The issue of the policy of multiculturalism toward ethno-cultural minorities in contemporary Serbia has been reviewed within the project Regional and European Aspects of Integrative Processes in Serbia held by the Institute for Philosophy and Social Theory. The aim of this paper is directed toward examination of theoretical and empirical problems regarding the phenomenon of multiculturalism. In spite of the fact that multiculturalism is one of the striking characteristics of modern life in Serbia our social sciences pay a (...) little attention to this topic. Ethnicity as an important part of multicultural discourse is based on nonscientific knowledge and in this manner it presents basis for policy and practice for the protection of rights of minorities in the country. This paper is interested in the interdisciplinary characteristics of European integration studies. It explores how the institutional and intellectual, internal and external boundaries of this interdisciplinary field are shaped. For this purpose, it discusses two interlocking dynamics that are most important: on the one hand, the European Union actively attempts to mobilise European integration studies to contribute to building a united Europe by providing specific spaces, resources, and infrastructures for academic research and the public dissemination (...) of results. On the other hand, the external and internal boundaries of this interdisciplinary field are shaped by the movements and interactions of scholars from different academic backgrounds. Together, the different academic strands and policies coproduce the interdisciplinary field of European integration studies. Suggesting avenues for future research, the conclusion recommends analysing key debates in the context of European integration in terms of boundary objects around which academics, policy-makers, and publics can engage with each other and points to specific sites for further observations of these processes of coproduction. Integration policies are underpinned upon assumptions that are taken for granted but that condition both the causal diagnosis and the lines of action and programs devised to respond to social challenges associated with migration and refugees movements. The so-called “European refugees crisis” of 2015 is an example of how preconceived ideas affect the analysis of social problems and the design of solutions. This crisis is the context within which the paper, first, examines the root causes of the “problem”; (...) then, explores the notions of identity and participation and the implications they had for policy; and, finally, studies two cases of relative integration success where different assumptions inform different programs and strategies. The Schuman Plan was enthusiastically endorsed by the Benelux countries, France, Germany, and Italy, but the United Kingdom declined to participate, refusing to accept the supranational role of the projected High Authority. The treaty Establishing the European Coal and Steel Community (ECSC) was signed in Paris on 18 April 1951. The European Economic Community (EEC) has provided the core framework for the process of European integration. The Single European Act (SEA) also inserted into the EEC (...) Treaty a number of specific new legal bases for Community action. The treaty provisions were superseded by the Treaty on European Union (TEU), which provides the legal basis for the common foreign and security policy (CFSP). The Reform Treaty was to shed the form, language, and symbols of a European Constitution in favor of having another amending treaty, similar in nature to the SEA, Treaty of Amsterdam (TA), or Treaty of Nice (TN). In this chapter I compare changes in immigrant integration policies in two European countries-France and Britain-with those of the United States. I focus first on the "national models" around which integration policies have been described, and then on the dynamics that are driving the changes and evolution of these models. I argue that national models in each country differentiate the direction, the content and the intensity of integration policy. These differences are most evident, moreover, if (...) we examine not only the policies themselves, but the perceived success and failure of different integration policies. I argue that three dynamics have been driving the evolving management of integration policy: problems of urban order, the development of European union and perceptions of failure and success. The problems of the functioning of religion in the countries of the European Union are extremely complex and ambiguous. The EU is primarily political and economic. It is in these areas that active intra-integration processes are observed: introduction of a single currency, single payment system, actual “blurring” of borders between member states, development of the Constitutional Treaty, orientation towards the creation of a common market, a common transport network, harmonization of educational systems, etc.

