This article argues for a new interpretation of the realist claim that politics is autonomous from morality and involves specific political values. First, this article defends an original normative source: functional normativity. Second, it advocates a substantive functional standard: political institutions ought to be assessed by their capacity to select and implement collective decisions. Drawing from the ‘etiological account’ in philosophy of biology, I will argue that functions yield normative standards, which are independent from morality. For example, a ‘good (...) heart’ is one that pumps blood well, and a good army is one that it is effective at exerting military force. I then interpret realism’s naturalistic conception of politics as an etiological function of social groups: namely making binding collective decisions under persistent disagreement. I conclude that political institutions should be evaluated realistically by how well they perform this task. Finally, I assess trade-offs between this functional political normativity and other moral values. I conclude that justice, fairness, freedom and equality remain obviously important concerns, but only once the basic political function is secured. (shrink)

Women have historically been prevented from living autonomously by systematic injustice, subordination, and oppression. The lingering effects of these practices have prompted many feminists to view autonomy with suspicion. Here, Marilyn Friedman defends the ideal of feminist autonomy. In her eyes, behavior is autonomous if it accords with the wants, cares, values, or commitments that the actor has reaffirmed and is able to sustain in the face of opposition. By her account, autonomy is socially grounded yet also (...) individualizing and sometimes socially disruptive, qualities that can be ultimately advantageous for women. Friedman applies the concept of autonomy to domains of special interest to women. She defends the importance of autonomy in romantic love, considers how social institutions should respond to women who choose to remain in abusive relationships, and argues that liberal societies should tolerate minority cultural practices that violate women's rights so long as the women in question have chosen autonomously to live according to those practices. In 2010, Martin Loughlin published his opus magnum Foundations of Public Law, the culmination of years of intensive research on the topics of public law and constitutional theory. In Questioning the Foundations of Public Law, Michael Wilkinson and Michael Dowdle put together a rich collection of papers that probe deeply into various facets of Loughlin’s work. In this review article, I critically examine an aspect of this probing, articulated by Wilkinson, to do with the autonomy of the political as (...) the basis of political jurisprudence. I argue that both the probing and Loughlin’s response articulate horns of a dilemma that points to a deeper issue: the epistemological repercussions of the rise of the social sciences as forms of distinctively modern inquiry into the causes of social phenomena, where these include phenomena such as the autonomy of political power in modern states. This article sets out a series of critical reflections on recent and contemporary theoretical literature that makes expansive claims for the status of the political as an autonomous category of social practice in modern society, and it argues that such theories usually rest on rather tautological and self-supporting constructions of society's politicality. To counter this, the article advocates and proposes a social-functional reconstruction of what, precisely, is political in modern society, and it suggests that modern societies are in fact structurally (...) dependent on their ability to reduce the volume of social exchanges that have to be articulated as specifically political. In particular, it asserts that many aspects of the legitimatory grammar of modern societies — especially rights and constitutions — are devices through which societies restrict their political concentration and de-politicize their primary functions. On this basis, the article concludes by proposing a more limited concept of the political that is socio-theoretically adjusted to, and usable in, the evolved form of a modern society. (shrink)

This commentary discusses several problems with the target article by Ceci et al. First, the results admit of an alternative interpretation that undercuts the conclusion drawn. In addition, at a number of points, the research should be supplemented by examining situations in which there is no tenure-granting policy. Finally, 60% of the questions are concerned with whistle-blowing, but the issues involved in such cases make them much less relevant to the assessment of tenure than the authors suppose. In the last two centuries, our world would have been a safer place if philosophers such as Rousseau, Marx, and Nietzsche had not given intellectual encouragement to the radical ideologies of Jacobins, Stalinists, and fascists. Maybe the world would have been better off, from the standpoint of sound practice, if philosophers had engaged in