In Death and Nonexistence, Palle Yourgrau defends what he calls the principle of Prior Possibility: nothing comes to exist unless it was previously possible that it exists. While this seems like a plausible principle, it’s not strong enough; it allows the impossible to come to exist. I argue for a stronger principle: nothing exists unless its existence has always been possible. Further, I argue that we then have reason to accept a surprising result: nothing exists unless its existence is always (...) possible. I argue that there is nothing in Kant’s moral theory that legitimates condemnation of same-sex relations and that the arguments from natural ends Kant relies on in doing so are unjustified by the constraints placed upon morality to avoid the empirical determination of judgments. In order to make clear why same-sex activity does not contradict the requirements of the moral law, we need to understand Kant’s account of legitimate sexual activity. I provide this reconstruction in the first section, drawing upon (...) the Lectures on Ethics and Metaphysics of Morals. In the second section, I critique the first kind of argument that grounds Kant’s assessment, that from natural ends. I show how it is based upon underlying teleological premises and raise doubts concerning Kant’s reliance on “regulative ideas” in making a consistent ethical theory. In the third section, I argue that same-sex activity that conforms to the conditions of the moral law, especially given the concepts of consent and reciprocity, are in conformity with Kant’s formal requirement of the law of pure practical reason, and therefore cannot justifiably be condemned on those grounds. Finally, I conclude with some discussion about Rawls and political liberalism. I hope to show how the present Kantian revival in ethical theory can place itself in opposition to the conservative and homophobic hysteria surrounding debates on political and legal issues such as same-sex “marriage.”. The paper explores the topic of organizational routines from a philosophical vantage point to see how the philosophy of action may help improve its understanding in organizational research. The main goal is to show the distinctive complexity of the intentional picture of routines. In this respect, the paper clarifies the interrelations between psychological habits and routines and describes similarities and differences between them. It also highlights the special place of mindfulness as a psycho-cognitive mechanism of action meta-control in intentional explanations (...) of routine complexity. (shrink)

BackgroundWhile ethicists have for many years called for human subject trial participants and, in some cases, local community members to benefit from participation in pharmaceutical and other intervention-based therapies, little is known about how these discussions are impacting the practice of research ethics boards that grant ethical approval to many of these studies.MethodsTelephone interviews were conducted with 23 REB members from across Canada, a major funder country for human subject research internationally. All interviews were digitally recorded and transcribed verbatim. After (...) coding, the data was analyzed to identify central themes and topics. Themes were identified, application of the themes was confirmed, and these themes were then used to populate the findings of this manuscript.ResultsOur analysis of the interviews identified two primary themes when considering what benefits are owed to research participants and their communities. 1) Most study participants felt that given that these studies are led by persons in the role of researcher rather than health care provider, they had a limited obligation to provide benefits to study participants. 2) These REB members were all working in Canada, a high income country where most residents enjoy high levels of access to health care. As a result of this context, the study participants tended to focus on ethical concerns including obtaining informed consent and avoiding undue inducement to participate in research rather than ensuring that study participants directly benefit from successful trials.ConclusionsResearch on REB members’ attitudes toward what benefits are owed to study participants and community members is needed in other countries in order to determine how context affects these attitudes. ABSTRACT Ethics is receiving increased emphasis in civil and environmental engineering. However, despite the proliferation of college textbooks and courses encouraging ethical reasoning, engineers in practice often limit their understanding narrowly to their individual actions. Broader issues of global importance are usually addressed in an ad-hoc manner, if at all. Our goal is to present the topic of ethics in a way that appeals to engineers, especially those receptive to ‘systems thinking’. Our broader motivation is to encourage the development of (...) educated, virtuous and caring professionals who engage in contextual ethical reasoning about complex systems. To these ends, we summarise relevant theoretical and applied concepts for ethical analysis, building from a recent chapter that reflects on ethics from an engineering systems perspective (but applied to the healthcare industry). We emphasise virtue ethics and the ethics of care as crucial supplements to duty ethics and utilitarianism. Analytical methods we discuss include Value Sensitive Design, Design for Care, and a multi-level classification of ethical issues into the micro (individual), meso (institutional), and macro (societal) levels. This work collects relevant considerations for designers of civil and environmental engineering systems and researchers interested in developing related design and analysis methods that include practical ethical reasoning. Topic modeling—a text‐mining technique often used to uncover thematic structures in large collections of texts—has been increasingly frequently used in the context of the analysis of scholarly output. In this study, we construct a corpus of 19,488 texts published since 1971 in seven leading journals in the field of bioethics and philosophy of medicine, and we use a machine learning algorithm to identify almost 100 topics representing distinct themes of interest in the field. On the basis of intertopic correlations, we (...) group the content‐based topics into eight clusters, thus providing a novel, fine‐grained intellectual map of bioethics and philosophy of medicine. Moreover, we conduct a number of diachronic analyses, examining how the “prominence” of different topics has changed across time. In this way, we are able to observe the distinct patterns in which bioethics and philosophy of medicine have evolved and changed their focus over the past half a century. (shrink)

