The first major section of the Critique of Pure Reason, the Transcendental Aesthetic, is concerned with the nature of space and time, and with the nature of our representation of them. In interpretations of this part of the Critique, there is a very widespread tendency to present Kant’s discussion of space as attempting to establish that the representation of space is a condition for individuating or distinguishing objects, and that it is on this basis that Kant establishes the apriority of (...) this representation. I believe that this way of interpreting the Aesthetic is wholly misguided. The interpretive tendency I have in mind takes a number of different forms. On one approach, the role of space is to allow us to distinguish objects even if they are qualitatively identical. This represents Kant as making a certain kind of anti-Leibnizian point, one that concerns Leibniz’s principle of the identity of indiscernibles. On another approach, space—or something closely analogous to space—is regarded as essential on account of its role in allowing us to re-identify objects over time. Interpretations of Kant that follow the second approach are largely inspired by Strawson’s discussions of these matters in chapter 2 of Individuals. (shrink)

A conflict within the community of those investigating business ethics is whether decision makers are motivated by an ethics of justice or an ethics of caring. The proposition put forward in this paper is that ethical orientations are strongly related to cultural backgrounds. Specifically, Hofstede's cultural stereotyping using his masculine-feminine dimension may well match a culture's reliance on justice or caring when decisions are made. A study of college graduates from six countries showed that Hofstede's dimension was remarkably accurate in (...) predicating a justice or caring orientation for decision makers from five of the six countries. Plato claimed that morality exits to control conflict. Business people increasingly are called upon to resolve moral conflicts between various stakeholders who maintain opposing ethical positions or principles. Attempts to resolve these moral conflicts within business discussions may be exacerbated if disputants have different communicative styles. To better understand the communication process involved in attempts to resolve a moral dilemma, we investigate the "discourse ethics" procedure of Jürgen Habermas. Habermas claims that an individual's level of moral reasoning parallels the type (...) of communication which that individual typically uses in attempts to resolve conflict. Our research focuses upon the relationship between the communicative style used by participants attempting to resolve a particular moral dilemma involving workplace safety and the level of moral reasoning possessed by those participants. The results of our study suggest that, contrary to Habermas' views, participants with "higher" levels of moral reasoning do not use "discursive" communicative tactics more frequently than participants that possessed "lower" moral reasoning. This paper is a commentary on the focal article by Grafen and on earlier papers of his on which many of the results of this focal paper depend. Thus it is in effect a commentary on the “formal Darwinian project”, the focus of this sequence of papers. Several problems with this sequence are raised and discussed. The first of these concerns fitness maximization. It is often claimed in these papers that natural selection leads to a maximization of fitness and that (...) this view is claimed in Fisher’s “fundamental theorem of natural selection”. These claims are refuted, and various incorrect statements about the meaning and interpretation of the fundamental theorem of natural selection, in this sequence and in other papers by other authors, are discussed. Next, much of the work in this sequence rests on the first Price equation. In the deterministic (infinite population) case this equation is no more than the standard classical equation relating to changes in gene frequencies. In the stochastic case the equation gives the change in gene frequencies as the sum of two terms (the second of which vanishes in the deterministic case). These two terms are of essentially equal importance in the situation considered in the focal article, yet one of Grafen’s results ignores the second term in the stochastic analysis. This is associated with a wavering between deterministic and stochastic analyses and the use of the Price fitness concept and the classical fitness concept. These comments cast doubts on Grafen’s optimization theory. (shrink)

An 11-week hybrid distance learning/personal contact ethics training program, customized for a leading information technology firm, is described in the format of a sequential process. The process is grounded on discourse ethics and the ethics training guidelines premised by the Hastings Institute. Indications from the firm and from the program’s participants are that the training has been beneficial.

