The foundation of methodical development of literary hermeneutics represents an altogether new proposition. There existed for centuries an old tradition of philological hermeneutics. It can glory in its venerable origins: the interpretation of ecclesiastical canonical writing, an art which ever since the period of Humanism has been erecting for itself a proud monument of re-edited and corrected texts and commentaries of ancient authors. It can also show just as impressive a result of historical interpretation of the texts of the world's (...) literary past which had served the ideal of an “objective” and therefore scholarly knowledge. However we know that these achievements were not a monopoly of the traditional philological hermeneutics, but were shared with the theological, juridical, philosophical and distorical hermeneutics: in short, with all branches of study concerned with editing, critical study of sources and historical interpretation of the writings of the past. The merits of the traditional hermeneutics of literary texts are so unexceptional, its history so difficult to distinguish from other regional hermeneutics that the epistemologist can speak of a common philological basis and pose the following fundamental question: where does the independence of literary hermeneutics really begin? How has it operated and how does it operate today in order to render justice to the aesthetic character of its texts? (shrink)

Historically, the productive aspect of the aesthetic experience can be described as a process during which aesthetic practice freed itself step by step from restrictions imposed on productive activity in both the classical and the biblical tradition. If one understands this process as the realization of the idea of creative man, it is principally art which actualizes this idea.1 First, when the poietic capacity is still one and undivided, it asserts itself subliminally; later, in the competition between technical and artistic (...) creation, it explicitly claims to be a production of a special kind. It is in that history of the concepts labor and work that the restrictions become most palpable.2 In the Greek tradition, all producing remains subordinate to practical action . As the activity of slaves who are rigorously excluded from the exercise of the virtues, poiesis occupies the lowest rank in social life. In the Christian tradition, handiwork is cursed, which means that man is meant to maintain himself only by toiling against a resistant nature ; salvation can only be found beyond his activity in this world. According to what Robert Stecker dubs the “ethical-aesthetic interaction” thesis, the ethical defects of a literary work can diminish its aesthetic value. Both the thesis and the only prominent argumentative strategy employed to support it the affective response argument have been hotly debated; however, Stecker has recently argued that the failure of the ARA does not undermine the thesis, since the argument “fails to indentify the main reason [the thesis] holds, when it in fact does.” I critically examine Stecker’s (...) objection to the familiar versions of the affective response argument and the line of support for ethical-aesthetic interaction he proposes to install in their place. I conclude that neither is compelling; however, an important insight can be salvaged from his positive proposal, and I argue that the insight does, in fact, point toward a novel defense of the thesis. Beginning with an article by Hans Robert Jauss, which detects in Hans Belting some "unease" towards hermeneutics, this paper claims instead that Belting, in his studies, manifests deep hermeneutic awareness, among other things indebted in many respects to Jauss' reception theory itself. Nonetheless, it is still possible to notice some "unease," which emerges in the way Belting considers hermeneutics among the "methods and games" of history of art. In this regard, Belting's analysis – concerning the relationship between (...) iconology and hermeneutics and between philosophical and art historical hermeneutics – appears densely loaded with meaning but also partial. This is due to the fact that he limits himself to critically discussing only one tendency, well represented, in his eyes, by Wilhelm Dilthey, Hans-Georg Gadamer and Hans Sedlmayr, the latter being the only representative of art historical hermeneutics that Belting takes into account. Some Western academics and Muslim scholars often question Mouridism, this Islamic tradition initiated by Sheikh Ahmadou Bamba in Senegal at the turn of the 19th century. Through the theory of reception developed by Robert Jauss for literature, this paper argues that Mouridism as a reception of Islam in Black Africa is as true as other Islamic traditions that developed after the death of Prophet Muhammad in 632 c.e. Thanks to Ahmadou Bamba’s charisma and genius, Islam became a popular religion that it was called to be among Black Africans as well. Using the ideological potential of this religion, Ahmadou Bamba brought about the cultural, religious, political and economic emancipation of Wolof people and by extension of all Senegalese that are proud of his contribution to the struggle for the independence of their country. The wealth of Sheikh Ahmadou Bamba’s teaching and action is still to be unfolded to Africans and all those interested in seeking ways to develop the African continent. (shrink)

