Situations in which patients lack medical decision-making (MDM) capacity raise ethical challenges, especially when the patients decline care that their surrogate decision makers and/or clinicians agree is indicated. These patients are a vulnerable population and should receive treatment that is the standard of care, in line with their the values of their authentic self, just as any other patient would. But forcing treatment on patients who refuse it, even though they lack capacity, carries medical and psychological risks to the patients (...) and the hospital staff. It is also often impractical to force some treatments, especially in the long term. For example, independent of the ethical “should” question, how would one force hemodialysis for the rest of a patient’s life, or force a surgery that requires weeks of post-operative physical therapy? In this article we present a novel algorithm that can help clinicians with ethical and practical decision making, with the goals of achieving the best outcomes for patients and reducing moral distress for their caretakers and clinicians. Early in the COVID-19 pandemic in the United States, concern that there could be a shortage of ventilators raised the possibility of rationing care. Denying patients life-saving care captures our moral imagination, prompting the demand for a defensible framework of ethical principles for determining who will live and who will die. Behind the moral dilemma posed by the shortage of a particular medical good lies a broad moral geography encompassing important and often unarticulated societal values, as well as assumptions about (...) the nature and purpose of health care and the consequences of long-standing choices about health care as a social good. This article explores what COVID-19 has exposed concerning values and choices around health care in the United States. Employing the lens of Catholic Social Thought, it argues for an approach to rationing that is grounded in respect for human dignity, committed to distributing social goods in light of the common good, and self-conscious about the construction of vulnerability to illness and death. The introduction of Dewey's masterwork through academic, institutional, or political avenues has influenced its reception within contemporary educational scenarios; these avenues need to be taken into account when analyzing the book's reception as well as its impact on the (...) reconstruction of educational discourse. Jeffrey Bishop’s The Anticipatory Corpse exposes a functional metaphysics at the root of contemporary medical practice that gives rise to inhumane medicine, especially at the end of life. His critique of medicine argues for alternative spaces and practices in which the communal significance of the body, its telos, can be restored and the meaning of a “good death” enriched. This essay develops an alternative epistemology of the body, drawing from Christian theological accounts of the communal or Eucharistic body and linking (...) liturgical practices to the cultivation of solidarity. It argues for an epistemology of the body that makes visible the invisible bodies at medicine’s margins and illumines the disparate worlds of health care globally. (shrink)

The almost simultaneous and overlapping discoveries of Mendel's forgotten work by Hugo de Vries, Carl Correns, and Erik von Tschermak gave rise to an intense rivalry, some jealousy, and more than a little illfeeling. De Vries, the first to announce the discovery, has been subjected to the charge that he wished to conceal his discovery and to obtain for himself the credit for having discovered what we now call Mendelism. This charge involves the statement that de Vries gave credit to (...) Mendel only after he had found that others had also read Mendel's papers. The evidence on which this charge is based is sketchy, and we can now show that at least that portion of it that is based on supposed alteration in the proof of de Vries' paper in the Berichte is without foundation. Unfortunately, de Vries gave three different accounts of how he was led to Mendel's work. Two of these involve Liberty Hyde Bailey.Bailey had listed Mendel's papers in a bibliography that he published in 1892 in The Rural Library. Bailey did not include this bibliography in the first edition (1895) of Plant Breeding or in its reprinting in 1896 and 1897. He did include the bibliography in the second edition (1902), but this was after de Vries and others had called attention to Mendel. In 1899, both Bailey and de Vries gave papers at the Hybrid Conference held at Chiswick, England, but we have no record of their having discussed Mendel. What evidence we have indicates that, at this time, neither of them had read Mendel's papers.De Vries wrote to Bailey that it was Bailey's listing of Mendel in the bibliography published in The Rural Library that led to his discovery of Mendel. Later, de Vries wrote to H. F. Roberts that he had first found a reference to Mendel in Bailey's Plant Breeding of 1895, where the bibliographic reference to Mendel's papers was not published. Finally, de Vries told Th. J. Stomps, who succeeded him at the University of Amsterdam, that he had first learned of Mendel early in 1900 from a reprint of Mendel's paper sent him by his friend Professor M. W. Beyerinck. Our present evidence favors Stomp's account as it shows that de Vries had not read Mendel's papers in 1899 but had early in 1900.Attempts to pinpoint de Vries' discovery of Mendel are aided in part, and in part confused, by the fact that he