In this paper the author focuses on some of the topics in the debate on multiculturalism, applying them to the issue of immigration, particularly female immigration, in Europe. She then illustrates how the individual/group relationship is a particularly complex one where women are concerned. In this framework she considers the various roles of a multicultural law and the thorny relation between women immigrants and their official representatives. Multicultural policy has recently been undergoing a marked crisis and is subject to wide criticism. In the light of recent terrorist attacks it is often highlighted that the reason for such situations might be too much openness towards foreigners. Most European countries are changing their immigration and integration policies limiting their social security and restricting the possibilities of an influx of immigrants. Sweden, which is perceived as one of the most open and tolerant states in Europe also faces (...) new challenges concerning the future of its multicultural policy. The crisis in tolerance towards foreigners is quite visible and it is obvious that the social moods in this state are evolving. Therefore, the aim of the article is to analyze changes in the attitude towards Swedish immigration and its integration policy in the light of the attack on the Charlie Hebdo weekly offices. Various authors emphasize an important aspect of the secular context of the contemporary world: the transfer of symbolic power from religion to political ideologies. National ideology enjoys a particular place. In the circumstance of cohabitation between religious minorities and the majority within a national state, solutions must be found that ensure the ground for religious pluralism and freedom. The paper in question aims at analyzing the prerequisites that will render possible cohabitation and mutual recognition between the minority groups and the (...) Orthodox majority within the Romanian context. Due to the cultural diversity of Romania, the state has to elaborate multicultural policies in order to ensure opportunities for affirming the plural religious identities that can be found within the national state. This important collection of essays offers a sustained philosophical examination of fundamental questions raised by multicultural education in primary and secondary schools. The essays focus on both theory and policy. They discuss the relation between culture and identity, the role of reason in bridging cultural divisions, and the civic implications of multi-culturalism in the teaching of history and literature. Several of the essays examine aspects of multicultural policies in California and New York, as well as the curriculum (...) guidelines promulgated by the National Council for Social Studies. Although much has been published on the subject of multi-culturalism, including the cultural war on American campuses, there is very little available on the impact of multicultural policies for primary and secondary education. The issue of the policy of multiculturalism toward ethno-cultural minorities in contemporary Serbia has been reviewed within the project Regional and European Aspects of Integrative Processes in Serbia held by the Institute for Philosophy and Social Theory. The aim of this paper is directed toward examination of theoretical and empirical problems regarding the phenomenon of multiculturalism. In spite of the fact that multiculturalism is one of the striking characteristics of modern life in Serbia our social sciences pay a little (...) attention to this topic. Ethnicity as an important part of multicultural discourse is based on nonscientific knowledge and in this manner it presents basis for policy and practice for the protection of rights of minorities in the country. In the 1970s and the 1980s, multicultural education spread in many countries. However, in the mid-1980s the golden age of multiculturalism came to an end. Neo-conservative political forces attacked multicultural policies and progressively a neo-liberal discourse pervaded economic and social policies, also affecting national education systems. In contrast, multicultural approaches have emerged with tremendous vigour in the field of business management. Juxtaposing cognitive, emotional and socio-communicative multiculturalism found in organisational studies onto multiculturalism in the International Baccalaureate (IB) (...) curriculum indicates whether multiculturalism in international schools aims to respond to the needs of global capitalism. The findings show that emotional, cognitive and socio-communicative multiculturalism are seen as essential traits for good performance in transnational corporations, and they are strongly encouraged in the IB curriculum. The relevance of multicultural skills in global management alongside the decay of multiculturalism in public education systems entails a growing educational disparity between lower class and higher class children. A new educational structure in which two differentiated systems – a national system and an international system – emerges and redefines the terms of inequality of opportunities. (shrink)

