Stakeholder theory has become a central issue in the literature on business ethics / business and society. There are, however, a number of problems with stakeholder theory as currently understood. Among these are: 1) the lack of a coherent justificatory framework, 2) the problem of adjudicating between stakeholders, and 3) the problem of stakeholder identification. In this essay, I propose that a possible source of obligations to stakeholders is the principle of fairness (or fair play) as discussed in the political (...) philosophic literature of Rawls, Simmons, and Cullity among others. The principle of fairness states that, “Whenever persons or groups of persons voluntarily accept the benefits of a mutually beneficial scheme of co-operation requiring sacrifice or contribution on the parts of the participants and there exists the possibility of free-riding, there exist obligations of fairness on the part of these persons or groups to co-operate in proportion to the benefits accepted.” In this essay I discuss the gaps in the current stakeholder literature, elucidate and defend a principle of fairness that fills the gap, compare the fairness model to other similar models of business ethics, and draw some conclusions for the future of stakeholder theory. A number of tensions have been suggested between stakeholder theory and strategic management (SM). Following a brief review of the histories of stakeholder theory and mainstream SM, we argue that many of the tensions are more apparent than real, representing different narratives about stakeholder theory, SM, business, and ethics. Part of the difference in these two theoretical positions is due to the fact that they seek to solve different problems. However, we suggest how there are areas of overlap, and we (...) argue that some of the tensions may, instead, provide interesting ways to put the two areas of scholarship and practice together. Abstract:This paper is a preliminary attempt to better understand the concept of legitimacy in stakeholder theory. The normative component of stakeholder theory plays a central role in the concept of legitimacy. Though the elaboration of legitimacy contained herein applies generally to all “normative cores” this paper relies on Phillips’s principle of stakeholder fairness and therefore begins with a brief description of this work. This is followed by a discussion of the importance of legitimacy to stakeholder theory as well as the (...) general ambiguity of the term. A distinction is then drawn between normative and derivative legitimacy. Reference to this distinction helps distinguish between a relationship with the organization based on direct moral obligation and one based on the power to help or harm the organization. It is concluded that stakeholders who retain the ability to affect the organization arelegitimate(derivatively), but that this legitimacy is derived from the moral obligation owed other (normative) stakeholders and that the two sorts of legitimacy are importantly different from one another. An example of the normative/derivative distinction at work in managerial decision making is elaborated upon and managerial and research implications are then suggested. (shrink)

Abstract:The purpose of this paper is to suggest that at least one strain of what has come to be called “stakeholder theory” has roots that are deeply libertarian. We begin by explicating both “stakeholder theory” and “libertarian arguments.” We show how there are libertarian arguments for both instrumental and normative stakeholder theory, and we construct a version of capitalism, called “stakeholder capitalism,” that builds on these libertarian ideas. We argue throughout that strong notions of “freedom” and “voluntary action” are the (...) best possible underpinnings for stakeholder theory, and in doing so, seek to return “stakeholder theory” to its managerial and libertarian roots found in Freeman (1984). Stakeholder theory is often unable to distinguish those individuals and groups that are stakeholders from those that are not. This problem of stakeholder identity has recently been addressed by linking stakeholder theory to a Rawlsian principle of fairness. To illustrate, the question of stakeholder status for the non-human environment is discussed. This essay criticizes a past attempt to ascribe stakeholder status to the non-human environment, which utilized a broad definition of the term "stakeholder." This paper then demonstrates how, despite the (...) denial of stakeholder status, the environment is nonetheless accounted for on a fairness-based approach through legitimate organizational stakeholders. In addition, since stakeholder theory has never claimed to be a comprehensive ethical scheme, it is argued that sound reasons might exist for managers to consider their organization's impact on the environment that are not stakeholder-related. Recent structural innovations in global commerce present difficult challenges for legacy understandings of responsibility. The rise of outsourcing, sub-contracting, and mobile app-based platforms have dramatically restructured relationships between and among economic actors. Though not entirely new, the remarkable rise in the prevalence of these “not-quite-arm’s-length” relationships present difficulties for conceptions of responsibility based on interrogating the past for specifiable actions by blameworthy actors. Iris Marion Young invites investigation of a “social connection model of responsibility” (SCMR) that is, in many ways, (...) better suited to this new commercial reality. Scholars working to understand corporate responsibility have invoked Young’s model to some good effect, though often superficially and uncritically. In this paper, we look closely at Young’s social connection model and its potential for helping us understand corporate responsibility in a radically networked world. (shrink)

