We are partial to people with whom we share special relationships--if someone is your child, parent, or friend, you wouldn't treat them as you would a stranger. But is partiality justified, and if so, why? Partiality presents a theory of the reasons supporting special treatment within special relationships and explores the vexing problem of how we might reconcile the moral value of these relationships with competing claims of impartial morality. Simon Keller explains that in order to understand why we (...) give special treatment to our family and friends, we need to understand how people come to matter in their own rights. Keller first presents two main accounts of partiality: the projects view, on which reasons of partiality arise from the place that people take within our lives and our commitments, and the relationships view, on which relationships themselves contain fundamental value or reason-giving force. Keller then argues that neither view is satisfactory because neither captures the experience of acting well within special relationships. Instead, Keller defends the individuals view, on which reasons of partiality arise from the value of the individuals with whom our relationships are shared. He defends this view by saying that we must accept that two people, whether friend or stranger, can have the same value, even as their value makes different demands upon people with whom they share different relationships. Our initial hypothesis is that it is nothing less than an inquiry into the origin of our moral concepts of justice, good and bad, and more particularly guilt, law, mercy, and love. It is here that a link with Nietzsche suggests itself, particularly with the Second Essay of On the Genealogy of Morals.* * *How do we breed an animal with the right to make promises? For Nietzsche, the human being is an originally forgetful creature, like a young child. To make this originally forgetful creature remember requires physical discipline; it behooves punishment. The teaching of morality is never gentle; it never droppeth from heaven like gentle rain. On the contrary, if something is to be retained in memory, it must be burned in. The origin of memory lies in pain and cruelty: "Man could never do without blood, torture and sacrifices when he felt the need to create a memory for himself" [GM 61]. Nietzsche's first, astonishing hypothesis in the Second Essay is that the origin of concepts like responsibility and conscience lies in cruelty—cruelty administered and maintained through a corporal and corporeal regime. Further, as religions are systems of cruelty, all forms of asceticism originate in the same painful place. "Consider the German punishments," Nietzsche proposes—and we all know that there's nothing quite like the German punishments: stoning, breaking on the wheel, piercing with stakes, tearing apart or trampling with horses, boiling in oil, flaying alive, cutting straps from the flesh, smearing the wrongdoer with honey and leaving him to the flies in the blazing sun. Can the difference between the two be described in terms of an opposition between a reciprocal and an exploitative relationship? What difference does the Judeo-Christian tradition make in (...) shaping the modern relationship with nature?To answer these questions I will give brief descriptions of the way in which three cultural traditions have structured the relationship between man and nature: societies that are ruled by sacred kings, societies where power over nature is attributed to divinities, and the Old Testament tradition. As cases of sacred kinship, I present ethnographic material taken from my anthropological fieldwork among the Lulubo, Lokoya, and Lotuho peoples from the East Bank of the Nile in Southern Sudan. I will use the term "Eastern Nilotic" as shorthand for this complex of peoples. For the societies where divinities play the central role, I take the Western Nilotic Dinka, Nuer, and Atuot living in the flood plains of the Nile north of the kingship societies.In comparing these three traditions my point of departure is René Girard's analysis of culture as a mechanism to resolve conflict by directing the aggression of the members of society onto a victim and so achieving a new consensus. We shall see that in the kingship societies what we call natural phenomena play an integral part in culturally staging the scapegoat mechanism. They are the stage of human rivalries and their resolution. Among the polytheistic Western Nilotes they are the instrument through which the gods make their power felt and demand attention from humans. As agriculturists they are dependent on regular rains. However, the rains in their area are erratic and localized. As a result there is always a risk that the harvest may fail. The soil is of varying quality, giving varying yields in different places. The birth rate is another major concern. It determines the security of the community in its relationship to neighboring, frequently hostile, communities. There is the concern for epidemics, crop-eating insects and birds, and root-eating worms. Violent winds may destroy the crop, and lions and leopards may kill humans and cattle. A concern of a different order is the extent of the effectiveness of weapons, spears, and bows and arrows, in assuring security.When adversity affects the community, the first question asked by those affected is that regarding its cause. Frequently the cause is a breach of the social rules: an act of violence and a failure to perform or properly perform a ritual of purification necessitated by the violence. It may also be unconscious resentment on the part of a person or group that feels excluded from benefits enjoyed by others. It may be the cry of a neglected relative. It may be incest. In poem 40, through a series of rhetorical questions, Catullus confronts Ravidus about what made him commit such a foolish action as to fall in love with Catullus’ own lover. The poem ends with the lines: eris, quandoquidem meos amores | cum longa uoluisti amare poena, ‘You will be, since you have chosen to love my lover at the risk of receiving a long punishment’. There is a long-standing tradition of scholarship which testifies to the frequency with which Catullus incorporates (...) wordplay in his poems, including bilingual puns. This paper raises the question under what circumstances a plurality forms a set, parallel to the Special Composition Question for mereology. The range of answers that have been proposed in the literature are surveyed and criticised. I