Sinceits founding by Jacques Waardenburg in 1971, Religion and Reason has been a leading forum for contributions on theories, theoretical issues and agendas related to the phenomenon and the study of religion. From time to time the series publishes volumes that map the state of the art and the history of the discipline.

A Ricoeurian hermeneutic affords readers of the Old Testament an opportunity to access the biblical text anew as a source and norm for faith. Reese gave a convenient summarising description of Ricoeur’s hermeneutical approach. Ricoeur organised his considerations around four poles, namely distanciation, objectification, projecting of a world, and appropriation. These operate as the structuring considerations of a Ricoeurian hermeneutic and were illustrated with a sample proverb from the collection Proverbs 10:1–15:33.

The paper provides an overview of the hermeneutic and phenomenological context from which the idea of a “constitutional analysis” of science originated. It analyzes why the approach to “hermeneutic fore-structure of scientific research” requires to transcend the distinction between the context of justification and the context of discovery. By incorporating this approach into an integral “postmetaphysical philosophy of science”, I argue that one can avoid the radical empiricism of recent science studies, while also preventing the analysis of science's discursive practices (...) from collapsing into the frames of radical anti-epistemological critique mandated by some hermeneutic philosophers. In this article, I examine various aspects of the application of Heidegger's motif of interpretative articulation (the core phenomenological motif of existential analytic) to the constitutional analysis of meaningful objects in scientific research that are contextually ready-to-hand. It is my contention that not only the concepts of the ‘fore-structure of understanding’ and the ‘as-structure of interpretation’, but also the extended concepts of the ‘hermeneutic fore-structure of meaning constitution’ and ‘characteristic hermeneutic situation’ are the keys to understanding the interpretative nature of (...) scientific research. The paper applies the constitutional analysis of hermeneutic phenomenology to several phenomena of scientific research—constitution of meaningful objects, situational fulfilment of a domain's general project, production of a domain's thematically given objects, implementation of readable technologies to what is contextually ready-to-hand, reading hypothetical theoretical objects, and exegetical textualizing within interrelated practices. The study is supplied with exemplary illustrations from enzymology and biochemistry. The correlation between a domain's interpretative articulation and the appropriation of research possibilities within the research everydayness is addressed. Special attention is paid to the belief in and reading of intracellular enzymes as hypothetical theoretical objects. (shrink)

According to Miranda Fricker, a hermeneutical injustice occurs when there is a deficit in our shared tools of social interpretation, such that marginalized social groups are at a disadvantage in making sense of their distinctive and important experiences. Critics have claimed that Fricker's account ignores or precludes a phenomenon I call hermeneutical dissent, where marginalized groups have produced their own interpretive tools for making sense of those experiences. I clarify the nature of hermeneutical injustice to make room for hermeneutical dissent, (...) clearing up the structure of the collective hermeneutical resource and the fundamental harm of hermeneutical injustice. I then provide a more nuanced account of the hermeneutical resources in play in instances of hermeneutical injustice, enabling six species of the injustice to be distinguished. This chapter is concerned with hermeneutics, and Martin Heidegger presents a precise and comprehensive outline of the hermeneutical tradition. Edmund Husserl's understanding of the phenomenological attitude is nearly connected to his understanding of phenomena. Gadamer's step beyond Heidegger's conception of phenomenon has a decisive advantage. According to Gadamer's conception, the deictic correlation is only a ‘phase’ in understanding; the hermeneutical and phenomenological orientation to texts could discern it as the basic structure of hermeneutical phenomenology. Paul Ricœur's hermeneutical phenomenology has (...) no phenomena. Phenomenality is more like a pattern of transparence and obscurity, of surface and depth, of denseness and distinctive structures. This essay addresses structural violence against Latinas by looking at the existential toll different forms of cultural violence take on us. In particular, it looks at linguistic violence and the role lesser-known violences play in the intergenerational continuation of colonial violence, such as hermeneutic violence. Defined as violence done to systems of meaning and interpretation, hermeneutic violence is discussed at length in relation to the experience of harm and injury. The essay further explores some resistant epistemic practices Latina feminists (...) have generated to address systemic violence. The significance of critical phenomenology for psychiatric praxis has yet to be expounded. In this paper, I argue that the adoption of a critical phenomenological stance can remedy localised instances of hermeneutical injustice, which may arise in the encounter between clinicians and patients with psychosis. In this context, what is communicated is often deemed to lack meaning or to be difficult to understand. While a degree of un-shareability is inherent to subjective life, I argue that issues of unintelligibility can be (...) addressed by shifting from individualistic conceptions of understanding to an interactionist view. This takes into account the contextual, historical and relational background within which meaning is co-constituted. I conclude by providing a corrective for hermeneutical injustice, which entails a specific attentiveness towards the person’s subjectivity, a careful sensitivity to contingent meaning-generating structures, and a degree of hermeneutical flexibility as an attitude of openness towards alternative horizons of possibility. Miranda Fricker’s account of hermeneutical injustice and remedies for this injustice are widely debated. This article adds to the existing debate by arguing that theories of recog- nition can fruitfully contribute to Fricker’s account of hermeneutical injustice and can provide a framework for structural remedy. By pairing Fricker’s theory of hermeneutical injustice with theories of recognition, I bring forward a modest claim and a more radical claim. The first concerns a shift in our vocabulary; recognition theory can give a (...) name to the seriousness of the long-term effects of hermeneutical injustice. The second claim is more radical: thinking of hermeneutical injustice as preventing what I call “self-recogni- tion” provides a structural remedy to the phenomenon of hermeneutical injustice. Because hermeneutical injustice is first and foremost a structural injustice, I contend that every virtue theory of hermeneutical justice should be complemented by structural remedies in terms of recognition. Finally, what I argue sheds light on the seriousness of cases of exclusion of and discrimination against women in academia and helps to draw our attention to new ways to combat such problems. When people respond to chants of “Black lives matter” with “All lives matter” or excoriate Colin Kaepernick for being “anti-military” or “anti-American” when he sits or kneels during the playing of the national anthem, there appears to be a break in understanding. BLM protestors and Kaepernick understand their actions and messages in one way, detractors in quite a different way. This presents an interpretive challenge. In this essay, I aim to explore the nature of this interpretive challenge by illuminating the (...) various obstacles that leave us without understanding. I will refer to such breaks in understanding as hermeneutical impasses. First, I sketch a taxonomy of hermeneutical impasses. I then discuss various ways of describing the notion of ‘understanding’ that may be at issue in impasses. Next, I discuss the relation between power and hermeneutical impasses, showing some of the ways power relations constrain our discursive practices. I conclude by arguing the structures of our environment make hermeneutical impasses difficult to avoid, if not inevitable. (shrink)

