The wrongful disability problem arises whenever a disability-causing, and therefore (presumptively) wrongful, procreative act is a necessary condition for the existence of a person whose life is otherwise worth living. It is a problem because it seems to involve no harm, and therefore no wrongful treatment, vis-à-vis that person. This essay defends the nonconsequentialist, rights-based, account of the wrong-making features of wrongful disability. It distinguishes between the person-affecting restriction, roughly the idea that wrongdoing is always the wronging of some (...) person, and the harm principle, the idea that all wrongings are harmings. It argues, first, that the harm principle should be rejected, in light of offending intuitions in salient examples. Rejection of the harm principle is not only independently plausible, but also paves the way for a nonconsequentialist diagnosis of wrongful disability. This diagnosis conceives of wrongdoing as a failure to express adequate respect for the humanity or personhood inherent in the person created. The paper defends a theory of humanity-respecting rights that accommodates plausible intuitions about satisficing and fairness, without resorting to consequentialist premises that lead to well-known impossibility results and paradoxes. From the scholarship available we can gather that fraternity has been subjected to several interpretations and linked with several virtues. For a few, it stands close to the actualities of solidarity, humanity, compassion, companionship, and brotherhood. For others, it is the “glue that binds equality and liberty to the civil society” and “presents a sense of continuity with the past and the future”. Omvedt replaces the word fraternity with “community” as an important component of a human vision for the new (...) millennium along with equality and justice. Historically, ‘liberty, equality, and fraternity became a major influence on political thought since the French Revolution. The Revolution marked the triumph of the people and pronounced the Declaration on Rights of Man and of the Citizen in 1789. In modern societies, although there are many differences in interpretation, the idea of fraternity is less directly accepted, but the principles of collective action and social responsibility are widely recognized’. According to Johnston, 'fraternity' was rather less central to the preconceptions of the enlightenment predecessors of the revolutionary era, their emphasis being given rather to the 'rights of man' and to the equality of entitlement to those rights. To date, our pre-occupation with liberty and equality has left vacant a conceptual upbringing of fraternity in the postcolonial context. (shrink)

Background Preconception Expanded Carrier Screening is a genetic test offered to a general population or to couples who have no known risk of recessive and X-linked genetic diseases and are interested in becoming parents. A test may screen for carrier status of several autosomal recessive diseases at one go. Such a program has been piloted in the Netherlands and may become a reality in more European countries in the future. The ethical rationale for such tests is that they enhance (...) reproductive autonomy. The dominant conception of autonomy is individual-based. However, at the clinic, people deciding on preconception ECS will be counselled together and are expected to make a joint decision, as a couple. The aim of the present study was to develop an understanding of autonomous decisions made by couples in the context of reproductive technologies in general and of preconception ECS in particular. Further, to shed light on what occurs in reproductive clinics and suggest concrete implications for healthcare professionals. Main text Based on the shift in emphasis from individual autonomy to relational autonomy, a notion of couple autonomy was suggested and some features of this concept were outlined. First, that both partners are individually autonomous and that the decision is reached through a communicative process. In this process each partner should feel free to express his or her concerns and preferences, so no one partner dominates the discussion. Further, there should be adequate time for the couple to negotiate possible differences and conclude that the decision is right for them. The final decision should be reached through consensus of both partners without coercion, manipulation or miscommunication. Through concrete examples, the suggested notion of couple autonomy was applied to diverse clinical situations. Conclusions A notion of couple autonomy can be fruitful for healthcare professionals by structuring their attention to and support of a couple who is required to make an autonomous joint decision concerning preconception ECS. A normative implication for healthcare staff is to allow the necessary time for decision-making and to promote a dialogue that can increase the power of the weaker part in a relationship. (shrink)

