The first issue of _Artificial Intelligence and Law_ journal was published in 1992. This paper discusses several topics that relate more naturally to groups of papers than a single paper published in the journal: ontologies, reasoning about evidence, the various contributions of Douglas Walton, and the practical application of the techniques of AI and Law.

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Despite increasing interest in studying arguments from deontic authority of the general form “(1) $$\delta$$ δ is a deontic authority in institution $$\varOmega$$ Ω ; (2) according to $$\delta$$ δ, I should do $$\alpha$$ α, C: therefore, (3) I should do $$\alpha$$ α ”, the state of the art models are not capable of grasping their complexity. The existing sets of critical questions assigned to this argumentation scheme seem to conflate two problems: whether a person is subject to an authority (...) of an institution in the first place and whether the command issued within the context of a particular institution is eventually binding. For this reason, we introduce (1) a set of Basic Critical Questions to scrutinize the former issue, and (2) a set of more detailed questions related to specific features, also referred to as “parameters”, of institutional environments (Intra-Institutional Critical Questions). We identify major elements of institutional environments in which authoritative utterances are made and the crucial parameters of arguments from deontic authority. The selected evidence from the decisions of the Polish Supreme Administrative Court helps us show how these parameters may be used to reconstruct subtypes of this argument scheme, with their associated sets of critical questions. In specific institutional contexts, such detailed schemes are capable of grasping the complexity of appeals to deontic authority and thus should be used rather than general schemes. The reconstruction of argumentation schemes with critical questions shows how particular arguments may successfully be attacked. (shrink)

This is a report on the Doctoral Consortium co-located with the 17th International Conference on Artificial Intelligence and Law in Montreal.

This book presents the current state of the art regarding the application of logical tools to the problems of theory and practice of lawmaking. It shows how contemporary logic may be useful in the analysis of legislation, legislative drafting and legal reasoning concerning different contexts of lawmaking. Elaborations of the process of lawmaking have variously emphasised its political, social or economic aspects. Yet despite strong interest in logical analyses of law, questions remains about the role of logical tools in lawmaking. (...) This volume attempts to bridge that gap, or at least to narrow it, drawing together some important research problems-and some possible solutions-as seen through the work of leading contemporary academics. The volume encompasses 20 chapters written by authors from 16 countries and it presents diversified views on the understanding of logic (from strict mathematical approaches to the informal, argumentative ones) and differentiated choices concerning the aspects of lawmaking taken into account. The book presents a broad set of perspectives, insights and results into the emerging field of research devoted to the logical analysis of the area of creation of law. How does logic inform lawmaking? Are legal systems consistent and complete? How can legal rules be represented by means of formal calculi and visualization techniques? Does the structure of statutes or of legal systems resemble the structure of deductive systems? What are the logical relations between the basic concepts of jurisprudence that constitute the system of law? How are theories of legal interpretation relevant to the process of legislation? How might the statutory text be analysed by means of contemporary computer programs? Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. The thesis of the paper holds that some future developments of argumentation theory may be inspired by the rich logico-methodological legacy of the Lvov–Warsaw School (LWS), the Polish research movement that was most active from 1895 to 1939. As a selection of ideas of the LWS which exploit both formal and pragmatic aspects of the force of argument, we present: Ajdukiewicz’s account of reasoning and inference, Bocheński’s analyses of superstitions or dogmas, and Frydman’s constructive approach to legal interpretation. This paper (...) does not aim at exhaustive elaboration of any of these topics or their usefulness in current discussions within argumentation theory. Rather, we intend to indicate chosen directions of a potentially fruitful research program for the emerging Polish School of Argumentation which would consist in application of methods and conceptions elaborated by the LWS to selected open problems of contemporary research on argumentation. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. In September 2018, the ArgDiaP association, along with colleagues from Germany and the UK, organised one of the longest and most interdisciplinary series of events ever dedicated to argumentation - Warsaw Argumentation Week, WAW 2018. The eleven-day ‘week’ featured a five day graduate school on computational and linguistic perspectives on argumentation (3rd SSA school); five workshops: on systems and algorithms for formal argumentation (2nd SAFA), argumentation in relation to society (1st ArgSoc), philosophical approaches to argumentation (1st ArgPhil), legal argumentation (2ndMET-ARG) (...) and argumentation in rhetoric (1st MET-RhET); and two conferences: on computational models of argumentation (7th COMMA conference) and on argumentation and corpus linguistics (16th ArgDiaP conference). WAW hosted twelve tutorials and eight invited talks as well as welcoming over 130 participants. All the conferences and workshops publish pre- or post-proceedings in the top journals and book series in the field. (shrink)

The first issue of _Artificial Intelligence and Law_ journal was published in 1992. This paper provides commentaries on landmark papers from the first decade of that journal. The topics discussed include reasoning with cases, argumentation, normative reasoning, dialogue, representing legal knowledge and neural networks.