In addition to opening a fertile field for inquiry in analytical social epistemology, Miranda Fricker’s work has provided powerful conceptual tools that merge descriptive capacity and political potency. For this reason, over the last fifteen years, the conceptual repertoire introduced by the author has been well received in both academic and political arenas. At times, the concepts of both testimonial and hermeneutical injustice acquire excessive dimensions in the literature, and this undermines, on the one hand, their analytical precision and, on (...) the other, their usefulness. In this paper I argue against Fricker’s structural parallelism thesis and defend an independent treatment of each of these concepts. On this basis, to counteract the hyperinflation of the concept of hermeneutic injustice, I proceed with an exercise of conceptual precision. To this end, I identify the conditions that make hermeneutic injustice both unjust and hermeneutic. Finally, I present theoretical and practical reasons to encourage the rigorous use of these concepts. (shrink)

Written by the philosopher and theologian Friedrich Schleiermacher as a method for the interpretation and textual criticism of the New Testament, it develops ideas about language and the interpretation of texts that are in many respects still unsurpassed and are becoming current in the contemporary philosophy of language. Contrary to the traditional view of Schleiermacher as a theorist of empathetic interpretation, in this text he offers a view of understanding that acknowledges both the (...) structurally and historically determined aspects of language and the need to take account of the activity of the individual subject in the constitution of meaning. This article presents a qualitative research about the way in which business leaders of a retail company gradually clarify the ethical responsibilities of their company – in an ongoing discussion of particular cases. It is based on 12 years of experience as an external member of the ethics committee. The aim of the article is not so much as to evaluate the different single decisions that were made and implemented to make the company meet high ethical standards, but rather to (...) focus on three issues and on how they relate to each other: (1) the shift from a communitarian Christian set of values to a broader secular framework of basic principles; (2) the way in which business people in a retailing company cope with issues that seem ethically troublesome, when reflected upon from a ethical point of view; and (3) how the process of ethical dialogue has led to a typology of the different levels of responsibility that retailers are willing to attribute to themselves according to the kind of problem at stake. The three issues together illustrate how a company that took the business ethics question head-on systematically moved into a particular ongoing collective learning process. (shrink)

The scientific transformation of the hermeneutic art has been the common goal for the various formalist-structuralist programs of interpretation that have dominated human studies in our century - such as New Criticism in literary analysis, the formalist programs in art history and musicology, the Gestalt and Freudian psychology, structuralism in linguistics and anthropology, etc. In this volume, these formalist-structuralist programs shall be called structural programs of interpretation in Europe and America.

