Knowledge about human wellbeing is a central part of ethical knowledge. But it is a neglected topic not only in ethics in general, but also in wellbeing theorizing, which has focused on enumerating the basic elements of wellbeing rather than on how to gauge, foster and maintain wellbeing in actual human lives. I consider the prospects for a procedural approach to wellbeing that sees it as depending on a process of continual adjustment between (...) values, preferences, actions and emotions. The value-fulfilment theory of Valerie Tiberius provides a model for such an approach, but needs to be corrected and supplemented in certain respects. I propose a version of the approach that is only partly, but still significantly procedural, and which does not privilege higher-order mental states. Considering the relevance of such an approach for ethics, I finally suggest that (certain forms of) moral agency may be best analyzed as an intersubjective process of adjustment and fulfilment of values and desires (etc.), and as a process of acquiring and exercising collective moral knowing how. This article presents and analyzes the basic features of wellbeing competence. Following a procedural approach to wellbeing, I propose wellbeing competence as a significant object of focus in the philosophical debate on wellbeing. Instead of being concerned one-sidedly with abstract ideals and explicit, theoretical knowledge about what constitutes wellbeing, wellbeing competence is the ability to handle the concrete process of living well and helping others live well in a generally qualified way. This (...) article presents a theory that considers wellbeing competence a complex form of knowing how. Further, it outlines central aspects and components of wellbeing competence. In professional settings, people often have diverse and competing conceptions of responsibility and of when it is fair to hold someone responsible. This may lead to undesirable gaps in the distribution of responsibilities. In this paper, a procedural model is developed for alleviating the tension between diverging responsibility conceptions. The model is based on the Rawlsian approach of wide reflective equilibrium and overlapping consensus. The model is applied to a technological project, which concerned the development of an in-house (...) monitoring system based on ambient technology. The development of this innovative technology raised questions among the technological researchers about its social acceptance and the way issues related to privacy and security should be addressed. The case is analyzed in terms of two procedural norms (reflective learning and inclusiveness), which are based on literature on policy and innovation networks. Analysis of the case shows that, in a pluralist setting, a procedural approach can be useful for encouraging discussion on the legitimacy of different responsibility conceptions and the question what a fair responsibility distribution amounts to. ABSTRACT The individual-community relationship has always been one of the most fundamental topics of social sciences. In sociology, this is known as the micro-macro relationship while in economics it refers to the processes, through which, individual actions lead to macroeconomic phenomena. Based on philosophical discourse and systems theory, many sociologists even use the term "emergence" in their understanding of micro-macro relationship, which refers to collective phenomena that are created by the cooperation of individuals, but cannot be reduced to individual actions. (...) "Emergence" theories attempt to explain the nature of society as a complex system by examining how individuals and their relationships lead to the creation of integrated and macro-social phenomena such as markets, educational systems, cultural beliefs, and shared social practices. As a prelude to activity, every researcher has to answer the question from the methodological point of view, how is it possible to study the behavior of social groups and how can we gain knowledge about the laws related to social groups? Anyone who deals with humanities and social sciences or any reality and phenomenon that affects human beings, inevitably deals with the reality that is emerging. In fact, emergence occurs when one level of reality emerges radically from another level. Examples of emergent levels of reality include how the mind emerges from the body; or the way society emerges from human beings. Therefore, when there is an emerging factor, different scientific disciplines should be used, because it is inevitable to talk about social affairs, psychology and neurobiology, as well as physical and even chemical. -/- INTRODUCTION Since its beginning in the 19th century, sociology has faced the fundamental question of what a social phenomena stands for? At a glance, sociologists deal with the study of social groups, collective behavior, institutions, social structures, social networks, and social dynamics, and ultimately all such phenomena are composed of individuals. Therefore, social phenomena seem to have no independent ontological status, and in this case, sociology is ultimately about reducible individuals. Different approaches about the micro-macro relationship, using the concept of "emergence", argue that although collective phenomena are created by individuals, they cannot be reduced to individual action. The term "emergence" is used to distinguish "emergent results" from " Procedural results". Results are called Procedural that can only be calculated by adding or subtracting the causes that act together. On the contrary, they are emergent outcomes that are qualitatively novel compared to the causes from which they originate. An example of such emergent results is mental characteristics that emerge from neural processes, but are not considered among the characteristics of neural processes of components - which are their origin. Philosophical debates about emergentism and reductionism focus on the mind-brain relationship, but as many philosophers have noted, they can be generalized to apply to any hierarchical set of features. The cognitive revolution reactivated a 19th century controversy between theorists of Identity and dualism. The theorists of Identity believe in reductionist materialism and elimination of metaphysics, according to which the mind is nothing more than the biological, while the dualists believe that the mind and the brain are distinct from each other. Emergence has been considered as a third way between the theories of Identity and dualism. -/- METHODOLOGY Interdisciplinarity Is fundamentally indicated by the dominance of open systems as well as social and emerging systems at different levels. Therefore, as long as we are facing a new emergentism, there will necessarily be different fields and an interdisciplinary method. The commonality of social sciences and cognitive sciences on the issue of emergence provides the possibility of interaction and exchange of concepts between these two for deeper research. Therefore, in this research, apart from the concepts of Subvenience and downward causation, we have used multiple realization and wildly disjunctive, which are used to explain the emerging concept in cognitive sciences, including neurobiology, psychology, and philosophy. For analytical and interdisciplinary approaches, after examining the concepts of subvenience, and wildly disjunctive, Individualistic and collectivist emergentism have been reviewed. And then their adequacy is criticized and evaluated in meeting strong emergence conditions. -/- FINDINGS Philosophers of the mind have been able to define the conditions of irreducibility and downward causation, which are essential for strong emergence, by using the principle of subvenience with the help of multiple realization and wildly disjunctive principles. Therefore, by definition, emergentist individualism suffers from the problem of how to explain downward causality and irreducibility, and emergentist collectivism faces the challenge of reification. The analysis of the challenges facing the two methodological approaches of individualism and collectivism leads us to three unresolved issues about the emerging phenomenon, which are realism, downward causality, and mechanism. Despite the differences in the stances of these two approaches regarding the aforementioned triple problems, individualists and collectivists both agree that some social characteristics are reducible; and some others are irreducible due to their complexity, the determination of which, depends on the case study of the mechanism of emergence of each social characteristic. -/- CONCLUSION An emergence that is consistent with reductionism is called a weak emergence. And strong emergence includes the principle of irreducibility and downward causality. According to strong emergence, the characteristics of social phenomena have downward causal power, which cannot be reduced to the causal forces. The principle of subvenience, together