The 21st Century Cures Act is a major act of legislation that contains numerous changes to drug and device regulation. The House of Representatives passed the Act after considerable interest group lobbying, but the bill and the key changes made during its drafting remain controversial. Using publicly disclosed records of written comments on the bill, we reviewed the key areas of lobbying activity and the compromises made in the final text. We focused on legislative provisions relating to management of the (...) National Institutes of Health, incentives for medical product development, and approval standards for new drugs and devices. By the end of the first comment period, the Committee received 118 comments. Most respondents were patient organizations, professional societies, and pharmaceutical and device companies. Overall, the majority of public comments were positive, although public health and consumer organizations were underrepresented in the number of submitted comments. As the legislative process continued, the draft bill underwent several changes relating to NIH funding, market exclusivity provisions, and scrutiny of regulatory evidentiary standards. Understanding the key statutory provisions and how they have evolved could help patients, researchers, and advocates make more informed comments on the bill and future health care legislation. Both faculties however depend conceptually on the ability to refer to absent situations by means of sign acts called 'context building'. The paper investigates the combined roles of quasi-pictorial sign acts and proto-assertive sign acts in the situation of initial context building, which, in the context of “concept-genetic” considerations, aims (...) for a philosophical explanation of the anthropological functon of pictures and their relation to imagination. There is a long tradition of characterizing man as the talking animal. However, the remarkable ability of using pictures also belongs to human beings, after all we know empirically so far. Are there conceptual reasons for that coincidence? Such a question belongs to the general science of language (linguistics) and philosophy of language just as well as to general visualistics (image science) - a discipline just emancipating itself from art history. We here take the visualistics point of view. A first (...) recapitulation of the two abilities to use words or pictures lists several similarities and distinctions. A well-known disparity between pictures and words in the relation to perception can be determined by differences in the modes of usage during the corresponding sign acts. Furthermore, there are distinct ways for splitting up the pictorial or verbal sign acts into figure and ground. Such a structural comparison can only clarify conceptual relations; it cannot explain that the conceptual structure ought to be like that, in contrast to concept-genetic considerations. Correspondingly the discussion is extended to a concept-genetic sketch of the abilities to use language or pictures. This shifts the focus of attention to the concept of sortal objects and the concept of contexts of behavior. They allow us to analyze more precisely the relation between the two abilities in question, in particular as something depending on the function of context building, which enables human beings to communicatively access contexts apart from the actual situation of behavior. We finally gain arguments that characterize that relation as one of mutual dependency, and even lead to an understanding of the concept of inner images - or rather: a concept of imagination. A well-known conceptual disparity between pictures and words (...) appears in their relation to perception: the difference can be further determined in an act-theoretic manner by four modes of use of the sign vehicles during the corresponding sign acts. Furthermore, the figure/ground dichotomy means something different for language uses and picture uses. In both cases, however, there is a close relation to the function of context building, by which humans are able to communicate not only with respect to the present situation of behavior but with respect to arbitrary contexts as well. Although the structural comparison does clarify the conceptual relations, it cannot explain that the conceptual structure ought to be like that. Therefore, the paper concludes with the programme of a "concept-genetic" consideration of the two abilities (i.e., to use propositional language or to use pictures) that is able to give us such a foundation. We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

Die gegenwärtig zu beobachtende Betonung des Visuellen ist den modernen Informationsgesellschaften zutiefst inhärent, weil erstens jene schon von ihrem Begriff her Mediengesellschaften sind (insofern Information immer nur medial zugänglich ist) und weil zweitens insbesondere die technischen Massenmedien ganz wesentlich als Bildmedien Bedeutung erlangen. In der Folge dieser Entwicklung dürfte ganz allgemein die Erzeugung von Sinn zunehmend im Zusammenhang von Zeige- statt (nur) von Sprechhandlungen auftreten. Dem steht bisher eine mangelnde Bildkompetenz gegenüber sowohl seitens der Forschung wie auch der Laien. Der (...) Mangel, der seitens der Laien besteht, ist das prominente Thema der Visual Culture Studies, deren Vertreter den bisher unzureichend bemerkten ideologischen Charakter der visuellen Kommunikation innerhalb unserer Gesellschaft bewußt machen und neutralisieren wollen. In Reaktion auf den Mangel hinsichtlich der wissenschaftlichen Reflexion hat sich über die letzten beiden Dekaden hingegen der breit angelegte Versuch einer interdisziplinären Bildwissenschaft entwickelt. -/- Bevor wir die inneren Beziehungen zwischen Medien und Bildern genauer diskutieren, wollen wir in einem ersten Schritt kurz das Verhältnis von Visual Culture Studies und Bildwissenschaft beleuchten und uns in einem zweiten Schritt der eigenen historischen und theoretischen Annahmen versichern bzw. diese explizieren. In dem ausführlicheren dritten Abschnitt werden wir auf den Medienbegriff näher eingehen und dabei exemplarisch die Medientheorie von McLuhan skizzieren. In einem vierten Abschnitt möchten wir unsere Bildtheorie gewissermaßen im Kontrast zu den Annahmen der Visual Culture Studies skizzieren. Dies zusammengenommen wird uns den theoretischen Hintergrund für unsere zentrale These in Abschnitt fünf liefern, daß die Fähigkeit der Bildverwendung als ein anthropologisches Grundprinzip verstanden werden sollte, von dem auch die Herausbildung der Sprachfähigkeit abhängt. In this volume specialists of medieval music and philosophy put the medieval 'musica' into the context of ideas and institutions in which it existed. The significance of 'musica' cannot be understood from a modern point of view since 'music' does not match the medieval 'musica'.

