The clinic is a loaded space for LGBTQI persons. Historically a site of pathology and culturally a site of stigma, the contemporary clinic for queer patient populations and their loved ones is an ethically fraught space. This paper, which introduces the featured articles of this special issue of the Journal of Bioethical Inquiry on “Bioethics, Sexuality, and Gender Identity,” begins by offering an analysis of scrutiny itself. How do we scrutinize? When is it apt for us to scrutinize? And (...) what are the benefits and perils of clinical and bioethical scrutiny? Bearing in mind these questions, the second half of this paper introduces the feature articles in this special issue in response to such forms of scrutiny. How, why, when, and in what ways to sensitively scrutinize LGBTQI persons in the clinic are the aims of this piece. (shrink)

Scrutiny (1932-1953) was one of the most important critical reviews of the last century. Its editors and contributors included F. R. Leavis, Q. D. Leavis, Denys Thompson, L. C. Knights, D. W. Harding, W. H. Mellers, H. A. Mason, among others. In recasting Scrutiny’s critique of mass culture by way of Alisdair MacIntyre’s After Virtue (1981), I hope to show that the Scrutiny project not only dramatizes the conflicts internal to what MacIntyre calls emotivist culture, but provides (...) a new way of looking at the group’s relation to the culture industry, its purported elitism, and its deep ties with a communitarian rather than socialist politics. The historical debate of scientific realism portrays a monumental sign of science-a way of critiquing philosophy. At first sight, this centrepiece of scientific realism could line up against the no-miracles argument and the pessimistic meta-induction because, by means of the no-miracles assumption, fundamental theories in science would be the fine manifestation of reality as well as are most likely to be the truth. Nonetheless, a means to an end of the pessimistic meta-induction arguably states the anti-realistic position-since scientific speculations are (...) not always plausible to be the ultimate truth vis-à-vis mature hypotheses of science in history. By and large, I have herein put forward a systemic meaning for realism: an inspection of unseen objects in the world, which are broken free from the human mind. However, I will demonstrate the no-miracles argument in the vicinity of realism, whilst the pessimistic meta-induction lies towards anti-realism. In the bargain, I will examine structural realism in response to this scientific dichotomy. Briefly, this research article is, apparently, bound-up with a very limited account of relevancies; ergo, it would be recommended to further research on this controversy. (shrink)

Self-scrutiny has long been considered necessary for the development of virtue. Maimonides’ insistence on the importance of self-scrutiny in the formation of character has its roots in Aristotle, but is developed by him in such a way as to be innovative. Three related themes are discussed here : Maimonides’ conception of the role self-scrutiny plays in moral development ; how the imperative of self-scrutiny shapes his analysis of Mosaic Law ; and the specifically religious function of (...) self-scrutiny. We argue that a responsible analysis of today's evidence-based risk assessments and risk debates in biology demands a critical or metascientific scrutiny of the uncertainties, assumptions, and threats of error along the manifold steps in risk analysis. Without an accompanying methodological critique, neither sensitivity to social and ethical values, nor conceptual clarification alone, suffices. In this view, restricting the invitation for philosophical involvement to those wearing a "bioethicist" label precludes the vitally important role philosophers of science may be able (...) to play as bioevidentialists. In this paper, I look to draw novel connections between critiques of drill and epistemic injustice by addressing the question of whether the critical scrutiny of drill constitutes an epistemic injustice. I argue that these critiques constitute two types of epistemic injustice: testimonial injustice and contributory injustice. We see testimonial injustice in how courts and police do not give credibility to drill artists’ testimonies about the storylike nature of their songs, and these credibility deficits are based in racist stereotypes (...) about black criminality and believability. We see contributory injustice in how courts and police, through wilful ignorance, see drill music as violent and criminal rather than expressive and fictional – as drill artists do – which thwarts drill artists’ ability to contribute to shared knowledge. In many of his writings, Quine has argued that language is indeterminate in various ways. He has pursued, at length and often, an ingenious conclusion about one such way, which he sometimes calls the inscrutability of reference and, sometimes, the inscrutability of terms. It is the conclusion that one dimension of indeterminacy leaves the references of general terms unfixed among a number of alternatives; further, that no sort of scrutiny of the terms or of the occasions of their utterance (...) could, in principle, provide a means for settling objectively which referent to assign to a term. This single doctrine assumes various guises: there is a firm claim about incompatible but equally acceptable translations of certain Japanese classifiers; there is a somewhat less clear commitment to the inscrutability of a choice between expressions and their Godel numbers as referents for quoted expressions; further, there is a yet more tentative endorsement of Harman's example of the various referents of numerical expressions given by competing set theoretic reductions of number. The ability of videos to serve as evidence of racial injustice is complex and contested. This essay argues that scrutiny of the Black body has come to play a key role in how videos of police violence are mined for evidence, following a long history of racialized surveillance and attributions of threat and superhuman powers to Black bodies. Using videos to combat injustice requires incorporating humanizing narratives and cultivating resistant modes of looking.

