Gillian Brock attempts to reconcile cosmopolitanism with nationalism in Global Justice: A Cosmopolitan Account . She claims that her cosmopolitanism leaves room for legitimate nationalism. I argue that her cosmopolitanism is not only a theory of global justice, but also a general theory of justice, according to which what justice may demand of us is fundamentally global in nature. As such, Brock's cosmopolitanism cannot accommodate nationalism in the overall structure of what justice may demand of us, but has to relegate (...) it to the discretionary space left open after what justice may demand of us globally has been met. This does not amount to much of a reconciliation or a particularly moderate cosmopolitanism, contrary to Brock's claim. More important, I argue, Brock's cosmopolitan theory of justice need not follow from the more fundamental view of moral cosmopolitanism. (shrink)

This work offers a timely philosophical analysis of interrelated normative questions concerning immigration and citizenship in relation to the global context of multiple nation states. In it, philosophers and scholars from the social sciences address both fundamental questions in moral and political philosophy as well as specific issues concerning policy. Topics covered in this volume include: the concept and the role of citizenship, the equal rights and representation of citizens, general moral frameworks for addressing immigration issues, the duty to obey (...) immigration law, the use of ethnic, cultural, or linguistic criteria for selective immigration, domestic violence as grounds for political asylum, and our duty to refugees in general. The urgency of the need to discuss these matters is clear. Several humanitarian crises involving human migration across national boundaries stemming from war, economic devastations, gang violence, and violence in ethnic or religious conflicts have unfolded. Political debates concerning immigration and immigrant communities are continuing in many countries, especially during election years. While there have always been migrating human beings, they raise distinctive issues in the modern era because of the political context under which the migrations take place, namely, that of a system of sovereign nation states with rights to control their borders and determine their memberships. In this paper I examine the counterfactual test for legislative intention as used in Riggs v. Palmer. The distinction between the speaker's meaning approach and the constructive interpretation approach to statutory interpretation, as made by Dworkin in Law's Empire, is explained. I argue that Dworkin underestimates the potential of the counterfactual test in making the speaker's meaning approach more plausible. I also argue that Dworkin's reasons for rejecting the counterfactual test, as proposed in Law's Empire, are either too weak or (...) unsound. A deeper reason for rejecting the counterfactual test as a method for the speaker's meaning approach is proposed in this paper. The difference between the counterfactual test and other tests for legislative intention which seem also to make use of counterfactual conditions in explained. (shrink)

This article gives an account of what Ronald Dworkin calls ‘the protestant attitude’ towards law. Dworkin’s protestantist claim that the interpretive attitude towards law is to be taken not only by judges, but also by ordinary citizens is explained and defended. The account of Dworkin’s protestantism about law in this article is not based on his more general protestantist view about the interpretation of social practices, but, rather, on the nature of authoritative statements of the law in Dworkin’s theory of (...) law as integrity. Protestantism is thus shown to be an integral part of the theory of law as integrity. It is also argued in this article that protestantism about law can accommodate the idea that legal deliberation is an authoritative and public process while leaving room for a significant role for citizens in the development of law. This monograph opens with an examination of the aid industry and the claims of leading practitioners that the industry is experiencing a crisis of confidence due to an absence of clear moral guidelines. The college athletics environment within the USA is ethically complex and often controversial. From an academic standpoint, athletes are often viewed as a privileged class receiving undue benefit. Yet closer inspection reveals that student athletes are at risk psychologically, physically, and intellectually in ways that undermine development and flourishing. This reality stands in troubling contrast to the prosocial, virtue-based goals expressed by university mission statements. Given the role of sport in many university business models, college athletics invites scrutiny from a (...) business ethics standpoint. Using a humanistic leadership perspective (Pirson in: Humanistic management: protecting dignity and promoting well-being, Cambridge University Press, Cambridge, 2017), we organize our analysis around three challenges facing the college athletics system: (1) navigating the tension between claiming college athletes are amateurs rather than professionals; (2) defining the ethical edge between winning and winning fairly; and (3) moderating the insatiable drive to win while protecting student athlete well-being. We then articulate three strategies for successfully addressing these challenges: leadership role modeling, putting structural supports in place and holding people accountable. We argue that humanistic leadership and a ‘balanced motivational drive mindset’ (Lawrence and Nohria in: J Bus Ethics 128:383–394, 2002, https://doi.org/10.1007/s10551-014-2090-2 ; Pirson 2017) could help move college athletics from an economistic model toward a more humanistic model that prioritizes the dignity and well-being of its participants, particularly student athletes. In the context of the well-recognized dialogue between faith and film culture, this article considers Ang Lee's award-winning and controversial film, Brokeback Mountain . Against the misinterpretations and ideological rhetoric that coopted the film, it effects a close reading of the narrative, tracing the development of the film's central theme, the constitutive vocation of the human being to give and receive love, an experience touched by human sinfulness and divine grace. After analyzing the film's masterful adaptation of the short story (...) on which it is based, its complex use of metaphorical language and its rich, expressive soundtrack, the article concludes with a consideration of the epilogue of the film as representing a breakthrough of grace and as an expression of the redeeming power of love. In an award-winning essay, Shu-Shan L ee discusses scholarly commentary about obedience to the emperor, focusing on public and hidden records of protest. The thesis of Lee’s essay is that the relationship between authority and subject in imperial Confucianism was built on a conditional obligation of obedience, despite traditional accounts of it as absolute. On his account, the obligation of obedience should be conceived through the rubric of imperial Confucianism as being conditional on fulfillment of reciprocal obligations. As part of (...) my response, I suggest that there is a third way to understand the obligation of obedience through the Confucian lens, which is less transactional than reciprocal obligation, while also providing a plausible alternative to absolute obligation as the correct understanding of imperial Confucian thinking about obedience to the emperor. Nietzsche’s Eternal Return (ER) is interpreted in many ways, including by him. I present it as a hermeneutic device, a way of reading texts, especially those whose influence threatens one’s authorial autonomy and/or are later difficult to take ownership of due to philosophical growth. It returns past texts with new interpretations, similar to the way ER leads one to embrace one’s past without changing anything, which radically changes everything from a resented painful burden into a celebrated enhancement of freedom and (...) power. I show how he could have derived the idea from Schopenhauer, his own embarrassing past, by performing the technique on Schopenhauer. The same attitude toward past texts of recreating them according to one’s present interests and concerns simultaneously releases one’s present texts for future readers to impose their readings onto them, just as Zarathustra tells his followers not to follow him. Heidegger takes the idea up in a far more nuanced account than he is usually given credit for and applies it, among other places, to the history of philosophy. All philosophers say the same as it keeps returning. Derrida then recreates this as iterability, the deconstruction of the no/change dichotomy that Nietzsche began. (shrink)

