Claims that the self and experience in general are narrative in structure are increasingly common, but it is not always clear what such claims come down to. In this paper, I argue that if the view is to be distinctive, the element of narrativity must be taken as literally as possible. If we do so, and explore the consequences of thinking about our selves and our lives in this manner, we shall see that the narrative view fundamentally confusues art and (...) life. We learn from art itself that our selves and lives transcend narratives and that thinking in a narrative manner ignores the rich complexity of individual persons. Our attitude towards cynicism is ambivalent: On the one hand we condemn it as a character failing and a trend that is undermining political and social life; on the other hand, we are often impressed by the apparent realism and honesty of the cynic. My aim in this paper is to offer an account of cynicism that can explain both our attraction and aversion. After defending a particular conception of cynicism, I argue that most of the work in explaining the (...) fault of cynicism can be done by referring not to the cynic’s beliefs about humanity, but to the attitude cultivated as a response to that belief. This attitude is hostile to the virtues of faith, hope and charity, upon which relationships and our sense of moral community depend. In conclusion, I suggest that holding the cynical belief is itself immoral, and that cynicism is disrespectful and destructive of morality. (shrink)

Taking hunting as an example, an account of animal beauty as animation can be developed. Our delight in many kinds of animals is crucially a matter of an aesthetic property which can be called “the animate” or “animation.” A proper response to animate animal beauty is a virtuous character trait that hunters lack. The beauty of animals calls for particular responses from observers: it brings along certain duties and requires the cultivation of certain traits of character—ones that are incompatible with (...) hunting animals. An argument against hunting animals can move from aesthetic value to ethical value relying on the aesthetic notion of disinterestedness. (shrink)

This is an essay in appreciation of The Abundant Herds, a study of the ama-Zulu's naming practices for their Nguni cattle. The book reveals an aesthetic vision in which contemplative and practical attention are intertwined and a complex classificatory system does not undermine an appreciation of the individuality of the cattle. The book and the practices it celebrates permit a richer account of the beauty of farm animals to the standard functionalist approach.

It seems to be a phenomenon of contemporary life that we consider goodness embarrassing and rather dull. In contrast, the activities and inner lives of villains are deemed more complex and fascinating than those of good people. This paper attempts to understand the conception of goodness that underlies this phenomenon, and I suggest that informing it is the combination of two ideas, in tension with each other: firstly, a distorted understanding of the ancient conception of full virtue as the absence (...) of all inner conflict; and secondly, the intuition that real goodness is only apparent and generated in inner conflict. In response, I offer an alternative picture of goodness as an ongoing, active and progressive relation to value, and conclude that in order to render goodness attractive again we need more adequate portraits of goodness from both philosophy and art. In this paper I discuss Gillian Brock’s and Michael Blake’s discussion of emigration in Debating Brain Drain in relation to the particular case of South Africa, and explore whether skilled white people have a duty to remain in the country. Focusing on the role of community in this debate, I argue that communities and allegiances in South Africa are still too divided and antagonistic for them to play the duty-grounding role that Brock requires.

This paper is a response to recent student protests at South African universities, and the essentialising rhetoric and practices that characterise South African public debates. I explore the likely responses of white South Africans to views that seem to make their whiteness inescapable and necessarily morally bad.

