Abstract. Environmental ethicists ask several questions about global climate change; especially on the moral justification of the problem of non-compliance; i.e., why agents do not comply with their climatic responsibilities. It is evident that some developed countries have been perpetuating the climate change crisis by not following their climatic responsibilities (i.e., mitigation, adaptation, and compensation) or even more surprisingly a few of those states have been denying the climate change facts. This paper focuses on comparing two forward-looking approaches to climate (...) justice; namely, the Ability to Pay Principle (APP) and the Power/Responsibility Principle (PRP) and seeks an answer whether any of these principles enable a response to the problem of non-compliance. Scrutinizing a few analogical examples and analysing contemporary debates on this issue, this paper then shows the APP does not enable a response to the problem of non-compliance whereas one possible distribution of duties according to the PRP does so and concludes that the relevant agents’ willingness to comply with climatic responsibilities seems to be the key factor to avoid harm in the context of climate change crisis. This paper demonstrates the political perspective of corporate social responsibility disclosures and, drawing on Weber’s notion of traditionalism, seeks to explain what motivates companies to make such disclosures in a traditional setting. Annual reports of 23 banking companies in Bangladesh are analysed over the period 2009–2012. This is supplemented by a review of documentary evidence on the political and social activities of corporations and reports published in national and international newspapers. We found that, in the banking companies over the period (...) of study, apparently neutral, corporate, philanthropic activities disclosed and promoted in CSR reports are inextricably linked to powerful leaders’ personal projects and the ruling party’s agendas. We have demonstrated elements of traditional societies, including personal loyalty and the public display of loyalty, the master–servant relationship, and obedience to personal rather than formal authority, provide an understanding of why banks have employed politically charged CSR disclosure strategies. The paper contributes to disclosure studies where political motivations of corporate disclosure rarely discussed. The paper extends the debate on political CSR by demonstrating that the role of family and familial values at the organisational and national levels may be much more important when it comes to CSR disclosure and activities. Psychotherapists and counsellors confront several ethical dilemmas as they tend to provide effective services. There has been much debate among psychotherapists and counsellors alike around the utility of therapeutic contracts. Some view contracts as being restrictive to the therapeutic process and often hindering the work done in sessions. In contrast, many counsellors and psychotherapists use those agreements to revisit specific therapeutic topics and establish the guidelines necessary for this professional arrangement. No matter the opinion or preference of contracts, the (...) development of written and/or verbal consent of specific topics in psychotherapy remains essential. This remains one of the formal features of the arrangement and starting relationship in current counselling and psychotherapy practice. While prophethood is the backbone of the Islamic tradition and an uncompromised tenet of faith, the impact of modernity with its ambivalent status afforded to the prophet and institution of prophethood shook many Muslim scholars. Through analysis of these modern debates on prophethood in Islam, this book situates Muhammad Iqbal's (1877-1938) and Said Nursi's (1877-1960) discourses within it and assesses their implications on the modern period. This article reviews the new developments that have occurred in the past ten to fifteen years in the field of Islam and science: the emergence of a “new generation” of thinkers, Muslim scientists who accept modern science's fundamental methodology, theories, and results, and try to find ways to “harmonize” it with Islam; and the exponential increase in the popularity of the I‘jaz ‘Ilmiy “theory,” the “miraculous scientific content of the Qur'an” as well as the continuation of the traditionalist school among (...) a section of the Muslim intelligentsia. The author then focuses on the next phase of issues, that is the “challenges” that this “new generation” must address, including the integration of methodological naturalism and evolution in the Islamic worldview, and positions to adopt regarding divine action and miracles. What does it take for Islam and science to engage in a genuine conversation with each other? This essay is an attempt to answer this question by clarifying the conditions which make having such a conversation possible and plausible. I will first distinguish between three notions of conversation: the trivial conversation (which