We outline the drivers, main features, and conceptual underpinnings of the compliance paradigm. We then use a similar structure to investigate the drivers, main features, and conceptual underpinnings of the cooperative paradigm for working with CSR in global value chains. We argue that the measures proposed in the new cooperation paradigm are unlikely to alter power relationships in global value chains and bring about sustained improvements in workers’ conditions in developing country export industries. After that, we provide a critical appraisal (...) of the potential and limits of the cooperative paradigm, we summarize our findings, and we outline avenues for research: purchasing practices and labor standard noncompliance, CSR capacity building among local suppliers, and improved CSR monitoring by local resources in the developing world. This article provides a review of what we know, what we do not know, and what we need to know about the relationship between industrial clusters and corporate social responsibility in developing countries. In addition to the drivers of and barriers to the adoption of CSR initiatives, this study highlights key lessons learned from empirical studies of CSR initiatives that aimed to improve environmental management and work conditions and reduce poverty in local industrial districts. Academic work in this area remains (...) embryonic, lacking in empirical evidence about the effects of CSR interventions on the profitability on local enterprises, workers, and the environment. Nor do theoretical frameworks offer clear explanations of the institutionalization and effects of CSR in local industrial districts in the developing world. Other key limitations in this research stream include an excessive focus on export-oriented industrial clusters, the risk that CSR becomes a form of economic and cultural imperialism, and the potential for joint-action CSR initiatives in clusters of small and medium-sized enterprises to offer a new form of greenwashing. From this review, the authors develop a theoretical model to explain why CSR has not become institutionalized in many developing country clusters, which in turn suggests that the vast majority of industrial clusters in developing countries are likely to engage in socially irresponsible behavior. The conceptualization and moral analysis of discrimination constitutes a burgeoning theoretical field, with a number of open problems and a rapidly developing literature. A central problem is how to define discrimination, both in its most basic direct sense and in the most prominent variations. A plausible definition of the basic sense of the word understands discrimination as disadvantageous differential treatment of two groups that is in some respect caused by the properties that distinguish the groups, but open questions remain on (...) whether discrimination should be restricted to concern only particular groups, as well as on whether it is best conceived as a descriptive or a moralized concept. Furthermore, since this understanding limits direct discrimination to cases of differential treatment, it requires that we be able to draw a clear distinction between equal and differential treatment, a task that is less simple than it may appear, but that is helpful in clarifying indirect discrimination and statistical discrimination. The second major problem in theorizing discrimination is explaining what makes discrimination morally wrong. On this issue, there are four dominant contemporary answers: the valuational and expressive disrespect accounts, which hold that discrimination is wrong when and if the discriminator misestimates or expresses a misestimate of the moral status of the discriminatee; the unfairness account, which holds that discrimination is wrong when and if the discriminator unfairly increases inequality of opportunity; and the harm account, which holds that discrimination is wrong when and if the discriminator harms the discriminatee. Each of these accounts, however, faces important challenges in simultaneously providing a persuasive theoretical account and matching our intuitions about cases of impermissible discrimination. At the same time, win–win and win–lose outcomes may exist simultaneously, even for the same stakeholder in the PPP. While the importance of ensuring proper design, monitoring, and IA of PPPs cannot be denied, their effects must be seen as an outcome of struggles between a␣variety of actors over the distribution of social and environmental hazards associated with broader processes of economic development and industrialization. Ausgangspunkt bildet die Notwendigkeit der informierten Einwilligung, die neben der Patientenautonomie vor allem auch die körperliche Integrität des Patienten schützt. Als Adäquatheitsbedingungen dienen die beiden normativen Funktionen der Patientenautonomie als Barriere und Schlüssel einer medizinischen Behandlung. Diese Konzeption von Patientenautonomie hat den Vorteil, Patienten besser vor Überforderungen zu bewahren und deren Bedarf an Unterstützungsangeboten (...) zur Förderung der Patientenautonomie deutlicher hervorzuheben. Mais elle montre aussi que cette domestication n’est jamais achevée et qu’elle tend même à perdre du terrain face au renouvellement contemporain de l’agriculture paysanne de subsistance, au sein de laquelle les femmes occupent le premier plan. The article explores one prominent account of what makes discrimination morally bad (when it is) – the disrespect-based account. The article first reviews and clarifies the account, arguing that it is most charitably understood as the claim that discrimination is morally bad when the discriminator gives lower weight to reasons grounded in the moral status of the discriminatee(s) in her decision-making. It then presents three challenges to the account, and reviews a recent argument in defense of it. The first challenge (...) is the fact that intuitions that might support the disrespect-based account can also be explained by reference to the fact that disrespect reflects poorly on the moral character of the discriminator. The second challenge is that there are cases where disrespectful discrimination is not intuitively worse than non-disrespectful discrimination. The third challenge is that the disrespect-based account has difficulties explaining our intuitions about cases of “doing right for the wrong reasons”. Finally, pace a recent argument in its defense, cases of harmless and apparently morally bad discrimination are plausibly best explained by other factors than disrespect. In the light of this analysis, the article concludes that the disrespect-based account should be abandoned. (shrink)