with multiple realization and wildly disjunctive, can provide the conditions of irreducibility and downward causality, which are essential conditions of strong emergence. Based on the philosophical analysis of two methodological approaches, individualist and collectivist, it can be concluded that emergentist individualism suffers from the problem of how to explain downward causality and irreducibility, and reification collectivism faces the challenge of reification. The analysis of the problems faced by these two approaches leads us to three unresolved issues, which are realism, downward causality, and mechanism. individualist emergentists acknowledge the existence of emergent social characteristics, but despite this, they believe that these characteristics are not real but merely analytical constructs that require explanation based on individuals and their mutual actions. But collectivists argue that emergentism yields a categorical ontology and supports social realism. They accept the dependence of social characteristics on individuals, but claim that social entities and structures are ontologically independent. Individualists and collectivists both agree that some social characteristics are reducible; and others are irreducible due to their complexity; and the only way to recognize this is to engage in empirical studies of the mechanisms and temporal processes of "emergence" that create social characteristics. -/- NOVELTY The newness of this compact article is as follows: a) Presenting an interdisciplinary approach using the analysis of philosophy of cognitive sciences, including the philosophy of mind, neurobiology and psychology to formulate the issue of social emergence; b) Criticizing individualist and collectivist methodological approaches to the issue of social emergence and explaining the sufficiency and shortcomings of both in providing weak and strong emerging conditions; c) Explaining and categorizing the challenges facing methodological approaches in explaining the phenomenon of social emergence, in three categories: realism, downward causality, and mechanism. N. Cartwright's recent results on invariance under intervention and causality (2003) are reconsidered. Procedural approach to causality elicited in this paper and contrasted with Cartwright's apparently philosophical one unravels certain ramifications of her results. The procedural approach seems to license only a constrained notion of intervention and in consequence the "correctness to invariance" part of Cartwright's first theorem fails for a class of cases. The converse "invariance to correctness" part of the theorem relies heavily on modeling (...) assumptions which prove to be difficult to validate in practice and are often buttressed by independently acquired evidence. This paper proposes a classification of hESC research regulation by shifting from the statutory content of relevant national Laws to the method of decision-making process, in order to verify whether it is possible to identify a connection between the concrete characters of that process and its outcome. A set of procedural indexes are identified and applied to the analysed legal systems. According to an increasing fulfilment of indexes, we may individuate two main regulatory families: the ‘value oriented’ and the (...) ‘procedure oriented’ ones. The latter is developing an increasing impact within European context: it is characterised by a mix of regulatory sources, each developing a specific function. Within this model, statutory law cannot infringe a regulatory space reserved to expertise and selfregulation, developing a subsidiary function; furthermore, it has to recognise the integrative role of expertise within statutory-making process. Although most Asian states are signatories to UNCLOS, which offers options for dispute resolution by either voluntary or compulsory processes, in reality fewer than a dozen Asian states have taken advantage of such an approach. The decision to adopt third-party mechanisms comes under great scrutiny and deliberation, not least because of the entailing legal procedures and the politically sensitive nature of disputes. Vietnam claims the second-largest maritime area in the South China Sea dispute after China. A comparison of two (...) recent cases—the arbitration between the Philippines and China and the conciliation between Timor-Leste and Australia—highlights the importance of selecting between binding and nonbinding decisions and framing a complaint. In particular, any legal action under UNCLOS should specify China’s claims and actions in areas that encroach on Vietnam’s claimed exclusive economic zone (EEZ) and violate international law. Recent major amendments of the Code of Civil Procedure of the Republic of Lithuania have added new and improved older procedural instruments that may be used for reimbursement of losses inflicted by the abuse of process. The law now clearly states that the court may take into account improper conduct of the participants when deciding on distribution of litigation costs. A fine in favour of the party aggrieved by the abuse may also be imposed. Therefore, in this article the (...) authors analyse litigation costs and private fine as measures to reimburse losses caused by the abuse of civil procedure. The authors argue that litigation costs can be a fairly effective and relatively easy-to-use procedural instrument, which might not only prevent procedural abuses, but also compensate losses inflicted by it that falls within the category of litigation costs. Therefore, changes to the statutory legislation, expressly empowering a court to deviate from general rules of distributing and awarding litigation costs, by taking into account the propriety of the party’s actions in a procedure and causes that have given rise to those litigation costs, are welcomed. It is a common refrain amongst phenomenologists, disability theorists, and feminist legal theorists that medical practice pays insufficient attention to people’s embodiment. The complaint that we take insufficient account of people’s embodiment isn’t limited to the clinical interaction. It has also been directed at healthcare regulation and welfare policy. In this paper, I examine the arguments for taking embodiment seriously in both medical practice and welfare policy, concluding we have good reasons to take better account of people’s embodiment. I then (...) set out two challenges to taking embodiment seriously in public policy. First, given the amount of variation in how people are embodied, there is strong possibility that adjusting policy to benefit particular individuals based on an appreciation of their embodied experiences could be detrimental towards other individuals. The second challenge concerns how to ensure that people’s testimony about their first-person embodied experience is subject to adequate scrutiny without this resulting in epistemic injustice. I argue that the solution to both of these challenges is to devise a just procedure for soliciting people’s testimony and taking it into account in the policy development process. Fundamental questions in value sensitive design include whether and how high-tech products/artefacts could embody values and ethical ideals, and how plural and incommensurable values of ethical and social importance could be chosen rationally and objectively at a collective level. By using a humanitarian cargo drone study as a starting point, this paper tackles the challenges that VSD’s lack of commitment to a specific ethical theory generates in practical applications. Besides, it highlights how mainstream ethical approaches usually related to VSD are (...) incapable of solving main ethical dilemmas raised by technological design for well-being in democratic settings. Accordingly, it is argued that VSD’s ethical-democratic import would substantially be enhanced by the espousal of a procedural ethics stance and the deliberative approach to value and welfare entailed by Amartya Sen’s capability approach. Differently from rival ethical–political theories, its normative and meta-ethical foundations better handle human diversity, value-goal pluralism, conflicting vested interests as well as the epistemic-moral disagreements typical of contemporary complex democracies. Particularly, Sen’s capability approach procedural-deliberative tenets result in an “objective-impartial” choice procedure selecting a “hierarchy” of plural incommensurable values and rational goals thus, suitable to validate an applied science such as welfare-oriented technological design in concrete social environments. Conclusions suggest that refining VSD with a capability-based procedural approach to ethics fosters the concern for democracy and social justice while preserving vital scientific-technical standards. Major advantages are at an applied level to delivering ethically and socially justified, but yet highly functional technologies and high-tech products/artefacts. (shrink)

