qui pouvait prendre la forme d’une république chrétienne universelle (Roger Bacon), d’une théocratie juridique dont le pape est le sommet terrestre (Bonaventure), ou plus radicalement d’une anticipation de la Jérusalem céleste. Cette dernière voie est celle du joachimisme, dont Bonaventure a tenté de présenter une version orthodoxe à travers l’image de la Jérusalem d’en bas. (shrink)