requires sharing a common language and the meaning of its ordinary expressions), superficial conversation (in which although the language is shared, the communicators fail to share the meaning of (...) their theoretical terms), and genuine conversation (which implies sharing the language and the meaning of ordinary as well as theoretical terms). I will then argue that our real concern with regard to the exchange between Islam and science is to be to specify the conditions under which their proponents can engage in a genuine conversation with each other and that such a conversation to take place essentially requires sharing a common ontology. Following Quine, I will argue that Muslims, like the followers of any religion, would have no other choice but to work from within science. Doing so, however, would not prevent Muslims from having a genuine conversation with the proponents of other worldviews because when the shared ontology fails to offer any potentially testable answer to our remaining questions about the world, the Islamic viewpoint can appear as a genuine alternative among other underdetermined ones, deciding between which would be a matter of pragmatic criteria. This paper critically analyses how Islamization of Knowledge (IOK), Radical Reform (RR), and Maqasid Methodology (MM), three distinct Islamic intellectual projects, attempted to develop discourses of Islamic epistemology in facing contemporary developments of natural and social sciences. Mainly, the paper focuses on similarities, differences, and potential contributions of all three projects respectively. Initially, this paper observes that IOK, RR, and MM have solid agreements among themselves in defining the core crisis of the modern Islamic intellectual tradition, as (...) well as in highlighting the importance of inclusion of Islamic primary sources and its normative guidance in the process of reorienting modern knowledge. Equally, each of those projects presents itself as a new reflection of Islamic primary texts considering current intellectual challenges. Nevertheless, this paper further finds that all three projects have deep disagreements among themselves in terms of defining the scope of epistemic authority of revelation, reason, and spirituality and thereby offer three different visions of Islamic epistemic schema in facing modern knowledge. Finally, this paper reflects how these differences could potentially impact visions of an alternative education system from an Islamic worldview. (shrink)

I begin the first part by showing how situationism should make us question traditional understandings of virtues as intrinsic dispositions. I concentrate specifically on situationist experiments related to mood. I then introduce Islamic virtue ethics and the dawa movement. In parts two and three I examine ethnography of the dawa movement to explore how they deal with worries about the influence of mood on their virtue. In part two I show how they train their habits in very traditional virtue (...) ethics ways in order to be more resilient when faced with virtue-diminishing affective situations. In part three I show how the situation, rather than hindering practitioners, is recruited into helping these women achieve piety. I conclude, in part four, by showing the dawa movement's creative use of the Islamic veil as a way to help these women deal with the objection that one cannot avoid all bad situations. Going beyond social psychological experiments, I examine two methodological sources not found in situationist debates. First, I argue for ethnography as an empirical method through which to study virtue. I draw on ethnography of the Islamic women's dawa movement. Contemporary global events, such as the wars in Iraq and Afghanistan, the unresolved conflict in the Middle East, and the pessimistic relationships with Muslim countries, pose challenges for Muslims living in the United States in all walks of life. In addition, Muslims encounter daily struggles to live within a society that follows considerably dissimilar beliefs, norms, and way of life. Therefore, Islamic schools and other organizations emerged in response to those challenges. There are several debates in the literature about (...) Islamic schools; among those debates is whether Islamic schools segregate Muslim students, inspire religious intolerance, and rejection of social pluralism's ideals. In addition, there are debates of whether Islamic schools are capable of developing a strong Muslim identity skilled to tackle future challenges. Discussing these debates is considered the first step to critically tackling the challenges meeting Islamic schools, their relevance, and their continuity in a way that benefits Muslim generations and the American society. Furthermore, such debates draw attention to the impediments facing the success of these schools and the possible strategies to resolve problematic issues. Al-Shāfiʿī’s works contain reports of numerous debates on the epistemological value of hadith reports, but unfortunately rarely name specific opponents or interlocutors or the groups to which they belong. In Jimāʿ al-ʿilm al-Shāfiʿī summarizes the views of scholars whom he considered opponents of hadith under two broad rubrics: those who reject hadith categorically and those who reject only part of the hadith. There have been speculations regarding their identity but only in 2013 was a concrete advance made, when Ahmed El (...) Shamsy identified one of al-Shāfiʿī’s opponents in debate as Ibn ʿUlayya. This study attempts to identify a group of al-Shāfiʿī’s opponents in Jimāʿ al-ʿilm, drawing on Abū l-Qāsim al-Balkhī’s Kitāb al-Maqālāt and other classical works of Islamic theology. (shrink)

