This article investigates relationships between countries' legal traditions and their quality of life as measured by a number of widely reported social indicators; in so doing it also offers a critique of a highly influential body of work which is widely cited in the literatures of corporate governance, economics and finance. That body of work has shown, inter alia, statistically significant relationships between legal traditions and various proxies for investor protection. We show statistically significant relationships between legal traditions and various (...) proxies for societal health. Our comparative evidence suggests that the interests of investors are not congruent with the interests of wider society, and that the criteria for judging the effectiveness of approaches to corporate governance should be broadened. If a critique of everyday life is to become a serious undertaking, virtually everything we experience needs to be subjected to careful and critical scrutiny. Even fairy tales. Like so much else in modern culture, these tales may not be as innocuous as they appear. To the extent that the culture industry has appropriated them and uses their motifs to manipulate consciousness or shape behavior, especially in children, fairy tales may be more effective as instruments of social control than one (...) would think. Perhaps for this reason the study of these tales is too important to be left to folklore aficionados or specialists in children's literature. (shrink)

Linguistic data are commonly considered a defeasible source of evidence from which it is legitimate to draw philosophical hypotheses and conclusions. Traditionally epistemologists have relied almost exclusively on linguistic data from western languages, with a primary focus on contemporary English. However, in the last two decades there has been an increasing interest in cross-linguistic studies in epistemology. In this entry, we provide a brief overview of cross-linguistic data discussed by contemporary epistemologists and the philosophical debates they have generated.

Recent trends in psychiatry involve a transition from categorical to dimensional frameworks, in which the boundary between health and pathology is understood as a difference in degree rather than as a difference in kind. A major tenet of dimensional approaches is that no qualitative distinction can be made between health and pathology. As a consequence, these approaches tend to characterize such a threshold as pragmatic or conventional in nature. However, dimensional approaches to psychopathology raise several epistemological and ontological issues. First, (...) we review major sources of evidence usually recruited in support of the dimensional trend (focusing on clinical observation and biological data), and we show that these are connected to different conceptualizations of how dimensional traits extend across health and pathology. Second, we criticize two unquestioned assumptions that stand at the core of the dimensional trend: a) that there is continuity from health to pathology at the symptomatic level; b) that such continuity reflects an underlying continuity in the genetic liability for pathological conditions. Third, we argue against the idea of a conventional threshold by showing that such a view implies a linear relationship between the genotype and the phenotype. Fourth, drawing on epigenetics and developmental biology, we offer a characterization of mental disorders as stable and dynamic constellations of multi-level variables that differ qualitatively from ‘healthy states’. We conclude by showing that our account has several theoretical advantages over both categorical and dimensional approaches. Notably, it provides crucial insights into psychological development over time and individual differences, with major implications in terms of intervention and clinical decision-making. (shrink)

The purpose of our article is to describe the initial development process of the subordinate influence ethics (SIE) measure, an instrument that was crossculturally conceived, designed, and validity tested to measure upward influence ethics strategies of professional subordinates across different societies, as well as within a single society. Development of the SIE began by defining the SIE constructs through theoretical review and empirical (nominal group technique) assessments in Germany, France, Hong Kong, and the U. S. In the present measurement development (...) phase, the SIE has been found to consist of three distinct dimensions: pro-organizational behaviors, self-serving behaviors, and maliciously intended behaviors. The construct validity of the SIE was examined across 4113 subjects from 30 countries. A reduced model of the SIE was developed empirically to represent the "best model" for the three-factor scale. Starting from an analysis of Wittgenstein's reasons for placing all true-seeming sentences about the relation between language and the world in the class of utterances that lack a truth-value and can only communicate in the privileged way, the doctrine of showing is investigated in Wittgenstein's later writings. In contrast to the view that the concept of showing simply disappeared with the abandonment of the picture theory of the sentence it is argued that much of his erarly doctrine of showing survives (...) in Wittgenstein's later philosophy. It is not often that one is graced with a mini-symposium upon reception of an article for publication, and for this I am grateful to Bill Hasker, who had to wait until after his editorship to respond to my provocative piece, and equally grateful to Richard Cross, whom Bill solicited for an assist. Since my piece called for a “radical transformation of standard philosophical strategies,” and Bill addressed that perspectival issue from the outset, while Richard focused on some axial (...) semantic and epistemological contentions, I shall begin with Bill Hasker’s overall puzzlements, proceed to address some issues on which Richard Cross and I seem fated to disagree, and close by addressing the neuralgic point of created freedom, which both Hasker and I find axial to attempting to articulate the creator/creature relation. What gratifies me is the opportunity to interact with such sterling critics, and to try to ascertain whether we can advance a discussion (as Bill Hasker suggests) of issues which no sane human inquirer can ever pretend to “get right.”. Development ethicists from one society may help understand and evaluate social change in another society. After examining several types of such cross-cultural assessments, the author argues that insider-outsider hybrids are the most promising cross-cultural dialogue partners.

