Background: Ethics support services are growing in Europe to help doctors in dealing with ethical difficulties. Currently, insufficient attention has been focused on the experiences of doctors who have faced ethical difficulties in these countries to provide an evidence base for the development of these services.Methods: A survey instrument was adapted to explore the types of ethical dilemma faced by European doctors, how they ranked the difficulty of these dilemmas, their satisfaction with the resolution of a recent ethically difficult case (...) and the types of help they would consider useful. The questionnaire was translated and given to general internists in Norway, Switzerland, Italy and the UK.Results: Survey respondents ranged in age from 28 to 82 years, and averaged 25 years in practice. Only a minority reported having access to ethics consultation in individual cases. The ethical difficulties most often reported as being encountered were uncertain or impaired decision-making capacity , disagreement among caregivers and limitation of treatment at the end of life . The frequency of most ethical difficulties varied among countries, as did the type of issue considered most difficult. The types of help most often identified as potentially useful were professional reassurance about the decision being correct , someone capable of providing specific advice , help in weighing outcomes and clarification of the issues . Few of the types of help expected to be useful varied among countries.Conclusion: Cultural differences may indeed influence how doctors perceive ethical difficulties. The type of help needed, however, did not vary markedly. The general structure of ethics support services would not have to be radically altered to suit cultural variations among the surveyed countries. (shrink)

Objectives: To determine whether authors of scientific publications in molecular biology declare patents and other potential financial interests.Design: Survey of a 6-month sample of papers related to molecular biology in Nature.Methods: The esp@cenet worldwide patent search engine was used to search for patents applied for by the authors of scientific papers in Nature that were related to molecular biology and genetics, between January and June 2005.Results: Of the 79 papers considered, four had declared that certain authors had competing financial interests. (...) Seven papers in which no financial interests were declared had authors with patent applications that were based on the research in the paper or were closely related to it. Another paper had two authors with connections to biotechnology companies that were not disclosed.Conclusion: Two thirds of the papers in which authors had patent applications or company affiliations that might be considered to be competing financial interests did not disclose them. Failure to disclose such information may have negative implications on the perception of science in society and on its quality if the possible bias is hidden. Journals should make greater efforts to ensure full disclosure, and scientific institutions should consider failure to disclose financial interests as an example of scientific malpractice. Establishing a register of interests for scientists is one way to increase transparency and openness. (shrink)

Recent military coups in West Africa have put the continent’s democratisation itself into question. In some places, for the moment, these coups appear to have popular backing. Nigeria, where radicalism is firmly rooted in democratic values and a human-rights framework, the radical grassroots opposition to the Buhari government’s creeping authoritarianism lies drenched in blood. The roots of this development go back to the history of Nigeria’s radicalism in the twentieth century. Much has appeared on the global 1968 recently, including that (...) of Africa. 1970s/1980s-style radicalism is reappearing today with Omoyele Sowore’s 2018 presidential candidacy, with the African Action Congress party, the #EndSARS protests and the tragic Lekki Toll Gate massacre (2020) in Nigeria. The shift towards radicalism is palpable with protest music such as Falz’s This is Nigeria, and Burna Boy’s Monsters you Made, both explicitly targeting neocolonialism and police brutality. Contrary to Achille Mbembe’s sweeping dismissal of African radicalism, the movement with very deep roots under study is meaningful once again, and is gathering momentum in West Africa’s giant polity. This article applies Walter Benjamin’s and also Nigerian radical thinkers’ conceptualisation of political, social and artistic radicalism, while it frames the Nigerian version via the movement’s history, in which marxisant theory and praxis, feminism, human rights and pro-democracy movements interact with emancipatory strands of Islam, Christianity, Igbo Judaism, and animism. In the context of Nigerian radicalism, even expressly pro-capitalist art theory performs a radical social function by stressing the African’s right to make universal statements (Olu Oguibe) in its de facto defiance of the neo-colony. As these different strands of protest meet, ethnic uprisings (amongst