published five relevant papers in 1900. These papers were in press simultaneously, and some of them were altered in proof. Further confusion is due to the fact that at least three of them were published in the reverse order of their acceptance for publication. The paper is not dated by de Vries but it was published in the volume, 128 pages ahead of a paper de Vries dated 19 March. In a footnote, de Vries cites a paper by Correns that was published on 25 January, so we can tell that it was written or corrected in proof after this date. Here Correns showed de Vries that he had already read Mendel's paper. Any attempt by de Vries to ignore Mendel or get credit for Mendelism after 25 January would have been senseless. This date was nearly two months before de Vries' Berichte paper was submitted for publication.Ber. deut. botan. Ges. 18: 83–90. Accepted for publication 14 march, published 25 April. This paper gives Mendel full credit and stimulated the publications of Correns and von Tschermak. Bortolotti argues that the irrationality of many delusions is no different in kind from the irrationality that marks many non-pathological states typically treated as beliefs. She takes this to secure the doxastic status of those delusions. Bortolotti’s approach has many benefits. For example, it accounts for the fact that we can often make some sense of what deluded subjects are up to, and helps explain why some deluded subjects are helped by cognitive behavioral therapy. But there is an alternative approach (...) that secures the same benefits as Bortolotti’s account while bringing additional benefits. The alternative approach treats both many delusions and many of the non-pathological states to which Bortolotti compares them as in-between states. Subjects in in-between states don’t fully believe the beliefs which it is sometimes convenient to ascribe to them. This alternative approach to belief and belief-ascription fits well with an independently attractive account of the varied purposes of our ordinary attitude ascriptions. The U.S. scientific community has long led the world in research on such areas as public health, environmental science, and issues affecting quality of life. These scientists have produced landmark studies on the dangers of DDT, tobacco smoke, acid rain, and global warming. But at the same time, a small yet potent subset of this community leads the world in vehement denial of these dangers. -/- Merchants of Doubt tells the story of how a loose-knit group of high-level scientists and (...) scientific advisers, with deep connections in politics and industry, ran effective campaigns to mislead the public and deny well-established scientific knowledge over four decades. Remarkably, the same individuals surface repeatedly-some of the same figures who have claimed that the science of global warming is "not settled" denied the truth of studies linking smoking to lung cancer, coal smoke to acid rain, and CFCs to the ozone hole. "Doubt is our product," wrote one tobacco executive. These "experts" supplied it. -/- Naomi Oreskes and Erik M. The imperviousness of delusions to counter-evidence makes it tempting to classify them as imaginings. Bayne and Pacherie argue that adopting a dispositional account of belief can secure the doxastic status of delusions. But dispositionalism can only secure genuinely doxastic status for mental states by giving folk-psychological norms a significant role in the individuation of attitudes. When such norms individuate belief, deluded subjects will not count as believing their delusions. In general, dispositionalism won't confer genuinely doxastic status more often than do (...) competing accounts of belief. (shrink)

Starting from an emblematic episode described by Rorty in Trotsky and the Wild Orchids, which is an effective narrative example of making public a private experience, the article provides an inquiry into Rorty’s thinking around education, with a particular focus on his notions of contingency and luck.In particular, the article offers an analysis of Rorty’s frequent use of the term “luck,” in accordance with a literary (non-philosophical) method, which informs his understanding of the role and function of education and his (...) view of the educational process. The use of a literary method is useful to give shape and meaning to the contingency of human experience, creating a narrative thread to connect the past and present and make meaning of the present through the images of the past. Within this framework, Rorty understands “luck” as a specific and crucial condition that highlights the presence of an undetermined space within which education can make a difference in individual life. Our behavior doesn't always match the beliefs attributed to us, and sometimes the mismatch raises questions about what our beliefs actually are. I compare two approaches to such cases, and argue in favor of the one which allows some belief-attributions to lack a determinate truth-value. That approach avoids an inappropriate assumption about cognitive activity: namely, that whenever we fail in performing one cognitive activity, there is a distinct cognitive activity at which we succeed. The indeterminacy-allowing approach also meshes well with (...) an attractive view of folk-psychology: that ascriptions can help shape the attitudes they report. (shrink)

From a feminist perspective, unlimited procreative liberty risks treating children as property, distorts understanding of the family, and neglects moral concerns about how we reproduce.