Chalmers’s two-dimensional argument against materialism (aka the zombie argument) is arguably the most ingenious attempt to ground a view about fundamental reality on epistemic considerations. From the conceivability of a being that is physically identical to a conscious being but that is deprived of phenomenal consciousness (a zombie), the argument draws on the interplay of the primary and the second intensions of the zombie hypothesis to infer the metaphysical possibility of a zombie world, and thus the falsity of physicalism about (...) phenomenality. By means of a detailed reconstruction of the two-dimensional argument, the paper tries to isolate its most central assumption: that the role played by an epistemic scenario (an intentional object) in the verification of the zombie hypothesis is played by a nonintentionally individuated metaphysical world (the zombie world) considered as actual. The paper argues that no non-viciously circular case for this assumption has been made. Thus, the two-dimensional argument is at best inconclusive. (shrink)

Many people have misgivings about the strategy of nuclear deterrence. Some of those misgivings centre on issues of effectiveness: safety depends entirely upon the dissuasion of an adversary. Other misgivings centre on moral concerns: the essence of deterrence is the threat, and the conditional intention, to kill millions of noncombatants. US President Reagan's Strategic Defence Initiative promised an alternative to deterrence, a strategic posture of interception of an adversary's weapons rather than preclusion of the decision to attack. It is conceived (...) as a means of ‘defending’ the United States that does not threaten anyone. In this essay I examine various SDI proposals. I argue that only one of these could justify the transition to a strategic posture of ‘defence’, and might be a genuine alternative to deterrence—the one that is least feasible technologically. Only that one could plausibly be claimed to be morally superior to deterrence—and for strategic reasons, even its claim is dubious at best. Technologically more feasible proposals are not ‘defences’, but variants of deterrence. Since that is so, the most common and dramatic claim of their moral superiority to deterrence is incoherent. This study explores why and how firms respond to social demands through philanthropic giving in the context of a severe natural disaster. Drawing on Marquis and Qian's organizational response model to government signals, we integrate resource dependence theory and institutional theory to build a two-step model of organizational response to social needs, in situations of disaster relief. We argue that firms depending more on the government for support are more likely to donate in disaster relief, while firms who receive more (...) scrutiny from the government and the general public and firms having more slack resources are likely to donate more. Evidence from Chinese listed companies' donations to the 2008 Sichuan earthquake largely supports our predictions. This study provides a more precise understanding of the corporate philanthropic decision process, decoupling the drivers of philanthropic giving, and those determining the amount given. This paper proposes that a corporation’s vulnerability to public scrutiny drives its corporate giving. The hypothesis that companies donate for strategic motives is tested against the alternative that they do so for altruistic reasons. Court cases and news articles were selected as proxies for public scrutiny. Macroeconomic variables were used to gauge the level of public charitable need and test for altruism. Through examining the philanthropic behavior of 40 Fortune 500 companies over 7 years, this paper finds that (...) companies are strategic and altruistic in their giving. (shrink)