This article examines joint action initiatives among small- and medium-sized enterprises in the manufacturing industries in developing countries in the context of the ascendancy of corporate social responsibility and the proliferation of a variety of international accountability tools and standards. Through empirical fieldwork in the football manufacturing industry of Jalandhar in North India, the article documents how local cluster-based SMEs stay coupled with the global CSR agenda through joint CSR initiatives focusing on child labor. Probing further, however, also reveals patterns (...) of selective decoupling in relation to core humanitarian and labor rights issues. Through in-depth interviews with a wide range of stakeholders involved in the export-oriented football manufacturing industry of Jalandhar in North India, the article highlights the dynamics of coupling and decoupling taking place, and how developing country firms can gain credit and traction by focusing on high visibility CSR issues, although the plight of workers remains fundamentally unchanged. The authors revisit these findings in the discussion and concluding sections, highlighting the main research and policy implications of the analysis. (shrink)

Dance, as aesthetic self-expression, is a unique arts-based program that combines the physical benefits of exercise with psychosocial therapeutic benefits. While dance has also been shown to support empowerment, meaningful self-expression, and pleasurable experience, it is rarely adopted to support these aspects of engagement in the context of dementia care. The instrumental reduction of dance to its application as a therapeutic tool can be traced to the contemporary movement towards cognitive science with an emphasis on embodied cognition. This has effectively (...) elided a consideration of how the body itself, separate and apart from cognition, could be a source of intelligibility, inventiveness, and creativity. We argue for the need to broaden the therapeutic model of dance to more fully support embodied and creative self-expression by persons living with dementia. To achieve this, we explore how a relational model of citizenship that recognizes corporeality and relationality as fundamental to human existence brings a new and critical dimension to understanding the importance of dance in the context of dementia. Drawing on this model, we articulate a new kind of ethic characterized by a pre-reflective intercorporeal sensibility that requires the mobilization of public structures and practices to cultivate a relational environment for individuals living with dementia that supports human flourishing. This paper seeks to analyse small- and medium-sized enterprise (SME) managers' representations of corporate social responsibility (CSR) and CSR communication in a corporate communication perspective. The basic question is: how strategic is CSR communication in SMEs? Corporate communication and CSR theories are used to establish an ideal typology of CSR concepts informing an analysis of qualitative data in the form of interviews with three middle managers in two Danish SMEs. A CSR communication model published earlier by the authors is challenged (...) from a SME perspective. Results from an Internet-based questionnaire survey of 1071 SMEs pave the way for the analysis. Our analysis shows that SME managers clearly have an inside-out approach to CSR, with a strong emphasis on the internal (corporate culture) dimension. However, SMEs and/or SME managers tend not to communicate externally about the CSR activities of the company. Based on these findings, the paper argues that CSR communication in SMEs is challenged by the global economy and is under revision. The contribution of the paper is to provide an insight into SMEs' present stage in relation to a possible future approach to strategic CSR communication. The paper also reminds us that SMEs have no interest in turning their local and authentic practice into a forced marketing and branding exercise, leaving them with an artificial picture of who they are and strive to be in the future. They should keep on acting locally but force themselves to think globally. (shrink)