Recent articles on teaching controversial topics in schools have employed Michael Hand's distinction between “directive teaching,” in which teachers attempt to persuade students of correct positions on topics that are not rationally controversial, and “nondirective teaching,” in which teachers avoid persuading students on topics that are rationally controversial. However, the four methods of directive teaching discussed in the literature — explicit directive teaching, “steering,” “soft-directive teaching,” and “school ethos endorsement” — make rational persuasion problematic, if not self-defeating. In this essay, (...) Maughn Rollins Gregory argues that “procedurally directive teaching” offers an alternative to such approaches because it derives from the intention to guide inquiry rather than to persuade. He demonstrates that the conceptual frameworks of perfectionism and antiperfectionism, which have been proposed for directive teaching on same-sex marriage, can instead be used to generate open questions for student inquiry, as can a third, civil rights framework. Given these considerations, Gregory maintains that pedagogical guidance on this topic should be procedurally directive rather than substantively directive. Further, the fact that legal, political, and ethics scholars disagree about which framework is more appropriate to the issue of same-sex marriage indicates that such arguments cannot be dispositive of the pedagogical issue of how to frame classroom discussions about it. This paper focuses on the inferential configuration of arguments, generally referred to as argument scheme. After outlining our approach, denominated Argumentum Model of Topics (AMT, see Rigotti and Greco Morasso 2006, 2009; Rigotti 2006, 2008, 2009), we compare it to other modern and contemporary approaches, to eventually illustrate some advantages offered by it. In spite of the evident connection with the tradition of topics, emerging also from AMT’s denomination, its involvement in the contemporary dialogue on argument schemes should not (...) be overlooked. The model builds in particular on the theoretical and methodological perspective of pragma-dialectics in its extended version, reconciling dialectic and rhetoric; nevertheless, it also takes into account numerous other contributions to the study of argument schemes. Aiming at a representation of argument schemes able to monitor the inferential cohesion and completeness of arguments, AMT focuses on two components of argument scheme that could be distinguished, readapting pragma-dialectical terms, as procedural and material respectively. The procedural component is based on the semantic-ontological structure, which generates the inferential connection from which the logical form of the argument is derived. The material component integrates into the argument scheme the implicit and explicit premises bound to the contextual common ground (Rigotti 2006). In this paper, the comparison of the AMT to other approaches focuses on the inferential configuration of arguments and not on the typologies of argument schemes and on the principles they are based on, which the authors intend to tackle in a further paper. 본 연구의 목적은 트랜스휴머니즘 시대의 약리학적 도덕교육의 방향에 대해 비판적 성 찰을 제공하고는 것이다. 즉 인류의 도덕성을 향상시키기 위한 방안 중 하나인 약리학적 방식으로 도덕적 능력을 향상시키는 방안을 살펴보고자 한다. 약리학적인 접근은 이론적 으로 의료화 또는 생의료화 현상과 깊은 연결성을 가지는데, 최근의 생의료화 접근은 치료 를 목적으로 하는 것을 넘어서 생명공학이 도덕적 생명향상에 초점을 두고 있다. 이것은 자연이나 사물을 향했던 기술이 이제 인간 자신을 향하게 되었지만 기술의 영향이 생의료 화 현상과 관련하여 주의할 필요성이 있게 된 것이다. 이 때문에 본 연구에서는 (...) 약리학의 의료화 생의료화가 정신건강과 행복교육의 영역을 먼저 어떻게 식민화화하면서 어떤 한 계를 표출하였는지를 살피고자 하였다. 이러한 한계는 도덕적 향상의 영역, 덕성 강화의 영역에서도 연결되면서 어떤 기술적 한계를 가질 수 있음을 살펴볼 것이다. 뿐만 아니라 윤리학적으로도 도덕판단에서 감정의 중요성과 역할에 초점을 맞추고 있는 약리학적 인간 향상 연구의 동향이 일면적 한계를 갖고 있음을 밝히면서 덕윤리학의 입장을 통해 인간의 감정에 대한 완벽한 조작가능성의 한계가 무엇인지 제시하고자 하였다. 비록 첨단 과학기 술을 통해 치료와 향상의 경계선이 불분명한 상황이지만 치료뿐만 아니라 향상의 추구가 상당한 한계를 갖고 있음을 제시하였다. 결국 트랜스휴머니즘의 도덕성 향상 기획중 약리 학적 접근은 아직 인간의 도덕적 행위능력을 고양시키지 못한다는 점을 강조하였으며, 의 료화와 생의료화의 경향이 강화되는 현실에서 오히려 역발상적 태도도 필요함을 제시하였다 즉 덕교육적 접근을 통해 전통적 도덕교육을. 제대로 시도해야 할 필요성이 있음을 제시하였다. Much work on legal knowledge systems treats legal reasoning as arguments that lead from a description of the law and the facts of a case, to the legal conclusion for the case. The reasoning steps of the inference engine parallel the logical steps by means of which the legal conclusion is derived from the factual and legal premises. In short, the relation between the input and the output of a legal inference engine is a logical one. The truth of the (...) conclusion only depends on the premises, and is independent of the argument that leads to the conclusion.This paper opposes the logical approach, and defends a procedural approach to legal reasoning. Legal conclusions are not true or false independent of the reasoning process that ended in these conclusions. In critical cases this reasoning process consists of an adversarial procedure in which several parties are involved. The course of the argument determines whether the conclusion is true or false. The phenomenon of hard cases is used to demonstrate this essential procedural nature of legal reasoning. (shrink)

