This paper assesses James M. Buchanan's claim of following a positive approach in stark contrast to the normative approach to public finance of Richard A. Musgrave. The goal of this paper is to shed light on the foundations of modern American public finance by analysing one aspect of the methodology of its two most prominent fathers. I show (1) that it is difficult to distinguish Musgrave's and Buchanan's theories of public goods along the positive/normative dividing line and (2) that Buchanan's (...) theory can also be considered normative. In the first three parts, I follow the Weberian methodological tradition in looking for value judgements in the theories, and by reflecting on the nature of ideal types. In the last part, I propose a broader interpretation of Buchanan's methodological stance within the academic context of the 1960s. (shrink)

Cultural capital and hegemonic masculinity are two concepts that have received intense attention. While both have received serious consideration, critique and analysis, the context or field-specificity of each is sometimes ignored. They have been used in a diversity of ways. Using ethnographic and interview data from a US male bodybuilding community, this study highlights one useful employment. Hegemonic masculinity takes different shapes in different fields of interaction, acting as a form of cultural capital: gender capital. Inherent in this discussion are (...) the cultural contradictions apparent among individuals striving for either physical or ideological embodiments of gender capital. Individuals can attempt to embody hegemonic idealizations, but bodies are not only inscribed with gender, inscriptions are read, and read differently by different social actors and in different settings. The capacity of gender capital to remain elusive is precisely what enables gender practices and projects like bodybuilding to retain passionate participation. (shrink)

This paper aims to deflate the idea that democracy would be in essence a privileged locus of civic trust. Three claims are defended: (1) there is nothing specific to democracy regarding the affirmation that trust is required for social cooperation; (2) democracy, when conceived discursively, depends on guarded epistemic trust and; (3) popular control may require, in some contexts, institutions that express and foster distrust towards a specific section of the population. Viewing emotion from an evolutionary perspective, researchers have argued that simple responses to affective stimuli can be triggered without mediation of cognitive processes. Indeed, findings suggest that positively and negatively valenced stimuli trigger approach and avoidance movements automatically. However, affective stimulus–response compatibility phenomena share so many central characteristics with nonaffective stimulus–response compatibility phenomena that one may doubt whether the underlying mechanisms differ. We suggest an “affectively enriched” version of the theory of event coding (TEC) that is able to account for (...) both affective and nonaffective compatibility, and that can account for the observation that both types of compatibility seem to be modulated by goals and intentions. Predictions from the model are tested in an experiment where participants carried out approach and avoidance responses to either the valence or the orientation of emotionally charged pictures. Under affective instruction the positive-approach/negative-avoid mapping yielded faster responses than the positive-avoid/negative-approach mapping, but no such effect was observed under spatial instruction. Conversely, spatial compatibility effects were obtained under spatial, but not under affective instruction. We conclude that affective and nonaffective compatibility effects reflect the same mechanism. (shrink)

This paper introduces two languages and associated logics designed to afford perspicuous representations of a range of natural language arguments involving adverbs and the like: first-order logic with basic adverbs (FOL-BA) and first-order logic with scoped adverbs (FOL-SA). The guiding logical idea is that an adverb can come between a term and the rest of the statement it is a part of, resulting in a logically stronger statement. I explain various interesting challenges that arise in the attempt to implement the (...) guiding idea, and provide solutions for some but not all of them. This paper presents a conception of corruption informed by epistemic democratic theory. I first explain the view of corruption as a disease of the political body. Following this view, we have to consider the type of actions that debase a political entity of its constitutive principal in order to assess corruption. Accordingly, we need to consider what the constitutive principle of democracy is. This is the task I undertake in the second section where I explicate democratic legitimacy. I present democracy (...) as a procedure of social inquiry about what ought to be done that includes epistemic and practical considerations. In the third section, I argue that the problem of corruption for a procedural conception of democracy is that the epistemic value of the procedure is diminished by corrupted agents’ lack of concern for truth. Corruption, according to this view, consists in two deformities of truth: lying and bullshit. These deformities corrupt since they conceal private interests under the guise of a concern for truth. In the fourth section, I discuss the difficulties a procedural account may face in formulating solutions to the problem of corruption. (shrink)

Traditional whistleblowing theories have purported that whistleblowers engage in a rational process in determining whether or not to blow the whistle on misconduct. However, stressors inherent to whistleblowing often impede rational thinking and act as a barrier to effective whistleblowing. The negative impact of these stressors on whistleblowing may be made worse depending on who engages in the misconduct: a peer or advisor. In the present study, participants are presented with an ethical scenario where either a peer or advisor engages (...) in misconduct, and positive and the negative consequences of whistleblowing are either directed to the wrongdoer, department, or university. Participant responses to case questions were evaluated for whistleblowing intentions, moral intensity, metacognitive reasoning strategies, and positive and negative, active and passive emotions. Findings indicate that participants were less likely to report the observed misconduct of an advisor compared to a peer. Furthermore, the findings also suggest that when an advisor is the source of misconduct, greater negative affect results. Post-hoc analyses were also conducted examining the differences between those who did and did not intend to blow the whistle under the circumstances of either having to report an advisor or peer. The implications of these findings for understanding the complexities involved in whistleblowing are discussed. (shrink)