Developing virtues requires attending to the affective and cognitive components of virtue. The former component implies cultivating apt emotional responses to specific situations. The cognitive part requires the (meta) virtue of phronesis. In dealing with “Phronesis in educating emotions,” this article attends to the nature of emotions and phronesis as its role in cultivating good action habits and virtuous emotional habits. It understands emotion regulation as one of the functions of phronesis. In the broader sense, phronesis includes elements other than (...) deliberation, such as dialectics and rhetoric, which can be helpful to induce a certain suspicion or to persuade somewhat since our affectivity is susceptible to persuasion (i.e. Aristotle’s political dominion of emotions). As a topic in the intersection of moral psychology and moral philosophy, we get valuable insights into a psychologist’s work, Magda Arnold’s (1903–2002) emotion theory. Her understanding of emotion elicitation elucidates the relation between phronesis and emotions. The article focuses on one of the central elements of emotion elicitation, the appraisal. This piece can make the education of emotions for virtue development more understandable. At first glance, our initial appraisal may be hasty and inaccurate, leading to emotional reactions. However, with careful reflection, we can correct and improve upon our initial appraisal and subsequent emotions. If our initial assessment was flawed, this second, more thoughtful evaluation can be enhanced through phronesis. Due to the appraisal’s spontaneity, cultivating educated emotions requires values’ teaching, learning, and thus, appraising good things. With the development of virtues, intuitive estimates become adequate, so emotional responses are more attuned to diverse situations. (shrink)

Group representations need not reduce to triadic conflict roles, although we infer group membership from them. A conceptual primitive of as one solidary, bounded unity or clique may motivate and facilitate reasoning about cooperative group interactions in context with and without intergroup conflict and may also be necessary for representing which agents would replace one another in a triadic conflict.

Since the middle of the 20th century, philosophers and legal scholars have debated the precise definition of punishment. This chapter surveys the debate, identifies six potential conditions of punishment, and critically reviews each of them: 1) the response condition, which holds that punishment must be in response to wrongdoing, 2) the culpability condition, which holds that punishment must be of a person morally responsible for wrongdoing, 3) the authority condition, which holds that punishment must be imposed by a relevant authority, (...) 4) the hard treatment condition, which holds that punishment must impose hard consequences on the punishee, 5) the intentionality condition, which holds that punishment must be intentional, and 6) the censure condition, which holds that punishment must communicate disapproval. The article argues that it is often unclear that there is a version of the condition that provides optimal lexical fit. It discusses the implications of this analysis, and concludes that there may be less reason to worry about the lack of an authoritative definition than has sometimes been assumed, but that definitional clarity remains an objective worth pursuing. Within the caring science paradigm, variations of a method of interpretation inspired by the French philosopher Paul Ricoeur's theory of interpretation are used. This method consists of several levels of interpretation: a naïve reading, a structural analysis, and a critical analysis and discussion. Within this paradigm, the aim of this article is to present and discuss a means of creating distance in the interpretation and the text structure by using narration in a poetic language linked to the meaning of the (...) text. Ricoeur's ‘Hermeneutical function of distanciation’ will be introduced, and this concept of distanciation will be illustrated with reference to narrations from a study of patient's life experiences living with chronic illness and home mechanical ventilation in Denmark. Distanciation in the interpretation objectifies the text, and narration in a poetic language creates a particular kind of mediation in the interpretation. That narration represents an interpreted understanding of the whole, which facilitates an appropriate and evocative presentation of the interpreted data. This way of objectifying the text through narration can contribute yet another perspective to Ricoeur's rich and varied theory of interpretation. (shrink)

