The increasing use of online simulations as replacements for animal dissection in the classroom or lab raises important questions about the nature of simulation itself and its relationship to embodied educational experience. This paper addresses these questions first by presenting a comparative hermeneutic-phenomenological investigation of online and offline dissection. It then interprets the results of this study in terms of Borgmann’s (1992) notion of the intentional “transparency” and “pliability” of simulated hyperreality. It makes the case that it is precisely encumbrance (...) and disruption—elements that are by definition excluded from simulations and interfaces—which give dissection its educational value. (shrink)

A culturally influential sub-discipline within literary studies, literary theory has developed in parallel form in other arts and social science disciplines, so that one might refer to "cultural theory" or "social theory" as well, or even just to "theory." It's as familiar as the word "postmodern" and as tricky as "deconstruction." What is it about? What is at stake? Theory is about rationality. This book's title invites two different interpretations of what it might mean to say so. For many, the (...) essence of literary theory is the unmasking and redescription of rationality in other terms. Put ironically, rationality is male; rationality is white; rationality is repression.... The book's title, however, can also be read in a second way. On this reading, rationality itself is the essence of literary theory and central to literature, art, and society. Certain conceptions of what it entails can be problematic; the critique in the first way of reading the title remains relevant. Yet one can affirm rationality as integral to human flourishing, including the processes of producing, analyzing, and enjoying literature, art, and culture. This paper argues that the principles of spiritual traditions provide normative ‘standards of goodness’ within which practitioners evaluate meaningful work. Our comparative study of practitioners in the Buddhist and Quaker traditions provide a fine-grained analysis to illuminate, that meaningfulness is deeply connected to particular tradition-specific philosophical and theological ideas. In the Buddhist tradition, meaningfulness is temporal and rooted in Buddhist principles of non-attachment, impermanence and depending-arising, whereas in the Quaker tradition, the Quaker testimonies and theological ideas frame meaningfulness as eternal. Surprisingly, we find that when faced with unethical choices and clashes between organizational normativity and spiritual normativity, Buddhist practitioners acknowledge the temporal character of meaningfulness and compromise their moral values, whereas in contrast, Quaker practitioners morally disengage from meaningless work. Our study highlights how normative commitments in different spiritual traditions can influence different levels of adaptability in finding work meaningful and stresses the central importance of normative commitments in meaningful work. Our study concludes with practical implications and future pathways for inter-disciplinary research. (shrink)

Metaethical expressivism is typically characterised as the view that normative statements express desire-like attitudes instead of beliefs. However, in this paper I argue that expressivists should claim that normative statements express beliefs in normative propositions, and not merely in some deflationary sense but in a theoretically robust sense explicated by a theory of propositional attitudes. I first argue that this can be achieved by combining an interpretationist understanding of belief with a nonfactualist view of normative belief content. This results in (...) a view I call ‘interpretative expressivism’. I then argue that traditional arguments employed by expressivists that normative statements express noncognitive attitudes can just as well support the claim that normative statements express nonfactual or nonrepresentational beliefs. Finally, I argue that this view has a number of advantages to versions of expressivism that deny that normative statements express non-deflationary normative beliefs. (shrink)

This essay critiques or engages a wide range of existing works on the ancient and well-contested issue of weakness of will, from a new perspective of comparative philosophy combined with a focus on a largely neglected Davidsonian paradox of irrationality. It aims at revealing the interplay between the descriptive and the normative in the very notion of critical interpretation, as well as a special relation between holding-true and making-true which helps to explain the non-accidentalness of the descriptive coat of (...) the Plato Principle and some of the Mencian paradigmatic tenets. By the same token, it also sheds light on some holistic picture about a certain implicit type of dynamic normativity, which seems evidently applicable to, for example, the Mencius-Xunzi 荀子 dispute on human nature, but scarcely noticed or articulated in contemporary contexts of comparative philosophy. In this article, I ask whether Korsgaard’s ethics can be reconciled with a hermeneutic understanding of the human subject. Hermeneutics, inspired by Nietzsche, has traditionally been skeptical about the notion that moral principles have authority over us. But Korsgaard’s account of normativity as grounded in self-consciousness and its reflective distance from beliefs and desires is strikingly similar to Gadamer’s description of human beings as distant and ‘free’ from their environment. The question hermeneutics poses to deontology is how a finite subject (...) can be bound unconditionally by principles, when our understanding of them is always historically mediated and partial. I argue that Gadamer’s notion of the subject matter of understanding (the Sache) allows us to see that we understand our principles as interpretations of fully determined principles. What binds us is the principle that we are always revising our way toward, but whose content we never completely determine. (shrink)