In keiner geisteswissenschaftlichen Disziplin hat Gadamers Hermeneutik tiefere Spuren hinterlassen als in der Literaturwissenschaft. Bezugnahmen auf 'Wahrheit und Methode' bilden langst eine Art 'Koine' der Selbstverstandigung des Fachs. Der aus einem Kolloquium im Deutschen Literaturarchiv Marbach hervorgegangene Band bilanziert diesen Bestand: Im ersten Teil diskutieren Jean Grondin, Dieter Teichert, Norbert Groeben, Tilmann Koppe u.a. Gadamers Theorievorschlage und deren Rezeption durch so wirkungsmachtige Literaturwissenschaftler wie Hans-Robert Jauss, E.D. Hirsch und Frank Kermode. The novel gives us access to fictional universes in a fundamentally unfinished mode, which allows the reader to give free rein to his or her imagination, in a freedom that is nevertheless monitored and controlled by rules. This article tries to understand the nature of this incompleteness, by discussing some classical readings. How does this specific dimension of fiction relate to Umberto Eco’s concept of the “open work” or to the idea, developed by the phenomenologist Roman Ingarden, that literary works (...) are “schemas” destined to be “concretized” in the consciousness of the reader? How does Hans Robert Jauss’s aesthetics of reception help us to think about the incompleteness of the work in the proper time of its different readings? Through the fruitful dialogue of these different theories, it is a question of highlighting two important points. First, these theories, while discussing the respective roles of the author and the reader, neglect a a third character who is nevertheless essential to the fictional narrative, the narrator. However, taking into account the latter sheds light on the problems encountered. Secondly, this relationship between the incompleteness of the narrative and the narrator’s position is not in itself specific to fiction. It is not absent from scientific texts, when they are thought of as narratives about reality susceptible of different readings in their history. (shrink)

Through an examination of the aesthetic ideas of the Konstanz School (in particular, in the texts of Wolfgang Iser and Hans Robert Jauss), we intend to make an inflection on the usual links between communication and the aesthetic experience - in the way they were traditionally encoded, as aspects of a critique of extreme mediatization processes, in the late stages of capitalism, illustrated by the philosophical ideas of the Frankfurt School (especially in the writings of Theodor W. Adorno (...) and Walter Benjamin). We set up as signs of this inflection the proposal for a rehabilitation of phenomena such as the “aesthetic effect” (in Iser) and “catharsis” (in Jauss), as elements that combine affective states of the aesthetic receptivity of works of art with their potential for communicability, proposing from there another type of connection for the appreciation of phenomena, processes and communicational products, in an aesthetic key. Dominic LaRochelle | : Les religions ne constituent pas des monolithes immuables et inchangés dans le temps. Elles évoluent au fil de l’histoire humaine, changent au gré des transformations culturelles et sociales des communautés dans lesquelles elles s’implantent, négocient avec les instances séculières et religieuses leur pertinence et leur droit d’exister ; bref, elles innovent constamment pour s’assurer une place dans un monde lui aussi en constant changement. Cet article propose deux outils pour analyser les innovations au sein des traditions (...) religieuses : les théories de la réception, inspirées des travaux de Hans Robert Jauss, et l’invention des traditions, inspirée du célèbre ouvrage d’Eric J. Hobsbawm et Terence O. Ranger. L’intérêt de l’utilisation de ces outils en histoire est qu’ils permettent, entre autres choses, de dépasser les oppositions classiques tradition/modernité et authenticité/innovation en analysant les religions du point de vue des ruptures et des transformations à l’intérieur de celles-ci. Ces outils seront appliqués à un cas particulier, celui de la réception et de la réinvention du taoïsme dans les sociétés occidentales au XXe siècle. Cette tradition religieuse chinoise vieille de plusieurs siècles a en effet été réinventée en Occident et transformée en une tradition spirituelle universelle répondant aux attentes des Occidentaux en matière de spiritualité contemporaine. | : Religions are not immutable monoliths that remain unchanged over time. They evolve over the course of human history ; changing according to the cultural and social transformations of the communities in which they are established and negotiating with secular and religious authorities for their relevance and right to exist. In short, they continually innovate to secure a place in a constantly changing world. This article proposes two tools to analyze innovations within religious traditions : reception theories, inspired by the works of Hans Robert Jauss, and the invention of tradition, inspired by the celebrated work of Eric J. Hobsbawm and Terence O. Ranger. The interest of using these tools in a historical approach is that they allow us, among other things, to overcome the traditional oppositions of tradition vs. modernity and authenticity vs. innovation by analyzing religions from a rupture and transformation point of view. These tools will be applied to a particular case, namely the reception and reinvention of Taoism in Western societies in the twentieth Century. This centuries-old Chinese religious tradition has been reinvented in the West and transformed into a universal spiritual tradition that meets the expectations of Westerners for contemporary spirituality. Philosophers have almost always relegated the topic of revision to the sidelines of their discipline, if they have thought about it at all. This book contends that acts of revision are central and indispensable to the project of philosophizing and that philosophy should be construed essentially as a practice of rereading and rewriting. The book focuses chiefly on Heidegger's highly influential interpretation of Nietzsche, conducted in lectures during the 1930s and 1940s and published in 1961. The author closely analyzes the (...) rhetorical means by which Heidegger repositions Nietzsche's thinking within a broad history of metaphysics, even as Heidegger positions his own reinterpretation as that history's more 'proper' reading. In addition to being the first book-length published study of Heidegger's interpretation of Nietzsche, the book also examines the work of Hans-Robert Jauss, Harold Bloom, and other critics of revision. ABSTRACTThe purpose of this article is an attempt to understand the concept of ‘confession’ as a literary genre in the works of Spanish philosopher María Zambrano. Firstly, we will try to understand confession within Zambrano's most relevant philosophical concepts, in particular her study La confesión: género literario y método [Confession. Literary Genre and Method]. Secondly, we will offer reinterpretation to confession in dialogue with theories of Reception by Wolfgang Iser and Hans Robert Jauss, and other authors like St. (...) Agustin, Rosa Chacel, Mikhail Bakhtin, Miguel de Unamuno and Michel Foucault. Finally we will highlight the performative aspect of confession as something that is truly relevant to Zambrano’s theory. Zambrano understands confession as a method that can bring people's experiences closer to knowledge, and therefore a method that can change life. In this context, we propose that the reader of confession plays a fundamental role in understanding Zambrano’s conception. (shrink)