This paper explains the nature and origin of what I am calling Transgressive Realism, a middle path between realism and anti-realism which tries to combine their strengths while avoiding their weaknesses. Kierkegaard created the position by merging Hegel’s insistence that we must have some kind of contact with anything we can call real (thus rejecting noumena), with Kant’s belief that reality fundamentally exceeds our understanding; human reason should not be the criterion of the real. The result is the idea that (...) our most vivid encounters with reality come in experiences that shatter our categories, the way God’s commandment to kill Isaac irreconcilably clashes with the best understanding of ethics we are capable of. I explain the genesis of this idea, and then show it at work in Heidegger and Levinas’ thought. Understanding this position illuminates important aspects of the history of continental philosophy and offers a new perspective on realism. (shrink)

Harry (bio)Scientists overwhelmingly agree that climate change is anthropogenic, caused by our greenhouse gas emissions.1 Given the evidence that exists, we should be able to convince ourselves to change the everyday behaviors resulting in these emissions. If we hope to save ourselves, other animals, plants, and the environment from a devastating future, then why would we continue to use fossil fuels?The answer here is (...) not an easy one. And yet, the ancient Greek philosopher, Aristotle, provides us with a possible cause. In his most famous work on ethics,2 Aristotle argued that being weak-willed, suffering from what he called, “akrasia,” is the reason we do things that we know we shouldn’t do. It is a condition that results when desire wins over reason. For example, I eat a chocolate bar when I know I should eat a salad because my desire for chocolate wins over what I have reasoned to be best for my health. Simply put, reason might be what distinguishes us from other animals and plants, but it is not always our most powerful faculty. It stands both to experience and to reason, then, that rational decision might not be what is going to get us out of this climate crisis. Then, what is?In this special issue, we hear from five contemporary scholars of the 18th–19th century German philosopher, F.W.J. Schelling, an oft-called “protean thinker” whose prolific, sometimes creative, and diverse works spanned over seventy years. A onetime roommate of Hegel and Hölderlin, Schelling’s works are lesser-known outside specialist circles, and yet one finds that his prescient insights continue to have much to offer. This is especially true vis-à-vis the climate crisis, as Schelling was the first post-Kantian philosopher to take nature seriously. He eschewed the modern, Kantian, and post-Kantian trend to focus on [End Page 1] ipseity, the self, and on what we as humans can rationally know. Instead, he returned to metaphysics and argued for a wholistic conception and experience of life—all life. For Schelling, humans are rational as an expression of nature, rather than as an exception to nature. As John Sallis put it so well as he argued for the Platonic influence in Schelling: “For what Schelling rewrites within the text of modern philosophy is a discourse on nature.”3 Sallis then reminds us that in Schelling’s 1809 text, Philosophical Investigations of the Essence of Human Freedom (“Die Freiheitschrift”), he openly criticizes post-Cartesian philosophy generally for its exclusion of nature; “All modern European philosophy since it began with Descartes has this common defect, that nature does not exist for it and that it lacks a living ground.”4 Schelling’s intention was to resolve the defect, and because of his efforts in this regard, his work has something to say to us about our relationship to the environment.The idea to think about what Schelling can offer us in our current climate crisis is hardly new. In 2014, the North American Schelling Society (NASS), hosted by Bruce Matthews and Bard College, thematized its third international conference on “Schelling in the Anthropocene,” asking scholars to think beyond modern philosophy’s legacy of the human/nature divide and to discuss Schelling’s contribution to the anthropogenic environmental crisis we currently face. Since then, published work on this topic includes: Bruce Matthews’s, “Schelling in the Anthropocene,”5 Christopher Lauer’s, “Confronting the Anthropocene,” 6 and Vincent Lee’s, “Schelling and the Sixth Extinction.”7 Other journals have published special issues on related topics, including McGrath et al. Guided by principles of life history strategy development, this study tested the hypothesis that sexual precocity and violence are influenced by sensitivities to local environmental conditions. Two models of strategy development were compared: The first is based on indirect perception of ecological cues through family disruption and the second is based on both direct and indirect perception of ecological stressors. Results showed a moderate correlation between rates of violence and sexual precocity (r = 0.59). Although a model incorporating direct and (...) indirect effects