The skeptical solution is based on two assumptions — the rejection of semantic facts and the denial of semantic nihilism. On the basis of the non-factualist interpretation of this solution, these two assumptions are reconciled by stating that meaning ascriptions possess non-descriptive function. Nonetheless, Alexander Miller argues that this position is self-refuting since, as despite its non-descriptivism, by rejecting any kind of semantic facts, it inevitably leads to semantic nihilism. In this text, I demonstrate that Miller’s argument is not sound. (...) I argue that a coherent non-factualist way of formulating the conditions of correct use of meaning ascriptions may be performed by rejecting the closure principle of assertibility of meaning ascriptions. On this basis, I demonstrate that argument formulated against non-factualist interpretation by Miller may be refuted. What is more, I argue that rejection of the closure principle should be regarded as the central aspect of Kripke’s skeptical solution. (shrink)

This book stands at the intersection of two topics: the decidability and computational complexity of hybrid logics, and the deductive systems designed for them. Hybrid logics are here divided into two groups: standard hybrid logics involving nominals as expressions of a separate sort, and non-standard hybrid logics, which do not involve nominals but whose expressive power matches the expressive power of binder-free standard hybrid logics.The original results of this book are split into two parts. This division reflects the division of (...) the book itself. The first type of results concern model-theoretic and complexity properties of hybrid logics. Since hybrid logics which we call standard are quite well investigated, the efforts focused on hybrid logics referred to as non-standard in this book. Non-standard hybrid logics are understood as modal logics with global counting operators ) whose expressive power matches the expressive power of binder-free standard hybrid logics. The relevant results comprise: 1. Establishing a sound and complete axiomatization for the modal logic K with global counting operators ), which can be easily extended onto other frame classes, 2. Establishing tight complexity bounds, namely NExpTime-completeness for the modal logic with global counting operators defined over the classes of arbitrary, reflexive, symmetric, serial and transitive frames ), MT), MD), MB), MK4) with numerical subscripts coded in binary. Establishing the exponential-size model property for this logic defined over the classes of Euclidean and equivalential frames ), MS5).Results of the second type consist of designing concrete deductive systems for standard and non-standard hybrid logics. More precisely, they include: 1. Devising a prefixed and an internalized tableau calculi which are sound, complete and terminating for a rich class of binder-free standard hybrid logics. An interesting feature of indicated calculi is the nonbranching character of the rule, 2. Devising a prefixed and an internalized tableau calculi which are sound, complete and terminating for non-standard hybrid logics. The internalization technique applied to a tableau calculus for the modal logic with global counting operators is novel in the literature, 3. Devising the first hybrid algorithm involving an inequality solver for modal logics with global counting operators. Transferring the arithmetical part of reasoning to an inequality solver turned out to be sufficient in ensuring termination.The book is directed to philosophers and logicians working with modal and hybrid logics, as well as to computer scientists interested in deductive systems and decision procedures for logics. Extensive fragments of the first part of the book can also serve as an introduction to hybrid logics for wider audience interested in logic.The content of the book is situated in the areas of formal logic and theoretical computer science with some elements of the theory of computational complexity. The purpose of this article is to discuss Kant’s concept of juridical state as the foundation of the contemporary rule of law. Therefore, the article tries to answer two questions: (1) what character can be attributed to Kant’s concept of juridical state taking into account the obligations arising from it; (2) can the analysis of the Kantian juridical state have any impact on the contemporary understanding of the rule of law and if so, what can this impact be. In order (...) to accomplish this task, moral presuppositions of Kant’s juridical state are discussed, according to the commonly accepted view that Kant’s political philosophy is closely linked with his moral and ethical reflection. Then, two interpretations of Kant’s juridical state – the liberal one and the authoritarian one – are analysed. The crucial difference between these interpretations lies in establishing the circumstances in which the duty of obedience to state power should be carried out. Then, Kantian juridical state is compared with two ways of understanding the rule of law – the material one and the formal one – in order to evaluate whether the rule of law should be considered as continuity of or rupture with the Kantian concept. We introduce a three-tiered framework for modelling and reasoning about agents who (i) can use possibly complete reasoning systems without any restrictions but who nevertheless are (ii) bounded in the sense that they never reach infinitely many results and, finally, who (iii) perform their reasoning in time. This last aspect does not concern so much the time it takes for agents to actually carry out their reasoning, as the time which can bring about external changes in the agents’ states such (...) as arriving of new information or discarding previously available information due to bounds of the agent’s resources. These three aspects are treated with the maximal possible degree of independence from each other. The treatment of layer (iii) can be combined with arbitrary logic at level (ii) which, in turn, can be combined with arbitrary agent logic at level (i). At the level (iii), we discuss briefly the duality (or rather, complementarity) of system descriptions based on actions and transitions, on the one hand, and states and their changes, on the other. We settle for the latter and present a simple language, for describing state changes, which is parameterized by an arbitrary language for describing properties of the states. The language can be viewed as a simple fragment of step logic, admitting however various extensions by appropriate choices of the underlying logic. Alternatively, it can be seen as a very specific fragment of temporal logic (with a variant of ‘until’ or ‘chop’ operator), and is interpreted over dense linear time. The reasoning system presented here is sound, as well as strongly complete and decidable (provided that so is the parameter logic for reasoning about single states). We give the main idea of the completeness proof and suggest a wide range of possible applications, which is a simple consequence of the parametric character of both the language and the reasoning system. We address then in more detail the case of non-omniscient rational agents, (ii). Their models are syntactic structures (sets of available formulae) similar in spirit, though not in the technical formulation, to the models used in other syntax oriented approaches and in active logic. We give a new sound, complete and decidable system for reasoning about such agents. Finally, we illustrate its extensions with the internal reasoning of agents, (i), by equipping them with some example logics. (shrink)

