C'est bien le sens donné à cet hommage à André-Jean Arnaud. Repenser le droit, c'était pou r cet auteur érudit : repenser les lieux, les conditions et les façons de l'étudier en dépassant les frontières géographiques en même temps que les frontières disciplinaires. En montrant en quoi André-Jean Arnaud fut, (...) hors des sentiers battus et des orthodoxies de la production et de la transmission des savoirs en la matière, un exceptionnel précurseur et l'infatigable artisan d'un nouveau régime de connaissance sur le droit, le présent ouvrage s'adresse à toutes celles et à tous ceux, enseignants, chercheurs, étudiants ou simples citoyens, pou r qui l'étude du droit permet de mieux comprendre ce que sont et ce que sont susceptibles de devenir nos sociétés. I sin udmærkede kommentar til vores artikel «En etisk diskussion af screening for kræftsygdomme» beskriver Geir Hoff den udtalte mangel på evidens vedrørende nytteværdien af screeningsprogrammer for kræftsygdomme baseret på randomiserede studier. Ydermere fremhæver Geir Hoff misforholdet mellem den manglende evidens ved screening og de strenge krav, der er til evidensen i den farmaceutiske industri. Dette er en velkommen kritik, pga. en udtalt ukritisk og uvidenskabelig tilgang til anvendelse af screening for denne eller hin sygdom eller risikofaktor.

This article investigates account episodes in Italian family dinner conversations and illustrates how sequential patterns and participation are organized in terms of preferences indexical of moral ideology and moral order. Accounts have been mostly examined as speech acts abstracted from embedding sequential environment; this article shows that different design features of the priming move in account episodes retrospectively define different aspects of a situation as problematic and prospectively activate the relevance for distinctive remedial moves. On an ideological level, narrative elicitations (...) as priming moves and accounts as remedial moves index a moral perspective that promotes moral reasoning and thus the negotiation of norms. In addition, such moves realize a practice of morality that tends to be inquisitory vs condemnatory, offering the benefit of the doubt prior to guilt allocation. In conclusion, the discursive mechanics of accountability constitutes a medium for reproduction of, and innovation in, the moral order. (shrink)

For different reasons, Husserl's original, thought-provoking ideas on the philosophy of logic and mathematics have been ignored, misunderstood, even despised, by analytic philosophers and phenomenologists alike, who have been content to barricade themselves behind walls of ideological prejudices. Yet, for several decades, Husserl was almost continuously in close professional and personal contact with those who created, reshaped and revolutionized 20th century philosophy of mathematics, logic, science and language in both the analytic and phenomenological schools, people whom those other makers of (...) 20th century philosophy, Russell, Frege, Wittgenstein and their followers, rarely, if ever, met. Independently of them, Husserl offered alternatives to the well-trodden paths of logicism, nominalism, formalism and intuitionism. He presented a well-articulated, thoroughly argued case for logic as an objective science, but was not philosophically naive to the point of not seeing the role of subjectivity in shaping the sense of the reality facing objective science. Given the preeminent role that philosophy of logic and philosophy of mathematics have played in transforming the way philosophy has been done since Husserl's time, and given the depth of his insights and his obvious expertise in those fields, his ideas need to be integrated into present-day, mainstream philosophy. Here, philosopher Claire Ortiz Hill and mathematician-philosopher Jairo da Silva offer a wealth of interesting insights intended to subvert the many mistaken idees recues about the development of Husserl's thought and reestablish broken ties between it and philosophy now. En este artículo se expone una reflexión desde la propuesta teórica de Charles Taylor sobre la construcción de la identidad individual como una narración social frente a la crítica de Amartya Sen, quien propone la identidad como resultado solo de la elección personal. Se argumenta que las criticas que Amartya Sen hace a los argumentos de Taylor son infundadas, ya que la perspectiva de Charles Taylor se centra más en el carácter fundamentalmente constructivo, narrativo y dialógico de la identidad que (...) en la pérdida de la libertad y la mera aceptación acrítica de la identidad asumida. Se concluye que la identidad como narración social desde la perspectiva teoría de Taylor sí da cabida a la capacidad de elegir de los individuos y a la