The penetration process of structures traditionally assigned to civil law into administrative law, especially administrative law aiming environmental protection, has been more noticeable through recent years. This process resulted in deepening the absence of a clear separation of private law norms from public law norms. It led to the existence of so-called quasi civil solutions, which can be found for example in the Act on prevention from damages in environment and its repair. Their specificity consists in the fact that they (...) cannot be regarded as civil law structures due to the differences between them and the civil law structures. This legal status sets new challenges for legal theorists as well as practition- ers. They concentrate on interpretation of administrative law provisions which were penetrated by civil law structures, taking into account differences between interpretation of administrative and civil law provisions. We should not reject specific character of the civil law provisions’ interpretation and interpret these provisions only by taking into account specificity of administrative law inter- pretation. Civil law institutions are characterized by a larger field for action, which is left for parties or performers, in comparison to the institutions of ad- ministrative law. This specificity of civil law structures should be considered as its advantage that should not be removed in the activities of public authorities. (shrink)

This essay is devoted to the study of useful ways of thinking about the nature of interpretation, with particular attention being given to the so called normative character of mental explanation. My aim of illuminating the nature of interpretation will be accomplished by examining several views, some of which are common to both Donald Davidson and Daniel Dennett, concerning its unique characteristics as a method of prediction and explanation. Moreover, some of the views held by Davidson and Dennett (...) will be adopted, elaborated, and defended. The conclusions of these philosophers do not, however, form an acceptable whole. Thus I will attempt to moderate some of their views. In particular, I will attempt to show up the deficits of Davidson's view of the mental by defending the possibility some sort of psycho-physical reduction. Despite such philosophical pretensions, major parts of this essay will be devoted to sketching the foundations of a method for the interpretation of intentional behaviour which I take to embody the key features of our ordinary practice of interpretation. In particular, I will attempt to sketch the bases for a method of interpretation which is sensitive to the methodological considerations associated with the seemingly unique normative character of mental explanation. To this end, I will also investigate the question of how certain formal measures of coherence can be made to yield models for understanding the actual and possible bases of interpretation. (shrink)

Official documents, such as the Word Anti-Doping Code (WADC), argue that sport can be deemed a homogenous and unitary concept. Even where different sports have varying characteristics, the homogenous view of a given sport (‘a sport’ or ‘the sport’) persists. The WADC, international and national sport associations aim to protect the spirit of (the) sport. In this picture, the intersection of sporting integrity and legal processes occupies a vital place. The article will posit that, from a legal perspective sport is (...) heterogeneous due to its governance, regulation, adjudication, and enforcement structures. International and national associations, such as sport federations and leagues, have separate normative orders. These normative orders lead to differences in ensuring sporting integrity. A plural normative environment is inherent in sport; thus, we need to deal with it. The article will conclude that although harmonising norms and interpretations related to sporting integrity through national and global institutions may be acceptable, these must be achieved by promoting good governance and human rights. Naturalistic Descriptions and Normative-Intentional Interpretations Normative pragmatists about linguistic meaning such as Sellars and Brandom have to explain how norms can be implicit in practices described in purely naturalistic terms. The explanation of implicit norms usually offered in the literature commits pragmatists to equate actions with naturalistic events. Since this is an unacceptable consequence, I propose an alternative explanation of implicit norms that avoids this identification. To do so, one has to treat the normative-intentional concepts such as "norm", "action", (...) "sanction", "belief", "desire" as a holistic system, in the sense that one has to apply all of them to a given naturalistic practice simultaneously. This result might be taken to imply that the pragmatist strategy of explaining the content of assertions and beliefs in terms of norm-governed use is misguided because it presupposes that one can account for the concept "norm" independently of the concept "belief". I argue that this consequence does not follow. (shrink)