This paper considers Tabensky's method of critical introspection, and in particular the conception of personhood that informs it. By interrogating the lives of pure hedonism, divinity and immortality from our already existing conception of personhood, Tabensky argues that such lives are incompatible with what it is to be a person, and desiring to live them is therefore irrational. Concentrating on the example of immortality, I argue that, while there are undoubtedly disadvantages associated with the immortal life, these are contingent rather (...) than essential to the notion of being a person. In fact, we have very little idea of the boundaries of that concept. The paper concludes by looking at the consequences of Tabensky's approach for issues surrounding moral vision and improvement, and new technologies of the person. S. Afr. J. Philos. Gerald Dworkin's influential account of Personal Autonomy offers the following two conditions for autonomy: Authenticity - the condition that one identify with one's beliefs, desires and values after a process of critical reflection, and Procedural Independence - the identification in must not be "influenced in ways which make the process of identification in some way alien to the individual" . I argue in this thesis that there are cases which fulfil both of Dworkin's conditions, yet are clearly not cases of (...) autonomy. Specifically, I argue that we can best assess the adequacy of Dworkin's account of autonomy through literature, because it provides a unique medium for testing his account on the very terms he sets up for himself - ie. that autonomy apply to, and make sense of, persons leading lives of a certain quality. The examination of two novels - Kazuo Ishiguro's The Remains of the Day and Henry James's The Portrait of a Lady - shows that Dworkin's explanation of identification and critical reflection is inadequate for capturing their role in autonomy and that he does not pay enough attention to the role of external factors in preventing or supporting autonomy. As an alternative, I offer the following two conditions for autonomy: critical reflection of a certain kind - radical reflection, and the ability to translate the results of into action - competence. The novels demonstrate that both conditions are dependent upon considerations of the content of one's beliefs, desires, values etc. Certain of these will prevent or hinder the achievement of autonomy because of their content, so autonomy must be understood in relation to substantial considerations, rather than in purely formal terms, as Dworkin argues. Few contemporary philosophers have made as wide-ranging and insightful a contribution to philosophical debate as John Cottingham. This collection brings together friends, colleagues and former students of Cottingham, to discuss major themes of his work on moral philosophy. Presented in three parts the collection focuses on the debate on partiality, impartiality and character; the role of emotions and reason in the good life; the meaning of a worthwhile life and the place of theistic considerations in it. In order to begin filling in this gap, I argue that Kant’s aesthetics is a promising resource for developing a model of aesthetic humility. Initially, however, this may seem like an unpromising starting point as Kant’s aesthetics might appear to promote aesthetic arrogance instead. In spite of this prima facie worry, I claim that Kant’s aesthetics provides an illuminating model of aesthetic humility that sheds light (...) not only on the self- and other-directed attitudes it involves, but also on how aesthetic humility can serve as a corrective to the vices of aesthetic arrogance and aesthetic servility. This article builds on Samantha Vice’s argument on the problem of whiteness in contemporary South Africa. I will explore the thesis of invisibility regarding whiteness and argue for its relevance to the rich per se. This thesis demonstrates how white privilege and affluence, despite being glaringly visible in a concrete sense, is rendered invisible together with the mostly black poverty by which it is contrasted. The invisibility of whiteness translates and flows into the so-called ‘invisibility of richness’, which (...) involves anyone who is economically affluent in this country and has the same effect of rendering poverty invisible. The massive and ever-growing divide between rich and poor means that both have fundamentally incommensurate experiences of life in this country, which is why post-apartheid South Africa is such a strange place to live in for all of its inhabitants. In the latter part of the article, a suggestion will be made about what the appropriate response to the injustices of this strange place might look like for whites. (shrink)

Samantha Besson sees the relationship between moral and legal human rights as one of mutuality.: “legal rights recognize, modify or even create moral rights“, and vice versa. She thus appears to ascribe agency to legal rights, or “the law“, and to moral rights, or morality. This ascription can only be understood as metaphorical: abstract concepts have no agency. Replacing the abstract concepts by human beings, “the law“ and morality must be understood as the respective norm-givers. This reveals what (...) is hidden by the metaphorical account: the supposed mutuality is no automatism but depends on the autonomous decision of human beings who are likely to be influenced by extant legal or moral norms, respectively, and/or by the values represented in those norms. The supposed mutuality should thus be seen rather as the result of the sociological influence exercised by extant norms, or the values they represent, on human norm-givers. (shrink)

Samantha Vice’s essay, ‘How Do I Live in This Strange Place?’, is a sensitive and subtle exploration of the difficult moral terrain of the issues of white responsibility and white moral self-reform in a South Africa that is formally post-apartheid, but still profoundly shaped by the legacy of white domination, both in its enduring socio-economic structures and in its citizens’ typical moral psychologies. Vice’s conclusion is that shame is the moral emotion most appropriate for whites unable to (...) free themselves from white privilege and live up to what she sees as the required standards of moral excellence. In response, I argue that she is in effect making the supererogatory obligatory, and constructing an unrealistic schedule of virtues. Drawing on various recent writings on non-ideal theory, I suggest that standard moral distinctions need to be relocated to take systemic social oppression into account, thereby yielding a more forgiving moral taxonomy than Vice’s own over-demanding mapping. Philosophical writing in the advocatorial mode aims to advance a given position by reasoned argument designed to rationally persuade anyone of its veracity. Philosophical writing in the confessional mode uses theoretical reasoning and critical rigour in the course of arriving at a specific kind of philosophical self-judgment with therapeutic intent. Here I suggest that the best way to read Samantha Vice’s paper (‘How Do I Live in This Strange Place?’) is to treat it as written in the confessional, (...) and not the advocatorial, mode, and that this way of reading the paper provides an alternate way of reflecting on some of the contentious claims Vice makes. The “local food” movement has been growing since at least the mid- twentieth century with the founding of the Rodale Institute. Since then, local food has increasingly become a goal of food systems. Today, books and articles on local food have become commonplace, with popular authors such as Barbara Kingsolver1 and Michael Pollan2 espousing the virtues of eating locally. Additionally, local food initiatives, such as the “farm- tofork,” “Buying Local,” and “Slow Food” have gained a strong international following with clearly (...) visible impacts on the food industry and policy. The numbers of local farmers’ markets, community- supported agriculture projects, and community gardens have been on the rise steadily since 1994. (shrink)

