No ancient authority has left us a clear account of how the judges at the Athenian dramatic festivals operated. We can therefore never know for certain what happened. But it may be possible to improve the reconstruction normally given, which does not look as if it could ever have yielded acceptable results. One thing that is very clear is that the choice of judges was taken seriously. Not only did it involve the Council, the Prytanies, and the Treasurers, but any (...) tampering with the panel from which the judges were eventually selected seems to have been punishable with death. Even the physical arrangements were quite complicated. Names approved by the Council were deposited in ten jars, one jar for each tribe but each jar containing several names, sealed by the Prytanies, held in safe-keeping on the Acropolis, and eventually brought down to the theatre, where the archon publicly broke the seals and drew out one name from each jar. At this stage of the process there emerged ten judges, one from each tribe. Their quality had been guaranteed by the Council's prior vetting of the panel, but their actual names were unpredictable because randomly selected from it. All had been done democratically and with equal representation of tribes, in perfect accord with normal Athenian practice. But now comes the difficulty. The paroemiographers record a proverb about judgement being in the lap of five judges — ν πντε κριτν γούνασι κεται; Lysias tells us of a judge whose vote was not counted; and Lucian, who likes to disguise a very careful antiquarianism behind an apparent casualness of style, says that at festival competitions the many know how to clap and hiss but that judgement is in the hands of seven or five or however many. ‘My own father’, Achilles says to Priam in the last book of the Iliad, ‘was a rich man and a powerful one. He was king of the Myrmidons, and he had a divine wife. But even so the gods gave him evils too. He had no family, only one son, and that son a παναώριος one. I do not look after him in his old age, but am far away, sitting here in Troy, inflicting misery on you and your children.’The (...) problem I propose to discuss is the meaning of παναώριος. The word is unique to this passage, and the standard translation ‘of all-untimely fate’ or ‘doomed to die young’ is open to many objections. I shall argue that by describing himself as ‘untimely’ what Achilles means is that he is someone who is always doing the wrong thing at the wrong time, a misfit. It may seem a petty point, hardly worth the long argument that will be needed to establish it. But it has consequences for our judgement of the Iliad as a whole. If the one interpretation is correct, then Homer is content to repeat his effects without regard to the situation of his characters, which in any other author we would call careless writing. On the other interpretation he is capable of focusing down to quite detailed nuances. The question is not therefore one of lexicology alone but also of literary criticism.The translation ‘all-untimely doomed’ has warrant from antiquity. Leaf quotes a scholium παντελ⋯ς ἄωρον ⋯ποθανούμενον, and the word ⋯ωρία is used by a scholiast at 1.505 to refer to the fate by which Achilles was to die early. (shrink)

For 150 years after Galileo’s condemnation in 1633, there were many references to the trial, but no sustained, heated or polarized discussions. Then came the thesis that Galileo was condemned not for being a good astronomer but for being a bad theologian ; it began in 1784–1785 with an apology of the Inquisition by Mallet du Pan in the Mercure de France and the printing in Tiraboschi’s Storia della letteratura italiana of an apocryphal letter attributed to Galileo but forged by (...) Onorato Gaetani. This thesis is not only untenable and false but inverts and subverts the truth; it proved to be long-lasting and widely accepted; so it may be labeled a myth. It was held by such writers as Bergier; Bergier; B; Feller; Cooper; Purcell; Marini; Reumont; Madden and Duhem. Afterwards, it was generally abandoned, its death knell being pope John Paul II’s speeches in 1979–1992. The newsletters appeared to be concocted from malicious gossip. 1The newspapers seemed to be published at the bidding of powerful political interests with little inclination to tell the (...) truth, 2and histories of recent events seemed to be based on faulty sources even when the writers endeavored to procure faithful accounts. “Truth is by nature elusive and slippery,” history theorist Agostino Mascardi admitted. All he could recommend as a defense for the inaccurate historian was the injunction against throwing the first stone: “Omnis homo mendax,” said David the holy king; and those who are such harsh critics of historians’ involuntary lies may well be astute trammelers of perfidy and deceit in their own lives.” 3He had no answer about historians who deliberately distorted the truth. In fact just when readers might have desired it most, from the earliest episodes of the Thirty-Years War to the last episodes of the Turkish Wars at the end of the century, the possibility of [End Page 487]gaining a realistic picture of the contemporary world seemed to be getting more and more remote.The argument of this article centers around a discussion of the cultural consequences of this late seventeenth-century trend. To some of the readers, writers, thinkers, and theorists in this period, the unreliability of information about their own time or about the past, however compounded by contemporary political and social circumstances, was nothing but a minor nuisance. To others it was a hint about the bad faith of the governments who influenced writers. To still others, this same unreliability raised deeply troubling questions about human nature and existence. It provided social and political reasons for historical skepticism, quite apart from one’s familiarity with Sextus Empiricus or the elite intellectual trends of the time. It placed everyday social and political reality in a new light, thus adding a more mundane element to the uneasy feeling produced by the new science and cosmology—the feeling, that is, of being borne along in uncontrollable currents whose exact nature the best minds nonetheless seemed incapable of understanding. In this article, we describe the influence of violations of community standards of fairness on subsequent ethical decision-making and emotions. Across two studies, we manipulated explanations for a common action, and we find that explanations that violate community standards of fairness lead to greater intentions to behave unethically than explanations that are consistent with community standards of fairness. We find that perceptions of justifiability mediate this relationship. We also find that individuals derive significant psychological benefits from engaging in unethical behavior (...) following perceived violations of fairness. (shrink)

