In recent literature many theorists, including Eklund (2011), endorse or express sympathy towards the view that the evaluative content of thick terms is not asserted with utterances of sentences containing them but rather part of their secondary content. In this article we discuss a number of features of thick terms which speak against this view. We further argue that these features are not shared by another, recently much-discussed, class of hybrid evaluative terms, so-called slurs, and that the evaluative contents of (...) these might thus very well be secondary. Within contemporary metaethics, it is widely held that there is a “presumption of realism” in moral thought and discourse. Anti-realist views, like error theory and expressivism, may have certain theoretical considerations speaking in their favor, but our pretheoretical stance with respect to morality clearly favors objectivist metaethical views. This article argues against this widely held view. It does so by drawing from recent discussions about so-called “subjective attitude verbs” in linguistics and philosophy of language. Unlike pretheoretically objective predicates (e.g., “is (...) made of wood”, “is 185 cm tall”), moral predicates embed felicitously under subjective attitude verbs like the English “find”. Moreover, it is argued that the widespread notion that moral discourse bears all the marks of fact-stating discourse is rooted in a blinkered focus on examples from English. Cross-linguistic considerations suggest that subjective attitude verbs are actually the default terms by which we ascribe moral views to people. Impressions to the contrary in English have to do with some unfortunate quirks of the term “think”. (shrink)

A well-known theory about under which circumstances a statement is true in a fiction is The Reality Principle, which originate in the work of David Lewis: (RP) Where p1... pn are the primary fictional truths of a fiction F , it is true in F that q iff the following holds: were p1 ... pn the case, q would have been the case (Walton 1990: 44). RP has been subjected to a number of counterexamples, up to a point where, in (...) the words of Stacie Friend “it is widely recognized that the Reality Principle […] cannot be a universal inference rule for implied story-truths” (Friend 2017: 33). This chapter argues that the strength of these counterexamples is widely overestimated, and that they do not, on closer scrutiny, constitute reasons for rejecting RP. (shrink)

ABSTRACTEvaluative aesthetic discourse communicates that the speaker has had first-hand experience of what is talked about. If you call a book bewitching, it will be assumed that you have read the book. If you say that a building is beautiful, it will be assumed that you have had some visual experience with it. According to an influential view, this is because knowledge is a norm for assertion, and aesthetic knowledge requires first-hand experience. This paper criticizes this view and argues for (...) an alternative view, according to which aesthetic discourse expresses affective states of mind, analogously to how assertions express beliefs. It is because these affective states require first-hand experience that aesthetic discourse communicates that such acquaintance is at hand. The paper furthermore argues that the lack of an experience requirement for aesthetic belief ascriptions constitutes a problem for the kind of expressivist who claims that evaluative belief states are covert non-cognitive states. It is widely held within contemporary metaethics that there is a lack of linguistic support for evaluative expressivism. On the contrary, it seems that the predictions that expressivists make about evaluative discourse are not borne out. An instance of this is the so-called problem of missing Moorean infelicity. Expressivists maintain that evaluative statements express non-cognitive states of mind in a similar manner to how ordinary descriptive language expresses beliefs. Conjoining an ordinary assertion that p with the denial of being in (...) the corresponding belief state famously gives rise to Moorean infelicity:?? It’s raining but I don’t believe that it’s raining. If expressivists are right, then conjoining evaluative statements with the denial of being in the relevant non-cognitive state of mind should give rise to similar infelicity. However, as several theorists have pointed out, this does not seem to be the case. Statements like the following are not infelicitous: Murder is wrong but I don’t disapprove of it. In this paper, I argue that evaluative statements express the kind of states that are attributed by ‘find’-constructions in English and that these states are non-cognitive in nature. This addresses the problem of missing Moorean infelicity and, more generally, goes to show that there are linguistic facts which support expressivism about evaluative discourse. (shrink)