Suicide is the 10th leading cause of death in the United States and the second cause of death among those ages 15–24 years. The current standard of care for suicidality management often involves an involuntary hospitalization deemed necessary by the attending psychiatrist. The purpose of this article is to reexamine the ethical tradeoffs inherent in the current practice of involuntary psychiatric hospitalization for suicidal patients, calling attention to the often-neglected harms inherent in this practice and proposing a path for future (...) research. With accumulating evidence of the harms inherent in civil commitment, we propose that the relative value of this intervention needs to be reevaluated and more efficacious alternatives researched. Three arguments are presented: (1) that inadequate attention has been given to the harms resulting from the use of coercion and the loss of autonomy, (2) that inadequate evidence exists that involuntary hospitalization is an effective method to reduce deaths by suicide, and (3) that some suicidal patients may benefit more from therapeutic interventions that maximize and support autonomy and personal responsibility. Considering this evidence, we argue for a policy that limits the coercive hospitalization of suicidal individuals to those who lack decision-making capacity. (shrink)

The boundary work approach has been established as one of the main ways to study controversies in science. However, it has been proposed that it does not meet the power dynamics of the scientific field sufficiently. This article concentrates on the intertwining of boundary work and power. It combines the boundary work approach developed by Thomas Gieryn and the analysis of power in the work of Pierre Bourdieu. Based on a literature review and an analysis of a controversy over therapeutic (...) touch, it finds four forms of boundary work: intradisciplinary, interdisciplinary, between science and society, and between science and other knowledge systems. The article shows how the different forms of boundary work reveal multiple power struggles, hierarchisations and tensions. The controversy appeared in Finnish nursing science when the Finnish Association of Sceptics gave its annual Humbug Award to a book on therapeutic touch. The book was based on a master’s thesis at the University of Tampere department of nursing science. The nursing scholars in the department reacted abruptly and banned certain books, which astonished the students, and a lively public debate followed. In the debate, nursing science was both defended and challenged. The framework of the study shows that the boundary work approach can be used to study different aspects of power. The article proposes that the framework could be used in other controversies as well to study the layers of power in boundary work. (shrink)

This article examines the media representation of Swedish elite sport from the end of the 1960s until the present day in terms of objectification, sexualization and pornification. During this period, Sweden became one of the world’s most gender-equal countries. Applying a critical qualitative textual analysis, the article shows that the media discourse on gender and sport is, however, not equal. Even if the discourse over time has become less condescending and less explicitly sexist, there are still more or less subtle (...) allusions to women as a sex. From the latter half of the 1990s onwards, it is possible to talk of a pornification of sport which is strongly linked to market adjustment and commercialization. Since pornification affects women to a greater extent, the media image of Swedish elite sport becomes a bastion for the reproduction of inequality. (shrink)

This article contributes to the current discussion on interdisciplinarity in the health research field. It focuses on the relationship between nursing research and gender research. Nursing research is a ‘health sciences’ field which draws from the social sciences, the humanities, and biomedicine. Previous research shows the difficulties that social scientists face in their efforts to integrate with biomedical scientists. The aim of this article is to analyse nursing researchers’ views about one potential collaboration partner in the social sciences and humanities: (...) gender research. The study draws its theoretical insights from research within the sociology of science. It uses ideas about the intertwining of power and knowledge, which is especially emphasised in the works of Pierre Bourdieu. The research material consists of 180 abstracts of nursing research articles that argue in some way about the relationship between nursing research and gender research. The Scopus database was selected because it covers nursing research in a broad sense. The scope of the study is long. The close reading of abstracts is inspired by rhetorical discourse analysis. We found three clearly different but also overlapping discourses that justified gender perspectives in nursing research: Gender research helps to highlight the socio-political context in nursing research; Gender research develops or reforms the nursing research tradition; and Gender research exists as a form of critique within nursing research. Most of the nursing research abstracts regard gender research positively for both external and internal reasons. The abstracts also demonstrate the tensions in the relationship and discuss the views and reasons that generate scepticism towards gender research in nursing research. (shrink)

