The article analyses the regulation for premature termination of the Parliament in Latvia. The introductory part of the article provides a short characteristic of the Constitution of Latvia - the Satversme adopted in 1922, and outlines the basic principles of legal regulation of the Parliament, i.e. the Saeima. Further chapters of the article analyse historic development of the premature termination of the Parliament. On 15 February, 1922, when the Satversme was adopted, only one mechanism for the premature (...) termination of the Parliament was established there: dissolution of the Saeima. However, relatively recently, in 2009, after a prolonged public discussion another mechanism for the premature termination of the activity of the Saeima was established, which was the recall.1 Both models of the termination of the activities of the Parliament are analysed in the article by specifying the principal differences between them. Along with the analysis of the provisions of the Constitution and theory, the practice of dissolution of the Saeima is characterised as well, because in 2011 the Parliament (the Saeima) was dissolved in a constitutional way for the first and so far the only time in the history of Latvia and extraordinary elections were held. The constitutional system of the Czech Republic, which is established on the principles of a parliamentary form of government, takes into account the possibility of dissolving the Chamber of Deputies of the Parliament of the Czech Republic. The Chamber of Deputies is a chamber to which the government is accountable and this is the chamber in which the major part of the authority of Parliament is concentrated. Parliamentary systems have been also structured according to whether a certain amount (...) of balance of power is preserved between parliament and the government. A typical characteristic of every parliamentary form of government is the possibility for a vote of confidence in the government by parliament, meaning a dependency of the government on the will of parliament. Some parliamentary systems counterbalance this relationship with a greater or lesser possibility for the government of dissolving that chamber of parliament, which votes confidence in it. This makes it possible for the government to be able to more significantly fulfil the role of political leader in a given country and it can actively initiate and form a political state. (shrink)

In 1536 the English Parliament under pressure from Henry VIII and the Lord Chancellor, Thomas Cromwell, gave its consent for the dissolution of the lesser monasteries and abbeys in the king’s realm, and three years later with the sanction of MPs some of the greater religious houses also suffered the same fate. The principal aim of this paper is to assess the importance of this political decision with a view to examining the progress being made in the field (...) of education in England in the middle of the sixteenth century resultant upon this dissolution. The evaluation of the merits and demerits originating from the suppression of the English monasteries is made in terms of both primary and academic education. The answers to these key questions are preceded by a short analysis of the reputation monasteries and abbeys had acquired by that time. Also on a selective basis, some opinions have been presented here to provide an overall picture of the standing of the monks and nuns and their concomitant activities, as perceived through the eyes of English society; the eminent scholars and humanists in particular. Subsequently, before assessing the consequences resulting from the dissolution of the religious houses in England, some consideration is given to the reasoning and rationale which lay behind both Henry VIII and his Lord Chancellor’s political decisions. Uno de los motivos en los que se anuncia esta temática es la relación intersubjetiva de intimidad. Entre otros temas, la novela narra la imposibilidad de establecer un vínculo de intimidad entre los cuerpos. De allí es que se pueda hablar de un modelo narrativo antifenomenológico. El cuerpo propio como instancia fundamental de la enunciación no se instituye en la sede originaria (...) de la significación. Para reconstruir el motivo de la intimidad corporal en el universo ficcional de Nadie nada nunca el trabajo usa como criterio de lectura el concepto de intimidad de Martin Heidegger.: Juan José Saer tells in the novel Nadie nada nunca the dissolution of the Enunciation instance. One of the narrative motive in that this topic reveals is the intersubjective relationship of intimacy. Among other topics, the novel tells the impossibility to set an intimacy bound between the bodies. Hence, it is possible to talk about an antiphenomenological narrative model. The own body as fundamental Enunciation instance doesn´t show itself as the original place of meaning. To bring to light this motive of corporal intimacy in the fictional universe of Nadie nada nunca this paper uses, as lecture criterion, the Heideggerian Concept of intimacy. (shrink)