Philosophical hermeneutics provides a model of interreligious dialogue that acknowledges the interpretive variability of truth claims while maintaining their relation to a preinterpretive reality. The dialectic and tensive structure of philosophical hermeneutics directly parallels the tension between the diversity of belief and the ultimacy of the sacred. By placing philosophers like Gadamer, Ricoeur, Peirce, and Whitehead in conversation, J. R. Hustwit describes religious truth claims as coconstituted by the planes of linguistic convention and uninterpreted otherness. Only when we (...) recognize that religious claims emerge from a dalliance back and forth across the limits of the understanding can we appreciate the engagement between religions. In terms of dialogue, this approach treats religious truth claims as tentative hypotheses, but hypotheses that are frequently commensurable and rationally contestable. Interreligious dialogue goes beyond facilitating bonhomie or negotiating tolerance; dialogue can and should be a disciplined space for rationally adjudicating claims about what lies beyond the limits of human understanding. Hermeneutics is usually defined as the theory and practice of interpretation. As a discipline it involves a long and complex history, starting with concerns about the proper interpretation of literary, sacred, and legal texts. In the twentieth century, hermeneutics broadens to include the idea that humans are, in Charles Taylor’s phrase, ‘self-interpreting animals’ (Taylor, 1985). In contrast to the narrowly prescriptive questions of textual interpretation, philosophical hermeneutics, as developed by thinkers like Heidegger, Gadamer, and Ricoeur, raises questions (...) about the conditions of possibility for human understanding — not how we should interpret or understand something, but what interpretation and understanding are and how they work. For the nineteenth-century philosopher Wilhelm Dilthey, the hermeneutical disciplines were very different from the disciplines of science, including the newly emerging science of psychology. In contrast to psychology, which, in part, attempts to explain the natural behaviour of human animals in causal terms, Dilthey (1926) thinks of the hermeneutical disciplines as attempting to under- stand the behaviour of human persons in terms of their experience and inner motivation. While people have a remarkable facility for understanding often hugely complex forms of communication and interaction in everyday cultural and social contexts, from the structures of symphonic works to what their partner means when they say “I don't understand Brahms”, philosophical analysis seeks to isolate one form of understanding as if it were the key to all others. In order to become language, noises and marks have to be in a manner in which non‐linguistic things are not. The essential divide (...) in contemporary approaches to these concerning language and understanding lies between those, who think that a theory of meaning must also give us an account of the notion of truth without presupposing an understanding of truth, and those, like Heidegger, who think truth must in some way be presupposed. The article suggests that in the digital world, material hermeneutics needs to be updated as it shifts from a scientific to an everyday technological context. Now, technologies not only “give voice” to things, they also produce new meanings to informational structures and direct users to certain meanings. When it comes to digital technologies, especially those involving artificial intelligence (AI), the technology actively mediates the world. In postphenomenological terms, it possesses a technological intentionality. The postphenomenological formula should be updated to reflect this type of technological intentionality, by reversing the arrow of intentionality so that it points to the user, rather than from the user. This study proposes a philosophical foundation for a Human Science research approach to psychological phenomena. The author examines the ground and origin of phenomenological thought by returning to the concept of Logos as founded by Heraclitus . The tensions between a descriptive and an interpretive approach to phenomenological research are exposed with the author arguing on behalf of the latter as more properly affirming the logic of "phenomenology" as rooted in the Greek terms . ;Heidegger's conception of language and (...) class='Hi'>hermeneutics are examined with the author exposing Heidegger's "creative misreading" of Heraclitus' concept of Logos. The study suggests that a return to Heraclitus reveals Logos to mean "the hidden and logically structuring meaning" underlying a phenomenon. Arguing on behalf of the primacy of the hidden and latent as primordial to a phenomenological conception of Truth, the author suggests that a Human Science research approach to man must assign a key and central role to Freudian concepts and theory in order to do full justice to the human dynamism of man. ;Pondering phenomenological theory of language as developed by Heidegger, the author surveys the philosophical underpinnings of Jacques Lacan's "return to Freud." The author argues Lacan as most rigorously providing a philosophical framework for psychoanalysis and for affirming a phenomenological conception of language as rooted upon Heideggerian ontology and Heraclitus' concept of Logos Ricoeur's work is identified as setting the stage for a hermeneutical research praxis guided and informed by psychoanalytic theory. Ricoeur's theory of interpretation is analyzed, his neglect of the concept of the signifier as developed by Lacan highlighted. Lacan's reading of Freud in particular is argued as providing the Human Sciences with a valuable framework to better guide its research strategies. The author argues on behalf of the relevance of Lacan's conception of the signifier for a hermeneutical research praxis guided and informed by the notion of Logos. The author concludes by suggesting that the Human Sciences, and psychoanalysis and phenomenology by extension, should look to the concepts of lack, absence and death, in order to approach the Being and psychological life of man in a more genuinely depthful way. The essay reflects on Gadamer’s ambiguous legacy for the philosophy of work. On the one hand, there are times when Gadamer reproduces the problematic distinction between language and labor which short-circuits the very idea of a hermeneutics of work. This is particularly evident in Gadamer’s reflections on technique and craftsmanship in the central sections of Truth and Method, as well as in his descriptions of the “art” of dialogue and the tasks of hermeneutics that separate them emphatically them (...) from the sphere of “making.” I raise some questions about the adequacy of the distinction Gadamer draws between techne and phronesis that structures this account. I argue here that Gadamer’s characterization of the learning process involved in the mastery of a technique, as well as his conception of the instrumentality and monologicality of technical knowledge, is difficult to sustain, especially in view of recent research in the psychology and anthropology of work. I then go on to point out that elsewhere in his oeuvre Gadamer himself is critical of the conception of work that emerges through the lens of the techne / phronesis distinction. Indeed, on these occasions he hints at a conception of work that points beyond the Arendt / Habermas conception towards a critical hermeneutics of working life. This alternative approach to work is particularly apparent in Gadamer’s appropriation of Hegel’s dialectic, in his understanding of play, and in some of his later diagnostic reflections on the spirit of the age. In section four, I offer some suggestions for explaining how the tensions evident in Gadamer’s approach to work came about. Here I am interested in what prevented Gadamer from embracing whole-heartedly the project of a hermeneutics of work that he himself helped to lay the foundations for. I conclude with some brief remarks on why we should seek to build upon these foundations and renew the project of a critical hermeneutics of work today. (shrink)