In this article I consider the normative and axiological dimension of Simmel’s thought. Building on previous interpretations, I argue that although Simmel cannot be interpreted as a systematic normative theorist, the issue of values and the normative standpoint can nevertheless be traced in various aspects of his multifarious work. This interpretive turn attempts to link Simmel’s obscure theory of value with his epistemological relationism. Relationism may offer a counterweight to Simmel’s value-pluralism, since it points to normative elements (e.g. internal teleology, (...) justice) that can contribute to the reconciliation between incommensurablity of forms and totality. Axiological and normative concerns (of a Hegelian source) survive also in his metaphysics of life, pointing beyond a merely Bergsonian and conservative Lebensphilosophie. I conclude with some thoughts on how this normative rethinking of Simmel’s thought can contribute towards more adequate appreciations of Simmel’s overall theory. (shrink)

Steven Crowell has been for many years a leading voice in debates on twentieth-century European philosophy. This volume presents thirteen recent essays that together provide a systematic account of the relation between meaningful experience and responsiveness to norms. They argue for a new understanding of the philosophical importance of phenomenology, taking the work of Husserl and Heidegger as exemplary, and introducing a conception of phenomenology broad enough to encompass the practices of both philosophers. This dissertation is an attempt at harmonizing hermeneutics. In particular, what I term the normative and descriptive approaches are explored and brought together. A normative approach is one concerned with providing the correct method for gaining knowledge of the meaning of a text. Beardsley's normative method of relying on the "text itself" is considered and rejected. Hirsch's normative method of relying on authorial intention is considered, criticized, and used as a springboard to my own normative method of urinterpretation. Propaedeutic to (...) the articulation of urinterpretation is an answer to the question: What is an author? After a survey of theories of authorship, I propose my own author construct--the urauthor. In constructing the urauthor we go back as far as possible to the model of the original. In urinterpretation we seek authorial intention on the basis of the urauthor. It is argued that through this method we secure the meaning of a text. ;Descriptive hermeneutics is concerned with describing the phenomenon of interpretive understanding. It eschews questions of epistemological method, which are at the center of a normative approach, in favor of an ontology of interpretive understanding. Gadamer's Truth and Method is the most complete philosophical account of descriptive hermeneutics to date, and accordingly our attention to descriptive hermeneutics is largely a critique of Gadamer's work. It is argued that both normative and descriptive hermeneutics can and should coexist, but to facilitate scholarship each should be explored separately. ;Interpretation and criticism are also harmonized. Interpretation is understood as the project of seeking the meaning of a text. The meaning of a text, it is argued, is discovered by seeking authorial meaning through the urauthor. Criticism is understood as the project of seeking the significance of a text. The significance of a text, it is argued, is its meaning-as-related-to: to me, to you, to our time, etc. The harmonization of interpretation and criticism is briefly explored in typical philosophical, literary, theological, and legal texts. This paper proposes a reading of Kelsen’s basic norm based on Kant’s regulative ideas. I begin by exposing Kant’s conception of the principles of reason. Then I criticize an interpretation of the basic norm along the same lines made by Stanley Paulson. Thirdly I analyze two theses from Hermann Cohen that influenced Kelsen greatly and reinforce my stance on the basic norm. Lastly, I explain how the Kelsenian tenet that the basic norm is the transcendental (...) grounding of the normativity of law can be comprehended based on the role the ideas of reason play in the systematization of knowledge. An essential aim of this study is to present principles of the legal interpretation of the term “building structure” for the needs of the imposition of a real estate tax. The analysis of both administrative courts’ judgments and the subject literature indicates lack of consistency in the scope of this term’s meaning. In my opinion, interpretative discrepancies are caused by incorrect legal interpretation of the legal definition. It should be noticed that numerous controversies connected with the legal (...) class='Hi'>interpretation of the term building structure are connected with considerable tax burden of this type of building objects. Taxpayers, for obvious reasons, are therefore “interested” in not finding the objects owned by them to be building structures in the meaning of the Tax Law, or possibly in finding only those objects’ specified parts to be building structures. It is easily apparent particularly in the case of objects of complex structures. On the other hand, however, for many municipalities in Poland, income from building structures’ taxation creates municipal budgets. This way the practice of applying local tax law encounters numerous disputes between taxpayers and self-government tax authorities. (shrink)