This paper contributes to the debate about how the overdemandingness objection applies to Kant's ethics. I first look at the versions of the overdemandingness objections Kant himself levels against other ethicists and ethical principles and I discuss in what sense he acknowledges overdemandingness as a problem. Then I argue that, according to Kant's own standards, introspection about the moral worthiness of one's actions can constitute forms of moral overdemandingness. Self-scrutiny and Kant's well-known claim that we can never be certain (...) that we acted for the right reason jeopardize agents’ deserved happiness. Furthermore, self-scrutiny can constitute an activity Kant himself criticizes under the labels of “micrology” and “fantastic virtue”. The demandingness of critical self-scrutiny has not yet received due attention in the overdemandingness debate since this debate is focused on duties we have towards others. (shrink)

The paper provides an analysis of two traditionally accepted distinctions between nominal and real definitions. The historical background is Kazimierz Ajdukiewicz’s conceptions of definitions as well as remarks by other members of the Lvov-Warsaw School of philosophy. The aim of the paper is to show that the analysed distinction, at least in Ajdukiewicz’s version, cannot be sustained.

Pindar’s songs were composed for men at play, but his poetry was political in its impulse and in its function. The men in question were rich and powerful, and their games were a display of exclusive class attributes, vicariously shared by lesser mortals who responded with gratitude and loyalty . Victories were counted as princely benefactions and laid up as city treasure like the wealth deposited in the treasuries at Delphi . Athletic victory was thus both a manifestation and an (...) enhancement of aristocratic domination, which meant that the poet who praised those who boxed and raced in pan-Hellenic games necessarily praised the social structure that depended on them.Pindar understood his political function and was proud of it—“I would consort with victors” .1 He believed in athletic contest as a model for all human life. He believed in the aristocratic system: “Inherited governance of cities lies properly with the nobility” . He believed also that praise poetry could regulate as well as laud that system, and he believed finally that such poetry was itself incorruptible. Games, song, and princely rulers were all parts of a single brilliant order, and this truth had a linguistic reflection, for the bit that tames a horse, the meter of a poetic line, and the moderation of a ruler were all called by the same name—metron. “Measure inheres in everything” . 1. A resounding debate has ensued over the utility of race in biomedical research, particularly as new drugs claiming to serve particular racial populations attempt to enter the marketplace. This creates a number of challenges for the Food and Drug Administration over how best to regulate new drugs seeking race specific indications. This article suggests that it may be beneficial for the FDA to turn to an area with experience negotiating such dilemmas - Constitutional Law - and its approach - strict (...) scrutiny - to help guide when and under what circumstances Government should give effect to racial categories in biomedicine. This paper develops and tests a model of fingerpointing behaviors that board members experience because of regulatory reforms. We present the partial results of a large study of 138 board members on 54 publicly traded boards in the United States. We found that recent governance reforms that mandate increased accountability of board members are associated with less board cohesion and thatlower board cohesion is associated with fingerpointing behaviors. These findings suggest that the stages of institutionalization following regulatory shock falter when (...) negative group behaviors develop under scrutiny. (shrink)