In this article, the author deals with the status of the self and personal identity in the digital milieu. In the first section, he presents his general approach to digital media and technologies, which he has called “digital hermeneutics”. He distinguishes between three perspectives in digital hermeneutics, namely the deconstructive, epistemological, and ontological approaches. In the second part, he focuses on digital hermeneutics as hermeneutics of the self. He compares Paul Ricoeur’s narrative identity to Pierre Bourdieu’s (...) habitus. His first thesis is that the habitus can be seen as a concept of subjectivation that neglects an important part of the subject. Narrative identity offers, in this sense, a remedy to such negligence. His second thesis is that today’s digital media and technologies are closer to the Bourdieusian habitus than to the Ricoeurian narrative identity. In other words, digital machines and technologies are “habitus machines” both in their structure and in their effects. In the conclusion, the author accounts for three potential responses to the habituation of our selves online. He also introduces the concepts of “digital agency” and “digital citizenship”. (shrink)

Of Aristotle’s core terms, potency (dunamis) and actuality (energeia) are among the most important. But when we attempt to understand what they mean, we face the following problem: their primary meaning is movement, as a source (dunamis) or as movement itself (energeia). We therefore have to understand movement in order to understand them. But the structure of movement is itself articulated using these terms: it is the activity of a potential being, as potent. This paper examines this hermeneutic circle, and (...) works out a strategy for reading Aristotle based on his conception of our epistemological predicament. This hermeneutic approach helps us gain access to the phenomena of movement and its sources (potency, and energeia). The paper closes with a review of the conceptual resources we deploy to think about movement: homogeneity, space and time, impulse, relativity, the blend of sameness and difference, and being and non-being. Showing that Aristotle uses none of these clears the landscape for a fresh inquiry into his account of movement. (shrink)