In modern argument theory argumentative practice is often analyzed and evaluated in terms of its correspondences with or deviations from a normative model. Such a methodology implies that there are three moments at which evaluations takes place which are not guided by the norms of the model itself because they imply an interpretation of the model by the analyst. This is demonstrated by an analogy with legal practice. this implies that an evaluation of an argumentative practice is not only (...) relative to choice of the normative model as such, but also relative to the threefold interpretation of the model. Perfectionism is an underexplored tradition, perhaps because of doubts about the grounds, content, and implications of perfectionist ideals. Aristotle, J.S. Mill, and T.H. Green are normative perfectionists, grounding perfectionist ideals in a normative conception of human nature involving personality or agency. This essay explores the prospects of normative perfectionism by examining Kant’s criticisms of the perfectionist tradition. First, Kant claims that the perfectionist can generate only hypothetical, not categorical, imperatives. But insofar as the normative perfectionist appeals to the normative category (...) of personality or agency, rather than a biological category of humanity, it can represent perfectionist demands as categorical imperatives. Second, Kant accepts a moral asymmetry in which we aim at our own perfection but at the happiness, rather than the perfection, of others. However, the importance of autonomy in normative perfection explains why the perfectionist should recognize a self/other asymmetry. Indeed, when we see how the normative perfectionist can answer Kant’s criticisms while respecting Kant’s own claims about the connection between rational nature and moral requirements, we can see the basis for a normative perfectionist interpretation of Kant’s own ethical theory. Insofar as Kantians and normative perfectionists both base ethical demands on an appeal to rational nature, they face a common worry that the appeal to rational nature is empty or incomplete. Normative perfectionists have more and less concessive responses to this worry, providing perfectionist explanations of various apparently non-perfectionist goods. Even if we end up being pluralists about the good, perfectionist elements play an important role. Finally, because the normative perfectionist, like the Kantian, grounds its ideals and requirements in a conception of persons as rational agents, it provides a promising account of the rational authority of perfectionist demands. This comparison of normative perfectionist and Kantian essentials gives us reason to take the normative perfectionist tradition seriously. (shrink)

This paper concerns connection between knowing or accepting a logical principle such as Modus Ponens and actions of reasoning involving it. Discussions of this connection typically mention the so-called ‘Lewis Carroll Regress’ and there is near consensus that the regress shows something important about it. Also, although the regress explicitly concerns logic, many philosophers think that it establishes a more general truth, about the structurally similar connection between epistemic or practical principles and actions involving them. This paper’s first aim is (...) to address key interpretations Carroll’s regress as clearly as possible so as to show precisely how it might be relevant to questions concerning the connection between logical knowledge and reasoning, and, more broadly, to discussions of how epistemic or practical principles may be action-guiding. Its second aim is to show that the regress fails to establish anything of substance about the connection between logical knowledge and reasoning, or any other structurally similar relation, unless substantive, contentious and typically undefended assumptions are made.