This book explores the relationship between the law and pervasive and persistent reasonable disagreement about justice. It reveals the central moral function and creative force of reasonable disagreement in and about the law and shows why and how lawyers and legal philosophers should take reasonable conflict more seriously. Even though the law should be regarded as the primary mode of settlement of our moral conflicts,it can, and should, also be the object and the forum of further moral conflicts. There is (...) more to the rule of law than convergence and determinacy and it is important therefore to question the importance of agreement in law and politics. By addressing in detail issues pertaining to the nature and sources of disagreement, its extent and significance, as well as the procedural, institutional and substantive responses to disagreement in the law and their legitimacy, this book suggests the value of a comprehensive approach to thinking about conflict, which until recently has been analysed in a compartmentalized way. It aims to provide a fully-fledged political morality of conflict by drawing on the analysis of topical jurisprudential questions in the new light of disagreement. Developing such a global theory of disagreement in the law should be read in the context of the broader effort of reconstructing a complete account of democratic law-making in pluralistic societies. The book will be of value not only to legal philosophers and constitutional theorists, but also to political and democratic theorists, as well as to all those interested in public decision-making in conditions of conflict. In _Biocultural Creatures_, Samantha Frost brings feminist and political theory together with findings in the life sciences to recuperate the category of the human for politics. Challenging the idea of human exceptionalism as well as other theories of subjectivity that rest on a distinction between biology and culture, Frost proposes that humans are biocultural creatures who quite literally are cultured within the material, social, and symbolic worlds they inhabit. Through discussions about carbon, the functions of cell membranes, the activity (...) of genes and proteins, the work of oxygen, and the passage of time, Frost recasts questions about the nature of matter, identity, and embodiment. In doing so, she elucidates the imbrication of the biological and cultural within the corporeal self. In remapping the relation of humans to their habitats and arriving at the idea that humans are biocultural creatures, Frost provides new theoretical resources for responding to political and environmental crises and for thinking about how to transform the ways we live. The book starts out by presenting a theoretical framework on eHealth and surveillance, followed by an introduction to the various ideas on eHealth and surveillance explored in the subsequent chapters. Issues addressed in the chapters include privacy and data protection, social acceptance of eHealth, cost-effective and innovative healthcare, as well as the privacy aspects of employee wellness programs using (...) eHealth, the use of mobile health app data by insurance companies, advertising industry and law enforcement, and the ethics of Big Data use in healthcare. A closing chapter draws on the previous content to explore the notion that people are 'under observation', bringing together two hitherto unrelated streams of scholarship interested in observation: eHealth and surveillance studies. This article surveys recent feminist contributions to moral philosophy with an emphasis on those works which engage with debates within mainstream ethics. The article begins by examining a tension said to arise from the two criteria a theory must meet if it is to count as feminist moral theory: the women's experience requirement and the feminist conclusion requirement. Subsequent sections deal with feminist relational theories of rights, feminist work on responsibility and feminist contractarian approaches to ethics. Background The review of human participant research by Research Ethics Committees or Institutional Review Boards is a complex multi-faceted process that cannot be reduced to an algorithm. However, this does not give RECs/ IRBs permission to be inconsistent in their specific requirements to researchers or in their final opinions. In England the Health Research Authority coordinates 67 committees, and has adopted a consistency improvement plan including a process called “Shared Ethical Debate” where multiple committees review the same project. Committee reviews (...) are compared for consistency by analysing the resulting minutes. Methods We present a description of the ShED process. We report an analysis of minutes created by research ethics committees participating in two ShED exercises, and compare them to minutes produced in a published “mystery shopper” exercise. We propose a consistency score by defining top themes for each exercise, and calculating the ratio between top themes and total themes identified by each committee for each ShED exercise. Results Our analysis highlights qualitative differences between the ShED 19, ShED 20 and “mystery shopper” exercises. The quantitative measure of consistency showed only one committee across the three exercises with more than half its total themes as top themes. The average consistency scores for the three exercises were 0.23, 0.35 and 0.32. There is a statistically significant difference between the ShED 19 exercise, and the ShED 20 and mystery shopper exercises. Conclusions ShED exercises are effective in identifying inconsistency between ethics committees and we describe a scoring method that could be used to quantify this. However, whilst a level of inconsistency is probably inevitable in research ethics committee reviews, studies must move beyond the ShED methodology to understand why inconsistency occurs, and what an acceptable level of inconsistency might be. Interest in republicanism as a political theory has burgeoned in recent years, but its implications for the understanding of law have remained largely unexplored. Legal Republicanism is the first book to offer a comprehensive, critical survey of the potential for creating republican accounts of fundamental issues in law and legal theory.