The article explores the problems of the legal status of the regulatory authorities in the energy sector of Ukraine in the context of the administrative reform currently taking place in the Ukraine and the fulfillment of the EU requirements in this sphere. Based on the analysis of the EU legislation, in particular Directive 2009/72/EC of the European Parliament and the Council of 13 July 2009 concerning common rules for the internal market in electricity and repealing Directive 2003/54/EC and Directive (...) 2009/73/EC of the European Parliament and the Council of 13 July 2009 concerning common rules for the internal market in natural gas and repealing Directive 2003/55/EC, and the experience of Ukraine in the field of energy regulation, the author of this article supports granting the special legal status to the national regulatory authorities in the energy sector of Ukraine and their separation from the system of state executive bodies, however, recommends to stipulate in the Constitution of Ukraine the provisions, regarding the organizational legal form and the establishment procedure of such bodies, the appointment and dismissal procedure for their management and members, the peculiarities of the relations of these bodies with the President of Ukraine, the Parliament of Ukraine and the Government of Ukraine. This article summarizes some of the results of the BIOMED II project “Basic Ethical Principles in European Bioethics and Biolaw” connected to a research project of the Danish Research Councils “Bioethics and Law”. The BIOMED project was based on cooperation between 22 partners in most EU countries. The aim of the project was to identify the ethical principles of respect for autonomy, dignity, integrity and vulnerability as four important ideas or values for a European bioethics and biolaw. The (...) research concluded that the basic ethical principles cannot be understood as universal everlasting ideas or transcendental truths but they rather function reflective guidelines and important values in European culture. The method of the research was conceptual, philosophical analysis of the cultural background of the four values or normative ideas that people use and find important in their existence. Moreover, this was combined with analysis of empirical legal material and policy documents. Also, a number of qualitative interviews with relevant experts were carried out. Another important result of the BIOMED project was the partner's Policy Proposals to the European Commission, the Barcelona Declaration, unique as a philosophical and political agreement between experts in bioethics and biolaw from many different countries. Open science will make science more efficient, reliable, and responsive to societal challenges. The European Commission has sought to advance open science policy from its inception in a holistic and integrated way, covering all aspects of the research cycle from scientific discovery and review to sharing knowledge, publishing, and outreach. We present the steps taken with a forward-looking perspective on the challenges laying ahead, in particular the necessary change of the rewards and incentives system for researchers (for which (...) various actors are co-responsible and which goes beyond the mandate of the European Commission). Most of what has been written on the ECSC/ EEC/ EC/ EU, has not been done by international relations (IR) theorists, but by comparativists, sociologists, historians, anthropologists, legal scholars, and many others. These writings are in general classified as intergovernmentalist, federalist, and supranationalist (functionalist and neo- functionalist) in most accounts of the theoretical perspectives on the EU (Webb 1983, Rosamond 2000). Wiener and Diez 2004 add a rational choice institutional category, as well, as they think that the policy analysis (...) within the polity developed into an autonomous brand of literature. It is only Andrew Hurrell in his chapter in Fawcett and Hurrell 1995, who makes an attempt to present the EU, as a regional integration, from the point of view of diverse IR approaches. Drawing on his classification scheme, I conduct an inquiry of the IR theories about European unification from the point of view of whether they allow for the iteration of the European experience in other parts of the world or not. The basic conclusion is that almost all IR work on Europe falls in the inter- governmentalist category, which tends to conceptualize the European Union as representing an n of 1. (Inter- governmentalism is the choice of realism and neo-realism, English School, and neoliberal institutionalism.) Within the liberal IR paradigm, there is a tension between law-focused and security-focused approaches, on the one hand, and economic approaches, on the other. The first believe in the possibility of multiple integrations, while the latter does not think that they are desirable. Critical theories are also hindered by divergent normative commitments, though the class-based theorizing is very clear about pursuing the social control of markets. (shrink)

