ABSTRACT Regarding an already consolidated tradition in discourse studies in Latin America, with featured importance in graduate programs in the field of Linguistics and a busy calendar of annual events in the field, it is possible to say that there is considerable amount of imported knowledge being applied and very little creativity in local theoretical or methodological production. Discourse studies are generally divided into two main schools of thought: French discourse analysis and English discourse analysis. The denomination that represents these (...) lines of discourse sheds light on the colonized nature of the field. This colonization of discourse knowledge, in more immediate terms, indicates considerable effort applied to theories viewed as universally valid and scarcely modified for the situated context, but it also shows the implications of being a discourse analyst in a subordinate space within the academic field – a place where we, Latin American discourse researchers, occupy compared to our colleagues in the global North – and about contemplating theoretical alternatives. The decolonizing effort of this field should thus be directed to three converging paths: decolonizing knowledge, in the sense of criticizing theories and methods while understanding that there is no universal knowledge; decolonizing the power of the creative act of overcoming this universalizing knowledge, which means accepting the force of local methodological and theoretical production, especially by constantly questioning disciplinary separation and its impositions; and decolonizing the being, making strategic use of this paradoxical space, which contains the possibilities of knowledge communion, also including common knowledge. All this should have an impact on graduate-level education in discursive studies, in a virtuous cycle between consciousness, criticism and creativity. (shrink)

This article examines one aspect of the criticism of inauthenticity that can be levelled against the trustworthiness of professional relationships in general and nurse-patient relationships in particular. The overall question is: are such relationships inherently trustworthy or untrustworthy, from the patient’s point of view? The author concludes that, in spite of legitimate grounds for concern, and while it remains true that nurse-patient relationships may be untrustworthy, they are not inherently so for reasons of inauthenticity relating to emotional labour. The arguments (...) used to defend this claim take their force from the idea that different criteria may be needed to assess the authenticity of nurse-patient relationships from those used to evaluate authenticity in ordinary social relationships. The utility of Hochschild’s idea of ‘deep’ acting, as offering a useful model for the management of emotions in nursing, is examined and rejected. (shrink)

On Aquinas’s account of this virtue, martyrdom fits best as its paradigm act. By this choice of paradigm, he underscores the way that the virtues of faith, hope, and charity inform courage, and the way grace infuses virtue and produces a joy that can overcome even the greatest fear and sorrow this world has to offer. Martyrdom, as the exemplar act of courage, is best suited to illustrate the features of this virtue so as to counter any mistaken conceptions of (...) courage—those relying solely on human power and control— that ancient and modern ideals alike might tempt us to hold. Aquinas’s choice ofmartyrdom as his paradigm introduces new dimensions of courage and redefines the standard elements of other portraits. His paradigm introduces a new understanding of power, one that resists the world’s eager use of force and offers grace-filled possibilities for human beings precisely in their vulnerability and weakness. Aquinas’s portrait of courage supplies new dimensions of love to counteract fear, and transforms the basis of hope and daring from human heroics to a relationship of humble dependence on divine assistance. In doing so, it also opens up this virtue to an entirely new range of practitioners. The infant in the baptismal waters is a fitting picture of human frailness and trust before the gift of divine grace and power, and captures the essential point of Aquinas’s baptismal transformation of courage. By modeling courage on the example of Christ’s own suffering and steadfast witness, Aquinas directs our moral gaze beyond the limits of human life and power to a life in which virtue and happiness are perfected by a power that is both beyond us and yet can become our own. Here we extend the logical treatment for assertions given by Dalla Pozza and Garola by outlining a pragmatic logic for assertions and hypotheses. We formulate a pragmatic square of oppositions for assertions and a hexagon of oppositions for hypotheses. Radical self-silencing is a particular variety of speech act disablement where the subject silences themselves, whether knowingly or not, because of their own faults or deficiencies. The paper starts with some concrete cases and preparatory comments to help orient and motivate the investigation. It then offers a summary analysis, drawing on a small number of basic concepts to identify its five individually necessary and jointly sufficient conditions and discriminating their two basic forms, ‘internalist’ and ‘externalist’. The paper then explicates and (...) defends what has been proposed, where