1 Introduction1 In the 1980s, hermeneutics was often incorporated into deconstructionism and literary theory. Rather than focus on authorial intentions, the nature of writing itself including codes used to construct meaning, socio-economic contexts and inequalities of power,2 Gadamer introduced a different perspective; the interplay between effects of history on a reader’s understanding and the tradition(s) handed down in writing. This interplay in which a reader’s prejudices are called into question and modified by the text in a fusion of understanding (...) and topic revitalized the study of the printed word. Gadamer’s turn to language for understanding the meaning of Being also appealed to the post-modern antipathy toward modernity and metaphysics.3 If the truth and validity of interpretations are limited to communities of language, then our mode of being in history cannot but be historical. This point of view rendered Gadamer’s phenomenological hermeneutics vulnerable to the critique of moral and epistemological relativism. However, Gadamer’s theory of interpretation also stems from re-examination of the beginning of knowledge in the Pre-Socratics and Plato, and on this basis, is receptive to another dimension of inquiry than that which was trending in North America. -/- At the East-West Center, University of Hawai’i at Manoa in 1982, Chung-ying Cheng for the first time introduced onto-hermeneutics to an audience of esteemed philosophers including Li Zehou, Ren Jiyu, Feng Youlan, and Zhang Liwen.4 In contrast to schools of deconstruction and literary theory that had disengaged the interpreter from trans-historical sources of meaning and truth, Cheng explained that interpreters exist within a cosmological order inextricable from responsibility to harmonize Heaven and Earth in creative acts of interpretation. By integrating Chinese cosmology into hermeneutics through ontology, he tacitly challenged philosophers in the West to re-examine assumptions about humanity’s place in nature and by implication, Gadamer’s recovery of the beginnings of knowledge in Western philosophy. -/- Cheng’s Neo-Confucianism is inspired by the method and goals of Thomé H. Fang. The following words by Fang seem to prefigure, although in an indistinct and bundled way, aspects of Cheng’s philosophy including a Mencian theory of human nature, comprehensive observation, and creativity: “In the very process of living in concord with creative Nature, Man is charged with an ideal to be fully realized in the light of the principle of comprehensive harmony.”5 Like Fang, Cheng reinvigorates Chinese culture and language, but not solely in order to vindicate the insights of Neo-Confucianism. He has studied Western thought, from pragmatism and the analytic school to German idealism and phenomenology, to unlock and clarify philosophical concepts within the Yijing tradition and thereby render them intelligible to Anglophones. The result has been an awakening of Western scholars to the moral and cultural consequences of decoupling their thought from metaphysical foundations that are neither dogmatic nor doctrinal. -/- Not unlike the dialectic of Gadamer’s dialogue form, onto-generative hermeneutics integrates contrary positions on the same topic in order to blend both sides into a world philosophy, or as Cheng says, a “totalizing or integrative theory,”6 not to be confused with a theoretical rewording of a theory. On the contrary, the universal scope and relevance of hermeneutics stems from personal experience. Just as Gadamer, in response to faction and strife, immersed himself in Plato during the war years, and developed a method with which to harmonize opposites, so too, according to On-cho Ng, was Cheng moved by faction, strife and political persecution to develop a path toward unity.7 Gadamer taught at McMaster University in Hamilton, Ontario, and Cheng at the University of Hawai’i at Manoa among other institutions in North America. They facilitated trans-continental educational and cultural ties. Similar experiences yield similar insights irrespective of differences of time and place. Hence, authors in this issue who reside in Europe, China and North America, delineate the differences between Gadamer and Cheng, yet also, in light of Cheng’s onto-generative method and cosmology, develop integrative theories. Due to the page-budget restriction of the publisher, certain articles of this special theme will be subsequently published in the next issue. -/- 2 Integrative Theory This special issue of The Journal of Chinese Philosophy confirms a dimension of hermeneutics that Cheng has both motivated and inspired. The contributors do not abide by the conviction that since thought is mediated by language, interpretations cannot transcend culture. On the contrary, their research exemplifies the fruits of trans-historical onto-dialogical hermeneutics within limits defined by their field inquiry, organized into Parts I and II, around three themes: language, the philosophy of history and ethics. -/- Andrew Fuyarchuk introduces the theme of ontology in relation to Gadamer’s turn to language. Fuyarchuk argues that Chung-ying Cheng’s criticism of Gadamer’s hermeneutics is informed by Heidegger’s concept of Dasein and thereby overlooks how Gadamer’s Platonic-Pythagorean problem of the division between the One and Many is harmonized in the event of language, which in turn positions Gadamer in proximity to the presupposed grounds of receptivity in Cheng’s onto-generative hermeneutics. Lauren Pfister’s contributing article addresses the year 2000 meeting between Cheng and Gadamer in Heidelberg and expands the transhistorical grounds of meaning in Gadamer to matters of theology. Pfister’s summary of the written Chinese record of their conversation indicates that Cheng does not address the role of Christian philosophy and hence, the role of the inner word in Gadamer’s hermeneutics. This is important not only for detecting changes in Cheng’s philosophical development, but also for modifying his hermeneutics along the lines of a living conversation, possibilities explored by Pfister in a sequel to the article submitted to this issue. Nevertheless, by raising the issue of how Gadamer’s turn to language for understanding the meaning of Being extends possibilities in Cheng’s thought, Pfister anticipates the article by Katarina Gajdosova. She returns to the roots of Chinese thought during the Warring States period and broadens the meaning of names in recently excavated texts. Contrary to the conventions about how to understand terms, she appeals to both Heidegger’s ontology and Cheng’s notion of receptivity and creativity to reinterpret naming in relation to cosmology. Along the same lines, insofar as the event of Being is lingual, Jay Goulding captures its emergent structure in an evolving community of scholars and scholarship. He recalls his philosophical journey toward Cheng’s philosophy that begins in conversations with Gadamer at McMaster University in Hamilton, leads to Heidegger and Asian thought, expands into turning points with teachers and colleagues from various backgrounds that by increments contributed to Goulding’s formulation of “Daoist phenomenology.” -/- Although differing traditions guide their inquiries and research, Cheng and Gadamer recall the wisdom of the past to ameliorate the fragmentation in contemporary life. This leads them to re-examine the origins of philosophy; historical roots and thus sources of creative re-interpretations East and West whose affinities are developed in contributions by Hyun Höchsmann and Friederike Assandri. Höchsmann assesses convergences and divergences in the origins of Chinese and Western philosophy (Confucius and Socrates, the Yijing and Pre-Socratics) that culminates in pairing Gadamer’s understanding of paideia in the context of Plato’s political cosmology in the Timaeus with moral and social cultivation in The Western Inscription. She delineates the limits of this comparison which in turn justifies introducing Vattimo’s notion of locality. Assandri’s comparative analysis moves between India and China, Buddhism and Tang Daoism. Based on Gadamer’s argument that writing detaches concepts from their cultural moorings, she defines and applies three levels of understanding in onto-generative hermeneutics to Buddhist terms that were assimilated into the Benji Jing and in so doing clarifies essential dimensions of Daoism. -/- Contributions by Stephen Palmquist and Nicholas Brasovan position Cheng in relation to Kant and Gadamer by way of Aristotle’s ethics respectively. On the one hand, Palmquist plots Cheng’s evolving criticism of Kant’s moral philosophy and draws on crucial dimensions of Gadamer’s hermeneutics to reposition that criticism in a constructive relation to Kant’s emphasis on the philosophical conditions of morality while also indicating how religious dimensions of his thought answer Cheng’s concerns for lived moral action. For Palmquist, Gadamer enables a constructive criticism of Cheng. On the other hand, Brasovan compares Cheng’s Yijing-based account of moral deliberation with Gadamer’s Aristotelian-based ethics and reasons that in contrast to Cheng, Gadamer’s hermeneutical consciousness is disengaged from practical knowledge. For Brasovan, Cheng is a constructive critic of Gadamer. Palmquist and Brasovan’s divergent angles on Gadamer and Cheng map onto a dialectic of contrast and complementarity that constitutes the inner logic of Cheng’s philosophy. In other words, Gadamer and Cheng ought to be read alongside one another for the sake of removing discrepancies and contradictions, which constitutes the organic structure of their thinking. -/- 3 Our Mode of Being in History Is Not Historical The conversations between Cheng and Gadamer in this issue of The Journal of Chinese Philosophy pivot on language, philosophy of history and ethics within a comparative framework of analysis, but also explore the grounds that make the comparisons possible. Those grounds are informed by Chinese cosmology, and function to wrest Gadamer from the shadow of Heideggerian facticity and reposition him within the range of Cheng’s ideas about our place in nature that is embedded in his question about how mind emerges from inorganic matter.8 -/- For Gadamer scholars of Heidegger, human finitude, our ownmost individuating death ensures that hermeneutics is always open to the other as other, always on the way toward understanding the meaning of Being. To arrest the process in a concept of “the Absolute” cannot but represent someone’s point of view, and thereby render hermeneutics indistinguishable from ideology. However, insofar as finitude is defined by them in terms of an onto-theological concept of immorality, finitude is a metaphysical concept consistent with epistemologies and confuse beings with the meaning of Being. As a result, the celebrated political value of hermeneutics to always be on the way toward an understanding of the meaning of Being admits subtle variations on the same worldview that are insufficiently self-critical. -/- Gadamer scholars of Heidegger are right. A transformation in ethos and opening to the meaning of Being depends on awareness of finitude. Yet this awareness does not yield openness to more of the same, i.e., discourse structurally incapable of coming to unity but instead, for both Gadamer and Cheng, openness to a distinctly different ontological dimension of reality. As Sandra Wawrytko and So-Seong Park indicate,9 this ontological dimension is prefigured in the experience of being-as-a-whole or the totality of all possible relations in both Chinese totemic shamanistic rituals,10 and Greek Dionysian festivals.11 Through these religious experiences human ethos and therefore consciousness is expanded and elevated from being centered on one’s ownmost concerns toward an affinity with all sentient beings from insects and plants to animals. The channel for this affinity is an auditory disposition and hence, the emotions, compassion, and feeling response. -/- The capacity for an auditory disposition, or as Gadamer calls it, listening consciousness to respond to the inter-relationality and therefore inherent balance of nature is developed through music, song and dance of the religious rituals and festivals. They facilitate the unity of mind with nature. This use of music, that transforms ordinary consciousness, explains Cheng’s emphasis on the receptivity of feeling response in comprehensive observation, and Gadamer’s emphasis on openness to the other in attunement. However, an auditory disposition characteristic of pre-literate oral cultures that reveals the “All” need not rely on religion. As theorists about the evolution of language have explained,12 modern languages preserve their pre-historical past in music or prosody. That is to say, the song and dance that revealed the totality of inter-related beings to an ethos of comprehensive observation and attunement toward beings in classical civilizations is retained in the back-and-forth movement or rhythm of the dialogue form. Our mode of being in history is a mode of being in nature – through the music of language. -/- While alerting the reader to the limits of a nominalist interpretation, Gadamer expresses the inner law of the nature as follows: “in perishing there is always becoming, and in becoming there is always perishing.”13 Considered in process, opposites generate and blend into each other. This law of nature applies to everything.14 Hence, in a manner comparable to Pfister’s concluding insights, onto-dialogical hermeneutics is not only open to discrete events of otherness but moreover, to the moving structure of reality expressed, as Gajdosova suggests, in the existential moment of naming. Considered as interplay of tension and resolution with a life of its own, the dialectic of a dialogue is self-similar to the way in which an organism grows (by instinct). There is, therefore, a sense in which the art of interpretation extends the human mind into the eternal cycles of nature such that we participate in the articulation of the inner telos/homeostasis toward which all beings strive and importantly for Gadamer scholars of Heidegger, within the material limits of energy to which our embodied minds are self-evidently subject. The main aim of this paper is to investigate how sexist ideology distorts our conceptions of sexual violence and the hermeneutical gaps such an ideology yields. I propose that we can understand the problematic issue of hermeneutical gaps about sexual violence with the help of Fricker’s theory of hermeneutical injustice. By distinguishing between hermeneutical injustice and hermeneutical misfire, we can distinguish between the hermeneutical gap and its consequences for the victim of sexual violence and those of the perpetrator of such (...) violence. I then argue that perpetrators are both morally responsible and accountable for their acts, even if they are the result of a hermeneutical misfire. Ultimately, I show that with regard to sexual violence, we should opt for accountability to change the behaviour of the perpetrator and the social structure. The article reflects on the symbolic forms of domination developed in the social environment and the real games of power that they are hidden behind the representations in nowadays. It approaches the relation that the medias has in the representation context, being an instrument of domination for the processes ofconstruction of the important meanings for the structure of a society. The study calls the attention for the problematic theoretician presented for the philosopher Pierre Bourdieu, writing on the agent and society, (...) through the antagonism and exclusion between itself. Others two philosophers worked in the research are Michel Foucault and Jürgen Habermas. Thinking on individuals separately, we have that as the participant ones to be responsible in all the constructionof ethical values, politicians, cultural among others that they guide the collective context. However, we will only get success in this question, if we know how to analyze the “search of the real”. (shrink)