Race is becoming an increasingly common lens through which biomedical researchers are studying the relevance of genes to group predispositions that may affect disease susceptibility and drug response. These investigations contravene decades of research in the natural and social sciences demonstrating that social categories of race have little genetic significance. Nevertheless, a resounding debate has ensued over the utility of race in biomedical research — particularly as new drugs claiming to serve particular racial populations enter the marketplace. Now that the (...) Food and Drug Administration has approved BiDil as the first race-specific treatment despite conflicting evidence and unsettled debates, is there a way for federal regulators to promote research that may address minority health concerns without giving undue credence to the dangerous idea that social understandings of race are genetically relevant? It may be useful for the FDA to turn to an area with experience negotiating such dilemmas — constitutional law — and its approach — strict scrutiny — to help guide when and under which circumstances government should give effect to racial categories in biomedicine. The COVID-19 pandemic poses extraordinary public health challenges. In order to respond to such challenges, most democracies have relied on so-called ‘evidence-based’ policies, which supposedly devolve to science the burden of their justification. However, the biomedical sciences can only provide a theory-laden evidential basis, while reliable statistical data for policy support is often scarce. Therefore, scientific evidence alone cannot legitimise COVID-19 public health policies, which are ultimately based on political decisions. Given this inevitable input on policy-making, the risk of arbitrariness (...) is ubiquitous and democratic scrutiny becomes essential to counter it. During the COVID-19 pandemic, the standards of scientific and democratic scrutiny have been, as a matter of fact, substantially lowered. This erosion potentially damages democracy. (shrink)

The ¿scrutiny of all the laws¿ that Andocides invokes in his defence On the Mysteries is usually interpreted as a recodification with the aim of barring prosecution for the crimes of civil conflict. This article advances four theses against that traditional reading: (1) In Andocides¿ argument the Scrutiny was designed for a more practicable purpose, not to pardon crimes unpunished but to quash any further action against former atimoi, those penalized under the old regime but restored to rights (...) in 403. In context, coming close upon the summary of Patrocleides¿ decree, ¿all the laws¿ means all laws affecting atimoi. (2) The other evidence from inscriptions and literary testimony, for the Athenian Amnesty and similar agreements, supports this reading: the oath that closed the covenants, mê mnêsikakein, functions as a rule of estoppel or ¿no reprise¿; it was not in itself a pledge of ¿political forgiveness¿. In regard to the Scrutiny, as in Patrocleides¿ decree, the oath means that old penalties, now cancelled, can never again be enforced. (3) The Scrutiny itself was a reauthorization of the old laws for summary arrest and other standard remedies against atimoi who trespass or violate their restrictions. As a corollary to this re-enactment, the statute of limitations was introduced, ¿to apply the laws from Eucleides¿: the rules punishing the disfranchised cannot be used against those whose liabilities were incurred before 403. (4) Teisamenus¿ decree for new legislation was prior to this revision; it is not the decree that Andocides read to the court as a document of the Scrutiny. An ancient editor simply inserted the wrong document. Teisamenus envisioned no alteration of the ¿Solonian Code¿; the decree for Scrutiny was an unforeseen but necessary correction. These measures were successive reforms sorting out the new hierarchy of rules, a process whose complexity is attested in Diocles¿ law. (shrink)