The article examines the key conclusions and recommendations to candidate countries and potential candidates for accession, set out by the European Commission in the annual Communication on the EU enlargement policy in 2022. For better understanding of the essence of the Commission’s Communication, this article the author analyses the realities faced by the EU with the beginning of the Russian Federation’s full-scale war against Ukraine. According to scholars and experts, the war changed Europe more profoundly than any event (...) since the end of the Cold War. It is found that the war clearly emphasized the attractiveness of EU membership and strengthened its transformative power, which was formed thanks to the values, diversity of the societies of the Member States, fundamental freedoms and way of life of the Union. In this context, one can agree with the statement of scholars that the real challenges that the EU cannot avoid if it wants to become more authoritative and strategically autonomous are the strengthening, not the weakening of the European level (institutional and legal systems, common EU policies) under a strict democratic control. The analysis of the conclusions and recommendations in the Commission’s Communication allowed us to conclude that after the Russian invasion of Ukraine, the policy of EU enlargement was returned to the forefront of the EU’s agenda. Evidence of this was, firstly, granting the status of a candidate for accession to Ukraine and Moldova and a potential candidate – to Georgia, and, secondly, a joint search by the EU and its Member States for ways to activate and speed up the process of European integration of the countries of the Western Balkans region. In addition, it should be noted that the cross-cutting themes of the Commission’s conclusions and recommendations are EU security and energy policy, key areas of the Green Course, in particular decarbonization of the economy, as well as the issue of recovery after the COVID-19 pandemic. A separate emphasis in the Commission’s Communication is placed on the reforms continued by the countries of the Western Balkans, which are necessary to fulfill the accession criteria. (shrink)

The Joint Research Centre (JRC) is the European Commission’s in-house science and knowledge service, employing a substantial staff of scientists devoted to conducting research to provide independent scientific advice for EU policy. Focussed on various research areas aligned with EU priorities, the JRC excels in delivering scientific evidence for policymaking and has published numerous science-for-policy reports and scientific articles. Drawing on a scientific integrity statement, surveys among JRC’s research staff, and thematic discussions with JRC’s research leaders, the (...) JRC has developed a comprehensive Scientific Integrity and Research Ethics (SIRE) framework, including instruments, procedures, and guidelines to ensure high standards and independence in its research. Key components of the SIRE framework include a Scientific Integrity Officer, an Editorial Review Board, a Research Ethics Board, and guidelines for responsible conduct of research. This article provides an overview of the JRC’s SIRE framework and how it was developed, emphasising the importance of maintaining independence, integrity, and ethics in scientific research that supports EU policy. The article also discusses potential gaps in the framework and where additional efforts may be needed, comparing with the recent U.S. National Science and Technology Council report on Protecting the Integrity of Government Science. European integration has increased to encompass security-related policies. One such policy is defense industry policy, which traditionally has been a national concern rooted in defense and security policy. Efforts have been made since the 1990s to create a European defense industry market. However, there have been different ideas of how this goal should be achieved or which model for state—industry relations the market should rest on. Using Sweden to illustrate the development, this article argues (...) that for the Europeanization of defense industry policy, marketization has played a vital role. Building on official documents and interviews, the article analyzes the efforts to create a European defense industry market, marketization of Swedish defense industry policy, and the increased interaction between Swedish and European defense industry policy processes. In this article I discuss the history of Italian Jews from the Emancipation to the racial laws of 1938 and their present-day attitudes to Judaism and the State of Israel. My aim is to suggest how the policy of social integration enabled Italian Jews to construct a new identity without losing their ancestral heritage. The example of Italian Jewry is relevant to understanding the growing need in today‘s European Union—now comprising 27 countries with different languages, cultures, and (...) values—of revising the concept of national identity and of exploring ways of constructing a new European identity. In the past decade, policy-makers in science have been concerned with harmonizing research integrity standards across Europe. These standards are encapsulated in the European Code of Conduct for Research Integrity. Yet, almost every European country today has its own national-level code of conduct for research integrity. In this study we document in detail how national-level codes diverge on almost all aspects concerning research integrity – except for what constitutes egregious misconduct. Besides allowing for potentially unfair responses to (...) joint misconduct by international collaborations, we argue that the divergences raise questions about the envisaged self-regulatory function of the codes of conduct. It appears likely that at its peak the classical economy was almost as large as that of Western Europe during the Industrial Revolution. The following review of the archeological and document evidence indicates that three events occurring in the first half of the first millennium BC trigger the emergence of a specialized and integrated classical economy after 500 BC: (i) growth in demand for silver as a medium of exchange in economies in the Near East; (ii) technical breakthroughs in hull (...) construction and sailing rig in merchant shipping of the late Bronze Age; (iii) perfection of ferrous metallurgy into the European hinterland. This last event raised agricultural productivity to a level capable of supporting the occupational specialization needed to sustain a vigorous trading economy. To these initial causes may be added the diffusion of alphabetic writing. While it did not create opportunities for long-distance trade, the diffusion of writing supplied the means of responding on a scale large enough economically to matter. (shrink)