provided a better fit than one based on family mediation alone, significant improvements were made by linking some ecological factors directly to behavior independently of strategy development. The models support the contention that violence and teenage pregnancy are part of an ecologically determined pattern of strategy development and suggest that while the family unit is critical in affecting behavior, individuals’ direct experiences of the environment are also important. This is a linguistic study of two primary metaphors with the same target-domain concept, “IMPORTANCE IS SIZE” and “IMPORTANCE IS WEIGHT,” in English and Chinese. It is suggested that these two primary metaphors are derived from the OBJECT image schema, abstracted from our embodied, sensorimotor experience, especially our visual and tactile perception, in dealing with physical objects in everyday life. The study focuses on size and weight adjectives in both languages and on linguistic evidence in two areas: their lexicalizations of (...) the importance senses as found in the dictionaries, and their roles in the instantiation of the two primary metaphors in natural discourse as found in the corpora. Our further analysis also shows that the primary metaphors can be manifested without explicit use of size and weight words when relevant conceptual frames in the source, evoked by other words or images, are mapped onto the target domain, thus activating the relevant region of our encyclopedic knowledge and triggering off the primary metaphors in our conceptual system. We also construct a hypothetical mapping scheme for primary metaphors based on the OBJECT image schema, in which OBJECT is mapped onto its target via three of its fundamental dimensions: SIZE, WEIGHT, and SOLIDITY. It is hoped that this mapping scheme will benefit future comparative studies of primary metaphors across languages and cultures in a more systematic way. (shrink)

Given that the benefits of Corporate Political Activity (CPA) are usually granted in the form of favorable industry regulation that benefits all industry participants rather than a single firm, small politically inactive firms are often able to take advantage of the benefits from CPA without investing in them. We argue that the free‐riding problem is context specific. Situations of extreme uncertainty create institutional voids that enable individual firms to more fully appropriate the returns from their CPA. In this paper, we (...) examine the influence that CPA had on the U.S. government’s disbursements of TARP funding in 2008. We find that politically active firms were able to avoid the free‐rider problem by obtaining more instances of TARP funding when compared to firms that were not politically active. In addition to being more likely to receive TARP funds, politically active firms received larger amounts of TARP funding than those firms who were not politically active. (shrink)

Here I wish to report on developments on three fronts concerning ‘religion’ in expanding global debates about the ‘the end of the world’ and ‘the ways we know it’, concerning: the word ‘religion’ itself, as half of the religion-science binary, and its marginalization–or complete absence–in the construction of the modern scholarly disciplines and university departments, and influencing of ‘modern’ culture and politics; proliferating doubts about the positivist epistemology of modern ‘science’; and the growing sense that we are caught up in (...) epochal transitions, in which we are significant actors, and that, far beyond what we can know ‘scientifically’, our responses involve leaps of hope and faith which contribute to tipping the balance among divergent possible futures. Lymphangiogenesis is an important developmental process that is critical to regulation of fluid homeostasis, immune surveillance and response as well as pathogenesis of a number of diseases, among them cancer, inflammation, and heart failure. Specification, formation, and maturation of lymphatic blood vessels involves an interplay between a series of events orchestrated by various transcription factors that determine expression of key genes involved in lymphangiogenesis. These are traditionally thought to be under control of several key growth factors including vascular growth factor‐C (...) (VEGF‐C) and fibroblast growth factors (FGFs). Recent insights into VEGF and FGF signaling point to their role in control of endothelial metabolic processes such as glycolysis and fatty acid oxidation that, in turn, play a major role in regulation of lymphangiogenesis. These advances have significantly increased our understanding of lymphatic biology and opened new therapeutic vistas. This essay is a reflection on the ways we understand East Asia, as well as how East Asia is related to our knowledge construction. In spite of the personal tone, which I use strategically to formulate arguments in a carefully designed narrative flow, the article remains critical throughout and its conclusion is clear: exploration of the essence of East Asian civilization can constitute a meaningful effort to reevaluate and even restructure our current world of knowledge.
