RESUMEN Una vez que el foco de la reflexión pasa de las teorías ideales a la aplicación de la justicia social, centrada en las instituciones de las sociedades democráticas, se requiere prestar especial atención a los estilos de vida. Estos tienen una alta incidencia en cómo la justicia es realizada y afectan tanto a la desigualdad económica como a la disponibilidad de los recursos naturales. En nuestras sociedades es posible establecer restricciones a los estilos de vida, especialmente en aquellos casos (...) en que, por el efecto de algunas dinámicas sociales, aquellos se desacoplan de las concepciones del bien. Se defiende que, en tales casos, la base normativa que permite exigir el respeto a los estilos de vida se disuelve y por ello es posible justificar su restricción. ABSTRACT Now that the focus of reflection has shifted from ideal theories to the application of social justice, centered on the institutions of democratic societies, it is necessary to pay special attention to lifestyles, since they not only influence the realization of justice, but also have an effect on economic inequality and the availability of natural resources. In our societies, it is possible to place restrictions on lifestyles, especially in those cases in which, influenced by certain social dynamics, they disengage from conceptions of the good. The article argues that, in those cases, the normative base grounding the demand that lifestyles be respected is dissolved, thus justifying their restriction. (shrink)

We study versions of limit models adapted to the context of metric abstract elementary classes. Under categoricity and superstability-like assumptions, we generalize some theorems from 7, 15-17. We prove criteria for existence and uniqueness of limit models in the metric context.

We study notions of independence appropriate for a stability theory of metric abstract elementary classes (for short, MAECs). We build on previous notions used in the discrete case, and adapt definitions to the metric case. In particular, we study notions that behave well under superstability‐like assumptions. Also, under uniqueness of limit models, we study domination, orthogonality and parallelism of Galois types in MAECs.

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

Final value accrues to objects that are good for their own sakes, while instrumental value accrues to objects that are good for the sake of their effects. The following paper aims to show that this distinction cuts across some surprising areas of the evaluative domain. This means that there may be some unexpected types of value that can come in a final or instrumental form. The argument proceeds by looking at two prominent types of value, namely kind-value and personal value. (...) The former accrues to objects that are good as the kinds of things that they are, while the latter accrues to objects that are good for someone. Substantive examples are offered in support of the idea that these types of value can come in final or instrumental form. The substantive examples are then given additional support by considering the structure and behavior of fitting attitudes. (shrink)

Some versions of moral naturalism are faulted for implausibly denying that moral obligations and prescriptions entail categorical reasons for action. Categorical reasons for action are normative reasons that exist and apply to agents independently of whatever desires they have. I argue that several defenses of moral naturalism against this charge are unsuccessful. To be a tenable meta-ethical theory, moral naturalism must accommodate the proposition that, necessarily, if anyone morally ought to do something, then s/he has a categorical reason to do (...) it. Versions of moral naturalism that deny this claim would, if widely believed, disable some crucial practical uses of moral concepts. In particular, if the existence of normative reasons for action is taken to be dependent on agents’ desires, it would breed profound skepticism about the legitimacy of evaluating others’ actions from a moral point of view. Also, it would raise doubts about whether people ought to correct their own behavior in light of moral considerations. Following Richard Joyce, I take these consequences to indicate that the concept of a categorical reason is a “non-negotiable” part of moral concepts. (shrink)

This situation is driving firms to undertake an environmental transformation process with the purpose of reducing the negative externalities that come from their economic activities. Within this context, environmental marketing is an emerging business philosophy by which organizations can address sustainability issues. Moreover, environmental marketing and orientation are seen as valuable strategies to improve a (...) firm's competitiveness. However, the literature that has analyzed the link between environmental strategies and firms' results has been inconclusive and contradictory. In this study, we propose and test a model that analyses how the implementation of ecological issues within a firm's marketing strategy and orientation influences organizational results. Data were obtained through a survey sent to Spanish manufacturing firms. The results show that environmental marketing positively affects firms' operational and commercial performance and this improvement will influence their economic results. Moreover, environmental marketing is revealed as an excellent strategy to obtain competitive advantages in costs and in product differentiation. Thus, this study agrees with the researchers who affirm that environmental strategies positively affect firm's competitiveness while reducing environmental impact. (shrink)