Under the influence of naturalistic approaches, contemporary philosophy of science tends to characterize scientific objectivity not by virtue of the individualistic following of rules or satisfying epistemic utilities, but as a property arising from the organisational features of groups. This paper presents a critical review of one such proposal, that of Helen Longino, probing some of its main features against the debate between Pasteur and Pouchet in mid-nineteenth-century France regarding the spontaneous generation of life. After considering some weaknesses and strengths, (...) it is argued that Longino’s social epistemology is only able to generate normativity by implicitly assuming a classic procedural notion of epistemic acceptability. The paper also aims to use this historical case to shed light on the complex, multidimensional nature of the dynamics of actual science, arguing both against purely epistemic and exclusively social approaches in a satisfactory meta-scientific explanation of controversies. How are the various classically equivalent definitions of compactness for metric spaces constructively interrelated? This question is addressed with Bishop-style constructive mathematics as the basic system – that is, the underlying logic is the intuitionistic one enriched with the principle of dependent choices. Besides surveying today's knowledge, the consequences and equivalents of several sequential notions of compactness are investigated. For instance, we establish the perhaps unexpected constructive implication that every sequentially compact separable metric space is totally bounded. As a by-product, (...) the fan theorem for detachable bars of the complete binary fan proves to be necessary for the unit interval possessing the Heine-Borel property for coverings by countably many possibly empty open balls. This article discusses the imbrication of racialising and sexualising scientific practices of gender testing and verification in elite athletics competition, and their intersection with social politics, using as a theoretical frame the feminist, anti-racist work of Hortense Spillers (2003), Judith Butler (1990, 1993a, 1993b, 2004) and Anne Fausto-Sterling (2000), among others. It traces the practice of sex-gender testing of ‘women’ at sanctioned International Association of Athletics Federations (IAAF) and International Olympic Committee (IOC) track and field competitions in order to contextualise (...) South African middle-distance runner Caster Semenya’s experiences at the 2009 Berlin World Championships and the subsequent spectacularisation of her body through the discursive practices of representation. To protect what it deems fundamental rights, the Supreme Court strictly scrutinizes legislation that impinges on these rights. The Court views such legislation as a means to some end the legislation seeks to accomplish. The Court requires that the statute be neither overinclusive nor underinclusive; the legislation may not affect more people than necessary to achieve its end, nor is the statute permitted to leave some people out in achieving its end.I argue that when legislation imposes burdens, its underinclusiveness is (...) irrelevant, and that when it dispenses rewards its overinclusiveness is irrelevant, because those affected by the statute areex hypothesi deserving. One commits thetu quoque fallacy when one tries to infer that those affected by the law are undeserving from the fact that some deserving individuals were not affected by the statute. (shrink)

Over the past decade, corporate scandals have proliferated. These scandals, along with the emergence of the #MeToo movement and Environmental, Social, and Corporate Governance (ESG) mandates, have increased the scrutiny of corporations’ ethics culture. How have companies responded in terms of the language appearing in their public ethics documents? We compare the Code of Ethics in 2008 versus 2019 for a sample of S&P 500 firms. For the vast majority of firms, their Code of Ethics lengthened, with the average (...) 2019 code having 29% more words (about 1760 words) than the 2008 average. The language of the codes has also changed. Words such as _bribery, corruption, sustainability, speak up, bullying, slavery,_ and _human rights_ all saw significantly higher usage in the later period. We review possible reasons for the dramatic changes and suggest what questions remain about the motivations behind them. Whether the changes we observe are primarily intrinsically motivated or simply market responses to public pressures is yet to be determined. What is clear from our findings is that society seems to be entering a new age of increasingly moral—or, at least, moralized—corporate governance. (shrink)

We aim, in this paper, to discuss how far the ethical framework for assessing medical research, generalized into other institutional settings, is also appropriate for social science research, particularly qualitative research. Recently, researchers have raised concerns about ‘ethics creep’, incompatibility with participatory methodologies and the exclusion of service users. Researchers are increasingly raising questions as to whether the processes of governance and the paradigmatic assumptions pervading research ethics committees are fit for purpose when they deliberate on non-clinical research that uses (...) social science methods. We review whether ethical scrutiny by research ethics committees is asking the wrong questions and holding research to the wrong standards. (shrink)

In the Spring and Summer of 2014, a group of experts convened a series of meetings at the Westminster headquarters of the UK Ministry of Justice in order to determine whether the Mental Capacity Act 2005 complies with the United Nations Convention on the Rights of Persons with Disabilities. The meetings were organised by the research team of the Essex Autonomy Project, a research and public policy initiative funded by the Arts and Humanities Research Council and based at the University (...) of Essex. The working group included civil servants from the MoJ, the Office of the Public Guardian, and the Department of Health, as well as the Official Solicitor, a senior judge of the Court of Protection, leading academic experts from psychiatry, law and ethics, and representatives of user-group organisations. In September 2014, the EAP research team reported to the MoJ on its findings. This article summarises some of the key arguments and conclusions of that report. Both the report itself and this article represent the views of their respective authors; they should not be taken to represent the views of the MoJ, the AHRC, or the other participants in these consultations.
