A renewed search for legal certainty is a reaction to the preponderance of judge made law, which has been in turn prompted by the democratic deficit of the EU and the impact of Anglo-American law. The problem is that the search is oblivious to both systematic interpretation and the need of re-systematization of law. The paper defines systematic interpretation, relates the definition to standard French and German conceptions, indicates the room for systematic interpretation in (...) Anglo-American laws, and states prima facie reasons for a re-systematization of law as a prerequisite of systematic interpretation. The problem cannot be appreciated outside its proper context. It is a disregard for causation and evaluation. Hence the paper outlines Aristotle’s understanding of causation and evaluation in his presentation of phronesis, reconsiders continental European legal thought in the light of Aristotle’s presentation, and offers policy-oriented jurisprudence as a remedy to the deficit of evaluation and causation in European legal thought. A solution to the problem offers a typology of criteria and clarifies positive and fundamental legal concepts, positive and fundamental criteria of systematization, and the place of criteria in knowledge of law. The usefulness of the criteria is demonstrated by a common approach to the systematization of law and an alternative diagnosis of a defect of systematization diagnosed by an authority in history and philosophy of law rather than legal theory. Hobbes’s political philosophy departs from a number of premises that are supposed to be self-evident, supplemented by various observations from experience. These statements are examined critically and in their interrelatedness in order to find out to what extent Hobbes provides a convincing system of thought. The importance of the basis of man’s actions, his self-interest, is inquired, since it serves as the basis of his practical philosophy. After this, Hobbes’s views on ‘moral’ notions are expounded. As it turns out, Hobbes (...) maintains a number of concepts that have such a connotation, but interprets these in a specific way. The thesis demonstrates the underlying coherence of Machiavelli's political thought by deriving his manifold maxims from an unified set of psychological assumptions. In so doing, it bridges the two principal cleavages of the interpretive literature: whether Machiavelli explored only autocratic power politics or classical republicanism as well, and whether he had a normative purpose or gave merely technical advice; also, it determines the meaning of such widely debated Machiavellian concepts as virtu, ambition, the great, the people, liberty, etc. ;At root, (...) Machiavelli assumed human beings to be individuals that have a first and second nature. In first nature, imagination and ingenuity stimulate the passions to grow into an insatiable ambition for glory, domination, wealth, and sexual pleasure. In second nature, coercive constraint may habituate individuals to cooperate in the pursuit of these ends. Regarding the first cleavage, individuals can thus be said to exist originally in a violent condition of licence, wherein political order springs from the power of an autocrat. The institutional order of a republic arises when such an autocrat habituates individuals to the "civil life"--non-exclusive government through laws. However, this civil life merely enables citizens to spare one another in order to satisfy their ambitions more effectively by jointly making war on foreigners; accordingly, J.G.A. Pocock's prominent claim that Machiavellian republics actualize Aristotelian virtue is mistaken. ;Regarding the second cleavage, Machiavelli's thought can be shown to proceed on two levels: instrumentally, it gives technical advice to rulers on how to satisfy their own ambition best; normatively, it constructs political order so that their self-seeking deeds redound to the security, greatness, empire, and treasure of the whole. ;Finally, Machiavelli's dual psychology engenders two kinds of foreign affairs. Fundamentally, states are locked into a violent struggle for domination which arises not only from ambition but from fear for preservation as well; since defensive alliances tend to fail in Machiavelli's view, this struggle leads recurrently to the formation of encompassing empire. Secondarily, habituation to peace under such an empire may temporarily enable its successor states to maintain a foreign institution that attenuates conflict among them. (shrink)

