The disclosure of information that identifies deceased organ donors and/or organ transplant recipients by organ donation agencies and transplant centres is regulated in Australia by state and territory legislation, yet a significant number of donor family members and transplant recipients independently establish contact with each other. To describe and synthesize Australian laws and guidelines on the disclosure of identifying information. Legislation and guidelines relevant to organ donation and transplantation were obtained following a search of government and DonateLife network websites. Information (...) about the regulation of identity disclosure was extracted and synthesised using a process guided by Walt and Gilson’s (1994) policy analysis framework. Nineteen documents were examined. Six guidelines refer to and were consistent with current legislation. Four documents did not address identity disclosure. All jurisdictions prohibit healthcare professionals from disclosing identifying information. In three states, the prohibition extends to all members of the public including donor family members and transplant recipients. Restrictions on identity disclosure have implications for public promotion of donation and transplantation where sharing of stories and images of organ donors and transplant recipients is common. Further research is required to understand the perspective of donor family members, transplant recipients, and healthcare professionals impacted by the current laws. (shrink)

In this paper, we outline a framework for understanding the different kinds of knowledge required for medical practice and use this framework to show how scientism undermines aspects of this knowledge. The framework is based on Michael Polanyi’s claim that knowledge is primarily the product of the contemplations and convictions of persons and yet at the same time carries a sense of universality because it grasps at reality. Building on Polanyi’s ideas, we propose that knowledge can be described along two (...) intersecting “dimensions”: the tacit–explicit and the particular–general. These dimensions supersede the familiar “objective−subjective” dichotomy, as they more accurately describe the relationship between medical science and medical practice. Scientism, we argue, excludes tacit and particular knowledge and thereby distorts “clinical reality” and impairs medical practice and medical ethics. (shrink)

The emergence of new obstetrical and neonatal technologies, as well as more aggressive clinical management, has significantly improved the survival of extremely low birth weight infants. This development has heightened concerns about the limits of viability. ELBW infants, weighing less than 1,000 grams and no larger than the palm of one's hand, are often described as of late twentieth century technology. Improved survivability of ELBW infants has provided opportunities for long-term follow-up. Thomas Aquinas famously held that (A) theft is always wrong, and also that (B) it is permissible for a starving man to take the bread he needs, openly or secretly, from another. He reconciled these two positions by claiming that (C) in cases of great need, it is not theft to take someone else’s property when she does not need it herself. On its face, (C) looks like a theoretically costly concession that Aquinas is forced into in order to (...) reconcile (A) and (B). Our first aim is to show that this is not so. We argue that (C) is in fact the only way to accommodate a set of intuitive norms of keeping and taking. Our second aim is to show that (C) has important implications for theories of property more generally: a plausible theory of property must acknowledge a foundational sense of "belong" on which things belong to those who need them. All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

When we register our modal commitments in ordinary descriptive language, affirming that there are such-and-such absolute necessities, possibilities, and impossibilities, we are projecting our sense of what the human mind can and cannot conceive. In some ways the account parallels Hume’s famous treatment of the necessity of causes, and in some respects it anticipates recent expressivist theories of absolute modality. To speedily explore as many innovations as possible, students are sometimes encouraged (...) to follow an alternative pathway, to create “design fiction.” Intended to exist only on paper or the screen, a “design fiction” is not really destined for the real world.1 As a learning technique, it allows for a significant degree of technical experimentation as well as the imagining of new social arrangements. Many design experts see this “free-for-all” method as rather annoying and untrustworthy—more art than science. Yet for the most creative students, it serves to liberate them from the various constraints of their discipline. My own peculiar process of “design fiction” is what I call the “Literary Method of Urban Design.” I will come to this method in a moment.Last year, I was invited by the Bauhaus Museum in Weimar, Germany, to contribute artworks for a special exhibition entitled “Ways to Utopia: Life Between Desire and Crisis” (running from April 1, 2023—January 29, 2024).2 [End Page 560] This exhibition is a celebration of the one-hundredth anniversary of the Bauhaus’s first architectural product: a modern suburban family home in the city of Weimar called the Haus Am Horn. Built in 1923 the Haus Am Horn ushered in the Bauhaus style, a streamlined functional elegance presented in clean, bright, hopeful hues.3 Beyond just style, though, the house was proffered up in utopian terms. Its Bauhaus creators suggested that such a home could be mass-produced on an industrial scale cheaply and efficiently to provide elegant living to every single family in Europe, be they rich or poor. In its first iteration, the Staatliches Bauhaus was a high-spirited, playful, future-oriented, and socially aware fine arts and architecture school that ran from 1919 to 1933 in Weimar, then Dessau, then Berlin. However, its liberalism and experimentation away from traditional teaching and practice invited scorn from conservatives and from the Nazi Party. The former took the Bauhaus school’s funding away; the latter shuttered it for good. Despite the closure of the building, the Bauhaus style transformed design across the world as former teachers and ex-students applied Bauhaus principles and approaches in new settings. The old Bauhaus school has since been resurrected, with the opening of Bauhaus Universität Weimar, and the