The aim of this paper is to apply the accuracy based approach to epistemology to the case of higher order evidence: evidence that bears on the rationality of one's beliefs. I proceed in two stages. First, I show that the accuracy based framework that is standardly used to motivate rational requirements supports steadfastness—a position according to which higher order evidence should have no impact on one's doxastic attitudes towards first order propositions. The argument for this will require a generalization (...) of an important result by Greaves and Wallace for the claim that conditionalization maximizes expected accuracy. The generalization I provide will, among other things, allow us to apply the result to cases of self-locating evidence. In the second stage, I develop an alternative framework. Very roughly, what distinguishes the traditional approach from the alternative one is that, on the traditional picture, we're interested in evaluating the expected accuracy of conforming to an update procedure. On the alternative picture that I develop, instead of considering how good an update procedure is as a plan to conform to, we consider how good it is as a plan to make. I show how, given the use of strictly proper scoring rules, the alternative picture vindicates calibrationism: a view according to which higher order evidence should have a significant impact on our beliefs. I conclude with some thoughts about why higher order evidence poses a serious challenge for standard ways of thinking about rationality. (shrink)

Decolonial approaches to technical design are part of a broader category of design methodologies, which actualize unfulfilled sociotechnical potentialities. In this paper, I present some decolonial theory concepts and discuss three decolonial approaches to illuminate philosophical debates that: 1) Can find in them clear traces of a third set of elements that shape every design/technology, along with the well-analyzed technical-scientific and ethical-political ones. In dialogue with Walter Vincenti and some others, I call these elements structured procedures, imagery lexicon, and aesthetical (...) values, which constitute the central aspects of Eugene Ferguson’s art of engineering; 2) Identify, starting from some Gilbert Simondon’s and Andrew Feenberg’s ideas, any invention as triply situated ; 3) Can be taught by these decolonial approaches about some of the mainstream philosophy of technology’s colonial limitations, becoming thus able to widen it. This methodological discussion invites critical reflection about the procedures used to analyze the contribution of qualitative and mixed methods research to nursing trials by mounting an argument that these should rest on multiple publications produced about a project, rather than a single article. We illustrate the value‐added of this approach with findings from a qualitative, cross‐case analysis of three critical case exemplars from nursing researchers that each used a qualitative approach with a mixed method phase. The holistic lens (...) afforded by a case‐based approach informs nursing inquiry by documenting that the critical case exemplars presented evidence of (a) a sustained commitment of resources and expertise for the qualitative methods that extended across more than one phase of the trial, (b) the impact of the qualitative methods on the trial or its aftermath, (c) deploying a theoretical or conceptual framework for a variety of purposes, and (d) integrating qualitative and quantitative data for purposes of extending explanatory power. Findings challenge the practice of linking purposes served by qualitative and mixed methods to a single trial phase. (shrink)