We can increase our understanding of expression by considering an analogy to demonstrative reference. The connections between a demonstrative phrase and its referent, in a case of fully successful communication with that phrase, are analogous to the connections between an expressible state and the behavior that expresses it. The connections in each case serve to maintain a certain status for the connected elements: as actions of persons; or as objects, events, or states significant to persons. The analogy to demonstrative reference (...) helps show that a positive account of expression can make conceptual connections between expressed states and expressive behaviors without courting reductive behaviorism. A general account of expression as marked by these connections is compared to accounts of expression offered by Dorit Bar-On and Mitchell Green. Bar-On’s account turns out to be compatible with the account proposed here, once some of its consequences are fully appreciated. Green’s account rules out, as not expressive, some behaviors like crouching (in fear) that intuitively seem expressive. When Green’s account is altered to allow such behaviors back in, the resulting account also fits the one proposed. (shrink)

Conversations with patients and families about the allow-natural-death (AND) order, along with the standard do-not-resuscitate (DNR) order during end-of-life (EOL) decision-making, may create engagement and understanding while promoting care that can be defended using enduring notions of autonomy, beneficence, and professional duty. Ethical, legal, and pragmatic issues surrounding EOL care decision-making seem to suggest discussion of AND orders as one strategy clinicians could consider at the individual practice level and at institutional levels. A discussion of AND orders, along with traditional (...) DNR orders is presented. I challenge my students to know and understand what they believe about themselves and others, what they value and why. I encourage them to really reflect and be very honest with themselves about their worldview and what influences has shaped this worldview, their faith, beliefs and values. I explain that it is important for them to know themselves before they can help others. Thomas Paine was a hugely influential revolutionary pamphleteer, whose writings were instrumental in bringing about some of the greatest political changes the world has seen. Paine's enduring importance lies not so much in the depth of his political philosophy as in his great abilities as a communicator of political ideas. Conway's Writingswas the first complete critical collection of Paine's works, and his Lifewas the first account to show Paine in a positive light.

When a wrongdoing occurs, victims, barring special circumstance, can aptly forgive their wrongdoers, receive apologies, and be paid reparations. It is also uncontroversial, in the usual circumstances, that wronged parties can aptly blame their wrongdoer. But controversy arises when we consider blame from third-parties after the victim has forgiven. At times it seems that wronged parties can make blame inapt through forgiveness. If third parties blame anyway, it often appears the victim is justified in protesting. “But I forgave him!” In (...) other cases, however, forgiveness seems irrelevant: B can forgive A, but it can still seem that third parties can aptly blame A for the wrong against B. This perplexity adds a dimension to ongoing discussion regarding criteria for apt blame and the related issues of standing and fittingness. This paper explores the status of third party blame after forgiveness. I argue that while post forgiveness blame is often inapt, in many other cases forgiveness is irrelevant. This difference is explained by appeal to the various relationships third parties might have to wronged parties, and how these differences affect the ways we blame and thereby blame’s aptness. A necessary criterion of Duncan Pritchard’s Anti-luck Virtue Epistemology is his safety condition. A believer cannot know p unless her belief is safe. Her belief is safe only if p could not have easily been false. But “easily” is not to be understood probabilistically. The chance that p is false might be extremely low and yet p remains unsafe. This is what happens, Pritchard argues, in lottery examples and explains why knowledge is not a function of the probabilistic strength of (...) one’s evidence. This paper argues that, contra Pritchard, modality holds no epistemic advantage over this type of “probabilistic evidentialism” that he criticizes. I begin with a review of Pritchard’s argument supporting modality over probability; second, I explain the problems with this argument, and third, I offer an alternative explanation of the lottery example. At the completion of the paper, modality and probability are on equal epistemic footing. (shrink)