Abstract In this paper, I pursue the question whether extending democratic rights to work is good in the broadest possible sense of that term: good for workers, firms, market economies, and democratic states. The argument makes two assumptions in a broadly consequentialist framework. First, the configuration of any relationship among persons in which there is less rather than more coercion makes individuals better off. Second, extending democratic rights to work will entail costs and benefits to both the power and authority (...) of employers and meaningful work for employees. These costs and benefits cannot be determined in advance because they are largely empirical, but there are still good reasons for expanding worker participation all-things-considered. First, I examine the parallel case for extending democratic rights to the workplace based on several similarities between politics and work organization. In addition, I consider the objections from voluntariness and efficiency. Although both objections raise interesting problems I believe that a properly formulated conception of democratic workplaces can answer them. In the final section, I sketch a minimal conception of these rights at the level of the firm that does not require a large-scale transformation of the market economy. (shrink)

Predictive processing (PP) has been repeatedly presented as a unificatory account of perception, action, and cognition. In this paper, we argue that this is premature: As a unifying theory, PP fails to deliver general, simple, homogeneous, and systematic explanations. By examining its current trajectory of development, we conclude that PP remains only loosely connected both to its computational framework and to its hypothetical biological underpinnings, which makes its fundamentals unclear. Instead of offering explanations that refer to the same set of (...) principles, we observe systematic equivocations in PP‐based models, or outright contradictions with its avowed principles. To make matters worse, PP‐based models are seldom empirically validated, and they are frequently offered as mere just‐so stories. The large number of PP‐based models is thus not evidence of theoretical progress in unifying perception, action, and cognition. On the contrary, we maintain that the gap between theory and its biological and computational bases contributes to the arrested development of PP as a unificatory theory. Thus, we urge the defenders of PP to focus on its critical problems instead of offering mere re‐descriptions of known phenomena, and to validate their models against possible alternative explanations that stem from different theoretical assumptions. Otherwise, PP will ultimately fail as a unified theory of cognition. (shrink)

Recent technological developments in automation threaten to eliminate the jobs of millions of workers in the near future, raising worrisome questions about how to satisfy their welfare. One proposal for addressing this issue is to provide all citizens with a “universal basic income” (UBI) that ensures everyone with a social minimum. The aim is to give all individuals an unrestricted cash grant that provides them with an income that does not depend on status, wealth, or employment. The question this paper (...) explores is whether UBI can replace work in the age of automation. Work has financial and non-pecuniary benefits that provide individuals with an income, as well as self-realization, self-respect, and community. While the provision of UBI will supplement the financial benefits of work, the question remains whether such a grant can replace these non-pecuniary benefits. The first section outlines the benefits and burdens of work. The second section considers the effects of technology on work in the context of automation. The third section examines the arguments for UBI that make it a philosophically attractive alternative to traditional welfare policies. Finally, the last section evaluates whether the benefits of UBI can replace the loss of work in terms of its non-pecuniary benefits. (shrink)