With the publication of their first collaborative book Thinking Through Confucius, David Hall and Roger Ames launched a comparative philosophical project juxtaposing American pragmatism and Chinese Confucianism. This essay focuses on the role pragmatic assumptions play in Hall’s and Ames’s announced goal of opening a “new route” into Chinese intellectual history. Hall and Ames aim to teach scholars whose scholarly sensibilities have been formed in the West what they must acknowledge about their own traditions before they can engage Chinese thinkers (...) constructively. After happily acknowledging my own debt to Hall and Ames and defending as hugely helpful the broad arc of their work, this essay raises questions about the way they deploy pragmatic assumptions as tools for “removing the useless lumber” that they claim “block” Western thinkers’ access to Chinese intellectual history. Specifically it argues that the “useless lumber” metaphor is misplaced. (shrink)

Western societies are experiencing a crisis of trust: we no longer enjoy high levels of confidence in social institutions and are increasingly skeptical of those holding positions of authority. The crisis of trust, however, seems paradoxical: at the same time we report greater feelings of mistrust or an erosion of trust in institutions and technologies we increasingly entrust our wellbeing and security to these very same technologies and institutions. Analyzing trust not only will help resolve the paradox but suggests that (...) the crisis entails normative expectations linked to collective identity, and as such, trust can be understood as a public virtue. Foss's critique of van Fraassen's constructive empiricism is shown to be completely wide of the mark (Foss 1984, van Fraassen 1980). Foss misunderstands van Fraassen's use of the terms 'observable', 'phenomena', 'empirical adequacy', and 'epistemic community'. He misconstrues constructive empiricism as making knowledge, and perhaps existence, dependent on the observer. On the basis of this error, he attempts to reduce constructive empiricism to skepticism. None of his criticisms are to the point.

I argue that the framing of environmental justice issues in terms of distribution is problematic. Using insights about the connections between institutions of human oppression and the domination of the natural environment, as well as insights into nondistributive justice, I argue for a nondistributive model to supplement, complement, and in some cases preempt the distributive model. I conclude with a discussion of eight features of such a nondistributive conception of justice.

A common theme of libertarians is that there is a conflict between the values of liberty and equality. Achieving equality, so libertarians often argue, would require frequent interference in individuals’ lives, creating constraints on freedom and obstacles to the development of individuality. Although not himself endorsing a libertarian conception of liberty, Oxford philosopher G.A. Cohen recently has advanced the surprising thesis that there is a tension in Marxist normative thought that in an interesting way parallels the often heard libertarian challenge (...) to egalitarianism. Media representations of illnesses, particularly those associated with stigma such as non-suicidal self-injury (NSSI), not only define health conditions for mass audiences, but generally do so in ways that are consistent with dominant ideologies. This article examines the construction of non-suicidal self-injury as practiced by female adolescents and young adults in four US films: Girl, Interrupted, Painful Secrets, Prozac Nation, and Thirteen. The methodology used to examine the films’ narrative structure is Kenneth Burke’s dramatism, while Julia Kristeva’s concept of abjection (...) informs the analysis. On one hand, a paradigmatic reading suggests that the films frame self-injury as resistance to repressive maternal domination of female adolescents. On the other hand, syntagmatic analysis reveals a privileged response to NSSI in the form of pacification administered by psychotherapists functioning as the return of the phallic-mother fantasy. I apply stigma-management strategies to corporate scandals and expand on past research by (a) describing a particular type ofstigma management strategy that involves accepting responsibility while denying it, (b) delineating types of stigma that occur in scandals (demographic versus character), and (c) considering the moral implications of shifting stigmas that arise from scandals. By emphasizing the distinction between character and demographic stigma, I make progress in evaluating the moral implications of shifting different types of stigma.

Journalists say sometimes that the end does not justify the means, but they can act otherwise. Even if there are only rare instances in which the end can justify the means, some guidelines are needed to determine when those situations exist. I propose six questions for application to this thorny issue and for avoiding extremes of moral laxity and false scrupulosity.

