This paper addresses the question of whether all that unites the main parts of John Stuart Mill’s On Liberty—the liberty principle, the defense of free discussion, the promotion of individuality, and the claims concerning individual competence about one’s own good—is a general concern with individual liberty, or whether we can say something more concrete about how they are related. I attempt to show that the arguments of On Liberty exemplify Mill’s institutional design approach set out in Considerations of Representative Government (...) and related works. Mill’s approach reflects both his debt to Bentham and his own progressive development of the utilitarian tradition. The paper proceeds by setting out the elements of Mill’s institutional designs and then showing that On Liberty neatly applies them, thereby clarifying the structure of the arguments of On Liberty. Joseph Persky's excellent book, The Political Economy of Progress: John Stuart Mill and Modern Radicalism, shows that J. S. Mill's support for socialism is a carefully considered element of his political and economic reform agenda. The key thought underlying Persky's argument is that Mill has an ‘evolutionary theory of justice’, according to which the set of institutions and practices that are appropriate to one state of society should give way to a new set of institutions as circumstances change and the (...) people themselves improve. However, Persky does not spend a great deal of time discussing Mill's theory of reform, in particular the principles he believes should guide our reform efforts. Reflecting on these principles – notably his principle of impartiality or equal treatment – shows the consistency of Mill's thought over time. (shrink)

Simon Blackburn can be seen as challenging those committed to sui generis moral facts to explain the supervenience of the moral on the descriptive. We hold that normative facts in general are sui generis. We also hold that the normative supervenes on the descriptive, and we here endeavour to answer the generalization of Blackburn's challenge. In the course of pursuing this answer, we suggest that Frank Jackson's descriptivism rests on a conception of properties inappropriate to discussions of normativity, and we (...) see reason to reject descriptivism generally. ‘Twelve Step' recovery programmes such as Alcoholics Anonymous teach that an alcoholic, or other addict, has a disease, and needs to accept that she is ‘powerless' over her addiction before recovery can begin. However, the disease model of addiction has been criticised on the grounds that some addicts recover without external intervention. This critique is questionable, not because such recovery does not occur, but because many genuine diseases are self-limiting. However, the disease model is better criticised on other grounds. Central (...) here is the idea of powerlessness. This article explores various supposed instances of powerlessness, including that induced by extreme fear, provocation and obsessive-compulsive disorder. It is argued that while addiction is a genuine phenomenon, it is strictly inaccurate to describe it as a lack of power. However, there is a deeper sense in which the autonomy of addicts is compromised, although this does not show that addiction is a disease. (shrink)

The two envelopes problem has generated a significant number of publications (I have benefitted from reading many of them, only some of which I cite; see the epilogue for a historical note). Part of my purpose here is to provide a review of previous results (with somewhat simpler demonstrations). In addition, I hope to clear up what I see as some misconceptions concerning the problem. Within a countably additive probability framework, the problem illustrates a breakdown of dominance with respect to (...) infinite partitions in circumstances of infinite expected utility. Within a probability framework that is only finitely additive, there are failures of dominance with respect to infinite partitions in circumstances of bounded utility with finitely many consequences (see the epilogue). This article addresses the long-standing problem of how to understand Mill’s famous harm principle in light of his failure to specify what counts as “harm” in On Liberty. I argue that standard accounts restricting “harm” to only certain negative consequences fail to do justice to the text, and that this fact forces us to rethink Mill’s defense of individual liberty. I then offer a new account of that defense in which “harm” is understood in an expansive sense, despite apparent problems (...) for such a view. (shrink)

Socrates is both the first thoroughgoing moral philosopher and the first to employ irony as a philosophical tool. These innovative and foundational aspects of Socratic philosophy, however, lead to apparent inconsistencies and worrisome interactions. Socrates is charged with making his interlocutors look foolish, arrogant, self-serving, or ignorant. Worse still, he seems aware of these reactions. If Socrates knows his methods stir resentment, why does he continue with them? Furthermore, how should we view irony in light of Socratic ethics? I argue (...) that Socrates uses irony and shame to bring about the desire for moral improvement. Socratic irony is of the riddling variety and the shame that it produces is not intended to belittle the interlocutor’s sense of self. Instead, shame is an appropriate response to the realization that one’s life is unexamined and possibly vicious. Therefore, the real problem with Socratic irony lies not with its use, but its failure rate. (shrink)