Controlling Natality - the ratio of births to the general population - is one of the best means a state has to control its demographic composition. However, the fact that the state has certain interests with regard to the size and composition of its population does not necessarily give it the right to set and pursue natality policies, because such policies can potentially infringe on various human rights such as the rights of women and the rights of minorities. Using a (...) feminist perspective I first argue that even if it is illegitimate for states to try to influence people's choice as to the number of their children in order to achieve demographic change, the state may, and should, enact natality policies aimed at promoting women's right to equality, regardless of whether their end result is to achieve a demographic change. Next I examine whether states are allowed to pursue natality policies that are aimed at decreasing natality rates in specific cultural groups, whose cultural precepts are oppressive to women and dictate very high natality rates. Using the ultra orthodox Jewish community in Israel as a test case, I present and reject three objections to the state's right to pursue such natality policies: the objection from free choice, the objection from free association, and the objection from culture. Rejecting these objections I conclude that not only is the state allowed, but it is indeed obligated, to pursue natality policies that aim to alleviate the oppression of women by decreasing inordinately high birth rates in illiberal communities. However, when choosing the measures for the implementation of such policies the state must take care to choose only measures that respect human rights. (shrink)

In this article the author intends to provide general normative guidelines which ought to inform policies concerning the most controversial multicultural claims for a liberal democracy. In order to do that, she proposes a general reconsideration of the struggle of cultures and identities which makes up the stuff of multiculturalism. She suggests that instead of focusing on the issue of compatibility, the adequate viewpoint from which considering multicultural claims should be justice and, within justice, the principle of equal (...) respect (ER). The reference to ER is widespread in the literature on multiculturalism, but it does not specify what should be the object of ER: persons and their dignity, or cultures/religions/identities and their members? The alternative is then examined and the author argues in favour of an interpretation of ER for persons which considers persons as they are, given their identities and differences. Finally, the author provides a typology of multicultural claims, ranked on a scale of different levels of disrespect, which consequently require different kinds of response. As a result, one is invited to reflect on the how beside the what, on the procedures and attitudes beside the benefits and measures, and not only for the pragmatic reasons of finding a relatively easy way out, but also for principled reasons of justice. This paper empirically re(dis)covers a moment of conjuncture within Leicester when an opportunity opened up through multicultural/anti-racist education for schools and colleges to develop their ‘multicultural capital’. It does this through the thematic analysis of the key proximate document Report of the Working Party on Multicultural Education as well as drawing on interview data provided by two important agents who helped to implement Leicester’s/Leicestershire’s moment of multicultural education. This moment generated a symbolic, ideational, and conceptual shift (...) within Leicester’s education provision toward a more culturally inclusive position that began to recognise the cultural capital of non-white students. However, this moment was to be lost in the ‘neoliberal epoch’. It is argued in this paper that neoliberal education policy/practice has become an enabling mechanism for renascent colonial ideology. By re(dis)covering this vision for the official recognition of non-white cultural capital, this paper demonstrates the possibilities for alternative directions within Leicester’s schools and colleges that can challenge neoliberal and colonial conceptions of education. It suggests that there are still spaces and structures that can be re(dis)covered in order for this vision to be enabled. (shrink)

In this paper I argue for a cautious multicultural approach, with specific regard to its implementation as a legal strategy. Such an approach is cautious only because, as I will demonstrate, it stems from an awareness that in some cases, and for different reasons (political, social, as well as legal), other multicultural policies based on minority or group rights do not work. In other words, I will argue for a strategy of recognition that is additional to others, and (...) that can be implemented and juxtaposed with others, in order to offer a better defence of those rights and claims, which other policies do not recognise (or recognise insufficiently). Social justice is a contested concept. For example, some on the left argue for equality of outcomes, those on the right for equality of opportunities, and there are differing emphases on the roles of state, market and individual in achieving a socially just society. These differences in emphasis are critical when it comes to examining the impact that public policy has on minority ethnic groups. Social justice should not be culture-blind any more than it can be gender-blind yet the (...) overwhelming burden of evidence from the UK shows that public policy, despite the political rhetoric of fifty years of governments since large-scale immigration started, has failed to deliver social justice to Britain’s minorities. In terms of outcomes, in respect for and recognition of diversity and difference, in their treatment, and in the failure of governments to offer an effective voice to minorities, the latter continue to be marginalised in British social, economic and political life. This is not an argument for abandoning the project of multiculturalism, however, but for ensuring that it is framed within the values of social justice. (shrink)