The National Science Foundation (NSF) has, since 1997, attempted to diversify and enrich science research and education in the USA through the Broader Impacts Criterion (BIC), also known as “Criterion Two” or the “Second Criterion”. In doing so, NSF has so successfully integrated BIC into its discovery grant funding programmes that it has become difficult to assess the efficiency (in an economic sense) of BIC activities, as opposed to cataloguing its products (number of trainees, publications, etc.). Moreover, current practice at (...) NSF requires that each and every Principal Investigator receiving a discovery grant address both Science, Technology, Engineering and Math activities and broader impacts, despite the fact that their formal training is most likely to be in only one of these areas. Against this backdrop, I consider NSF spending on broader impacts, conduct a microeconomic analysis of effectiveness of BIC expenditures, and discuss alternative funding models and Principal Investigator profiles and expertise sets that might not only accelerate the goals of expanding NSF's broader impact, but additionally enhance the quality of science funded by this agency. What role should religion play in public discourse? Not long ago Richard Rorty argued, in more than one place, that religion is a "conversation stopper" which polite people refer to only in private conversations. Religious believers complain, however, that this practice renders it impossible for them to participate in public discourse. They ask whether a democratic community is worthy of the name if it effectively forbids (by custom or legislation) a significant segment of its citizens from acknowledging and drawing upon (...) their own traditions to help justify their moral and political claims? This paper draws upon the work of Jeffrey Stout, Robert Brandom, and importantly a Confucian understanding of ritual to argue that Rorty goes too far in arguing that religious assumptions have no place in public discourse. We critique the metaphysical ecology developed by J. Baird Callicott in “The Metaphysical Implications of Ecology” in light of what we take to be the most viable attempt to provide an inclusive theoretical framework for the wide variety of extant ecosystem analyses—namely, hierarchy theory. We argue that Callicott’s metaphysical ecology is not consonant with hierarchy theory and is, therefore, an unsatisfactory foundation for the development of an environmental ethic.

There are at least two notable and distinct literatures on the subject of questions: the educational literature, analyzing questions with a pedagogical upshot in mind, and the philosophical literature, analyzing questions with the concerns of philosophy of language and logic. This paper goes some way towards bridging these literatures by taking a philosophical stance on questions and by examining how a basic treatment of questions as a philosophical theme can greatly aid the introduction of students to the study of philosophy. (...) The foreignness of philosophy to many students means that they enter philosophy courses with many assumptions about it. Discussing their assumptions about questions (e.g. “There are certain questions that should not be asked;” “There are certain questions that cannot be answered”) is a useful way to ease students into philosophical inquiry. This approach also allows for the enrichment of students’ taxonomies of questions. Unlike many other answer-oriented disciplines, philosophy places a high value on the role of questions in inquiry and pays close attention to how different types of questions call for different types of answers. The author defines a number of types of questions (normatively answerable, unanswerable, and defective) and addresses both their philosophical import as well as their value for students. (shrink)

Deception has been practiced by sellers since the beginning of the marketplace. Research in marketing ethics has established benchmarks and parameters forethical behavior that include honesty, full disclosure, equity, and fairness. Deception in marketing, however, has not received the same level of attention. This paper proposes to treat deception in marketing within the context of criminology. By examining deception in marketing within the context of criminology, additional insight can be gained into identifying its antecendents and the likelihood of its occurrence. (...) To this end, deception in marketing is interpreted under the empathy/harm matrix, Cressey’s fraud triangle, and the transparency/time-lag matrix. These frameworks are then combined into a diagram detailing antecedents affecting the likelihood of marketing agents participating in deceptive marketing actions. Summary Mining companies after the Gold Rush depended heavily on foreign expertise, and yet historians of mining have glorified ‘German engineering’ in America. The application of German technology in America was fraught with difficulties, and most advances were micro- rather than macro-innovations, such as Philip Deidesheimer's famous square-set timbering on the Comstock Lode. The problem began at German mining schools, such as the Freiberg Mining Academy, where Americans like Louis and Henry Janin, while they acquired advanced training and adopted an (...) engineering ethos, struggled to learn about Mexican and American mining. Having complemented their course of study to remedy this deficiency, the brothers returned to the US intending to modernize mining on the frontier. Louis attempted the ‘Freiberg Process’ of amalgamation on the Comstock Lode, but locally developed methods proved more feasible, and the experiment failed. He came to apply his training rather toward the micro-level problem of how to reprocess amalgamation waste heaps. (shrink)