only modest, decent theory, as did John Stuart Mill. Yet, as Ronald Beiner contends, the point of theory is not to think safe thoughts; the point is (...) to open intellectual horizons. In Philosophy in a Time of Lost Spirit, Beiner reflects on the dualism of theory and practice. How should we read Foucault's claims, in his late work, for the relevance of ‘aesthetic criteria’ to politics? What is Foucault's implicit understanding of the nature of aesthetics and the autonomy of the aesthetic sphere? Would an ethics which gave a place to the aesthetic legitimize a politics of manipulation, brutality and aggression ‐ in short, a ‘fascist’ politics ‐ as some of Foucault's critics argue? In this paper, I examine key accounts of the fascist ‘aestheticization (...) of politics’ ‐ from Walter Benjamin's classic essay, ‘The Work of Art in the Age of Mechanical Reproduction’ (1936), to Philippe Lacoue‐Labarthe's work on the relation between Heidegger's philosophy and the fascist theme of politics as the plastic art of the state. Through a discussion of Foucault's late work, the paper demonstrates the connection between Foucault's turn to ancient Greek ethical practices and his call for a contemporary renewal of the idea of ethics as an art of living. The aim of the paper is to show in what ways the ethico‐political position which is presented in Foucault's late work, far from contributing to a fascist politics, in fact provides ways of thinking about the relationship between the aesthetic and the political which avoid both mindless radicalism and totalitarian narcissism. Democracy has been a flawed hegemony since the fall of communism. Its flexibility, its commitment to equality of representation, and its recognition of the legitimacy of opposition politics are all positive features for political institutions. But democracy has many deficiencies: it is all too easily held hostage by powerful interests; it often fails to advance social justice; and it does not cope well with a number of features of the political landscape, such as political identities, boundary disputes, and environmental (...) crises. Although democracy is valuable it fits uneasily with other political values and is in many respects less than equal to the demands it confronts. In The Autonomy of Morality Charles Larmore challenges two ideas that have shaped the modern mind. The world, he argues, is not a realm of value-neutral fact, nor does human freedom consist in imposing principles of our own devising on an alien reality. His aims are much more modest: to sketch a theoretical framework for better understanding what the essence of authority is; to show that the relation between authority and trust is the key to explaining the effect of neoliberal politics on the authority of the university and (...) university professors; to discuss professors' autonomy as deriving primarily from epistemic authority and to point out that what makes professors epistemic authorities is not the truth of what they say, but rather the students' belief that it is true; and to disclose some problems related to authority, university autonomy, and neoliberal politics. An attractive form of social stability is realized when the members of a well-ordered society give that society’s organizing principles their free and reflective endorsement. However, many political philosophers are skeptical that there is any requirement to show that their principles would engender this kind of stability. This skepticism is at the root of a number of objections to political liberalism, since arguments for political liberalism often appeal to its ability to be stable in this way. The aim of this (...) paper is to address skepticism about the stability condition by putting forward a novel defense of it. 'Autonomy' is originally a political notion. In this chapter, I argue that the political theory Kant defended while he was writing the _Groundwork_ sheds light on the difficulties that are commonly associated with his account of moral autonomy. I argue that Kant's account of the two-tiered structure of political legislation, in his _Feyerabend Lectures on Natural Law_, parallels his distinction between two levels of moral legislation, and that this helps to explain why Kant could regard the notion of (...) Unilateral coercive international political, diplomatic, and economic sanctions are regular events of international relations and international law within the landscape of foreign affairs. However, while they may be prescribed by international law, or national legal systems, for peace and security reasons they have also been imposed for political grounds by powerful States such as the United States. The US sanctions are now targeting science, academic and university domains. When applied in this way, these sanctions violate international law, principles of human (...) rights, ethics, the autonomy of scientific institutions, and the norm of universalism in science. All of which protect and promote scientific freedom of expression. It is vital that international and domestic law be correctly applied to uphold proper ethical standards and scientific independence in order to protect