the most salient and pressing objections concern the use of two basic concepts: ‘uptake’ and ‘silencing’. ABSTRACTIn the seventeenth century, when the modern Self emerged in the shape of a self-assured Cartesian cogito, a radically opposite movement of ‘emptying’ or ‘deconstructing’ that Self took place. The religious subject, having become modern, understood its ultimate aim as becoming selfless. The battlefield on which the new subject fought the fight with its own modern condition was the issue of ‘love’. ‘What is the status of his Self when it is involved in the act of love?’ was the central (...) question in seventeenth century religiosity. This essay examines the early modern idea of pur amour and focuses only on two voices in the Querelle Du Quiétisme, François de Fénelon and Nicolas Malebranche. Fénelon vehemently defended the pur amour, a concept he adopted from a century-long tradition of spirituality in France and which he tried to explain and legitimize in a systematic and theoretical way. Malebranche was highly critical of that tradition, but refused neither to use the term nor to refer to the ideal of pur amour. His interpretation of the Self, however, forced him to draw different conclusions on the nature of pure love. (shrink)

This article deals with the reframing of the concept of universal mediated communication on a global scale. Subjects include the following: the universe has a conscious force field at all its scales, requiring continuous inter-scale communication of information; the field exhibits distinct electromagnetic frequencies associated with the building blocks of life; and advances in the technology of sound production with electronic synthesizers can be applied to study mechanisms of such universal communication. The question being addressed is how electronic synthesizers (...) can be used to create sonic xenolinguistic expressions when composing with sonified frequencies obtained from bio-organisms, human protein structures, phonemes and various types of interstellar frequencies that include, but are not limited to, gamma bursts, pulsars and neutron stars. The objective is to construct sonic xenolingusitic expressions that can act like feedback loops within the field of consciousness. These sonic expressions can include anomalous cognitive, emotive or spiritual experiences that may be emerging out of the universal field of consciousness in real time. Xenolinguistics is a hypothetical language used to communicate with other sentient beings in the universe. The rationale for composing sonic xenolingustic expressions is the belief that the universe is considered conscious and that there is a field of consciousness existing throughout the universe that in principle is also instrumental in how communication can evolve with extraterrestrials. Outlines of other attempts at extraterrestrial communication by other researchers will be offered based on current literature. The probability that other life forms have established some mode of information exchange that is detectable and that, in return, may be able to create a form of communication to respond will be covered. It is postulated that various energy fields existing before and after the creation of our universe interacted with one another becoming abiotic, and then over time, formed even more complex structures. It is these complex structures that were then able to communicate essential information for maintaining their stability and survivability by using specific signalling frequencies. It is hypothesized that first life in the universe emerged within an already existing field of information and that our consciousness is thereby able to establish communication with other forms of consciousness in the universe. It is on this basis that a novel scientific and philosophical paradigm is considered in which the universe is conceived of as an active information matrix that can entertain potential extraterrestrial communication. In this framework, the present article will offer a new approach to orchestrated electronic sounds as a means to such communication. By integrating quantum physical properties into that sonic framework, a new study emerged on how sonic xenolinguistic elements can be incorporated into electronic composition techniques. This new framework may produce new algorithms for musical expression that not only represent an innovative future of electronic music but may also be crucial in the formulation and induction of new states of consciousness that will enable humankind to directly participate in the further becoming of the universe as a result of the evolution of this universal field of consciousness. Democratic societies expect their armed forces to act in a morally responsible way, which seems a fair expectation given the fact that they entrust their armed forces with the monopoly of violence. However, this is not as straightforward and unambiguous as it sounds. Present-day military practices show that political assignments, social and cultural contexts, innovative technologies and organisational structures, present military personnel with questions and dilemma’s that can have far-reaching consequences for all involved – not in the last place for (...) the soldiers themselves. A thorough training and education, in which critical thinking is developed and stimulated, seems therefore a necessary condition for morally responsible behaviour. For