them IPOB) find ways to establish common cause with social radicalism, posing a composite threat to the prebendalist oligarchy that rules and oppresses the country via a militarised neoliberalism. The significance of the complicated numbering of the propositions in the Tractatus has occasioned much speculation. Wittgenstein's own explanation has, following Stenius, been generally regarded as misleading. But an examination of the Prototractatus reveals that the numbering system was for Wittgenstein principally an aid in the composition of his work. It allowed him to mark out certain propositions which required further work or supplementation, without disturbing the basic structure of the treatise. But the reworking of the Prototractatus to form the (...) Tractatus considerably changed the original order in which the ideas were connected, and thus made it more difficult to understand the Tractatus. Several specific examples make it clear that it is essential to look back at the context of the Prototractatus in order to achieve a correct interpretation of many of the propositions in the Tractatus. This paper offers a new answer to an old question. Others have argued that exploitation is wrong because it is coercive, or degrading, or fails to protect the vulnerable. But these answers only work for certain cases; counterexamples are easily found. In this paper I identify a different answer to the question by placing exploitation within the larger family of wrongs to which it belongs. Exploitation is one species of wrongful gain, and exploiters always gain at the expense of others (...) by inflicting relative losses on disadvantaged parties. They do harm to their victims, even when their interactions are mutually advantageous, by failing to benefit the disadvantaged party as fairness requires. This failure is the essential wrong in every case of wrongful exploitation. At the end of the paper I assess how wrong this failure is as a way to gain at another's expense. (shrink)

Nietzsche's metaphor of the spider that spins its cobweb expresses his critique of the metaphysical use of language - but it also suggests that ‟we, spiders‟, are able to spin different, life-affirming, healthier, non-metaphysical cobwebs. This book is a collection of 12 essays that focus not only on Nietzsche's critique of the metaphysical assumptions of language, but also on his effort to use language in a different way, i.e., to create a ‟new language‟. It is from this viewpoint that the (...) book considers such themes as consciousness, the self, metaphor, instinct, affectivity, style, morality, truth, and knowledge. The authors invited to contribute to this volume are Nietzsche scholars who belong to some of the most important research centers of the European Nietzsche-Research: Centro Colli-Montinari (Italy), GIRN (Europhilosphie), SEDEN (Spain), Greifswald Research Group (Germany), NIL (Portugal). Introduction No consent for health and medical research is appropriate when the criteria for a waiver of consent are met, yet some ethics committees and data custodians still require informed consent. Methods A single-blind parallel-group randomised controlled trial: 1129 families of children born at a South Australian hospital were sent information explaining data linkage of childhood immunisation and hospital records for vaccine safety surveillance with 4 weeks to opt in or opt out by reply form, telephone or email. A subsequent (...) telephone interview gauged the intent of 1026 parents (91%) in relation to their actions and the sociodemographic differences between participants and non-participants in each arm. Results The participation rate was 21% (n=120/564) in the opt-in arm and 96% (n=540/565) in the opt-out arm (χ2 (1 df) = 567.7, p<0.001). Participants in the opt-in arm were more likely than non-participants to be older, married/de facto, university educated and of higher socioeconomic status. Participants in the opt-out arm were similar to non-participants, except men were more likely to opt out. Substantial proportions did not receive, understand or properly consider study invitations, and opting in or opting out behaviour was often at odds with parents' stated underlying intentions. Conclusions The opt-in approach resulted in low participation and a biased sample that would render any subsequent data linkage unfeasible, while the opt-out approach achieved high participation and a representative sample. The waiver of consent afforded under current privacy regulations for data linkage studies meeting all appropriate criteria should be granted by ethics committees, and supported by data custodians. U.S. multinational enterprises must now follow the policies of Title VII of the Civil Rights Act of 1964 in their overseas operations, at least with respect to U.S. expatriate employees. Doing so in a culture which discourages gender equality in the workplace raises difficult issues, both practically and ethically. Vigorously importing U.S. attitudes toward gender-equality into a social culture such as Japan or Saudi Arabia may seem ethnocentric, a version of ethical imperialism. Yet adapting to host country