In this article, I investigate how gendered nationalism is articulated through everyday practices in relation to immigrant integration policy and the intersectional production of inequality in South Korea. By using ethnographic data collected at community centers created to implement national “multicultural” policy, I examine the individual perspectives and experiences of Korean staff and targeted recipients. To defend their own “native” privileges, the Korean staff stressed the gendered caretaking roles of marriage migrants and their contribution to the nation (...) as justification for state support. The migrants, while critical of the familial responsibilities imposed on them in Korea, underscored their gendered value to the nation to offset their subjugated position. The diverging perspectives of the two groups are informed by “everyday” nationalism, generated through constantly gendered terms and effects. Bringing together the literature on nationalism and migration through a focus on reproductive labor, I expose how national boundaries are drawn through quotidian practices of gendered nationalism, with significant implications for gender and ethnic hierarchies. This article analyzes the implications of a particular conception of social justice in education for the policies that have led to significant political controversies in contemporary communities in the United States. Many of these controversies have arisen from the collision between the increasingly multicultural reality in those communities and the accountability system that has during the past decade or so been imposed on the schools by standards-based reformers in the federal and state governments. For this task, the article considers (...) the schools in a hypothetical community in which significant immigration of Latino citizens has occurred. It proposes a theory of social justice in education that uses John Rawls's ideas about political liberalism and an overlapping political consensus in a pluralistic society as a basis for analyzing the normative and factual disagreements in that community. Employing the principles of that theory, the article considers whether the system of accountability that has led to the disagreements is normatively justified and concludes in particular that that system violates both the principles of personal liberty and of equality of educational opportunity in education. It also concludes that a dramatically different system of accountability is required, one in which central political authorities have a responsibility to hold localities accountable for the social justice purposes of education and in which local authorities have a responsibility to design the school curriculum to be genuinely responsive to the diverse cultural interests that children have in their local communities. Luce Irigaray classically challenges what she takes to be the masculine foundations of knowledge in Western liberal culture. The present article contends not only that this epistemological challenge implicates a radical feminist politics, but that it is also more helpful in formulating a multicultural feminist theory than is often acknowledged by her readers. This is because her account responds to the false neutrality of liberal feminist approaches to multiculturalism. It does so by supporting, at the socio-political level, transformative genealogical (...) practices that are aimed at fostering women's agency in culturally sensitive ways. However, Irigaray's recent work on multiculturalism does not sustain the necessary continuity between her core epistemological critique and her political claims. In particular, the continuity between her criticism of the West's sexual indifference and the cultural multiplicity of female identity becomes problematic in her recent work. The author finally contends that Irigaray's writings pose difficulties for a multicultural feminism, because they fail to specify the different forms of policy necessary to promote diverse women's equality in the postcolonial contexts on which she recently focuses. Abstract:In the last two decades, Spain’s general music education curriculum has moved beyond the exaltation of so-called Western art music to also include some instances of non-Western musical traditions. This process of diversification is often articulated as entirely positive. The present paper interrogates such discourses, following a post-structural, socio-historical approach. It looks into the circumstances surrounding the emergence of Spain’s multicultural music education as a field of study, paying special attention to the inherent limitations and (contradictory) effects it produced. (...) It argues that, despite its progressive-sounding rhetoric, Spain’s multicultural music education still draws on age-old colonial discourses that pin the Self and the Other against each other. Following this line of inquiry, the paper then unpacks the emergence of the notions of music and schooling, as well as Spain’s recent move toward deregulating music and the arts as school subjects. Interspersed, the paper includes brief critical discourse analyses of policy documents and scholarly texts to exemplify its main points. (shrink)