Ordoliberalism is often recognized as a powerful ideational source during the Euro crisis; however, there is no pure ordoliberal vision of European integration, and ordoliberal ideas have been used to support both Eurosceptical and Europeanist positions during the crisis. This article reconstructs the ordoliberal theoretical and political debate on European integration and argues that there exist two ordoliberal paradigms of European integration: one bottom-up, whereby the commitment to liberal economic policies at the national level (...) is the precondition for a liberal international order; the other top-down, whereby a liberal international order can help the establishment of a liberal order at the national level. The article compares two ordoliberal visions of the international order: Wilhelm Röpke’s ‘liberalism from below’ (which follows the bottom-up logic) and Viktor Vanberg’s ‘competitive federalism’ (which follows the top-down logic). Then, it explores the ordoliberal political debate on two episodes of the European integration process – the Maastricht Treaty and the Euro crisis – to argue that the bottom-up and the top-down logics underpinned, respectively, Eurosceptical and Europeanist arguments. The European Union’s common agricultural policy (CAP), in addition to its primary production and farm income goals, is a large source of funding for environmentally friendly agricultural practices. However, its schemes have variable success and uptake across member states (MS) and regions. This study tries to explain these differences by demonstrating differences between policy levels in the understanding of the relationship between nature and farming. To compare constructs and values of the respective policy communities, their discursive (...) construction as it appears in the main strategic EU and MS agricultural policy documents is analysed. The theoretical framework integrates elements from existing frameworks of CAP and environmental discourse analysis; specific agri-environmental discourses, their elements and interplay, are identified. The six discourses suggested here are ‘Productivism’, ‘Classical neoliberal’, ‘Ecological modernisation’, ‘Administrative’, ‘Multifunctionality’ and ‘Radical green’. The discourse analysis of selected documents reveals that there are indeed differences in how farming and the environment are generally conceptualised at different levels of CAP decision-making. At EU level, farming is primarily understood as a sector whose main task is to produce food (‘Productivism’), and the environment is used as a justification for CAP payments (‘Multifunctionality’). At the national/regional level, Rural Development Programmes reflect different value systems: in England, environmental protection is mainly seen as sound management of natural capital (‘Classical neoliberal’); in Finland, a benefit for producers and conscious consumers (‘Ecological modernisation’); in Croatia, a necessity limiting productivity (‘Productivism’) and imposed by an external authority (‘Administrative’ discourse). This diversity shows that differences can visibly manifest despite the Commission constraining the discursive space, helping to explain the differential implementation and success of environmental measures. The most urgent problem facing the European Union is to develop the best approach to conflicts over integration in the fields of culture, economics and foreign policy. The essay argues that a particular form of democratic integration is better than the two predominant approaches. This approach draws on the actual practices of the democratic negotiation of integration that citizens engage in on a daily basis but which tend to be overlooked and overridden in the dominant (...) approaches. The concept of Europeanization has become very popular in studies of European integration and particularly in analyses on the post-communist countries undergoing extensive transformation on the road to European Union membership. Although the Europeanization process has been quite successful in the countries of Central and Eastern Europe (CEE), the same scenario has not played out in the western Balkans region. With the purpose of analysing the effectiveness and impact of the Europeanization process in the western Balkans, the (...) main subject of the paper is Bosnia and Herzegovina’s EU-related reform processes. Although Bosnia has been undergoing thorough Europeanizing reforms since the late 1990s, when the country entered the Stabilization and Association Process (SAP), it is still an unstable and dysfunctional country. That makes it the perfect case for assessing the possible shortcomings of the Europeanization process. Thus far, most scholars have concluded that domestic political elites in Bosnia are the only party responsible for Bosnia’s political deadlock. However, this paper analyses the continued Bosnian deadlock from a different perspective, trying to figure out the degree of responsibility the European Union shares in the country’s Europeanization process. Although uncooperative Bosnian political elites are to a great extent responsible for the continued political and social status quo, EU leaders are not faultless either. In fact, so far European leaders have often appeared to be deeply divided, incoherent, and short-sighted in terms of Europeanization policies in Bosnia, thus further deepening the political deadlock in the country. Therefore, we can ask whether Bosnia represents a litmus test which the EU has failed. (shrink)