Hegel's _Phenomenology_ is considered by many to be the most difficult book in the philosophical canon. While some authors have published excellent essays on various chapters and aspects of the book, few authors have successfully tackled the whole. In _The Unity of Hegel's "Phenomenology of Spirit_", Jon Stewart interprets Hegel's work as a dialectical transformation of Kantian transcendental philosophy, providing from this unified standpoint a case for Hegel's own conception of philosophy as a system. In restoring them to their larger (...) systematic contexts, Stewart clarifies Hegel's individual analyses, as well as indicating the meaning and significance of the transitions and illustrating the parallelisms between the respective analyses. Summary This paper tries to show how the irreducible indeterminacy of textual meanings can be reconciled with epistemological realism which normally presupposes independently existing but determinate objects of knowledge. E.D. Hirsch's project of objective interpretation, including his most recent attempts to show that meanings, in spite of their openness to future modifications, are historically determined objects of knowledge, is being criticized. The paper argues that his use of the semantics and the reference theories of Kripke, Putnam, and others forces (...) him to give up, against his own intention, his methodologically important distinction between meaning and significance. Within such theories a strict separation of linguistic knowledge of meaning and world knowledge can no longer be upheld. Since the application of individually and historically variable world knowledge is unavoidable in the process of understanding texts, the textual meanings reconstructed by readers will always remain indeterminate. BackgroundTitles and abstracts are the most read sections of biomedical papers. It is therefore important that abstracts transparently report both the beneficial and adverse effects of health care interventions and do not mislead the reader. Misleading reporting, interpretation, or extrapolation of study results is called “spin”. In this study, we will assess whether adverse effects of orthodontic interventions were reported or considered in the abstracts of both Cochrane and non-Cochrane reviews and whether spin was identified and what type of (...) spin.MethodsEligibility criteria were defined for the type of study designs, participants, interventions, outcomes, and settings. We will include systematic reviews of clinical orthodontic interventions published in the five leading orthodontic journals and in the Cochrane Database. Empty reviews will be excluded. We will manually search eligible reviews published between 1 August 2009 and 31 July 2019. Data collection forms were developed a priori. All study selection and data extraction procedures will be conducted by two reviewers independently. Our main outcomes will be the prevalence of reported or considered adverse effects of orthodontic interventions in the abstract of systematic reviews and the prevalence of “spin” related to these adverse effects. We will also record the prevalence of three subtypes of spin, i.e., misleading reporting, misleading interpretation, and misleading extrapolation-related spin. All statistics will be calculated for the following groups: (1) all journals individually, (2) all journals together, and (3) the five leading orthodontic journals and the Cochrane Database of Systematic Reviews separately. Generalized linear models will be developed to compare the various groups.DiscussionWe expect that our results will raise the awareness of the importance of reporting and considering of adverse effects and the presence of the phenomenon of spin related to these effects in abstracts of systematic reviews of orthodontic interventions. This is important, because an incomplete and inadequate reporting, interpretation, or extrapolation of findings on adverse effects in abstracts of systematic reviews can mislead readers and could lead to inadequate clinical practice. Our findings could result in policy implications for making judgments about the acceptance for publication of systematic reviews of orthodontic interventions. (shrink)

Any sort of cognition, perception, and action is necessarily shaped by (re)activation of “schemata.” Any interpretation is schema (re)activation. Schemata are epistemologically speaking “structural” activation patterns which are psychologically and neurologically speaking accommodated, adapted, “learned” by co- and re-activating neuronal assemblies. Six levels of interpretative schema activations (schema interpretations) are outlined from invariable primary “interpretations” through conventional, classificatory, and justificatory, as well as meta-interpretations. Constitutive schema interpretations are unavoidable. Strike action in healthcare has been a common global phenomenon. As such action is designed to be disruptive, it creates substantial ethical tension, the most cited of which relates to patient harm, that is, a strike may not only disrupt an employer, but it could also have serious implications for the delivery of care. This article systematically reviewed the literature on strike action in healthcare with the aim of providing an overview of the major justifications for strike action, identifying relative (...) strengths and shortcomings of this literature and providing direction for future discussions, and theoretical and empirical research. Three major themes emerged related to (1) the relationship between healthcare workers, patients and society; (2) the consequences of strike action; and (3) the conduct of strike action. Those who argue against strike action generally cite the harms of such action, particularly as it relates to patients. Many also argue that healthcare workers, because of their skills and position in society, have a special obligation to their patients and society more generally. Those who see this action as not only permissible but also, in some cases, necessary have advanced several points in response, arguing that healthcare workers do not necessarily have any special obligation to their patients or society, and even if so, this obligation is not absolute. Overwhelmingly, when talking about the potential risks of strike action, authors have focused on patient welfare and the impact that a strike could have. Several directions for future work are identified, including greater explorations into how structural and systemic issues impact strike action, the need for greater consideration about the contextual factors that influence the risks and characteristics of strike action and finally the need to tie this literature to existing empirical evidence. Most interpretations of Kant’s Critique of Pure Reason focus on its Doctrine of Elements, and ignore that the Doctrine of Elements needs to be grounded systematically in the Doctrine of Method. As a step toward remedying such neglect, this paper outlines the relation between the Doctrine of Elements and the Doctrine of Method within the Critique. It lays out the three systematic needs implied in the Doctrine of Elements, and shows that, in Kant’s account, these needs can be satisfied (...) only in the Doctrine of Method. In doing so, the paper reveals the systematic dependence of the elements of cognitions on the method of cognition from pure reason. (shrink)