Debates over the significance of the particle concept, and the problem of locality-how do we represent localized phenomena?-appear to presuppose that particles and observed phenomena are things rather than events. Well-known theorems (Hergerfelt, Reeh-Schlieder), and a recent variant of Hergerfelt's theorem due to David Malement, present a problem of locality only given the tacit appeal to the concept of thing, in fact an individual, in a sense contrary to particle indistinguishability. There is no difficulty with the particle concept per se, (...) but it is a global construction more than one step removed from events actually observed, which are represented by local integrals over self-adjoint field densities. Moral-theoretical categories have almost disappeared from the theoretical vocabulary of sociology. Neither perceptions of legitimacy nor perceptions of injustice, neither moral argument nor normative consensus now play a significant role in explaining the social order. Instead the object of sociological inquiry is understood either according to the pattern of anonymous self-organization processes or as the result of cooperation among strategically-oriented actors; accordingly, the disciplinary role models are biology or economics, whose conceptual models appear suited to explain such a complex process (...) as the reproduction of societies. One may easily get the impression that current sociology wishes to finally bid farewell to the generation of its founding fathers; since from Weber and Durkheim to Talcott Parsons, it was a settled matter that an adequate basic conception of the social world could only be derived using the concepts, models, or hypotheses of moral theory – practical philosophy was, so to speak, the foundation and guiding discipline for classical sociology. After the “Theory of Communicative Action”– the last grand sketch of a complete social theory based on the sources of practical philosophy – all this seems to have been forgotten. In any event, it could until recently appear that with Habermas’ book the tradition of a normatively oriented sociology has come to an end. It is mostly due to the efforts of a small group of researchers in France – which assembled around Luc Boltanski and Laurent Thévenot – that there continues to be a strand within social theory that employs sources of moral philosophy. Having emerged from an internal critique of Pierre Bourdieu's sociology, the works of this highly productive circle, probing ever new directions, seek to explain the integration of our societies through the interplay of different moral convictions.1 The foundational text of this sociological school is the study On Justification, originally published in 1991.2 This book, which has meanwhile also been published in German,3 deserves careful consideration not least because it represents the most interesting attempt of the more recent past to give sociology a basis in moral philosophy. This book presents an original thesis about the notion of sensory experience and of the mind’s architecture, which is grounded in current trends in cognitive science and philosophy of mind. Presented in the form of a dialogue, the book explores some of the psychological and philosophical consequences that the author derives from his proposal.

Due to the dissolution of Parliament, election diate had to be advanced. As parties did not dispose of a long time in order to constitute their candidates-lists, their leadership were compelled to abandon all kinds of consultation of their members. They therefore used the technique of indirect vote, by asking the active militant core to approve a test-list of candidates selected by the leadership.

Cette contribution examine les rapports entre le matérialisme des intérêts que revendique Bakounine dans ses derniers textes et la critique qu’il propose des notions d’intérêt général, de représentation politique et de centralisation dans La théologie politique de Mazzini et l’Internationale (1871). Son objet est de montrer que la prise en compte du rôle social et historique des intérêts rend caduque toute possibilité d’un intérêt général qui viendrait à son tour fonder la légitimité d’une représentation politique dans une assemblée centraliste. La (...) première partie de l’article examine le rapport entre ce matérialisme des intérêts et la conception matérialiste de l’histoire proposée par Marx et Engels. La seconde insiste sur la critique de l’intérêt général comme fiction et sur l’impossibilité qui en découle de toute représentation dans le cadre d’un système centralisé, la reconnaissance de cette impossibilité débouchant même sur une critique du mandat impératif. The topic of this contribution is the tension between the everyday dichotomy of nature and technology and the nanotechnological understanding of the world. It is essential to nanotechnology that nature and technology not be categorically opposed as the manmade and the non-manmade, but rather regarded as parts of a structurally identical whole. After the introduction, I will address three points: In a brief first section I will formulate a few questions and a thesis about the nanotechnological developments that can be (...) expected to come. In the main section I will assess four aspects of everyday understanding of nature and technology that are used to legitimate nanotechnology. Finally I will discuss whether an everyday understanding of nature can be conceived as a critical authority with respect to the nanotechnology program. (shrink)