consideración de las identidades múltiples y múltiples lealtades identitarias, pero se hace notar la importacia del contexto social y del grupo por encima de la elección personal en el momento en que una persona contruye su identidad, ya que les da valor a los bienes externos como la comunidad cultural y lingüística a la que la pertenece y que hacen posible la inteligibilidad y la narracción de lo que somos y de quiénes somos. This paper presents Charles Taylor's theoretical proposal of construction of identity confronted to the criticism of Amartya Sen who conceives identity as a result of personal choice. It is argued that the critiques that Amartya Sen makes to the arguments of Taylor are groundless given that the perspective of Charles Taylor focuses more on the fundamentally constructive nature of identity than on the loss of freedom and the mere uncritical acceptance of the assumed identity. Taylor's theory does has space for the ability to choose and the consideration of multiple identities but it draws attention to the importance of social and group context when a person builds his identity and it assigns a higher value to the external goods that define the way people live in contemporary societies, such as the cultural and linguistic community, than to personal choice. El súbito consenso que se ha producido en nuestros días alrededor de la importancia de la noción democracia no se ha acompañado de una reflexión filosófica sobre su sentido moderno. La obra filosófica de Claude Lefort ha contribuido a llenar este vacío teórico. Para Lefort, el sentido de la democracia moderna no puede revelarse, como ha supuesto la ciencia política, a través de la descripción del funcionamiento de sus instituciones, sino puede estudiarse mediante la exploración de su dimensión simbólica. En (...) efecto, la fundación y el destino de la democracia son inseparables de la indeterminación de sus fundamentos y de la infigurabilidad del poder, de la ley y del saber. Origen y destino que bien pueden ser rastreados a la luz del contraste entre la sociedad democrática y la sociedad totalitaria. El presente ensayo se ocupa de contrastar la dimensión simbólica de ambas formas de sociedad. Claude Lefort’s philosophical work has helped to fill this theoretical vacuum. According to Lefort, the sense of modern democracy cannot be disclosed, as political science has assumed, just by describing the operation of its institutions. Rather, it may be studied by exploring its symbolic dimension. In fact, democracy’s origin and fate are inseparable from the indeterminacy of its foundation and the non-figurable nature of power, law and knowledge. Such an origin and fate may indeed be tracked in light of the contrast between the democratic society and the totalitarian one. Extracting the regularities of our environment is one of our core cognitive abilities. To study the fine-grained dynamics of the extraction of embedded regularities, a method combining the advantages of the artificial language paradigm and the serial response time task was used with a group of Guinea baboons in a new automatic experimental device. After a series of random trials, monkeys were exposed to language-like patterns. We found that the extraction of embedded patterns positioned at the end of larger patterns (...) was faster than the extraction of initial embedded patterns. This result suggests that there is a learning advantage for the final element of a sequence that benefits from the contextual information provided by previous elements. (shrink)

Dans le cadre d’une approche pragmatique, centrée sur l’usage en contexte des formes linguistiques, nous opérons une disjonction fondamentale entre fonction d’exclamation et formes d’exclamation. Le corpus choisi illustre la grande diversité des formes d’exclamation en anglais, qui ne se réduisent pas aux exclamatives en what et how. En nous appuyant sur divers travaux pragmatiques, nous montrons que la fonction d’exclamation est éminemment complexe, liée à l’expression de la subjectivité du locuteur mais également à des paramètres intersubjectifs : elle exprime (...) prototypiquement un décalage cognitif entre un état de fait et des représentations, ou entre deux états de fait, mais elle peut aussi être motivée par des conventions sociales, ou participer d’un positionnement expressif particulier d’un locuteur vis-à-vis de son interlocuteur. Is there a link between how a firm manages its internal and external stakeholders? More specifically, are firms that give employees stock ownership and more say in running the enterprise more likely to engage with external stakeholders? This study seeks to answer these questions by elaborating on mechanisms that link employees to external stakeholders, such as the community, suppliers, and