This article argues that the practical difficulties and normative dilemmas at stake in the European refugee crisis as a crisis of EU integration extend beyond refugee policies into what we may call ‘the citizenship regime’ of the European Union in ways that are consequential for refugees, member states, and the European Union. It advances arguments for the relatively rapid access to citizenship of refugees, demonstrates that this norm has at least some acknowledgment in the policies of (...) EU member states and considers what further differentiation of refugees from other classes of migrant might be a part of developing a just and legitimate Common European Asylum Regime. It argues that there are some reasons to favour a CEAS in which refugees receive EU citizenship prior to national citizenship in a member state. (shrink)

The European Union (EU) has been challenged by several crises lately. In addition to Brexit, the Euro crisis, and the migration crisis; global issues such as the coronavirus pandemic and the Russian attack on Ukraine affected the EU. The migration crisis, on the one hand, differs from the above-mentioned crises with one remarkable feature. The member states have no real consensus about forming a common migration policy. Besides, for geographic reasons, some member states put much more burden on (...) immigrants. Agreeing on immigration becomes impossible for the border countries on the migration route and also transit countries. The paper argues that, unlike the other crises of the EU, the migration crisis reinforces EU integration in such a way that disputes between member states prevent the EU from making institutional changes about the issue. The study results assume that the other above-mentioned crises, on the other hand, stimulated institutional change throughout the EU. In light of this information, this study evaluates, using a method of relevant literature review and comparing the arguments of the researchers, how the migration issue became a subject of dispute between member states by evaluating the 2015 crisis. European citizenship is a nested membership in a multilevel polity that operates at member state and union levels. A normative theory of supranational citizenship will necessarily be informed by the EU as the only present case and will be addressed to the EU in most of its prescriptions, but should still develop a model sufficiently general to potentially apply to other regional unions as well. The Article first describes three basic characteristics of such a polity — democratic representation at (...) the supranational level, internal freedom of movement between member states, and regional limits to external geographic expansion — and argues that a multiplication of such regional unions would contribute to a more just and peaceful international order. Building on this modification of Kant’s model for a global confederation of republics, the contribution explores three alternative approaches for strengthening democratic citizenship in the European Union: a statist approach that aims at transforming the EU into a federal state, a unionist approach whose goal is to strengthen union citizenship vis-a`-vis member state nationality, and a pluralist one that specifies citizenship norms for each level and balances them with each other on the basis of the current state of federal integration. These approaches are then compared with regard to their implications for three policy questions: general status differences and inequality of rights amongst EU citizens living in their country of nationality, EU citizens residing in other member states, third-country nationals, and EU citizens residing outside the territory of the Union; voting rights in European, national, and local elections; and access to Union citizenship and to member state nationality. Everything begins in 1959 when Turkey applies to associate membership to the European Economic Community. But unfortunately for Turkey, the accession to the Community was not to accomplish. In time, the European Economic Community became the European Union. The organization pass through the enlargement process multiple times that (...) today it is the Union of the 28 countries, but still without Turkey as a member. After all this time, a question is raised: what drags Turkey from achieving the membership status in all this time? At the beginning of the year, the Draft Common Frame of Reference (DCFR) was published. The text is the result of the work of a broad range of private law scholars from the Member States of the European Union, and it presents itself as an ‘academic’ document, committed to the precepts of scholarship rather than politics. Notwithstanding its unwieldy name, the text is nothing less than the draft of the central components of a European Civil Code. The following (...) article aims to inform the reader about this potentially important document and to initiate further academic debate about it. Following an overview of the genesis and content of the DCFR (Part 1), the discussion focuses on whether, and to what extent, it is based upon consistent and convincing core aims and values (Part 2). The article then proceeds to address, more specifically, the significance of private autonomy, and it examines the extent to which the proposed rules satisfy the requirements of legal certainty and legal clarity (Part 3). Thereafter, the DCFR is measured against the criteria of internal consistency and systematic integrity (Part 4). Political theorists aiming to articulate normative standards for the EU have almost entirely focused on whether or not the EU suffers from a ‘democratic deficit'. Almost nothing has been written, by contrast, on one of the central values underpinning European integration since at least the European Coal and Steel Community (ECSC), namely solidarity. What kinds of principles, policies, and ideals should an affirmation of solidarity commit us to? Put another way: what norms of socioeconomic justice ought to (...) apply to the EU? This is not an empirical or narrowly legal question. We are not trying to gauge the degree of attachment there currently is in the EU by, for example, citing the latest Eurobarometer poll. We are also not attempting to state the implicit rationale followed by the Court of Justice in its recent ‘solidarity’ jurisprudence, let alone trying to fix what the Commission might mean by it. In this article, I ask the more fundamental question underlying both the legal and the empirical questions: What principles of social solidarity ought to apply between states and citizens of the emerging European polity? This question has rarely been asked or answered by political theorists in an EU context, so we are entering largely uncharted territory. The article develops a tripartite model of EU solidarity in Section 2, and then applies it to the case of free movement of persons in Section 3. (shrink)