The recent interest in systematic review methods in bioethics has highlighted the need for greater transparency in all literature review processes undertaken in bioethics projects. In this article, I articulate features of a good bioethics literature review that does not aim to be systematic, but rather to capture and analyse the key ideas relevant to a research question. I call this a critical interpretive literature review. I begin by sketching and comparing three different types of literature review conducted (...) in bioethics scholarship. Then, drawing on Dixon-Wood's concept of critical interpretive synthesis, I put forward six features of a good critical interpretive literature review in bioethics: answering a research question, capturing the key ideas relevant to the research question, analysing the literature as a whole, generating theory, not excluding papers based on rigid quality assessment criteria, and reporting the search strategy. The phenomenon of systematic polysemy offers a fruitful domain for examining the theoretical differences between lexicological and lexicographic approaches to description. We consider here the process that provides for systematic conversion of count to mass nouns in English (a chicken Æ chicken, an oak Æ oak etc.). From the point of view of lexicology, we argue, standard syntactic and pragmatic tests suggest the phenomenon should be described by means of a single unindividuated transfer function that does not distinguish (...) between interpretations (rabbit = "meat" vs. "fur"). From the point of view of lexicography, however, these pragmatically determined"sense precisions" are made part of explicit description via the inclusion of semantic "licenses," a mechanism distinct from lexical rules. Kant's account of systematicity, in the Critique of Judgment, provides the basis for judgements regarding the moral salience of objects in experience, thus satisfying this necessary condition for the practical employment of teleological judgement. Kant's account of systematicity, however, grounds merely theoretical teleological interpretation of experience without necessarily grounding practical judgements. In order to provide a basis for practical judgements, teleological judgement must subordinate the teleological interpretation of experience to an account of the necessary commitments of a rational (...) subject. In 'A Nice Derangement of Epitaphs' Donald Davidson attacks a picture of language which, he says, is prevalent among philosophers and linguists. Davidson's criticism, even if correct, is not radical enough. The common irregularities of everyday language, such as malapropisms, nicknames, and slips of the tongue, not only imply that linguistic meanings are not governed by conventions that are learned in advance of occasions of interpretation, but undermine the very idea that linguistic meaning can be accounted for in terms (...) of systematic meaning-theories. Davidson continues to hold that Tarskian truth-definitions should play a central role in philosophical accounts of language, but if the goal is to describe rather than to improve or otherwise change language, we must give up the aspiration towards theoretical systematicity altogether. In this connection, Davidson's approach is compared with those of Quine and Wittgenstein. It is argued that Davidson's unwillingness to give up the notion that meaning is systematic is best explained in terms of his vacillating between treating meaning-theories as mere representations of the linguistic abilities of a speaker and seeing them as playing a more substantial role in communication. We use the interpretation of vague scalar predicates like small as an illustration of how systematic semantic models of dialogue context enable the derivation of useful, fine-grained utterance interpretations from radically underspeci- fied semantic forms. Because dialogue context suffices to determine salient alternative scales and relevant distinctions along these scales, we can infer implicit standards of comparison for vague scalar predicates through completely general pragmatics, yet closely constrain the intended meaning to within a natural range.