The idea of inclusive collective decision-making is important in establishing democratic legitimacy, but it fails when citizens are excluded. Stated-preference methods of valuation, which are commonly used in economics, have been criticised because the principle of willingness to pay may exclude low-income earners who do not have the capacity to pay. Deliberative valuation has been advocated as a way to overcome this problem, but deliberation may also be exclusive. In this review, two deliberative valuation frameworks are compared. The first is (...) grounded on the idea of rational discourse that emphasises argument at the expense of other communicative strategies. It seeks to secure inclusion through procedural rules and prerequisites, but fails to address the underlying democratic limitation of argumentation. The second does not rely on the distinction between rational and rhetorical speech, and therefore admits alternative forms of communication. This approach recognises differences in the communicative capacities and practices of those who take part in deliberation, and so is better equipped to improve, though not to guarantee, inclusion. This paper analyzes the impact that Lamarckian evolutionary theory had in the scientific community during the period between the advent of Zoological Philosophy and the publication Origin of Species. During these 50 years Lamarck’s model was a well known theory and it was discussed by the scientific community as a hypothesis to explain the changing nature of the fossil record throughout the history of Earth. Lamarck’s transmutation theory established the foundation of an evolutionary model introducing a new way to research (...) in nature. Darwin’s selectionist theory was proposed in 1859 to explain the origin of species within this epistemological process. In this context, Charles Lyell’s Principles of Geology and Auguste Comte’s Cours de Philosophie Positive appear as two major works for the dissemination of Lamarck’s evolutionary ideology after the death of the French naturalist in 1829. Rips et al. claim that the principles underlying the structure of natural numbers cannot be inferred from interactions with the physical world. However, in their target article they failed to consider an important source of interaction: finger counting. Here, we show that finger counting satisfies all the conditions required for allowing the concept of numbers to emerge from sensorimotor experience through a bottom-up process.

This article integrates previously missing components of government quality into the governance-piracy nexus in exploring governance mechanisms by which global obligations for the treatment of IPRs are effectively transmitted from international to the national level in the battle against piracy. It assesses the best governance tools in the fight against piracy and upholding of intellectual property rights (IPRs). The instrumentality of IPR laws (treaties) in tackling piracy through good governance mechanisms is also examined. Findings demonstrate that: (1) while all governance (...) tools under consideration significantly decrease the incidence of piracy, corruption-control is the most effective weapon; (2) but for voice and accountability, political stability and democracy, IPR laws (treaties) are instrumental in tackling piracy through government quality dynamics of rule of law, regulation quality, government effectiveness, corruption-control, and press freedom. Hence, the need for a policy approach most conducive to expanding development is to implement an integrated system of both IPRs and corollary good governance policies. Moreover, our findings support the relevance of good governance measures in developing countries wishing to complement their emerging IPR regimes. (shrink)

Plagiarism is a serious, yet widespread type of research misconduct, and is often neglected in developing countries. Despite its far-reaching implications, plagiarism is poorly acknowledged and discussed in the academic setting, and insufficient evidence exists in Latin America and developing countries to inform the development of preventive strategies. In this context, we present a longitudinal case study of seven instances of plagiarism and cheating arising in four consecutive classes of an Epidemiology Masters program in Lima, Peru, and describes the implementation (...) and outcomes of a multifaceted, “zero-tolerance” policy aimed at introducing research integrity. Two cases involved cheating in graded assignments, and five cases correspond to plagiarism in the thesis protocol. Cases revealed poor awareness of high tolerance to plagiarism, poor academic performance, and widespread writing deficiencies, compensated with patchwriting and copy-pasting. Depending on the events’ severity, penalties included course failure and separation from the program. Students at fault did not engage in further plagiarism. Between 2011 and 2013, the Masters program sequentially introduced a preventive policy consisting of: intensified research integrity and scientific writing education, a stepwise, cumulative writing process; honor codes; active search for plagiarism in all academic products; and a “zero-tolerance” policy in response to documented cases. No cases were detected in 2014. In conclusion, plagiarism seems to be widespread in resource-limited settings and a greater response with educational and zero-tolerance components is needed to prevent it. (shrink)