This book uses real-life experiences of diverse people to illustrate that, if not understood and addressed, situational minorities at school or work are unlikely to perform at their highest potentials.

The paper addresses the manner in which the theory of Coalescent Argumentation [CA] has been received by the Argumentation Theory community. I begin (section 2) by providing a theoretical overview of the Coalescent model of argumentation as developed by Michael A. Gilbert (1997). I next engage the several objections that have been raised against CA (section 3). I contend that objectors to the Coalescent model are not properly sensitive to the theoretical consequences of the genuinely situated nature of argument. I (...) conclude (section 4) by suggesting that the resolution to the dispute between Gilbert and his objectors hinges on the outcome of several foundational theoretical questions identified over the course of the paper. We discuss four methodological issues regarding cross-cultural judgment studies of facial expressions of emotion involving design, sampling, stimuli, and dependent variables. We use examples of relatively recent studies in this area to highlight and discuss these issues. We contend that careful consideration of these, and other, cross-cultural methodological issues can help researchers minimize methodological errors, and can guide the field to address new and different research questions that can continue to facilitate an evolution in the field’s thinking about (...) the nature of culture, emotion, and facial expressions. Since 2010, the European Journal of Anaesthesiology has required the reporting of five items concerning ethical approval in articles describing human research: ethics committee’s name and address, chairperson’s name, study’s protocol number and approval date. We aimed to assess whether this requirement has helped to identify and to contact the referenced ethics committees. In this cross-sectional study, we analysed articles requiring ethical approval, according to the Swiss federal law for human research and published in the European Journal of Anaesthesiology (...) in 2011. Ethics committees were searched through our institutional Internet access based on information provided in the articles. The last search was performed in November 2015. Numbers of items reported, of ethics committees identified, and of those that confirmed having provided ethical approval are reported. Of 76 articles requiring ethical approval, 74 declared it. Ethics committees’ names and addresses were mentioned in 63/74, protocol numbers in 51/74, approval dates in 48/74, and chairpersons’ names in 45/74. We could identify 44/74 committees; 36/74 answered our inquiry and 24/74 confirmed their role. Thirty-four of 74 articles reported all five items; in 25/34, we were able to identify an ethics committee, 18/34 answered our inquiry, and 15/34 confirmed their role. Forty of 74 articles reported ≤4 items; in 19/40, we were able to identify an ethics committee, 18/40 answered our inquiry, and 9/40 confirmed their role. Reporting five items significantly increased identification of ethics committees and their confirmation of ethical approval. Twelve of 74 ethics committees were unable to confirm their role in approving the study. Even when details concerning ethical approval were reported in these studies of human research, we were unable to identify almost half of the ethics committees concerned. The reporting of five items, compared with reporting ≤4, was associated with facilitated identification of ethics committees, and increased the likelihood that they would be able to confirm the study’s approval. Future research should identify which information facilitates identification of, and contact with, ethics committees. (shrink)

This review should properly be prefaced with two caveats. First, I am not a specialist in the field of human origins. I am not an archaeologist or anthropologist, but a geologist who is generally unfamiliar with the literature covered and reviewed in this book as well as the issues and controversies. Second, I did not read the entire book. This review is based on a reading of the introduction and conclusion while skimming the rest of the text. For those who (...) find it unsettling that a reviewer has not read a book in its entirety, I can only tell you that it is very difficult to find people who are willing to donate the time necessary to read and review long technical books. (I’m still waiting on JSE to find reviewers for books I published in 2010). Anyone who is offended by my failure to peruse this volume from front to back covers may satisfy themselves with one-hundred percent of nothing by stopping their reading at this point. Ancient Ocean Crossings examines the evidence and arguments that human cultures in the Western Hemisphere were influenced by occasional contacts with ocean voyagers before Christopher Columbus arrived in the Americas in 1492. As the author notes, it’s now conceded that Vikings established a few settlements in North America hundreds of years before Columbus, yet these colonies were short-lived and apparently had little to no influence on American Indians. The ocean crossings referred to in the text are hypothetical voyages that may have occurred in the ten thousand years before Europeans first set foot in the Americas. There are some striking and unexplained cultural similarities between native peoples of the Old World and the Americas. These include “technical complexities of weaving and dyeing that are shared between southern Asia and the Central Andean region of South America, “stepped temple pyramids that are oriented to the cardinal directions in both Mesoamerica and Cambodia, and the belief “in both China and Mesoamerica, that raw jade can be discovered in nature owing to ‘exhalations’ coming from the stone” (p. 5). We propose in this paper to focus upon the de-ontological self concept discoverable in Eastern and Western philosophical traditions. In a larger study, we intend to contrast this “no self” paradigm with major pro-ontological formulations of the self concept. These pro-ontological definitions can be divided into three basic types, namely the absolute-universal self, the transcendental-constituting self, and the natural-organic self.

