The consistent sentencing of white collar criminals does not exist in today's judicial system. Guidelines for sentencing individuals and corporations have already been developed by the U.S. Sentencing Commission but have not yet been implemented in the courts. Pros and cons of the guidelines are given, as is the extent and form of sentencing deemed appropriate for the individual or corporation. The activities of the sentencing commission are depicted by a timeline.

People may have open minds on whether a life-extending drug or technology is going to be developed before their sixties and may strongly desire that development. Do they therefore hope that it occurs? Do they hope for it in the substantive sense of “pinning their hopes” on the development? No, they do not. Hoping for a prospect in that sense certainly presupposes having an open mind on whether it will occur and having a desire for its occurrence. But, more crucially, (...) it means investing the prospect with a characteristic, galvanizing, and orientating role: it involves setting aside doubts about the possible nonoccurrence of the prospect and acting accordingly. This article offers a characterization of hope in that substantive sense and argues both that it can be rational and that it is ubiquitous. (shrink)

Metaphor has a double life. It can be described as a directional process in which a stable, familiar base domain provides inferential structure to a less clearly specified target. But metaphor is also described as a process of finding commonalities, an inherently symmetric process. In this second view, both concepts may be altered by the metaphorical comparison. Whereas most theories of metaphor capture one of these aspects, we offer a model based on structure-mapping that captures both sides of metaphor processing. (...) This predicts (a) an initial processing stage of symmetric alignment; and (b) a later directional phase in which inferences are projected to the target. To test these claims, we collected comprehensibility judgments for forward (e.g., “A rumor is a virus”) and reversed (“A virus is a rumor”) metaphors at early and late stages of processing, using a deadline procedure. We found an advantage for the forward direction late in processing, but no directional preference early in processing. Implications for metaphor theory are discussed. (shrink)

In this paper I argue that holes are not objects, but should instead be construed as properties or relations. The argument proceeds by first establishing a claim about angles: that angles are not objects, but properties or relations. It is then argued that holes and angles belong to the same category, on the grounds that they share distinctive existence and identity conditions. This provides an argument in favour of categorizing holes as one categorizes angles. I then argue that a commitment (...) to the existence of properties to be identified with holes provides sufficient resources to account for true claims about holes. (shrink)

This paper considers pick-the-winners contests as a simple method for harnessing the wisdom of crowds to produce probability forecasts. Pick-the-winners contests are those in which players pick the outcomes of selected future binary events with a prize going to the player with the most correct picks. In contrast to soliciting probability forecasts from experts, this paper shows that competition among players is to be encouraged because it improves the accuracy of the resulting crowd probability forecasts. This improvement comes because the (...) competition not only discourages the overbetting of favorites that occurs if prizes are awarded based on absolute performance, but also helps mitigate the public knowledge bias that occurs if everyone reports truthfully. In addition to the theoretical arguments, the paper analyzes picks from 6 years of pick-the-winners contests involving hundreds of players and 1037 college lacrosse games to find that the crowd proportions outperformed two benchmark sets of probabilities. The study of word meanings promises important insights into the nature of the human mind by revealing what people find to be most cognitively significant in their experience. However, as we learn more about the semantics of various languages, we are faced with an interesting problem. Different languages seem to be telling us different stories about the mind. For example, important distinctions made in one language are not necessarily made in others. What are we to make of these cross-linguistic differences? (...) How do they arise? Are they created by purely linguistic processes operating over the course of language evolution? Or do they reflect fundamental differences in thought? In this sea of differences, are there any semantic universals? Which categories might be given by the genes, which by culture, and which by language? And what might the cross-linguistic similarities and differences contribute to our understanding of conceptual and linguistic development? The kinds of mapping principles, structures, and processes that link language and non-linguistic knowledge must accommodate not just one language but the rich diversity that has been uncovered. The integration of knowledge and methodologies necessary for real progress in answering these questions has happened only recently, as experimental approaches have been applied to the cross-linguistic study of word meaning. In Words and the Mind, Barbara Malt and Phillip Wolff present evidence from the leading researchers who are carrying out this empirical work on topics as diverse as spatial relations, events, emotion terms, motion events, objects, body-part terms, causation, color categories, and relational categories. By bringing them together, Malt and Wolff highlight some of the most exciting cross-linguistic and cross-cultural work on the language-thought interface, from a broad array of fields including linguistics, anthropology, cognitive and developmental psychology, and cognitive neuropsychology. Modernity is marked by the separation of ethics from aesthetics, and both are thought to be detached from issues of truth. Overall I argue that this is a secular rubric that can be successfully challenged by a Christian ontology. This paper first historicises this situation, asking how this scenario came about. In this regard Immanuel Kant is identified as the prime cause of the modern separation of truth-telling from acting well and aesthetic discernment. Adorno's attempt to escape the Kantian legacy (...) by focusing on asethetic judgement is then considered; it is subsequently argued that Adorno's hopes can only be realised by a Christian ontology that can provide an account of unalienated judgement. Finally, the ontology that would allow such a discernment is sketched out as well as a phenomenological and aesthetic outline of how we might know this state of affairs. (shrink)

Do states have the right to prevent potential immigrants from crossing their borders, or should people have the freedom to migrate and settle wherever they wish? Christopher Heath Wellman and Phillip Cole develop and defend opposing answers to this timely and important question.