[...] it would seem natural to assume that the disciplines of literary studies and linguistics should by rights converge regularly to exchange views as each pursues its own goals. Is such a convergence possible on the question of sense and nonsense? James W. Underhill (this volume) The contributors to the present volume have focused their attention on two sets of problems that are leitmotifs in all the articles gathered. Firstly, should literary semantics - the linguistic study of texts/discourses marked (...) with the feature of 'literariness' and 'poeticalness' - strive after an interpretation of all such texts at all costs? Are all literary texts interpretable? How do we cope with such troublesome linguistic phenomena as anomaly, deviance, and absurdity? Aren't we, by any chance, fascinated by nonsense? Do we try to make it at least partly meaningful? Is interpretability our default value? The introductory article by the renowned scholar Margaret H. Freeman is an important voice, indeed a manifesto of sorts of literary semanticists in this respect. Secondly, while trying to answer all these questions, well aware of the fact that literary semantics is a fuzzy branch of linguistic studies, we have attempted at exploring its borderline zone to see to what extent we have to draw from various theoretical sources. Literary semanticists have often proved that they are capable of arguing contrastively in the atmosphere of openness to such neighbouring fields as: discourse analysis, literary pragmatics and reader-response theories, narratology, literary semiotics and hermeneutics, translation studies and - very importantly - the philosophy of language. The authors contributing to this book, an international company of regularly cooperating linguists and literary scholars, strike a nice balance between the cognitive and the more traditionally or philosophically-oriented frameworks of study, being a vivid proof that cognitive and other "denominations" are perfectly capable of fruitful coexistence. The volume ends with a short presentation by RadosÅaw Nowakowski, already known to academic and artistic audiences in Europe as a creator and propagator of liberature - the art of unusual bookmaking, the art of the book liberated from our traditional preconceptions. We hope that our volume will be of interest to academics and students of literary theory and linguistics alike, especially those involved in literary semantics, stylistics and poetics. Naturally, the book is also addressed to members and sympathizers of IALS (International Association of Literary Semantics) and the readers of Journal of Literary Semantics, scattered across the world. This inevitably raises questions about the purpose and aims of education consistent with conceptions of democracy. These ultimately rest on the practical applicability and outcomes of competing visions of democracy without appeal to pre-political or prior goods, nor to certain knowledge (...) about justice or right; that is, to the dominant liberal discourse of citizenship that has become indistinguishable from the citizenship implicit in official policy documents. I argue in favour of a notion of citizenship conceived of in terms of learning processes that have a developmental and transformative impact on the learning subject, and an educational model that is more attuned to the procedural concerns of deliberative democracy than civics and citizenship education which tend to be underpinned by preconceptions of liberal citizenship, values and democracy. Liberalism is doomed to failure, John Kekes argues in this penetrating criticism of its basic assumptions. Liberals favor individual autonomy, a wide plurality of choices, and equal rights and resources, seeing them as essential for good lives. They oppose such evils as selfishness, intolerance, cruelty, and greed. Yet the more autonomy, equality, and pluralism there is, Kekes contends, the greater is the scope for evil. According to Kekes, liberalism is inconsistent because the conditions liberals regard as essential for good (...) lives actually foster the very evils liberals want to avoid, and avoiding those evils depends on conditions contrary to the ones liberals favor. Kekes argues further that the liberal conceptions of equality, justice, and pluralism require treating good and evil people with equal respect, distributing resources without regard to what recipients deserve, and restricting choices to those that conform to liberal preconceptions. All these policies are detrimental to good lives. Kekes concludes that liberalism cannot cope with the prevalence of evil, that it is vitiated by inconsistent commitments, and that—contrary to its aim—liberalism is an obstacle to good lives. In the accompanying paper I have attempted a new collation of the manuscripts of Moschus’Europa, in order to correct some errors and omissions that may be detected in the critical apparatus of Winfried Büihler’s excellent edition of this work . Büihler’s textual decisions, for instance, are refreshingly free from slavish preconceptions and inert prejudice. When he prints an emendation or opts for the daggers of despair, he is usually right. The occasions when he rejects the manuscript tradition without overriding justification (...) are rare. At 77 there is probably no need to posit corruption in δήγάρ At 127 κóλου foreshadows with typical Hellenistic ambiguity the verb λοώθηin 129.2 It is possible that there are two other places also where the manuscript tradition has wrongly been suspected: κυανin 47 and ϊαρόν in 60. The historical researches of Louis Couturat saved the logical work of Leibniz from the oblivion of neglect and forgetfulness. They revealed that Leibniz developed in succession several versions of a “logical calculus” (calculus ratiocinatororcalculus universalis). In consequence of Couturat's investigations it has become well known that Leibniz's development of these logical calculi adumbrated the notion of a logistic system; and for these foreshadowings of the logistic treatment of formal logic Leibniz is rightly regarded as the father of symbolic logic.It is (...) clear from what has been said that it is scarcely possible to overestimate the debt which the contemporary student of Leibniz's logic owes to Couturat. This gratitude must, however, be accompanied by the realization that Couturat's own theory of logic is gravely defective. Couturat was persuaded that the extensional point of view in logic is the only one which is correct, an opinion now quite antiquated, and shared by no one. This prejudice of Couturat's marred his exposition of Leibniz's logic. It led him to battle with windmills: he viewed the logic of Leibniz as rife with shortcomings stemming from an intensional approach.The task of this paper is a re-examination of Leibniz's logic. It will consider without prejudgment how Leibniz conceived of the major formal systems he developed aslogicalcalculi – that is, these systems will be studied with a view to the interpretation or interpretations which Leibniz himself intends for them. The aim is to undo some of the damage which Couturat's preconception has done to the just understanding of Leibniz's logic and to the proper evaluation of his contribution. (shrink)

