This book provides a multidisciplinary analysis of the potential conflict between a government’s duty to protect children and a parent’ right to raise children in a manner they see fit. Using philosophical, bioethical, and legal analysis, the author engages with key scholars in pediatric decision-making and individual and religious rights theory. Going beyond the parent-child dyad, the author is deeply concerned both with the inteests of the broader society and with the appropriate limits of government interference in the private sphere. The relationship between democracy and constitutions is a long and fractious one. Those who lean towards the constitutionalist side have tended to perceive democracy as a threat to political order and the preservation of important values, whereas those who take a more democratist stance tend to treat constitutions as elite hindrances to popular rule as much as anything else. In this paper, we will give the constitutionalist thesis a broader theoretical and political scrutiny. By way of explanation, we will address (...) and recommend the possibilities and problems for putting into practical operation such an anti-constitutionalist stance; the recent experience of the U.S. State of California offers itself as a good forcing-ground for these ideas. In short, from a democratic standpoint, the challenge for the citizenry is not so much about defining the values of constitutions, but constitutions whose change is outside the scope of popular decision making, supposed to exclusively take place through judicial interpretation or through an amendment formula designed precisely to make change difficult and unlikely. Too often, constitutions place checks and limits on democratic participation in the name of some other set of vaunted truths or elite-favouring values. For the strong democrat, it is formal constitutions and their institutional paraphernalia that do more to inhibit and dull democracy's emancipatory potential than to nurture and fulfil it. (shrink)

Opponents of male circumcision have increasingly used human rights positions to articulate their viewpoint. We characterize the meaning of the term “human rights.” We discuss these human rights arguments with special attention to the claims of rights to an open future and to bodily integrity. We offer a three-part test under which a parental decision might be considered an unacceptable violation of a child's right. The test considers the impact of the practice on society, the impact of the practice on (...) the individual, and the likelihood of adverse impact. Infant circumcision is permissible under this test. We conclude that infant circumcision may be proscribed as violating local norms, even though it does not violate human rights. (shrink)

JacobsMy1 circumcision experiences are remarkable mostly for their ordinariness. My wife Danaë gave birth to our son Perseus2 while I was a resident in obstetrics and gynecology in a city where we had no family. Perseus was circumcised in a Jewish brit milah3 ceremony on the eighth day of his life, as were my wife's and my male ancestors back into ancient (...) times. We were relieved because Perseus had just recovered from a potentially serious condition. After a difficult forceps delivery, his blood bilirubin rose almost to the point where he might have developed the dreaded kernicterus syndrome. Kernicterus can cause permanent severe motor, intellectual and visual impairment. It was unclear whether he would be discharged from the hospital in time. He had to spend a week in restraints under a bright light whose frequency degraded bilirubin. Happily, he came home the day before the scheduled brit.Our four parents attended the brit. Danaë's father was the sandek,4 being granted the honor of holding our son on his lap during the circumcision ceremony. The mohel, or circumciser, was the local Conservative rabbi. We were mildly anxious because he didn't do many circumcisions in this city with few Jews. Perseus cried briefly after he was circumcised. The circumcision undoubtedly was far less stressful than treatment of elevated bilirubin. The circumcision certainly was less painful than the prodding and sticks for the many blood tests he had to undergo in the hospital, not to mention the pain of his difficult forceps delivery. Perseus did not seem to have much discomfort in his penis afterward, and had no circumcision complications.After the brit, our parents and my resident colleagues ate refreshments and chatted for an hour or so. A brit milah is a happy occasion, but not an elaborate one. It marks the end of the joy, anxiety, and excitement of the child's birth and its aftermath and is followed by the less exalted rhythm of feedings, diaper changes, and sleep deprivation.At the brit, our boys are assigned Hebrew names and confirmed in the Biblical covenant between God and the Hebrew people established between God and Abraham, and reaffirmed between God and Moses. Regardless of the historical truth of the formation of the covenant, it is accepted as a myth tantamount to [End Page 71] truth. In other words, regardless of its literal truth, such a myth is to be regarded as true because it concretizes God's demands or a moral truth. The covenant is real for me whether or not there was a historical Abraham. As with other religious commitments, the obligation to circumcise our sons is unprovable, but binding. On this basis, Perseus's ancestors on both sides were circumcised in brit milah ceremonies for many centuries into the past.My two grandsons were circumcised as well. Achilles was circumcised among friends and relatives. The mohel was an experienced obstetrician who was certified to officiate at a brit milah following the practices of Conservative Judaism. He administered adequate analgesia with topical local anesthetic cream followed by an injected regional block. Achilles slept through his circumcision, suffered no complications, and had little discomfort afterward. My other grandson had a circumcision performed as an infant outside the context of Judaism and is not being raised as a Jew.The two brit milah in my family were beautiful, dignified ceremonies, welcoming the infants into the Jewish fold, and bestowing their Hebrew names.5 Some of my relatives, including Perseus's son, had circumcisions performed in a medical setting without a ceremony. None of the many boys in my family had obvious short- or long-term problems with their circumcisions. My social circle has many Reform and Conservative Jews. I have never heard any Jewish man in my circle of acquaintances complain about his circumcision. Circumcision is a given. Problems are rare, and an exposed glans is the norm. Our men typically enjoy sex and have no difficulty in fathering children. Circumcision is part of the comforting cocoon of custom and tribe that helps to protect us as a group. Female genital alteration is any cutting, removal or destruction of any part of the external female genitalia. Various FGA practices are common throughout the world. While most frequent in Africa and Asia, transglobal migration has brought ritual FGA to Western nations. All forms of FGA are generally considered undesirable for medical and ethical reasons when performed on minors. One ritual FGA procedure is the vulvar nick. This is a small laceration to the vulva that does not cause morphological changes. Besides (...) being performed as a primary ritual procedure it has been proposed as a substitute for more extensive forms of FGA. Measures advocated or taken to reduce the burden of FGA can be punitive or non-punitive. Even if it is unethical to perform VN, we argue that it also is unethical to attempt to suppress it through punishment. First, punishment of VN is likely to cause more harm than good overall, even to those ostensibly being protected. Second, punishment is likely to exceed legitimate retributive ends. We do not argue in favor of performing VN. Rather, we argue that non-punitive strategies such as education and harm reduction should be employed. (shrink)