The present paper argues that a right to work, defined as social and legal guarantees to fair conditions of employment, should be an essential part of a democratic state with market arrangements. This argument proceeds along the following lines. First, I reconstruct an account of rights that defends the “correlativity” thesis of rights and duties. The basic idea is that a social member’s legitimate demand to something of value, such as gainful employment, implies duties on the part of others to (...) respect and fulfill it. These duties include the following with regard to that demand: avoiding actions that cause the harm, protecting it against standard threats, and otherwise providing aid in case it is deprived. Second, I sketch an outline of what a right to work will entail in terms of the correlative duties just described. This means that respect and fulfillment of the demand will require both social members and the democratic state alike to guarantee fair conditions of employment: first, by forbearing from actions that deprive members of access to work; and second, by protecting members against threats of deprivation and aiding them when they are so deprived. Third, I answer some ethical and empirical objections to the idea of a right to work: that it violates the legal rights of owners and employers, fails to impart self-respect, lacks economic efficiency, and erodes human capital by undermining competitive incentives. Finally, I make some concluding observations that a democratic right to work so conceived is ethically and economically superior to alternative arrangements that neither respect nor fulfill these correlative duties to avoid harm, protect against threats, and provide aid in cases of deprivation. There is an ongoing investigation by scholars of ethics and economics into whether human decision making and the resultant acts should be guided by rules and procedures or by judgment and discretion. Although each of these modes offers advantages and disadvantages to decision makers, they are by no means neutral in their effect on professional development. The paper presents an in-depth view of discretionary decisions using an Aristotelian-Thomistic framework. This is the first of the series of papers which focus on (...) the application of realistic philosophical principles to ethical professional behaviour and decision making in daily practice. Results indicate that classical philosophical theories which use virtues and truth as indispensable components still may give rise to desirable and moral conduct among individuals who apply them. The article discusses problems of image development in selected professional engineering communities, as expressed in their ethical codes. Specific codified norms are presented and their likely effects discussed on two levels: personal and social. The findings show, that not all of the codes of ethics solve the development problem identically, with the differences likely to cause some variability in be-havioural patterns among members of the professional societies. The analysis suggests the need for further research and analyses as well as the (...) standardization of codified solutions to this problem among professional engineering societies. (shrink)

The paper attempts to analyse the ethical duties of engineers contained in selected engineering codes of ethics and indicates a few problems arising in teaching professional engineering ethics in technical studies. The codes of ethics under analysis, both Polish and foreign (American), show similarities and differences. The author indicates the likely causes of these similarities and differences and suggests the need for further research on the development of ethical standards as well as their implementation, application and enforcement. The author indicates a lack of necessary teaching materials in Polish and the existence of no Polish forum for discussing ethical problems of engineering in Poland both in the areas of teaching and research. Integrity is a common and well established concept in the ethical vocabulary. It is also being used in various codes of ethics, and investigated by means of various methods. However a review of the contemporary reference literature reveals various meanings associated with this term, which is followed by its variable applicability. It is mentioned among the desirable virtues possessed by the professionals. In various Polish codes of engineering ethics there is an absence of the integrity concept, at least comprehended as (...) fully as it is in the ethics literature. The paper contains an analysis of the meaning of integrity in English and its translations into Polish in selected codes of engineering ethics. The scopes of the used terms are compared and in result it is postulated that some initiatives be undertaken in order to clarify the discrepancies existing in various engineering codes of ethics around the professional integrity concept. Pessoa (2013) makes an impressive case that emotion, motivation, and cognition are neurally intertwined. Our commentary broadens the discussion to the functional, “mind” level. We argue that philosophical and computational considerations justify some modern “separatist” views. We highlight several psychological phenomena that illustrate independence, including affective and motivational reactions to rudimentary inputs, and the guiding role of such reactions in cognition.

Does “The Colbert Report” promote democratic values in American political dialogue? If so, does it encourage substantive criticism of political orthodoxy? Or does it just encourage the politics of cynicism, like so many other cable news shows? We claim that Stephen Colbert's style of political satire promotes democratic values of free, open, and critical speech because it reflects an ethical commitment that evokes the earlier spirit of criticism embodied by the ancient Greek philosophical tradition of _parrhesia_, or "speaking the truth" (...) fearlessly in public. This paper examines constitutional issues concerning same-sex marriage. Although same-sex relations concern broader ethical issues as well, I set these aside to concentrate primarily on legal questions of privacy rights and equal protection. While sexual orientation is neither a suspect classification like race, nor a quasi classification like gender, there are strong reasons why it should trigger heightened scrutiny of legislation using sexuality as a standard of classification. In what follows, I argue that equal-protection doctrine is better suited for including (...) same-sex couples where legal benefits and burdens of marriage are at stake. (1) I reconstruct arguments from privacy and the controversial ruling of Bowers v. Hardwick but discount this strategy for problematic legal reasons. (2) In order for equal protection to apply, sexual orientation must meet the criteria of suspect classification that the Court has established. (3) Since sexual orientation meets these criteria, heightened scrutiny should be applied to such legislation on equal-protection grounds. (4) Finally, I rely on some familiar Rawlsian arguments of public justification that demonstrate why this extension of marriage rights is consistent with basic constitutional principles. (shrink)