Consider the opening sentence of Tolkien’s The Hobbit: In a hole in the ground there lived a hobbit. By writing this sentence, Tolkien is making a fictional statement. There are two influential views of the nature of such statements. On the pretense view, fictional discourse amounts to pretend assertions. Since the author is not really asserting, but merely pretending, a statement such as Tolkien’s is devoid of illocutionary force altogether. By contrast, on the alternative make-believe view, fictional discourse prescribes that (...) the reader make-believe the content of the statement. In this paper, we argue that neither of these views is satisfactory. They both fail to distinguish the linguistic act of creating the fiction, for instance Tolkien writing the sentence above, from the linguistic act of reciting it, such as reading The Hobbit out loud for your children. As an alternative to these views, we propose that the essential feature of the author’s speech act is its productive character, that it makes some state of affairs obtain in the fiction. Tolkien’s statement, we argue, has the illocutionary force of a declaration. (shrink)

Some things that we take to be the case in a fictional work are never made explicit by the work itself. For instance, we assume that Sherlock Holmes does not have a third nostril, that he wears underpants and that he has never solved a case with a purple gnome, even though neither of these things is ever mentioned in the narration. This article argues that examples like these can be accounted for through the same content-enriching reasoning that we employ (...) when confronted with non-fictional discourse, with the important difference that fictional discourse essentially involves pretence. Fictional discourse works in much the same way as non-fictional discourse, and what is conveyed without being stated can accordingly be explained through familiar pragmatic mechanisms. It is argued that this account carries some distinct advantages over competing views. (shrink)

Supervenience in metaethics is the notion that there can be no moral dif-ference between two acts, persons or events without some non-moral difference underlying it. If St. Francis is a good man, there could not be a man exactly like St. Francis in non-evaluative respects that is not good. The phenomenon was first systematically discussed by R. M. Hare (1952), who argued that realists about evaluative properties struggle to account for it. As is well established, Hare, and following him, Simon (...) Blackburn, mistakenly took the relevant phenomenon to be weak rather than strong supervenience, and the explanations they offered for it are accordingly outdated. In this paper, I present a non-factualist account of strong su-pervenience of the evaluative and argue that it fares better than compet-ing realist views in explaining the conceptual nature of the phenomenon, as well as in offering an account of the supervenience of the evaluative in general, rather than more narrowly the moral. While Hare and Blackburn were wrong about the specifics, they were right in that non-factualists can offer a plausible account of the supervenience of the evaluative, that in certain respects is superior to competing realist explanations. This article discusses why it is the case that we refuse to accept strange evaluative claims as being true in fictions, even though we are happy to go along with other types of absurdities in such contexts. For instance, we would refuse to accept the following statement as true, even in the con-text of a fiction: -/- (i) In killing her baby, Giselda did the right thing; after all, it was a girl. -/- This article offers a sensibilist diagnosis of (...) this puzzle, inspired by an observation first made by David Hume. According to sensibilism, the way we feel about things settles their evaluative properties. Thus, when confronted with a fictional scenario where the configuration of non-evaluative facts and properties is relevantly similar to the actual world, we refuse to go along with evaluative properties being instantiated ac-cording to a different pattern. It is the attitudes we hold in the actual world that fix the extension of evaluative properties, even in non-actual worlds. When engaging with a fiction, we (to some extent) leave our be-liefs about what the world is like behind, while taking our emotional atti-tudes with us into the fiction. To substantiate this diagnosis, this paper outlines a sensibilist semantics for evaluative terms, based on recent discussion regarding predicates of personal taste, and explains how, together with standard assumptions about the nature of fictional discourse, it makes the relevant predictions with respect to engagement with fictions. It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

