This is a Swedish translation of the complete text of "In Defense of Abortion and Infanticide" from Moral Issues, edited by Jan Narveson, Oxford University Press, Toronto and New York, 1983, 215-233. -/- There are various ways of attempting to defend an extreme liberal view on abortion, according to which a woman always has the right to control what happens inside her own body. First of all, there is the popular view that appeals to the idea that there is a (...) fundamental, underived right that women have to control what occurs within their own bodies. Secondly, there is a related type of philosophical argument advanced by Judith Jarvis Thomson in her famous and oft-reprinted article “A Defense of Abortion” for the slightly weaker claim that while abortion is not always permissible, since, as she says near the end of her essay, it is impermissible in, and only in, the following circumstances: “There may well be cases where carrying the child to term requires only Minimally Decent Samaritanism of the mother, and this is a standard w must not fall below.” Subsequently, Thomson’s type of argument was then developed and defended at much greater length by David Boonin in his very carefully argued book A Defense of Abortion, though Boonin does not discuss the case of the Minimally Decent Samaritan. I believe that there is a strong objection to the Thomson/Boonin approach to justifying abortion. It was set out in an article by Richard Langer, namely, in ‘Silverstein and the “Responsibility Objection”’, Social Theory and Practice 19/3. 345-58. Langer’s discussion is not, in general, very strong, but in a very important paragraph, on pages 351-2, Langer argues that if the responsibility objection to Thomson is unsound, then it follows that there will also be circumstances in which allowing one’s children to die, simply because one no longer wishes to care for them, will also be morally permissible. David Boonin replies to Langer’s objection in his A Defense of Abortion, but in discussing, on pages 182-3, Langer’s point about a parent’s responsibility to his or her children, Boonin relies upon a tacit consent argument that appears open to decisive objections. It seems to me, then, that the only possibility for a successful defense of an extreme liberal view concerning the justification of abortion will have to involve setting out a plausible account of what it is that gives something a right to life, and I think that the right answer is that neo-Lockean persons, and only neo-Lockean persons, have a right to continued existence. This leaves one with the scientific question of when developing humans become neo-Lockean persons. The answer to that question is perhaps still not firmly settled, although the extensive research that I carried out back in the 1970s seemed to me to support the conclusion that it is not until sometime that humans acquire the capacity for thought, a capacity that is necessary if a developing human is to be a neo-Lockean person. The upshot is that if one defends an extreme liberal view on abortion in the only way that seems to be satisfactory – that is, by setting out an account of what it is that gives something a right to life, and arguing that humans before birth do not have the relevant property, one must also address the question of infanticide, and that to fail to do so is intellectually unacceptable. By definition, “logic of postmodernism" would appear to be a contradiction in terms: philosophic post¬modernism emerged as a critique of attempts to found philosophy on some principle of reasoning and to found reasoning on some formal guidelines for how we ought to think. Nonetheless, there are two reasons why Charles Sanders Peirce (1839-1914) ought to be labeled the logician of postmodernism — the philosopher who, more than any other, etched out the normative guidelines for postmodern thinking. The first reason is (...) that Peirce attempted to accomplish the impossible, or at least the contradictory. He launched his philosophic career with a logical critique of "Cartesianism" — his label for the modernist attempt to found philosophy on some formal principles of reasoning. He then attempted to replace the principles of Cartesian reasoning with a set of anti-modernist principles that proved themselves to be as modernist as their contraries. The second reason for giving Peirce his label is that his failures to accomplish the impossible engendered in him something he was unable to achieve willfully: a habit of self-critical yet self-affirming thinking that was neither modernist nor anti-modernist but, rather, a disciplined variety of postmodern thinking. In his later years, Peirce began to sketch out the principles of philosophic postmodernism by describing features of his own emergent habit of thinking. This sketching comes close enough to what I would label a logic of postmodernism — where the method of logic is as postmodern as the thinking it describes. (shrink)

How should disability justice be conceptualised, not by orthodox human rights or capabilities approaches, but by a legal philosophy that mirrors an African relational community ideal? This book develops the first comprehensive answer to this question through the contemporary literature on African philosophy, which is relied upon to construct a legal philosophy of disability justice comprising of ethical ideals of community, human relationships and obligations. From these ideals, an African legal philosophy of disability justice is offered as a criterion for (...) critically evaluating existing laws, legal and political institutions, as well as providing an ethical basis for creating new ones to ensure that they are inclusive to people with disabilities. In taking an alternative perspective on the subject, the book outlines and emphasises the need for a new public culture of obligations owed to people with disabilities, highlighting both the prospects and difficulties of achieving the ideal of disability justice that continues to elude the lived experiences of millions of Africans today. Nudging works through dispositions to decide with specific heuristics, and has three component parts. A nudge is a feature of an environment that enables such a disposition; a person is nudged when such a disposition is triggered; and a person performs a nudged action when such a disposition manifests in action. This analysis clarifies an autonomy-based worry about nudging as used in public policy or for private profit: that a person’s ability to reason well is undermined when she is nudged. (...) Reasoning well is a component of self-guidance, which is an aspect of autonomy and so something there is reason to promote, preserve, or respect. However, a person can reason well when she is nudged: Many of these heuristics are good rules to reason with, and she can be flexible with respect to them when she takes there to be a better way to reason. Along the way, this paper uncovers several design specifications for responsible nudging, and discusses open empirical questions. However, nudging’s being compatible with reasoning well crystallizes a distinct worry about manipulation: that nudge designers can rely on nudged people guiding themselves toward the designers’ own ends. Manipulation of this sort exploits one aspect of autonomy (namely, self-guidance) to undermine autonomy in other respects. (shrink)