This essay situates Jon Stewart’s Hegel’s Interpretation of the Religions of the World and Hegel’s Lectures on the Philosophy of Religion in the genre of philo­sophical anthropology, wherein corresponding conceptions of the human and the divine are studied in tandem and the reciprocal relationship between them is revealed. In this context, the essay shows how Hegel’s interpretation of religion—viz. as a trans-cultural vehicle of human maturation—can make a significant contribution to our thinking about globalization, the pursuit of reciprocal recognition, and (...) the future of Christianity. I conclude my essay by demonstrating that Stewart’s interpretation positions us to understand that Hegel not only accommodates, but also authorizes, the articulations of religious exemplarity advanced by two of his greatest critics: Søren Kierkegaard and Friedrich Nietzsche. According to Donald Davidson, any philosophy of mind that appeals to propositional content is doomed to become an account of the mind as a private theater. But Davidson's own work on thought‐attribution can be used to make propositional content safe. This paper uses Davidson's negative reaction to Gareth Evans's works on perceptually based demonstrative thought to tease out a way of talking about propositional content that doesn't slide into subjectivism. It also explains why Davidson saw Evans as a mentalist enemy (...) rather than an externalist ally, and suggests that Evans's work could play an important role in furthering Davidson's distinctive externalism. One of the most neglected aspects of Bentham's thought is his opposition to war. His views on this subject have been sketched out in a number of studies, but they have never been examined in any detail. Interested scholars have tended to base their assessments on a narrow range of sources. Most have relied on the four brief essays, collectively entitled ‘Principles of International Law’, which were published in John Bowring's edition of Bentham's Works. More particularly, they have leaned heavily (...) on just one of these essays, ‘A Plan for an Universal and Perpetual Peace’. The aim of this paper is to present a much fuller picture of Bentham's views by supplementing relevant material in the international law essays with ideas drawn from Bentham's other works and unpublished papers. This paper explores how Islam is understood by Muslim women entrepreneurs and considers its influence on their entrepreneurial experiences in the country-specific context of Lebanon. In so doing, we adopt a qualitative interpretative approach, drawing upon 21 in-depth, semi-structured interviews with women entrepreneurs. Accordingly, we present empirical evidence detailing how Muslim women entrepreneurs utilise various aspects and teachings of Islam to make sense of their entrepreneurial decisions. We thus provide insight into how women’s entrepreneurship interlocks with Islamic teachings and the (...) restrictions imposed by patriarchal socio-cultural values in Lebanon. This paper advances entrepreneurship research by demonstrating how Islam unfolds as a source of inspiration and resilience for women entrepreneurs, if and when equipped with an Islamic feminist interpretation. Celebrando os quarenta anos de A Hermenêutica do Sujeito — o curso ministrado por Michel Foucault no Collège de France, em 1982 —, este texto propõe-se a estabelecer conexões, gerais e específicas, entre aquele curso e a Educação. É feita uma discussão acerca da perspectiva analítica não metafísica adotada por Foucault, em contraste com o atual discurso pedagógico interpretativo dominante. São discutidos os sentidos que se pode dar a alguns insights daquele curso, em suas relações com a Educação contemporânea. Propondo-se (...) uma diferenciação entre pedagogia e Pedagogia, destaca-se a função subjetivante das práticas pedagógicas na educação escolarizada. Argumenta-se em favor da ontologia histórica, em oposição à ontologia transcendental e recorre-se ao conceito de frame, de modo a ressaltar sua importância e limitações em estudos como este. Discute-se a inversão moderna que colocou ênfase no preceito do “conhece-te a ti mesmo” (gnôthi seautón), deixando em segundo plano o preceito do “cuida de ti mesmo” (epiméleia heautoû), do que resultou a substituição do ideal antigo do sujeito das ações corretas pelo ideal moderno do sujeito dos saberes verdadeiros. Weaves: between Hermeneutics of the Subject and Education Abstract: Celebrating the forty years of The Hermeneutics of the Subject —the course by Michel Foucault at the Collège de France, in 1982—, this text proposes to establish connections, both general and specific, between that course and Education. A discussion is made about the non-metaphysical analytical perspective adopted by Foucault, in contrast to current dominant interpretive pedagogical discourses. The meanings that can be given to some insights from