On September 1, 2023, Texas made important revisions to it its decades‐old statute granting legal safe harbor immunity to physicians who withhold or withdraw life‐sustaining treatment over the objection of critically ill patients’ surrogate decision‐makers. However, lawmakers left untouched glaring flaws in a key safeguard for patients—the transfer option. The transfer option is ethically important because, when no hospital is willing to accept the patient in transfer, that fact is taken as strong evidence that the surrogates’ treatment requests fall outside (...) accepted medical practice. But there are serious shortcomings in how the transfer option is carried out in Texas and many other states, which undermines the ethical usefulness of the process. We identify these shortcomings and recommend revisions to state statutes and professional guidelines to overcome them. (shrink)

How do we use our mental images of the present to reconstruct our past? Maurice Halbwachs addressed this question for the first time in his work on collective memory, which established him as a major figure in the history of sociology. This volume, the first comprehensive English-language translation of Halbwach's writings on the social construction of memory, fills a major gap in the literature on the sociology of knowledge. Halbwachs' primary thesis is that human memory can only function within (...) a collective context. Collective memory, Halbwachs asserts, is always selective; various groups of people have different collective memories, which in turn give rise to different modes of behavior. Digital phenotyping is the term given to the capturing and use of user log data from health and wellbeing technologies used in apps and cloud-based services. This paper explores ethical issues in making use of digital phenotype data in the arena of digital health interventions. Products and services based on digital wellbeing technologies typically include mobile device apps as well as browser-based apps to a lesser extent, and can include telephony-based services, text-based chatbots, and voice-activated chatbots. Many of these digital (...) products and services are simultaneously available across many channels in order to maximize availability for users. Digital wellbeing technologies offer useful methods for real-time data capture of the interactions of users with the products and services. It is possible to design what data are recorded, how and where it may be stored, and, crucially, how it can be analyzed to reveal individual or collective usage patterns. The paper also examines digital phenotyping workflows, before enumerating the ethical concerns pertaining to different types of digital phenotype data, highlighting ethical considerations for collection, storage, and use of the data. A case study of a digital health app is used to illustrate the ethical issues. The case study explores the issues from a perspective of data prospecting and subsequent machine learning. The ethical use of machine learning and artificial intelligence on digital phenotype data and the broader issues in democratizing machine learning and artificial intelligence for digital phenotype data are then explored in detail. In it, Bucke described his own experience, that of contemporaries, and the experiences and outlook of historical figures including Buddha, Jesus, Paul, Plotinus, Muhammad, Dante, Francis Bacon, and William Blake. Bucke developed a theory involving three stages in the development of consciousness: the simple consciousness of animals; the self-consciousness of the mass of humanity ; and cosmic consciousness (...) - an emerging faculty and the next stage of human development.