While the richness of Heideggerian philosophy is attractive as a healthcare research framework, its density means authors rarely utilise its fullest possibilities as an hermeneutic analytic structure. This article aims to clarify Heideggerian hermeneutic analysis by taking one discrete element of Heideggerian philosophy (Being-towards-death), and using it’s clearly defined structure to conduct a meta-synthesis of Heideggerian phenomenological studies on the experience of living with a potentially life-limiting illness. The findings richly illustrate Heidegger’s philosophy that there is either an inauthentic positioning (...) towards death, or an authentic positioning towards death with a proposition that (1) death is certain; (2) death is indefinite; (3) death is non-relational; and (4) death is not-to-be-outstripped. None of the 29 included studies on the experience of a confrontation with death fully utilised this framework, despite claiming a grounding in Heideggerian thought. This demonstrates the value in modelling how Heideggerian existential structures can be used proactively as analytical ‘hooks’ for data in research claiming a basis in this philosophy and/or method. By modelling the potential application of an important Heideggerian philosophical construct to published qualitative data, this meta-synthesis has revealed new domains and more nuanced understandings of the temporal structure of Being-towards-death. Such an approach helps to more fully unveil the existential concerns of people at the core of interpretative phenomenological enquiry and may provide a blueprint to map either primary or synthesised data to other key ontological existentials. This article re-examines the theoretical basis for environmental and heritage interpretation in tourist settings in the light of hermeneutic philosophy. It notes that the pioneering vision of heritage interpretation formulated by Freeman Tilden envisaged a broadly educational, ethically informed and transformative art. By contrast, current cognitive psychological attempts to reduce interpretation to the monological transmission of information, targeting universal but individuated cognitive structures, are found to be wanting. Despite growing signs of diversity, this information processing approach to interpretation remains dominant. (...) The article then presents the alternative paradigm of hermeneutics through the works of Schleiermacher, Dilthey, Heidegger and Gadamer, to provide a broader interpretation of interpretation. This not only captures the essence of Tilden’s definition but construes heritage interpretation as a more inclusive, culturally situated, critically reflexive and dialogical practice. (shrink)