it is as doing things that the speech act approach in analytic philosophy of language tries to understand all utterances. Taking such an approach, this book offers ways to enhance our appreciation of poetry and to develop our understanding of philosophy. It explores work by a range of poets from Chaucer to Geoffrey Hill and J. H. Prynne, and culminates in an extended study of Shakespeare's Sonnets. What work does poetry set itself, and how does this determine the way it is to be judged? What do poets commit themselves to, and what they may be held responsible for? What role does a poet have, or their audience, or their context, in determining the meaning of a poem, what work it is able to achieve? It has come to our attention that in the original article [1] information regarding dates was omitted. The data in this study were obtained in Switzerland four years before the entering into force of the new Swiss Human Research Act in 2014, when the guidelines of the Swiss Academy of Medical Sciences ceased to apply. It is important for readers to know that at the time of the study there was no binding law in Switzerland, only the more open (...) SAMS guidelines that have a different legal status. Einstein knew and accepted some philosophical ideas similar to Bridgman's operationalism, at the time when he developed the theory of relativity. It is possible to detect the influence of those ideas both in the special and the general theories. Some of the basic steps taken by Einstein were essentially operationalistic: they could not be justified without epistemological principles of that kind. The common opinion is held that the special theory of relativity embodied a complete and coherent operational elucidation of physical (...) magnitudes. This paper, however, points out some instances of physical magnitudes used in special relativity – such as the force that acts upon a moving body, its mass and its temperature – that could not be measured. It is claimed that this shows an early empistemological inconsistency in Einstein's work. RESUMO: Einstein conhecia e aceitava idéias filosóficas aparentadas ao operacionalismo de Bridgman na época em que desenvolvia a teoria da relatividade. Pode-se detectar essa influência nas teorias especial e geral da relatividade. Alguns dos passos básicos de Einstein foram essencialmente operacionalistas. Assim, é comum a opinião que supõe ter sido completamente efetuada, na teoria especial, de modo coerente, a elucidação operacional das grandezas físicas. Neste artigo, porém, apresentam-se exemplos de grandezas físicas utilizadas na relatividade especial – como a força que age sobre um corpo em movimento, sua massa e sua temperatura – que não eram mensuráveis. Joint practical deliberation is the activity of deciding together what to do. In this dissertation, I argue that several speech acts that we can use to alter our moral obligations – promises, offers, requests, demands, commands, and agreements – are moves within joint practical deliberation. -/- The dissertation begins by investigating joint practical deliberation. The resulting account implies that joint deliberation is more flexible than we usually recognize, in two ways. First, we can make joint decisions not only about what (...) we will do together, but also about what you or I will do alone. Second, we can deliberate by means of two distinct methods: propose-and-ratify, in which a proposed joint decision must be explicitly accepted to come into effect, and propose-and-challenge, in which a proposed joint decision comes into force unless it is explicitly challenged. -/- Varying these parameters generates a botany of different kinds of proposals we can make within joint deliberation. When we look at these proposals more closely, we make a surprising discovery: for each kind of proposal we can make in joint practical deliberation, there is an everyday speech act with the very same properties. A certain kind of proposal to make a joint decision regarding one’s own actions has the same normative effects, under the same conditions, as a promise. One kind of proposal to make a joint decision regarding one’s addressee’s actions has all the essential features of a command; another kind of deliberative proposal – with the same content but a different method of evaluation – looks exactly like a request. And so on. -/- These similarities are too systematic to be coincidental. The only explanation, I argue, is that these ordinary speech acts are identical to their doppelgängers within joint practical deliberation. Promises and offers are proposals to make joint decisions about what I will do. Commands, demands, and requests are proposals to make joint decisions about what you will do. And agreements are joint decisions about what we will do. Call this the deliberative theory of these speech acts. -/- Considering each speech act in turn, I defend the deliberative theory by arguing that it provides a uniquely powerful explanation of its targets’ social and moral significance. Once we see how naturally these speech acts fall out of our practice of joint deliberation, theories that treat them as sui generis – as many moral philosophers now do – will come to seem redundant and nonexplanatory. Conversely, thinking of promises, offers, commands, demands, requests, and agreements as moves within joint practical deliberation allows us to give an elegant and generative