norms risks a (...) kind of moral relativism. This article supports the view that MNEs which promote workplace equality in a host country such as Japan, which is actively involved in the international economic and political community, is not ethical imperialism in any pejorative sense and is preferable to a moral relativism or social contract approach.We hold these truths to be self-evident: that all men are created equal, and endowed by their creator with certain rights — life, liberty, and the pursuit of happiness. Lucid dreaming refers to a dream state characterized by the dreamers awareness of being in a dream and being able to volitionally control its content. The aim of this study was to find neurophysiological evidence for the 7 criteria of lucid dreaming proposed by Paul Tholey. Each of the criteria was analyzed separately with regard to its underlying neurocircuits. We hypothesized that not one, but many regions are involved in the state of lucid dreaming. Our results have shown a satisfactory (...) overlap of the theoretical components and the brain regions activated during a lucid dream. During lucid dreaming, a brain network seems to emerge, that is more than the sum of its parts. Further research is needed to understand the psychoneurological underpinnings of lucid dreams. The nurse–patient relationship is of great significance for both nurses and patients. The purpose of this article is to gain an understanding of how the individual is constituted through a focus on the execution of the patient’s and nurse’s role in the joint relationship. The article represents a social-constructionist consideration using Kenneth Gergen’s concept of multi-being. Gergen’s notions of the self as a multi-being focuses on the individual’s relational character through former relationships and social interactions. Gergen’s concept is applied onto (...) nurses and patients as individuals to gain an understanding of the broader institutional and social context of each role and their interactions within the nurse–patient relationship. The article focuses on the nurse–patient relationship in general with regard to specific challenges in the home care setting. Various demands and experiences from a myriad of past relationships merge as potential actions for nurses and patients during the forming of a relationship. Nurses as multi-beings see themselves confronted with guidelines and legal conditions, their own as well as the patients’ expectations and the actual possible forming of a relationship in the light of daily nursing care. Patients as multi-beings experience an extended social environment that comprises the nurse–patient relationship while simultaneously having to cope with illness and increasing care dependency within their own homes. Discrepancies can be observed in the relationship with regard to the inherent human qualities, the demands of forming a relationship, and the actual relationship arising due to framework conditions. Contrary to the assumptions of those who pair Dewey and Piaget based on progressivism's recent history, Dewey shared broader concerns with Vygotsky (whose work he never read). Both Dewey and Vygotsky emphasized the role of cultural forms and meanings in perpetuating higher forms of human thought, whereas Piaget focused on the role played by logical and mathematical reasoning. On the other hand, with Piaget, Dewey emphasized the nurture of independent reasoning central to the liberal Protestant heritage the two men shared. (...) Many patients were surprised or confused by their first visit to Dr. Freud's office. Lying on the famous couch, they found themselves surrounded by a plethora of objects and images they would never have associated with the business of the psychoanalytic cure. Statuettes, masks, and portraits from ancient times were arranged in showcases, on the shelves and on desks within a room whose walls were covered with depictions of mythological scenes and portraits of Freud's mentors . The patient's first impressions (...) of this peculiar display, which has been faithfully preserved by Anna Freud in their last London home at Maresfield Gardens, were frequently strong ones. One of the most articulate of Freud's patients, Hilda Doolittle, herself a lover of antiquities, did not hesitate to tell him how “overwhelmed and upset” she was to find him “surrounded by these treasures, in a museum, a temple.” During her own analysis, a variety of these “toys,” as she called them, seemed to act as replicas or “ghosts” of the figures appearing in her dreams or memories: “We are all haunted houses.”1 · 1. Abstract Many of Boettke's criticisms of formalist economics are justified. However, he defines formalism so broadly that it becomes practically synonymous with mainstream economics, while his criticisms primarily target the sins of formalist economics more narrowly defined. And since he treats Austrian economics as the only viable alternative to mainstream economics, he incorrectly awards victory to Austrian economics. While Austrian economics has some valuable ideas to contribute to mainstream economics, it has serious deficiencies of its own.

