Two currently much discussed views about truth, truth pluralism and truth relativism, are found in Sellars’s writings. I show that his motivations for adoping these views are interestingly different from those shared by most of their recent advocates. First, I explain how Sellars comes to embrace a version of truth pluralism. I argue that his version overcomes a difficulty confronting pluralists, albeit at a serious cost. Then I argue that Sellars’s truth pluralism isn’t motivated by his interest in domains of (...) discourse beyond the “matter-of-factual.” Rather, the key to his truth pluralism, his analysis of truth as “semantical assertibility,” is motivated by the same consideration that leads him to adopt truth relativism. This is his interest in applying semantic notions to discourse that embodies conceptual structures other than ours. Despite their common motivation, I conclude that Sellars’s relativism is independent of, and indeed stands in tension with, the analysis of truth that underlies his pluralism. (shrink)

Surveys Western literature and thought to reveal the evolution of the ideals of sincerity and authenticity.

A growing number of bioethics papers endorse the harm threshold when judging whether to override parental decisions. Among other claims, these papers argue that the harm threshold is easily understood by lay and professional audiences and correctly conforms to societal expectations of parents in regard to their children. English law contains a harm threshold which mediates the use of the best interests test in cases where a child may be removed from her parents. Using Diekema9s seminal paper as an example, (...) this paper explores the proposed workings of the harm threshold. I use examples from the practical use of the harm threshold in English law to argue that the harm threshold is an inadequate answer to the indeterminacy of the best interests test. I detail two criticisms: First, the harm standard has evaluative overtones and judges are loath to employ it where parental behaviour is misguided but they wish to treat parents sympathetically. Thus, by focusing only on ‘substandard’ parenting, harm is problematic where the parental attempts to benefit their child are misguided or wrong, such as in disputes about withdrawal of medical treatment. Second, when harm is used in genuine dilemmas, court judgments offer different answers to similar cases. This level of indeterminacy suggests that, in practice, the operation of the harm threshold would be indistinguishable from best interests. Since indeterminacy appears to be the greatest problem in elucidating what is best, bioethicists should concentrate on discovering the values that inform best interests. (shrink)

In an earlier paper entitled _Harm is all you need?_, I used an analysis of English law to claim that the harm threshold was an unsuitable mediator of the best interests test when deciding if parental decisions should be overruled. In this paper I respond to a number of commentaries of that paper, and extend my discussion to consider the claim that the harm threshold gives appropriate normative weight to the interests of parents. While I accept that parents have some (...) rights over their children, I argue these are dependent on parents’ duties to benefit their children. While many such benefits are understood pluralistically, and are thus within parents’ ambit to decide, I claim that health benefits are ordinally different, because they play a foundational role in the flourishing of an individual. In the light of this, clinicians have the moral authority to override parental refusals, although in some cases abstaining from exercising this authority may be a pragmatic way to maintain parental engagement and ensure our ability to benefit the child in future. Laborie and Hessayon bring rare prophetic and millenarian texts to an international audience by presenting sources from all over Europe (broadly defined), and across the early modern period in English for the first time.

The experience of being famous was investigated through interviews with 15 well-known American celebrities. The interviews detail the existential parameters of being famous in contemporary culture. Research participants were celebrities in various societal categories: government, law, business, publishing, sports, music, film, television news and entertainment. Phenomenological analysis was used to examine textural and structural relationship-to-world themes of fame and celebrity. The study found that in relation to self, being famous leads to loss of privacy, entitization, demanding expectations, gratification of ego (...) needs, and symbolic immortality. In relation to other, or world, being famous leads to wealth, access, temptations, and concerns about family impact. Areas of psychological concern for celebrity mental health include character-splitting, mistrust, isolation, and an unwillingness to give up fame. Being-in-the-world of celebrity is a process involving four temporal phases: love/hate, addiction, acceptance, and adaptation. Findings are presented in the form of a Composite Textural Description and two Individual Structural Descriptions. (shrink)