This article articulates and defends a dissolution of the so-called repugnant conclusion, which focuses on the notion of life worth living figuring both in Parfit's formulation of the repugnant conclusion and in most responses to such a conclusion. The proposed dissolution demonstrates that the notion of life worth living is plagued by multiple ambiguities and that these ambiguities, in turn, hamper meaningful debate about both the issue of whether the repugnant conclusion can be avoided and the issue of (...) whether the repugnant conclusion is actually repugnant. This result does not exclude that some modified versions of the repugnant conclusion may yield valuable insights about the value of populations and the tenability of different axiological/ethical theories. Still, if the proposed dissolution is correct, then the repugnant conclusion rests on an ill-defined notion and we lack the information required to assess the merits of the repugnant conclusion. Freud’s discussion of uncanny [unheimlich] experiences focuses on their peculiar ambivalence. On his view, the uncanny is a paradoxical feeling of both familiarity and alienation. While Freud’s analysis of this paradoxical feeling does succeed in explaining it away, it does little to explain it. One might expect a psychoanalytical demystification of the real experience that is hidden behind the superstitious overtones of uncanny experiences. Instead, the uncanny is attributed rather anti- climactically to the combination of a previous superstition (maintained unconsciously) (...) and an entirely coincidental verification of that superstition. The implication is that there is no uncanny per se. There is no distinctive category of experience, the unique character of which tends to cause or encourage superstitious beliefs; rather, such beliefs are prerequisite to having the experience. In other words, the experience suits the belief, and not vice-versa. The uncanny is the fantasized verification of a repressed fantasy. It involves a breakdown of the reality principle and the projection of beliefs into the external world, rather than a peculiarity of feeling that can be linked intrinsically to a specific category of experience. I do not intend to reject this analysis in its entirety. The basic structure, repression and return, is sound. However, Freud’s analysis of the uncanny, which resolves uncanny ambivalence into the separate categories of consciousness and unconsciousness, merely reinstates the problematical opposition of das heimliche and das unheimliche, familiar and unfamiliar, within the mind rather than in the external world. The coincidence of the two feelings in uncanny experience cannot be explained without an intervening stage between repression and return. I will suggest that Freud’s characterization of uncanniness as the return, in superstition, of the repressed is a misplacement of the experience of uncanniness. The aesthetical feeling is the cause of, but not identical to, the projected superstitions and ideas which surround it. An explanation of the feeling of uncanniness must fall not on the side of the repressed, but on the side of consciousness. The import of my position is that the feeling of uncanniness refers, in a manner of speaking, to something “real,” rather than merely to infantile ideas projected upon the external world. Freud’s explanation makes the unconscious a kind of scapegoat to be blamed for imposing fundamentally irrational beliefs into our interpretation of present experience, in that way preserving a model of the conscious ego as autonomous, fundamentally attuned to reality and ultimately independent of the unconscious. I will argue, on the contrary, that the experience of the uncanny is not merely a falling back into irrational or infantile beliefs, but an experience of a deep disunity in personhood that rightly causes us to question our everyday confidence in the unity, independence, and rationality of our conscious sense of self. The ambivalence of the feeling has its source in an irresolvable ambivalence that can exist in consciousness, and not simply in an analytically resolvable psychical ambivalence between consciousness and the unconscious. This article investigates the efficacy of a form of electoral innovation unique to the island-state of Singapore, the Nominated Member of Parliament scheme, and its impact on democratic governance, in light of the changing political landscape. A comparative perspective will be employed and broader conclusions on electoral engineering will be reached, especially for democratizing countries. Contrary to conventional scholarly wisdom, I argue that the NMP scheme can actually boost democratic representation in the country, considering the changing political landscape in (...) the state previously dominated by a hegemonic party. This is via two ways: firstly, NMPs could better represent the voices of the people at the margins of society and, secondly, they could be better positioned to raise issues that are deemed too to be raised by opposition parties. NMPs can enhance democratic governance by promoting deliberation, accountability, and representation. (shrink)