Foucault contra Habermas is an incisive examination of, and a comprehensive introduction to, the debate between Foucault and Habermas over the meaning of enlightenment and modernity. It reprises the key issues in the argument between critical theory and genealogy and is organised around three complementary themes: defining the context of the debate; examining the theoretical and conceptual tools used; and discussing the implications for politics and criticism. In a detailed reply to Habermas' Philosophical Discourse of Modernity, this volume explains the (...) difference between Habermas' philosophical practice and Foucault's between the analytics of truth and the politics of truth. Many of the most difficult arguments in the exchange are subject to a detailed critical analysis. Habermas does not rule out the possibility of violence in language. In fact his account explicitly licenses a broad conception of violence as ‘systematically distorted communication’. Yet he does rule out the possibility that language simultaneously imposes as it discloses. That is, his argument precludes the possibility of recognizing that there is an antinomy at the heart of language and philosophical reason. This occlusion of the simultaneously world-disclosing and world-imposing character of language feeds and sustains Habermas’s legal and political arguments, (...) where he states that in order to achieve consensus rational deliberation must eliminate force. In this paper, I claim that this argument operates through a manoeuvre that leaves Habermas’s position curiously blind to its own predicament. To explain why, I turn to Kant’s treatment of the problem of evil in Religion Within the Boundaries of Mere Reason. Here, as in the Western philosophical tradition more generally, evil has no separate existence: it is folded back into Kant’s philosophical scheme. Arendt notes that as soon as Kant identifies the problem of evil he rationalizes it into comprehensible motives. I will show how, through a move that is structurally similar to Kant’s rationalization of evil, Habermas rationalizes and attempts to eliminate violence from his consideration of law and language. In Habermas’s work, law and language appear as ciphers for reason. The case to be made here is that Habermas’s inability to recognize the paradoxical character of language and reason makes his work blind to the violence in which it is unavoidably implicated. The concept of medical necessity is often used to explain or justify certain decisions—for example, which treatments should be allowed under certain conditions—as though it had an obvious, agreed-upon meaning as well as an inherent normative force. In introducing this special issue of Clinical Ethics on medical necessity, we argue that the term, as used in various discourses, generally lacks a definition that is clear, non-circular, conceptually plausible, and fit for purpose. We propose that future work on this concept should (...) address three main questions: what medical necessity is (i.e., what makes something medically necessary, as opposed to something else); what the concept does (what ‘work’ is it doing when invoked in different settings); and what should follow, normatively, from the fact that something is indeed medically necessary (on some plausible conception). Thomas Hobbes is an iconic figure who serves as an easy reference for pundits commenting on the brutality of war as well as for critics of a distinctly modern individualism in which calculating and rapacious self-interest is the cause of the violence, destruction, and exploitation endemic to the contemporary world. Frost's reading of Hobbes's philosophy shows us that underlying such visions of self and politics is another iconic figure: that of the Cartesian subject. What gives the iconic Hobbes his hardcore (...) individualism and its corollary accounts of instrumentalism, conflict, and absolutism is a Cartesian rendering of the self as split into mind and body. Carefully elaborating Hobbes's materialist ontology, _Lessons from a Materialist Thinker_ challenges both our implicit Cartesian assumptions about the self and the commonplace Hobbes that so readily figures violence in our political imagination. Through his materialism, Hobbes presents an alternative modern account of self-consciousness, reason, agency, power, freedom, and responsibility. In doing so, he shows that our fundamental intersubjectivity and interdependence require that we pursue peace above all else. (shrink)

We speculate with Hegel about language, critiquing interpretations of Hegel’s views on language given by Jim Vernon, John McCumber, Stephen Houlgate, and Michael N. Forster, as well as defending Sophisticated Radical Whorfianism from the objections of Maria Francisca Reines and Jesse Prinz. Prior to discussing Forster, we explicate Hegel’s views on mechanical memory. We conclude by discussing why, although thought grows up, it does not move out.

In his Letters on the Aesthetic Education of Man, Friedrich Schiller draws a striking connection between aesthetic value and individual and political freedom, claiming that, ‘it is only through beauty that man makes his way to freedom’. However, contemporary ways of thinking about freedom and aesthetic value make it difficult to see what the connection could be. Through a careful reconstruction of the Letters, we argue that Schiller’s theory of aesthetic value serves as the key to understanding not only his (...) view of aesthetic engagement, but also his distinctive account of individual and political freedom. In Part I, we develop a reconstruction of Schiller's view that aesthetic value is the only path to individual freedom and in Part II we analyze how Schiller connects aesthetic value to political freedom. In the end, we show that Schiller defends a non-hedonic, action-oriented, communitarian theory of aesthetic value and a theory of freedom that makes the aesthetic not just supererogatory but fundamental for any fully autonomous life. Although we have lost touch with this way of thinking about aesthetic value and freedom, we submit that it is illuminating for contemporary thinking about both. (shrink)