Prior studies provide consistent evidence of deficits for psychopaths in processing verbal emotional material but are inconsistent regarding nonverbal emotional material. To examine whether psychopaths exhibit general versus specific deficits in nonverbal emotional processing, 34 psychopaths and 33 nonpsychopaths identified with Hare's (R. D. Hare, 1991) Psychopathy Checklist-Revised were asked to complete a facial affect recognition test. Slides of prototypic facial expressions were presented. Three hypotheses regarding hemispheric lateralization anomalies in psychopaths were also tested (right-hemisphere dysfunction, reduced lateralization, and reversed (...) lateralization). Psychopaths were less accurate than nonpsychopaths at classifying facial affect under conditions promoting reliance on right-hemisphere resources and displayed a specific deficit in classifying disgust. These findings demonstrate that psychopaths exhibit specific deficits in nonverbal emotional processing. (shrink)

These mixed ancestries also come with different social expectations. In the social-political world of Native Studies where I walk daily, my French grandmother, mamere, is argued as coming from a world of privilege because she was white-skinned, and my Cree grandmother, nokum is thought to come (...) from a world of oppression because she was dark-skinned. Yet both my grandmothers experienced abuse and prejudice. How and where the abuses originated may be different, but they did occur. I have a lot to learn from my grandmothers, but it has taken me many years of inner conflict, self-righteousness, and pain to get to this understanding. To acknowledge both grandmothers having been oppressed means I cannot continue to think of the world in simplistic, binary terms of colonizer/colonized. I must legitimize the equality of suffering in both cultures. Indeed, my worldviews had been turned upside down as I began to identify with the feminist movement, nonetheless it is nokum's world that was shattered, demeaned, and distorted, so it is her world I bring to you today with this story. Another day I may talk about my mamere's patriarchal world, but today is for nokum. (shrink)

Technology has expanded genomic research and the complexity of extracted gene-related information. Health-related genomic incidental findings pose new dilemmas for nurse researchers regarding the ethical application of disclosure to participants. Consequently, informed consent specific to incidental findings is recommended. Critical Social Theory is used as a guide in recognition of the changing meaning of informed consent and to serve as a framework to inform nursing of the ethical application of disclosure consent in genomic nursing research practices.

Galileo’s Sunspot Letters, published in 1613, underwent extensive censorship before publication. It seems likely that the Roman Inquisition had charge of the pre-publication review of Galileo’s work, rather than the usual organ, the Master of the Sacred Palace. A study of that process demonstrates that the issue to which the censors objected was Galileo’s use of the bible, not his allegiance to Copernicus. In the course of the first phase of Galileo’s trial, orchestrated by one of the most powerful Cardinal (...) Inquisitors, two propositions allegedly drawn from the book were judged either “formally heretical” or “at least erroneous in the faith.” These judgments might have come not from the published book but from the Inquisition’s censorship of its drafts. Resituating her quotation about “kinship systems” from Judith Butler into Butler's discussion of house mothers in ball culture, it calls attention to the erasure of queer racialized embodiment and intellection from Nelson's account, emblematized by Cherríe Moraga's Medea and – as embodied site of “shit and labor” (...) – the perineum, figuring the work of connection. In light of recent doctrinal changes, we examine the confused state of U.S. insider trading law, identifying gaps that permit certain market participants to trade on the basis of material nonpublic information, and contrast U.S. insider trading doctrine with the European approach. We then explore the ethical implications of the status quo in the U.S., explaining why the dominant legal justifications for prohibiting classical insider trading and misappropriation—the fiduciary duty and property rights theories—fail to account for the wrongfulness of insider (...) trading by eavesdroppers and certain tippees. We refute common arguments for legalizing insider trading, including arguments that insider trading is a victimless crime and that the practice promotes efficiency. We explain why insider trading constitutes the moral wrong of cheating, grounding our theory in the legitimate expectations of market participants. Having considered Kantian deontology