Although prenatal screening is routinely undertaken as part of a woman's antenatal care, the ethics surrounding it are complex. In this paper, the author examines the Jewish position on the permissibility of several tests, including those for Down's syndrome and Tay-Sachs disease, the latter being especially common in the Jewish community. Clearly, the status of the tests depends on whether termination of affected pregnancies is allowed, and contemporary rabbinical authorities are themselves in dispute as to the permissibility of terminating (...) affected pregnancies. The nature of these arguments is examined and the author concludes that there are grounds on which the full range of prenatal screening is permitted in Jewish law. (shrink)

Norman Daniels’s theory of health justice is the most comprehensive and systematic such theory we have. In one of the few articles published so far on Daniels’s new book, Just Health, Benjamin Sachs argues that Daniels’s core “principle of equality of opportunity does not do the work Daniels needs it to do.” Yet Sachs’s objections to Daniels’s framework are deeply flawed. Where these arguments do not rely on significant misreadings of Daniels, they ignore sensible strands in Just Health (...) that considerably dull their force. After disarming Sachs’s arguments against Daniels’s theory, I explain why I agree with Sachs’s conclusion: Daniels’s equality of opportunity-based account of health justice rests on shaky foundations. This volume, which contains the 1962 lecture "Zeit und Sein," is the most important publication by Heidegger since Unterwegs zur Sprache appeared in 1959. Bearing the same title as the much discussed missing part of the first half of Sein und Zeit, "Zeit und Sein" is the best demonstration we have of how the later Heidegger carries out the program which was outlined in Sein und Zeit, i.e., how the clue which the analytic of Dasein provides--that Being is to be (...) understood in terms of time--is followed out in the later works. Heidegger explicates the temporality of Being in terms of its character as a "gift" and an epochal sending which "is" both as having been and as to come. Being as time is thus the "event of appropriation". In addition to "Zeit und Sein," Zur Sache des Denkens also contains: The notes of a seminar which Heidegger conducted at Todtnauberg in 1962 upon the "Zeit und Sein" lecture. As Professor Alfredo Guzzoni, the editor of these notes, indicates this is the only time that Heidegger has conducted a seminar on a text of his own composition. A lecture entitled "The End of Philosophy and the Problem of Thought," which was delivered at a Kierkegaard colloquium in 1964. An autobiographical description of Heidegger's growing interest in and attraction to Husserl's phenomenological method in the pre-Sein und Zeit period; this was prepared in 1963 for a Festschrift in honor of Hermann Niemeyer.--J. Julius Sachs (1832–1897), who has been quite rightly called “the father of plant physiology,” was a German physiologist of international standing, whose research interests contributed to virtually every branch of the plant sciences, and whose work presaged plant molecular biology and systems biology. Here, we focus on one of his last publications, from 1892, wherein he argued that the term “cell” (_Zelle_) is misleading and should be replaced by “energid” (_Energide_), which he defined as “a nucleus together with the (...) corresponding protoplasm that is governed by it,” based on his observations of coenocytic algae such as _Caulerpa_ whose nuclei “can only control” so much cytoplasm. Although most of his colleagues did not accept this novel terminology for the description of the “basic, minimal living unit” (_Elementarorganismus_) of animals, plants, and microbes, we argue that the energid concept prefigured the subsequent discovery of mRNA. We also argue that the resistance to the energid concept revolved around a deep-seated philosophical debate between those adhering to cell theory versus organismal theory. The first English translation of the seminal work by Sachs, “Physiologische Notizen. II. Heideggerian thought is routinely understood to involve an insistence on finitude, and a rejection of the metaphysical priority of the infinite. As a general rule, this characterization is adequate, but it risks a significant oversimplification of a complex theme in Heidegger’s thinking. After an initial discussion of his dominant position on (in)finitude, the paper focuses on a number of largely neglected and some recently published texts concerning Heidegger’s retrieval of the inheritance of the Greek and Latin grammar of Being, as (...) well as the origins of the idea of the infinite in Anaximander’s ἄπειρον. These texts reveal some important tensions in Heideggerian thought on the status of infinitude in its relation to die Sache selbst of that thought. (shrink)