theory of these phenomena that have confounded moral philosophers for so long. A rigorous ab initio derivation of the (square of) Dirac’s equation for a particle with spin is presented. The Lagrangian of the classical relativistic spherical top is modified so to render it invariant with respect conformal changes of the metric of the top configuration space. The conformal invariance is achieved by replacing the particle mass in the Lagrangian with the conformal Weyl scalar curvature. The Hamilton-Jacobi equation for the particle is found to be linearized, exactly and in closed form, by (...) an ansatz solution that can be straightforwardly interpreted as the “quantum wave function” of the 4-spinor solution of Dirac’s equation. All quantum features arise from the subtle interplay between the conformal curvature acting on the particle as a potential and the particle motion which affects the geometric “pre-potential” associated to the conformal curvature itself. The theory, carried out here by assuming a Minkowski metric, can be easily extended to arbitrary space-time Riemann metric, e.g. the one adopted in the context of General Relativity. This novel theoretical scenario appears to be of general application and is expected to open a promising perspective in the modern endeavor aimed at the unification of the natural forces with gravitation. The Belgian Act on Euthanasia came into force on 23 September 2002, making Belgium the second country—after the Netherlands—to decriminalize euthanasia under certain due-care conditions. Since then, Belgian nurses have been increasingly involved in euthanasia care. In this paper, we report a qualitative study based on in-depth interviews with 18 nurses from Flanders (the Dutch-speaking part of Belgium) who have had experience in caring for patients requesting euthanasia since May 2002 (the approval of the Act). We found that the (...) care process for patients requesting euthanasia is a complex and dynamic process, consisting of several stages, starting from the period preceding the euthanasia request and ending with the aftercare stage. When asked after the way in which they experience their involvement in the euthanasia care process, all nurses described it as a grave and difficult process, not only on an organizational and practical level, but also on an emotional level. “Intense” is the dominant feeling experienced by nurses. This is compounded by the presence of other feelings such as great concern and responsibility on the one hand, being content in truly helping the patient to die serenely, and doing everything in one’s power to contribute to this; but also feeling unreal and ambivalent on the other hand, because death is arranged. Nurses feel a discrepancy, because although it is a nice death, which happens in dignity and with respect, it is also an unnatural death. The clinical ethical implications of these findings are discussed. (shrink)

Nos manières de rendre la Justice s’inscrivent dans un système général et a priori paradoxal : pour juger, les procès construisent une narration individualisante des acteurs et des causes de leurs (...) actes ; mais, pour réprimer, ils transforment chaque action interindividuelle en agression contre la «société» ou contre l’Etat. Comment comprendre ce système du jugement et de la répression et ce jeu des catégories pénales? La Loi est souvent présentée comme instaurant le règne de la raison contre les réactions passionnelles. Ne produit-elle pas en réalité des effets de dépossession et du traumatisme? A quelles conditions une sociologie critique pourrait-elle nous donner les moyens d’imaginer un droit moins violent, un Etat moins souverain et une justice plus démocratique? En mêlant récits et analyses théoriques, Geoffroy de Lagasnerie montre que l’institution judiciaire ne forme pas seulement une réponse à la délinquance. La scène du tribunal, où un individu est forcé de comparaître devant des juges, est un miroir grossissant de notre appartenance à l’Etat. Si bien que, au bout du compte, cet ouvrage offre une exploration de notre condition de sujet politique. The closely related debates concerning abortion, the protection of the embryo and stem cell science have captured the legislative agenda in Mexico in recent years. This paper examines some contemporary debates related to stem cell science and the legal and political action that has followed in the wake of the latest Supreme Court judgment on abortion, which debates are directly linked to the degrees of protection of the embryo stipulated in the Mexican Constitution. While some Mexican states have opted to (...) take no further action, others, where conservative political forces are in the majority, have been very active in seeking to ensure that their constitutions are amended to protect human life from conception onwards. This intense legislative activity has not, however, been repeated at the federal level, where there is currently no overarching national regulatory framework governing stem cell research. Although major efforts have been made by the conservative block within the Senate to bring forward legislative proposals for the prohibition of human embryonic stem cell research, and despite the public expression by the federal government of its commitment to encourage inward investment and innovation in the area of biotechnology, stem cell science has, so far, remained unregulated. The legislative