This study investigates how individuals’ life satisfaction and depression are affected by the dissolution of a steady non-cohabiting intimate relationship. Previous studies have focused more on the consequences of divorce and less on the influence of non-cohabiting relationships on the well-being of the individual. The data for this study were taken from pairfam, a large-scale German panel survey, and were used to estimate fixed-effects panel regression models and impact functions to identify the overall effect of dissolution and trajectories (...) after separation. The study sample comprised 2,631 individuals who were observed over the course of 11,219 partnership years. Based on the results of this study, three main findings were reported. First, the dissolution of a non-cohabiting relationship led to a significant decline in mental health and life satisfaction. Second, the trajectories after dissolution suggest that the decline was only temporary, showing readjustment after 1 year. Third, gender differences were identified, suggesting worse consequences for men who experienced a significant decline in both dimensions and did not readjust in life satisfaction until several years after the dissolution. For women, decreases were only found for life satisfaction, but quick readjustments were observed. (shrink)

Starting from first person experience, I argue that early miscarriage may invoke a sense of loss that is enigmatic and ambiguous, often times complicated by the fact that the topic of miscarriage is culturally silenced. Understanding the frequency of such occurrences of early pregnancy loss (in terms of the “miscarriage iceberg”) adds to the existential need to conceptualize such losses as they bleed into life at its very emergence. The prevalent cultural discourse on loss, even when it deals with ambiguity, (...) is focused upon individuation and personhood, which may complicate the grieving process in the case of early pregnancy loss.In searching for alternative epistemologies to address early pregnancy loss and its consequent grief, I propose the following conceptual pathways to elucidate the nature of this loss. First, early pregnancy loss may be understood in terms of the dissipation of a pregnant constellation, thereby putting less emphasis on losing a “being” but rather a sense of participation. This clarifies the kind of loss involved but does not yet completely explain what kind of relationality is lost. Secondly, the grief involved in early pregnancy loss benefits from the Freudian-inspired theories of Pauline Boss and Judith Butler, who emphasize that grief entails absence and presence (Boss, The myth of closure: ambiguous loss in a time of pandemic and change. W.W. Norton & Company, New York, 2021) as well as a deep loss of identity given the loss of relational ties that inform identity (Butler, Stud Gender Sexuality 4(1):9–37, 2003). This deepens the account of grief but does not precisely address the loss of mere emergent relationality. Thirdly, following Gilbert Simondon’s theory on ontogenesis (Simondon, The genesis of the individual. In Crary J, Kwinter S (eds) Incorporations. Zone Books, New York, 297–319, 1992), pregnancy loss involves losing a bridge to a pre-individual relationality, due to which the formerly pregnant body cannot easily leap “back” into former forms of individuation nor leap forward into a socially recognized altered collectivity. This account is able to clarify the kind of relational loss involved in early pregnancy loss. (shrink)

Several logical puzzles, riddles and problems are defined based on the notion of games in informative contexts. Hintikka argues that epistemology or the theory of knowledge must be considered from the notion of information. So, knowledge cannot just be based on the notions of belief and justification. The present proposal will focus on the logical structure of information, and not only on the quantification of information as suggested by Claude A. Shannon. In many cases, the information bits, although seemingly or (...) factually contradictory, are quite relevant. The paraconsistent systems of logic offer a formalization of reasoning that can support certain contradictions. The well-known “Bar-Hillel–Carnap Paradox” causes embarrassment when it concludes that the informational content of a contradiction would be maximum, opposing the traditional notion that the semantic information must be true, and that contradictions are necessarily false. It is not a survey, still less a textbook, but rather a delineation of what seem to me to have been the areas of fundamental change. The purpose of this research is to present the major factors that lead to ethical dissolution in an organization. Specifically, drawing from a wide spectrum of sources, this study explores the impact of organizational, individual, and contextual factors that converge to contribute to ethical dissolution. Acknowledging that ethical decisions are, in the final analysis, made by individuals, this study presents a model of ethical dissolution that gives insight into how a variety of elements coalesce to draw individuals (...) into decisions that result in the ethical undoing of an otherwise healthy organization. ENRON, TYCO and WorldCom did not happen in a vacuum. Nor can such debacles be explained as simply one or two individuals who were morally corrupt. The ethical breakdowns that occurred in these companies happened over a period of time, involved numerous individuals both inside and outside of the organization, and brought about the implosion of viable companies. Seeking to extend the work of previous researchers, this study attempts to tie together a disparate set of factors into a cohesive explanation of ethical breakdowns in organizations. (shrink)

In a formal theory of induction, inductive inferences are licensed by universal schemas. In a material theory of induction, inductive inferences are licensed by facts. With this change in the conception of the nature of induction, I argue that the celebrated “problem of induction” can no longer be set up and is thereby dissolved. Attempts to recreate the problem in the material theory of induction fail. They require relations of inductive support to conform to an unsustainable, hierarchical empiricism.