Graph normal form, introduced earlier for propositional logic, is shown to be a normal form also for first-order logic. It allows to view syntax of theories as digraphs, while their semantics as kernels of these digraphs. Graphs are particularly well suited for studying circularity, and we provide some general means for verifying that circular or apparently circular extensions are conservative. Traditional syntactic means of ensuring conservativity, like definitional extensions or positive occurrences guaranteeing exsitence of fixed points, emerge as special cases.

Despite their ethical intentions, ethically minded consumers rarely purchase ethical products (Auger and Devinney: 2007, Journal of Business Ethics76, 361–383). This intentions–behaviour gap is important to researchers and industry, yet poorly understood (Belk et al.: 2005, Consumption, Markets and Culture8(3), 275–289). In order to push the understanding of ethical consumption forward, we draw on what is known about the intention–behaviour gap from the social psychology and consumer behaviour literatures and apply these insights to ethical consumerism. We bring together three separate (...) insights – implementation intentions (Gollwitzer: 1999, American Psychologist54(7), 493–503), actual behavioural control (ABC) (Ajzen and Madden: 1986, Journal of Experimental Social Psychology22, 453–474; Sheeran et al.: 2003, Journal of Social Psychology, 42, 393–410) and situational context (SC) (Belk: 1975, Journal of Consumer Research2, 157–164) – to construct an integrated, holistic conceptual model of the intention–behaviour gap of ethically minded consumers. This holistic conceptual model addresses significant limitations within the ethical consumerism literature, and moves the understanding of ethical consumer behaviour forward. Further, the operationalisation of this model offers insight and strategic direction for marketing managers attempting to bridge the intention–behaviour gap of the ethically minded consumer. Responding to the increasingly influential role of Hannah Arendt's political philosophy in recent years, Hannah Arendt and the Limits of Total Domination: The Holocaust, Plurality, and Resistance, critically engages with Arendt's understanding of totalitarianism. According to Arendt, the main goal of totalitarianism was total domination; namely, the virtual eradication of human legality, morality, individuality, and plurality. This attempt, in her view, was most fully realized in the concentration camps, which served as the major "laboratories" for the regime. While Arendt focused (...) on the perpetrators' logic and drive, Michal Aharony examines the perspectives and experiences of the victims and their ability to resist such an experiment. The first book-length study to juxtapose Arendt's concept of total domination with actual testimonies of Holocaust survivors, this book calls for methodological pluralism and the integration of the voices and narratives of the actors in the construction of political concepts and theoretical systems. To achieve this, Aharony engages with both well-known and non-canonical intellectuals and writers who survived Auschwitz and Buchenwald concentration camps. Additionally, she analyzes the oral testimonies of survivors who are largely unknown, drawing from interviews conducted in Israel and in the U.S., as well as from videotaped interviews from archives around the world. Revealing various manifestations of unarmed resistance in the camps, this study demonstrates the persistence of morality and free agency even under the most extreme and de-humanizing conditions, while cautiously suggesting that absolute domination is never as absolute as it claims or wishes to be. Scholars of political philosophy, political science, history, and Holocaust studies will find this an original and compelling book. (shrink)