challenge is to resist the pressure that has been injected by religious leaders and to act in accordance with the values and principles adopted by the community in the Mexican Constitution. In the final analysis, Mexico faces particular difficulties in accommodating conservative political forces on one hand, while recognising on the other its need, as an emerging economy, to promote a progressive approach to innovation in biotechnology. Moreover, by distinguishing the ideal meanings from the psychic realities of the act, it chased its followers from the quagmire of psychic genesis, causal justification and rational "proof" of the religious object, and forced them to concentrate on the intentional terminus of the experience. In ways accentuated by the global coronavirus pandemic, corporations constitute vital instruments of the acts of beneficence needed by the people of the world to make progress in public health and increase collective and individual well-being. This article contributes to understanding the variety of moral forces that may lead corporations to commit acts of beneficence, including Friedman’s business case for corporate beneficence, the duty of beneficence as developed by business ethicists, and Dunfee’s social contract account of corporate obligation. Whereas Mejia (...) recently contributed to scholarship on corporate beneficence by expressly adopting shareholder primacy’s conception of corporate governance, this article embraces a stakeholder-oriented, managerialist picture of corporate governance. I extend the literature on beneficence by incorporating what I argue is the intuition underlying Dunfee’s contractualist formula of minimal contribution, namely that management’s duty to do good is awakened and unshackled to the extent management judges the corporation can afford to commit acts of beneficence, all stakeholders considered. The all-stakeholders-considered case for corporate beneficence compels management to act, I argue, when inaction would undermine the moral integrity of managers personally committed to promoting the well-being of humanity. There is a general consensus that the concept of "absolute evil" was coined in order to account for the moral atrocities of the twentieth century. The connotations associated with such a concept are usually threefold: such an evil is not to be understood negatively as a privation of goodness, but as a positive force; such an evil can not be accommodated into any onto-theological order of being, but rather refers to the collapse of such an order; such an evil (...) is diabolical, motivated by the negation of moral law as such, and not by the pursuit of egoistic interests. Moreover, there is a general consensus that Kant's concept of "radical evil" is not radical enough to approximate to this excess of evil, specially since Kant categorically denies the possibility of devilishness. The purpose of this paper is to question this consensus. On the one hand, it is doubtful whether demonic interpretations can provide us with a deeper insight in the moral horrors of the twentieth century. They rather relieve us of our responsibilities, because they withdraw evil from our everyday experiences of weakness. On the other hand, it can be shown that Kant's idea of radical evil, notwithstanding his rejection of the demonic, is much more disturbing than is generally admitted: evil originates in an act of freedom, not in being overwhelmed by desire; the evil of hatred is already prefigurated in the banal evil of indifference; evil is enracinated in a "moral state of nature", where we can only develop our self-respect by continuously comparing ourselves with others, thus initiating ruthless forms of competition. The conclusion proposes to radicalize Kant's notion of evil, not in the direction of a demonic connotation, but in a direction indicated by Levinas: by referring to the experience of the victim. Only confronted with the suffering of others that is caused by me, my moral failure appears to be more than lack or privation: it is inherently excessive, since the victim experiences its own suffering as an intrinsic malignity that can not be accommodated into any order of being. Cet article aborde le problème du fonctionnement de l’attention à l’étape initiale du travail du cartographe. Il a pour base les concepts d’ attention flottante de Sigmund Freud, celui de reconnaissance attentive de Henri Bergson et les contributions de la phénoménologie aux sciences cognitives contemporaines. This article presents a conceptual discussion on the phenomenon of incorporation of tools and other objects in the light of Maine de Biran’s philosophy of the relation between the body and the motor will. Drawing on Maine de Biran’s view of the body as that portion of the material world which directly obeys one’s motor will, as well as on his view (supported by studies in contemporary cognitive science) of active touch as the perceptual modality that is sensitive to objects (...) as fields of forces resisting the perceiver’s movements, we discuss the phenomena of motor incorporation and haptic incorporation, as well as the relation between them. Motor incorporation occurs when something is integrated into the motor system, i.e. when practice enables one to animate an object as directly, effortlessly and fluently as one is able to animate one’s own body. The subject then has the experience of acting there, where the object is located, not at the body–object interface. In order to better understand the phenomenon of motor incorporation, we highlight the phenomenological difference between directly and indirectly moving something. Haptic incorporation occurs when something is integrated into the haptic system, i.e. when an object is used as an instrument for the haptic perception of other objects. Finally, we seek to shed light on the phenomenon of transparency, understanding the transparency acquired by the incorporated object as both a relational property and a matter of degrees. (shrink)