Axiom weakening is a novel technique that allows for fine-grained repair of inconsistent ontologies. In a multi-agent setting, integrating ontologies corresponding to multiple agents may lead to inconsistencies. Such inconsistencies can be resolved after the integrated ontology has been built, or their generation can be prevented during ontology generation. We implement and compare these two approaches. First, we study how to repair an inconsistent ontology resulting from a voting-based aggregation of views of heterogeneous agents. Second, we prevent the generation of (...) inconsistencies by letting the agents engage in a turn-based rational protocol about the axioms to be added to the integrated ontology. We instantiate the two approaches using real-world ontologies and compare them by measuring the levels of satisfaction of the agents w.r.t. the ontology obtained by the two procedures. (shrink)

This collection of essays, written on four continents by scientists, philosophers and humanists, was initially presented to Karl R. Popper on his sixtieth birthday as a token of critical admiration and in recognition of his work. But the volume also stands on its own as a remarkable series of statements utilizing Popper's critical vision in the study of philosophy proper, logic, mathematics, science as method and theory, and finally to the study of society and history. What is remarkable is that (...) Popper worked in all of these areas, not in a cursory or discursive way, but with the utmost clarity and rigor.. The core position of this volume and its contributors is that the progress of knowledge is not a linear accumulation of definitive acquisitions but a zigzagging process in which counterexamples and unfavorable evidence ruin generalizations and prompt the invention of more comprehensive and sometimes deeper generalizations, to be criticized in their turn. A critical approach to problems, procedures, and results in every field of inquiry is therefore a necessary condition for the continuance of progress. The title of this volume then is, in a sense, an homage to Popper's critical rationalism and critical empiricism. The essays are a tribute to his unceasing and uncompromising quest, not for final certainty, but for closer truth and increased clarity. Among the contributors are outstanding figures in philosophy and the exact sciences in their own right, including Herbert Feigl, R. M. Hare, J.O. Wisdom, Nicholas Rescher, David Bohm, Paul K. This paper develops a new kind of approach to conspiracy theories – a procedural approach. This approach promises to establish that belief in conspiracy theories is rationally criticisable in general. Unlike most philosophical approaches, a procedural approach does not purport to condemn conspiracy theorists directly on the basis of features of their theories. Instead, it focuses on the patterns of thought involved in forming and sustaining belief in such theories. Yet, unlike psychological approaches, a (...) procedural approach provides a rational critique of conspiracist thought patterns. In particular, it criticises these thought patterns for failing to conform to procedures prescribed by reason. The specific procedural approach that I develop takes its cue from the Kantian notion that reason must be used self-critically. I tentatively suggest that conspiracy theorists fail to engage in the relevant sort of self-critique in at least three ways: they do not critically examine their own motivations, they avoid looking at matters from the point of view of others, and they fail to reflect on the limits of human knowledge. _Purpose__._ This article aims at outlining the socio-communicative prerequisites for the influence of personality on the acquisition of rigorous scientific knowledge. _Theoretical__ basis__._ The communicative foundations of an individual’s activity in general and the functioning of his consciousness in particular were laid by the philosophy of Edmund Husserl, primarily due to his introduction of the concepts of "intersubjectivity" and "lifeworld". From these positions, attempts were made to understand the discussion of Karl Popper and Thomas Kuhn regarding the role of the (...) individual in science, in particular, the concept of a "normal scientist" as a participant in the lifeworld of scientists who support special intersubjective norms of reproduction of this lifeworld through scientific communication. The concept of "communicative mind", correlated with the philosophy of Jürgen Habermas, best expresses the rational and argumentative principles of achieving consensus in science. _Originality__._ Social anthropology reveals the constitutive significance of teamwork in science as a way of achieving rigorous scientific knowledge. Social phenomenology concretizes this by emphasizing the need for constant improvement of the rules of this communication. The verification of scientific knowledge by facts is strictly determined by the observance of community-recognized scientific tools for achieving such verification, in particular, the conventional agreement within a certain community of scientists regarding the language of science, which is used to describe verification, falsification, and other procedures for organizing scientific knowledge into a system. _Conclusions._ Verification of the obtained scientific knowledge critically depends on the formulation, dissemination and observance of certain institutional rules of scientific communication. This applies, in particular, to the conventionally recognized rules for the verification of scientific knowledge by empirical facts: it is not an isolated scientist who should identify, verify, organize and evaluate empirical facts, but a community of scientists who conduct scientific research in an organized manner. Team scientific work is a special case of collective action, which is characterized by a high level of reflection and application of critical thinking on a communicative basis. In particular, the legitimation of acquired scientific knowledge occurs in the process of scientific research due to the observance of procedural rules and careful work with empirical facts. The paper presents a pioneering approach to assessing the effectiveness of innovation processes in logistics. Indicators and the procedure of evaluating the efficiency of innovation processes in enterprise logistic activity are described. Possibilities of applying this approach are suggested.