Rationality bashing has become a popular sport. Critiques have quite rightly challenged models of rational planning that follow a linear progression from predefined ends to achieved goals. There have been several alternative theoretical and empirical developments including incrementalist projects, network theories, critical communication approaches, and heuristic models. Notwithstanding critiques of linear models of policy-making and planning, rationality as a general idea remains an important reference point for designing and evaluating policy-making and for orientating planning projects. We suggest that the concept (...) of rationality needs to be revised rather than abandoned and this article discusses how rationality in decision making may be reconstructed. We first review and critique some of the main preconceptions of rationality in policy-making and planning. We then discuss the nature and purpose of rationality from the perspective of John Dewey’s pragmatist philosophy and in light of contemporary theoretical and empirical analyses. We position rationality as a procedural standard of excellence that evolves and informs practices in the context of problematic situations. We propose that a theory of rationality, as a guide for planning and policy, should be developed for application in concrete problematic situations and at the same time should play a normative role and be orientated to moral, socio-historical, and ecological considerations. Dewey’s pragmatist theory is a promising source for such considerations. In this article we identify four ‘pillars’ of pragmatism to support such a revised rationality construct: (i) situationality, (ii) normativity, (iii) philosophical via media between foundationalism and relativism, and (iv) democratic inquiry. We discuss the application of a pragmatist rationality, that we refer to as ‘situational transactive’ rationality, using a model of decision making that builds on current understandings in planning and policy science. Finally, we discuss some of the possible advantages and challenges of undertaking such a pragmatist revision of rationality. (shrink)

The cover illustration for Richard Joyce’s elegant and powerful recent work, The Evolution of Morality, is a reproduction of an oddly fascinating and disturbing sixteenth-century engraving, the Anatomia del corpo humano. One has to examine the image for a minute to realize that the standing human figure, stripped of skin, and with muscles, tendons and joints revealed, holds the anatomist’s knife in his left hand and that, with his right, he holds up the single piece of skin, from bearded face (...) to dangling extremities, that had once covered his body. This is the anatomist self-flayed, revealed to inspection by his own knife. A double worry is suggested: the body without the skin may have surprising, or disquieting, features. There is no assurance that what is revealed will accord with our preconceptions. Additionally, there is the thought that only the artist’s magic, freezing a moment in time, permits the body to maintain its integrity. In reality, the body of the self-flayer would collapse and die in short order. -/- Richard Joyce similarly undertakes to wield the analytic knife of science and philosophy to cut away the surface appearance of the moral sense and see what lies beneath. Again, what we find may be surprising or disquieting. Beneath the surface, we find the once-hidden articulation of the moral sensibility. We see its parts, how they are connected, how one links to another. And we may also suspect or fear that what remains cannot long stand inspection in such a state. It may be, indeed, that “we murder to dissect.” And if so, then like the self-flayer, we are ourselves the victims. (shrink)

To scholars of Western intellectual history Hegel is one of the most important of all political thinkers, but politicians and other "down-to-earth" persons see his speculative philosophy as far removed from their immediate concerns. Put off by his difficult terminology, many participants in practical politics may also believe that Hegel's idealism unduly legitimates the status quo. By examining his justification of legal punishment, this book introduces a Hegel quite different from these preconceptions: an acute critic of social practices. Mark Tunick (...) draws on recently published but still untranslated lectures of Hegel's philosophy of right to take us to the core of Hegel's political thought. Hegel opposes radical criticism like that later offered by Marx, but, argues Tunick, he employs "immanent" criticism instead. For instance, Hegel claims that punishment is the criminal's right and makes the criminal free. From this standpoint, he defends specific features of the practice of punishment that accord with this retributive ideal and criticizes other features that contradict it. In a lucid account of what Hegel means by right and freedom, Tunick addresses Hegel specialists and those interested in criminal law, the interpretation of legal institutions and social practices, and justification from an immanent standpoint. Here at last is an American counterpart to Bertrand Russell's History of Western Philosophy. The eminent historian Bruce Kuklick tells the fascinating story of the growth of philosophical thinking in the USA, in the context of the intellectual and social changes of the times. Kuklick sketches the genesis of these intellectual practices in New England Calvinism and the writing of Jonathan Edwards. He discusses theology in the eighteenth and nineteenth centuries and the origins of collegiate philosophy in the early part (...) of the nineteenth century. We see the development of secular preconceptions and the emergence, after Darwin's writings of the mid-late nineteenth century, of forms of thought hostile to religion. Philosophy is situated in a variety of cultural contexts - the ministry, the growing system of higher learning, the conflict between philosophers and theologians and between amateur and professional thinkers, the suspicion of European ideas, and worries about the relevance of philosophy to public and political life. Kuklick's narrative portrays such great thinkers as Charles Peirce, William James, John Dewey, C. I. Lewis, Wilfrid Sellars, W. V. Quine, and Richard Rorty, and assesses their contributions to philosophy. He brings us right up to date with the first historical treatment of the period after pragmatism, and the fragmentation of philosophy in the second half of the twentieth century. Kuklick steers a controversial course between the divergent views that historians and philosophers take of the significance of philosophy in recent years. A discussion of the political role of monarchs in contemporary Western Europe is complicated by three uncritical preconceptions : the traditionalist-monarchist view of Kings as transcendent sovereigns, the democratic-emancipatory view which assumes that Kings are by definition nothing but constitutional nonentities, and the media-view of members of a royal family as at one and the same time both superhuman and very human actors.A realistic analysis of the role of monarchs and monarchy focuses on at least five issues : whether countries (...) remained monarchies in the wake of democratisation because of, or notwithstanding being monarchies ; the relationship of monarchs to major social cleavages; the very real importance of Kings within the actions of the nominal Crown notwithstanding the importance of the principle of ministerial responsibility ; the inevitably personal role of Kings in the making, the crisis and the fall of cabinets ; and the unavoidable conflict between the personal rights and actions of monarchs and the limitations which constitutional monarchy implies. According to Father Patrick Verspieren, a Roman Catholic priest and member of the Society of Jesus, the chief duty of the palliative care-giver is to suspend all preconceptions of the incurably ill patient's journey to life's end: "To accompany a dying patient is not to walk ahead of him, or to show him the right path, or to impose an itinerary on him, or even to presume to know what direction he will take. Rather, it consists in walking at the (...) patient's side, leaving him free to choose his own way and the rhythm of his own step". Is it possible, in practice, to suspend one's judgment regarding what is best for a dying patient and to respect the uncharted horizon that presents itself to each dying... (shrink)

