Religion is increasingly a social and political factor in post-modern societies nowadays and the question of the role of religion in the public sphere is more and more brought to the fore: a challenge to legal philosophers. Should religion be only a private affair, or should the public dimension of religion be more acknowledged? Do we have to interpret the freedom of religion and the separation of church and state in a strict (laicist) sense, (...) or do we have to allow for a more benevolent relation between religion and the state? Political philosophy has difficulties to cope with the complexity and variety of state-religions relations. ‘Strict separationism’ is still the preferred option amongst liberals, deliberative and republican democrats, socialist and feminists. In this article, I develop a complex typology based on comparative history and sociology of religions. I summarize my reasons why institutional pluralist models like plural establishment or non-constitutional pluralism are attractive not only for religious minorities but for religiously deeply diverse societies in general. Most attention is paid defending (...) associative democracy, the most flexible and open variety of institutional pluralism, against realist objections that group representation is incompatible with liberal democracy, that it leads to stigmatization and bureaucratization, that it strengthens undemocratic leaders, that it leads to an ossification of the status quo, and, most importantly, that it is inherently divisive undermining social cohesion and political unity. In my refutation of these objections I try to show that it helps to integrate minority religions into liberal democratic policies compatible with reasonable pluralism and to prevent religious and political fundamentalism. The article discusses the conflict between lived religion and the state control of poor relief in a modernizing society by analysing the case of Emma Mäkinen’s private orphanage. Emma Mäkinen’s philanthropic work among neglected children was motivated by her Evangelical Revivalist conviction. Because of her trust in the transformative power of faith, she considered it appropriate to establish an orphanage next to a shelter for ‘fallen’ women. This decision led her onto a collision course with the State (...) Inspector of Poor Relief and the general public, who did not share her religious views but emphasized the legislative and moral aspects vis-à-vis organizing social work. The conflict demonstrates, firstly, how the ancien régime and the traditional religious authority of the Evangelical Lutheran state church in particular was challenged by individual agency in voluntary associations such as the Evangelical Revivalist Free Mission. Secondly, the case of Emma Mäkinen’s orphanage reflects how new kinds of boundaries were created by the encroaching of state control into the sphere of private philanthropy, followed by the strengthening role of scientific theories and nationalistic thinking in social work. Thirdly, the conflict opens up a view on border-crossings, thus emphasizing the undefined nature of a modernizing society. (shrink)

This paper considers the relationship between women, religion and the Australian state via an examination of federal anti-discrimination law. Much of the social research into religion-state relations over the last ten years, particularly with the rise of neo-liberalism, demonstrates that religious groups and ideas are actively involved in public debate, policy formation and implementation. While this has been examined by some scholars in social policy, particularly education, there has been little research on the relationship between women’s (...) rights and post-secular politics. This essay will address this gap by firstly locating women’s rights in the context of global forms of neo-liberalism and specifically by examining Australian federal anti-discrimination legislation, which seeks to protect religious freedom by allowing religious groups general exemption from adhering to non-discriminatory employment and training protocols. The work defends autonomy-based liberalism and elaborates how this liberalism can meet the requirements of liberal neutrality. Church leaders often express views on political issues and there is no objection to them doing so. However, when they direct members of Parliament on how they should vote on particular issues and intervene in litigation between private individuals, they contravene the long accepted principle of separation between church and state. The separation of church and state isn’t the same as separating religion from politics. Countries that have enshrined secularism have found themselves discussing religious architecture, law and clothing.

Tanabe Hajime, the Kyoto School philosopher of modern Japan, proposes a new idea of the relationship between religion and politics in terms of the triadic logic of species that is motivated by the religious moment of repentance. Even the state existence has the inherently radical evil as in the case of the individual person, due to its duality of the species level of being. This means that the state existence is on the way of actualization of the (...) genus like universality, while always involving in the regression into the past substrative being which prevents it from realizing its own universality. In other words, the state existence is not absolute as such but rather a balanced being between ideality and reality, absolute and relative. This entails that politics is in need of perpetual reformation in connection with the religious act of repentance for sin and evil deeply lurked in human beings from time immemorial. Tanabe’s Logic of Species as the dialectic elucidates the negative mediation of politics and religion from the metanoetic perspective and sheds a new light on the relation of world religion and politics today. There is some discussion of the tension between his philosophy and Prussian authorities in Berlin. Hegel's political liberalism appears to have compromised by both civil and religious authorities of his day.