In a recent series of papers, Jane Friedman argues that suspended judgment is a sui generis first-order attitude, with a question as its content. In this paper, I offer a critique of Friedman’s project. I begin by responding to her arguments against reductive higher-order propositional accounts of suspended judgment, and thus undercut the negative case for her own view. Further, I raise worries about the details of her positive account, and in particular about her claim that one suspends judgment about (...) some matter if and only if one inquires into this matter. Subsequently, I use conclusions drawn from the preceding discussion to offer a tentative account: S suspends judgment about p iff S believes that she neither believes nor disbelieves that p, S neither believes nor disbelieves that p, and S intends to judge that p or not-p. According to the orthodox view, the goodness of a life depends exclusively on the things that actually happened within it, such as its pleasures and pains, the satisfaction of its subject’s preferences, or the presence of various objective goods and bads. In this paper, I argue that the goodness of a life also depends on what could have happened, but didn’t. I then propose that this view helps us resolve ethical puzzles concerning the standards for a life worth living for (...) animals and the significance of a life’s shape. (shrink)

We introduce a variant of pointer structures with denotational semantics and show its equivalence to systems of boolean equations: both have the same solutions. Taking paradoxes to be statements represented by systems of equations (or pointer structures) having no solutions, we thus obtain two alternative means of deciding paradoxical character of statements, one of which is the standard theory of solving boolean equations. To analyze more adequately statements involving semantic predicates, we extend propositional logic with the assertion operator and give (...) its complete axiomatization. This logic is a sub-logic of statements in which the semantic predicates become internalized (for instance, counterparts of Tarski’s definitions and T-schemata become tautologies). Examples of analysis of self-referential paradoxes are given and the approach is compared to the alternative ones. (shrink)

The purpose of this study was to measure professional and personal values among nurses, and to identify the factors affecting these values. The participants were 323 Israeli nurses, who were asked about 36 personal values and 20 professional values. The three fundamental professional nursing values of human dignity, equality among patients, and prevention of suffering, were rated first. The top 10 rated values all concerned nurses' responsibility towards patients. Altruism and confidentiality were not highly rated, and health promotion and nursing (...) research were rated among the last three professional values. For personal (instrumental) values, honesty, responsibility and intelligence were rated first, while ambition and imagination were rated 14th and 16th respectively out of 18. Significant differences (P < 0.05) were found among some personal and professional values rated as functions of culture, education, professional seniority, position and field of expertise. The results may assist in understanding the motives of nurses with different characteristics and help to promote their work according to professional ethical values. (shrink)