In this article I argue that anti-perfectionist liberals can accept nudging in certain areas: in particular, they can accept nudges aimed at helping people to discharge their nonenforceable duties, and to secure personal autonomy. I claim that nudging is not disrespectful since it does not involve a comparative negative judgment on people’s ability to pursue their plans, and that the judgments that motivate nudging are compatible with treating citizens as free and equal. I also claim that despite being sometimes manipulative, (...) nudging is easy to resist and so it can be employed to pursue legitimate goals. (shrink)

I defend the view that circular definitions can be useful and illuminating by focusing on the fitting-attitudes analysis of value. This definition states that an item has value if and only if it is a fitting target of attitudes. Good items are the fitting targets of positive attitudes, and bad items are the fitting targets of negative ones. I shall argue that a circular version of this definition, defended by Rabinowicz and Rønnow-Rasmussen (2006), is preferable to its non-circular counterpart and (...) upholds reasonable standards of acceptability. The standards I will be discussing come from Humberstone (1997), who claims that definitions cannot be informative as long as they are inferentially circular. (shrink)

This paper presents key elements of Paolo Prodi´s historiagraphic theory that allow us to include him in the contemporary debate on the rol of religion and morality within democratic societies. The text is developed in three moments. First, we will briefly describe the aforementioned debate. Second, we will present the theorical elements found in Prodi’s works which are more relevant for the topic discussed. This book examines the human ability to participate in moments of joint feeling. It presents an answer to the question concerning the nature of our faculty to share in what might be called episodes of collective affective intentionality. The proposal develops the claim that our capacity to participate in such episodes is grounded in an ability central to our human condition: our capacity to care with one another about certain things. The author provides a phenomenologically adequate account of collective affective (...) intentionality that takes seriously the idea that feelings are at the core of our emotional relation to the world. He details a form of group emotional orientation that relies on the fact that the participating individuals have come to share a number of concerns. Readers will learn that at the heart of a collective affective intentional episode, one does not merely find a set of shared concerns, but also a particular mode of caring. In the end, the argument presented in this monograph makes plausible the idea that the emotions through which humans participate in moments of affective intentional community express our nature. In addition, it shows that the debate on collective affective intentionality also permits us to better understand the relationship between two conflicting philosophical pictures of ourselves: the idea that we are essentially social beings and the claim that we are creatures for whom our personal existence is an issue. Thus, aiming at an elucidation of the nature of our ability to feel together, the book offers a detailed account of what it is to situationally express our human nature by caring about something in a properly joint manner. Abstract In The Descent of Man (1879), Charles Darwin proposed a speculative evolutionary explanation of extended benevolence—a human sympathetic capacity that extends to all nations, races, and even to all sentient beings. This essay draws on twenty-first century social science to show that Darwin’s explanation is correct in its broad outlines. Extended benevolence is manifested in institutions such as legal human rights and democracy, in behaviors such as social movements for human rights and the protection of nonhuman animals, and in (...) normative attitudes such as emancipative values and a commitment to promote the rights or welfare of animals. These phenomena can be substantially explained by cultural evolutionary forces that trace back to three components of what Darwin called the human “moral sense”: (1) sympathy, (2) our disposition to follow community rules or norms, and (3) our capacity to make normative judgments. Extended benevolence likely emerged with “workarounds,” including political ideologies, that established an inclusive sympathetic concern for sentient life. It likely became as widespread as it is now due to recently arisen socio-economic conditions that have created more opportunities for people to have contact with and take the perspective of a broader cross-section of humanity, as well as other species. Why I thought it useful to offer an explanation of Hegel’s doctrine on the Incarnation was so that the reader may be empowered to identify Hegel’s influence in modern accounts of this mystery. Even if, in my view, Hegel’s interpretation of revealed religion differs greatly from Catholic Doctrine, it is not surprising to find the presence of some of his concepts in modern theology. In truth, what matters is not the theologian’s self-identification as Hegelian or as non-Hegelian, but whether or (...) not the theologian adopts Hegel’s concepts. This paper offers an explanation of the internal dynamism of Hegelian concepts and their relation to Christian doctrine in Hegel’s Phenomenology of Spirit. This research may help to show in what way it is possible to explain Christian religious doctrine with a philosophy other than the Thomistic one and how, at least in Hegel’s case, religious doctrine is changed and reduced to an erroneous philosophical content. Also, an attempt is made to show the internal “coherence” of this Hegelian re-reading of Christianity so that theologians may become more cautious about accepting an explanation of Christian doctrine simply because the Christian language is preserved in that explanation. For millennia it has been discussed whether literature appropriately can or should be used in education for a moral purpose. Taking as a premise that it can actually be educative and not merely moralising, we tackle the case made against such use, based on the claim that it would be perverting the aesthetic nature of literature as a form of art, as it would be instrumentalised. Given that this claim is based on a dichotomy between an aesthetically educative approach and (...) a morally educative approach to literature, we examine how warranted such a formulation of this dichotomy is. We argue that, at least on some occasions, those two educative approaches to literature—the aesthetic and the moral—can actually be mutually reinforcing in such a way that aesthetic appreciation will suffer if the moral is not deeply examined with both mind and heart, and vice versa. This does not mean, however, that this relation of mutual contribution will always obtain in a neat way. It may actually be the case that just in a few cases, and only if carried out in a pedagogically appropriate manner, it will be correct to use literature with a morally educative purpose. (shrink)