In this paper I argue that Hegel thought that systematicity was both a necessary condition for a body of thought to be recognized as philosophy and a normative principle by which progress in the history of philosophy can be evaluated. I argue that Hegel’s idiosyncrasies in the interpretation of thinkers who he considers to be philosophers can be explained by referring to the structure of his own philosophical system. I also argue that Hegel’s conception of philosophy as being essentially (...) systematic leads him to claim that traditions that do not have systematic philosophy do not have philosophy at all and this leads to their marginalization. Finally, I identify the role of Hegel’s assumptions in shaping the self-understanding of philosophers through the shaping of the philosophical canon. (shrink)

I present a systematic interpretation of the foundational purpose of constructions in ancient Greek geometry. I argue that Greek geometers were committed to an operationalist foundational program, according to which all of mathematics—including its entire ontology and epistemology—is based entirely on concrete physical constructions. On this reading, key foundational aspects of Greek geometry are analogous to core tenets of 20th-century operationalist/positivist/constructivist/intuitionist philosophy of science and mathematics. Operationalism provides coherent answers to a range of traditional philosophical problems regarding classical (...) mathematics, such as the epistemic warrant and generality of diagrammatic reasoning, superposition, and the relation between constructivism and proof by contradiction. Alleged logical flaws in Euclid can be interpreted as sound operationalist reasoning. Operationalism also provides a compelling philosophical motivation for the otherwise inexplicable Greek obsession with cube duplication, angle trisection, and circle quadrature. Operationalism makes coherent sense of numerous specific choices made in this tradition, and suggests new interpretations of several solutions to these problems. In particular, I argue that: Archytas’s cube duplication was originally a single-motion machine; Diocles’s cissoid was originally traced by a linkage device; Greek conic section theory was thoroughly constructive, based on the conic compass; in a few cases, string-based constructions of conic sections were used instead; pointwise constructions of curves were rejected in foundational contexts by Greek mathematicians, with good reason. Operationalism enables us to view the classical geometrical tradition as a more unified and philosophically aware enterprise than has hitherto been recognised. (shrink)

Understanding the functional mechanisms underlying genetic signals associated with complex traits and common diseases, such as cancer, diabetes and Alzheimer's disease, is a formidable challenge. Many genetic signals discovered through genome‐wide association studies map to non‐protein coding sequences, where their molecular consequences are difficult to evaluate. This article summarizes concepts for the systematic interpretation of non‐coding genetic signals using genome annotation data sets in different cellular systems. We outline strategies for the global analysis of multiple association intervals and (...) the in‐depth molecular investigation of individual intervals. We highlight experimental techniques to validate candidate (potential causal) regulatory variants, with a focus on novel genome‐editing techniques including CRISPR/Cas9. These approaches are also applicable to low‐frequency and rare variants, which have become increasingly important in genomic studies of complex traits and diseases. There is a pressing need to translate genetic signals into biological mechanisms, leading to prognostic, diagnostic and therapeutic advances. (shrink)

In this book Mark Bevir and Jason Blakely set out to make the most comprehensive case yet for an 'interpretive' or hermeneutic approach to the social sciences. Interpretive approaches are a major growth area in the social sciences today. This is because they offer a full-blown alternative to the behavioralism, institutionalism, rational choice, and other quasi-scientific approaches that dominate the study of human behavior. In addition to presenting a systematic case for interpretivism and a critique of scientism, Bevir and (...) The study deals with Kant's theory of aesthetics, which is mainly exposed in his "Critique of Judgment". This theory represents one of the most important interpretations of the problem of aesthetic being and is one of the best examples of the Cartesian account of the philosophical foundations of aesthetics. In the submitted study it is emphasized that Kant in his theory relied upon previous aesthetic theories of the 18th century, especially those of the German and English philosophers of the period (...) of the Enlightenment. On the other hand it is stressed that Kant's conception was a great achievement in the field of original philosophical thought. Especially his conception of universal validity of aesthetic judgments apriori was an outstanding example of Kant's ability to find a new original solution of old philosophical problems. Kant's final humanistic account of aesthetics and its close relation to ethics is also very important. (shrink)

The belief that obscure dreams have meaning, that they can be understood in spite of their seeming incoherence, is shared by most cultures: the importance attributed to the interpretation of dreams comes up several times in such sacred texts as the Bible and Talmud, where it is warned that an uninterpreted dream is like an unopened letter. However, even if such a point of view may justify the interpretation of obscure dreams, it does not provide a basis for (...) a systematic interpretive approach. Roger Caillois considered the will to interpretation “one of the noblest flaws of the human spirit,” defining it as “this passion to find meaning in what has none, and thus to derive meaning from the meaningless.” And it is surely the human spirit's inherent need for intelligibility that underlies the desire to account for the existence of dreams, whether as a divine message or a symptom of neurosis. The act of interpretation consists of giving meaning to something that, at first glance, appears to have none; and this is done not arbitrarily but by discerning a meaning - with the help of methods created for this purpose - that is believed to be implicitly contained in the dream. Thus to interpret a dream we must explain it in relation to the context in which it takes it meaning. For Freud “the interpretation of a dream” requires specifying its “sense” and then replacing it with something that can fit within the chain of our psychic actions. (shrink)