His own approach to aesthetics was unusually pure. Frank Sibley wrote lapidary essays that remain models of a type of philosophical prose in which distinctions are carefully drawn, arguments are patiently developed, and a clarity of overall conception is achieved through a great economy of means. The virtues most often mentioned in connection with Sibley are those of this type of prose. But his philosophical approach was pure in another—and more substantive—sense too. Sibley characteristically investigated conceptual issues that (...) were identifiable without regard to specific aesthetic contexts. For instance, when Sibley discussed gracefulness, the particular point he had in mind could, if he so chose, be made about a vase, a line in a painting, the arch of a person’s eyebrow, or a pebble. We might think that such a procedure would severely constrain the interestingness of what an aesthetician has to say, and yet time and again Sibley shows us how much there is to gain from it. If being a phenomenologist means having a keen eye for elusive but potentially vital features of our experience, then Sibley, as a phenomenologist of the aesthetic, has no peers. (shrink)

The majority of the currently flourishing theories of actual causation are located in a broadly counterfactual framework that draws on structural equations. In order to account for cases of symmetric overdeterminiation and preemption, these theories resort to rather intricate analytical tools, most of all, to what Hitchcock has labeled explicitly nonforetracking counterfactuals. This paper introduces a regularity theoretic approach to actual causation that only employs material conditionals, standard Boolean minimization procedures, and a stability condition that regulates the behavior of (...) causal models under model expansions. Notwithstanding its lightweight analytical toolbox, this regularity theory performs at least as well as the structural equations accounts with their heavy appliances. (shrink)

Due to their non-hierarchical structure, socio-technical networks are prone to the occurrence of the problem of many hands. In the present paper an approach is introduced in which people’s opinions on responsibility are empirically traced. The approach is based on the Rawlsian concept of Wide Reflective Equilibrium (WRE) in which people’s considered judgments on a case are reflectively weighed against moral principles and background theories, ideally leading to a state of equilibrium. Application of the method to a hypothetical (...) case with an artificially constructed network showed that it is possible to uncover the relevant data to assess a consensus amongst people in terms of their individual WRE. It appeared that the moral background theories people endorse are not predictive for their actual distribution of responsibilities but that they indicate ways of reasoning and justifying outcomes. Two ways of ascribing responsibilities were discerned, corresponding to two requirements of a desirable responsibility distribution: fairness and completeness. Applying the method triggered learning effects, both with regard to conceptual clarification and moral considerations, and in the sense that it led to some convergence of opinions. It is recommended to apply the method to a real engineering case in order to see whether this approach leads to an overlapping consensus on a responsibility distribution which is justifiable to all and in which no responsibilities are left unfulfilled, therewith trying to contribute to the solution of the problem of many hands. Medical professionals often deny patients who inject opioids a second or third heart valve replacement, even if such a surgery is medically indicated. However, such a position is not well defended. As this paper demonstrates, the ethical literature on the topic too often fails to develop and apply an ethical lens to analyse the issue of multiple valve replacements. This paper addresses this lacuna by analysing the case of Mr Walsh, a composite case which protects the identity of any one (...) patient, through the principlist approach of Beauchamp and Childress. It argues that the hospital should offer Mr Walsh, a second valve replacement because the procedure is: medically indicated, autonomously requested, non-maleficent, beneficent and does not violate a formal account of justice. The paper concludes with clinical ethical guidelines for valve surgery for patients with opioid use disorder. (shrink)

The 2010s were a golden age of information privacy research, but its policy accomplishments tell a mixed story. Despite significant progress on the development of privacy theory and compelling demonstrations of the need for privacy in practice, real achievements in privacy law and policy have been, at best, uneven. In this chapter, I outline three broad shifts in the way scholars (and, to some degree, advocates and policy makers) are approaching privacy and social media. First, a change in emphasis from (...) individual to structural approaches. Second, increasing attention to the political economy of privacy—especially the business models of information companies, such as social media platforms. And third, a deeper understanding of privacy’s role in a healthy digital public sphere. (shrink)

Scientific realism asserts that the methods of science, combined with the intellectual powers of human beings can give us reliable knowledge of states of the world beyond the limits of perception. Among the varieties of realism, policy realism is based on the principle that taking plausible theories to be putative descriptions of actual states of affairs is the best way to design experiments and to advance our knowledge. We carve out the umwelt from the welt by the use of our (...) instruments and apparatus. The key procedure in science has been and still is the invention and testing of models---plausibility and empirical adequacy are the marks of a theory based on a model capable of supporting policy realism. Social ontological inquiry has been pursued in analytic philosophy as well as in the social scientific tradition of critical realism. These traditions have remained largely separate despite partly overlapping concerns and similar underlying strategies of argumentation. They have also both been the subject of similar criticisms based on naturalistic approaches to the philosophy of science, which have addressed their apparent reliance on a transcendental mode of reasoning, their seeming distance from social scientific practice, and their (erroneous?) tendency to advocate global (...) solutions to local and pragmatic problems. Two approaches aiming to naturalize these two traditions of social ontology have been proposed in recent years: one drawing on a Gierean, model-based approach to scientific practice, the other drawing on inference to the best explanation. In our paper, we compare and contrast these naturalistic approaches to social ontology in terms of their capacity to respond to the aforementioned challenges. We also defend a form of methodological pluralism, according to which there are multiple different naturalistically acceptable approaches to social ontology, which emphasize contrasting procedural continuities between social scientific research and philosophical practice. Emotions are often met with suspicion in political debates about risky technologies, because they are seen as contrary to rational decision making. However, recent emotion research rejects such a dichotomous view of reason and emotion, by seeing emotions as an important source of moral insight. Moral emotions such as compassion and feelings of responsibility and justice can play an important role in judging ethical aspects of technological risks, such as justice, fairness, and autonomy. This article discusses how this idea can (...) be integrated into approaches for political decision making about risk. The article starts with an analysis of the dichotomous view of reason and emotion in risk theory, in approaches to participatory risk assessment as well as in relevant approaches to political philosophy. This article then presents alternative approaches in political philosophy and political theory that do explicitly endorse the importance of emotions. Based on these insights, a procedural approach for policy making is presented, in which emotional responses to technological risks, and the ethical concerns that lie behind them, are taken seriously. This approach allows for morally better political decisions about risky technologies and a better understanding between experts and laypeople. (shrink)