in other work, we find that virtue ethics theory offers a helpful albeit rough framework for assessing the morality of insider trading independent of its legality. We also find that social contract theories, with norms of equality of opportunity and moral desert, provide a compelling ethical basis for retaining, clarifying and broadening current legal prohibitions against insider trading. On 26 February 1616 Galileo was ordered to cease to defend heliocentrism in any way whatsoever. This order, called a precept, automatically applied to anything he might later attempt to publish on the subject. Issued at the end of his first trial by the Roman Inquisition, the precept became the spark that triggered his second trial in 1632–3 and figured importantly in the justification of his sentence. This precept has been a subject of controversy since the late nineteenth century for (...) its authenticity, legality and legitimacy. This paper addresses the first two points and establishes the facts of what probably happened in 1616. It does so by examining seven texts that bear on the event. All but one of these agree tolerably well that Galileo did indeed receive the precept in the strongest form. An examination of the singleton text in the context of how the Inquisition produced and kept its records as well as of its procedures and personnel shows that it is the least reliable source. This context also supports the argument that certainty about what happened is impossible to achieve. The theory that the document most damaging to Galileo was a forgery is also disposed of. Examination of the crucial phrase successive ac incontinenti in one of the documents supports the paper's suggestion that more caution is in order before accepting the currently nearly universal claim that the precept was improper in law. This paper argues for a feminist genealogy of anti-nuclear protest art, around the nucleus of the women’s camp at Greenham Common, 1981–87, a coherent account of whose significance is missing from both feminist film history and left protest history. Drawing on Adrienne Rich’s poetics as a thread connecting the larger anti-nuclear and non-violent/anti-military feminist movement specifically to aesthetic and political formations that informed films made at and about Greenham, the paper constellates a number of experimental works in relation to the (...) well-known observational documentary Carry Greenham Home. Their legacy, and the concept of a Greenham genealogy, is apparent in Sally Potter’s anti-nuclear Cuban Missile Crisis-set drama Ginger & Rosa, whose imbrication of poetry, politics, and experimental film techniques argues for a Greenham poetics. In particular, this paper considers a feminist poetics of attending to the nuclear, re-visioning the atomic, molecular and core as both an ecopoetics and a refusal of heteropatriarchal structures, both necessary to a viable alternative political formation. In their granular detailing of both world and work, these feminist texts offer a rich and continuous history, practice and analysis of anti-nuclear protest art that demands the same attention as they enact. Lars Lih’s Lenin Rediscovered seeks to replace the textbook-myth of Leninism with a painstaking reconstruction of ‘Lenin’s Erfurtian drama’. That reconstruction is more accurate than the Lenin-myth, but Lih’s step forward is marred by two steps back. One is his account of Lenin’s ‘worry about workers’. The other is Lih’s new translation of What Is to Be Done?.

We describe and analyze 13 cases handled by our ethics consultation service (ECS) in which families requested continuation of physiological support for loved ones after death by neurological criteria (DNC) had been declared. These ethics consultations took place between 2005 and 2013. Patients’ ages ranged from 14 to 85. Continued mechanical ventilation was the focal intervention sought by all families. The ECS’s advice and recommendations generally promoted “reasonable accommodation” of the requests, balancing compassion for grieving families with other ethical and (...) moral concerns such as stewardship of resources, professional integrity, and moral distress. In cases we characterized as finitegoal accommodation, a “reasonable accommodation” strategy proved effective in balancing stakeholders’ interests and goals, enabling steady progress toward resolution. When a family objected outright to a declaration of DNC and asked for an indefinite accommodation, the “reasonable accommodation” approach offered clinicians little practical direction, and resolution required definitive action by either the family or the clinical team. Based on our analysis and reflections on these 13 cases, we propose ethically justified and practical guidelines to assist healthcare professionals, administrators, and ECSs faced with similar cases.