"Textual Reasoning" is the name a family of contemporary Jewish thinkers has given to its overlapping practices of Jewish philosophy and theology. This collection represents the most public expression to date of the shared work, over a period of 12 years, of this society of "textual reasoners." Although the movement of textual reasoning is diverse and pluriform, it is characterized at bottom by the pursuit of the claim that there are significant affinities between Jewish forms of reading and reasoning and (...) postmodern thought. These affinities are presently being pursued by scholars throughout Jewish studies, in fields such as Bible, Talmud, Midrash, medieval philosophy, Kabbalah and the Jewish penomenology of Rosenzweig and Levinas among others. As the essays here convey, the work of these scholars has stimulated a lively and creative re-engagement with the philosophical dimensions of Jewish texts and, even more, the textual dimensions of Jewish reasoning. In large part this new energy has come from a conception of the postmodern as a place where some of the most distinctive features of Jewish reasoning can be elucidated as well as challenged. Scriptural Reasoning (SR) is a practice of philosophic theology that is offered as a rationally warranted albeit fallible response to the inadequacies of modern liberal and anti-liberal theologies whether they are adopted as academic projects or as dimensions of lived religious practice. In terms of everyday religious practice in the West today, SR may be characterized as an effort, at once, to help protect Abrahamic folk traditions (that is, of Christianity, Judaism, and Islam) from the cultural and theological effects of (...) residual western colonialism and to help protect religiously pluralist societies in the West from reactionary, anti-modern movements within these traditions. In the terms of recent academic discourse in theology, SR may be characterized as pragmatic, postliberal, scriptural, and inter-Abrahamic. SR may be labeled “pragmatic,” because it employs philosophic reasoning only to identify problems in its practitioners’ communities of everyday practice and in the institutions that are expected to repair them. SR may be labeled “postliberal,” because it emerges as a response to problems in the projects of modern, liberal theology, in particular this theology’s inadequate attention to problems in everyday practice. At the same time, SR is equally critical of anti-liberal theologies, or those that, rejecting the autonomy of human reason, argue for the opposite: grounding all projects of reasoning on a practice of “Christian reasoning” per se (or, comparably, of other confession-grounded reasonings). Unlike anthologies that combine translations by many hands, this volume includes a fully integrated set of translations by a two-person team. The glossary--the most detailed in any edition--explains Aristotle's vocabulary and indicates the correspondences between Greek and English words. Brief notes supply alternative translations and elucidate difficult passages.

Some cognitive processes appear to have “phenomenal” properties that are directly revealed to the subject and not determined by physical properties. I suggest that the source of this appearance is the method by which our brain processes sensory information. The appearance is an illusion. This is the first study of Charles Peirce's philosophy as a form of writing and the first study of his pragmatic writings as a critique of the modern attempt to change society by writing philosophy. According to Ochs, Peirce concluded that his own pragmatism displayed the errors of modernity, attempting to recreate rather than repair modern philosophy. His self-critique - which he called pragmaticism - refashions pragmatism as what Ochs calls a 'pragmatic method of reading': a method of, (...) first, uncovering the conflicting beliefs that generate modern philosophies and, second, recommending ways of repairing these conflicts. Redescribing Peirce's pragmatism as 'the logic of scripture', Ochs suggests that Christians and Jews may in fact re-read pragmatism as a logic of Scripture: that is, as a modern philosopher's way of diagramming the Bible's rules for repairing broken lives and healing societal suffering. This is a genealogical study that traces a “broadly Cartesian” pattern of argumentation: from Augustine’s scriptural semiotic to the “narrowly Cartesian” practice of foundationalism to Charles Peirce’s pragmatic and reparative semiotic. The essay argues (1) that Augustine transformed Stoic logic into a scriptural semiotic; (2) that this semiotic breeds both Cartesian foundationalism and the pragmatic semiotic that repairs it; (3) that Peirce’s semiotic displays the latter. In sum, Augustine’s inquiry risks foundationalism but also breeds a self-corrective “reparative reasoning.” This reasoning (...) is at once scriptural and philosophic. (shrink)