In late 2003, the Canadian media reported that the Islamic Institute of Civil Justice would start offering arbitration in family disputes in accordance with both Islamic legal principles and Ontario's Arbitration Act of 1991. A vociferous two-year debate ensued on the introduction of “Sharia law” in Ontario. This article analyzes representations of Muslim women's agency that came to the fore in this debate by examining reports in three Canadian newspapers. The debate demonstrated two notions of (...) agency. The predominant perspective conceptualized Muslim women's agency as their ability to resist domination, tying secularization to agency. A second strain of the debate portrayed agency as embedded in intersecting social forces of domination and subordination. The first perspective homogenized diverse Muslim communities, fostering the gendered racialization of these communities. Understanding agency as embedded, by contrast, enabled conceptualizations of Muslim women as agentic religious subjects. (shrink)

This article presents an analysis of a short treatise entitled Ādāb al-Baḥth wa al-Munāẓarah (The art of discussion and disputation) by the celebrated Ottoman scholar Abu al-Khayr ‘Iṣām al-Dīn Aḥmad ibn Muṣṭafā ibn Khalīl Ṭāshkubrīzādah or Ṭaşköprüzade (d. 968 AH/ 1561 CE). An overview of the nomenclature and a brief introduction about the author and his work will be presented along with an annotated English translation of the text in order to highlight Ṭaşköprüzade’s contribution to this nearly forgotten discipline.

The public visibility of Islam reveals new political stakes in European democracies around issues of immigration and citizenship. By focusing on the societal debates and the controversies around the construction of mosques and minarets, this article explores the ways in which Islamic difference is manifested, perceived and framed in public life. The ‘visibility’ of Islam in public is conceptualized as a form of agency, a manifestation of religious difference that cannot be thought independent of the materiality of culture, namely (...) aesthetic forms, dress codes, or architectural genres. It is argued that the debates for or against the banning of the construction of mosques and/or minarets reveal the tumultuous transition of Muslims from the status of the invisible migrant-worker to that of visible Muslim citizenship. The public visibility is approached therefore as a radically disruptive, transgressive, provocative form of transformative agency that is intrinsically related to the political process of becoming citizens. ABSTRACT An important aspect of the nineteenth century debate on the relationship between science and religion concerned the popularity of deterministic views among scientists. An integral part of Comte's positivism, the idea of immutable laws that determined natural and social phenomena became an increasingly prevalent component of scientific perspectives in the Darwinian era. Referring to this tendency as ‘scientific fatalism,’ critics likened it to Calvinist predestination, which transformed the debate into one involving polemics about different branches of Christianity (...) as well. This paper focuses on a neglected aspect of this debate, namely, the role that references to Islam and Turks played in it. ‘Mohammedan fatalism,’ already a common theme in justifications of colonialism, promptly became a tool with which to condemn new scientific views. Comparing French, British, and American writings on the topic, the paper illustrates that while there emerged approaches that praised the fatalism of Muslims while making a case for scientific determinism, most scientists and thinkers resorted to condemning the fatalism of Muslims in order to distinguish their views from it. In this respect, the paper demonstrates how political and religious discourses played a significant part in the shaping of scientific discourse in the Victorian era. (shrink)

