Jedes Tableau der Handlungsmöglichkeiten, so abstrakt es auch abgefaßt sein mag, ist gebunden an Vorstellungen möglicher Handlungssubjekte, denen wir Handlungsmöglichkeiten zuschreiben. Handlungstheorie ist daher notwendig Reflexion unserer Praxis, in der wir uns selbst als Selbstbewußtsein erfahren, das seinem Verhältnisbewubtsein enthoben (...) ist, ohne dieses dadurch selbst schon aufzuheben zu können. Daß uns Freiheit im Handeln unaufhebbar prekär und problematisch bleiben mub, ist die Grundvoraussetzung dafür, dab wir Handlungstheorien historisch und bereichsbezogen ständig neu entwerfen müssen. Although declarations of the death of God seem to be provocations announcing the end of the era of theology, this announcement is actually central to the Christian revelation in its most classic forms, as well as to its reworkings in contemporary religious thought. Indeed provocative new possibilities for thinking theologically open up precisely in the wake of the death of God. Already Hegel envisaged a revolutionary new realization of divinity emerging in and with the secular world through its establishment of (...) a total order of immanence. However, in postmodern times this comprehensive order aspired to by modern secularism implodes or cracks open towards the wholly Other. A hitherto repressed demand for the absolute difference of the religious, or for “transcendence”, returns with a vengeance. This difference is what could not be stated in terms of the Hegelian System, for reasons that poststructuralist writers particularly have insisted on: all representations of God are indeed dead. Yet this does not mean that they cannot still be powerful, but only that they cannot assign God any stable identity. Nietzsche’s sense of foreboding concerning the death of God is coupled with his intimations of the demise of representation and “grammar” as epistemologically bankrupt, but also with his vision of a positive potential for creating value in the wake of this collapse of all linguistically articulated culture. He points the way towards the emergence of a post-secular religious thinking of what exceeds thought and representation. (shrink)

Compassion is an emotion that occupies a central position in Mah?y?na Buddhist philosophy while it is often a neglected subject in contemporary western philosophy. This essay is a comparison between an Eastern view of compassion based upon Mah?y?na Buddhist perspectives and a western view of the same emotion. Certain principles found in Mah?y?na Buddhist philosophy such as the Bodhisattva Ideal, and suffering to name two, are explored for the information they contain about compassion. An essay by Lawrence Blum is taken (...) as representative of a Western view and it is analyzed for its shortcomings in light of the Buddhist view. The conclusion briefly describes the value of understanding an eastern view on compassion as a means of filling the void one finds in western medical ethics discourse which focuses so heavily, and redundantly, upon issues such as patient autonomy and paternalism. The aim of my paper is to compare three alternative formal reconstructions of van Inwagen’s famous argument for incompatibilism. In the first part of my paper, I examine van Inwagen’s own reconstruction within a propositional modal logic. I point out that, due to the expressive limitations of his propositional modal logic, van Inwagen is unable to argue directly (that is, within his formal framework) for incompatibilism. In the second part of my paper, I suggest to reconstruct van Inwagen’s argument within (...) a first-order predicate logic. I show, however, that even though this reconstruction is not susceptible to the same objection, this reconstruction can be shown to be inconsistent (given van Inwagen’s own assumptions). At the end of my paper, I suggest to reconstruct van Inwagen’s argument within a quantified counterfactual logic with propositional quantifiers. I show that within this formal framework van Inwagen would not only be able to argue directly for incompatibilism, he would also be able to argue for crucial assumptions of his argument. (shrink)

Some properties are causally relevant for a certain effect, others are not. In this paper we describe a problem for our understanding of this notion and then offer a solution in terms of the notion of a program explanation.

Many versions of the ontological argument have two shortcomings: First, despite the arguments put forward, for example, by Hugh Chandler and Nathan Salmon, they assume that S5 is the correct modal logic for metaphysical modality. Second, despite the classical arguments put forward, for example, by David Hume and Immanuel Kant or the more recent arguments put forward, for example, by John Findlay and Richard Swinburne, they assume that necessary existence is possible. The aim of the paper is to develop an (...) alternative version of the ontological argument that, by an appeal to the logic of ‘actually’, avoids these two shortcomings. The version helps to leave aside unnecessary debates about the modal logic S5 or about the possibility of necessary existence and to focus on the actual challenge for the debate about the ontological argument: the challenge to evaluate the claim that it is possible that God exists. In the context of discovery-oriented hypothesis testing research, behavioral scientists widely accept a convention for false positive (α) and false negative error rates (β) proposed by Jacob Cohen, who deemed the general relative seriousness of the antecedently accepted α = 0.05 to be matched by β = 0.20. Cohen’s convention not only ignores contexts of hypothesis testing where the more serious error is the β-error. Cohen’s convention also implies for discovery-oriented hypothesis testing research that a statistically significant observed effect is (...) four times more probable to be a mistaken discovery than for a statistically significant true observed effect to be independently replicable. In the long run, Cohen’s convention thus is epistemically harmful to the development of a progressive science of human behavior, making its acceptance crucial in explaining the replication crisis in behavioral science. The balance between α- and β-errors generally ought to be struck using both epistemic and practical considerations. Yet epistemic considerations alone imply that making a genuine contribution to the body of knowledge in behavioral science requires error rates that are not only small but also symmetrical. (shrink)