The concept of recognition, and its relationship to the way we theorise identity and justice, has emerged as part of an important debate in contemporary political and social theory. With contributions from Nancy Fraser and international commentators, this new collection examines key theoretical and practical problems of 'recognition' in politics. Beyond important normative issues in social theory, such as how cultural claims to difference may be justly accommodated in liberal polities, it addresses a range of practical problems in which a (...) politics of recognition approach casts new light on old conflicts and tensions, examining these problems within the context of processes of globalisation and increasing cultural diversity. In this essay Troy Richardson works to develop a conceptual framework and set of terms by which a diplomatic reception of different forms of law can be developed in multicultural education. Taking up the trope of the door in multiculturalist discourse as a site in which a welcoming of the difference of others is organized, Richardson interrogates the complex nature of receptivity to Indigenous customary law, in particular. He argues that, within this trope, a metonymic structure operates in relation (...) to the deployment of “policy” that maintains a perspective of customary law as premodern and primitive. This structure leads to an impoverished set of terms and a lack of diplomacy toward difference. Richardson proceeds by considering the notion of extraterritoriality and the metonyms that organize Emmanuel Levinas's discourse of “doors” in conceptualizing a welcoming receptivity. The term “extraterritoriality” anticipates the law of the other as it approaches the door and implies a diplomatic moment of reception of such difference. Richardson concludes by highlighting Jacques Derrida's evaluation of Levinas's discourse of receptivity and by considering the possibilities for a diplomatic engagement with the laws of others toward a mutation in the current geopolitical moment. Approximately 47 million Latinos currently live in the United States, and nearly 25 percent of them are undocumented. The USA is a very different country from just a generation ago – culturally, socially, and demographically. Its presumed core values have been transformed largely by the changes wrought by immigration and ethnicity. A multicultural society has, in 2008, elected a multicultural president. This article examines immigration discourse, framed in terms of fear and security, and the evolution of the US (...) immigration policy. Latino immigration is presented as a force that has shaped the nation's past and continues to shape the economic, demographic, and cultural future of the United States. Psychological barriers to the social integration of immigrants are also explored. This article concludes that government policy makers should encourage a more tolerant, multicultural society by integrating Latino immigrants into the social, economic, and political fabric of the nation. It is not uncommon to hear that poor school performance, welfare dependancy, youth unemployment, and criminal activity result more from shortcomings in the personal makeup of individuals than from societal forces beyond their control. This study offers a theoretical framework for stakeholder management in an international and multicultural environment. Through the use of an extensive qualitative case study analysis, a methodological approach was developed for analyzing stakeholder dialogue data for cultural differences. Based on the empirical data it was possible to show specific ways in which cultural dimensions affect the international diffusion of stakeholder related policies. These findings contribute to the fields knowledge on internal stakeholder management implementation, by addressing the complexity of embedding (...) stakeholder management principles and practices within various international subsidiaries of the same multinational organization. This paper explores the ethics of deceased‐directed donation (DDD) and brings a unique perspective to this issue—the relevance of providing family‐centered care and culturally sensitive care to deceased donors, potential recipients, and their families. The significance of providing family‐centered care is becoming increasingly prevalent, specifically in pediatric healthcare settings. Therefore, this topic is especially relevant to those working with and interested in pediatrics. As the world is becoming more diverse with globalization, assessing the cultural aspect of the ethics of DDD (...) is increasingly salient. We provide a brief overview of DDD across the globe, review prominent arguments both for and against DDD, consider family‐centered and culturally specific considerations, and offer considerations for the development of a policy or guideline. We determine that the practice of DDD is ethically defensible in certain circumstances and congruent with providing both family‐centered and culturally sensitive care. Our analysis is relevant to any country with a diverse population and any healthcare provider or institution that operates under a framework of family‐centered care, such as those in pediatric hospitals. This book provides the first systematic study on three types of incentives for organ donation. It covers extensive research conducted in four culturally different societies: Hong Kong, mainland China, Iran and the United States, and shows on the basis of the research that a new model of incentives can be constructed to enhance organ donation in contemporary societies. The book focuses on three types of incentives: honorary incentives, commonly adopted in the United States and other Western countries by offering things (...) such as a thank-you card and a memorial park for donors to encourage donations motivated by pure altruism; compensationalist incentives, adopted in the Islamic Republic of Iran to encourage donation by providing monetary compensation to unrelated living donors for appreciating their altruistic contribution of donation; and familist incentives, implemented in Israel and mainland China to provide priority to organ transplantation to donors and/or their family members. The book demonstrates that a new model of incentives must go beyond offering only one type of incentives and should rather include different types of incentives that are practically effective, politically legitimate and ethically justifiable for particular societies. This implies that suitable incentive measures may vary from society to society to optimize organ donation. This book provides a clear reference for both the scholars and practitioners in the field of organ transplantation, as well as for general readers interested in bioethics and health care policy. This article focuses on public debates and public policy on the Islamic headscarf in the Netherlands and Germany. In the Netherlands the Islamic headscarf meets with an accommodating policy reaction, while in Germany some eight federal states have introduced legislation to ban the headscarf. This difference is explained, so I argue, by national differences in citizenship traditions. While the Netherlands represents a multicultural model, Germany used to be the paradigmatic example of an ethno‐cultural model of citizenship. Yet, (...) the reaction of the German left to the headscarf, while often non‐accommodating, is very differently inspired by German history than that of the right. A commonality is that in both countries the issue is framed as a conflict between public neutrality and religious freedom, not gender equality. An effect of the focus in the debate on neutrality is that it obscures the agency of Islamic women and the gender dynamics in Islamic communities. (shrink)