John Dewey developed a pragmatic theory of inquiry to provide intelligent methods for social progress. He believed that the logic and attitude of successful scientific inquiries, properly conceived, could be fruitfully applied to morals and politics. Unfortunately, his project has been poorly understood and his logic of inquiry neglected as a resource. Contemporary pragmatists, like Richard Rorty, for example, dismiss his emphasis on method and avoid judgments of moral progress that are in any way independent of the biases of particular (...) cultures. In this article, I argue that Dewey’s theory of inquiry indeed provides intelligent methods and intellectual criteria for engaging moral and political matters. Inquiry, as Dewey conceives it, issues in judgments that are increasingly objective, reliable and refined in application. These judgments are rooted in particular times and places, in actual ‘situations’, but are not entirely hostage to specific cultures. I then apply Dewey’s theory to two standard moral problems to demonstrate how it works. The conclusion is that Dewey’s theory of inquiry gets it just right: it provides solid ground for criticism and moral progress while remaining acutely sensitive to cultural differences and changing circumstances. The article presents a thought experiment aimed at indicating a possibility for thinking education beyond the logic of progress. In its first part, the argument reconstructs the entanglement of the modern idea of progress (as found in Francis Bacon and Comenius) and education, while tracking down the specific coupling of obedience and conquest at work. Through such an analysis a link between the ideas of progress and of emancipation is determined, which leads to the acknowledgement of the difficulty of the (...) task of imagining education outside of the logic of progress. In the second part an attempt is made to match this task by suggesting that when studying with a teacher, the logic of progress is deactivated. A phenomenological analysis of the practices involved in studying with a teacher points to a specific way of living together that such a collective study involves. This way of living together is formed by continual exercises in the humble equality realized through shared attention to something worthy of study: this stems from attentiveness to what exists, and it develops an attitude of care and respect for being as such. This paper analyzes selected issues related to the philosophy of the Krakow physicist Andrzej Fuliński. Since the 1970s, Fuliński has been strongly associated with the interdisciplinary milieu gathered around Heller and Życiński. His activity can therefore be considered within the context of the broader phenomenon known as the Krakow School of Philosophy in Science, which was founded by Heller and Życiński. This paper proposes the thesis that Fuliński’s style of philosophy is connected with the concept of philosophy in science and (...) tries to justify the thesis that Fuliński, due to his cooperation with the interdisciplinary milieu in Krakow and the specificity of his philosophical works, deserves to be regarded as a representative of the Krakow School of Philosophy in Science. This piece outlines an argument against recent changes in U.S. immigration policy that aim to give priority in admissions to skilled workers rather than family members seeking unification. I argue that democratic states have a moral obligation to admit individuals seeking unification with family members, rather than give priority to skilled workers.