While mainstream CSR research has generally explored and argued for positive ethical, social and environmental performance, critical CSR scholars argue that change has been superficial—at best, and not possible in any substantial way within the current capitalist system. Both views, however, only address the role of business within larger systems. Little attention has been paid to the everyday material CSR practice of individual managers. We go inside the firm to investigate how the micro-level acts of individual managers can aggregate to (...) drive transformation of the macro-level business logic. We draw on the strategy-as-practice approach to organize our research. The study reveals two orientations towards the integration of personal ethics into the workplace: abdication and activism. These orientations are supported by managerial practice such as reproductive and coping tactics and covert and overt tactics ; and, three enabling conditions of activist practice: empowerment and psychological safety, moral shock, and morality praxis. While our findings illustrate the tremendous challenges managers face when attempting to influence organizational practices towards their ethical and environmental aspirations, we also show that under specific conditions, individual managers can become fully engaged advocates and drivers of positive change from the inside. In so doing, our individual-level analysis of intrapreneurship provides a more complex picture of the possibilities for positive change than have been previously put forth by mainstream and critical CSR research. Over the last two decades, social scientists across disciplines have been researching how value is extracted and governed in the reproductive bioeconomy, which broadly refers to the various ways reproductive tissues, bodies, services, customers, workers, and data are inserted into capitalist modes of accumulation. While many of these studies are empirically grounded in single country–based analyses, this paper proposes an integrative political economy framework, structured around the concept of “global fertility chains.” The latter articulates the reproductive bioeconomy as a nexus (...) of intraconnected practices, operations, and transactions between enterprises, states, and households across the globe, through which reproductive services and commodities are produced, distributed, and consumed. Employing a diffractive reading of the literature on commodity chains and care chains, this unified approach scrutinizes the coproduction of value, biology, and technoscience and their governance mechanisms in the accumulation of capital by taking into account the unevenly developed geographies of global fertility chains, their reliance on women’s waged and unwaged reproductive labor, and the networked role of multiple actors at multiple scales without losing sight of the constitutive role of national states in creating demand, organizing supply, and accommodating the distribution of surplus value. We empirically ground this integrative political economy approach of the reproductive bioeconomy through collaborative, multisited fieldwork on transnational reproduction networks in Israel/palestine, Romania, Georgia, and Spain. Despite the fact that Husserl did not write a book on aesthetics, it is widely accepted that a Husserlian aesthetics can be developed from his writings. In this article, I describe and analyze a feature of Husserlian aesthetics which I call the “radical individuality of the aesthetic object.” This radical individuality stems from Husserl’s interpretation of aesthetic consciousness in terms of the neutrality modification. I make the case for a radical reading of the neutrality modification by contrasting it with the (...) inactuality modification and the notion of foundation and I argue that the neutrality modification must be kept distinct from these concepts. I further describe the concept of the radical individuality of the aesthetic object by reference to Ingarden’s notion of the aesthetic object as monosubjective. The thesis of the radical individuality of the aesthetic object prima facie leads Husserlian aesthetics close to axiological relativism expressed in the adage that de gustibus non est disputandum. I explain that despite such proximity, Husserlian aesthetics does not entail an axiological relativism and does not preclude discussions concerning aesthetic values. On the contrary, Husserlian aesthetics ultimately shows that such discussions are necessary for keeping the possibility of aesthetic perception itself alive, and thereby encourages such discussions. I conclude with a practical demonstration of the results of my Husserlian analyses by critically engaging some aspects of Proust’s theory of art in À la recherche du temps perdu. (shrink)

Classical logic, of first or higher order, is extended with sentential operators and quantifiers, interpreted substitutionally over unrestricted substitution class. Operators mark a single layered, consistent metalanguage. Self-reference, arising from substitutional quantification over sentences, allows to express paradoxes which, unlike contradictions, do not lead to explosion. Semantics of the resulting language, using semi-kernels of digraphs, is non-explosive yet two-valued and has classical semantics as a special case for clasically consistent theories. A complete reasoning is obtained by extending LK with two (...) rules for sentential quantifiers. Adding (cut) yields a complete system for the explosive semantics. (shrink)

This essay presents the Aestheticism of the 19th century as the foundational movement of modernist-formalist aesthetics of the 20th century. The main principle of this movement is what I denominate “productive opacity”. Aestheticism has not been recognized as a philosophical aesthetic theory. However, its definition of artwork as an exclusive kind of form—a deep, opaque form—is among the most precise ever given in the discipline. This essay offers an interpretation of aestheticism as a formalist theory, referred to here as “deep (...) formalism”, focusing on the thinking of leading aestheticists, Walter Pater, Oscar Wilde, and James Whistler. Główny cel badań sprowadza się tym samym do bacznego przyjrzenia się potencjalnej korelacji pomiędzy zewnętrznymi w rozumieniu starożytnego Greka postaciami bogów i bogiń, a wewnętrznymi przejawami nieświadomości zbiorowej, które mogą stanowić – według Carla Gustava Junga – istotę antycznych bóstw. This paper critically assesses the possibility of moral enhancement with ambient intelligence technologies and artificial intelligence presented in Savulescu and Maslen (2015). The main problem with their proposal is that it is not robust enough to play a normative role in users’ behavior. A more promising approach, and the one presented in the paper, relies on an artifi-cial moral reasoning engine, which is designed to present its users with moral arguments grounded in first-order normative theories, such as Kantianism or utilitarianism, (...) that reason-responsive people can be persuaded by. This proposal can play a normative role and it is also a more promising avenue towards moral enhancement. It is more promising because such a system can be designed to take advantage of the sometimes undue trust that people put in automated technologies. We could therefore expect a well-designed moral reasoner system to be able to persuade people that may not be persuaded by similar arguments from other people. So, all things considered, there is hope in artificial intelli-gence for moral enhancement, but not in artificial intelligence that relies solely on ambient intelligence technologies. (shrink)