The article seeks to investigate the intersection of local-based religion legal system and state’s legal system. It focuses on the constitutional debates on the position and the status of Aceh Qanun Jinayat within the Indonesian legal system and how the Indonesian Supreme Court the Islamic penal law based on Aceh’s Qanun in their decisions. Using the legal research approach, this article begins with the background of the Qanun Jinayat implementation in Aceh, then discusses the constitutional debates on the (...) position of the Qanun in the Indonesian legal system and ends with analyses of Supreme Court decisions on the application of the Qanun Jinayat in criminal cases in Aceh. This article argue that Aceh’s Qanun is similar to the other provincial regulation within the Indonesian legal system, which has limited areas to regulate the punishment in criminal cases. However, the paper found that although the Indonesian legal system forbids Aceh’s Qanun holds the penalty more severe than the National criminal law, the Supreme Court seems to accept these practices and use them in their decisions in Aceh’s criminal cases. By Charles B.Jones. Honolulu: University of Hawaii Press, 1999. 233 pp. Charles Jones spent over three years living in Taiwan pursuing the research for this book and for journal articles about religion on the island. He is (...) currently on the faculty of the Department of Religion at the Catholic University of America. Jones primarily focuses on the history of Chinese Buddhism as an organized religion in Taiwan from the mid-1600s to the late 1980s. This is a much needed study as most literature on Chinese Buddhism is based on Mainland Chinese Buddhism. Only in the last decade has there been a shift to focus on Taiwan Buddhism as a separate entity rather than seeing it only as an extension of Mainland Chinese Buddhism.The book is nicely organized into three major historical eras. Part 1 is titled "The Ming and Qing Dynasty (1660-1895)." This section, only one chapter, mainly focuses on the arrival and early development of Buddhism in Taiwan. Part 2 is titled "The Japanese Colonial Period (1895-1945)." This section, two chapters, of course focuses on the advent of Japanese Buddhism on the island along with its impact on Taiwan's Buddhism. Part 3 is titled "From Retrocession to the Modern Period (1945-1990)." This is the largest section of the book, with four chapters. I found this section to be more detailed and interesting than the previous two sections. I will spend the remainder of this book review commenting on this last section.In part 3 of his book, Jones begins with a chapter on the retrocession (the period at the end of World War II when Japan was forced out of Taiwan) and the arrival of the Mainland Buddhist monks to Taiwan. This chapter shows the emergence of an organized Buddhism that started to develop under the oversight of the Buddhist Association of the Republic of China (BAROC), which had begun previous to World War II in Mainland China but relocated to Taiwan with the national government in 1949. Also of interest in this chapter is the discussion of the power struggles within Buddhism between a traditionalist faction led byYuanying, and a reformist faction led by Taixu. In the end, the struggle was resolved in favor of the traditionalists; this has led to Taiwan Buddhism tending to incline toward conservatism.Chapter five focuses entirely on the Buddhist Association of the Republic of China (BAROC). It is neatly organized into two major sections, "The early period, 1949-1960," and "The middle period, 1960-1986." In the early period section, Jones does a good job explaining the BAROC's organization, mission, and activities. Included as well is a small but fascinating discussion on "The vitality of the nun's order after 1952," in which Jones tries to answer the question of why nuns have increasingly come to predominate numerically over monks, a situation that exists only in Taiwan and Hong Kong.The second half of the chapter, "The middle period, 1960-1986," focuses on the leadership of the BAROC under Baisheng. From 1960, when Baisheng became president of BAROC, until his death in 1986, Baisheng remained a controlling presence in BAROC affairs, despite the fact that he did not hold the presidency continuously [End Page 133] during this period. Also in this section, Jones highlights the internationalism ofTaiwan Buddhism under the leadership of Baisheng, which was seen in the ordinations of foreign monks and in the involvement of BAROC in international Buddhism organizations. This chapter also covers the continual struggle to regain possession of Japanese-era temples.Chapter five ends with a section called "Criticisms of the BAROC." The largest criticism leveled against the BAROC was that it failed to become the unifying force for Taiwan Buddhism that it might have been, a problem related to its elitist attitude at the national level, where only a very small closed group of people had the actual decision... How does state policy shape our most intimate desires? This groundbreaking anthropological approach to the study of desire shows how Orthodox desires and their discontents are reshaped at the intersection of religion, reproduction and politics, highlighting how ethical choreographies between personal desire and the state emerge even in the most traditional settings.

This article provides a brief introduction to articles reflecting on the current state of conversation regarding religion and violence. I begin by noting the occasion for which the articles were developed, then note some of the points made by each of the authors.

The secular character of the Nigerian state should not impede collaboration between the Roman Catholic Schools Management Board and the Government of Cross River State (Nigeria) in the area of religious education. Based on the above claim, this paper is an exercise in content analysis of The Catholic School{\\ial is, the document regulating Catholic principles of education in schools) and Religion and National Values: Primary 1- 5(text on curricular contents of religious education at the primary school level (...) in Nigeria) in view of highlighting its implications for religious education. This work is focused on bringing out some points of convergence and divergence, if any, in these two documents. Content analysis technique is the modus operandi used in this research paper. The research findings of this paper show that Catholic primary schools can adopt the curriculum for religious education but should be weary of some of its doctrinally watered-down contents. (shrink)