L’article entend confronter la théorie moderne de l’art au phénomène d’esthétisation de la sphère marchande mis en évidence par la sociologie, en prenant pour cadre de référence l’esthétique de la réception de Hans Robert Jauss. Bien que s’appliquant surtout à la littérature, la théorie de Jauss n’est pas sans concerner aussi les arts plastiques. La synthèse qu’elle opère entre, d’un côté, le formalisme russe du début du xx e siècle, qui, le premier, s’employa à isoler les propriétés (...) internes des œuvres d’art, et, de l’autre, l’historicisme d’inspiration marxiste qui s’attacha pour sa part à rendre compte de leurs évolutions en fonction de l’histoire générale de la société, semble particulièrement propice à l’abord d’un problème qui est à la fois symbolique, esthétique et historique. En effet, dès lors que de nombreux produits et services de consommation tendent à adopter certaines caractéristiques de l’œuvre d’art, l’analyse formelle, qui constitue l’arc-boutant de l’approche esthétique moderne, entre dans un périmètre d’application beaucoup plus large que celui dont participe l’histoire de l’art. Dans ce cas, l’importance accordée à la forme des objets, prise en ce sens esthétique, devient en elle-même une composante de l’histoire sociale, dans la mesure où elle ne concerne plus seulement les évolutions de la production artistique, mais intéresse aussi, en leurs principes, celles plus générale de la production marchande. Moyennant un approfondissement de leur versant social – ceci en se demandant, non pas comment l’expérience artistique transforme le monde vécu, mais comment le monde vécu transforme lui-même le monde artistique – les analyses de Jauss nous permettent ainsi de reformuler, en des termes propres à la théorie de l’art, la question de la convergence catégorielle mise en évidence par la sociologie, et, de là, d’engager une réflexion nouvelle sur les transformations de la sphère artistique à l’heure du capitalisme esthétique. The essay reconsiders Wolfgang Iser’s phenomenology of reading, taken as a possible non reductionist answer to the neuroscientific theories of literature. By emphasizing the aesthetic nature of reading, thanks also to Hans Robert Jauss’ contribution, the idea of a ‘reader’s imagination’ emerges here, as a specific and unique power which allows not only the access to the world of the literary text, but opens also new spheres for the understanding and exploration of the real world. At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. The author's thesis is that there is a conceptually necessary connection between law and morality which means legal positivism must fail as a comprehensive theory. The substantiation of this thesis takes place within a conceptual framework which shows that there are at least 64 theses to be distinguished, concerning the relationship of law and morality. The basis for the author's argument in favour of a necessary connection, is formed by the thesis that individual legal norms and decisions as well as (...) whole legal systems necessarily make a claim to correctness. The explication of this claim within the frame of discourse theory shows that the law has a conceptually necessary, ideal dimension, which connects law with a procedural, universalistic morality. The standard view of academic freedom and free speech is that they play complementary roles in universities. Academic freedom protects academic discourse, while other public discourse in universities is protected by free speech. Here I challenge this view, broadly, on the grounds that free speech in universities sometimes undermines academic practices. One defense of the standard view, in the face of this worry, says that campus free speech actually furthers the university’s academic aims. Another says that universities have a secondary (...) democratic function, which cannot be fulfilled without free speech on campus. I identify shortcomings in both types of arguments. (shrink)

