While Gabriel Watts and Ainsley Newson argue that diagnostic laboratories do not have a general duty to routinely reinterpret genomic variant classifications, they do formulate several restricted duties to actively reinterpret specific types of classifications.1 They place these duties with laboratories, acknowledging that they are setting aside any responsibilities that might arise for clinicians. Here, we will discuss the implications of this obligation for clinicians and the moral tension it may confront them with. We focus in particular on the consequences (...) of the proposed moral obligation to actively reinterpret variant classifications that carry a higher risk of being false positives. Such reclassification is likely to result in ‘downgrades’: previously pathogenic variants (pathogenic/likely pathogenic, P/LP) reclassified to benign (likely benign/benign, LB/B) or uncertain variants (variant of uncertain significance, VUS). Any laboratory policy to actively reinterpret (specific sets of) classifications will confront the clinician with the question whether the person tested should be recontacted on a reinterpretation of previously reported results. As others have pointed out, recontacting in general comes with challenges, since patients may not want to be recontacted or have forgotten about their genetic test.2 3 Recontacting in case of a downgrade, however, is particularly impactful. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

While questions about the environmental sustainability of contemporary farming practices and the socioeconomic viability of rural communities are attracting increasing attention throughout the US, these two issues are rarely considered together. This paper explores the current and potential connections between these two aspects of sustainability, using data on community members’ and farmers’ views of agricultural issues in California’s Central Valley. These views were collected from a series of individual and group interviews with biologically oriented and conventional farmers as well as (...) community stakeholders. Local marketing, farmland preservation, and perceptions of sustainable agriculture comprised the primary topics of discussion. The mixed results indicate that, while many farmers and community members have a strong interest in these topics, sustainable community development and the use of sustainable farming practices are seldom explicitly linked. On the other hand, many separate efforts around the Valley to increase local marketing and agritourism, improve public education about agriculture, and organize grassroots farmland preservation initiatives were documented. We conclude that linking these efforts more explicitly to sustainable agriculture and promoting more engagement between ecologically oriented farmers and their communities could engender more economic and political support for these farmers, helping them and their communities to achieve greater sustainability in the long run. Empirical studies have revealed a disturbing prevalence of research misconduct in a wide variety of disciplines, although not, to date, in the areas of ethics and philosophy. This study aims to provide empirical evidence on perceptions of how serious a problem research misconduct is in these two disciplines in Spain, particularly regarding the effects that the model used to evaluate academics’ research performance may have on their ethical behaviour. The methodological triangulation applied in the study combines a questionnaire, a debate (...) at the annual meeting of scientific association, and in-depth interviews. Of the 541 questionnaires sent out, 201 responses were obtained, with a significant difference in the participation of researchers in philosophy and in ethics ; 26 researchers took part in the debate and 14 interviews were conducted. The questionnaire results reveal that 91.5% of the respondents considered research misconduct to be on the rise; 63.2% considered at least three of the fraudulent practices referred to in the study to be commonplace, and 84.1% identified two or more such practices. The researchers perceived a high prevalence of duplicate publication and self-plagiarism, use of personal influence and citation manipulation, in contrast to a low perceived incidence of data falsification or fabrication. The debate and the interviews corroborated these data. Researchers associated the spread of these misconducts with the research evaluation model applied in Spain. (shrink)

The theory and practice of advertising self-regulation have been evolving for decades in pursuit of basic standards for advertising quality. In Spain, this discipline was put into practice in 1995, the year the Association for the Self-Regulation of Commercial Communication was created. This article aims to examine in depth the functioning of the Spanish advertising self-regulation system, with special emphasis on the Advertising Jury, and explore to what extent some of the normative requirements of rigour, independence and participation can be (...) considered to have been met. The paper is based on a case study in which interviews with Autocontrol members, Jury members and consumer associations have particular bearing. Much of the attention by social scientists to the rapidly growing organic agriculture sector focuses on the benefits it provides to consumers (in the form of pesticide-free foods) and to farmers (in the form of price premiums). By contrast, there has been little discussion or research about the implications of the boom in organic agriculture for farmworkers on organic farms. In this paper, we ask the question: From the perspective of organic farmers, does “certified organic” agriculture encompass a commitment to (...) “sustainability” that prioritizes social goals? Specifically, we aim to broaden our understanding of the relationship between social sustainability and organic agriculture by drawing attention to issues affecting farmworkers, whose labor and contribution tends to elude most discussions of organic agriculture. We present findings from a survey of organic farmers in California about the possible incorporation of social standards into organic certification criteria. Our findings suggest that, at best, lukewarm support for social certification within organic agriculture exists among certified organic farmers in California. They also question expectations that organic agriculture necessarily fosters social or even economic sustainability for most of the farmers and farmworkers involved. However, we also find exceptions to the patterns evidenced in our survey. In-depth interviews with select organic farmers demonstrate that there are individuals whose practices are atypical and demonstrate that, under some circumstances, an organic production system can be at once environmentally, economically, and socially sustainable. Abstract:This paper is a preliminary attempt to better understand the concept of legitimacy in stakeholder theory. The normative component of stakeholder theory plays a central role in the concept of legitimacy. Though the elaboration of legitimacy contained herein applies generally to all “normative cores” this paper relies on Phillips’s principle of stakeholder fairness and therefore begins with a brief description of this work. This is followed by a discussion of the importance of legitimacy to stakeholder theory as well as the (...) general ambiguity of the term. A distinction is then drawn between normative and derivative legitimacy. Reference to this distinction helps distinguish between a relationship with the organization based on direct moral obligation and one based on the power to help or harm the organization. It is concluded that stakeholders who retain the ability to affect the organization arelegitimate(derivatively), but that this legitimacy is derived from the moral obligation owed other (normative) stakeholders and that the two sorts of legitimacy are importantly different from one another. An example of the normative/derivative distinction at work in managerial decision making is elaborated upon and managerial and research implications are then suggested. (shrink)