The title of the English translation is that of the lead essay, the highly celebrated lecture which Heidegger gave in 1962 and which bears the same title as the never published "third division" of the "first half" of Being and Time. This lecture is perhaps the (...) most significant document to be added to the Heideggerian corpus since the Letter on Humanism. It is of course dramatically different from Being and Time and so cannot be regarded as a "continuation of the text of Being and Time." "Time and Being" thematizes the central notion of Heidegger’s later work, "Das Eregignis," [[sic]] translated happily by Miss Stambaugh as "Event of Appropriation". The "Event of Appropriation" is the "It" which "gives" Being and time in the sequence of epochs which constitute the history of Western metaphysics. The lecture is followed by an instructive "seminar" conducted by Heidegger on the text of "Time and Being." There is found here also a penetrating essay entitled "The End of Philosophy and the Task of Thinking," as well as a fascinating piece of autobiography entitled "My Way in Phenomenology." Nach einer Reihe alleinstehender Personen wie Derbolav, Bühler, Jost, Glinz behandeln wir die Strömungen der symbolischen Logik und der linguistic analysis. Die symbolische Logik will das Denken in einer logischen Modellsprache analysieren. Die linguistic Analysis betrachtet die gewöhnliche Umgangssprache als Trägerin des Denkens und will, daß alle Philosophen und Wissenschaftler sich in dieser gewöhnlichen Umgangssprache ausdrücken, die bei guter Analyse für jeden intelligenten (...) Menschen verständlich ist. Die Strömungen der Phänomenologie und des Existentialismus äußern die Erfahrung, daß der Mensch seine Existenz ganz in einer sprechenden Welt erfährt und daß sich seine Existenz in der Sprache vollzieht : die Sprache ist das Haus seines Daseins. Keine Sache kann in unserem Bewußtsein zur Existenz gelangen, wenn wir sie nicht zu Wort bringen können. Die Ethnolinguisten und Psycholinguisten sind zu dem Ergebnis gekommen, daß die Formen, in denen ein Mensch jeweils denkt, von den unerbittlichen und unentrinnbaren Strukturen der Wörter mit ihren Bedeutungen und den Strukturen der Wortkombinationen kontrolliert werden. Diese Strukturen sind die Strukturen der jeweiligen Muttersprache. Das Denken eines Menschen vollzieht sich in seiner Sprache. Society has historically not taken a benign view of genetic disease. The laws permitting sterilization of the mentally re tarded~ and those proscribing consanguineous marriages are but two examples. Indeed as far back as the 5th-10th centuries, B.C.E., consanguineous unions were outlawed (Leviticus XVIII, 6). Case law has traditionally tended toward the conservative. It is reactive rather than directive, exerting its influence only after an individual or group has sustained injury and brought suit. In contrast, state legislatures have not been (...) inhibited in enacting statutes. Many of their products can be characterized as hasty, unnecessary, ill-conceived, and based on the heart rather than the head. Moreover the lack of expert consultation sought has also been remarkable. One state legislature, for example, has advocated immunization for sickle cell anemia! Many others have enacted laws for the screening of inborn errors of metabolism, e.g., phenylketon uria, but have poorly defined the lines of responsibility to secure compliance. A spate of specific disease-related bills has emerged in the u.S. Congress, each seeking recognition and appropriations. Sickle cell anemia, hemophilia, Cooley's anemia and Tay-Sachs disease have been among the front-runners for support. Finally, in 1975, Congress has begun to examine an omnibus bill concerning all forms of genetic disease. The bill, termed the National Genetic Diseases Act is, however, still far from being enacted. Fred Dallmayr is one of the most perceptive commentators on the implications of continental philosophy for political thinking. Following Hannah Arendt he describes his essays as "exercises in contemporary political theory." Whether exploring the meaning of Heidegger's reflections on freedom, Gadamer, Oakeshott or Rorty on conversation and dialogue, Habermas on communicative action and rationality, or Foucault on power, Dallmayr has the rare gift of enabling texts "to speak to us" in new and illuminating ways. He beautifully exhibits a theme that (...) he explores in several of these essays--authentic conversation, where he shows us how to listen to the other and to pursue in depth the common subject