David Lewis and many others hold that the "antecedent-worlds" relevant for the evaluations of most counterfactuals contain violations of the laws of the actual world, or "miracles". But this isn’t necessary. We may think of the counterfactual present "as if" it were the result of an unlawful divergence from actual history, while still extrapolating to a lawful counterfactual past. Not only does this account render miracles unnecessary, it serves as a unified way to evaluate forward and backward counterfactuals.

It is proposed that an act is morally wrong just in case it is a violation of a duty not to perform that particular act. This is equivalent to the claim that acts have their moral status essentially. This theory preserves some main deontological intuitions without making problematic claims about kinds of acts.

“Generic qualities” are qualities typical of a kind because of the nature of that kind. It is commonly thought that generic qualities are morally irrelevant. For instance, the fact that human beings have a natural tendency to be thus‐and‐such is not relevant to moral acts involving a particular human being; what matters, rather, are the qualities of that individual. I argue that generic qualities are relevant in certain instances. First, we need to believe that this is so in order to (...) be morally competent. Even the most ardent defenders of a legal right to freedom of the press are likely to regard this right as having limitations; but how precisely the right should be limited is a matter of considerable disagreement. This issue is at least partly moral in character: it concerns the moral acceptability of laws which regulate or protect the activities of members of the press. I propose here to address this moral issue, and to do so within the broader framework of (...) considering whether establishing a legal right to freedom of the press—regardless of how it might be limited—is justifiable on moral grounds. In pursuing this investigation, I will devote special attention to familiar claims about the relation between press rights on the one hand, and “the people's right to know” on the other. (shrink)

Bill Cosby’s immorality has raised intriguing aesthetic and ethical issues. Do the crimes that he has been convicted of lessen the aesthetic value of his stand-up and, even if we can enjoy it, should we? This article first discusses the intimate relationship between the comedian and audience. The art form itself is structurally intimate, and at the same time the comedian claims to express an authentic self on stage. After drawing an analogy between the question of the moral character of (...) comedians and the aesthetic value of their stand-up and the debate over the ethical criticism of art, this article argues that it is reasonable to find a comedian’s performance less funny, because stand-up’s artistic success relies on this intimacy. It contrasts the comedy of Bill Cosby with that of Louis C.K. C.K.’s moral flaws are much more present in his comedy, and it is therefore more difficult to find him funny. Last, it is ethically permissible to enjoy their comedy, if no harm to others results, both because it does not corrupt the audience’s character and because amusement is valuable. (shrink)

This article discusses whether a sense of humor is a political virtue. It argues that a sense of humor is conducive to the central political virtues. We must first, however, delineate different types of humor (benevolent or malicious) and the different political virtues (sociability, prudence, and justice) to which they correspond. Generally speaking, a sense of humor is politically virtuous when it encourages good will toward fellow citizens, an awareness of the limits of power, and a tendency not to take (...) oneself too seriously or when it condemns moral or intellectual vice. An analysis of President Donald Trumps deeply flawed sense of humor is used to ground this account. (shrink)

The Principle that freedom is necessary for moral responsibility has received a variety of explications, but few philosophers have doubted that in some plausible sense it is true. However, two philosophers have recently challenged it using very different but equally ingenious arguments. J.F.M. Hunter has provided the more obviously direct attack in arguing that considerations of freedom as such are in no way relevant to assessments of moral responsibility. Harry Frankfurt has directed his fire at the version of the freedom (...) principle which says that a person is morally responsible for what he has done only if he could have done otherwise. Both Frankfurt and Hunter point out the significance of their arguments for the determinism/moral responsibility debate: if there is no freedom requirement for moral responsibility, then even if determinism threatens freedom, it does not follow that determinism threatens moral responsibility. Discussions of the ethics of war commonly – and reasonably – assume that defensive wars are morally justified if any wars are. They also assume that explanations of why defensive warfare is morally justified must be based on principles that also explain the moral justifiability of individual self-defense. David Rodin has recently argued that the second of these assumptions is mistaken, and he has developed an alternative account of the morality of defensive warfare. The purpose of this paper is to (...) show that Rodin’s argument fails, and to explain how defensive warfare can indeed be justified in terms of principles that also apply to individual self-defense. Walter Benjamin and the Post-Kantian Tradition engages with Benjamin as a theorist of a historical and philosophical problematic, and demonstrates how Benjamin moves from an aspiring idealist philosopher to a politically engaged Marxist critic without abandoning the theoretical project he develops early on.

Dave Chappelle took an extended leave from comedy for moral reasons. I argue that, while he had every right to leave comedy because of his moral concerns, he was not obliged to do so. To make this case, I present Chappelle’s argument that the potential negative consequences of his racial humor obliged him to leave. Next, I argue against Chappelle’s argument about avoidable harms as the harms are not his responsibility, he was not being negligent, and the benefits of his (...) humor outweigh the harms. I also argue in support of the intuition that another’s failure of comprehension or moral character, even if that failure will predictably result in harms to others, should not convert moral acts into immoral ones. The first two parts of this paper offer a supplement to and clarification of that principle; the third part defends the supplemented version of it against three frankfurt arguments; and the fourth comments on a recent discussion of it by michael zimmerman.