Copredication is the phenomenon whereby two or more predicates seem to require that their argument denotes different things. The denotation of words that copredicate has been broadly discussed. In this paper, I investigate the metaphysics behind this question. Thus, mereological theories of dot objects claim that these nouns denote complex entities; Asher (Lexical meaning in context, Cambridge University Press, 2011, https://doi.org/10.1017/CBO9780511793936) thinks that they denote bare particulars; and the Activation Package Theory contends that they stand for multiple denotations. According to (...) the Activation Package Theory, copredicative nouns stand for complex knowledge structures that offer a range of multiple potential denotations. In this paper, I claim that the Activation Package Theory contributes to solve some of the metaphysical questions that arise from copredication. (shrink)

If the bounded proper forcing axiom BPFA holds and ω 1 = ${\mathrm{\omega }}_{1}^{\mathrm{L}}$ , then there is a lightface ${\mathrm{\Sigma }}_{3}^{1}$ well-ordering of the reals. The argument combines a well-ordering due to Caicedo-Veličković with an absoluteness result for models of MA in the spirit of "David's trick." We also present a general coding scheme that allows us to show that BPFA is equiconsistent with R being lightface ${\mathrm{\Sigma }}_{4}^{1}$ , for many "consistently locally certified" relations R on $\mathrm{\mathbb{R}}$ . There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

This paper offers some insights and clarifications of the paramount role that Mexico has had in the forging of first-order cybernetics. Our account starts with Arturo Rosenblueth as a key intellectual figure in the foundation and formation of the field. After revisiting a historical context of people and places, we proceed to a cultural and media archeological investigation that helps us obtain new insights into the ongoing effort to intertwine the complex intellectual networks across different countries in Latin America, North (...) America, and Europe. We then present cases and first-hand interviews to discuss the legacy of cybernetics in Mexico around institutions where Rosenblueth was affiliated, mainly the Institute of Cardiology and, later on, the CINVESTAV at the Instituto Politécnico Nacional. We claim that subjective affinities are as important as common scientific goals to establish and keep connections alive, necessary to the development of a research field. As the active compound in spicy peppers, capsaicin represents a local component to the definition of cybernetics. Ultimately, the paper aims to contribute to the research on the importance of cybernetics in Latin America. (shrink)

In this brief note, I offer some considerations to the effect of arguing (i) that Duffley's criticism to formal semantics is based on a dogma about the proper nature of the linguistic sing, and (ii) that, even when I agree with the general spirit of his realizational theory of meaning, an explicit theory of how syntax affects meanings realization is missing.