This article reconstructs the complex diplomatic negotiations that led to the peculiar organization of molecular biology at the European level, by focusing in particular on the establishment of the European Molecular Biology Conference (EMBC), the intergovernmental structure founded in 1969–70 to support the scientific program of the European Molecular Biology Organization (EMBO). By combining the analysis of the informal decision-making kept in the Nobel Prize laureate John C. Kendrew’s personal papers (Oxford) with the in-depth exploration of the (...) institutional documentation available in the EMBO and CERN archives (Heidelberg and Geneva) and the Swiss Federal Archives (Bern), the article sheds light on the importance of the EMBC not only for the construction of molecular biology as a scientific, social, and political field in the European context, but also for the broader process of definition of the European research policy. Far from being just a mere replica of CERN, the EMBO/EMBC inaugurated in fact an alternative and flexible ‘bottom-up’ model of science policy in the European context, based on competition, networking, and scientific excellence, which paved the way to the establishment of the European Research Council (ERC) in the early 2000s. Among the various experiments in ‘new governance’, the model of Responsible Research and Innovation is emerging in the European landscape as quite promising. Up to now, there have been two versions of RRI: a socio-empirical version which tends to underline the role of democratic processes aimed at identifying values on which governance needs to be anchored and a normative version which stresses the role of EU goals as ‘normative anchor points’ of both governance strategies and policy making. Both (...) versions are unsatisfactory. The first since it suggests movable anchorage which could clash with prefixed values, such as individual rights. The second since it does not safeguard fundamental rights in the process of balancing ‘anchor points’. This result is counterintuitive because it exposes governance to the risk of facing adverse court decisions in the defense of individual rights, thus losing its anticipative attitude. In order to avoid this outcome, the paper argues that it is only through better integration between the system of human rights and that of EU fundamental rights that the anticipative feature of RRI can be preserved. While Rorty’s conceptual instruments stem from the field of epistemology and moral philosophy and have, so far, not been widely applied to theorizing statehood in general and labour market policy in particular, his ideas can help to understand leftist (...) politics between inter- and re-nationalization. By drawing on empirical findings on debates and negotiations between European trade union organizations, the text proposes an idea on how to overcome a dualistic framework beyond a footloose cosmopolitanism and national protectionism. Multicultural policy has recently been undergoing a marked crisis and is subject to wide criticism. In the light of recent terrorist attacks it is often highlighted that the reason for such situations might be too much openness towards foreigners. Most European countries are changing their immigration and integration policies limiting their social security and restricting the possibilities of an influx of immigrants. Sweden, which is perceived as one of the most open and tolerant states in Europe also (...) faces new challenges concerning the future of its multicultural policy. The crisis in tolerance towards foreigners is quite visible and it is obvious that the social moods in this state are evolving. Therefore, the aim of the article is to analyze changes in the attitude towards Swedish immigration and its integration policy in the light of the attack on the Charlie Hebdo weekly offices. The post-communist revolutions of 1989 triggered parallel transformation in the ideological landscape on both sides of the former Iron Curtain. The geo-political opening after the end of the Cold War made global integration a highly salient factor in political mobilization, opting out to replace the capital-versus-labor dynamics of conflict that had shaped the ideological families of Europe during the 20th century. This has resulted in splitting the traditional constituencies of the Left and the Right and reorganizing them along new (...) fault-lines: those shaped by attitudes to globalization and EU enlargement (in the West) and by attitudes to EU accession and global economic competition (in the East). Thus, an ideational convergence between East and West is taking place in Europe, radically altering the structure of political competition in the early 21st century. As the new political cleavage cuts across, rather than runs along, the left—right ideological continuum, it is eroding the societal alliances that had supported the post-war European Social Model. The emerging structure of political competition enables substantive changes in the European Social Model in the direction of deepening labor commodification, thus defeating the emancipatory potential that earlier labor-market policies had contained. The vulnerable require special justification to participate in human subject research in order to eliminate potential human rights abuses. The Nuremberg Code of 1947 was written in response