We present a new approach to measurement theory. Our definition of measurement is motivated by direct laboratory procedures as they are carried out in practice. The theory is developed within the quantum logic framework. This work clarifies an important problem in the quantum logic approach; namely, where the Hilbert space comes from. We consider the relationship between measurements and observables, and present a Hilbert space embedding theorem. We conclude with a discussion of charge systems.

The paper discusses the myth of the founding of Vilnius as an example of a myth of city foundation. The myth has received two independent semiotic interpretations. Narrative grammar procedures are applied to the analysis of the mythical story and the semantic code generating the story in the paper “Gediminas’ Dream (Lithuanian myth of city foundation: an attempt at analysis)” by Algirdas Julien Greimas (1971). The sovereignty ideology expressed in the myth, which describes religious and spiritual culture of the Grand (...) Duchy of Lithuania, is linked to the tri-functional model of the Indo-European social structure. The semantics of the Vilnius myth is seen as analogous with such Indo-European myths as king’s accession to the throne and creation of a city-state. The Lithuanian myth of Vilnius is linked paradigmatically to the Indo-European mythology in the study “Vilnius, Wilno, Vil’na: City and myth” by Vladimir Toporov (1980). At the level of the signifier, phonological equivalents of toponyms of Vilnius are traced. At the level of the signified, transformations of the “core” Indo-European myth are identified. The myth of the city foundation can be read both as a figurative form of cultural expression and as an ideology narrated as a plot of a story. In this view, the paradigmatic and syntagmatic approaches complement each other. (shrink)

We prove that the observational equivalence of third-order finitary Idealized Algol is decidable using Game Semantics. By modelling the state explicitly in our games, we show that the denotation of a term M of this fragment of IA is a compactly innocent strategy-with-state, i.e. the strategy is generated by a finite view function fM. Given any such fM, we construct a real-time deterministic pushdown automaton that recognizes the complete plays of the knowing-strategy denotation of M. Since such plays characterize observational (...) equivalence, and there is an algorithm for deciding whether any two DPDAs recognize the same language, we obtain a procedure for deciding the observational equivalence of third-order finitary IA. Restricted to second-order terms, the DPDA representation cuts down to a deterministic finite automaton; thus our approach gives a new proof of Ghica and McCusker’s regular-expression characterization for this fragment. Our algorithmic representation of program meanings, which is compositional, provides a foundation for model-checking a wide range of behavioural properties of IA and other cognate programming languages. Another result concerns second-order IA with full recursion: we show that observational equivalence for this fragment is undecidable. (shrink)

Before COVID-19, dementia singing groups and choirs flourished, providing activity, cognitive stimulation, and social support for thousands of people with dementia in the UK. Interactive music provides one of the most effective psychosocial interventions for people with dementia; it can allay agitation and promote wellbeing. Since COVID-19 has halted the delivery of in-person musical activities, it is important for the welfare of people with dementia and their carers to investigate what alternatives to live music making exist, how these alternatives (...) are delivered and how their accessibility can be expanded. This community case study examines recent practice in online music-making in response to COVID-19 restrictions for people with dementia and their supporters, focusing on a UK context. It documents current opportunities for digital music making, and assesses the barriers and facilitators to their delivery and accessibility. Online searches of video streaming sites and social media documented what music activities were available. Expert practitioners and providers collaborated on this study and supplied input about the sessions they had been delivering, the technological challenges and solutions they had found, and the responses of the participants. Recommendations for best practice were developed and refined in consultation with these collaborators. Over 50 examples of online music activities were identified. In addition to the challenges of digital inclusion and accessibility for some older people, delivering live music online has unique challenges due to audio latency and sound quality. It is necessary to adapt the session to the technology's limitations rather than expect to overcome these challenges. The recommendations highlight the importance of accessibility, digital safety and wellbeing of participants. They also suggest ways to optimize the quality of their musical experience. The pandemic has prompted innovative approaches to deliver activities and interventions in a digital format, and people with dementia and their carers have adapted rapidly. While online music is meeting a clear current need for social connection and cognitive stimulation, it also offers some advantages which remain relevant after COVID-19 restrictions are relaxed. The recommendations of this study are intended to be useful to musicians, dementia care practitioners, and researchers during the pandemic and beyond. (shrink)