In her final book, Environmental Culture as well as elsewhere, Val Plumwood advances the view that sustainability should properly be seen as emergent from an ecofeminist partnership ethic of nourishment and support between humans and nonhuman nature, and that such an ethic must replace the characteristic institutional structures and dominant conceptions of rationality found in capitalist modernity. In making this case, Plumwood impressively charts the impact and significance of the expansionist, exclusionary models of the disembodied but appropriative self found in (...) Cartesian and Lockean thought along with the impact of private property doctrines derived from this source. However, whilst making reference to ecosocialist alternatives at the broader political level, Plumwood offers no systematic account of property that might dovetail with her wider philosophical concerns. In this paper I attempt to generate the start of such an account, drawing on Plumwood's own canon and bringing it into relationship with (1) reflections on ideas of belonging and culture drawn from a range of thinkers including Erazim Kohák, Erich Fromm, and William James, and (2) the contemporary debate over the relationship between green political thought and the liberal democratic tradition. Mill argues that, apart from the principle of utility, his utilitarianism is incompatible with absolutes. Yet in On Liberty he introduces an exceptionless anti-paternalism principle—his liberty principle. In this paper I address ‘the absolutism problem,’ that is, whether Mill's utilitarianism can accommodate an exceptionless principle. Mill's absolute claim is not a mere bit of rhetoric. But the four main solutions to the absolutism problem are also not supported by the relevant texts. I defend a fifth solution—the competence view—that turns on (...) his attention to decision-making structures and, in particular, on the role of expertise considerations in his account. (shrink)

In this commentary, we present two examples where perception is not only influenced by, but also in fact driven by, top-down effects: hallucinations and mental imagery. Crucially, both examples avoid all six of the potential confounds that Firestone & Scholl (F&S) raised as arguments against previous studies claiming to demonstrate the influence of top-down effects on perception.

This article examines various models of legal interpretation and their implications for comparative law, drawing inspiration from Rodolfo Sacco’s early career theories. It contrasts the Tarskian Correspondence Model, which seeks objective reality in legal texts, with the Symphonic Model, which interprets legal language as a harmonious interplay of elements. The Tarskian model reflects classical legal thought’s search for fixed meanings, while the Symphonic model aligns with contemporary legal practice’s nuanced understanding. Further, the article explores Heraclitean Realism, acknowledging the fluidity of (...) language and meaning, and the Provocative Tapestry Model, which introduces paradox and tension in legal interpretation. These models are likened to narrative genres, offering varied approaches to understanding legal discourse: the Tarskian model as a detective novel, the Symphonic model as a comedy, the Living Tapestry model as a melodrama, and the Provocative Tapestry model as a tragedy. The article argues that these models of legal interpretation do not inherently carry a political essence; the political stance emerges from the choices of interpreters. It emphasizes the need for human agency in the application of legal norms and the responsibility of legal professionals to actively engage in the interpretation process. Comparative law is discussed as a discipline that benefits from understanding these diverse interpretative models, as it seeks to analyze legal systems across jurisdictions. The article concludes that while narrative styles in legal interpretation have political histories, they are not bound to specific ideologies, highlighting the versatility and subjectivity in the field of legal interpretation. By highlighting underappreciated textual evidence and key distinctions, this introduction attempts to show how the contributions of the symposium authors – Melina Constantine Bell, Rafael Cejudo, Christopher Macleod, and Dale E. Miller – point toward a more complete account of Mill's views.

We investigated the causes and impact of procrastination on “slippery deadlines,” where the due date is ill-defined and can be autonomously extended, using the unique applied setting of grievance arbitration across two studies. In Study One, using 3 years of observed performance data derived from Canadian arbitration cases and a survey of leading arbitrators, we examined the effect of individual differences, self-regulatory skills, workloads and task characteristics on time delay. Observed delay here is a critical criterion, where justice is emphasized (...) to be swift and sure. Multilevel Modeling established trait procrastination as a substantive predictor of observed delay, equivalent to the environmental contributors of expediting the arbitration procedure or grievance complexity. Also, despite substantive negative consequence of delay for both arbitrators and their clients, arbitrators who scored one standard deviation above the mean in procrastination took approximately 83 days to write their decisions compared to the 26 days for arbitrators one standard deviation below the mean. In Study Two, we conducted a replication and extension survey with a much larger group of American arbitrators. Consistent with Temporal Motivation Theory, trait procrastination was largely explained by expectancy, value, and sensitivity to time related traits and skills, which together accounted for majority of the variance in trait procrastination, leaving little left for other explanations. For example, perfectionism connection to procrastination appears to be distal, being largely mediated by each of TMT’s core variables. Finally, procrastination was largely synonymous with a deadline pacing style, indicating that observed delay can be used as a proxy for procrastination as long as little or no prior work was done. In all, our results indicate that procrastination is rampant in the workplace and has seriously detrimental effects. (shrink)