Background Best interests is a ubiquitous principle in medical policy and practice, informing the treatment of both children and adults. Yet theory underlying the concept of best interests is unclear and rarely articulated. This paper examines bioethical literature for theoretical accounts of best interests to gain a better sense of the meanings and underlying philosophy that structure understandings. Methods A scoping review of was undertaken. Following a literature search, 57 sources were selected and analysed using the thematic method. Results Three (...) themes emerged. The first placed best interests within the structure of wider theory, noting relationships with consequentialism, deontology, prudential value theory, rights and political philosophy. The second mapped a typology of processes of decision-making, among which best interests was ambiguously positioned. It further indicated factors that informed best interests decision-making, primarily preferences, dignity and quality of life. The final theme considered best interests from a relational perspective. Conclusions Characterisation of best interests as strictly paternalist and consequentialist is questionable: while accounts often suggested a consequentialist basis for best interests, arguments appeared philosophically weak. Deontological accounts, found in law and Kantianism, and theories of political liberalism influenced accounts of best interests, with accounts often associating best interests with negative patient preferences (i.e. individual refusals). There was much more emphasis on negative interests than positive interests. Besides preference, factors like dignity and quality of life were held to inform best interests decisions, but generally were weakly defined. To the extent that preferences were unable to inform decision making, decisions were either made by proxy authority or by an intersubjective process of diffuse authority. Differing approaches reflect bifurcations in liberal philosophy between new liberalism and neo-liberalism. Although neither account of authority appears dominant, bias to negative interests suggests that bioethical debate tends to reflect the widespread ascendancy of neo-liberalism. This attitude was underscored by the way relational accounts converged on private familial authority. The visible connections to theory suggest that best interests is underpinned by socio-political trends that may set up frictions with practice. How practice negotiates these frictions remains a key question. (shrink)

Assent to medical research or treatment may be an intuitively attractive way to address the area between incapacity and capacity that might otherwise be subject to a best interests assessment. Assent has become a widely disseminated concept in law, research, and clinical ethics, but little conceptual work on assent has so far occurred. An exploration of use of assent in treatment and research in children and people with dementia suggests that at least five claims are made on behalf of assent. (...) Since at least some of these may lead to tensions with others, assent requires firmer conceptual underpinning. Whether assent remains primarily a local approach to research in children in the United States, where it appears to fit with legal background conditions, or develops its promise to overturn the dominant, binary, approach to (in)capacity will depend on the strength of future philosophical work to improve the theoretical foundations to assent. In the western healthcare, shared decision making has become the orthodox approach to making healthcare choices as a way of promoting patient autonomy. Despite the fact that the autonomy paradigm is poorly suited to paediatric decision making, such an approach is enshrined in English common law. When reaching moral decisions, for instance when it is unclear whether treatment or non-treatment will serve a child’s best interests, shared decision making is particularly questionable because agreement does not ensure moral validity. With reference (...) to current common law and focusing on intensive care practice, this paper investigates what claims shared decision making may have to legitimacy in a paediatric intensive care setting. Drawing on key texts, I suggest these identify advantages to parents and clinicians but not to the child who is the subject of the decision. Without evidence that shared decision making increases the quality of the decision that is being made, it appears that a focus on the shared nature of a decision does not cohere with the principle that the best interests of the child should remain paramount. In the face of significant pressures toward the displacement of the child’s interests in a shared decision, advantages of a shared decision to decisional quality require elucidation. Although a number of arguments of this nature may have potential, should no such advantages be demonstrable we have cause to revise our commitment to either shared decision making or the paramountcy of the child in these circumstances. Dans cet article, nous analysons comment et dans quelle mesure les changements dans les modalités d’allocation des financements publics génèrent des transformations dans les pratiques, les temporalités et l’organisation de la recherche en histoire. Face aux deux thèses qui s’affrontent autour de cette problématique, l’une soutenant l’hypothèse de la déprofessionnalisation et de la perte d’autonomie des chercheurs, et l’autre celle d’une recomposition de la profession académique, le travail d’enquête réalisé dans trois laboratoires d’histoire en France montre qu’il n’y a pas (...) de modèle unique d’adaptation des équipes et des chercheurs par rapport à la montée en puissance des financements sur projet (FSP). La prise en compte du niveau organisationnel, avec ses spécificités contextuelles, se révèle essentielle pour saisir les modalités d’ajustement des laboratoires et des chercheurs face au renforcement des mécanismes de contractualisation. Par ailleurs, contrairement aux disciplines nécessitant des dispositifs expérimentaux coûteux, le niveau plus modeste des ressources mobilisées pour la conduite des recherches en histoire permet plus facilement aux historiens d’adopter une position de repli face aux FSP. Cette posture est également renforcée par le système de reconnaissance de la qualité académique propre au champ historiographique qui accorde une importance particulière au travail individuel et à l’investissement de longue durée. The experience of being in love involves a longing for union with the other, where an important part of this longing is sexual desire. But what is the relation between being in love and sexual desire? To answer this it must first be seen that the expression ‘in love’ normally refers to a personal relationship. This is because to be ‘in love’ is to want to be loved back. This much would be predicted by equity and social exchange theories of (...) interpersonal attraction. Findings suggest however that love differs fundamentally from liking and, consequently, distinct approaches to the theory of love have been developed. A phenomenological theory is then put forward which suggests that the experience of being in love involves a complex of desires for reciprocal vulnerability in order to care and be cared for. Sexual desire is then seen to involve the physical expression of these desires in the form of desires for mutual baring in order to caress and be caressed. Unlike love, however, sexual desire need not refer to the other person's desires. This is supported by the existence of sexual desires like fetishism. It is concluded that other desires which often appear in instances of being in love are not basic to the experience of being in love. (shrink)