Locke scholars continue to disagree over how he analyzed natural laws, real essence-power relations in physical substances. Some say he regarded them as emanations, necessitated by the corpuscular structure of real essences; for others his laws are adventitious, imposed on substances by God and contingent on divine alterable will. The second view has been increasingly favored in recent years, assisted no doubt by Edwin McCann's potent case for it in "Lockean Mechanism" (1985). While all states in the United States require certain vaccinations for school attendance, all but three allow for religious exemptions to receiving such vaccinations, and 18 allow for exemptions on the basis of other deeply held personal beliefs. The rights of parents to raise children as they see fit may conflict with the duty of the government and society to protect the welfare of children. In the U.S., these conflicts have not been settled in a uniform and consistent manner. We (...) apply a test that provides a concrete and formal rubric to evaluate such conflicts. For some vaccinations, based on the individual medical characteristics of the disease and the risks of being unvaccinated, the test would suggest that permitting conscientious exemptions is ethical. However, for vaccinations protecting against other diseases that are more severe or easily transmitted, the test would suggest that the federal government may ethically impose laws that deny such exemptions. I propose a test to determine what sorts of parental decisions might trigger intervention. I also propose constraints on government action to minimize government unfairness in applying the test. Psychological approaches to fostering sustainability are heavily focused on individual behaviors and often insufficiently address the physical and social contexts individuals are embedded in. This limits the ability to create meaningful, long-lasting change, as many of day-to-day behaviors are social practices embedded in broader cultural norms and systems. This is particularly true in the work context, where organizational cultures heavily condition both the actions of individual employees and the collective actions of organizations. Thus, we argue cultures, not behaviors, must become (...) the focus of sustainability change efforts. In this paper, we present a theory of change aimed at fostering strong organizational cultures of sustainability (COS) within a high-performance multi-tenant office building. Our theory takes a systems perspective that incorporates the social and physical aspects of the work environment, and views culture change as a co-creative exercise involving engagement of multiple stakeholders. The distinction between taxonomic plant geography and ecological plant geography was never absolute: it would be historically inaccurate to portray them as totally divergent. Taxonomists occasionally borrowed ecological concepts, and ecologists never completely repudiated taxonomy. Indeed, some botanists pursued the two types of geographic study. The American taxonomist Henry Allan Gleason (1882–1975), for one, made noteworthy contributions to both. Most of Gleason's research appeared in short articles, however. He never published a major synthetic work comparable in scope or influence (...) to the ecological texts of Clements, Schimper, and Warming.Despite exceptions such as Gleason, most plant geographers throughout the twentieth century have emphasized the distinction between ecological and taxonomic plant geographies. Why have these distinct traditions developed? In his book Geographical Ecology, Robert MacArthur has suggested a psychological explanation for the dichotomy: “Unraveling the history of a phenemenon has always appealed to some people and describing the machinery of the phenomenon to others... The ecologist and physical scientist tend to be machinery oriented, whereas paleontologists and most biogeographers tend to be history oriented.”46Without necessarily rejecting MacArthur's explanation, my study suggests a more complex relationship between taxonomic and ecological plant geographies. At the turn of the century a group of botanists self-consciously defined a new area of botanical research. These ecologists defined their new discipline in opposition to what they believed was a moribund, nineteenth-century, natural-history tradition. They turned from historically oriented, descriptive, taxonomic plant geography to experimental physiology. The new ecological plant geography was to focus on communities rather than on species, on proximate environmental causes rather than on historical explanations, and on physiological experiments rather than on morphological descriptions.As we look back, much of the “revolt from morphology” was rhetorical. Ecologists never completely replaced species as units of distribution, nor did they set geography on an explicitly physiological basis. Indeed, much of early ecological research was, quite simply, descriptive. Plant communities were defined in terms of dominant species, representative life forms, or general physiognomy. The underlying physiological basis for community characteristics was more often assumed than demonstrated by experiments.Despite the fact that ecological plant geography was not a truly physiological specialty, it was significantly different from more traditional taxonomic plant geography. First, ecologists were less explicitly evolutionary in their approach than were taxonomists. Following Darwin, most taxonomic plant geographers viewed distribution in historical terms. In contrast, early ecologists tended to ignore the traditional geographic problems. Most ecologists were skeptical of historical explanations, emphasizing instead the proximate, environmental causes of distribution. While some nineteenth-century biogeographers had studied the correlation between climate and vegetation, twentieth-century ecologists focused much more sharply on the interactions between plant and environment. Plant ecologists did not place biogeography on a physiological basis, but by emphasizing physiology they laid the foundation for a more detailed understanding of adaption. This emphasis on physiology and environmental causation was a second distinguishing characteristic of ecological plant geography. Finally, the idea of the plant community, articulated by Eugenius Warming in 1895, provided ecologists with a unique perspective on the distribution of plants. For early ecologists, the community was more than an assemblage of species; it was an integrated unit. The distribution of these units became the major focus of ecological plant geography. Communities never completely replaced species as geographic units, and the distinction between flora and vegetation was often blurred. Nonetheless, ecologists were innovative in studying the distribution of structurally and functionally integrated groups of plants.In the twentieth century plant geography has occupied an anomalous position in biology. It has not developed into an autonomous discipline, nor has it been incorporated into the developing discipline of ecology. Ecologists and taxonomists have pursued fairly distinct styles of geographic research, with the result that two relatively independent approaches to the study of plant distribution have persisted. It seems quite appropriate, then, that the first Zionist Congress was held in Basle, where Nietzsche spent several years as a professor of classical philology. This coincidence gains profound significance when we see Nietzsche's impact on the first Zionist leaders and writers in Europe as well as his presence in Palestine and, later, in the State of Israel.--from the Introduction The early Zionists were deeply (...) concerned with the authenticity of the modern Jew qua person and with the content and direction of the reawakening Hebrew culture. Nietzsche too was propagating his highest ideal of a personal authenticity. Indeed, the antisemitic uses to which Nietzsche's thought was turned after his death have led most commentators to assume the philosopher's antipathy to Jewish aspirations. Jacob Golomb proposes a Nietzsche whose sympathies overturn such preconceptions and details for the first time how Nietzsche's philosophy inspired Zionist leaders, ideologues, and writers to create a modern Hebrew culture. Golomb cites Ahad Ha'am, Micha Josef Berdichevski, Martin Buber, Theodor Herzl, Max Nordau, and Hillel Zeitlin as examples of Zionists who dared to look into Nietzsche's abyss. There is growing philosophical interest in “affective injustice”: injustice faced by individuals specifically in their capacity as affective beings. Current debates tend to focus on affective injustice at the psychological level. In this paper, I argue that the built environment can be a vehicle for affective injustice — specifically, what Wildman et al. (2022) term “affective powerlessness”. I use resources from ecological psychology to develop this claim. I consider two cases where certain kinds of bodies are, either intentionally or unintentionally, (...) deprived of access to goods affording the development and maintenance of their subjective well-being: hostile architecture and masking practices in autism. This deprivation, I argue further, leads to a significant weakening and diminishment of their spatial agency, hinders their well-being, and in so doing gives rise to a pervasive experience of affective powerlessness. By drawing attention to these themes, I show that an ecological approach helpfully supplements existing approaches. It highlights how affective injustice can emerge via the way bodies are positioned in space, and the central role that built environments play in determining this positioning. (shrink)