My aim in this chapter is to push back against the tendency to emphasize Mill’s break from Bentham rather than his debt to him. Mill made important advances on Bentham’s views, but I believe there remains a shared core to their thinking—over and above their commitment to the principle of utility itself—that has been underappreciated. Essentially, I believe that the structure of Mill’s utilitarian thought owes a great debt to Bentham even if he filled in that structure with a richer (...) conception of human nature and developed it in more liberal directions. This commonality is revealed, in particular, in Mill’s own institutional designs and practical reform proposals in Considerations on Representative Government and related writings. If this is right, then the tendency of interpreters to highlight their differences rather than their similarities has been to the detriment of both Mill and Bentham scholarship, and so to our understanding of the rise of liberal utilitarianism. In this paper, for the benefit of reflection processes in clinical and in local, regional, and national priority-setting, we aim to develop an ethical theoretical framework that includes both ethical principles and medium-range narratives. We present our suggestion in the particular case of having to choose between treatment interventions for attention deficit hyperactivity disorder (ADHD) and treatment interventions for other conditions or diseases, under circumstances of scarcity. In order to arrive at our model, we compare two distinct ethical approaches: a (...) generalist (principles) approach and a particularist (narratives) approach. Our focus is on Sweden, because in Sweden prioritization in healthcare is uniquely governmentally regulated by the “ethics platform.” We will present a (fictional) scenario to analyse the strengths and weaknesses of the generalist principled perspective of the ethics platform and the particularist perspective of narrative ethics. We will suggest an alternative (moderately particularist) approach to prioritization, which we dub a “principles plus medium-range narratives” approach. Notwithstanding the undeniably central role of principles in distributive justice, we claim that medium-range narratives concerning individuals or groups who stand to benefit or lose from ADHD prioritization practices should also be read or listened to and taken into account at all levels of priority-setting. These narratives are expected to ethically optimize clinical priority-setting, as well as that undertaken at local, regional, and national levels. (shrink)

Emphasizing imaginaries as an essential tool in deep understanding of social phenomena, the essays in this volume address socio-anthropological environments; collective dynamics of social integration; mass media metamorphosis; politics legitimation processes; symbolic dimension of economics and material culture; and representation of otherness.

This paper addresses two issues: the controversy over pragmatism in environmental philosophy, and the habitual exclusion of William James's work from serious examination. Addressing critiques of pragmatic naturalism from Max Horkheimer, Eugene Hargrove and Holmes Rolston, I argue that their criticisms misfire, primarily due to skewed perception derived from mis-interpretative projections of views to which pragmatism is not committed. I conclude that the critics' major concerns are largely groundless, but that greater emphasis on pragmatism's experiential aspect would clarify this.