The overreliance on verbal models and theories in psychology has been criticized for hindering the development of reliable research programs (Harris, 1976; Yarkoni, 2020). We demonstrate how the conceptual space framework can be used to formalize verbal theories and improve their precision and testability. In the framework, scientific concepts are represented by means of geometric objects. As a case study, we present a formalization of an existing three-dimensional theory of emotion which was developed with a spatial metaphor in mind. Wundt (...) posits that the range of human emotion can be represented along three axes of basic emotions (pleasure/displeasure, excitement/inhibition, tension/relaxation), just as color vision can be represented using three basic colors. We use dimensions to represent basic emotions, points to represent emotional states, and regions to represent broader emotional concepts. We then compare our formalization to an existing structuralist formalization of Wundt’s theory. Further, we discuss the empirical predictions that our formalization generates, such as comparisons of similarity and intensity. We conclude by demonstrating how the tools developed in the conceptual space framework can be used to formulate a theory of emotion based on empirical observation. (shrink)

This paper offers a theoretical framework that can be used to derive viable engineering strategies for the design and development of robots that can nudge people towards moral improvement. The framework relies on research in developmental psychology and insights from Stoic ethics. Stoicism recommends contemplative practices that over time help one develop dispositions to behave in ways that improve the functioning of mechanisms that are constitutive of moral cognition. This article presents qualitative research conducted in an Israeli ova `extraction' clinic in Romania. Following on from a piece written by Jyotsna Gupta and published in this journal in February 2006, this article asks what kinds of feminist alliances can or should be made in the arena of reproductive technologies. In conversation with Gupta, the author asks whether `an ethic of universal human dignity' is possible or desirable. This article looks to the voices of Romanian egg sellers themselves as a (...) source of theoretical and political direction for transnational feminists who try to think about responses to reproductive technologies. Celem artykułu jest analiza dwóch problemów – obcości oraz przemocy – w ramach opracowywanej przez Bernharda Waldenfelsa fenomenologii responsywnej. Autor pokazuje, w jaki sposób oba te fenomeny wymagają zradykalizowanej formy redukcji fenomenologicznej, która zostaje określona jako redukcja responsywna. Pozwala to na uchwycenie centralnej roli, jaką problemy obcości i przemocy odgrywają w rozwijanej przez Waldenfelsa responsywnej etyce.

The War Inside is a groundbreaking history of the contribution of British psychoanalysis to the making of social democracy, childhood, and the family during World War II and the postwar reconstruction. Psychoanalysts informed understandings not only of individuals, but also of broader political questions. By asserting a link between a real 'war outside' and an emotional 'war inside', psychoanalysts contributed to an increased state responsibility for citizens' mental health. They made understanding children and the mother-child relationship key to the successful (...) creation of a democratic citizenry. Using rich archival sources, the book revises the common view of psychoanalysis as an elite discipline by taking it out of the clinic and into the war nursery, the juvenile court, the state welfare committee, and the children's hospital. Modern physics is founded on two mainstays: mathematical modelling and empirical verification. These two assumptions are prerequisite for the objectivity of scientific discourse. Here we show, however, that they are contradictory, leading to the ‘experiment paradox’. We reveal that any experiment performed on a physical system is—by necessity—invasive and thus establishes inevitable limits to the accuracy of any mathematical model. We track its manifestations in both classical and quantum physics and show how it is overcome ‘in practice’ via the concept (...) of environment. We argue that the unravelled paradox induces a new type of ‘ontic’ underdetermination, which has deep consequences for the methodological foundations of physics. (shrink)