Some recent developments in Artificial Intelligence—especially the use of machine learning systems, trained on big data sets and deployed in socially significant and ethically weighty contexts—have led to a number of calls for “transparency”. This paper explores the epistemological and ethical dimensions of that concept, as well as surveying and taxonomising the variety of ways in which it has been invoked in recent discussions. Whilst “outward” forms of transparency may be straightforwardly achieved, what I call “functional” transparency about the inner (...) workings of a system is, in many cases, much harder to attain. In those situations, I argue that contestability may be a possible, acceptable, and useful alternative so that even if we cannot understand how a system came up with a particular output, we at least have the means to challenge it. As far back as we know, there have been individuals incapacitated by memories that have filled them with sadness and remorse, fright and horror, or a sense of irreparable loss. Only recently, however, have people tormented with such recollections been diagnosed as suffering from "post-traumatic stress disorder." Here Allan Young traces this malady, particularly as it is suffered by Vietnam veterans, to its beginnings in the emergence of ideas about the unconscious mind and to earlier manifestations of traumatic memory (...) like shell shock or traumatic hysteria. In Young's view, PTSD is not a timeless or universal phenomenon newly discovered. Rather, it is a "harmony of illusions," a cultural product gradually put together by the practices, technologies, and narratives with which it is diagnosed, studied, and treated and by the various interests, institutions, and moral arguments mobilizing these efforts. This book is part history and part ethnography, and it includes a detailed account of everyday life in the treatment of Vietnam veterans with PTSD. To illustrate his points, Young presents a number of fascinating transcripts of the group therapy and diagnostic sessions that he observed firsthand over a period of two years. Through his comments and the transcripts themselves, the reader becomes familiar with the individual hospital personnel and clients and their struggle to make sense of life after a tragic war. One observes that everyone on the unit is heavily invested in the PTSD diagnosis: boundaries between therapist and patient are as unclear as were the distinctions between victim and victimizer in the jungles of Southeast Asia. The impact of digital media and technology on performance arts is evident when digital visual effects (VFX) filming techniques are introduced on a film set. Digital technologies influence the film actor’s approach to be congruent to and authentic within the circumstances of the scene. Actors require an effective skillset and strategies to successfully deliver an embodied performance aligning with the various digital VFX techniques. Focusing on imagination, action and emotion that would facilitate such an embodied performance, we drew on relevant (...) neuroscientific notions such as neuron reactivation, conceptual blending, as-if body states and affordances. Additionally, we incorporated relevant embodied performance concepts from Stanislavski, Laban/Bartenieff Movement Studies, Effector Patterns including the Emotional Body Approach and Lessac Kinesensics to the development of a digital acting programme, advancing the actor’s required skills and providing on-set digital acting strategies to support congruency with digital VFX and authenticity within the diegetic reality. The efficacy of this programme was determined by assessing pre- and post-intervention recordings of both a control and an experimental group of trained actors. Reflection-on-action journals from participants supplemented the assessment. The assessments and journals indicate that the acquired skillset and on-set digital acting strategies effectively improve the actor’s performance with digital VFX filming technology. (shrink)