Bauhaus Museum, with locations in Weimar and Dessau.A few years back, Skyhorse Publishers published a book of my own “design fictions” depicting real-world cities set far in the future, each presented in utopian terms.4 Because of this, the Bauhaus approached me to help them celebrate their centennial anniversary by displaying my utopian urban designs in their museum. However, to convey the centenary theme of the exhibition, they requested exactly 100 different artworks of 100 different urban utopias portraying 100 different real-world cities set 100 years in the future. At the time, I had only produced eighty such works over the preceding decade. However, since the exhibition was to include masterworks by Bauhaus design greats like George Muche and Alma Buscher, I did not want to fall short. :This article focuses on historical queer cultural geographies of masculinities and to do so it focuses on two cases/places. The first is an archival case/place: a partial assembly of documents of beats and their uses during and in the wake of Gay Liberation in Australia. The second is a literary case/place: Thomas Mann's Death in Venice, a canonical twentieth-century imbrication of male homosexuality and geography. This article will seek to rationalize the mobilization of these two asynchronous cases/places through the (...) insights that both afford, when brought together, for elaborating contributions that queer readings of Nietzsche can make to contemporary queer theories of space, time and masculinities. Hobbes’s interpreters have struggled to find a plausible semantics for evaluative language in his writings. I argue that this search is misguided. Hobbes offers neither an account of the reference of evaluative terms nor a theory of the truth-conditions for evaluative statements. Rather, he sees evaluative language simply as having the non-representational function of prescribing actions and practical attitudes, its superficially representational appearance notwithstanding. I marshal the evidence for this prescriptivist reading of Hobbes on evaluative language and show how it (...) sidesteps various textual and philosophical problems that bedevil the traditional interpretations. The term “globalization” was popularized by Marshall McLuhan in War and Peace in the Global Village. In the book, McLuhan described how the global media shaped current events surrounding the Vietnam War [1] and also predicted how modern information and communication technologies would accelerate world progress through trade and knowledge development. Globalization now refers to a broad range of issues regarding the movement of goods and services through trade liberalization, and the movement of people through migration. Much has also (...) been written on the global effects of environmental degradation, population growth, and economic disparities. In addition, the pace of scientific development has accelerated, with both negative and positive implications for global health. Concerns for national health transcend borders, with a need for shared human security and an enhanced role for international cooperation and development [2]. These issues have significant bioethical implications, and thus a renewed academic focus on the ethical dimensions of public health is needed. Future developments in science and health policy also require a firm grounding in bioethical principles. These core principles include beneficence; nonmaleficence ; respect for persons and human dignity ; and attention to equity and social justice. According to the World Health Organization [3], global ethical approaches should monitor and update ethical norms for research, as necessary; anticipate ethical implications of advances in science and technology for health; apply internationally accepted codes of ethics; ensure that agreed standards guide future work on the human genome; and ensure that quality in health systems and services is assessed and promoted. Risk-weighted expected utility theory is motivated by small-world problems like the Allais paradox, but it is a grand-world theory by nature. And, at the grand-world level, its ability to handle the Allais paradox is dubious. The REU model described in Risk and Rationality turns out to be risk-seeking rather than risk-averse on one natural way of formulating the Allais gambles in the grand-world context. This result illustrates a general problem with the case for REU theory, we argue. I present a new argument that we are much more likely to be living in a computer simulation than in the ground-level of reality. (Similar arguments can be marshalled for the view that we are more likely to be Boltzmann brains than ordinary people, but I focus on the case of simulations.) I explain how this argument overcomes some objections to Bostrom’s classic argument for the same conclusion. I also consider to what extent the argument depends upon an internalist conception (...) of evidence, and I refute the common line of thought that finding many simulations being run—or running them ourselves—must increase the odds that we are in a simulation. Blood supplies have become indexes of national security and the public good. While blood shortages can provoke anxiety, controversies continue to erupt in many countries over proper donor screening, especially with reference to HIV. This article sketches these dynamics in several global settings, focusing especially on activist efforts by gay men to reform exclusionary blood donor guidelines. The contours of the debate recall familiar conflicts between the putative demands of public health and the rights of individuals in the era of (...) AIDS. However, if gay activists marshal a discourse of individual rights vis-a-vis forms of institutional exclusion, they also seek a broader shift in social and cultural understandings of gay identity. To capture this complex interplay of citizenship and sociality, risk and responsibility, the article introduces the notion of `vital publics' to refer to the peculiar associational form represented by blood supplies. Vital publics are kinds of embodied association elicited through the generalized exchange of body — in this case, blood. Hailed to `give life' by the jargon of the pervasive social marketing of varied blood service systems, activists seek to contribute to the life of the `vital public' that transfusion medicine calls into being. > Wealthy nations must do much more, much faster. The United Nations General Assembly in September 2021 will bring countries together at a critical time for marshalling collective action to tackle the