Şeybânî (ö. 189/805), Şâfiî (ö. 204/820), İsâ b. Ebân (ö. 221/836) ve Buhârî (ö. 256/870) gibi sünnî ekolün tanınmış fıkıh ve hadis alimlerinin haber-i vâhid lehine ortaya koydukları çalışmalar bu noktada oldukça etkili olmuştur. Abstract Despite various criticisms, Ian Barbour's fourfold classification of the possible relationships between religion and science remains influential. I compare Barbour's taxonomy with the theories of four authors who, in the last four decades, have addressed the relationship between science and religion from a Muslim perspective. The aim of my analysis is twofold. First, I offer a comparative perspective to the debate on science and Islam. Second, following Barbour's suggestion, I test the general applicability of his categories by comparing (...) them with a discourse on science and religion that is not focused on Christianity. In the first section, I reconstruct Barbour's typologies, recalling some major objections to them, and arguing why despite the latter, Barbour's model is employed for the present analysis. I also reconstruct Barbour's parallel model for the relationships between different religions. In the second section, I reconstruct the discourse on science and religion developed by the Palestinian-American scholar Ismail Raji al-Faruqi. The third section is devoted to the ideas of the Persian-American scholar Seyyed Hossein Nasr. In the fourth section, I examine the views of the Iranian author Mehdi Golshani. The fifth section reconstructs the theories of the Algerian author Nidhal Guessoum. In the final section, I argue that a generalized use of the “integration” concept to refer to the entire debate on Islam and science is unhelpful. While these positions do not appear to instantiate Barbourian integration of science and religion, they do move toward what Barbour (skeptically) describes as integration between religions. (shrink)

As global business operations expand, managers need more knowledge of foreign cultures, in particular, information on the ethics of doing business across borders. The purpose of this paper is twofold: to share the Islamic perspective on business ethics, little known in the west, which may stimulate further thinking and debate on the relationships between ethics and business, and to provide some knowledge of Islamic philosophy in order to help managers do business in Muslim cultures. The case of (...) Egypt illustrates some divergence between Islamic philosophy and practice in economic life. The paper concludes with managerial implications and suggestions for further research. The article seeks to advance the debate on Islam and secularism, not by thinking of secularism in terms of whether there is or should be state neutrality toward religion, but rather by proposing that we think in terms of a state neutrality that is anchored in pluralism to-come. The latter is not a future pluralism that will one day arrive but is rather characterized by a structural promise of openness to futurity which thus exposes us to absolute surprise simultaneously (...) of the best and the worst in plurality, the one never coming without opening the possibility of the other. The analysis is developed via a critical examination of the presuppositions of Abdullahi A. An-Na‘im’s book, Islam and the Secular State, supplemented with key ideas from Jacques Derrida’s political philosophy. I specifically propose to shift the debate on the question of Islam and state neutrality in two ways. First, I propose that instead of thinking in terms of secularism and its mechanism – civic reason – for sustaining pluralism in heterogeneous societies, we think in terms of a secularity and a civic reason, both of which presuppose a pluralism to-come. Second, I propose that we think not simply in terms of actual pluralism but rather in terms of an autoimmune pluralism. (shrink)

Since 9/11, Islamophobia has been gaining the attention of scholars, and, increasingly, it is perceived to be an integral part of the emerging zeitgeist of the 21st century. However, the term itself is much debated and little consensus exists as to what it means. Using data drawn from political debate on talk radio between Nick Griffin, Chairman of the British National Party, and Abdul, a Muslim from Manchester and membership categorisation analysis as a methodology, this paper aims to reveal (...) the category-work by which Islamophobia is achieved as a members’ accomplishment. Findings indicate that two versions of Islamophobia are talked into being. On the one hand, Griffin “does” Islamophobia through the operation of an adversarial standard relational pair Islam/west which operates within a membership categorisation device “worlds”, and so he achieves exclusion through cultural incompatibility. On the other hand, Abdul uses the membership categorisation device “race” within which the adversarial standard relational pair Muslim/asian-white British is operative, and so he ascribes overt racist attitudes to Islamophobes. Al-Ghazali is arguably one of the most influential thinkers in the history of Islam, and his writings have received greater scholarly attention in the West than those of any other Muslim scholar. This study explores an important dimension of his thought that has not yet been fully examined, namely, his polemical engagement with the Ismailis of the Fatimid and early Alamut periods. Two Christian theologians writing in Arabic in the early ninth century argued that God had created