For millennia, diagnosticians distinguished natural sadness that arose from social circumstances from depressive disorders that were disproportionate to their contexts. In 1980, the DSM-III transformed this tradition through equating depressive disorders with symptoms without regard to context. Nevertheless, it excluded grieving people without especially severe or enduring symptoms from diagnosis. Subsequently, considerable empirical research indicated that bereavement was not unique but a model for all stressor-maintained conditions. Yet, despite the evidence showing that the causes, prognoses, and optimal treatments for context-specific (...) depressions differ from those that aren’t, the DSM-5 removed the bereavement exclusion from the diagnostic criteria for major depression. This article considers the reasons behind this elimination and its implications for the research, labeling, and treatment of depression. (shrink)

I outline the theoretical framework of, and three research programs within American speculative philosophy of science during the period 1900-1931. One program applies verificationism to research in psychology, one investigates the methodology of research programs, and one analyses scientific explanation and other scientific concepts. The primary sources for my outline are works by Morris Raphael Cohen, Grace Andrus de Laguna, Theodore de Laguna, Edgar Arthur Singer Jr., Harold Robert Smart, and Marie Collins Swabey. I also use my outline to provide (...) a partial comparison of American speculative philosophy of science and 1930s logical positivism. My comparison suggests that logical positivism was a proposal for substantially narrowing down and winding back American philosophy of science and was based on positions that were already problematized in the American context. -/- . We provide self-contained proof of a theorem relating probabilistic coherence of forecasts to their non-domination by rival forecasts with respect to any proper scoring rule. The theorem recapitulates insights achieved by other investigators, and clarifi es the connection of coherence and proper scoring rules to Bregman divergence.

