Increasing evidence from psychology and neuroscience suggests that emotion plays an important and sometimes critical role in moral judgment and moral behavior. At the same time, there is increasing psychological and neuroscientific evidence that brain regions critical in emotional and moral capacity are impaired in psychopaths. We ask how the criminal law should accommodate these two streams of research, in light of a new normative and legal account of the criminal responsibility of psychopaths.

Psychopathy is characterized by pronounced emotional deficits, yet individuals with psychopathic traits generally understand the law and the likely punishments for violating it. Vitacco, Erickson, and Lishner (2013) suggest that because of this appreciation, there is no question that psychopaths are criminally responsible. We make the modest argument that increasing psychological and neurological evidence calls into question whether conventional assumptions about an offender’s culpable states of mind hold true for psychopaths. It is likely, we suggest, that a wide range of (...) deficits found in psychopaths impair their ability to calculate risks of harm and utilize information about the consequences of their behavior. Two experiments involving an international collaboration of experimenters sought to replicate and extend a previously published psi experiment on precognition by Daryl Bem that has been the focus of extensive research. The experiment reverses the usual cause–effect sequence of a standard psychology experiment using priming and reaction times. The preregistered confirmatory hypothesis is that response times to incongruent stimuli will be longer than response times to congruent stimuli even though the prime has not yet appeared when the participant records their (...) judgments. The confirmatory hypothesis for Experiment 1 was not supported. Exploratory analyses indicated that those participants who completed the English-language version rather than a translation showed a significant effect, as was the case in the original study; no significant departure from chance was found in data involving non-English translations. Experiment 2 sought to enhance the predicted effect by having each participant read either a pro-psi or an anti-psi statement at the beginning of the experiment to test the pre-recorded hypothesis that a pro-psi statement would produce a larger effect than an anti-psi statement. The results did not support the primary psi hypothesis and there was no effect in the English-language sample. However, there was mixed support for the effect of the psi statement on performance; those participants who received the pro-psi statement had a greater psi score than those who received the anti-psi statement. As in the original experiment, neither the experimenters’ nor participants’ beliefs were significantly associated with the dependent measure. In sum, the pre-registered confirmatory hypotheses were not supported. William Hasker thinks that his emergent dualism provides a plausible account of the mind’s survival of bodily death, giving it a crucial advantage over physicalism. I do not share this appraisal. Emergentism by its very nature works against the (immediate) survival of death. The analogies that Hasker employs to overcome this initial implausibility fail due to factual errors, and his position ends up in no less a difficult position than the physicalism that Hasker rejects. Hasker’s attempt to escape this (...) difficulty results in what is effectively an abandonment of emergentism, and the adoption of a more traditional dualism. (shrink)

This essay introduces a cluster of articles titled “Devalued Currency: An Elegiac Symposium on Paradigm Shifts.” Eagleton's piece addresses, from a perspective indebted to Walter Benjamin, the notion of Thomas Kuhn that “shifts” in the controlling paradigms of disciplines and practices are entirely transformative not only of their futures but also of their pasts. Benjamin argued that a work of art is a set of potentials that may or may not be realized in the vicissitudes of its afterlife. The true (...) significance of works might be said, therefore, to emerge only after some as-yet-unexpected event or upheaval makes their significance apparent. In this sense, we might argue that historical events make full sense only in the light of “judgment day”; until then, history remains an incoherent chronicle. But the totality that will one day be revealed cannot be anticipated. The past is open-ended because the present is, and meanwhile, the meaning of history is in our hands to change. Since we have that power, Eagleton suggests that we recycle figures of the past as characters in a comedy rather than tragedy. Still, it is never possible to say which figures of the past and which works are ultimately important and which are not, because we cannot say which mutations will result in major developments to come. No work or person is important or peripheral in itself or himself; it is the critic and historian who render them so. (shrink)

Matthew D. Eddy and David Knight’s new edition of William Paley’s Natural Theology deserves to become the standard scholarly edition of what is a historically, theologically, and philosophically important work, despite a certain neglect of philosophical issues on the part of the editors.

Harry V. Jaffa (1918-2015), professor at Claremont McKenna College and Distinguished Fellow of the Claremont Institute, was one of the most influential thinkers of the 20th century. His hundreds of students have reached positions of power and prestige throughout the intellectual and political world, including the Supreme Court and the Trump White House. Jaffa authored Barry Goldwater's famous 1964 Republican Convention speech which declared, "Extremism in the defense of liberty is no vice. And moderation in the pursuit of justice is (...) no virtue." William F. Buckley, Jaffa's close friend and a key figure in shaping the modern conservative movement, wrote, "If you think it is hard arguing with Harry Jaffa, try agreeing with him." His widely acclaimed book Crisis of the House Divided: An Interpretation of the Issues in the Lincoln-Douglas Debates (1959), was the first scholarly work to treat Abraham Lincoln as a serious philosophic thinker. As the earliest protégé of the controversial scholar Leo Strauss, Jaffa turned his theoretical insights to understanding the United States as the "best regime" in principle. He saw the American Revolution and the Civil War as world-historical events that revealed the true nature of politics. Statesmanship, constitutional government, and the virtues of republican citizenship are keys to unlocking the most important truths of political philosophy. Jaffa's student, Glenn Ellmers, was given complete access to Jaffa's private papers at Hillsdale College to produce the first comprehensive examination of his teacher's vast body of work. Charles R. Kesler, an eminent scholar and prodigious editor, has exerted a profound influence on the study of American politics and the practice of American conservatism. A precocious high-school student, he impressed a visiting William F. Buckley Jr. who, before becoming a life-long friend, wrote him a recommendation letter to Yale. Kesler asked for another--to Harvard, where he completed his undergraduate degree and earned a PhD under the legendary professor Harvey C. Mansfield. An early passion for political journalism, played (...) out largely on the pages of National Review, led Kesler to author an NR cover story on his third great influence, Harry V. Jaffa. Kesler became a faculty colleague of Jaffa's at Claremont McKenna College and Claremont Graduate University and is perhaps best known as the editorial helmsman of the Claremont Review of Books. The author of I Am the Change: Barack Obama and the Crisis of Liberalism and Crisis of the Two Constitutions: The Rise, Decline, and Recovery of American Greatness, Kesler also co-edited (with William F. Buckley Jr.) Keeping the Tablets: Modern American Conservative Thought. His edited volume of The Federalist Papers is the best-selling edition version in the country. Richard Rorty places William James in the same category of thinkers as Hegel. These thinkers, he claims, do not believe that philosophical discussion involves any reference to a reality external to their dialogue. Rorty’s claim initially seems justified, for Jamesdoes after all speak of the malleability of reality and insists that reality is part of experience. However, the fact that reality is part of experience does not necessarily mean that it is created by experience. Indeed, James insists that the (...) reality that limits truth is “found, not manufactured,” and the flexibility of truth cannot be attributed to the lack of an external reality but rather results from the interplay of thought and reality in determining truth. Traditionally, analytic philosophers writing on aesthetics have given short shrift to nature. The last thirty years, however, have seen a steady growth of interest in this area. The essays and books now available cover central philosophical issues concerning the nature of the aesthetic and the existence of norms for aesthetic judgement. Glenn Andrew Peoples has criticized my mind-body theory, emergentism or emergent dualism, on the grounds that it does not, as claimed, allow for the possibility of disembodied survival. I show that his criticisms are misplaced. His objections to my scientific analogies for mind-body emergence misstate what was said by the scientific authorities (Roger Penrose and Kip Thorne) on which I rely. And his philosophical argument relies on a definition of emergentism to which I do not subscribe.