This paper considers the variant of the social contract that has arguably gained the most attention among business ethicists: integrative social contracts theory or ISCT [Donaldson and Dunfee: 1999, Ties That Bind (Harvard Business School Press, Boston)]. A core precept of ISCT - that consent to membership in an organization entails obligations to follow the norms of that organization, subject to the moral minimums of basic (...) human rights - is a reasonable and appealing notion. One potential challenge for those attempting to apply this idea, however, lies in the dynamic nature of social norms. Organizational norms evolve, often through the conscious efforts of community members and leaders. As currently formulated, ISCT offers a framework that under-appreciates the evolving nature of moral norms. In this paper, we extend ISCT by considering the circumstances under which the terms of and parties to social contracts change. We also consider a number of principles that should be considered as the terms and parties to organizational social contracts change. (shrink)

ABSTRACT:This essay attempts to provide a useful research agenda for researchers in both strategic managementandbusiness ethics. We motivate this agenda by suggesting that the two fields started with similar interests, diverged, and are beginning to converge again. We then identify several streams that hold particular promise for developing our understanding of the relationship between strategy and ethics: stakeholder theory, managerial discretion, behavioral strategy, strategy as practice, and environmental sustainability.

The private provision of security services has attracted a great deal of recent attention, both professional and popular. Much of that attention suggests the questioned moral legitimacy of the private vs. public provision of security. Linking the literature on moral legitimacy and responsibility from new institutional and stakeholder theories, we examine the relationship between moral legitimacy and responsible behavior by both private security companies (PSCs) and their stakeholders. We ask what the moral-legitimacy-enhancing responsibilities of both might be, and contribute to (...) both literatures and their managerial implications by detailing the content of those responsibilities, emphasizing the reciprocal nature of moral obligations. A mainstay of stakeholder management is the belief that firms create value when they invest more time, money, and attention to stakeholders than is necessary for the immediate transaction. This tendency to repeat interactions with the same set of stakeholders fosters what we call stakeholder friction. Stakeholder friction is a term for the collection of social, legal, and economic forces leading firms to prioritize and reinvest in current stakeholders. For many stakeholder scholars, such friction is close to universally beneficial, but (...) the associated costs—to both the firm and legitimate stakeholders—have been underspecified. Failure to account for the effects of stakeholder friction can cause managers to under-allocate attention and value to some legitimate stakeholders and to over-allocate attention and value to current stakeholders. We examine the concept of stakeholder friction and elaborate on three exemplar sources of friction prominent in the stakeholder literature. This is followed by an analysis of investments in stakeholder relationships and a consideration of the implications of stakeholder friction on the ability of firms to prioritize stakeholders. The tendency to reinvest in current stakeholders has, in addition to the oft-discussed benefits, a predictable downside. (shrink)

In this paper, I explore the relationship between naturalism and transcendental idealism in Fichte. I conclude that Fichte is a near-naturalist, akin to Baker, Lynne Rudder (2017). “Naturalism and the idea of nature,” Philosophy 92 (3): 333–349. A near-naturalist is one whose position looks akin to the naturalist in some ways but the near-naturalist can radically differ in metaphilosophical orientation and substantial commitment. This paper is composed of three sections. In the first, I outline briefly what I take transcendental idealism (...) to be, as well as some differences in types of naturalism, and how this maps on to Fichte. In the second, I give an exegesis of Fichte’s key arguments in the Later Jena period, which are important for the question of his relationship to naturalism. In the third, I continue the exegesis with a discussion of Fichte’s conception of God, and conclude that these arguments support a near-naturalist reading of Fichte. (shrink)