§1. Iterated Gödelian extensions of theories. The idea of iterating ad infinitum the operation of extending a theory T by adding as a new axiom a Gödel sentence for T, or equivalently a formalization of “T is consistent”, thus obtaining an infinite sequence of theories, arose naturally when Godel's incompleteness theorem first appeared, and occurs today to many non-specialists when they ponder the theorem. In the logical literature this idea has been thoroughly explored through two main approaches. One is that (...) initiated by Turing in his “ordinal logics” and taken very much further in Feferman's work on transfinite progressions, which also introduced the more general study of extensions by reflection principles, of which consistency statements are a special case. This approach starts from an assignment of theories to ordinal notations, and extracts sequences of theories through a suitable choice of a path in the set of ordinal notations. The second approach, illustrated in particular by the work of Schmerl and Beklemishev, starts instead from a suitably well-behaved primitive recursive well-ordering, which is used to define a sequence of theories. This second approach has led to precise results about the relative proof-theoretical strength of sequences of theories obtained by iterating different reflection principles. The Turing-Feferman approach, on the other hand, lends itself well to an investigation in qualitative and philosophical terms of the relevance of such iterated reflection extensions to mathematical knowledge, in particular because of two developments associated with this approach. The right to health is enshrined in the constitution of the World Health Organization and numerous other international agreements. Yet today, an estimated 5.7 million people die each year from treatable infectious diseases, most of which are susceptible to existing antimicrobials if they were accessible. These deaths occur predominantly among populations living in poverty in low- and middle-income countries, and they greatly exceed the estimated 700,000 annual deaths worldwide currently attributed to antimicrobial resistance. Ensuring universal appropriate access to antimicrobials is (...) not only a critical part of realizing the right to health, it is necessary for mobilizing effective collective action against the development and spread of AMR. Dahlbäck, Forsblad and Hydén argue that conversational remembering in the real‐world must be acknowledged as an interactional practice grounded in and bound to the communicative actions produced by the interlocutors. They illustrate the complexity of those processes by referring to their own fieldwork examining older adults’ prospective memory within their homes (Dahlbäck, Kristiansson, & Stjernberg, 2013) and propose alternative methodologies (e.g., scenarios design) to increase collaborations between ethnographic and experimental memory researchers.

Early modern medicine was much more dependent on the senses than its contemporary counterpart. Although a comprehensive medical theory existed that assigned great value to taste and odor of medicaments, historical descriptions of taste and odor appears imprecise and inconsistent to modern eyes. How did historical actors move from subjective experience of taste and odor to culturally stable agreements that facilitated communication about the sensory properties of medicaments? This paper addresses this question, not by investigating texts, but by going straight (...) to the sensory impression, which certain substances convey. The aim is not to overwrite or rectify historical descriptions but to investigate whether modern methodologies for sensory assessment can be enlisted to understand the past. We draw on history of science for framing and research questions, pharmaceutical science for knowledge of pharmaceuticals and preparations, and food and meal science for assaying procedures and protocols. We show that sensory evaluation can yield precise descriptions that would not have been alien to early modern medicine makers. However, there are problems with translating descriptions of taste between different historical contexts. By comparing contemporary descriptions of sensations with eighteenth‐century ones, the article discusses how sensory descriptions are highly dependent on context, and subject to historical change. Emergence is a universal phenomenon that can be defined mathematically in a very general way. This is useful for the study of scientifically legitimate explanations of complex systems, here defined as hyperstructures. A requirement is that the observation mechanisms are considered within the general framework. Two notions of emergence are defined, and specific examples of these are discussed.

This contribution traces the parallel development of two distinct approaches to peasant agroecological education: the peasant-to-peasant horizontal method that disseminated across Mesoamerica and the Caribbean beginning in the 1970s, and the political-agroecological training schools of combined consciousness-building and skill-formation that have been at the heart of the educational processes of member organizations of La Via Campesina since the 1990s. Applying a theoretical framework that incorporates territorial struggle, agroecology and popular education, we examine spatial and organizational aspects of each of these (...) models for peasant education and movement-building. Recognizing that the models, their respective contexts, and the dialectical relationships therein have been in constant evolution, we share findings on the movement-place as a territorial system with socio-historical subjectivity, that is, peasant movements as territorially-embedded, collective historical actors. This leads to some conclusions in moving past educational theory that has centered upon individual subjects, and approaching a conception of territory as a subject of learning processes. (shrink)

Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim Erwerb (...) argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. Orientiert an klaren fachlichen Standards finden sich hier Aufgaben auf vier Niveaustufen, jeweils in Verbindung mit übersichtlichen Merkblättern. Die Aufgaben der beiden unteren Niveaustufen lassen sich bereits für jüngere Lernende der Sekundarstufe einsetzen, Aufgaben der obersten Niveaustufe richten sich an Lernende von Abschlussklassen oder der Studieneingangsphase. Für die Hand der Lehrpersonen werden die Aufgaben und Merkblätter durch fachliche und didaktische Kommentare sowie Lösungshinweise ergänzt. (shrink)