En este sentido el propósito del estudio es abrir la tradición médica a la pregunta por la salud y explorar la posibilidad de plantearla desde el enfoque de la hermenéutica filosófica gadameriana. Se realizó una investigación de naturaleza filosófica desde el ámbito de la hermenéutica gadameriana mediante la dialéctica de pregunta-respuesta para delimitar el punto de partida y elaborar el horizonte de comprensión. Se expone la necesidad de explorar el sentido originario de la salud mediante el diálogo con la tradición médica y recuperar el ámbito existencial de la salud como un modo de ser y aproximarse a su esencia. Al situar la cuestión de la salud como un problema hermenéutico y recuperar su sentido existencial, se enuncia la pregunta en los siguientes términos: ¿cuál es el sentido originario de la salud? Interrogante que pretende establecer un diálogo con la tradición médica occidental para pensar la salud dentro de la vida como el enigma más profundo que la salud propone al pensamiento. Historically the question of health is not understood and ask it can be approached as a philosophical problem. In this regard the purpose of the study is open to question medical tradition for health and explore the possibility to raise it from the perspective of Gadamer's philosophical hermeneutics. An investigation of a philosophical nature was made from the field of Gadamer's hermeneutics by dialectic question and answer to delimit the starting point, develop the horizon of understanding and the question was asked. At the starting point of health as hermeneutical problem arises. The question of the type discussed: what is health?; and it identifies that the issue of health should integrate the meaning, structure and horizon from which he is interrogated. When it opens to understanding the health question the need to explore the original meaning of health through dialogue with the medical tradition and retrieve the existential field of health as a way of being and approach the essence of health it is exposed. By placing the issue of health as a hermeneutical problem and regain health existential sense, hermeneutical question is stated as follows: what is the original meaning of health? Question that seeks to establish a dialogue with the Western medical tradition to think about health in life as the deepest enigma that health proposes to thought. (shrink)