global environmental crisis. They will meet again at the biodiversity summit in Kunming, China, and the climate conference 26) in Glasgow, UK. Ahead of these pivotal meetings, we—the editors of health journals worldwide—call for urgent action to keep average global temperature increases below 1.5°C, halt the destruction of nature (...) and protect health. Health is already being harmed by global temperature increases and the destruction of the natural world, a state of affairs health professionals have been bringing attention to for decades.1 The science is unequivocal; a global increase of 1.5°C above the preindustrial average and the continued loss of biodiversity risk catastrophic harm to health that will be impossible to reverse.2 3 Despite the world’s necessary preoccupation with COVID-19, we cannot wait for the pandemic to pass to rapidly reduce emissions. Reflecting the severity of the moment, this editorial appears in health journals across the world. We are united in recognising that only fundamental and equitable changes to societies will reverse our current trajectory. The risks to health of increases above 1.5°C are now well established.2 Indeed, no temperature rise is ‘safe’. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 63.1 (2002) 63-82 [Access article in PDF] Faith, Philosophy, and the Nominalist Background to Luther's Defense of the Real Presence Thomas Osborne Recent scholarship has brought into question the traditional interpretation of Luther as being hostile towards philosophy. 1 Graham White claims that Luther holds a place in the history of logic as a member of the Nominalist tradition. 2 Bruce D. (...) Marshall argues that Luther and Thomas Aquinas fundamentally agree on the relationship between faith and reason. 3 Both scholars recognize that Luther himself stressed the importance of logic and used late medieval philosophical techniques. Although I agree with this scholarship that Luther's thought must not be understood in isolation from late medieval thought, I will argue that Luther uses philosophical ideas in a way which conflicts with that of the scholastic tradition. The focus here is on Luther's understanding of the relationship between faith and reason in the context of Luther's controversy over the Eucharist with the Swiss sacramentarians, among whom Zwingli and Oecolampadius were the most prominent. 4 Although Luther uses philosophical [End Page 63] distinctions to argue against what he thinks are misinterpretations of the Bible, he does not in any explicit and systematic way use philosophy to arrive at a theological understanding of the Eucharist. Luther differs from his scholastic predecessors in that he uses philosophy not to develop theological conclusions but only to attack errors about the Bible, and so the concern here is with Luther's use of Nominalist doctrines about presence in his attack on the sacra-mentarians' belief that Christ cannot be present both at the right hand of God and in the Eucharist at the same time.In his discussion of the Eucharistic doctrine which is presented in The Babylonian Captivity of the Church (1520), Luther not only argues against the Catholic doctrine of the Eucharistic sacrifice but also against transubstantiation. 5 Luther explicitly states that he was influenced on this issue by Peter D'Ailly, a Nominalist follower of William of Ockham. D'Ailly and other Nominalists thought that transubstantiation was not the only possible way that Christ could be present in the Eucharist, since if God wished he could also make Christ present along with the substance of the bread and wine. 6 From a Nominalist [End Page 64] perspective transubstantiation requires two actions of God, namely, the annihilation of the substance of the bread and the placement of Christ's body under the species. Therefore, consubstantiation would be a simpler account of Christ's Eucharistic presence. If Christ's body were present along with the substance of the bread annihilation would not have to occur. But D'Ailly and the Nominalists argue that we know from Church authority that the real presence occurs through transubstantiation. On this issue the Nominalists differ from Thomas Aquinas, who gives philosophically-based arguments against consubstantiation. 7 When Luther attacks Thomas, he attacks not so much the use of philosophy in theology as Thomas's philosophy: "But this opinion of Thomas hangs so completely in the air without support of Scripture or reason that it seems to me he knows neither his philosophy nor his dialectic." 8Since the Nominalist belief in transubstantiation rather than consubstantiation rests on an acceptance of Church authority, the rejection of such authority would seem to lead to a rejection of transubstantiation. If Luther had assented to traditional Nominalist theology with the sole exception of its reliance on Church authority, one would expect him to argue for the necessity of consubstantiation. However, Luther sees himself as rejecting an unnecessarily philosophical theology in a return to a more biblical faith. 9 Luther claims that he argues for a particular understanding of the Eucharistic presence but rather "that every one may feel at liberty to ponder, hold, and believe either one view or the other without endangering his salvation." 10 Although Luther's training in Nominalist theology leads him to think that consubstantiation is possible, he at no point argues that a belief... This paper examines the function of Hume’s use of a peculiar example from A Treatise of Human Nature. The example in question is that of a burning piece of coal that is whirled around at a sufficient speed to present to a viewer an image of a circle of fire. The example is a common one; and Hume himself points to Locke as his source in this case. Hume’s reference appears accurate since both Locke and Hume seem to marshal the (...) example in order to bolster a case for an upper and lower temporal threshold for perception. But several philosophical problems inherent in Hume’s appeal to the example make the case for Locke as Hume’s sole or even primary source difficult to sustain. The paper sketches a history of uses of the example from the seventeenth century through the twentieth century. An argument is presented that Pierre Bayle’s use of the example is most in accord with Hume’s, and that for this and other reasons, Bayle is his likeliest source. Further, making sense in this way of Hume’s use of the burning coal example illuminates Hume’s interesting contributions to the notions of time, identity, and individuation. (shrink)