humanity to freely choose good or evil actions, a belief shared universally by previous Christian writers in Greek and Syriac no matter the denomination they came from. They were debating with Muslim intellectuals who held that God created all human actions before they were acquired by humans, so that God had already decided which actions a particular human being would choose, whether good or evil. Theodore Abū Qurra and ʿAmmār al-Baṣrī developed dialogues with determinist Muslims in the hope that they might influence these determinist Muslims to adopt earlier Muslim beliefs that the Qurʾan taught that God would judge humans for the choices that they freely made for good or evil. However, the trend towards determinism was so strong that by the end of the ninth century the mainstream Sunni view would be that God decreed all human actions before they were acquired by humans. In the spring of 2003, Jacques Derrida sat down for a public debate in Paris with Algerian intellectual Mustapha Chérif. The eminent philosopher arrived at the event directly from the hospital where he had just been diagnosed with pancreatic cancer, the illness that would take his life just over a year later. That he still participated in the exchange testifies to the magnitude of the subject at hand: the increasingly distressed relationship between Islam and the West, and the questions (...) of freedom, justice, and democracy that surround it. As Chérif relates in this account of their dialogue, the topic of Islam held special resonance for Derrida—perhaps it is to be expected that near the end of his life his thoughts would return to Algeria, the country where he was born in 1930. Indeed, these roots served as the impetus for their conversation, which first centers on the ways in which Derrida’s Algerian-Jewish identity has shaped his thinking. From there, the two men move to broader questions of secularism and democracy; to politics and religion and how the former manipulates the latter; and to the parallels between xenophobia in the West and fanaticism among Islamists. Ultimately, the discussion is an attempt to tear down the notion that Islam and the West are two civilizations locked in a bitter struggle for supremacy and to reconsider them as the two shores of the Mediterranean—two halves of the same geographical, religious, and cultural sphere. Islam and the West is a crucial opportunity to further our understanding of Derrida’s views on the key political and religious divisions of our time and an often moving testament to the power of friendship and solidarity to surmount them. This book is a comprehensive analysis of the major intellectual positions in the philosophical debate on Islamic law that is occurring in contemporary Iran.

Approximately 15% of couples are affected by infertility worldwide. Subsequently, the use of assisted reproductive technologies is becoming increasingly popular, including the use of donor eggs, sperm and embryos. Despite ongoing ethical debate surrounding gamete donation, this is now a widely accepted practice in Western countries. Assisted reproductive technology is becoming more commonly utilised within the Muslim population; however, gamete donation remains a relatively controversial and taboo topic within this religion. Interestingly, there are significant differences in beliefs between Sunni (...) and Shi’a Muslims. Whilst Sunni Islam absolutely forbids the use of third-party reproductive assistance, Shi’a Islam is somewhat more lenient towards this practice. Reproductive tourism has therefore become prevalent in Shi’a Middle Eastern countries that permit the use of donor gametes in assisted reproductive technologies; however, this continues to evoke a strong bioethical debate, particularly around sperm donation. With the increased influx of reproductive tourism, this is beginning to weaken the regional Sunni Islam ban on the use of donor technologies, questioning the morality of their current beliefs. Consideration of religious beliefs is also crucial for patient-centred care in UK patients treated by the National Health Service for fertility issues. Of note, there is a lack of non-Caucasian donors in the United Kingdom. Reproductive tourism is also becoming increasingly common in the United Kingdom and needs to be considered in terms of future patient management in delivering good obstetric care. (shrink)