the work and the freedom of scholarship. ABSTRACT While democratic states may manipulate public opinion and mobilize society to serve their interests, a focus on such active efforts may distract us from the passive, default condition of ignorance‐based state autonomy. The electorate’s ignorance ensures that most of what modern states do is unknown to “society,” and thus need not even acquire social approval, whether manipulated or spontaneous. Similarly, suggestions that democratic states may be “captured” by societal groups must take cognizance of the factors that enable elites (...) to serve the interests of specific societal groups at the expense of the larger society. Bringing studies of voter ignorance into the analysis of state’s autonomy from society provides a novel approach to the study of democratic states’ autonomy, while also serving to explain how societal “capture” of state policies is possible. This article critically examines the transition from Marx to Spinoza within Antonio Negri’s postoperaist thought and explores a potential alternative rooted in Mario Tronti’s concept of the ‘autonomy of the political’. In Negri’s postoperaismo, the embrace of Spinoza reevaluates Marx’s critique of political economy through an optimistic lens, suggesting a tendency beyond capitalism. However, Negri’s embrace of a Spinozian plane of immanence entails a problematic affirmation of what exists. The article argues that Negri’s worldview, despite its beginnings, ends up (...) resembling deterministic historical materialism. While critical theory exposes flaws in Negri’s theory, it falls short in providing a practical alternative. Returning to Negri’s interpretation of Spinoza’s Political Treatise uncovers earlier arguments, rooted in paradoxes inherent to practical politics. However, reliance on the concept of the multitude highlights deeper issues in Negri’s approach. Rather than adhering to postoperaismo or critical theory, the article suggests an alternative in Tronti’s journey from operaismo, particularly in the concept of the ‘autonomy of the political’. Notwithstanding critiques, this attempted liberation from Marxist determinism allows for a clearer confrontation with politics. The article concludes that Hardt and Negri’s recent critical engagement with this concept advances their arguments but does not entirely overcome inherent limitations in their approach. (shrink)

Friedman presents a well-considered theory of autonomy, usefully elaborating the ways social influence is compatible and incompatible with autonomous action. In its reconciliation of autonomy and gender socialization, Friedman’s account makes important progress in addressing feminist concerns about autonomy. Nonetheless, Friedman could say more about the role of political society, particularly liberal society, in protecting and promoting autonomy.

Political liberals argue that the classical conception of autonomy must be discarded because it is sectarian and metaphysical. This article rejects that a commitment to autonomy necessarily leads to sectarianism and questions the notion that respect for persons is separable from the commitment to autonomy. It defends a Kantian approach to autonomy, as belonging to the standpoint of practical reason, and argues that in this approach autonomy is a norm regulating how we should treat each (...) other as opposed to a good to be promoted. This article contends that the environmental release of genetically engineered (GE) animals with heritable traits that are patented will present a challenge to the efforts of nations and indigenous peoples to engage in self‐determination. The environmental release of such animals has been proposed on the grounds that they could function as public health tools or as solutions to the problem of agricultural insect pests. This article brings into focus two political‐economic‐legal problems that would arise with the environmental release of such (...) organisms. To address those challenges, it is proposed that nations considering the environmental release of GE animals must take into account the underlying circumstances and policy failures that motivate arguments for the use of the modified animals. Moreover, countries must recognize that the UN International Covenant on Civil and Political Rights and the UN International Covenant on Economic, Social and Cultural Rights place on them an obligation to ensure that GE animals with patented heritable traits are not released without the substantive consent of the nations or indigenous peoples that could be affected. The subject matter of the essay is the autonomy of art, which will be analysed from a Jungian perspective. What Jung had in mind with his notion of the independence of the artistic process is its freedom from the conscious mind of an artist, rather than its independence from the current social, political or cultural conditions. Art, according to Jung, is autonomous if it comes from deeper levels of the human psyche, and that is unconsciousness. To test the validity (...) of Jung’s "autonomous complex", I will be checking the empirical reality of artistic creation, by providing professional artists’ accounts of the creative process. Also, I will challenge the categorically laid and the deeply rooted idea of a close link between artistic talent and mental illness, trying to see if the artistic process can be independent of an artist’s psychological state. In Jung’s view, art happens instead of and not because of potential illness of an artist. Additionally, I am going to contrast his view with Freud’s, for whom an artwork is a sublimation of sexual drive or a product of neurosis. This idea was not acceptable to Jung, as he believed in the existence of not only sexual but also art complex. Finally, I will try to argue that Jung’s view is more accurate in the depiction of artistic process than Freud’s and that his emphasis on the autonomy in art, although radical, deserves more attention from scholars in philosophy and psychology of art. Charles Taylor's well-known essay, “Atomism”, criticizes libertarian theories of rights like Nozick's that make individual rights independent of any duties to belong to, support, or obey the law in the society in which those rights are to be enjoyed. Taylor argues that if one grounds rights to important liberties on the human capacity for autonomy, this commits one to the view that the development of autonomy in oneself and others is morally obligatory. Further, Taylor argues that most people (...) cannot develop autonomy in the absence of a certain sort of social and political environment. Hence, if it is morally obligatory to try to develop autonomy in oneself and others, it is also obligatory to belong to, support, and give obedience to those institutions which create the environment in which autonomy can be developed. Given that many people with disabilities have been excluded from political deliberation and subjected to infantilizing and degrading treatment from others, many members of the disability rights movement are understandably critical of policies and practices that speak on behalf of people with disabilities and presume to know what is really in their best interest. Yet, this analysis argues that a general principle of anti-paternalism is not desirable for disability politics. In particular, people with cognitive disabilities are sometimes unable to (...) make important decisions by themselves, and may require assistance from family members or more cognitively able and verbally fluent citizens to make their political voices and choices heard. Drawing from John Locke and Alasdair MacIntyre, this article reconsiders the relationship between paternalism and autonomy, suggesting that autonomous decisionmaking and expression are best thought of as collaborative processes undertaken between people with a range of capacities. It is a commonplace that ‘autonomy’ has several different senses in contemporary moral and political discussion. The term’s original meaning was political: a right assumed by states to administer their own affairs. It was not until the nineteenth century that ‘autonomy’ came (in English) to refer also to the conduct of individuals, and even then there were, as now, different meanings.1 Odd as it may seem from our perspective, one that was in play from the beginning was Kant’s (...) notion of “autonomy of the will,”2 as Kant defined it, “the property of the will by which it is a law to itself independently of any property of the objects of volition” (4:440).3That’s a mouthful, to say the least. Immanuel Kant is often viewed by educational theorists as an individualist, who put education on “an individual track,” paving the way for political liberal conceptions of education such as that of John Rawls. One can easily find evidence for such a view, in “Answer to the Question: ‘What is Enlightenment?’,” as well as in his more metaphysical, moral inquiries. However, the place of reason in Kant’s philosophy––what I call the “autonomy of reason”––spells out a negative rather than positive conception (...) of freedom, from which stems a less individualistic or political liberal education than many presume. I cite both well known and lesser known works in the essay to demonstrate that Kant defended universal freedom only as a means towards developing the “autonomy of reason”, and I consider comparatively the education it entails with that spelled out by Rawls, despite the common conflation of the two. Several philosophers, including most prominently Theodore Benditt, have recently urged that the discourse of rights, widely thought to be a central, if not foundational feature of moral and political thought, is in reality a mere “redundant” appendage---a discourse that holds no distinctive place in moral or legal reasoning owing to the fact that it is thoroughly derivative because collapsible into other forms of moral or legal language. In this paper I attempt to (1) flesh out this “Redundancy” Thesis (RT) and (...) (2) identify and criticize at least two general arguments that might be thought to give rise to it: the claims that rights reduce (respectively) to duties (the Correlativity Thesis) or to permissions (the Permissibility Thesis). I try to show how and why these arguments fail and why they do not therefore support RT. (shrink)