This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

Este escrito plantea la complejidad sistémica del concepto crisis moral aplicada en la sociedad contemporánea, especialmente en el caso latinoamericano, lo que exige un estudio interdisciplinario para abordar el asunto. Ahora bien, se alude a una complejidad sistémica de la crisis moral por cuatro aspectos. En primer lugar, porque la moral, al ser un sistema normativo basado en el deseo de una sociedad mejor, nunca se sentirá satisfecha de la sociedad en la que se enmarca, lo que provoca un permanente (...) malestar. En segundo lugar, porque una crisis moral indica que no hay un acoplamiento entre la realidad de lo que se tiene con lo que se quiere, por lo que el acoplamiento deseado supone interrelacionar diversas variables sistémicas para que pueda suceder realmente un desarrollo moral (para lo cual se seguirá, con algunas correcciones, el modelo de desarrollo moral de Kohlberg), variables que son más complejas de lo que el sistema político cree o quiere hacer creer. En tercer lugar, porque afirmar la existencia de una crisis moral y, por tanto, la necesidad de acciones tendientes a resolverla, no implica que haya consenso sobre cuál es la moral que debe aceptarse ni sobre el camino a seguir para lograr dicho fin, para empezar porque es relativamente común que los agentes acusados de ser los causantes de la actual “crisis moral de la sociedad y del derecho” en las sociedades contemporáneas suelen ser los agentes que denuncian, como free riders, la misma crisis. Y, en cuarto lugar, porque un cambio sistémico que posibilite un salto en el desarrollo moral debe ser significativamente fuerte, y las medidas que suelen enunciarse para afrontarlo, además de no ser claras, suelen ser insuficientes o ingenuas (tales como pedir la creación o el fortalecimiento de una asignatura de ética en los planes de estudio de los futuros ciudadanos en general y abogados en especial). Finalmente, se propondrá partir de este diagnóstico sistémico e interdisciplinario para potencializar las respuestas que puedan darse para enfrentar la crisis; de lo contrario, lo rechazado permanecerá. In the last chapter of In the beginning was the deed: realism and moralism in political argument, Williams raised the question of truthfulness in politics and warned that the media, particularly, television, and the market of communication in general, work in ways contrary to truthfulness -understood as the combination of the virtues of sincerity and accuracy. In this paper we would like to carry on Williams’ line of thinking in connection with the impact of the new social media platforms on (...) politics. Where Williams focused on television, we will consider the impact of the internet public sphere. After reviewing how the digital social media encourages motivated reasoning in general, we propose to focus on two main phenomena derived from it: the rise of conspiracy theories and the moralization of politics. Conspiracy theories epitomize the risk of self-deception Williams was concerned to signal. On the other hand, the process of moralization of politics triggers sectarianism and hate for the “others”, the outgroup. Both phenomena are not exclusive of the internet sphere, but both are boosted by it, and entail a lack of interest in truth and truthfulness, and in this way they threaten the value of truth for democracy. En este artículo describiremos la vitalidad del sistema fonológico del mapudungun hablado por escolares pewenches de la Provincia del Biobío, VIII Región. Específicamente, nos hemos propuesto: a) Determinar los fonos/fonemas, y su fonotaxis, que se relevan como indicadores de vitalidad, b) Identificar las transferencias fonético-fonológicas presentes en la fonología del pewenche hablado por estos escolares y c) Interpretar las transferencias encontradas en términos del grado de vitalidad de la fonología de la lengua. La muestra está conformada por un grupo de (...) 20 escolares bilingües de entre 12 y 15 años de edad, que se encuentran cursando 7° y 8° año básico en escuelas rurales pertenecientes a dos comunidades pewenches del valle del Queuco, en la comuna de Alto Biobío. Para la recolección del material fonológico, se aplicó a los participantes una lista léxica de 65 ítems, material que se complementó con la narración oral en mapudungun de un cuento. Según nuestros datos, hemos podido constatar la existencia de una serie de rasgos fónicos en el mapudungun hablado por los escolares pewenches que obedece a la influencia de las estructuras fonológicas del castellano. Sin embargo, el grado y la difusión de los fenómenos de transferencia se desarrollan de manera heterogénea en ambas comunidades en estudio, debido, entre otros factores, a la intensidad del contacto. In this article we will describe the vitality of the phonological system Mapudungun spoken by Pewenche schoolchildren from the Biobío province, VIII Region. We intend: a) To determine the phones/phonemes, and their phonotactics, which are revealed as vitality markers. b) To identify the phonetic-phonological transferences which are present in the Pewenche spoken by these schoolchildren, and, c) To interpret the transferences found in terms of the degree of the language phonological vitality. The sample is composed of 20 bilingual schoolchildren from 12 to 15 years old, who are in 7th and 8th grade in rural primary schools belonging to two Pehuenche comunities from Valle del Queuco, in the city of Alto Biobío. To collect the phonological material, we applied a 64-item lexical list, which was complemented with the oral narration of a tale in Mapudungun. According to our data, we have been able to verify the existence of a series of phonic features in the Mapudungun spoken by Pewenche schoolchildren, which originate because of the influence of the Spanish phonological structure. However, the degree and spread of the transference phenomena develop in a heterogeneous way in both of the studied communities. due to the contact intensity, among other possible factors. (shrink)