Al-Shāfi’ī has been unreservedly credited as one of the designers, if not the “master architect,” of uṣūl al-fiqh. His most important scholarly work, Al-Risālah, clearly demonstrates his cognitive creativity in this field. One of the methodologies for the decision of cases under Islamic law that Al-Shāfi’ī championed is qiyās, which he equated with ijtihād. His balanced approach invites further enquiry into the extensive use of qiyās in general and in criminal law in particular. The extent to which qiyās can (...) be applied to Islamic criminal law depends upon the degree or typology of qiyās being used, taking into account the Islamic theory of criminology. This article will analyse the position of al-Shāfi’ī in this regard. It will critically examine al-Shāfi’ī’s complex views on the use of qiyās as a method for establishing culpability under Islamic criminal law. It will then explore how his position corresponds to the human rights paradigm in the contemporary age. This article concludes that, while the use of qiyās in criminal law, especially in law of retaliation and predetermined punishments in accordance with al-Shāfi’ī’s approach is tantamount to incriminating a person based on less than certainty, it also represents the most promising way of protecting the right of victim. Non-medical or Social egg freezing (oocyte cryopreservation) is currently a controversial topic in Islam, with contradictory fatwas being issued in different Muslim countries. While Islamic authorities in Egypt permit the procedure, fatwas issued in Malaysia have banned single Muslim women from freezing their unfertilized eggs (vitrified oocytes) to be used later in marriage. The underlying principles of the Malaysian fatwas are that (i) sperm and egg cells produced before marriage, should not be used during marriage to conceive a child; (...) (ii) extraction of mature egg cells from single women being unacceptable; and (iii) fertility preservation in anticipation of late marriage is a conjecture that has not yet occurred. Ovarian tissue freezing can potentially be a more Shariah-compliant alternative to social egg freezing, because once the frozen ovarian cortical tissue sections have been re-transplanted back into the woman, mature egg cells can readily be produced, collected, and fertilized by the husband’s sperm only during the period of marriage contract (′akd al-nikāḥ). Unlike accidental mix-ups with frozen eggs, muddling of lineage (nasab) would be automatically avoided in ovarian tissue freezing due to immunological rejection. However, upon critical analysis based on Qawā’id Fiqhiyyah (Islamic Legal Maxims), Maqāṣid-al-Shariah (Higher Objectives of Islamic Law), and Maslaḥah-Mafsadah (benefits versus harmful effects on society), elective ovarian tissue freezing by healthy single women for social reasons would likely be a highly contentious and controversial issue within Muslim communities that may conflict with conservative social-religious norms. This thus needs further debate among Islamic jurists in dialogue with medical doctors and biomedical scientists. (shrink)

Ein Handbuch, edited by Heidrun Eichner, Matthias Perkams, and Christian Schäfer (Darmstadt: WBG, 2017); and The Oxford Handbook of Islamic Philosophy, edited by Khaled El-Rouayheb and Sabine Schmidtke (Oxford: Oxford University Press, 2017). One may, therefore, wonder whether López-Farjeat should have provided another one. My answer is a resounding "yes." The Oxford Handbook presents specific texts, The Routledge [End Page 320] Companion gives brief overviews of specific themes, and Islamische Philosophie provides a sketch of the development of Arabic-Islamic philosophy as well as an introduction to some of the major philosophers' most significant themes or works. By contrast, López-Farjeat offers a detailed picture of lively philosophical debates between philosophers, theologians, and other intellectuals, showing how philosophy pervaded thinking in the Islamic lands and was itself enriched by serious thinking in theology and other fields.After presenting the Islamic context and the translation movement from Greek into Arabic, López-Farjeat focuses on six main themes: (1) Theologians and Philosophers on Islamic Revelation; (2) The Classification of the Sciences, Logic, and Language; (3) Philosophy and the Natural Science; (4) Metaphysics in the Islamic Philosophical Context; (5) Psychology and Theories of Cognition; and (6) Ethics and Political Philosophy. In each case, he focuses on various much-debated philosophical issues, reconstructing their evolution. He begins by highlighting the Greek background, then moves to show chronologically how and why those debates evolved. When needed, he indicates in which other section of the book the context for a particular philosopher's or theologian's specific position on a debated issue can be found. Finally, after each chapter, he gives an excellent list of further readings (mostly in English) for the reader who wishes to delve more deeply into the topic.López-Farjeat's approach highlights the liveliness and the nuances of the debates between intellectuals of various religious persuasions in a way rarely done before. Such a detailed attention to specific contexts also means that his book does not allow for a quick, easy read. It provides all the information that even someone unfamiliar with Islamic studies or ancient philosophy may need to appreciate the richness and depth of Islamic-Arabic thinking, but this amount of information requires close and slow reading. López-Farjeat's frequent references to scholarly disagreement about specific issues could make this book at times challenging for nonspecialists. This means, however, that