Continuing Keith Ward's series on comparative religion, this book deals with religious views of human nature and destiny. The beliefs of six major traditions are presented: the view of Advaita Vedanta that there is one Supreme Self, unfolding into the illusion of individual existence; the Vaishnava belief that there is an infinite number of souls, whose destiny is to be released from material embodiment; the Buddhist view that there is no eternal Self; the Abrahamic belief that persons are essentially (...) embodied souls; and the materialistic position that persons are complex material organisms. Indian ideas of rebirth, karma, and liberation from samsara are critically analysed and compared with semitic belief in the intermediate state of Sheol, Purgatory or Paradise, the Final Judgement and the resurrection of the body. The impact of scientific theories of cosmic and biological evolution on religious beliefs is assessed, and a form of 'soft emergent materialism' is defended, with regard to the soul. In this context, a Christian doctrine of original sin and atonement is presented, stressing the idea of soterial, as opposed to forensic, justice. Finally, a Christian view of personal immortality and the 'end of all things' is developed in conversation with Jewish and Muslim beliefs about judgement and resurrection. (shrink)

The collection of essays in this volume critically explore various aspects of the modern development of the religion-secular dichotomy and its ideological function in the assertion of colonial power since the 16th century. The authors hope to illuminate the role and formation of the modern category of religion, and of the academic study of religion, as colonial instruments in the more general subjection of indigenous concepts of order to the classificatory needs of Euro-America. The methodology tends to (...) overflow traditional disciplinary boundaries and offers analyses that are historiographical, literary and ethnographical. However, rather than seeking comprehensiveness in such a vast field, the authors here concentrate on specific aspects of the colonial relationship either from the point of view of a particular colonized culture, for example Mexico, Guatemala, Vietnam, India, Japan, South Africa, Canada; or from the point of view of the colonizing powers, in this case England, Germany and the United States. The authors hope to encourage further studies by specialists in different cultures and languages in the problems of imposition, translation, and reception of the separation of 'religion' from other domains such as 'politics', 'economics' and the 'non-religious' civil domain. This essay explains the rationale behind a series of reviews on interactions between knowledge and values, science and religion, in different countries or regions around the world. The series will run in Zygon for the whole of 2015 and beyond. In the literature, it may seem that discussions in the United States and to a lesser extent the United Kingdom are typical of the issues, but they need not be. David Livingstone showed that the reception of evolution differed, even (...) among Calvinists in different countries. Thus, rather than an export model, we should take time to learn from scholars rooted in different contexts how in their situation issues on knowledge and values arise and are dealt with. In this interplay of global processes and local contexts, indicated with the term glocalization, we should be alert to the migration of concepts and the transformations that ideas undergo. (shrink)

Some scholars see this critique of Christianity as an expression of the irreligious, immoral, neopagan, or scientific Machiavelli, making it the chief index of his modernity. 1 One subset within this group treats Machiavelli’s (...) [End Page 597] anthropology as a secularized version of Augustine on original sin, absent an Eden behind it and a redemption before it. 2 Another view of Machiavelli on religion sees him as treating religion, whatever its teachings, functionally, as an instrument promoting desirable political behavior. 3 This is why they regard [End Page 598] Machiavelli as original and modern; although Maury D. Feld notes rightly that Machiavelli is here simply imitating the ancient Roman historians, who all treat religion in just this way. 4 For some proponents of the functionalist interpretation, it does not preclude Christian belief on Machiavelli’s part. To some extent, yes. Once, that is, we consider a number of issues not always brought to bear on this question. Machiavelli recognizes that the foreigners who have overrun Italy and deprived Florence of the republic he had served are as Christian as the Italians. At home and abroad, their Christianity has not undermined their military strength or the civic virtue Machiavelli associates with republics. Within contemporary Florence there were three kinds of republicanism on offer, for those unhappy with the Medici restoration of 1512. One group sought to restore the pre-Medici governo stretto constitution dominated by the ottimati. Their opponents defended governo largo republicanism. Machiavelli advocated this type of polity, informed by his reading of ancient history and his assessment of human nature. But another, competing version of governo largo was put forth by Girolamo Savonarola during the Dominican friar’s stormy career as de facto head of the Florentine state from 1494 to 1498. Savonarola’s republican theory combined a number of ideas that Machiavelli loathed: the appeal to the Venetian Great Council as a model, the wish to purge Florence of her sins so that she could serve as the New Jerusalem in the coming apocalypse, and the notion that governo largo was a means to these religious ends, since the more broad-based the government, the more readily could it legislate and enforce moral reform. And, far from self-destructing after the friar’s ashes had been strewn on the Arno, Savonarolan republicanism continued to draw support from a diverse and substantial group of Florentines. This paper looks at the state of research on churchstate relations in post-communist Romania in order to provide an outline of the most important questions which need to be addressed in the coming years. The article consists of two parts. First, a survey of academic studies published over the past two decades on the relationship between the country’s churches and state after 1990.