This article illustrates some of the difficulties of defining discrimination and briefly sketches the benefits and desiderata of doing so. It then examines and defines generic direct discrimination as an agent treating two groups differently because of the property that defines one of the groups as a group, in a way that is worse for that group, clarifying each of these three conditions in turn. It considers two arguments for further conditions: that an act must target one among a particular (...) set of groups to constitute discrimination, and that an act must be in some sense morally wrong to constitute discrimination. It concludes that while these objections are forceful it may be the case that they illustrate that we employ multiple, partly overlapping concepts of discrimination, and that it may be more important to recognize this heterogeneity than it is to attempt to establish a dominant or unitary definition. This article clarifies what a neuroscience challenge to criminal justice must look like by sketching the basic structure of the argument, gradually filling out the details and illustrating the conditions that must be met for the challenge to work. In the process of doing so it explores influential work by Joshua Greene and Jonathan Cohen, and Stephen Morse respectively, arguing that the former should not be understood to present a version of the challenge, and that the latter's argument against the (...) challenge is unpersuasive. This analysis allows the article to flesh out the challenge, and demonstrate why it is currently non-completeable. However, the paper argues that contrary to what is often assumed the burden of proof falls on the defenders of criminal justice, and that they will find meeting it a monumental task. (shrink)

Increasing vaccine hesitancy among parents in high income countries and the resulting drop in early childhood immunisation constitute an important public health problem, and raise the issue of what policies might be taken to promote higher rates of vaccination. This article first outlines the background of the problem of increasing vaccine hesitancy. It then explores the pros and cons of three types of policy: 1) Interventions focused on increasing awareness of the benefits of vaccination while eliminating mistaken perceptions of risks. (...) 2) “Nudges”, which make certain choices more likely to be voluntarily chosen by manipulating the decision environment. 3) Policies that impose costs to make non-vaccination undesirable even for parents who are hesitant. It argues that a wide range of policies, including coercive policies, is desirable from a public health perspective, as the least intrusive policies alone are unlikely to achieve and sustain the important public good of herd immunity. It is often suggested that during development the brain barriers are immature. This argument stems from teleological interpretations and experimental observations of the high protein concentrations in fetal cerebrospinal fluid (CSF) and decreases in apparent permeability of passive markers during development. We argue that the developmental blood–CSF barrier restricts the passage of lipid‐insoluble molecules by the same mechanism as in the adult (tight junctions) rendering the paracellular pathway an unlikely route of entry. Instead, we suggest that both protein and passive (...) markers are transferred across the epithelium through a transcellular route. We propose that changes in volume of distribution can largely explain the decrease in apparent permeability for passive markers and that developmentally regulated cellular transfer explains changes in CSF protein concentrations. The blood–CSF tight junctions are functionally mature from very early in development, and it appears that transfer from blood into embryonic brain occurs predominately via CSF rather than the vasculature. In this article I deal with Kant's concept of reflective judgment, and recover it through its links to the aesthetic dimension as its fundamental scenario. Then I go on to explain why Hannah Arendt understood this important Kantian connection, and why she thought it would allow her to develop it through a political dimension. Last, having reviewed both Kant and Arendt's contributions to the concept of reflective judgment, I recover my own input to the concept by showing its linguistic dimension (...) based on the Heideggerian notion of world-disclosure. With this in mind, I show how the concept of reflective judgment is the most suitable to analyze evil actions. (shrink)

This article is the guest editors’ introduction to the special issue in Business & Society on “SMEs and CSR in Developing Countries.” The special issue includes four original research articles by Hamann, Smith, Tashman, and Marshall; Allet; Egels-Zandén; and Puppim de Oliveira and Jabbour on various aspects of the relationship of small and medium enterprises to corporate social responsibility in developing countries.