that course are discussed, in their relations with education. Proposing a differentiation between pedagogy and Pedagogy, the subjectivizing function of pedagogical practices in schools is highlighted. We argue in favor of historical ontology, as opposed to transcendental ontology, and we resort to the concept of frame, in order to emphasize its importance and limitations in foucauldian studies. We discuss the modern inversion that placed emphasis on the precept “know thyself” (gnôthi seautón), leaving in the background the precept “take care of yourself” (epiméleia heautoû), which resulted in the replacement of the ideal of the subject of correct actions by the modern ideal of the subject of true knowledge. We suggest that Education can contribute to suspend the announced death of the subject or, at least, mitigate its effects. Keywords: Foucault; Subjectivizing; Pedagogy; Historical ontology. Tesituras: entre la Hermenéutica del Sujeto y la Educación Resumen: Celebrando los cuarenta años de La Hermenéutica del Sujeto —curso por Michel Foucault en el Collège de France, en 1982—, este texto se propone establecer conexiones generales y específicas, entre ese curso y la Educación. Se discute la perspectiva no-metafísica adoptada por Foucault, en contraste con el actual discurso pedagógico interpretativo dominante. Se problematizan los sentidos que se pueden dar a algunos insigths de aquel curso, en sus relaciones con la educación contemporánea. Se propone una diferenciación entre pedagogía y Pedagogía y se destaca la función de subjetivación de las prácticas pedagógicas en las escuelas. Se argumenta a favor de la ontología histórica, en oposición a la ontología transcendental, y se recurre al concepto de frame, para enfatizar su importancia y limitaciones en estudios foucaultianos. Se discute la idea moderna que puso énfasis en el precepto de “conócete a ti mismo” (gnôthi seautón), dejando en segundo plano el “cuida de ti mismo” (epiméleia heautoû), lo que derivó en la sustitución del ideal antiguo del sujeto de las acciones correctas, por el ideal moderno del sujeto del conocimiento verdadero. Se sugiere que la Educación puede contribuir a suspender la anunciada muerte del sujeto o, al menos, mitigar sus efectos. Palabras clave: Foucault; Subjetivación; Pedagogia; Ontologia histórica. John Lewis and Thomas Aquinas may seem like an unusual pairing for an essay. The first was a modern American congressman and civil rights activist, and the second was a priest, philosopher, and theologian from medieval Italy. Differences notwithstanding, their worldviews share a remarkable degree of overlap. This paper explores how each of these figures describes the development of right judgment and thus serves modern audiences seeking to understand how reason, emotion, and virtue operate in moral decision-making. Bringing them together, (...) the author examines methods for rightly developing practical moral knowledge. Lewis’s political influence is studied theologically for how social formation, individual agency, and collective action function in perceiving and implementing natural law. Aquinas provides a theoretical framework for comprehending these concepts, by first defining synderesis and conscience, then discussing ways of knowing natural law, and, finally, explaining the virtue of prudence. This text focuses on the idea that philosophical inquiry can be understood as a practice for social development as far as a real social development requires a qualitative change in the way society carries out its activities, such as through more progressive and more reflective attitudes and behavior by the population, the adoption of more democratic and participative social forms of organization, the use of more advanced technology, and the dissemination and circulation of more advanced forms of knowledge. Philosophical inquiry (...) is, indeed, a powerful means of spreading intelligence in all the contexts of associated life; since it enhances human intellectual potential through sound reflection both on human experiences as well as on the beliefs, understandings, values which frame and give meaning to these experiences. This practice requires and promotes contexts of shared meanings as well as contexts of social development, aiming at: clarification of ideas; construction of new meanings; and development of new interpretative perspectives of reality. In these terms it can be acknowledged as a social development device for the construction of new ideas and the transformation and emancipation of individuals and social groups as it introduces and enhances reflection in different fields of associated living. The outcomes of philosophical inquiry are, by consequence, new ideas, values, and actions that can make for a new sense of, and construct a new understanding of human experience, indicating new developmental directions to human societies.