At the center of the hate speech controversy is the question whether it constitutes conduct. If hate speech is not conduct, then restricting it runs counter to free speech. But even if it could be shown that it is a kind of conduct, complicated questions arise. Does it necessarily follow that we restrict speech? Practically speaking, can speech even be restricted, either through new legislation or the enforcement of existing laws regulating conduct? Are measures such as hate crimes legislation both (...) useful and appropriate in protecting individuals and groups from violence? The present paper aims to address these questions by reconstructing and assessing Judith Butler’s important treatment of speech-acts and hate speech in her book Excitable Speech: The Politics of the Performative. There is currently no international consensus around post-trial obligations toward research participants, community members, and host countries. This literature review investigates arguments and attitudes toward post-trial access. The literature review found that academic discussions focused on the rights of research participants, but offered few practical recommendations for addressing or improving current practices. Similarly, there are few regulations or legislation pertaining to post-trial access. If regulatory changes are necessary, we need to understand the current arguments, legislation, and attitudes towards post-trial access (...) and participants and community members. Given that clinical trials conducted in low-income countries will likely continue, there is an urgent need for consideration of post-trial benefits for participants, communities, and citizens of host countries. While this issue may not be as pressing in countries where participants have access to healthcare and medicines through public schemes, it is particularly important in regions where this may not be available. The present paper motivates one possible answer to Kant’s question, “What remains of the Enlightenment?” by reinterpreting the relation between Foucault and critical tradition from Kant to the Frankfurt School. The Enlightenment has left us with “normative superstition,” or a healthy form of skepticism about the justification of modern institutions and ideals. Along these lines, I adopt an interpretation of Foucault that diverges from the standard view. I argue that he shares with his detractors a common heritage of this “critical (...) attitude,” placing him squarely in line with Kant, Hegel, and critical theory generally. If it is possible to view this critical attitude as an expression of Enlightenment-oriented views, then there are reasons to believe that his so-called “postmodernism” is nothing more than hyper-modernism. The lines of this last argument have been made elsewhere, notably in Robert Pippin’s important work, but there is a need to situate Foucault in the unfolding narrative of modernity, rather than label him a hostile opponent to it. In my view, the “Foucault addiction” now so popular is consistent with the critical tradition and the aim of this paper is to develop this claim. (shrink)

Empathy is the ability to infer and share the feelings, intentions, and goals of other persons.1 It provides the basis for our extraordinary capacity to help others, including strangers we may never meet, without interest in personal benefit. Its extent has been controversial, but recent studies in neuroscience, empirical psychology, and primatology support a highly empathic understanding of human nature. Although widely recognized as founder and key figure in the current re-emergence of pragmatism, Charles Peirce is rarely brought into contemporary dialogue. In this book, Kory Sorrell shows that Peirce has much to offer contemporary debate and deepens the value of Peirce’s view of representation in light of feminist epistemology, philosophy of science, and cultural anthropology. Drawing also on William James and John Dewey, Sorrell identifies ways in which bias, authority, and purpose are ineluctable constituents of shared representation. He nevertheless (...) defends Peirce’s realistic account of representation, showing how the independently real world both constrains social representation and informs its content. This essay focuses on the role relationships of authority play in the communal production of knowledge. The author draws on recent developments in feminist epistemology and the pragmatism of John Dewey to show that not only is authority representation ineluctable, but is desirable if held properly accountable.

ABSTRACT This article defends Charles Peirce's “doctrine of immediate perception.” This realistic view holds that conscious agents, due to the work of unconscious mind, directly perceive the world and often know objects, events, and persons as they truly are, independently of how we might prefer to think of them. The doctrine provides a promising alternative to more recent views insisting that all experience of the world and other persons is ineluctably mediated by language, along with the categories and biases language (...) inevitably imposes. Peirce's view is further explicated in terms of what neuroscientists now call the “new” unconscious and supported by recent work in both neuroscience and empirical psychology, especially experiments involving infants. The article supports the conclusion that, while much experience is mediated by language, direct access to a world that informs and often surprises us persists throughout conscious experience. Income inequality in democratic societies with market economies is sizable and growing. One reason for this growth can be traced to unequal forms of compensation that employers pay workers. Democratic societies have tackled this problem by enforcing a wage standard that all workers are paid regardless of education, skills, or contribution. This raises a novel question: Should there be equal pay for all workers? To answer it, we need to investigate some factors that are relevant to the unequal conditions of (...) power and authority in which wage offers are made. By clarifying these, we can determine whether wage inequality is morally permissible. If not, then a case might be made to pay all workers the same regardless of education, skills, or contribution. Even if it is permissible, another question worth considering is whether there are limits to how much inequality is acceptable. The argument here proceeds along the following lines. First, I summarize the economic and non-economic factors that determine the value of wages in labor markets. Second, I examine a particular problem that concerns whether the conditions of wage labor are coercive because they restrict alternatives or otherwise include threats to the welfare of workers. If there is coercion, we have good reasons to establish a standard that improve these conditions. Finally, I claim that establishing this standard requires increasing the value of low-wage work. Doing so will not only expand alternatives that are available to these workers, it will also diminish the potential threat to their welfare. (shrink)