Peter van Inwagen’s original formulation of the Consequence Argument employed an inference rule that was shown to be invalid given van Inwagen’s interpretation of the modal operators in the Consequence Argument. In response, van Inwagen recently suggested a revised interpretation of his modal operators. Following up on a debate between Blum and Schnieder, I analyze van Inwagen’s revised interpretation in terms of explanatory notions and I argue that van Inwagen faces a dilemma: he either has to admit that beta entails (...) fatalism, or he has to admit that a new counterexample invalidates beta. Either way, it seems reasonable to reject beta and to conclude that the Consequence Argument fails. Further, I argue that Widerker’s well-known substitute for rule beta is faced with a similar dilemma and, therefore, is bound to fail as well. I conclude that, if the modal operators are interpreted in terms of explanatory notions, neither van Inwagen’s nor Widerker’s rule of inference turns out to be valid. (shrink)

This novel contributed volume advances the current debate on free will by bridging the divide between analytic and historically oriented approaches to the problem. With thirteen chapters by leading academics in the field, the volume is divided into three parts: free will and determinism, free will and indeterminism, and free will and moral responsibility. The contributors aim to initiate a philosophical discourse that profits from a combination of the two approaches. On the one hand, the analytic tools familiar from the (...) debate – arguments, concepts, and distinctions – can be used to sharpen our understanding of classical philosophical positions. On the other hand, the rich philosophical tradition can be reconstructed so as to inspire new solutions. In recent years, the problem of free will has received special attention in the analytic arena. In this paper, I try to show that Kripke’s proposed solution to the problem of negative existentials fails. I try to show that Kripke’s proposal fails because it entails that anybody who has good reasons to believe that there are no propositions has also good reasons to believe that he or she does not exist. However, there were philosophers who had good reasons to believe that there are no propositions even though they didn’t have good reasons to believe that they (...) do not exist. I conclude that Kripke’s proposed solution to the problem of negative existentials fails. (shrink)

Twice in the 2020 term, in Bostock and Comcast, the Supreme Court doubled down on the reasoning of “but-for causation” to interpret antidiscrimination statutes. According to this reasoning, an outcome is discriminatory because of some status—say, sex or race—just in case the outcome would not have occurred “but-for” the plaintiff’s status. We think this reasoning embeds profound conceptual errors that render the decisions deeply confused. Furthermore, those conceptual errors tend to limit the reach of antidiscrimination law. In this essay, we (...) first unpack the ambiguity of this but-for causal reasoning. We then show that this reasoning arises from a misapplication of tort law principles within antidiscrimination law, and that, as a result, it is both conceptually and normatively indeterminate. The aim of this paper is to relate the debate about the status of S4 and S5 as modal logics for metaphysical modality to the debate about the identity of propositions. The necessary truth of the characteristic axioms of S4 and S5 (when interpreted in terms of metaphysical modality) is derived from a view about the identity of propositions, the view that necessarily equivalent propositions are identical.

In the consolidated cases Altitude Express v. Zarda, Bostock v. Clayton County, and R.G. & G.R. Harris Funeral Homes v. EEOC, the Supreme Court will decide whether or not Title VII prohibits discrimination on the basis of sexual orientation or gender identity. Although the parties disagree as to the appropriate formulation of a but-for test to determine whether or not there was a discriminatory outcome, all parties do agree to the use of such a test, which asks “whether the evidence (...) shows ‘treatment of a person in a manner which but for that person’s sex would be different.’” City of Los Angeles, Dep’t. of Water and Power v. Manhart, 435 U.S. 702, 711 (1978). However, but-for tests confuse more than they clarify the inquiry; a discriminatory outcome cannot be explained by appeal to just a discrete characteristic of a particular person. Individuals are not discriminated against because of these characteristics per se. Rather, they are discriminated against because of the social meanings and expectations that attach to these characteristics. Beyoncé and Taylor Swift illustrate the difference between individual-level causation and social explanation in two separate songs, “If I Were a Boy” and “The Man.” The explanation for why the counterfactual ‘male’ Beyoncé and Swift are evaluated differently than their current ‘female’ versions does not lie in individual-level features considered apart from the social world, but in social-level roles and expectations associated with those features. For this reason, a social explanation test—one that asks whether the social meanings of sex characteristics, rather than the characteristics per se, explain the outcome in question—is more suitable for determining whether or not Title VII has been violated. This article rebuts Ramsey's earlier theory, in 'Universals of Law and of Fact', of how laws of nature differ from other true generalisations. It argues that our laws are rules we use in judging 'if I meet an F I shall regard it as a G'. This temporal asymmetry is derived from that of cause and effect and used to distinguish what's past as what we can know about without knowing our present intentions.