even seasoned scholars might find something to learn from López-Farjeat's treatments of the aspects of Islamic thought they might be less familiar with. And while beginners will need some time to absorb the vast amount of information López-Farjeat provides, they will be grateful for the clear way he has organized it.Too often and for too long have historians of Islamic philosophy focused on thinkers who saw themselves as mainly Aristotelians and neglected what philosophers learned from other disciplines, in particular from theology, be it Islamic or Christian. This book shows how Christians in the Islamic world had already integrated some Greek philosophy into their thinking from an early time, when they first entered into dialogue with Islamic theologians. In turn, Islamic theologians integrated philosophical elements in their works. López-Farjeat's knowledge of Islamic theology and Eastern Christian theology allows him to show that this process of integration was not a one-way street. The Islamic milieu and its theological developments raised new questions and issues that philosophers under Greek influences had to take into account. One does not philosophize in a vacuum: new questions raised in a different cultural and linguistic environment led to a refinement and enrichment in the understanding of philosophical issues.As an example, let us consider chapter... There exists a limited pluralist model of regulating or `managing' religious diversity in contemporary Europe. This pluralist model, however, is in contrast to the limitations that appear at the state level, which reflect an increasingly illiberal, secular Europe. Such contrast stems historically from tensions that exist between the national and transnational aspects of the model itself, but it also reflects the emerging debates on religious pluralism and the democratic state. With the settlement of post-colonial migrants (with Muslims constituting a large (...) majority) a public debate on the role of religion in Europe has resurfaced as these communities exist outside the historical formation of Western church-state relations and are challenging the very underpinning of what comprises a `liberal' democratic state. In particular, it is the role of Islam in secular Europe that frames several questions in this debate: to what extent is it necessary to regulate religious freedoms in the `public sphere' in order to protect the democratic state? What restrictions on minority religions should be considered `necessary in a democratic society’ and what limitations should be placed on state interference in minority religions as protection against the undue influence of a dominant social group? Against this backdrop, this article explores the historical social formation of religious pluralism in the European context and examines the legal and political frameworks at the national and regional levels to `regulate' diversity. In this paper, I examine several commentaries and glosses on the prolegomenon of Najm al-Dīn al-Kātibī’s (d. 675/1276–77) Shamsiyya that relate to debates on the Aristotelian and Ibn Sīnān theory of science in the postclassical period. Chief among the commentaries of the Shamsiyya is Quṭb al-Dīn al-Rāzī’s (d. 766/1365) Taḥrīr al-qawāʿid al-manṭiqiyya. This commentary, rather than the base text of the Shamsiyya, set the stage for later interpretations by Mirak al-Bukhārī (fl. 733/1332), Naṣīr al-Dīn al-Qāshānī (d. 755/1354), Saʿd al-Dīn al-Taftāzānī (...) (d. 792/1390), al-Sayyid al-Sharīf al-Jurjānī (d. 816/1413), Dāwūd al-Khwāfī (fl. 839/1465) and ʿIṣām al-Dīn Isfarāyinī (d. 945/1538). I focus on three issues that were raised in these interpreta­tions of the Shamsiyya’s prolegomenon: (1) the place of the elements of sciences in logical corpus, (2) the notion of the prolegomenon and its content, and (3) the real essence of a science. I attend to the particular debates and contentions on these issues to reveal the general idea of science at that time. (shrink)

This book approaches the question of technology from an Islamic ethical perspective. The book tries to broaden the scope of the Sharia to deal comprehensively with the ethical questions and dilemmas that arise in the midst of a postmodern technological culture due to the absence of well-defined religious-ethical ends. It looks at the maqasid as a universal ethical theory to be interpreted and applied in the global technological context. In this article we consider the forms of democratic participation that revolve around issues of religious faith and Islam. The context of such work is one in which a concern with the levels of participation in the political institutions of Western Europe and North America feature prominently in both journalistic and academic debate. The article speaks to debates that are concerned with the efficacy of specific forms of participation. In doing so we argue that we need to think carefully (...) about the forms of social action that constitute participation in the democratic process. We also need to think precisely