Contemporary societies are riddled with moral disputes caused by conflicts between value claims competing for the regulation of matters of public concern. This familiar state of affairs is relevant for one of the most important debates within liberal political thought: should institutions seek to realize justice or peace? Justice-driven philosophers characterize the normative conditions for the resolution of value conflicts through the establishment of a moral consensus on an order of priority between competing value claims. Peace-driven philosophers have concentrated, perhaps (...) more modestly, on the characterization of the ways in which competing value claims should be balanced, with a view to establishing a _modus vivendi _aimed at containing the conflict. _Interactive Justice _addresses an important question related to this debate: on what terms should the parties interact _during_ their conflict for their interaction to be morally acceptable to them? Although largely unexplored by political philosophers, this is a main area of concern in conflict management. Building on a proceduralist interpretation of "relational" concerns of justice, the author develops a liberal normative theory of interactive justice for the management of value conflict in politics grounded in the fundamental values of fair hearing and procedural equality. This book innovatively builds a bridge between works in political philosophy and peace studies to propose a fresh lens through which to view the normative responses liberal institutions ought to give to value conflict in politics, and moves beyond the apparent dichotomy between pursuing end-state justice through conflict resolution or peace through conflict containment. Those procedures which, at some future date, could constitute the operations resulting in the cloning of a human being are defined as a tool. As humans have been using tools for some two million years, sets of rules or ethics have been devised to make sure that tools are used to promote the maximum benefit and cause the minimum harm. It would, therefore, seem appropriate to consider the human cloning process as one such tool and approach the ethical issues (...) which might govern its use in a manner which has been informed by how we have approached similar instances of new tool development. In this we can be guided by a range of thought experiments and practical considerations. When we combine these two facilities we may conclude that there are some benefits to be gained by the use of the human cloning tool, while there are other aspects of the use of the tool that need to be carefully controlled and regulated. An outline of a pragmatic approach to the initial uses of the tool is described. (shrink)

Many Sides is the first full-length study of Protagorean antilogic, an argumentative practice with deep roots in rhetorical history and renewed relevance for contemporary culture. Founded on the philosophical relativism of Protagoras, antilogic is a dynamic rather than a formal approach to argument, focused principally on the dialogical interaction of opposing positions (anti-logoi) in controversy. In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. In (...) turn, Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms. Respect for patient autonomy is paramount in resolving ethical tensions in end-of-life care. The concept of relational autonomy has contributed to this debate; however, scholars often use this concept in a fragmented manner. This leads to partial answers on ascertaining patients’ true wishes, meaningfully engaging patients’ significant others, balancing interests among patients and significant others, and determining clinicians’ obligations to change patients’ unconventional convictions to enhance patient autonomy. A satisfactory solution based on relational autonomy must incorporate patients’ competence (apart from (...) decisional capacity), authenticity (their true desires or beliefs) and the involvement level of their significant others. To that end, we argue that John Christman’s procedural approach to relational autonomy provides critical insights, such as the diachronic or socio-historical personhood, sustained critical reflection and his recent explication of the nature of asymmetrical relationships and helpful interlocutors. This study reviews Christman’s account, proposes minor modifications and advocates for an integrated three-dimensional model for medical decision-making. Clarifying the relationship among the three elements promotes an ethical framework with a coherent understanding of relational autonomy. This model not only provides a descriptive and normative framework for end-of-life care practice but also reconsiders the nature of the clinician–patient relationship and its normative implications. We further present a case study to illustrate the merits of our proposed model. Altogether, our proposal will help navigate complex medical decision-making, foster trust and negotiate shared values between patients and their significant others, particularly in end-of-life care. Over the past 50 years, technical advances have taken place in medicine that have greatly increased the possibilities of life-prolonging intervention. The increased possibilities of intervening have brought along new ethical questions. Not everything that is technically possible is appropriate in a specific case: not everything that could be done should be done. In the 1980s, a new term was coined to indicate a class of inappropriate interventions: “medically futile treatment”. A debate followed, with contributions from the USA and several (...) western European countries. A similar debate later took place in Mediterranean countries, although with a different terminology. The purpose of this article is to provide an up-to-date and systematic analysis of the concept of futility, and to draw some conclusions on its operationalisation in medical practice. While the concept of “medical futility” in theory applies to all kinds of medical intervention that might be performed without being medically indicated—things such as certain medical screenings and cosmetic surgery—in practice the literature on “futility” deals only with life-saving and life-sustaining medical interventions. This article deals with this more limited application of the concept of “futility”. (shrink)

In this chapter I examine how expected-value theory might inform responses to what I call the dual-use problem. I begin by defining that problem. I then outline a procedure, which invokes expected-value theory, for tackling it. I first illustrate the procedure with the aid of a simplified schematic example of a dual-use problem, and then describe how it might also guide responses to more complex real-world cases. I outline some attractive features of the procedure. Finally, I consider whether and how (...) the procedure might be amended to accommodate various criticisms of it. (shrink)

As children and adolescents receive increased research attention, ethical issues related to obtaining informed consent for pediatric intervention research have come into greater focus. In this article, we conceptualize parent permission and child assent within a goodness-of-fit framework that encourages investigators to create consent procedures “fitted” to the research context, the child's cognitive and emotional maturity, and the family system. Drawing on relevant literature and a hypothetical case example, we highlight four factors investigators may consider when constructing consent procedures that (...) best reflect participants' rights, concerns, and well-being: (a) the child's current assent capacity and the likely impact of study information on the child's mental and physical development, (b) parents' understanding of their child's treatment needs and distinctions between treatment and clinical trials research, (c) the family's history of shared decision making, and (d) the child's strivings for autonomy within the context of their parents' duty to make decisions in the child's best interest.