The impact of contextual influences on human resource management and management more generally has been the focus of much scholarly interest. However, we still know very little about how context impacts on the practice of ethical HRM specifically. Therefore, drawing on 59 in-depth interviews with HR practitioners in Brazil, Colombia and the UK, this paper theorizes how they perceive the ethical dimensions of their roles within their respective national contexts and how the way they act in relation to them is (...) informed, shaped and directed by the institutional context. In doing so it provides an important insight into three key themes: first, the views of HRM practitioners and managers about ethical HRM and how they articulate what it means to be ethical; second, how they respond to perceived ethical dilemmas; and third, how their responses are influenced by institutional forces and associated beliefs, values and scripts. In addition to providing an ‘emic’ perspective of this increasingly important topic and theorizing the experience and practice of ethical HRM, the paper answers calls for more international comparisons of ethical HRM practice in contemporary organizations. With the principle of tour de force, we refer to the use of the power of moral legality, the strength of statutes, and the fairness of judgments. A quantum force of moral legality and legal morality serves as an imperative force in the implementation of fair criminal justice, as well as in the prevention of future victims across the globe. Contrary to positivist ideas, the simple notion of morality contains within itself the very essence of international criminal (...) norms. If the source of morality did not exist in the structure of our criminal justice, we could no longer call it criminal justice and would instead have to call it criminal revenge. Beyond the moral essence of international criminal justice, we also challenge the hidden illegality and immorality of certain attitudes. This is done in order to prevent acts which violate human rights law and criminal justice provisions. The codes of international human rights law cannot properly function without the comprehensive nature of morality which elevates the moral virtue of international criminal justice and strengthens the tour de force. One may observe that the principle of the tour de force of the moral virtue within the system of international criminal justice loses its legal power when governments attempt to justify their unjust decisions. This is the main reason why the major potential value of the tour de force of the moral virtue of human rights law and international criminal justice is not as strong as it should be. In order to achieve a vision of the tour de force of moral virtue, we need to establish a devoted influential ethical vision of the truth beyond political tradition. Qu'est-ce qui, chez l'homme, retient ou empeche la fuite en avant d'une pulsion specifique? Une autre pulsion complementaire ou antagoniste? L'instance subjective d'un moi se pliant aux commandements du surmoi? L'ordre du corps vivant, de la raison ou du signifiant? Ou est-il pensable qu'une pulsion humaine se gouverne elle-meme en canalisant son energie excessive et en veillant a sa transformation ou a sa sublimation plutot que de se livrer a l'ivresse d'une repetition sterile?Ce livre aborde ces questions en envisageant les (...) pulsions humaines, en amont, depuis leur ancrage dans les forces de la nature ou les instincts animaux et, en aval, en vue de leur prolongement en desirs symboliquement structures. Dans une telle perspective, le questionnement psychanalytique de Freud et de Lacan rencontre tout naturellement les interrogations d'une philosophie de la nature, de la vie et de la culture. Inversement, une rehabilitation de l'energetique psychanalytique favorise la redecouverte d'une pensee philosophique, pour laquelle la dynamique des forces virtuelles prime sur la presence de substances statiques, et pour laquelle aucun acte effectif n'efface sa dette vis-a-vis d'un pouvoir-etre retenu ou d'un manque d'etre. De cette metaphysique dont le livre suit le cheminement d'Aristote a Husserl en passant par Leibniz et Schopenhauer, Nietzsche et la psychanalyse marquent aussi les limites, en projetant sur elle l'ombre du nihilisme des pulsions de mort. A ceux qui se montrent désireux de saisir l'épaisseur politique et historique du droit constitutionnel, les différends opposant les corps constitués peuvent apparaître, dans leurs expressions les plus marquées, comme des objets d'étude particulièrement stimulants. En effet, ces conflits peuvent se présenter comme de singuliers laboratoires où devient brusquement visible la texture politique des lois constitutionnelles dont les dispositions sont parfois si fortement tissées d'incertitudes