On doit à l’économiste américain d’origine allemande, Richard A. Musgrave, la formulation des critères d’Équité Horizontale (ÉH) et d’Équité Verticale (ÉV). Étant donnée une base fiscale, l’ÉH veut que les égaux soient traités également, alors que l’ÉV exige que les inégaux soient traités inégalement (par exemple que les plus riches payent proportionnellement plus d’impôts). Musgrave opère en 1959 une redescription créative de considérations d’équité qui ont une longue histoire de Hobbes à Buchanan, en passant notamment par la fameuse maxime de (...) Adam Smith. La reconstruction généalogique montre que l’ÉV et l’ÉH relèvent de la justice distributive au sens aristotélicien du terme. Un critère purement formel, l’équité en matière d’impôt signifie l’égalité proportionnelle dans la répartition des charges communes à tous les individus membres d’une communauté politique. A great need for systematic evaluation of ethics training programs exists. Those tasked with developing an ethics training program may be quick to dismiss the value of training evaluation in continuous process improvement. In the present effort, we use a case study approach to delineate how to leverage formative and summative evaluation measures to create a high-quality ethics education program. With regard to formative evaluation, information bearing on trainee reactions, qualitative data from the comments of trainees, in addition to empirical (...) findings, can ensure that the training program operates smoothly. Regarding summative evaluation, measures examining trainee cognition, behavior, and organization-level results provide information about how much trainees have changed as a result of taking the ethics training. Significant disagreement remains in ethics about the duties we have towards wild animals. This paper aims to mediate those disagreements by exploring how they are supported by, or diverge from, the common-sense ethical principles of non-maleficence, beneficence, autonomy and justice popular in medical ethics. We argue that these principles do not clearly justify traditional conservation or a ‘hands-off ’ approach to wild-animal welfare; instead, they support natural negative duties to reduce the harms that we cause as well as natural positive (...) duties to promote the welfare of wild animals. This article demonstrates how instructors of professionalism and ethics training programs can integrate a professional decision-making tool in training curricula. This tool can help trainees understand how to apply professional decision-making strategies to address the threats posed by a variety of psychological and environmental factors when they are faced with complex professional and ethical situations. We begin by highlighting key decision-making frameworks and discussing factors that may undermine the use of professional decision-making strategies. Then, drawing upon findings from past research, (...) we present the “SMART” professional decision-making framework: seeking help, managing emotions, anticipating consequences, recognizing rules and context, and testing assumptions and motives. Next, we present a vignette that poses a complex ethical and professional challenge and illustrate how each professional decision-making strategy could or should be used by characters in the case. To conclude, we review a series of educational practices and pedagogical tools intended to help trainers facilitate trainee learning, retention, and application of “SMART” decision-making strategies. Nous appuyant sur quelques-uns des principaux textes ayant donné corps à ces théories de la mondialisation, nous retraçons les principaux déplacements du centre de gravité (...) de l'analyse qu'elles opèrent. Prenant acte des apports de ces théories pour la compréhension des processus d'appropriation des flux transnationaux, cet article souligne aussi leurs limites et conclut à la nécessité d'inclure les perspectives de l'économie politique dans l'étude des processus de transnationalisation pour que ceux-ci soient appréhendés dans toute leur complexité.The objective of this paper is to show how, since the late 1980s, theories of cultural globalization, born of a convergence in the Anglo-Saxon academic field between some proponents of cultural studies, anthropology and sociology, marked a break in the way of understanding issues of internationalization of the media. Drawing on some of the main texts that gave substance to these theories of globalization, we trace the main movements of center of gravity analysis they operate. Acknowledging the contributions of these theories for understanding the process of appropriation of transnational flows, this article also highlights limitations and concludes with the need to include the perspectives of political economy in the study of transnational processes that they are apprehended in all their complexity. Heidegger argues that for being x to count as ‘alive’ it must satisfy three metaphysical conditions. It must be capable of engaging in active behaviour with a form of intentional directedness that offers to us a “sphere of transposition” into which we can intelligibly “transpose ourselves.” Heidegger’s discussion of these conditions, as they apply to the being of animals, is well-known. But, if his argument is sound, they ought also to apply to the being of plants. Heidegger, unfortunately, does not (...) supply this part of his ontology of life in any systematic detail. However, my thesis is that it is possible to interpret the nature and activities of plants, along the lines of –, and thus to make good on Heidegger’s omission. The key to this reconstruction is a reconceptualization of plant movements as constituted by a form of representationally blind, motor-intentionality. (shrink)