Managers throughout the world regularly face ethical dilemmas that have important, and perhaps complex, professional and personal implications. Further, societal consequences of decisions made can be far-reaching. In this study, 210 financial services managers from Australia, Chile, Ecuador and the United States were queried about their ethical beliefs when faced with four diverse dilemmas. In addition, the situational context was altered so the respondent viewed each dilemma from a top management position and from a position of economic hardship. Results suggest (...) a complex interaction of situation, culture and issue when individuals make ethical judgments. Specifically, Chileans were found to have different beliefs about sex discrimination and child labor dilemmas when compared to their colleagues from the other three nations. Chileans and Australians also disagreed on the bribery dilemma. Anglo managers were more likely than Latin American managers to change their ethical responses when the situation was altered. For multinational firms interested in maintaining healthy ethical climates, the findings suggest that culturally contingent ethical guidelines, or policies adapted to the local customs, must be considered. Further, managers must remain aware of issues related to specific situations, both internal and external, that would cause subordinates to alter their moral judgment. (shrink)

Insofar as the postcolonial project is one of the elaboration of "the plurality of modernity, and the agency multiplying its forms", my project is a contribution to this larger one in the form of a postcolonial theory of multiculturalism (Ashcroft, 2009, p. 85). Drawing from minority standpoints, arguments, and narratives, I focus on the lives and perspectives of a few broad groups in particular: indigenous peoples in Canada, Muslim women, and East Asian "immigrant" minorities. I take up a critical theory (...) approach to framing multicultural theory and the questions it asks from the standpoints of minorities themselves, foregrounding the challenges and perspectives of racialized groups for whom their ethno-culture is morally salient and central to their own understanding of their identities and aims. This framework draws on the insights of feminist theorists of deliberative democracy but also departs from them in the crucial respect of affirming a conception of culture and identity that accepts some basic "communitarian" ideas of morality and culture, while conceiving these within a postcolonial project of cultural reclamation rather than a republican framework of the public sphere. My project is organized into two parts: The first section systematically critiques the dominant liberal multiculturalist model based on Canadian multicultural policy and theorized by Kymlicka, which is oriented by the liberal state's perspective in its aims of integrating minorities. In the first chapter, I reject his universalist principle of liberal neutrality as the standard for justice in favour of a pluralist democratic standard that accommodates "thin" theories of the good. In the second and third chapters, I reformulate Kymlicka's categories of "national minorities" and "polyethnic minorities" respectively in order to take account of postcolonial indigenous sovereignty and the transnational scope of ethnic identity. The second section develops a pluralist account of agency in its descriptive (Chapter 4), normative (Chapter 5), and prescriptive (Chapter 6) aspects (Deveaux 2006 p. 179). This is developed as a constructive critique of liberal standards of autonomy, particularly feminist proposals for a standard of procedural autonomy, as unable to adequately describe and assess heteronomous agency. This article explores the contemporary scientific practice of human genome science in light of Michel Foucault’s articulation of the problem of population. Rather than transcending the politics of social categories and identities, human genome research mobilizes many different kinds of populations. How then might we aim to avoid overgeneralized readings of the refiguring of human difference in the life sciences and grapple with the multiple and contradictory logics of population classification? In exploring the study of human variation through the case (...) of the ‘Quebec founder population’ at a private genome research laboratory in Canada, the article argues that the power to define and shape meanings of human variation and to organize vitality is not held by any one institution or form of scientific practice. While molecular genomics may be transforming conceptions of human difference, the laboratory is only one of many places where human genomic variation accrues value, meaning and relevance. Molecular configurations of human difference gain meaning through a traffic in populations that extends beyond the laboratory. In the case explored here this traffic in populations is constituted within a nexus of empire, national census practices and contemporary articulations of multicultural policies. (shrink)