This dissertation aims to construct a non-dogmatic defence of common sense. It tries to show why the absence of justification for the judgements of common sense, which the sceptic reveals, does not invalidate them.

This article provides a general, theoretical reflection on the decline of the normative dimension in postmodern societies. Modern societies were the first to recognize themselves as societies, that is, to reflect explicitly on the normative basis of their constitution. With the decline of modernity, societal integration, which was based in part on the collective solidarity borne of an idea of Justice, has dissolved into merely `social' forms of integration, legitimized in terms of a claim to operational perfection. At a purely (...) epistemological level, this results in a profound misunderstanding of the subjective and unitary character of society and social action. The article ends in a plea for the recovery of a reflection on values, understood not just as a change in values, but as a change in the relation to values, necessary to confront the irreducible plurality of the world. There is widespread agreement that we cannot know of a lottery ticket we own that it is a loser prior to the drawing of the lottery. At the same time we appear to have knowledge of events that will occur only if our ticket is a loser. Supposing any plausible closure principle for knowledge, the foregoing seems to yield a paradox. Appealing to some broadly Gricean insights, the present paper argues that this paradox is apparent only.

Throughout the 20th century, market capitalism was defended on parallel grounds. First, it promotes freedom by enabling individuals to exploit their own property and labor-power; second, it facilitates an efficient allocation and use of resources. Recently, however, both defenses have begun to unravel—as capitalism has moved into its “platform” phase. Today, the pursuit of allocative efficiency, bolstered by pervasive data surveillance, often undermines individual freedom rather than promoting it. And more fundamentally, the very idea that markets are necessary to achieve (...) allocative efficiency has come under strain. Even supposing, for argument’s sake, that the claim was true in the early 20th century when von Mises and Hayek pioneered it, advances in computing have rekindled the old “socialist calculation” debate. And this time around, markets—as information technology—are unlikely to have the upper hand. -/- All of this, we argue, raises an important set of governance questions regarding the political economy of the future. We focus on two: How much should our economic system prioritize freedom, and to what extent should it rely on markets? The arc of platform capitalism bends, increasingly, toward a system that neither prioritizes freedom nor relies on markets. And the dominant critical response, exemplified by Shoshana Zuboff’s work, has been to call for a restoration of market capitalism. Longer term, however, we believe it would be more productive to think about how “postmarket” economic arrangements might promote freedom—or better yet, autonomy—even more effectively than markets, and to determine the practical steps necessary to realize that possibility. In the present paper I analyze the theme of death in Gothic Metal songs such as Forever Failure (1995) by Paradise Lost, Everything Dies (1999) by Type O Negative, The Hanged Man (1998) by Moonspell or Gone with The Sin (1999) by HIM. The subthemes I am mostly interested in are the death of anima, the suicide of the self and the universal death. Several Romanian poets – Mihai Eminescu (1850-1889), Iuliu Cezar Săvescu (1866-1903), George Bacovia (1881-1957) and D. Iacobescu (...) (1893-1913), who all have in common the pursuit of nihilism – used death to enhance their nihilist poetical universe. I will trace the aforementioned subthemes in some of their most spectacular poems. (shrink)

I argue that Descartes is not a reductionist about life, but dissolves or eliminates the category entirely. This is surprising both because he repeatedly refers to the life of humans, animals, and plants and because he appears to rely on the category of life to construct his physiology and medicine. Various attempts have been made in the scholarship to attribute a principled concept of life to Descartes. Most recently, Detlefsen has argued that Descartes “is a reductionist with respect to explanation (...) of life phenomena but not an eliminativist with respect to life itself”. I show that all these attempts either result in arbitrariness or force Descartes's wider philosophical project into incoherence. I argue that Descartes's ontological commitments make a principled concept of life impossible, that he does not need such a concept, and that his project ends up more coherent without one. (shrink)