Attempts to conduct systematic reviews of ethical arguments in bioethics are fundamentally misguided. All areas of enquiry need thorough and informative literature reviews, and efforts to bring transparency and systematic methods to bioethics are to be welcomed. Nevertheless, the raw materials of bioethical articles are not suited to methods of systematic review. The eclecticism of philosophy may lead to suspicion of philosophical methods in bioethics. Because bioethics aims to influence medical and scientific practice it is tempting to adopt scientific language (...) and methods. One manifestation is the increasing innovation in, and use of, systematic reviews of ethical arguments in bioethics. Yet bioethics, as a broadly philosophical area of enquiry, is unsuited to systematic review. Bioethical arguments are evaluative, so notions of quality and bias are inapplicable. Bioethical argument is conceptual rather than numerical, and the classification of concepts is itself a process of argument that cannot aspire to neutrality. Any ‘systematic review’ of ethical arguments in bioethics thus falls short of that name. Furthermore, labels matter. Although the bioethics research community may find that adopting the language and the outward methods of clinical science offers apparent prospects of credibility, policy influence and funding, we argue that such misdirection carries risks and is unlikely to pay dividends in the long term. Bioethical sources are amenable to the review methods of the social sciences, and it is on these methods that specific methods of bioethics literature review should be built. (shrink)

However, once the problem has been construed in these terms, it is plain that too much has already been assumed. For what has been assumed is just that persons do have an identity. Wikipedia est devenue en quelques années un outil de diffusion d'informations scientifiques de premier plan, utilisé par élèves, professeurs et chercheurs (parmi ces derniers, un sur dix reconnaît y contribuer). Malgré un système d'édition relativement complexe, le ' wiki de la connaissance ' a gagné en popularité (15 millions d'articles, 270 langues, 100 000 contributeurs bénévoles). On en sait davantage sur son fonctionnement : son taux d'erreur factuel est relativement similaire à celui de l'encyclopédie payante Britannica ; les articles sont (...) souvent rédigés par un petit nombre de contributeurs (5 % des contributeurs sont à l'origine de 90 % du contenu) ; une série d'' administrateurs ' jouent les pompiers ou les gendarmes, non sans s'attirer les foudres d'une partie des contributeurs ; dynamique communautaire et positionnement identitaire sont les deux motivations principales pour contribuer ; les sources scientifiques sont d'autant plus citées dans Wikipedia qu'elles le sont déjà dans le monde scientifique (le ' facteur d'impact ' est involontairement reproduit)... Comparée à ses concurrents, Citizendium et Knol, l'encyclopédie contributive se démarque par son développement insolent, mais l'éventualité d'une stabilisation du nombre d'articles (on assiste aujourd'hui à une sorte de plafonnement) laisse imaginer qu'à l'avenir les contributeurs se concentreront davantage sur la qualité des articles. Building on recent work, I present sequent systems for the non-classical logics LP, K3, and FDE with two main virtues. First, derivations closely resemble those in standard Gentzen-style systems. Second, the systems can be obtained by reformulating a classical system using nonstandard sequent structure and simply removing certain structural rules (relatives of exchange and contraction). I clarify two senses in which these logics count as “substructural.”.

ABSTRACT:‘Race’ has long searched for a stable, suitable idea, with no consensus on a master meaning in sight. What I call deflationary pluralism about the existence of race recognizes that various meanings may be true as far as they go but avoids murky disputes over whether there are races in some sense. Once we have rejected the notion that racial essences yield innate cognitive differences, there is little point to arguing over the race idea. In its place, I propose the (...) idea of socioancestry, which jettisons racial thinking yet recognizes the social dynamics of color. For example, Black Americans, many of whom have traceable non-African ancestry, constitute an Africa-identified, socioancestrally black subgroup. ‘Race’ talk is not needed to sustain legitimate color-conscious approaches to social identity and social justice. Long-standing fixation on the race idea has obscured the simple truth that visible continental ancestry is the root of the social reality of color consciousness. (shrink)