to the extreme human subject abuses that occurred under the Nazi regime, and, although the intent of the 1947 Code was to protect human rights, rigid voluntary consent requirements deprived some individuals of the right to participate in clinical trials. Recent human research guidelines, such as the CIOMS/WHO guidelines referenced above and the guidelines referenced in Section V of this Scope Note, attempt to balance both protection from abuse in research and access to new, experimental treatments for the vulnerable.Although various protective guidelines stipulate special protections for vulnerable populations, the concept of vulnerability and consequently the criteria designating vulnerable populations remain vague. Clinical researchers, healthcare workers, ethical reviewers, and policymakers must be able to identify vulnerable subjects to establish how healthcare resources will be allocated and who will qualify for special protections and socialized benefits. Attempts to quantify vulnerability in clear, measurable ways have met little if any consensus. In fact, there is no purposeful categorisation at all."Difficulties in defining vulnerability have prompted discourse surrounding its utility as a qualifying factor in the allocation of health resources and its appropriateness as a guiding principle in bioethics. "Labeling individuals as 'vulnerable' risks viewing vulnerable individuals as 'others' worthy of pity, a view rarely appreciated" (III, Danis and Patrick 2002, p. 320). The categories of vulnerable groups listed under the Common Rule have been the source of controversy, "for example, many find the suggestion that pregnant women are vulnerable to be quite sexist" (IV, DeBruin 2001, p. 7). Instead of creating categories of vulnerable populations, would it not be better to derive an account of just treatment from a just social policy at large that encompasses human vulnerabilities (II, Brock 2002, p. 283).For some of the authors listed here, the concept of vulnerability is essential to bioethics. ABSTRACTThe German state permitted about one million refugees to enter Germany in 2015–2016, although many were subsequently denied refugee status. Germany adopted an ‘integration’ and ‘welcome’ politics, an important, if imperfect, model for a European refugee policy. The integration of refugees required the joint activity of state, of civil society, of the public sphere and of refugees themselves. Civil society initiated a vast amount of essential care work and solidarity with refugees pursued especially, but not only, (...) by women, yet civil society and refugees had no say in refugee policies. German refugee policy and practice raised many normative issues, producing an intense and vigorous national debate about them, in which philosophers and theorists were active. Among the questions debated were whether Germany had accepted ‘too many’ refugees, the acceptability of the costs of the policy, the risks of harm to the least well off, the purported risks to safety, security and the social order and the purported threats to German culture. I first describe German state policies, practices and civil society efforts and then turn to normative debates. I discuss the limits of the German discourse and suggest how it needs to be expanded. The Knowledge-Based Bio-Economy has gained prominence as an agricultural R&D agenda of the European Union. Specific research policies are justified as necessary to create a KBBE for societal progress. Playing the role of a master narrative, the KBBE attracts rival visions; each favours a different diagnosis of unsustainable agriculture and its remedies in agro-food innovation. Each vision links a technoscientific paradigm with a quality paradigm: the dominant life sciences vision combines converging technologies with decomposability, while a marginal one combines (...) agro-ecology with integral product integrity. From these divergent visions, rival stakeholder networks contend for influence over research policies and priorities, especially within the Framework Programme 7 on Food, Agriculture, Fisheries and Biotechnology, which has aimed to promote a Knowledge-Based Bio-Economy. Although the FAFB programme has favoured a life sciences vision, agro-ecological approaches have gained a presence, thus overcoming their general lock-out from agricultural research agendas. In their own way, each rival paradigm emphasises the need for collective systems to gather information for linking producers with users, as a rationale for the public sector to fund distinctive research priorities. Twenty Years of Poland's Euro-Atlantic Foreign Policy During the years 1989-1991, after a deep transformation of the internal system and the international order in Europe, Poland pursued a sovereign foreign policy. The new policy had the following general goals: 1) to develop a new international security system which would guarantee Poland's national security; 2) to gain diplomatic support for the reforms conducted in Poland, including primarily the transformation of the economy and its adaption to free market mechanisms, (...) which were designed to result in economic growth; and 3) to maintain and increase the international prestige of Poland and the Poles, who had been the first to commence the struggle to create a democratic civil society in the Eastern bloc. Implementing this new concept of foreign policy, Poland entered the Council of Europe in November 1991. The following year, Warsaw started to strive for membership of NATO, which was achieved in March 1999. A few years later, Polish leaders pursued policies in which Poland played the role of a "Trojan horse" for the USA. This was manifested most clearly during the Iraqi crisis of 2003, and in the following years, particularly in 2005-2007. From spring 1990 Poland aspired to integration with the European Community; in December of the following year it signed an association agreement, which fully entered into force in February 1994. In the period 1998-2002 Poland negotiated successfully with the European Union and finally entered this Union in May 2004. In subsequent years Poland adopted an Eurosceptic and sometimes anti-EU position. The new Polish government, established after the parliamentary election of autumn 2007, moved away from an Eurosceptic policy and pursued a policy of engagement with European integration. (shrink)