about definitions of the political with which people engage. If we take the political as a domain in which the ethical settlement of society is contestable, the sorts of mobilization around faith communities that this article describes are clearly a form of political participation. Yet the article argues that the reasons many become involved in these forms of social organization in contemporary East London is precisely because they are seen as less complicit with mainstream political institutions of the British state. Philosophy in the Islamic world emerged in the ninth century and continued to flourish into the fourteenth century. It was strongly influenced by Greek thought, but Islamic philosophers also developed an original philosophical culture of their own, which had a considerable impact on the subsequent course of Western philosophy. This volume offers new translations of philosophical writings by Farabi, Ibn Sina, Ghazali, Ibn Tufayl, and Ibn Rushd. This essay presents an analysis of different processes of machine learning: supervised, unsupervised, and semisupervised, through the prism of the epistemologies of several prominent Islamic philosophical schools. I discuss the way each school conceptualizes the ontological absolute (immortality, death, afterlife) and the way this shapes their respective epistemologies. I present an analysis of the different machine learning processes through the prism of the epistemological constructs of each of these philosophic traditions. I conclude with the argument that more scholars from (...) the Islamic philosophical tradition should engage in the debates about the development of artificial intelligence and its implications, given that many Muslim countries are among the leaders in this development and its application in everyday life. In this chapter, I elaborate an idealized type of Islamic philosophy of education and epistemology. Next, I examine the crisis that Islamic schools face in Western societies. This will occur on two fronts: (1) an analysis of the relationship (if any) between the philosophy of education, the aspirations of school administration, and the actual character and practice of Islamic schools; and (2) an analysis concerning the meaning of an Islamic curriculum. To the first issue, I argue (...) that there exists a disjuncture between Islamic educational ideals (as expressed by Muslim philosophers of education), the aspirations of school administrators, and the manner in which Islamic schools operate in practice. Concerning the second item, I argue that Islamic schools, notwithstanding their own insistent claims, must struggle to define what an Islamic education entails that is uniquely distinctive to Islamic schools. Finally, I argue that Islamic educators need to encourage open-minded discussions concerning issues on which there is no settled opinion. I illumine this discussion by drawing upon minority Muslim voices that encourage further dialogue and debate. Above all else, this chapter is an attempt to highlight the challenges that Muslim educators in the West face as they aim to reconcile an idealized caricature of Islamic philosophy of education with the on-the-ground needs of Muslim children socialized in a non-Islamic society. In recent years, the genetic testing and selection of IVF embryos, known as preimplantation genetic testing (PGT), has gained much traction in clinical assisted reproduction for preventing transmission of genetic defects. However, a more recent ethically and morally controversial development in PGT is its possible use in selecting IVF embryos for optimal intelligence quotient (IQ) and other non–disease-related socially desirable traits, such as tallness, fair complexion, athletic ability, and eye and hair colour, based on polygenic risk scores (PRS), in what (...) is referred to as PGT-P. Artificial intelligence (AI) and machine learning–based analysis of big data sets collated from genome sequencing of specific human ethnic populations can be used to estimate an individual embryo’s likelihood of developing such multifactorial traits by analysing the combination of specific genetic variants within its genome. Superficially, this technique appears compliant with Islamic principles and ethics. Because there is no modification of the human genome, there is no tampering with Allah’s creation (_taghyīr khalq Allah_). Nevertheless, a more critical analysis based on the five maxims of Islamic jurisprudence (_qawa'id fiqhiyyah_) that are often utilized in discourses on Islamic bioethics, namely _qaṣd_ (intention), _yaqın̄_ (certainty), _ḍarar_ (injury), _ḍarūra_ (necessity), and _`urf_ (custom), would instead reveal some major ethical and moral flaws of this new medical technology in the selection of non–disease-related socially desirable traits, and its non-compliance with the spirit and essence of Islamic law (shariah). Muslim scholars, jurists, doctors, and biomedical scientists should debate this further and issue a fatwa on this new medical technology platform. (shrink)