This article discusses the ethical responsibilities that psychology faculty have when psychological information is seriously misrepresented or psychological techniques are misued by nonpsychology faculty. General values derived from the American Psychological Association's (APA) ethical principles are identified and reviewed. The APA ethical code recommends that psychologists limit the misrepresentation of psychological information and protect students from the misuse of psychological techniques. Examples from my experience are presented to illustrate these ethical principles and responsibilities.

This paper explores the topic of military ethics, what we mean by that term, what it covers, how it is understood, and how it is taught. It suggests that the unifying factor that makes this a coherent subject beyond individual national interpretations of it is the core idea of military professionalism. The paper draws out the distinction between training and education and draws on research conducted by a number of different people and agencies, including the International Committee of the Red (...) Cross, to establish what factors contribute to effective pedagogy and the inculcation of appropriate attitudes and behaviours. The paper concludes by looking at the way military ethics contributes to military outcomes from protecting civilians and the vulnerable to building resilience in our own military personnel to protect their mental health, through to the strategic costs of losing the moral high ground if behaviour is seen to fall short of that expected from military professionals. This is an intellectual autobiography that aims to explain how I am both an analytic philosopher who writes on questions of moral relativism and pluralism and also on classical Confucianism and Daoism. I have written on the subjects of moral psychology and moral epistemology, articulating what I see to be a fruitful consilience between insights of both Confucian and Daoist thinkers and some of the latest findings in psychology and neuroscience. I regard as synergistic and completely logical this combination of (...) interests, but many find it surprising, so I identify the experiences and influences that brought me to where I am now. Creativity is intrinsic to Humanities and STEM disciplines. In the activities of artists and engineers, for example, an attempt is made to bring something new into the world through counterfactual thinking. However, creativity in these disciplines is distinguished by differences in motivations and constraints. For example, engineers typically direct their creativity toward building solutions to practical problems, whereas the outcomes of artistic creativity, which are largely useless to practical purposes, aspire to enrich the world aesthetically and conceptually. In this essay, (...) an artist (DHS) and a roboticist (GS) engage in a cross-disciplinary conceptual analysis of the creative problem of artificial consciousness in a robot, expressing the counterfactual thinking necessitated by the problem, as well as disciplinary differences in motivations, constraints, and applications. We especially deal with the question of why one would build an artificial consciousness and we consider how an illusionist theory of consciousness alters prominent ethical debates on synthetic consciousness. We discuss theories of consciousness and their applicability to synthetic consciousness. We discuss practical approaches to implementing artificial consciousness in a robot and conclude by considering the role of creativity in the project of developing an artificial consciousness. The notion of sound symbolism receives increasing interest in psycholinguistics. Recent research – including empirical effects of affective phonological iconicity on language processing (Adelman et al., 2018; Conrad et al., 2022) – suggested language codes affective meaning at a basic phonological level using specific phonemes as sublexical markers of emotion. Here, in a series of 8 rating-experiments, we investigate the sensitivity of language users to assumed affectively-iconic systematic distribution patterns of phonemes across the German vocabulary:After computing sublexical-affective-values (SAV) concerning valence (...) and arousal for the entire German phoneme inventory according to occurrences of syllabic onsets, nuclei and codas in a large-scale affective normative lexical database, we constructed pseudoword material differing in SAV to test for subjective affective impressions.Results support affective iconicity as affective ratings mirrored sound-to-meaning correspondences in the lexical database. Varying SAV of otherwise semantically meaningless pseudowords altered affective impressions: Higher arousal was consistently assigned to pseudowords made of syllabic constituents more often used in high-arousal words – contrasted by less straightforward effects of valence SAV. Further disentangling specific differential effects of the two highly-related affective dimensions valence and arousal, our data clearly suggest arousal, rather than valence, as the relevant dimension driving affective iconicity effects.