We investigated whether memories are selected for the life story based on event characteristics. Sixty-one students completed weekly diaries over their first term at university. They described, dated and rated two events each week. Three months after the end of the term they completed an unexpected memory test. They recalled three memories from the diary period that were important to their life story. Three randomly selected events scoring low on importance to the life story functioned as control memories. Life story (...) memories were rated higher on goal relevance, emotional intensity, importance and rehearsal in the diary and maintained their higher ratings at the test session, while ratings for control memories dropped off. Life story memories’ content was less consistent over time but they were more accurately dated than control memories. The results suggest that event characteristics play an important role for the selection of life story memories. (shrink)

In this article I critically examine a standard feature in conceptions of discrimination: the group-criterion, specifically the idea that there is a limited and definablegroup of traits that can form the basis of discrimination. I review two types of argument for the criterion. One focuses on inherently relevant groups and relies ultimately on luck-egalitarian principles; the other focuses on contextually relevant groups and relies ultimately on the badness of outcomes. I conclude that as neither type of argument is convincing, the (...) criterion is morally arbitrary, and as such untenable. Finally, I suggest both some of the conceptual and some of the practical implications of abandoning the criterion. (shrink)

A recent report in the UK, Being Disabled in Britain: A Journey Less Equal, highlights the many inequalities, threats to dignity and discriminatory attitudes faced by disabled people. No doubt these are replicated in other countries. Using the evidenced-based findings from this report and the report’s invitation for those concerned to join the conversation on disability, this paper explores both the way in which the experiences of people with disabilities can sharpen up an understanding of Catholic social teaching and the (...) way in which that teaching contributes to a deeper theology of disability. Moreover, insights from this teaching demonstrate that people with disabilities contribute significantly and positively to society and to interpersonal relationships. (shrink)

This article analyses proportionality as a potential element of a theory of morally justified surveillance, and sets out a teleological account. It draws on conceptions in criminal justice ethics and just war theory, defines teleological proportionality in the context of surveillance, and sketches some of the central values likely to go into the consideration. It then explores some of the ways in which deontologists might want to modify the account and illustrates the difficulties of doing so. The article concludes that we need and should apply only a necessity condition, but notes that proportionality considerations may retain some use in in practice, as a form of coarse‐grained filter applied before assessing necessity when deliberating the permissibility of potential forms of surveillance. Traditional interpretations of Aristotle’s theory of perception mainly focus on uncovering the underlying mechanisms that are at stake when perceivers are affected by sensible qualities. Investigating the nature of sense perception is one of Aristotle’s main worries and one that he explicitly relates to the question of its causes (e. g.Sens. 436a16–17, 436b9) and its ends (e. g.de An. 434a30 ff.). Therefore I suggest that, in order to fully explain Aristotle’s view of perceptual phenomena, the possibilities, the constraints, and the (...) goals defined by the embodied and situated engagement of perceivers with the external world must be taken into account. Accordingly, in this paper, I provide an affective reading of Aristotle’s theory of perception. I shall ask what, in addition to functioning sense organs and appropriate response mechanisms, the perceiver contributes to perceptual content. Specifically, I propose to shed light on the significance of perceptual experience for the perceiver and I aim to show that, according to Aristotle, one’s biological and personal qualities are perceptually relevant, meaning that they underpin perception, rather than coming into play after perception has occurred and its objects have been discerned. The paper is divided into two parts, respectively dealing with sensory affections and more complex affective phenomena. As regards the domain of primal sense perception, I will focus on smell as a representative example: since Aristotle identifies it as the least developed of human sensory faculties, it will serve as a revealing illustration of how sense perception is informed and qualified by what, drawing on contemporary philosophical terminology, I will call ‘perceptual interests’, viz. the affective sense of what is at stake in the living being’s interaction with the environment. I will then proceed to consider the way more complex affective phenomena underpin perception by examining the case of emotions and that of virtues of character. By showing how perception is affectively inflected and how emotion is rooted in perception’s bodily nature, I aim to sketch out the general lines along which I believe that the Aristotelian theory of perception should be approached.