Philosophy is general and systematic reflection about what there is, what ought to be done or is good, and how knowledge about both is possible. Legal philosophy raises these questions with respect to the law. In so doing, legal philosophy is engaged in reasoning about the nature of law. The arguments addressed to the question of the nature of law revolve around three problems. The first problem addresses the question: In what kinds of entities does the law consist, and how (...) are these entities connected such that they form the overarching entity we call “law”? The answer is that law consists of norms as meaning contents which form a normative system. The second problem addresses the question of how norms as meaning contents are connected with the real world. This connection can be grasped by means of the concepts of authoritative issuance and social efficacy. The latter includes the concept of coercion or force. The third problem addresses the correctness or legitimacy of law, and, by this, the relationship between law and morality. To ask about the nature of law is to ask about necessary relations between the concepts of normative meaning, authoritative issuance as well as social efficacy, and correctness of content. (shrink)

McGowan argues that everyday verbal bigotry makes a key contribution to the harms of discriminatory inequality, via a mechanism that she calls sneaky norm enactment. Part of her account involves showing that the characteristic of conversational interaction that facilitates sneaky norm enactment is in fact a generic one, which obtains in a wide range of activities, namely, the property of having conventions of appropriateness. I argue that her account will be better-able to show that everyday verbal bigotry is a key (...) factor in social inequality if it tries to isolate a more specific property of conversation as the thing that facilitates sneaky norm enactment. Robert Stalnaker is an actualist who holds that merely possible worlds are uninstantiated properties that might have been instantiated. Stalnaker also holds that there are no metaphysically impossible worlds: uninstantiated properties that couldn't have been instantiated. These views motivate Stalnaker's "two dimensional" account of the necessary a posteriori on which there is no single proposition that is both necessary and a posteriori. For a (metaphysically) necessary proposition is true in all (metaphysically) possible worlds. If there were necessary a posteriori (...) propositions, that would mean that there were propositions true in all possible worlds but which could only be known to be true by acquiring empirical evidence. Consider such a purported proposition P. The role of empirical evidence for establishing P's truth would have to be to rule out worlds in which P is false. If there were no such worlds to be ruled out, we would not require evidence for P. But by hypothesis, P is necessary and so true in all metaphysically possible worlds. And on Stalnaker's view, the metaphysically possible worlds are all the worlds there are. So there can be no proposition that is true in all possible worlds, but that we require evidence to know. In this way, the motivation for Stalnaker's two dimensional account of the necessary a posteriori rests on his denying that there are metaphysically impossible Worlds. I argue that given his view of what possible worlds are, Stalnaker has no principled reason for denying that there are metaphysically impossible worlds. If I am right, this undercuts Stalnaker's motivation for his two dimensional account of the necessary a posteriori. (shrink)

Contemporary discussions about practical reason or practical rationality invoke four competing views which can be named as follows by reference to their historical models: Aristotelian, Hobbesian, Kantian and Nietzschean. The subject-matter of this article is a defence of the Kantian conception of practical rationality in the interpretation of discourse theory. At the heart, lies the justification and the application of the rules of discourse. An argument consisting of three parts is pre sented to justify the rules of discourse. The three (...) parts are as follows: a transcen dental-pragmatic argument; an argument which takes account of the maximisation of individual utility and an empirical premise about an interest in correctness. Within the framework of the problem of application, the article outlines a justification of human rights and of the basic institutions of the democratic constitutional state on the basis of discourse theory.