matter--die Sache. These exercises continue the investigations begun in his Twilight of Subjectivity: Contributions to a Post-Individualist Theory of Politics. The important and intriguing aspect of Dallmayr's project is the way in which he confronts contemporary critiques of individualism, subjectivism, and humanism--and yet dialectically seeks to incorporate the "truth" of what is being criticized. His primary concern is with reconstruction rather than deconstruction. Throughout there is the exercise of good judgment and phronësis in his balanced interpretations. The dominant figure in Dallmayr's own meditative thinking is Heidegger. Dallmayr presents us with one of the most judicious, sensitive, and insightful interpretations of Heidegger's relevance for understanding the meaning of polis and praxis. The opening sentence of Heidegger's Letter on Humanism may well be taken as an epigraph for the entire volume: "We are still far from pondering the essence of action seriously enough." Like Heidegger, Dallmayr wants to dislodge the concepts of freedom and power from human willfulness and subjectivity, and to show that the essence of freedom involves solidarity--a reciprocal effort of liberation or a mutual "letting-be." Dallmayr underscores "the exploratory, non-systematic, or en route" character of his essays. One source of uneasiness that a reader may feel arises from the sheer variety of political views represented by the thinkers that Dallmayr examines including Strauss, Heidegger, Gadamer, Oakeshott, Rorty, Arendt, Merleau-Ponty, and Foucault. For they cover the political spectrum. There are many directions that a post-individualist theory of politics may take. It is not entirely clear from these exploratory essays where we or Dallmayr are being led. To use a Hegelian turn of phrase, one needs more "determinate negation"--more specificity--in Dallmayr's own Holzwege. The type of tensions that have been characteristic of the Hegelian legacy where one can read Hegel as a potentially radical and revolutionary thinker or as a fundamentally conservative thinker--tensions which have continued to plague a good deal of political thinking since Hegel are implicit in and not yet resolved by Dallmayr. Nevertheless, although one follows the many pathways opened up for us with a certain amount of intellectual caution, the journey is an exciting and revealing one.-Richard J. Includes notes and an introductory essay. Focus Philosophical Library translations are close to and are non-interpretative of the original text, with the notes and a glossary intending to provide the reader with some sense of the terms and the concepts as they were understood by Plato’s immediate audience.

In November 2008 Professor Mike Richards issued his much awaited review of the British Department of Health's policy on out-of-pocket payments for drugs not approved as cost effective by the National Institute for Health and Clinical Excellence. The policy stated, or had been construed as stating, that those who top up thereby became ineligible for further National Health Service treatment for the condition targeted by the drug. For instance, if a lung cancer sufferer bought Avastin, which is not NICE approved, (...) she could no longer receive free treatment for her cancer on the NHS's tab. Richards, the National Cancer Director, recommended that the policy be repealed. From an ethical point of view, this change should be enthusiastically welcomed. (shrink)

Recent studies indicate that mammalian chromosomes contain discretecis‐acting loci that control replication timing, mitotic condensation, and stability of entire chromosomes. Disruption of the large non‐coding RNA gene ASAR6 results in late replication, an under‐condensed appearance during mitosis, and structural instability of human chromosome 6. Similarly, disruption of the mouse Xist gene in adult somatic cells results in a late replication and instability phenotype on the X chromosome. ASAR6 shares many characteristics with Xist, including random mono‐allelic expression and asynchronous replication timing. (...) Additional “chromosome engineering” studies indicate that certain chromosome rearrangements affecting many different chromosomes display this abnormal replication and instability phenotype. These observations suggest that all mammalian chromosomes contain “inactivation/stability centers” that control proper replication, condensation, and stability of individual chromosomes. Therefore, mammalian chromosomes contain four types ofcis‐acting elements, origins, telomeres, centromeres, and “inactivation/stability centers”, all functioning to ensure proper replication, condensation, segregation, and stability of individual chromosomes.