This article proposes a new social- and moral-psychological understanding of cultural identity, tailored to the mixed multicultural contexts of every major city today. Seeking to protect vulnerable cultural groups, theories of multiculturalism have insufficiently assessed the psychological significance of intercultural social comparison, in identity-formation. While plays of prestige are a fact of life for immigrant and gay minorities, not everyone is equally able to cope with ascribed negative prestige. This is shown in an analysis of reactive attitudes towards negative (...) prestige under contrasting conditions (of rough cultural equality, and in underclass-culture). The idea of prestige-resilience is proposed both as an explanatory concept in the debate on underclass-culture and as a normative concept from which basic moral and ethical thresholds for cultural identity-formation might be deduced. Outcomes are considered relevant for psychological analysis of underclass-formation and for multicultural policy-making, specifically in immigrant states. (shrink)

There are three possible justifications of the claim cultural communities make for their right to transmit an identity to their children. A group strategy and a parenting strategy are both defective. More promising is the view that there is value to children in the sharing of a familial life. But parental authority is limited by the requirement that children acquire sufficient autonomy. Some multicultural policies are thus not ruled out by the recognition of the need to accommodate children's interests.

The death of multiculturalism has been pronounced many times. In spite of this, this political program has proven resilient and the fact of cultural diversity remains inescapable in most liberal democracies. Still, with the rise of the far right, the migrant crises in the United States and Europe and with social movements pushing the boundaries of multicultural theory, it is high time to review multiculturalism, a movement of the late 20th century, and see where it is headed in the (...) 21st century. This article has two objectives. First, after reviewing three debates—anti‐essentialists versus multiculturalism, interculturalism versus multiculturalism and multiculturalism versus the welfare state—I argue that the normative core of multiculturalism is still viable. Second, I argue that multiculturalism remains unable to contribute to some of the most pressing issues of the 21st century and point to a novel approach to the justification of multicultural policies. This justification relies on the concept of vulnerability, a concept that plays an important but undertheorized role in current multicultural theories. (shrink)

The Law has always been an instrument to exorcise different kinds of fear, primarily the fear of differences, through the distribution of shares of power. Perhaps, this system, inherently conflictual, is behind the failure of the multicultural policies of many countries, that have divided the society in as many separate communities as are the elements that differentiate each human being. The Law has also recognized to men a total power over Nature, feeding its illusion of control, that in recent (...) decades has shattered in front of several natural disasters. Ecuador, Buthan and South Africa have introduced in their Constitutions ideas belonging to the indigenous cultural tradition (buen vivir, buddhism and ubuntu), which express harmony between men and Nature. The paper analyzes these experiences in order to propose a new model of eco-friendly constitutionalism. (shrink)