This systematic review identifies and critically evaluates instruments that have been developed to measure clinical trial informed consent comprehension in non-cognitively-impaired adults.Literature searches were carried out on Medline (Ovid), PsycInfo, CINHAL, ERIC, ScienceDirect, and Cochrane Library for English language articles published between January 1980 and September 2008. Instruments were excluded if they focused on consent onto paediatric trials, the construct under study was primarily capacity or competency, or the instrument was developed specifically for psychiatric or cognitively-impaired populations. Instruments selected (...) for review were evaluated against the following criteria: (1) method of item generation; (2) type and format of test items; (3) administration and interpretation of test results; and (4) psychometric properties.Three instruments met our defined inclusion criteria: the Deaconess Informed Consent Comprehension Test (DICCT), the Quality of Informed Consent (QuIC) questionnaire and the Brief Informed Consent Protocol (BICEP). Each instrument varied in terms of content measured. Significantly, these are the first standardized instruments developed to assess comprehension in non-cognitively-impaired adults. This article explains Kant’s claim that sciences must take, at least as their ideal, the form of a ‘system’. I argue that Kant’s notion of systematicity can be understood against the background of de Jong & Betti’s Classical Model of Science (2010) and the writings of Georg Friedrich Meier and Johann Heinrich Lambert. According to my interpretation, Meier, Lambert, and Kant accepted an axiomatic idea of science, articulated by the Classical Model, which elucidates their conceptions of systematicity. I show (...) that Kant’s critique of the mathematical method is compatible with his adherence to this axiomatic conception of science. I further show that systematicity furthers traditionally accepted logical ideals of scientific knowledge, which explains why Meier and Kant think that sciences must be ‘systematic’. (shrink)

Donald Davidson contributed more deeply to our understanding of language, thought, and reality than perhaps any other recent philosopher. His discussions of skepticism are sometimes seen as peripheral to those contributions. As I read him, Davidson argued against three skeptical worries. First, beliefs are true or false relative to a conceptual scheme. Second, beliefs generally are false. Third, other minds and an external world do not exist. Call those worries ‘conceptual relativism’, ‘falsidicalism’, and ‘solipsism’, respectively. I investigate how Davidson’s arguments (...) are connected. I then show that those connections are so systematic that Davidson ultimately offers a single, master argument with two premises. Premise one is that I think. Premise two is an application of his account of radical interpretation. Focusing on the systematicity of Davidson’s anti-skeptical arguments demonstrates that discussions of skepticism were more central to his views than often appreciated and shines fresh light on his project overall. The purpose of this dissertation is to establish an interpretive framework for the study of Kant's Critique of Judgment. The central themes of the text are presented in the first chapter in terms of two different problems. The first is referred to as the prima facie problem. This problem concerns the search for a transcendental principle for the faculty of judgment corresponding to the principles established for understanding and reason in the first two critiques. The second is referred to as (...) the systematic problem. This problem concerns the search for a transcendental principle which can mediate between the domains of understanding and reason and provide for a "unity of transition" between nature and freedom. ;The value of this interpretation is demonstrated in the second chapter through a criticism of Paul Guyer's work on the third critique, Kant and the Claims of Taste . This criticism focuses on Guyer's interpretive method and scholarship. ;The interpretation is developed further in the third and fourth chapters in which specific problems that have not been dealt with adequately in the recent literature in English are addressed. The systematic argument of the two introductions that Kant prepared for the text is presented in the third chapter. Finally, the fourth chapter focuses on the deduction of pure aesthetical judgments and advances an account of this argument that is shown to be preferable to the account of Guyer as well as that developed by Donald Crawford in his study Kant's Aesthetic Theory. Computation is interpretable symbol manipulation. Symbols are objects that are manipulated on the basis of rules operating only on theirshapes, which are arbitrary in relation to what they can be interpreted as meaning. Even if one accepts the Church/Turing Thesis that computation is unique, universal and very near omnipotent, not everything is a computer, because not everything can be given a systematic interpretation; and certainly everything can''t be givenevery systematic interpretation. But even after computers and computation (...) have been successfully distinguished from other kinds of things, mental states will not just be the implementations of the right symbol systems, because of the symbol grounding problem: The interpretation of a symbol system is not intrinsic to the system; it is projected onto it by the interpreter. This is not true of our thoughts. We must accordingly be more than just computers. My guess is that the meanings of our symbols are grounded in the substrate of our robotic capacity to interact with that real world of objects, events and states of affairs that our symbols are systematically interpretable as being about. This article systematically investigates so-called “truth variants” of several functional interpretations. We start by showing a close relation between two variants of modified realizability, namely modified realizability with truth and q-modified realizability. Both variants are shown tobe derived from a single “functional interpretation with truth” of intuitionistic linear logic. This analysis suggests that several functional interpretations have truth and q-variants. These variants, however, require a more involved modification than the ones previously considered. Following this lead we present truth and (...) q-variants of the Diller-Nahm interpretation, the bounded modified realizability and the bounded functional interpretation. (shrink)