New methods to analyse social media data provide a powerful way to know publics and capture what they say and do. At the same time, access to these methods is uneven, with corporations and governments tending to have best access to relevant data and analytics tools. Critics raise a number of concerns about the implications dominant uses of data mining and analytics may have for the public: they result in less privacy, more surveillance and social discrimination, and they provide new (...) ways of controlling how publics come to be represented and so understood. In this paper, we consider if a different relationship between the public and data mining might be established, one in which publics might be said to have greater agency and reflexivity vis-à-vis data power. Drawing on growing calls for alternative data regimes and practices, we argue that to enable this different relationship, data mining and analytics need to be democratised in three ways: they should be subject to greater public supervision and regulation, available and accessible to all, and used to create not simply known but reflexive, active and knowing publics. We therefore imagine conditions in which data mining is not just used as a way to know publics, but can become a means for publics to know themselves. (shrink)

Deflationists about truth seek to undermine debates about the nature of truth by arguing that the truth predicate is merely a device that allows us to express a certain kind of generality. I argue that a parallel approach is available in the case of logical consequence. Just as deflationism about truth offers an alternative to accounts of truth's nature in terms of correspondence or justification, deflationism about consequence promises an alternative to model-theoretic or proof-theoretic accounts of consequence's nature. I then (...) argue, against considerations put forward by Field and Beall, that Curry's paradox no more rules out deflationism about consequence than the liar paradox rules out deflationism about truth. L’objectif, éminemment politique, de cet ouvrage est de proposer pour 2012 une alternative aux programmes court-termistes et consensuels qui pourraient être développés par les candidats lors de la campagne officielle pour les élections présidentielles. Il vise à offrir une perspective de long terme de ce à quoi la société pourrait ressembler d’ici trente à cinquante ans si nous prenons un véritable virage écologique et humain et si nous opérons un changement concret de paradigme. Si, ces dernières années, un grand nombre (...) d’ouvrages et de films ont dénoncé les pires crises que traverse l’humanité, si d’autres se sont évertués à mettre en lumière des alternatives, force est de constater que très peu se sont attelés à la tâche d’offrir une vision articulée, écologique et positive de l’avenir. Loin des “yaka-fokon” et des déclarations d’intention pleines de bonne volonté, cet ouvrage met en lumière des solutions qui ont fait leur preuve, à petite comme à grande échelle, dans la plupart des domaines de la société. Pour chaque thématique, une personnalité “experte”, ayant développé une vision du sujet - voire souvent conduit ou observé une expérimentation -, propose en quelques pages des voies de transition concrètes, ainsi que les moyens à disposition de tous, qu’ils soient citoyens, élus ou entrepreneurs, pour les mettre en action. Chacune de ces propositions s’appuie sur un “cas pratique” : un exemple concluant mené à l’échelle d’un territoire européen (canton, département, région...). Development of the shapes of living organisms and their parts is a field of science in which there are no generally accepted theoretical principles. What form these principles are likely to take, when they emerge, is a subject in which there is a wide gulf of disagreement between physical scientists and experimental biologists. This book contains both an extensive philosophical commentary on this dichotomy in views and an exposition of the type of theory most favoured by physical scientists. In this (...) theory living form is a manifestation of the dynamics of chemical change and physical transport or other physics of spatial communication. The reaction-diffusion theory, as initiated by Turing in 1952 and since elaborated by Prigogine and by Gierer and Meinhardt among others, is discussed in detail at a level that requires a good knowledge of a first course in calculus, but no more than that. The great growth of molecular biology has tended to overshadow the increase in our understanding of the nature of these kinetic processes. This book seeks to reawaken interest in dynamics in the hope that a better balance between the importance of things and the importance of actions may emerge in the biology of the 21st century. The revisionary approach to semantic paradox is commonly thought to have a somewhat uncomfortable corollary, viz. that, on pain of triviality, we cannot affirm that all valid arguments preserve truth (Beall2007, Beall2009, Field2008, Field2009). We show that the standard arguments for this conclusion all break down once (i) the structural rule of contraction is restricted and (ii) how the premises can be aggregated---so that they can be said to jointly entail a given conclusion---is appropriately understood. In Canada, as in many other countries, there exists an organ procurement/donation crisis. This paper reviews some of the most common kidney procurement and allocation programmes, analyses them in terms of public and private administration, and argues that privately administered living donor models are an inequitable stopgap measure, the good intentions of which are misplaced and opportunistic. Focusing on how to improve the publicly administered equitable cadaveric donation programme, and at the same time offering one possible explanation for its current (...) failure, it is suggested that the simple moral principle of “give and you shall receive”, already considered by some, be extended further. This would allow for those who are willing to sign up to be a public cadaveric donor be given a priority for receiving an organ donation should they ever require it. It is argued that this priority may provide the motivation to give that is so far lacking in Canada. This model is called the Public Cadaveric Organ Donation Program. (shrink)