The surge in interest in natural language processing in artificial intelligence has led to an explosion of new language models capable of engaging in plausible language use. But ensuring these language models produce honest, helpful, and inoffensive outputs has proved difficult. In this paper, I argue problems of inappropriate content in current, autoregressive language models—such as ChatGPT and Gemini—are inescapable; merely predicting the next word is incompatible with reliably providing appropriate outputs. The various fine-tuning methods, while helpful, cannot transform the (...) model from mere next word prediction to the kind of planning and forethought necessary for saying the right thing. The upshot is that these models will increasingly churn out bland, generic responses that will still fail to be accurate or appropriate. (shrink)

A phenomenological hermeneutic study of the lifeworld of critical care nursing was undertaken, from which emerged the concept of ‘focusing’. Focusing is defined as empathizing concern for the critically ill person and his/her family amid the high technology of the intensive care unit. When nurses focus on the patient and the patient's family they are able to empathize with die personal dimensions of caring. When Jesus meets the Samaritan Woman at Jacob’s well in John 4, it is a meeting between two colonial subjects in the Roman Empire. In this encounter we find the Samaritan Woman as a triply marginalised body, a woman subject to multiple, intersecting forms of oppression within her patriarchal context. Identified as a Samaritan Woman, Jewish rabbis regarded her as unclean, impure, and being menstruous from birth. It can also be deduced that she is an outcast in her own society (...) because she comes to draw from the well at noon, the hottest part of the day when people did not usually fetch water. This Samaritan Woman is nameless, landless and powerless in an imperial, colonial and patriarchal context. The poem of Diana Ferrus, I’ve come to take you home, in memory of Sarah Baartman, highlights how Baartman was dehumanised and treated as a sexual object by European colonisers. Through a postcolonial reading of John 4, I consider the intersections between the Samaritan Woman and the early life of Sara Baartman in their respective colonial contexts and invite the reader, as the poem invites Baartman, to come home to Africa and resist Western European imperial and colonial patterns and tendencies.Contribution: This article has interdisciplinary implications. This is an interdisciplinary study in the sense that it offers a biblical interpretation of John 4 that is informed by the life of Sara Baartman that has been uncovered through anthropology, history and sociology. It is also integrating the field of postcolonial biblical hermeneutics with the theory of intersectionality. (shrink)

Fin de siecle Vienna was once memorably described by Karl Kraus as a "proving ground for the destruction of the world." In the decades leading to the World War that brought down the Austro-Hungarian empire, the city was at once an operetta dream world masking social and political problems and tension, as well as a center for the far-reaching explorations and innovations in music, art, science, and philosophy that would help to define modernity. One of the most powerful critiques of (...) the retreat into fantasy was that of the philosopher Ludwig Wittgenstein, whose early career in Vienna has helped frame debates about ethical and aesthetic values in culture. In Wittgenstein's Vienna Revisited Allan Janik expands upon his work Wittgenstein's Vienna (co-authored with Stephen Toulmin) to amplify a number of significant points concerning the genesis of Wittgenstein's thought, the nature of Viennese culture, and criticism of contemporary culture. Although Wittgenstein is the central figure in this volume, Janik places considerable emphasis on other influential figures, both Viennese and non-Viennese, in order to break down some of the persistent stereotypes about the philosopher and his surrounding culture, especially the myths of "carefree" Vienna and Wittgenstein the positivist. The persistence of these myths, in Janik's view, stems in part from the inability of many historians to differentiate past from present in the evaluation of intellectual currents. Janik reviews a number of figures overlooked in assessing Wittgenstein: Otto Weininger, Kraus, Schoenberg, Nietzsche, Wagner, Ibsen, Offenbach, and Georg Trakl. All of these, Janik demonstrates, are absolutely necessary to understand what was at stake in the debates on aestheticism and the critique of a modern culture. Wittgenstein's efforts to recognize the limits of thought and language and thus to be fair to science, religion, and art account for his place of honor among critical modernists. These essays elucidate Wittgenstein's perspective on our culture. (shrink)