This paper questions the fairness of our current tort-law regime and the philosophical underpinnings advanced in its defense, a theory known as corrective justice. Fairness requires that the moral equality and responsibility of persons be respected in social interactions and institutions. The concept of luck has been used by many egalitarians as a way of giving content to fairness by differentiating between those benefits and burdens that result from informed choice and those that result from fate or fortune. We argue (...) that the theory of corrective justice, along with its institutional embodiment of tort law, is at odds with an egalitarian commitment to fairness because it allows luck an unjustifiable role in determining dissimilar liability for similar wrongs and dissimilar compensation for similar losses to bodily integrity. Many egalitarian political theorists have also recognized, if not defended, the notion of distinct forms of justice, namely corrective, retributive, and distributive. Although theorists of these different forms of justice have been concerned with negating unfair luck inside the operations of each form of justice, there has been little attention to the way in which luck operates to sort cases into each form of justice. We claim that there is a significant way in which luck operates to subject different people to principles of corrective, retributive, and distributive justicewhich flies in the face of the egalitarian value of fairness. After surveying the arguments put forward by theorists defending a categorical distinction between corrective justice and retributive and distributive principles, we argue that although analytical distinctions can be made between different forms of justice (although, we also suggest that the distinctions are not as sharp as some commentators suggest), there is no good reason to defend an acoustic separation between these forms of justice when doing so creates unfair outcomes. The purpose of this paper is to investigate some problems of using finite (or *finite) computational arguments and of the nonstandard notion of an infinitesimal. We will begin by looking at the canonical example illustrating the distinction between classical and constructive analysis, the Intermediate Value Theorem.

In this paper, I consider the relationship between Inference to the Best Explanation and Bayesianism, both of which are well-known accounts of the nature of scientific inference. In Sect. 2, I give a brief overview of Bayesianism and IBE. In Sect. 3, I argue that IBE in its most prominently defended forms is difficult to reconcile with Bayesianism because not all of the items that feature on popular lists of “explanatory virtues”—by means of which IBE ranks competing explanations—have confirmational import. (...) Rather, some of the items that feature on these lists are “informational virtues”—properties that do not make a hypothesis \ more probable than some competitor \ given evidence E, but that, roughly-speaking, give that hypothesis greater informative content. In Sect. 4, I consider as a response to my argument a recent version of compatibilism which argues that IBE can provide further normative constraints on the objectively correct probability function. I argue that this response does not succeed, owing to the difficulty of defending with any generality such further normative constraints. Lastly, in Sect. 5, I propose that IBE should be regarded, not as a theory of scientific inference, but rather as a theory of when we ought to “accept” H, where the acceptability of H is fixed by the goals of science and concerns whether H is worthy of commitment as research program. In this way, IBE and Bayesianism, as I will show, can be made compatible, and thus the Bayesian and the proponent of IBE can be friends. (shrink)

In this paper, I offer an analysis of the radical disagreement over the adequacy of string theory. The prominence of string theory despite its notorious lack of empirical support is sometimes explained as a troubling case of science gone awry, driven largely by sociological mechanisms such as groupthink (e.g. Smolin 2006). Others, such as Dawid (2013), explain the controversy by positing a methodological revolution of sorts, according to which string theorists have quietly turned to nonempirical methods of theory assessment given (...) the technological inability to directly test the theory. The appropriate response, according to Dawid, is to acknowledge this development and widen the canons of acceptable scientific methods. As I’ll argue, however, the current situation in fundamental physics does not require either of these responses. Rather, as I’ll suggest, much of the controversy stems from a failure to properly distinguish the “context of justification” from the “context of pursuit”. Both those who accuse string theorists of betraying the scientific method and those who advocate an enlarged conception of scientific methodology objectionably conflate epistemic justification with judgements of pursuit-worthiness. Once we get clear about this distinction and about the different norms governing the two contexts, the current situation in fundamental physics becomes much less puzzling. After defending this diagnosis of the controversy, I’ll show how the argument patterns that have been posited by Dawid as constituting an emergent methodological revolution in science are better off if reworked as arguments belonging to the context of pursuit. According to Peter van Inwagen’s arguments for the incompatibility of free will and determinism, nobody is able to do anything about the truth of a complete description of a past state of the world. In my chapter, I do not argue directly against this assumption. Instead, I develop four arguments to the conclusion that van Inwagen’s attempt to justify this assumption fails. I argue that many philosophical views as well as independent arguments all speak against van Inwagen’s attempt to justify (...) this assumption. Besides that, I show that this has a bearing on a famous argument for the incompatibility of free will and divine foreknowledge. (shrink)

We develop a Bayesian framework for thinking about the way evidence about the here and now can bear on hypotheses about the qualitative character of the world as a whole, including hypotheses according to which the total population of the world is infinite. We show how this framework makes sense of the practice cosmologists have recently adopted in their reasoning about such hypotheses.