An emerging body of research recognizes the importance of the past and history for corporate social responsibility scholarship and practice. However, the meanings that scholars and practitioners can ascribe to the past and history differ fundamentally, posing challenges to the integration of history and CSR thinking. This essay reviews diverse approaches and proposes a broad conceptualization of the relationship between the past, history, and CSR. We suggest historical CSR as an umbrella term that comprises three distinct theoretical perspectives. The “past-of-CSR” (...) perspective is concerned with the history of CSR and business ethics as a set of concepts and practices. The “past-in-CSR” perspective involves employing empirical historical research to substantiate and elaborate CSR concepts and theories. Finally, the “past-as-CSR” perspective seeks to understand the past as a living, yet contested, facet of current organizations, influencing contemporary perceptions of corporate and managerial responsibility. We then elaborate on conceptual issues and paths that may prove useful for future research. In all, this essay and the thematic symposium it precedes strive to deepen and broaden the salience of the past and history for thinking about business ethics and business responsibilities. (shrink)

Will stakeholder theory continue to transform how we think about business and society? On the occasion of this journal’s 60th anniversary, this review article examines the journal’s role in shaping stakeholder theory to date and suggests that it still has transformative potential. We conducted a bibliometric analysis of co-citations in the literature from 1984 to 2020. Reporting these results, we examine the field’s evolving structure. Contextualized theoretically as an accomplishment of institutional work—the creation of a meaningful and innovative field ideology—this (...) structure is remarkable for how it integrates ethical and behavioral arguments, invites engagement from adjacent domains, and arrives at important insights for business and society. “I am only what I make myself to be”, Fichte tells us. In this paper, I outline Fichte’s views on sex, marriage and gender, with two aims. Firstly, to elucidate an aspect of his moral theory which has received little attention, and secondly to argue that Fichte’s distinctive stance on selfhood, freedom, and normativity lead to a revisionary account of gender expression and identity, where people can freely carve out their own identity, irrespective of “nature”. In this paper, I therefore (...) outline Fichte’s own views, highlighting what I see as a tension in the texts between essentialism and antiessentialism about gender, before reconstructing a neo-Fichtean view which foregrounds the anti-essentialist aspect. It is no longer controversial or suspicious to be curious. But, until recently, there has been little curiosity about curiosity itself. This has begun to change, with the publication of a series of books asking what curiosity is and why it matters. Though an eclectic and slippery subject, taking different forms in different times and places, curiosity has two common threads. The first is ‘care’, comprising commitment or interest and a quality of attention. The second is concerned with ‘questions’, and (...) this highlights the drivers and parameters of enquiry: the mixture of virtue, pleasure and passion that drives explorers to uncover the new. Critical attention to curiosity – examining relations of care that drive curiosity, and drawing attention to the origin and form of questions – speaks to fundamental questions about knowledge: how we come to know the things we know. Alexander Raven Thomson was a British fascist philosopher, active from 1932 to 1955. I outline Thomson’s Spenglerian views on civilization and decline. I argue that Thomson in his first book is an orthodox Spenglerian who accepts that decline is inevitable and thinks that it is morally required to destroy civilization in its final stages. I argue that this suffers from conceptual issues which may have caused Thomson’s change to a revised form of Spenglerianism, which is more authentically fascist. This authentically (...) fascist view is then seen to fall prey into the problem inherent in the very idea of permanent rebirth. (shrink)

George Sword an Oglala Lakota (1846–1914) learned to write in order to transcribe and preserve his people’s oral narratives. In her book Delphine Red Shirt, also Oglala Lakota and a native speaker, examines the compositional processes of George Sword and shows how his writings reflect recurring themes and story patterns of the Lakota oral tradition. Her book invites further studies in several areas including literature, translation studies and more. My review of her book suggests some ways it could be used (...) as a primary resource book in developing curricula in Indigenous philosophy . (shrink)

It is well-known that Kant defends a conception of God and the final end of our moral striving, called the highest good. In this article, I outline Kant's argument for why we ought to have faith in God and hope for the highest good, and argue that the Kantian argument can be extended in such a way as to show the unity of the theological virtues. This feature of the Kantian account can then have ramifications in further questions regarding the (...) relationship of faith and moral action. (shrink)