et d'ellipses qu'elles laissent soudain jaillir l'imprévisible. D'une part, le conflit constitutionnel n'est pas une simple (...) controverse constitutionnelle participant généralement d'un processus historique de pacification des différends politiques par le droit : d'autre part, il constitue un conflit politique dont la particularité réside dans le fait que les acteurs s'efforcent d'étayer leur raisonnement par des arguments juridiques tirés d'une lecture de la lettre constitutionnelle, chaque camp accusant la partie adverse d'une mésinterprétation ou d'une violation de ses dispositions. Lors d'une telle crise, mis à l'épreuve de sa propre force, le droit constitutionnel prend toute la mesure de l'indétermination et de la duplicité de ses règles. Qu'ils portent sur l'interprétation ou sur l'application des dispositions constitutionnelles relatives aux modalités d'exercice de la puissance étatique, les différends entre organes constitués peuvent ainsi, dans certaines circonstances, dépasser le stade de la simple controverse pour épouser la forme plus dense du conflit constitutionnel. En effet, quand la difficulté de mettre un terme au différend est telle que les processus de discussion et de délibération codifiés par le droit sont eux-mêmes impuissants à imposer une solution reconnue acceptable par tous les acteurs, le durcissement de la crise peut alors conduire à une situation qu'il est possible de qualifier de conflit constitutionnel. Aussi bien vit-il la naissance de l'Etat moderne, et le heurt de la tradition humaniste et chretienne avec l'ideologie du monstre froid qui n'aspire qu'a sa propre perpetuation et transcendance. Faut-il renoncer a incarner les valeurs? Faut-il les imposer par la violence a la violence deguisee du pouvoir? (...) Pascal ne laisse pas la verite sans force devant la force, mais il sait aussi l'injustice de la justice rebelle. Realiste sans machiavelisme, augustinien mais non augustiniste, il n'avance point tant une politique chretienne qu'un usage chretien du politique. (shrink)

Dick Popkin and James Force have attended a number of recent conferences where it was apparent that much new and important research was being done in the fields of interpreting Newton's and Spinoza's contributions as biblical scholars and of the relationship between their biblical scholarship and other aspects of their particular philosophies. Hegel is most famous for his view that conflicts between contrary positions are necessarily resolved. Whereas this optimism, inherent in modernity as such, has been challenged from Kierkegaard onward, many critics have misconstrued Hegel's own intentions. Focusing on the Science of Logic, this transformative reading of Hegel on the one hand exposes the immense force of Hegel's conception of tragedy, logic, nature, history, time, language, spirit, politics, and philosophy itself. Un verbe exprime en français l'un des secrets de notre être et l'une des clés de notre époque maniaco-dépressive : ce verbe, c'est revivre. Il a deux sens que tout paraît opposer. Revivre, c'est en effet renaître, retrouver le sentiment d'être vivant et relié à autrui. Mais c'est aussi se laisser rattraper par "un passé qui ne passe pas » et se replier sur soi-même. Chacun de nous fait cette double expérience, souvent sans le savoir. Il faut pourtant la penser, (...) l'affronter, résister à ce qui nous enferme, accéder à ce qui nous délivre. Inventaire de nos blessures et de nos ressources, diagnostic du moment présent, parcours dans les idées et les oeuvres, ces propos renouent avec les actes les plus intenses de notre vie. Un art de vivre, c'est-à-dire de revivre, qui pourrait bien être le seul possible aujourd'hui. (4e de couv.). (shrink)

[Omslag] La question du mal résonne à travers toute l'œuvre de Paul Ricoeur comme une énigme et un scandale : très présente dès les premières œuvres, dans Finitude et culpabilité ou dans Le conflit des interprétations, elle est également au centre de l'inédit Logique, éthique et tragique du mal chez saint Augustin et elle resurgit avec force dans l'essai, Le mal. Un défi à la philosophie et à la théologie. Il n'en est pas de même de la thématique du (...) pardon, qui n'est vraiment développée que dans les dernières œuvres, en particulier dans l'épilogue de La mémoire, l'histoire, l'oubli. Et pourtant, si, comme le dit Ricoeur, « la compassion vient briser le cercle vicieux de la culpabilité », n'est-ce pas à la lumière du pardon qu'il importe de revisiter la question de la faute et même l'excès du mal? C'est l'hypothèse que suggère cet ouvrage consacré à l'œuvre de Paul Ricoeur. Fruit d'une journée d'étude organisée conjointement par le Centre Sèvres - Facultés jésuites de Paris et le Fonds Ricoeur, à l'occasion du centenaire de la naissance de Paul Ricoeur, ce volume offre en outre un long inédit de Paul Ricoeur, qui éclaire la manière dont il a travaillé Augustin, mais aussi la genèse et l'évolution de sa pensée sur la question du mal. La pensée française a beaucoup perdu à se couper de la « psycho-philosophie » de l’entre-deux-guerres. Non seulement les injections massives de phénoménologie ont occulté les possibilités de jonction entre psychologie positive et métapsychologie, mais la nature des thèses inventées par Sartre et relayées par Deleuze, d’une individuation toujours solitaire et solipsiste, ont rendu incompréhensibles les processus de cogenèse des consciences.