Fertility treatments, which are part of "assisted reproductive technologies" (ART), mainly undertaken through in vitro fertilization (IVF), offer the opportunity to infertile couples to conceive. IVF treatments are undertaken in Israel in significantly higher numbers than in the rest of the world. As such, Israel provides an important case-in-point for examining the validity of the actual claims used to justify the more generous public funding of IVF treatments at the policy level. In this article, we utilize an analytical philosophy (...) approach to conduct this examination. First, we highlight two fundamental concepts that were used at the Israeli public policy level in order to justify the generous public funding of IVF treatments. These concepts are “emotional vulnerability” and the “worthlessness of the childless,” where the latter emphasizes the infinite value of children. Then, by applying the perspective of the European model of Bioethical Principlism, and focusing the attention to these two concepts we show that these justifications are invalid. Specifically, it is suggested that these concepts are on the one hand both relying on and expressing the principles of vulnerability, dignity, and integrity; yet on the other hand, these concepts are also undermining the very principles of bioethics they are supposed to express and rely on. Based on this suggested criticism, we offer two “take home” messages informed by our analysis of the Israeli case, but reaching beyond it. (shrink)

The recent construction of “gender equality” as a defining value of European societies has shaped the policy goals of immigrant integration programs. This focus on “gender equality” may function, paradoxically, to exclude immigrants, if immigrant integration policies rely on stereotypical representations of immigrants and fail to acknowledge the multiple, intersecting forms of inequality that immigrant women face. This article contributes to the critical scholarship on the role of “gender equality” in the field of immigrant integration (...) policy by examining the framing of this concept in the policy documents and implementation of the French civic integration program. Using ethnographic observations and field interviews, I illustrate how frontline workers, many of whom were women of immigrant origin, interacted with participants to frame “gender equality” in exclusionary and inclusionary ways, and how “gender equality” functioned as a racial boundary within the program. The tensions in the discourses of frontline workers mirrored those of the political context in which the policy developed; they were constrained by a difference-blind ideology of French republicanism as they insisted on “gender equality” as the pathway to belonging in France. The process of agricultural unification will dominate the German scene for the next few years. At this stage, however, analysis and forecasts are hampered by the considerable problem concerning the viability of East German agriculture in a market economy and by the absence of reliable data in the German Democratic Republic (GDR). This can only be understood in terms of the agricultural situation in the GDR before unification, which is discussed in the first section. The political and economic incentives for (...) German unification are described in the next section of this paper, focusing especially on the integration of the GDR into CAP. The third section considers some critical structural, legal, social, and economic constraints in the process of integrating the two agricultural systems. Finally, the implications for German agriculture as well as the challenges for the CAP will be addressed. Data were collected from interviews with key agricultural policy makers, farm organizations, commodity groups, consumer groups, and agricultural experts, as well as interviewing East German farmers. Additional data were compiled from government statistics, EC publications, and press reports. The conclusions reached in this research show the urgent need for the German government to reconsider the objectives and rationale for structural policies in agriculture, and point out that the new Germany, itself full of paradoxes and uncertainty, stands at the center of European agricultural disorder. After the establishment of the independent Slovak Republic, legal and institutional ground rules were set for providing asylum to foreigners present on the territory of the Slovak Republic. The national legislation of the last twenty years was adopted in compliance with international treaties and the European Union instruments covering asylum matters. In the field of asylum policy, the Slovak Republic complies with its traditional pillars and supports new forms of protection following the new challenges faced by the international (...) community. The currently valid Asylum Act regulates the international protection of aliens in the Slovak Republic, by defining the conditions and procedures related to granting asylum and provision of subsidiary protection and temporary shelter. The Asylum Act also covers the rights and obligations of different categories of persons, stay in asylum facilities and, partially, the integration of persons that are granted asylum. This article describes and analyses the development of the Slovak asylum legal framework and the concept of asylum policy. Furthermore, it looks at different protection statuses granted to foreigners and finally deals with the refugee migration trends in the Slovak Republic. (shrink)