The question standing in the backgrounds of this paper is what kind of hermeneutics can emerge on basis of philosophy of life. To answer it, the theories of German philosophers Georg Misch and Josef Koenig have been analyzed. The first developed hermeneutical logics, which is based on identification the notions ‘life’ and ‘articulation’ ). Three aspects –life as logical category, life as hermeneutical category, and the discoursive forms of self-representation of life- extracted from Misch’s theory seem to be relevant (...) for further development of hermeneutics. Koenig carries forward this research program, but focuses on the linguistic structures of human perception experience and drafts a kind of analytical hermeneutics. The remarkable part of both conceptions is that they pose it logical heterogenity of theoretical and practical discourses. These differences are relevant for rethinking of such epistemological phenomenon, such as ‘meaning’, ‘concept’, ‘truth’ and ‘knowledge’. According to these positions, hermeneutics can be a homogenous theory of interpretation or understanding, but on the contrary the different logical areas of hermeneutics must be constituted. Thus, hermeneutics can be interpreted as an alternative to the traditional, i.e., epistemological approach, to the theory of knowledge, on the one hand, and to analytical philosophy of language on the other. Arguably, the most promising and compelling route to demonstrating the significance of Hegel’s thought to contemporary philosophy has been the series of recent readings that construe Hegel as continuing and completing Kant’s Copernican turn. Paul Redding explicitly locates his interpretation within this program, seeing the hermeneutic dimension of Hegel’s thought as providing for the possibility of continuing the Kantian project. Kant’s Copernican turn can be loosely stated as the procedure of reflectively uncovering unexperienced conditions of experience that contribute to the (...) nature of experience in ways that require its further re-determination and re-description. What a hemeneutic take on this reflective procedure adds is that foremost among those conditions are contexts of intersubjective or dialogical relations—structures of recognition. While perhaps disappointing to anyone interested in the problem of textual interpretation, there is finally nothing more to Redding’s account of Hegel’s “hermeneutics” than the establishing of recognitive structures as forming the ultimate horizon of human experience. I take Redding’s relentless tracking of the problem of recognition to be one of his book’s virtues. (shrink)

We present a computer-supported approach for the logical analysis and conceptual explicitation of argumentative discourse. Computational hermeneutics harnesses recent progresses in automated reasoning for higher-order logics and aims at formalizing natural-language argumentative discourse using flexible combinations of expressive non-classical logics. In doing so, it allows us to render explicit the tacit conceptualizations implicit in argumentative discursive practices. Our approach operates on networks of structured arguments and is iterative and two-layered. At one layer we search for logically correct formalizations for (...) each of the individual arguments. At the next layer we select among those correct formalizations the ones which honor the argument’s dialectic role, i.e. attacking or supporting other arguments as intended. We operate at these two layers in parallel and continuously rate sentences’ formalizations by using, primarily, inferential adequacy criteria. An interpretive, logical theory will thus gradually evolve. This theory is composed of meaning postulates serving as explications for concepts playing a role in the analyzed arguments. Such a recursive, iterative approach to interpretation does justice to the inherent circularity of understanding: the whole is understood compositionally on the basis of its parts, while each part is understood only in the context of the whole. We summarily discuss previous work on exemplary applications of human-in-the-loop computational hermeneutics in metaphysical discourse. We also discuss some of the main challenges involved in fully-automating our approach. By sketching some design ideas and reviewing relevant technologies, we argue for the technological feasibility of a highly-automated computational hermeneutics. (shrink)

This paper investigates the state of the law in Canada in regards to a public health emergency, and in particular the jurisdictional logic that might come into effect were a public health emergency to occur. Although there has yet to be a national public health emergency in Canada, threats of such crises are likely to arise in the future. It is therefore recognised as necessary to address Canada’s legal preparedness for a public health emergency and evaluate proposed reforms to the (...) legal structure that could facilitate response. This paper contributes to this goal by identifying multiple jurisdictional factors that could inform legal interpretations in a public health emergency. It considers how the legal system and the courts are dealing with public health as a national security issue while taking into account s. 7 of the Canadian Charter. It also looks at the power of the government defined in the Emergencies Act [1985, c. 22] and a proposed legal reform that would make it easier for the government to act unilaterally in a public health emergency. The paper draws on the legal theory of Robert Cover to analyse the hermeneutics of jurisdiction that characterise legal interpretations of public health in Canada, as well as the relationship between jurisdiction and legal violence that these hermeneutics imply. It then develops a case study of the use of medical triage in a public health emergency to explore the possibility of holding the state liable under private law for harm caused to individuals by public health decisions. The paper concludes by suggesting that the state’s public health power can be conceptualised as a form of legal violence and that the courts in Canada should adopt a jurisgenerative approach to legal interpretation in the area of public health.