The focus of this paper are Dummett's meaning-theoretical arguments against classical logic based on consideration about the meaning of negation. Using Dummettian principles, I shall outline three such arguments, of increasing strength, and show that they are unsuccessful by giving responses to each argument on behalf of the classical logician. What is crucial is that in responding to these arguments a classicist need not challenge any of the basic assumptions of Dummett's outlook on the theory of meaning. In particular, I (...) shall grant Dummett his general bias towards verificationism, encapsulated in the slogan 'meaning is use'. The second general assumption I see no need to question is Dummett's particular breed of molecularism. Some of Dummett's assumptions will have to be given up, if classical logic is to be vindicated in his meaning-theoretical framework. A major result of this paper will be that the meaning of negation cannot be defined by rules of inference in the Dummettian framework. (shrink)

In this paper, we consider a few actual cases of mnemonic strategies among older subjects (older than 65). The cases are taken from an ethnographic study, examining how elderly adults cope with cognitive decline. We believe that these cases illustrate that the process of remembering in many cases involve a complex distributed web of processes involving both internal or intracranial and external sources. Our cases illustrate that the nature of distributed remembering is shaped by and subordinated to the dynamic characteristics (...) of the on-going activity and to our minds suggest that research on memory and distributed cognition should focus on the process of remembering through detailed descriptions and analysis of naturally occurring situations. Rumfitt has given two arguments that in unilateralist verificationist theories of meaning, truth collapses into correct assertibility. In the present paper I give similar arguments that show that in unilateral falsificationist theories of meaning, falsehood collapses into correct deniability. According to bilateralism, meanings are determined by assertion and denial conditions, so the question arises whether it succumbs to similar arguments. I show that this is not the case. The final section considers the question whether a principle central to Rumfitt's first (...) argument, ‘It is assertible that if and only if it is assertible that it is assertible that ’, is one that bilateralists can reject, and concludes that they cannot. It follows that the logic of assertibility and deniability, according to a result by Williamson, is the little known modal logic K4 studied by Sobociński. The paper ends with a plaidoyer for bilateralists to adopt this logic. (shrink)

We treat the classical dynamics of the hydrogen atom in perpendicular electric and magnetic fields as a celestial mechanics problem. By expressing the Hamiltonian in appropriate action–angle variables, we separate the different time scales of the motion. The method of averaging then allows us to reduce the system to two degrees of freedom, and to classify the most important periodic orbits.

In bilateral logic formulas are signed by + and –, indicating the speech acts assertion and denial. I argue that making an assumption is also speech act. Speech acts cannot be embedded within other speech acts. Hence we cannot make sense of the notion of making an assumption in bilateral logic. Attempts to solve this problem are considered and rejected.

Empathy facilitates everyday social interactions and has often been linked in the literature to prosocial behavior. Robust evidence has been found for a positive relationship between experiencing empathy and behaving prosocially. However, empathy, and the empathy–prosocial behavior relationship in particular, has been studied mostly in combination with negative emotions. Less research has been conducted on empathy for positive emotions, and the link between positive empathy and displayed prosocial behavior has not been intensively investigated so far. The purpose of the present (...) article is thus twofold: first, we review and summarize research evidence on empathy for positive emotions, and second, we propose that people’s motivation to maintain an experienced positive affect is a viable mechanism linking positive empathy and prosocial behavior. One way to explain the epistemic access to the world that fictional literature provides is by comparing it to thought experiments. Both? thought experiments and works of fiction? might be seen as imaginative exercises which help to find out what would or could happen if certain conditions were met. This comparison of fictional literature with thought experiments provides the point of departure (...) for the contributions in our volume. It contributes to the discussion of an approach that has quite recently entered the field of the philosophy of literature. (shrink)