argue that there is good reason to reject both the view that pluralities never form sets and the view that pluralities always form sets. Instead, we need to affirm restricted set formation. Casting doubt on the availability of any informative principle which will settle (...) which pluralities form sets, the paper concludes by affirming a naturalistic approach to the philosophy of set theory. Expressivism is the view that the function of normative sentences is not to represent a kind of fact, but to avow attitudes, prescribe behavior, or the like. The idea can be found in David Hume. In the 20th century, G.E. Moore’s Open Question Argument provided important support for the view. Elizabeth Anscombe introduced the notion of “direction of fit,” which helped distinguish expressivism from a kind of naive subjectivism. The central advantage of expressivism is that it easily explains the motivational (...) force of moral conviction. Its chief problem is it has difficulty explaining the “realist surface” of moralizing. Quasi-realism is a strategy for explaining the realist surface without abandoning the underlying ideas of expressivism. It aims to explain moral error as well as deal with the so-called Frege-Geach problem. This chapter explains quasi-realism, and evaluates it by comparison with its chief rivals: Aristotelian approaches, Kantian approaches, realist moral naturalism, and fictionalism. (shrink)

The reasons for this are explored, using academic studies, survey reports as well as insights gained from the Institute of Business Ethics' work with large corporations. These indicate that there is a gap between the existence of explicit ethical values and principles, often expressed in the form of a code, and the attitudes and behaviour (...) of the organisation. The paper suggests that two basic reasons appear to be at the heart of the problem: ineffective ethics programmes and deficiencies in corporate culture. The paper concludes that successfully embedded corporate ethical values requires well‐designed ethics policies, sustained ethical leadership and incorporation of ethics in organisational processes and strategy as part of an ethical culture at all levels of the organisation. Many environmental scientists, scholars and activists characterise our situation as one of alienation from nature, but this notion can easily seem meaningless or irrational. In this book, Simon Hailwood critically analyses the idea of alienation from nature and argues that it can be a useful notion when understood pluralistically. It is often claimed by environmental philosophers and green political theorists that liberalism, the dominant tradition of western political philosophy, is too focused on the interests of human individuals to give due weight to the environment for its own sake. In "How to be a Green Liberal", Simon Hailwood challenges this view and argues that liberalism can embrace a genuinely 'green', non-instrumental view of nature. The aim of this paper is to re-evaluate the manner in which the Ticking Bomb Scenario (TBS), a thought experiment in philosophical enquiry, has been used in the discussion of the justifiability or otherwise of forward-looking interrogational torture (FLIT). The paper argues that criticisms commonly raised against the thought experiment are often inappropriate or irrelevant. A great many criticisms misunderstand the way in which thought experiments in general, and the TBS in particular, are supposed to work in philosophical (and for (...) that matter scientific) inquiry. The paper is not about the acceptability or otherwise of FLIT per se but rather an attempt to show that thought experiments such as the TBS are useful analytic tools and ought not to be rejected due to their inappropriate use by those engaged in the justifiability or otherwise of FLIT. By rescuing the TBS from its erroneous use the paper seeks to show its proper worth as part of an argumentative device in uncovering conflicting moral intuitions in our search for ethical truths. ArgumentEarly modern Europeans routinely compared nature to a theater or spectacle, so it makes sense to examine the practices of observing real spectacles and performances in order to better comprehend acts of witnessing nature. Using examples from the history of fireworks, this essay explores acts of observing natural and artificial spectacles between the sixteenth and late eighteenth centuries and suggests these acts of observation were mutually constitutive and entailed ongoing and diverse exchanges. The essay follows the changing ways in which (...) audiences were imagined or expected to react to fireworks and shows how these also shaped experiences of natural phenomena. Both natural and artificial spectacles were intended to teach morals about the state and nature, yet audiences rarely seemed to take away what they were expected to learn. The essay examines how performers thus sought to discipline audience observation, before exploring, in conclusion, how spectacle provided a vocabulary for discerning and articulating new natural phenomena, and sites for the pursuit of novel experiments. Scholars are divided over whether a victim's rights persist when an agent permissibly responds to an emergency. According to the prevailing view the moral force of rights is not extinguished by moral permissibility and the agent, therefore, has a duty to compensate the victim. According to another influential view permissibility does erase the moral force of rights and the agent, therefore, can only have a duty to compensate for reasons other than the fact that they committed a rights transgression. I (...) argue that liability does not follow even if we grant that the victim's rights persevere. A non-pecuniary remedy such as a formal apology provides an adequate way of vindicating the victim's rights and of recognizing the agent's causal role. Thus, the answer to the question of what remedy the permissible transgressor owes the victim does not provide us with an answer to the question of who should bear the burden. (shrink)

It is, I suggest, unclear whether any old inanimate objects deserve to be treated with respect simply because they are old. Yet this does not entail that an object’s age has no bearing at all on the question of how it may permissibly be treated. I defend the claim that those who fail to take seriously the histories of old inanimate objects typically deserve to be criticized on aretaic grounds. Such people, I argue, tend to lack the virtue of humility.