Several studies on research misconduct have already explored and discussed its potential occurrence in universities across different countries. However, little is known about this issue in Spain, a paradigmatic context due to its consolidated scientific evaluation system, which relies heavily on metrics. The present article attempts to fill this gap in the literature through an empirical study undertaken in a specific university: Universitat Jaume I (Castelló). The study was based on a survey with closed and open questions; almost half the (...) total population of the university’s researchers participated (505 out of 1030, i.e. 49.03%), yielding a representative sample of different academic career stages and areas of knowledge. Results show that 71.68% (n = 362) of the respondents consider at least one form of misconduct to be proliferating in their area of knowledge at the national level. This figure falls to 48.95% (n = 247) in reference to misconduct in their own institution. The most frequently reported types of misconduct linked to life with colleagues are especially the use of personal influence (in evaluation or review processes); lax supervision of doctoral theses; and the abuse of power over people in lower positions. Personal ambitions and pressure from the evaluation system are regarded as the most influential causes of misconduct proliferation, according to academics at this Spanish university. (shrink)

Abstract:Should the responsibilities of business managers be understood independently of the social circumstances and “market forces” that surround them, or (in accord with empiricism and the social sciences) are agents and their choices shaped by their circumstances, free only insofar as they act in accordance with antecedently established dispositions, their “character”? Virtue ethics, of which I consider myself a proponent, shares with empiricism this emphasis on character as well as an affinity with the social sciences. But recent criticisms of both (...) empiricist and virtue ethical accounts of character deny even this apparent compromise between agency and environment. Here is an account of character that emphasizes dynamic interaction both in the formation and in the interplay between personal agency and responsibility on the one hand and social pressures and the environment on the other. Los índices bibliométricos están adentrándose de manera progresiva en la realidad de la comunidad académica. Por un lado, conceptos como ranking de publicaciones y cuartiles se emplean en procesos de valoración como las acreditaciones, los sexenios o la concesión de proyectos. Por otro lado, las grandes editoriales están consolidando modelos de difusión de la información que dificultan su acceso para la comunidad investigadora. El objetivo de este artículo consiste en examinar críticamente la combinación que se produce entre la bibliometría, los (...) sistemas imperantes de valoración de la investigación y los modelos editoriales. Este análisis nos lleva a esbozar algunos retos éticos que se plantea para el área de filosofía moral. Bibliometric indices are progressively moving towards the reality of the academic community. On the one hand, concepts like rankings of publications and quartiles are used in evaluation processes, such as accreditations, sexennials or awarding projects. On the other hand, large publishing houses consolidate models to diffuse information which makes the access difficult for the research community. This article aims to critically examine the combination formed by bibliometry, prevailing systems that evaluate research and publishing models. This analysis allowed us to outline some ethical challenges that are considered for the moral philosophy area at different levels. (shrink)

El problema se ha nombrado de muchas maneras: incapacidad de proveer políticas acertadas, corrupción, desencanto o abstención electoral, entre otros indicadores de la crisis de legitimidad que atraviesan al sistema. En la búsqueda de soluciones, se discute la viabilidad de mecanismos alternativos o complementarios a los representativos: ¿Es el referendo un buen instrumento para incluir a la ciudadanía en la toma de decisiones? ¿Pueden los procesos deliberativos contrarrestar los efectos de las fake news? ¿Debería el gobierno de los expertos reemplazar (...) a los "incompetentes políticos"? o ¿Debería promoverse el gobierno de "los comunes", seleccionados por sorteo? Aquí discutimos determinados modelos de democracia disponibles -representativa, participativa, deliberativa, aleatoria y monitorizada- para proponer una "ecología de la participación". En otras palabras, sugerimos entender los mecanismos de ejercicio del poder, en un sistema determinado, como estructuras de incentivos socio-políticos que promueven la formación de consensos o la polarización, el control o la delegación, la ampliación de la agenda pública o su restricción, la demagogia o el debate informado.