Appartient-il au philosophe de fixer strictement la compréhension de notre concept d'art, ou doit-il limiter sa tâche à celle d'une clarification de ses usages? À cette question, les textes de Jean-Pierre Cometti réunis dans ce volume répondent en choisissant la voie d'une esthétique « minimale », qui renonce aux vertiges de l'ontologie et aux ambitions définitionnelle de la philosophie analytique de l'art, tout en prenant acte du caractère caduc des grands récits spéculatifs hérités de l'esthétique idéaliste ou des mirages (...) de la déconstruction. There is a long history and growing evidence base that the use of drugs, such as anabolic-androgenic steroids, to enhance human performance is common amongst armed forces, including in Australia. We should not be surprised that this might have occurred for it has long been predicted by observers. It is a commonplace of many recent discussion of the future of warfare and future military technology to proclaim the imminent arrival of Super Soldiers, whose capacities are modified via drugs, digital technology (...) and genetic engineering, in ways that increase their performance exponentially. This is what some observers have referred to as the “Gladiator Model” wherein the aim is to create soldiers able to perform feats of which ordinary citizens are not capable. One key aspect of this “gladiator project” is the use of illicit drugs to enhance performance. Could we use drugs, such as steroids or amphetamines, to enhance performance? Should we use such drugs? In this paper we explore the ethics of creating Super Soldiers, and raise issues of consent, coercion and the extent to which such use is permitted or condemned by just war theory. We conclude that much will depend on the extent to which such use is harmful to the soldiers themselves and this is still an open question. (shrink)

La double expérience que chacun de nous a des mouvements de son corps – comme objet mondain et comme organe de sa volonté – atteste, au sein de la métaphysique de Schopenhauer, la provenance de tout objet de représentation de la Volonté en soi. Nos « mouvements » charnels se prêtent cependant encore à des modalités diverses, selon qu’ils sont volontaires ou involontaires, et selon que la volonté y est appréhendée à travers une perception interne de ses « actes » (...) successifs ou à travers des sensations de plaisir et de douleur se rapportant à des « désirs » conscients ou inconscients. Formulé dans un langage freudien, la volonté-pulsion inconsciente se phénoménalise selon le double régime de la représentation et de l’affect, c’est-à-dire au sein d’un corps propre dont le principe de réalité et le principe de plaisir se disputent le gouvernement. Cette analyse des comportements corporels humains sert aussi de fondement à la philosophie de la nature de Schopenhauer. De même que nos actes volontaires, tout en se conformant à des « motifs » rationnels, puisent leur énergie dans une pulsion irrationnelle, les mouvements des corps matériels, tout en se conformant aux lois de la physique, restent animés par des « forces naturelles » qu’il faut comprendre comme la présence de la volonté pulsionnelle au sein de la nature. Croisant perspectives métaphysiques, anthropologiques et cosmologiques, l’auteur veut plus particulièrement mettre en lumière que la philosophie de la Volonté de Schopenhauer est la philosophie d’une force pulsionnelle nihiliste, héritière pessimiste du rationalisme leibnizien et visionnaire de la pulsion de mort de Freud. Tout en s’inscrivant dans le sillage kantien, cette philosophie conteste aussi déjà le principe d’une subjectivité originelle au nom du principe d’une vie pulsionnelle anonyme, inconsciente et irrationnelle. L’article rend compte d’un dispositif de la « clinique de la multiplicité » mis à la disposition notamment de familles dont la construction identitaire et le lien parent-enfant ont été mis à mal par un contexte de migration forcée. À travers l’exemple de la rencontre clinique d’une mère et de deux adolescents khmers dont l’histoire, marquée par le génocide de l’Angkar, a voulu effacer le noyau identitaire – constitué de tous les éléments de transmission qui font ce que l’on est (...) –, l’auteure montre qu’un « travail de migration » est nécessaire pour permettre à chacun, adolescents et parents, de passer d’un état d’être à un autre et de se reconnaître héritiers des différents mondes dont ils sont issus. La co-construction d’un récit fondateur permettra la restauration psychique en passant par la redéfinition symbolique de leur acte de naissance, sorte de mythe pourvoyeur de sens de leur existence.