Am Beginn des 21. Jahrhunderts sind die gesellschaftlichen Konsequenzen neuer Formen der Sammlung, Verwendung und Vernetzung von Daten zur Überwachung und Beeinflussung von Menschen und Gruppen noch nicht vollends absehbar. Mit den Surveillance Studies können die Bedingungen und Diskurse von Sicherheit, Überwachung und Kontrolle im Rahmen einer interdisziplinären Forschungsinitiative analysiert werden. Verschiedene Pespektiven werden hier einführend dargestellt. Beiträge aus der Rechtswissenschaft, der Kriminologie, der Geographie, Soziologie und Kunstgeschichte zeigen, welche unterschiedlichen Perspektiven es gibt, um die komplexen und folgenreichen Zusammenhänge der (...) Surveillance zu verstehen oder zukünftige Entwicklungen einzuschätzen. Die verschiedenen Perspektiven ergänzen sich zu einem Gesamtbild, welches die Strukturen und Feinheiten dieser Entwicklungen deutlich macht. Die Beiträge gehen dabei auf grundsätzliche Probleme bei der Analyse von Überwachung aus ihrer jeweiligen Sicht ein und bieten so eine kompakte Übersicht über ein spezifisches, in dieser Hinsicht neues Forschungsfeld. Weiterhin zeigen sie, wie vielschichtig der Einfluss der von Überwachungtechnologien und Kontrolldiskursen auf unser tägliches Leben tatsächlich ist. Als einführende Texte bieten die versammelten Beiträge einen Ausgangspunkt für weitere Analysen und Diskussionen – vor allem jenseits aller akademischen Debatten. (shrink)

Kampf, Gewalt und Subjekt sind in der modernen Philosophie seit langem verbunden. Dies zeigt sich auch in anderen kulturellen Reflexionsräumen wie dem Boxkampf. Wenn Menschen kämpfen, lenken sie Aggression und Gewalt in regelgeleitete, gesellschaftskonforme Bahnen. Die Kontrahenten müssen sich gegenseitig anerkennen und machen sich selbst als eigenständige Subjekte anerkennbar. Das Buch diskutiert, inwiefern der Boxkampf als exemplarische Aufführung des Entstehens von Subjektivität in und durch einen Kampf in Bezug auf Hegel und Nietzsche verstanden werden kann. Bei beiden Denkern findet sich (...) eine agonale Essenz. Im Gegeneinander sollen Subjekte eigenständige Individuen werden. Zugleich gilt die Agonalität sozialen Lebens beiden als Grundlage sozialer Entwicklung. Die Idee der fundamentalen Bedeutung von Kämpfen entwickelt sich in der Philosophie des frühen 20. Jahrhunderts zu einem Leitgedanken, der auch über die Philosophie hinaus bedeutsam wird und im Boxkampf eine besondere Aufführungsform findet. (shrink)

Ethicism is the most comprehensively defended answer to the question regarding whether ethical properties determine aesthetic properties in artworks. According to ethicism, aesthetically relevant ethical flaws in artworks count as aesthetic flaws and aesthetically relevant ethical merits count as aesthetic merits. In this paper, I argue that ethicism’s most significant argument, the Merited Response Argument suffers from an ambiguity that makes it either unsound or uninteresting. Specifically, the notion of an artwork’s ‘prescribing’ a response, central to MRA, is ambiguous between (...) merely attempting to elicit a response from appreciators as appropriate to a work, and endorsing a response as appropriate to relevant parts of the actual world. While the first sense of ‘prescribe’ does the aesthetic work, the second does the ethical. (shrink)

In this paper, we explore and discuss the use of the concept of being affected in biomedical decision making processes in Germany. The corresponding German term ‘Betroffenheit’ characterizes on the one hand a relation between a state of affairs and a person and on the other an emotional reaction that involves feelings like concern and empathy with the suffering of others. An example for the increasing relevance of being affected is the postulation of the participation of people with disabilities and (...) chronic or acute diseases in the discourse, as partly realized in the German National Ethics Council or the Federal Joint Committee. Nevertheless, not only on the political level, the resistance against the participation of affected people is still strong; the academic debate seems to be cross-grained, too. Against this background, we explore the meaning and argumentative role of the concept of being affected as it is used by affected and lay people themselves. Our analysis is based on four focus group discussions in which lay people, patients and relatives of patients discuss their attitudes towards biomedical interventions such as organ transplantation and genetic testing. This setting allows for a comparison of how affected and non-affected people are concerned and deliberate about medical opportunities, but also of how they position themselves as being affected or non-affected with respect to (scientific) knowledge and morality. On this basis, we discuss the normative relevance of being affected for the justification of political participation. (shrink)