In this paper, I will investigate the early work of William Temple (1881–1944). My contention is that Temple’s systematic philosophy contains resources for an interesting variant of a desire argument for God’s existence and for the truth of Christianity. This desire argument moves from claims about the nature of human reason to the conditions for its satisfaction and how that satisfaction might be achieved. In constructing this argument, Temple confronts the problem of evil, and so I will also outline his (...) response to the problem here. Temple is often overlooked in histories of philosophy, though he was conversant with philosophical classics, including Plato, Aristotle, Kant, Hegel, and Lotze, and, to list a few of the contemporaries or near-contemporaries: Balfour, Haldane, F. H. Bradley, A. C. Bradley, Moore, Bosanquet, Joachim, and Croce. He also acknowledges, in the preface to his main philosophical work Mens Creatrix, a special debt to Bergson, but also signals distance from him in the same place. Temple presents an interesting case of a philosopher and theologian (most of his books are a mixture of the two, some being more predominantly one or the other) because of his commitment to philosophical system in the midst of early analytic philosophy. This short piece is collected in the complete edition of Fichte's works published by the Bavarian Academy of Sciences (1964-2012), IV/1, pp. 153-167. According to the editors' foreword, it first appeared anonymously as part of a pamphlet titled "Something from Professor Fichte and for him. Published by a veracious schoolmaster" in 1799 in Bayreuth as a response to the so-called atheism dispute, which eventually cost Fichte his chair in Jena. This translation concerns a part appended to the pamphlet which is (...) titled "Professor Fichte's Ideas on God and Immortality. Published from lecture notes". The schoolmaster who published the pamphlet was Christian Wilhelm Friedrich Penzenkuffer, who had studied theology and was at that time teaching biblical exegesis at high school. It was found that among the students who attended Fichte's lectures in the winter semester 1794 there was a Johann Friedrich Penzenkuffer, probably a brother of the pamphlet author. It seems most plausible that the content of the pamphlet came from a student transcript of Fichte's lectures on logic and metaphysics in Jena and the anonymous publication was intended as a defence for Fichte that what he taught was not atheism but rather theism. This pamphlet has importance not only as part of its immediate context - the atheism dispute - but also for Fichte's philosophy of religion more generally. (shrink)

The trend toward increased levels of business interconnectedness in the value chain has clouded the issue of responsibility for business practices. Firms havehistorically denied responsibility for many questionable practices by suggesting that such acts were committed somewhere else in the value chain and that, because they are separated by an arm’s length transaction, they are not responsible. Emerging evidence suggests that in light of the interconnected and networked business environment, the arm’s length defense is growing less effective. We discuss the (...) practical realities that firms are facing in the highly networked environment and offer examples of each. The purpose of this study is to deconstruct the language used in President Trump’s Facebook posts while on the campaign trail, and the subsequent comments which reiterate and reify this rhetoric, to understand how Syrian refugees are labeled as a dangerous population unworthy of asylum. By utilizing the theoretical groundwork of Foucault, Agamben, and Mbembe, this qualitative content analysis will explore how Syrian refugees, as depicted by Facebook comments, represent a “disposable population.” We conclude that by reducing Syrian refugees to (...) a sub-human status and representing them as the dangerous and unworthy other, both President Trump who initiated this rhetoric, and those who responded in a way which legitimized his views, effectively labeled Syrian refugees as a dangerous population unworthy of asylum within the USA. Competency to be executed evaluations are conducted with a clear understanding that no physician-patient relationship exists. Treatment however, is not so neatly re-categorized in large measure because it involves the physician's active provision of the healing arts. A natural tension exists between what practices may be legally permissible and what are ethically acceptable. We present an overview of the existing positions on this matter in the process of framing our argument.

The history of physician involvement in capital proceedings is longstanding and ripe with controversy and conflicts of ethical concerns. Previously one of us has written that the controversy is more appropriately characterized as a conflict of moral position rather than one of ethical dilemma.In hindsight, we believe that analysis, while true, does not capture the depth or complexity of the issue.Forensic psychiatric evaluations, including competency to be executed evaluations, are done with a clear understanding that no physician-patient relationship exists.