This paper offers a revised political conception of human rights informed by legal pluralism and epistemic considerations. In the first part, I present the political conception of human rights. I then argue for four desiderata that such a conception should meet to be functionally applicable. In the rest of the first section and in the second section, I explain how abstract human rights norms and the practice of specification prevent the political conception from meeting these four desiderata. In the last (...) part of the paper, I argue that full-fledged tolerance in the international order – that is tolerance-as-non-intervention and tolerance-as-respect – should be attached to (1) compliance with jus cogens norms and to; (2a) a political community recognizably organized as a community of inquiry that is; (2b) committed to the specification and incorporation or expression of the idea of human rights within its local legal system. Gillian Russell has recently proposed counterexamples to such elementary argument forms as Conjunction Introduction and Identity. These purported counterexamples involve expressions that are sensitive to linguistic context—for example, a sentence which is true when it appears alone but false when embedded in a larger sentence. If they are genuine counterexamples, it looks as though logical nihilism—the view that there are no valid argument forms—might be true. In this paper, I argue that the purported counterexamples are not genuine, on the grounds (...) that they equivocate. Having defused the threat of logical nihilism, I argue that the kind of linguistic context sensitivity at work in Russell’s purported counterexamples, if taken seriously, far from leading to logical nihilism, reveals new, previously undreamt-of valid forms. By way of proof of concept I present a simple logic, Solo-Only Propositional Logic, designed to capture some of them. Along the way, some interesting subtleties about the fallacy of equivocation are revealed. (shrink)

Cependant, la protection des données personnelles destinées à être publiées reste difficile techniquement. Cet article a (...) pour objectif de décrire une attaque minimaliste qui a été réalisée en 2014 sur un jeu de données protégé par l’application d’un algorithme de pseudonymisation. L’originalité de cette attaque réside dans sa simplicité de fonctionnement – elle ne nécessite pas d’accès à un jeu de données auxiliaire – et dans sa cible – l’algorithme de pseudonymisation. Nous présentons la famille des algorithmes de pseudonymisation, décrivons et analysons l’attaque, et concluons sur la place de la pseudonymisation dans le Règlement Général sur la Protection des Données personnelles. State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team’s larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious (...) wrongdoing by physicians. Hydraulic fracturing ('fracking') has enabled the recovery of previously inaccessible resources and rendered new areas of the underground 'productive'. While a number of studies in the US and UK have examined public attitudes toward fracking and its various impacts, how people conceptualise the deep underground itself has received less attention. We argue that views on resources, risk and the deep underground raise important questions about how people perceive the desirability and viability of subterranean interventions. We conducted day-long deliberation workshops (two (...) in each country), facilitating discussions among diverse groups of people on prospective shale extraction in the US and UK. Themes that emerged in these conversations include seeing the Earth as a foundation; natural limits (a greater burden than the subsurface can withstand versus simply overuse of natural resources); and ideas about the fragility, instability and opacity of the deep underground. We find that concerns in both countries were not limited to specific, localised impacts but also addressed ecosystem links between surface and subsurface environments and broader questions about the use, identification and value of natural resources. This paper examines an ideology I call techno-colonialism. I argue that techno-colonialism represents an attempt to selectively reproduce settler colonial practices adjusted to twenty-first century realities. This argument has implications for contemporary settler colonialism, the radical right, and climate change politics. In what follows, I discuss the techno-colonial doctrines of Nick Land, Curtis Yarvin, Peter Thiel, and Patri Friedman. These figures articulate a political theory about exploiting new technologies to escape the state and found new societies. To explore techno-colonial ideology, (...) I focus on Seasteading—the practice of creating floating city-states to colonize the ocean––as an attempted realization of techno-colonial ideals. As I claim, techno-colonialism attempts to humanize the politics of settlement. But I argue that techno-colonialism's ambitions fail, and techno-colonialism fails to create a harmless politics of settlement. I conclude that we should be attentive to the relations of political and economic power in which such exit projects are embedded. Moreover, this paper also promotes our understanding of climate change and the radical right's politics. While scholars most naturally associate the radical right with climate change denialism, the techno-colonists illustrate another possibility. They welcome catastrophe, and see rising-sea levels as an opportunity to start society afresh. (shrink)