Los estudios sobre el Vaticano II se concentran en tres áreas estrechamente vinculadas: las investigaciones históricas, los trabajos sistemático-hermenéuticos y aquellos referidos a los procesos de recepción en las distintas zonas geográficas. Esta contribución afronta el segundo ámbito y con una delimitación precisa: tres contribuciones relevantes que marcaron el debate en torno a la década del ochenta del siglo pasado y que favorecieron un salto de calidad en la comprensión hermenéutica del Concilio. Se trata, en primer término, de la interpretación (...) de Karl Rahner acerca de una iglesia mundial. Segundo, la formulación de los principios generales de interpretación en torno al Sínodo extraordinario de 1985. Tercero, la elaboración por parte de Giuseppe Alberigo de criterios hermenéuticos propios de este Concilio en base a la idea del Vaticano II como evento que inspiró la investigación histórica más importante y detallada en los años noventa. Los trabajos concretados al inicio de nuestro siglo han construido sobre las bases que pusieron los avances analizados en esta contribución. The studies on the Vatican II focus in three areas that are closely linked: historical research, systematic studies in which particular emphasis is placed on the hermeneutic perspective, and research that lays emphasis on the multiple processes of reception in the regional contexts. This article deals only with the systematic aspect, taking into account three relevant contributions that marked the debate particularly around the eighties of the last century. These studies favored a qualitative leap in the hermeneutic understanding of the Council Firstly, the interpretation of Karl Rahner on a worldwide church. Secondly, the formulation of general principles of interpretation by the 1985 Synod. And finally, the specific hermeneutical criteria elaborated by Giuseppe Alberigo after the idea of Vatican II as an event that inspired the most relevant and detailed historical research of the nineties. The hermeneutical work produced during the beginning of our century has built on the foundations laid down by the three contributions discussed in this article. (shrink)

This book is the first to offer a systematic account of the role of language in the development and interpretation of physics. An historical-conceptual analysis of the co-evolution of physics and mathematics leads to the classical/quantum interface. Bohr's interpretation is analyzed and extended to the interpretation of the standard model of particle physics.

This article probes the question of what interpretations of quantum mechanics actually accomplish. In other domains, which are briefly considered, interpretations serve to make alien systematizations intelligible to us. This often involves clarifying the status of their implicit ontology. A survey of interpretations of non-relativistic quantum mechanics supports the evaluation that these interpretations make a contribution to philosophy, but not to physics. Interpretations of quantum field theory are polarized by the divergence between the Lagrangian field theory that led to the (...) Standard Model of Particle physics and the Algebraic quantum field theory, that discounts an ontology of particles. Ruetsche's interpretation, it is argued, offers a potential for loosening the sharp polarization that presently obtains. A brief evaluation focuses on the functional ontology of quantum field theory considered as an effective theory. (shrink)

We describe a unified framework for the understanding of structure representation in primate vision. A model derived from this framework is shown to be effectively systematic in that it has the ability to interpret and associate together objects that are related through a rearrangement of common “middle-scale” parts, represented as image fragments. The model addresses the same concerns as previous work on compositional representation through the use of what+where receptive fields and attentional gain modulation.