Mobile health devices pose novel questions at the intersection of philosophy and technology. Many such applications not only collect sensitive data, but also aim at persuading users to change their lifestyle for the better. A major concern is that persuasion is paternalistic as it intentionally aims at changing the agent’s actions, chipping away at their autonomy. This worry roots in the philosophical conviction that perhaps the most salient feature of living autonomous lives is displayed via agency as opposed to patiency—our (...) lives go well in virtue of what we do, rather than what happens to us. Being persuaded by a device telling us how to conduct our lives seemingly renders the agent passive, an inert recipient of technological commands. This agential bias, however, has led to a marginalization of patiential characteristics that are just as much part of our lives as are agential characteristics. To appreciate the inherent interlocking of acting and being acted upon, it is vital to acknowledge that agency and patiency are correlates, not mutually exclusive opposites. Furthermore, it is unclear whether an action can only count as agential so long as its causes are internal. Drawing on the extended mind and extended will framework, I argue that mHealth applications merely serve as volitional aids to the agent’s internal cognition. Autonomously set goals can be achieved more effectively via technology. To be persuaded by an mHealth device does not mainly—let alone exclusively—emphasize patiency; on the contrary, it can be an effective tool for technologically enhancing agency. (shrink)

Ian Rumfitt has proposed systems of bilateral logic for primitive speech acts of assertion and denial, with the purpose of ‘exploring the possibility of specifying the classically intended senses for the connectives in terms of their deductive use’ : 810f). Rumfitt formalises two systems of bilateral logic and gives two arguments for their classical nature. I assess both arguments and conclude that only one system satisfies the meaning-theoretical requirements Rumfitt imposes in his arguments. I then formalise an intuitionist system of (...) bilateral logic which also meets those requirements. Thus Rumfitt cannot claim that only classical bilateral rules of inference succeed in imparting a coherent sense onto the connectives. My system can be extended to classical logic by adding the intuitionistically unacceptable half of a structural rule Rumfitt uses to codify the relation between assertion and denial. Thus there is a clear sense in which, in the bilateral framework, the difference between classicism and intuitionism is not one of the rules of inference governing negation, but rather one of the relation between assertion and denial. The present paper unravels ontological and normative conditions of personhood for the purpose of critiquing ‘Cognitivist Views’. Such views have attracted much attention and affirmation by presenting the ontology of personhood in terms of higher-order cognition on the basis of which normative practices are explained and justified. However, these normative conditions are invoked to establish the alleged ontology in the first place. When we want to know what kind of entity has full moral status, it is tempting to establish an (...) ontology that fits our moral intuitions about who should qualify for such unique normative standing. But this approach conflates personhood’s ontology and normativity insofar as it stresses the primacy of the former while implicitly presupposing the latter; it thereby suffers from a ‘Normative Fallacy’ by inferring from ‘ought’ to ‘is’. Following my critique of Cognitivism, I sketch an alternative conception, contending that, whereas the Cognitivist ontology of personhood presupposes the normative, a social ontology is constituted by it. In due consideration of evidence from developmental psychology, the social embeddedness of persons—manifested in the ability of taking a ‘second-person stance’—is identified as a key feature of personhood that precedes higher-order cognition, and is directly linked to basic normative concerns. This article is an attempt to examine Christoph Menke’s critical theory of modern bourgeois law through the lenses of analytic jurisprudence. We therefore scrutinize some core concepts from his Critique of Rights in order to gain a better understanding of the so-called “new law” which is presented as a theoretical alternative to the allegedly defective law of ius proprium-rights [Eigenrechte]. In the first part, we sharpen Menke’s concept of normativity with a reason-based approach and by using the metaethical notions of (...) formal and robust normativity. This sets the stage for analyzing his brand-new concept of counter-rights [Gegenrechte] in the second part. We identify a whole archipelago of meanings for it and group them by considering potential mereological relations between ius proprium-rights and counter-rights. Our mapping turns out to be fruitful in shedding new light on an already known dilemma for the concept of counter-rights. The final section delivers a sketch of the implementation challenge for counter-rights: How can we achieve a “new law”? We distinguish several conceptions of a corresponding utopia and criticize Menke for resorting to a construction that is based on a fiction. (shrink)