Im Fokus steht der Umgang mit dem kosmopolitischen Erbe der Aufklärung im 19. und frühen 20. Nikolai Lossky is key to the history of the Husserl-Rezeption in Russia. He was the first to publish a review of the Russian translation of Husserl’s first volume of the Logische Untersuchungen that appeared in 1909. He also published a presentation and criticism of Husserl’s transcendental idealism in 1939. An English translation of both of Lossky’s publications is offered in this volume for the first time. The present paper, which is intended as an introduction to these documents, situates Lossky within (...) the Rezeptionsgeschichte of Husserl in Russia and explains why he is central to it. It also explains what Lossky principally found in Husserl: he saw in the latter’s critique of psychologism support for his own ontology, epistemology, and axiology. Lossky characterizes his ontology as an ideal-realism. According to ideal-realism, both the realm of ideal beings and the realm of real beings are mind-independent. Per his epistemology, which he calls “intuitivism,” real beings are intuited by sensual intuition and ideal beings by intellectual intuition. The realm of ideal beings includes the subrealm of values, which is intuited by axiological intuition. This thoroughly realist conception contrasted sharply with the subjectivist tendencies of the time. So, when Lossky took cognizance of Husserl’s critique of psychologism, he thereupon found an ally in his battle against the various subjectivisms. But, when Husserl took the transcendental idealist turn, Lossky was at the forefront of the backlash against the new direction Husserl wanted to give to phenomenology. (shrink)

Political philosophy was once dominated by discussion of the virtues of character and their importance to the good life and the good society. Contemporary political philosophers, however, following the towering influence of John Rawls, have primarily focused on a single virtue of institutions: justice, while largely avoiding controversial claims about the good life. As a result, political philosophy lacks a unified account of the virtues of institutions and the virtues of character. More importantly, we lack an understanding of the connection (...) between the just society and the good life. This book begins to mend this broken seam, which, on reflection, lies at the heart of our deepest political problems. The book’s central argument is that the virtues of character require institutions, while good institutions enable persons to live together virtuously. Political institutions are a necessary precondition for the moral agency exhibited by the virtues. But good institutions enable virtue to grow, while helping to constrain the excesses of vice. On this view, justice emerges primarily as a virtue of character, not institutions. The just person balances conformity to existing institutional norms with practically wise reforms. Ultimately, this book concludes that the just society and the good life are linked through the common good of virtuous activity within the shared institutions of a political community. (shrink)

Opposition to university fees is often framed as a defence of higher education as a 'right' rather than a 'privilege'. However, the basis and nature of this right is unclear. This article presents a conceptual exploration of the question, drawing on an initial analysis of international law. This is a translation from Bulgarian into English of Nikolai Lossky’s “Razlichniiat smisul na dumata intuitsiia” (“The Different Senses of the Word Intuition”), published in the Sofianite journal Filosofski pregled (Philosophical Review), 1931, year III, book 1, pp. 1–9. In this article, solicited by the journal’s editor-in-chief, the Bulgarian philosopher Dimitar Mihalchev, Lossky surveys the different ways in which the word “intuition” (intuitsiia) has been used throughout the history of philosophy: Kant, Fichte, Schelling, Hegel, Friedrich Jacobi, Ivan Kireevski, Alexei Khomyakov, (...) Vladimir Solovyov, Bergson, Husserl, and Hans Driesch. Lossky then situates his own use of the word within this philosophical tradition and compares his intuitivism with gnoseologies similar to his own, namely, those of Semyon Frank, Johannes Rehmke, Max Scheler, Paul Linke, Dimitar Mihalchev, the English realists (Samuel Alexander and John Laird), the American realists (Edwin Holt, Walter Marvin, William Montague, Ralph Perry, Walter Pitkin, and Edward Spaulding), and the Neo-Scholastic Josef Gredt. As such, the article makes a valuable addendum to his Obosnovanie intuitivizma (The Foundation of Intuitivism) (1906) and provides a helpful synopsis of his theory of knowledge, which, in accordance with the Russian terminological tradition, he calls “gnoseology”. This article addresses a paradoxical stance taken by young straight men in three groups who identify aspects of themselves as “gay” to construct heterosexual masculine identities. By subjectively recognizing aspects of their identities as “gay,” these men discursively distance themselves from stereotypes of masculinity and privilege and/or frame themselves as politically progressive. Yet, both of these practices obscure the ways they benefit from and participate in gender and sexual inequality. I develop a theory of “sexual aesthetics” to account for their (...) behavior and its consequences, contributing to a growing body of theory regarding the hybridization of contemporary masculinities and complicating theories of sexual practice. I argue that the unthought philosophical bias in favor of seriousness and sense rather than nonsense and joking blocks the path to reality. Because of this bias we obsess over significant signs and forget to consider what signs are signs of; we lose sight of the forest because there are so many interesting trees. Through a thoroughgoing interrogation of signs or appearances, we can reveal what it is that all signs present or represent: the underlying real joke. Once the “sensible (...) bias” of philosophy is overcome and the sense of nonsense restored, we can reveal the object of ontology—the Kantian noumenon—and, therefore, understand the necessary order of signification or representation. In this way, I argue, we can come to be equally amused by all appearances, recognizing that their deceptive character is necessitated by the playful nature of the real thing which, qua joke, provokes amusement.