The origin of Paraconsistent Logic is closely related with the argument that from the assertion of two mutually contradictory statements any other statement can be deduced, which can be referred to as ex contradict!one sequitur quodlibet (ECSQ). Despite its medieval origin, only in the 1930s did it become the main reason for the unfeasibility of having contradictions in a deductive system. The purpose of this paper is to study what happened before: from Principia Mathematica to that time, when it became (...) well established. The main historical claims that I am going to advance are the following: the first explicit use of ECSQ as the main argument for supporting the necessity of excluding any contradiction from deductive systems is to be found in the first edition (1928) of the book Grundzüge der theoretischen Logik by Hilbert and Ackermann. At the end, I will suggest that the aim of the 20th century usage of ECSQ was to change from the centuries long philosophical discussion about contradictions to a more "technical" one. But with Paraconsistent Logic viewed as a technical solution to this restriction, the philosophical problem revives, but now with an improved understanding of it at one's disposal. (shrink)

One of the strongest defences of free speech holds that autonomy requires the protection of speech. In this paper I examine five conditions that autonomy must satisfy. I survey recent research in social psychology regarding automatic behaviour, and a challenge to autonomy is articulated. I argue that a plausible strategy for neutralising some of the autonomy-threatening automatic responses consists in avoiding the exposure to the environmental features that trigger them. Resumen: Una de las formas más comunes y menos estudiadas de parcialidad judicial subjetiva es la disminución de la credibilidad otorgada a un testigo debido a un prejuicio identitario implícito del agente judicial. En la epistemología social, este fenómeno ha sido estudiado bajo la rúbrica de la injusticia testimonial. En este ensayo mostramos que para determinar la ocurrencia de un caso de injusticia testimonial en el derecho se deben cumplir tres condiciones que son imposibles de verificar empíricamente y que están (...) basadas en presupuestos psicológicos que han sido puestos en duda en años recientes. Sin la posibilidad de verificar estas condiciones, estamos frente a un tipo de parcialidad judicial indetectable. En su lugar, ofrecemos una nueva forma de entender la injusticia testimonial en el derecho como un fenómeno más general que describe una tendencia comportamental prejuiciosa recurrente por parte de un agente judicial. Entendida de este modo, la injusticia testimonial es completamente verificable. -/- Abstract: One of the most common and least studied forms of subjective judicial partiality is the credibility deficit suffered by a witness due to an implicit identity prejudice in a judicial agent. Social epistemologists have studied this form of partiality under the rubric, “testimonial injustice.” In this essay we argue that to verify the occurrence of a singular instance of testimonial injustice in law three facts must be established, none of which can be established with any degree of confidence. Furthermore, all of them are based on psychological suppositions that have been recently discredited. Without the possibility of establishing these facts, we end up with an undetectable form of subjective judicial partiality. In its place, we offer a new way of understanding testimonial injustice in law as a general phenomenon that describes a recurrent pattern of prejudiced behavior in a judicial agent. Under this characterization, testimonial injustice becomes empirically verifiable. (shrink)