This essay explores social science researchers with ‘insider status’. This term describes a researcher who is a member of the population they are studying. The research in question involved a birth mother studying the impact of compulsory child adoption on birth mothers. Research that grows from traumatic experiences may involve a researcher revisiting painful memories through her interactions with participants. She may hold unconscious biases and preconceptions. If not exposed or addressed, this raises ethical implications and can negatively affect the (...) reliability of the findings. Personally motivated research can be validated with the use of reflexivity. Often used in feminist methodology, it demands that the researcher examines her own feelings, reactions, and motives, and how these influence the interactions with participants, the analysis and findings. This essay shows how these philosophies behind reflexivity operate in practice. By reflexively aligning my own personal journey alongside birth mothers’ narrative, I was able to recognise and validate the role of myself in my research. This allowed me to face up to and challenge my biases and to avoid hierarchy that commonly exists between researcher and participants. For me this process went beyond simply being ethical practice, opening up opportunities for both creative and personal transformations. (shrink)

Nurses and midwives are part of health care in all the stages of our lives from preconception to death. Recent scientific advances have introduced new techniques of screening and diagnosis linked to stem cell isolation and therapies. These could affect us at any age and therefore nurses will be involved as carers and patients advocates for these techniques. In this article stem cell techniques and therapies are outlined, as well as some of the ethical challenges faced by various nursing (...) groups, whether in adult, learning difficulties, mental health, paediatric, primary care, public health or health visiting areas. Nurses have to understand the ethical issues and the rights of all parties (donor, recipient and families), which may conflict with each other, to be able to weigh up the benefits and costs to each group involved. Answers have to be found on a case-by-case basis within local moral frameworks and law. Nurses represent all parties in these therapies and act as advocates for every patient group. They need to act in an interprofessional environment to promote the best interests of all their clients, both clinically and ethically. (shrink)

This dissertation examines the phenomenology of self-awareness in an attempt to get clear on the nature of our 'basic sense of self'. I argue that our self-understanding is typically muddled by a prevalent but false metaphysical view that I refer to as 'the quasi-Cartesian view'. I begin with a diagnosis of this quasi-Cartesian view of the self and self-awareness, and argue that there are two main reasons for one might hold this view: on the one hand, we may have our (...) phenomenology colored by false metaphysical preconceptions; on the other, we may end up holding this view as a result of commitments held in the philosophy of mind. I try to cure us of this view by showing that it is neither defensible when presented with counter-arguments, nor fits the phenomenological data of our own experience. I next develop a positive account of what our basic sense of self is like when we have shed the distorting quasi-Cartesian preconceptions. I argue that in basic experience, we experience ourselves as bodily agents; moreover, I develop a transcendental argument to the effect that we must be embodied agents in order for us to have the kinds of experience that we do have. I next turn to an examination of the Heideggerian claim that we are self-interpreting animals in part constituted by our own self-interpretations in an attempt to determine the truth as well as the scope of this claim. My conclusion is that we can truthfully be said to be partly constituted by our own self-interpretations, but that we have but a limited authority as to the 'rightness' of an interpretation. Thus there are strict limits to our ability to be self-constituting. (shrink)