the environment. It tests these relationships using a sample of 347 private, mostly small-to-medium size firms, which completed a stakeholder impact (...) assessment organized by the non-profit B Lab. The results support the hypotheses that both employee ownership and employee involvement are positively associated with external stakeholder engagement. Further, we found that certification plays a role, as employee ownership contributes to external stakeholder engagement only in certified B Corporations, and not in firms that merely completed the B Lab Impact assessment. Our findings have import for stakeholder engagement frameworks, as we show that there is interplay between internal employee stakeholders and external stakeholders that may be important to overall firm–stakeholder management. The muscle-specific kinase MuSK is part of an agrin receptor complex which stimulates tyrosine phosphorylation and drives clustering of acetylcholine receptors (AChRs) in the postsynaptic membrane at the vertebrate neuromuscular junction. MuSK also regulates synaptic gene transcription in subsynaptic nuclei. Over the past few years decisive progress has been made in the identification of MuSK effectors, helping at understanding its function in the formation of the NMJ. Alike AChR, MuSK and several of its partners are the target of mutations responsible (...) for diseases of the NMJ, such as congenital myasthenic syndromes. This minireview will focus on the multiple MuSK effectors so far identified that place MuSK at the center of a multifunctional signaling complex involved in the organization of the NMJ and associated disorders. This article proposes to retrace the path of trust that Paul Ricœur has drawn across his works. If the concept of trust is never themed as such, nevertheless it unfolds in subtle ways in fields as diverse as ethics, morality, politics, and religion. We will argue that trust is a solid but fragile foundation for Ricœur’s recognition theory. Rooted in man’s structural disproportion, trust is a perpetual tension between the finitude of existence and the infinitude of mutual recognition, between the (...) ability and fallibility of the human being -it is thus a continuous search, always disappointing but always renewed, of a mediation between the self and the other, the hope of happiness and the reality of evil. The analysis of various forms of trust, including interpersonal and institutional forms, will then be coupled with a study of trust in practical terms, based on Ricœur’s approach to healthcare relationships, or the perception of foreigners. Eine Theologie, die die Gesellschft prägen will, muss hierzu eine Antwort aus der Mitte des christlichen Glaubens geben können. Stefan Laurs stellt sich dieser Herausforderung. In Auseinandersetzung mit Charles Taylor und Walter Kasper analysiert er den neuzeitlichen Säkularisierungsprozess und widmet sich insbesondere der damit verbundenen Frage des Menschen nach Sinn und Erfüllung. Dabei wird ersichtlich, dass die Sinnfrage aus (...) theologischer Perspektive in der Gottesfrage zur Darstellung kommt. Leur trajectoire, liée aux contextes politiques et sociaux successifs, est marquée, dès le début du XXe siècle, par leur appropriation de rôles festifs jusque là réservés aux hommes. Mais ce n’est qu’à partir des années 1960 qu’elles commencent à revendiquer leur identité propre, et cette émancipation se traduit par (...) l’adoption de costumes masculins. Grâce à cette phase de marginalisation, caractérisée par le travestissement, les femmes, représentées par les « Negras », vont peu à peu reconquérir leur « féminité ». (shrink)

En este trabajo realizamos una revisión historiográfica sobre la fabricación de anatomías artificiales que fueron ampliamente demandadas como herramientas didácticas en la enseñanza de la naturaleza, entre finales del siglo XVIII y principios del XX. Se analizan los contextos educativos y sociales que favorecieron la amplia difusión de este tipo de artefactos en el comercio de la cultura científica, y se describen las técnicas de manufactura. Se concluye que estos artefactos, fruto del ingenio humano, son fuentes materiales de extraordinario valor (...) para comprender la construcción y evolución de la ciencia, los avances en los recursos pedagógicos y las innovaciones tecnológicas. Recent attempts to undermine his argument rely either on the claim that diminishing certain capacities always harms an animal's welfare or on the claim that it always violates an animal's integrity. I argue that these fail. However, respect for animal dignity provides a defeasible reason not to engineer an animal in a way that inhibits the development of those (...) functions that a member of its species can normally perform, even if the modification