In contrast to multicultural theory, which in discussions of respect for difference has primarily focussed on the state as the agent of respect, multicultural policy has instead tended to focus on citizens themselves as the potential agents of this sort of respect. This article examines the plausibility of this type of respect (which is advocated by some theorists too), and argues that is not a reasonable or necessary demand. While there are several different ways of understanding respect (...) — most of which focus on respecting persons — none seem capable of doing the work required for it to enable either the adequate or reasonable accommodation of diversity in a liberal society. More specifically, I use Darwall's influential distinction between appraisal and recognition respect — the latter in a broad non-moralised sense — to make my case. While appraisal respect for difference may be theoretically easy to dismiss, it is not uncommon in multicultural policy. On the other hand, recognition respect — which is more behavioural than attitudinal — may appear a more plausible candidate. Yet it too remains overly demanding for individual citizens, especially, and most importantly, in difficult cases. I conclude that tolerance of difference (coming out of respect for citizenship) is a more appropriate demand on the individual. (shrink)

Multiculturalism has become a political touchstone in many countries around the world. While many of those on the right oppose it, and many of those on the left embrace it, things are not this simple. For those who defend them, multicultural policies are generally seen as key to the fair and successful integration of minorities, many of whom are immigrants, into diverse democratic societies. For those who oppose multiculturalism, who have become part of the so-called "backlash" against multiculturalism, they (...) are charged with generating segregation rather than inclusion, undermining national cultures, reinforcing difference, and privileging minority groups. Around the world, we see failing attempts at migrant integration, persistent religious intolerance and racial and ethnic discrimination, resurgent national minorities, emboldened majorities, permanent minorities, continuing social isolation, and increasing extremism, including in the form of white nationalism. But is multiculturalism the solution to these problems or does it just make them worse? In this for-and-against book, two prominent scholars of multiculturalism put forward different answers to this important question. While Patti Tamara Lenard argues for minority rights as both the consequence of a right to culture and a way to redress the effects of nation-building, Peter Balint rejects minority rights altogether, instead arguing for a re-imagined liberal neutrality. This theoretical disagreement plays out in real-world policy disagreement. Lenard, for example, argues strongly in favor of exemptions from general rules for minority cultures including the right of Sikhs to be exempt from helmet laws, and for Jews and Muslims to be exempt from bans on male circumcision. She also defends the right of minority cultures to have government-supported separate spaces. Balint, on the other hand, argues directly against these types of exemptions and government support. He is opposed to any form of differentiation based on culture, religion, or ethnicity. The book uses a wide range of real-world examples to demonstrate their significant theoretical disagreement, and to recommend very different policy proposals. (shrink)

Large-scale migration is one of the most topical issues of our time. There are two main problems. First, millions of persons will enter Europe in the short and middle run in spite of the firewalls we have built. When the income levels in the development countries raises, the migration pressure will even become stronger for a long time. Second, the present integration policy in most European countries is deficient. In contrast to common knowledge, strong social benefits for migrants, (...) class='Hi'>multicultural policies and fast naturalization do not further integration. To address these two problems we propose a procedure that takes into account that most migrants react to incentives in a rational way. Migrants in our countries are joining a cooperative and take advantage of many collective goods and social institutions the citizen of the immigration countries have provided. Migrants therefore should pay an entry fee to join the cooperative. This proposal has positive consequences for both the countries of immigration and of origin, as well as for actual and would-be immigrants. It has many advantages compared to other schemes. (shrink)

Liberalism and pluralism are seen as being in tension in liberal Western nation-states, while multiculturalism, as a policy of resource allocation to minority groups, has been the standard response to pluralization. This limits the pluralist potential of a constitutional liberalism. The fusion of a liberal theory of autonomous individuality with a pluralist theory of multiple belonging has to look beyond multicultural policy in order to enhance liberal commitments to citizens through pluralist provisions. An analysis of the Indian (...) Constitution's Fundamental Rights, as a normative document, shows that the citizen can be understood as an autonomous individual given identity through belonging to a plurality of groups. Consequently, rights are taken to accrue to all citizens equally as autonomous individuals, but also by virtue of their belonging to groups, with special provisions made available for vulnerable ones. Rights for a plurality of vulnerable groups should not be seen as illiberal additions but integral to the conception of liberalism. If such a view of citizenship were to be integrated into the liberal constitutions of irreversibly pluralizing Western democracies, then a pluralistic constitutional patriotism could be fostered amongst members of vulnerable groups, while demonstrating that standard liberal rights guarantee equal citizenship for all.