“Self-transcendence” is proposed as a way in which individuals might find relief and support in the context of COVID-19, as well as other times of uncertainty. However, the authors propose that the multiple definitions of self-transcendence within existing literature lean towards the complex, sometimes obscure, and imprecisely spiritual. A concern is that this creates a circumstance, where the possibility of supporting self-transcendence in a wider population will become excluding in this complexity. In this paper, we have undertaken a critical summary (...) review focused primarily on historical foundations of the concept of self-transcendence, and key theoretical approaches in which self-transcendence and self-transcendent experiences are discussed with the motive of finding a clarity to understanding self-transcendence and the pathways towards it. We argue that this much-needed clarity in our understanding of self-transcendence may serve as an inclusive and democratized resource in which to support well-being and resilience in the context of COVID and beyond. I agree with Capra that autopoiesis is the signature of life and that Maturana did well to reject Cartesian dualism. Contrary to how mainstream biology defines life, I point out that reproduction is a consequence of life, not its origin. Furthermore, I address the questions of whether both autopoiesis and cognition together are necessary for life and whether autopoiesis can be extended beyond the molecular domain. I also have words of criticism for Maturana, who called for “objectivity” to be put (...) in parentheses, and conclude with a reminder that it was Varela who was instrumental in making autopoiesis a household term. As biological and biomedical research increasingly reference the environmental context of the biological entities under study, the need for formalisation and standardisation of environment descriptors is growing. The Environment Ontology (ENVO) is a community-led, open project which seeks to provide an ontology for specifying a wide range of environments relevant to multiple life science disciplines and, through an open participation model, to accommodate the terminological requirements of all those needing to annotate data using ontology classes. The binding problem is fundamental to visual perception. It is the problem of associating an object's visual properties with itself and not with some other object. The problem is made particular difficult because different properties of an object, such as its color, shape, size, and motion, are often processed independently, sometimes in different cortical areas. The results of these separate analyses have to be combined before the object can be seen as a single coherent entity as opposed to a collection (...) of unconnected features. Visual bindings are typically initiated and updated in a serial fashion, one object at a time. Here, we show that one type of binding, location-identity bindings, can be updated in parallel. We do this by using two complementary techniques, the simultaneous-sequential paradigm and systems factorial technology. These techniques make different assumptions and rely on different behavioral measures, yet both came to the same conclusion. (shrink)

As a stress test of experimenter demand effects, we run an experiment where subjects can physically destroy coupons awarded to them. About one subject out of three does. Giving money back to the experimenter is possible in a separate task but is more consistent with an experimenter demand effect than an explanation based on altruism towards the experimenter. A measure of sensitivity to social pressure helps predict destruction when social information is provided.

In this engaged and engaging survey Piers Benn examines the major currents of ethical theory, concentrating on sound reasoning about morality. Benn's account offers a qualified defence of Aristotelian virtue theory, while bringing out what is distinctive and valuable in a broad range of approaches, such as those of Kant and the Utilitarians. His examples emphasize the ordinary choices of everyday life - gossip, friendship, honesty, sexual relations, work, and self-realization.

We are very grateful to Chong-Ming Lim for his thoughtful reply published in this journal on one of our articles, which motivated us to think more carefully about accommodating autistic individuals and treating autism. However we believe there are some confusions in Lim's argument. Lim uses the accommodation thesis, according to which we should accommodate autistic individuals rather than treat autism, as the starting point for his reasoning. He claims that if the accommodation thesis is right, then we should not (...) treat autistic individuals for their autism, not even low-functioning ones, because this would be disrespectful to all autistic individuals. We should instead limit ourselves to accommodate all autistic individuals. However, the opposition between accommodation and treatment is not valid in the case of autism, because of ambiguity in the concepts of accommodation and treatment. Moreover there is confusion in Lim's reasoning caused by omitting important facts about the practice of treating autism. (shrink)

John Stuart Mill’s defense of free discussion in On Liberty includes the claim that silencing discussion implies an “assumption of infallibility.” This claim is often dismissed as absurd on the ground that a censor might attempt to silence an opinion he believes to be true but pernicious, or because rational assurance short of infallibility is obviously sufficient to justify censorship. This paper argues that Mill is concerned about the epistemic position one assumes with regard to future persons and circumstances as (...) a result of attempting to settle some matter irremediably. The irrationality of this "assumption" sets an important authority-limiting constraint on both social authority and individuals in matters that otherwise would fall under their rightful control. For individuals, in particular, it explains Mill's restriction on selling oneself into irrevocable slavery. (shrink)

Per quanto diverse esse siano, assumiamo in genere che le pratiche descrittive possano aspirare a qualche forma di verità e corrispondere al modo in cui le cose stanno. (...) Non è facile spiegare in che cosa consista questa "corrispondenza", anche perché è controversa la possibilità di distinguere quanto, nelle rappresentazioni linguistiche, dipende dal mondo e quanto dai nostri schemi concettuali. Il ruolo del concetto di verità diventa sempre più complesso, se si prendono sul serio le differenze nei modi di accedervi e nei campi oggettivi di riferimento; ciò dà spazio ad uno spettro molto ampio di posizioni filosofiche, fra loro contrastanti, che rimescolano le carte delle tradizionali controversie tra realisti, antirealisti, relativisti.