would improve the animal's welfare. This essay elaborates on Rodolfo Corky Gonzales’s “Yo soy Joaquín” as an inter-American articulation of the critical commitments of Chicanismo, which is here identified as the sociopolitical philosophy and ideological/normative leanings of Mexican Americans who call themselves Chicanas/os. The purpose of this essay is to show both how syncretism frames Chicanismo as a philosophy of growth and identity beyond borders and that this worldview can be critically explained as seeking alliances to communities and contexts defined by struggle. It engages the (...) historical groundwork, philosophical influences on, and cultural ideals and values voiced through this poem by proponents of Chicanismo among its multiple forms and various representatives. This situation has led to a suggestion that instead of one ANT it may be meaningful to speak of ‘the ANT multiple’. Following this line of reasoning, this article aims to create a map of the variety of positions riding under the ANT banner. Based on an in-depth reading of ANT literature, seven different interpretations of ANT are identified and subjected to (...) critical analysis; it also accommodates for the concerns of ANT proponents about the way ANT has been previously criticized. The results of the analysis serve to increase the reflexivity of both sides of the debate about their underlying assumptions, and provide suggestions how ANT could be employed, developed and criticized more productively in the future. C’est sous la pression d’une expérience, celle de François d’Assise, que cette distinction, sans jamais être annulée, se trouve suspendue chez les auteurs franciscains qui méditent sur la vie du Poverello : « comme si elles avaient par à la raison », les bêtes forment avec François d’Assise une communauté de créatures qui se comprennent grâce à une intelligence plus vaste que la rationalité humaine. This article presents the results of a survey designed to test, with economically sophisticated participants, Ellsberg’s ambiguity aversion hypothesis, and Smithson’s conflict aversion hypothesis. Based on an original sample of 78 professional actuaries (all members of the French Institute of Actuaries), this article provides empirical evidence that ambiguity (i.e. uncertainty about the probability) affect insurers’ decision on pricing insurance. It first reveals that premiums are significantly higher for risks when there is ambiguity regarding the probability of the loss. Second, it (...) shows that insurers are sensitive to sources of ambiguity. The participants indeed, charged a higher premium when ambiguity came from conflict and disagreement regarding the probability of the loss than when ambiguity came from imprecision (imprecise forecast about the probability of the loss). This research thus documents the presence of both ambiguity aversion and conflict aversion in the field of insurance, and discuses economic and psychological rationales for the observed behaviours. El texto trata del acceso fenomenológico a la muerte. El punto de partida de la reflexión está constituido por la descripción de la muerte que hace Bernhard Welte como un momento en el cual el ser humano alcanza su totalidad. Así, cuando se considera a una persona fallecida, experimentamos una transfiguración en su imagen, de tal modo que el momento de la muerte puede ser calificado como un instante numinoso y sacro. Si se compara esta descripción con el análisis que (...) Martin Heidegger ofrece en Ser y tiempo, constatamos diferentes accesos. Heidegger intenta mostrar que la muerte no puede ser definida por la vía del trato con la muerte de otra persona, sino solo describiendo la relación individual con la propia muerte. Finalmente, el texto discute el concepto que Eugen Fink ofrece de la muerte, el cual tiene dos aspectos: la dimensión solitaria (la propia muerte) y su dimensión social (la muerte de los otros). Ambas dimensiones se complementan. The paper deals with the phenomenological approach to death. The starting point of the reflection is Bernhard Welte’s description of death as a moment in which a human being achieves his wholeness. Thus, when regarding a dead person, we experience a transfiguration in his/her image in such a way that the moment of death can be spoken about as a numinous and sacred instant. Comparing this description with Martin Heidegger’s analysis in Being and Time, we see a different approach. Heidegger attempts to show that death cannot be defined by dealing with the death of another person, but only by describing the individual’s relationship to his/her own death. Finally the text discusses Eugen Fink’s notion of death, which has two aspects: the solitary dimension (one’s own death) and its social dimension (the death of others).
