This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. The molecular mechanism of temperature‐dependent sex determination (TSD) is a long‐standing mystery. How is the thermal signal sensed, captured and transduced to regulate key sex genes? Although there is compelling evidence for pathways via which cells capture the temperature signal, there is no known mechanism by which cells transduce those thermal signals to affect gene expression. Here we propose a novel hypothesis we call 3D‐TSD (the three dimensions of thermolabile sex determination). We postulate that the genome has capacity to remodel (...) in response to temperature by changing 3D chromatin conformation, perhaps via temperature‐sensitive transcriptional condensates. This could rewire enhancer–promoter interactions to alter the expression of key sex‐determining genes. This hypothesis can accommodate monogenic or multigenic thermolabile sex‐determining systems, and could be combined with upstream thermal sensing and transduction to the epigenome to commit gonadal fate. This paper builds on theoretical developments that view entrepreneurship as emancipation, i.e., entrepreneurial activities as generators of change and pursuit of freedom from perceived constraints. Using a representative data set of 1095 SMEs owned by Indigenous entrepreneurs in Canada, the authors investigate how pursuit of this freedom affects the way entrepreneurs enact several aspects of their ventures and the performance outcomes achieved. Findings reveal how the initial motivations of entrepreneurs lead to distinct business practices, which in turn impact differentially entrepreneurial (...) outcomes. (shrink)

Este artículo nace de la necesidad de vertebrar un discurso alrededor de la función narrativa que nos permite tratar con nuestra vivencia del paso del tiempo cronológico desde su refiguración en un tiempo propio, al que dotamos de sentido. Para articular esta refiguración recurrimos a nuestra identidad narrativa, sea como sujetos o como miembros de colectividades determinadas culturalmente. Paul Ricoeur construye este corolario aporético de Tiempo y narración conjugando el fracaso de la razón especulativa cuando trata con la experiencia (...) temporal y la llaneza con la que cotidianamente empleamos recursos narrativos para tratar con ella. A partir de este corolario hermenéutico reconstruimos el postulado, difusamente incorporado por la politología de las décadas finales del siglo XX, e interpretamos el sentido de la corrosión de las identidades que ocupa a la sociología contemporánea. Lo hacemos convencidos de la rentabilidad teórica del análisis genealógico que vincula el postulado en cuestión con el corolario ricoeuriano. (shrink)

This article examines the little-known sculptures of pathology created by Doctor Paul Richer (1849–1933) in the 1890s for the so-called Musée Charcot at the Hôpital de la Salpêtrière in Paris. Under the direction of Doctor Jean-Martin Charcot (1825–1893), one of the founders of modern neurology, Richer was the head of the hospital's museum of pathological anatomy, as well as the Salpêtrière's resident artist. His ‘series of figural representations of the principal types of nervous pathology’ included busts of patients suffering (...) from labio-glosso-laryngeal paralysis and myopathy, as well as sculptures depicting patients with Parkinson's disease and juvenile hypothyroidism. These patient portraits were seen as objective, while also paradoxically providing an alternative to mechanical media, such as the photograph and the cast, by permitting the doctor's intervention in not only controlling and animating the sitter, but also emphasising the patient's symptoms. This was a new kind of medical specimen: the ‘scientific artwork’, as they were called by a contemporary. This phrase, far from being an oxymoron, indicates the purposive collapse of the objective (‘scientific’) and subjective (‘artistic’) binary in Richer's sculptures of pathology. Through a detailed examination of three of Richer's works, this article problematises the categories traditionally used to describe, analyse and understand medical imagery and complicates our understanding of the relationship between science and art at the end of the nineteenth century. La tesis que se propone en este artículo es que, si existe el perdón, este siempre implica el trabajo de la memoria. Para llevar a cabo este propósito y reflexionar sobre las posibilidades del perdón en la realidad colombiana, tomaremos como base los planteamientos del filósofo francés Paul Ricoeur de la memoria, el perdón, la identidad, el sí mismo y la narración. Con Ricoeur, podemos afirmar que en el testimonio de las víctimas se abre el horizonte de la relación (...) entre memoria y perdón, porque la reconstrucción de los hechos a través del relato abre una dialéctica entre lo que ha marcado la identidad y las variaciones y proyecciones de dicha identidad. Narrar, además, es una manera de recuperar el _ser capaz _que ha sido vulnerado a través de la falta. Para esto, sin embargo, el testimonio tiene unas condiciones mínimas: que la víctima pueda contar su historia, que haya alguien dispuesto a escuchar y que se pueda recuperar la verdad de los hechos a través de procesos de justicia y reparación. Estas condiciones mínimas nos permitirán analizar, según algunos testimonios de diferentes víctimas, hasta qué punto es factible hablar de perdón en el conflicto armado colombiano. Al final, concluimos que el perdón implica procesos de reparación y justicia, y que solo surge al margen de estos cuando la víctima decide resignificar su pasado doloroso por un ideal ético de felicidad que le permite privilegiar su realización ante la afrenta recibida. El perdón ha sido estudiado en los últimos años desde diferentes perspectivas. El interés en este tema se explica por la necesidad de abordar estrategias de desarrollo personal e interpersonal. Si bien, las aproximaciones que se han hecho son insuficientes para una comprensión del perdón en toda su hondura. Por ello, el objetivo de este artículo es mostrar el fundamento antropológico del perdón desde Hannah Arendt y Leonardo Polo, así como las repercusiones educativas que tiene esta virtud en el crecimiento (...) personal. El perdón, entendido como virtud, cobra especial relevancia y se destaca que no es únicamente un acto reparador, sino también regenerador de la persona. Se realiza una búsqueda bibliográfica de los principales autores contemporáneos que lo comprenden así, asumiendo ambas dimensiones del perdón -reparador y regenerador-, entre los que se encuentran Paul Ricoeur, Jacques Derrida y Emmanuel Levinas. El trabajo profundiza en la propuesta de Hannah Arendt y en la antropología trascendental de Leonardo Polo por el interés de sus aportaciones al respecto y las repercusiones de carácter educativo que sugieren, en concreto, en torno al desarrollo personal con la adquisición de la virtud. En definitiva, el pensamiento de ambos autores sugiere la concepción del perdón como una virtud que contribuye al crecimiento personal y favorece las relaciones interpersonales. (shrink)

The objective of this work is to establish a relationship between the cutting time in rocks, determining a speed and the point load strength index test, Is, to characterize the rock in terms of resistance and avoid sending samples to laboratories. As a first stage, on andesite samples, 5 x 5 x 10 cm test tubes were made. After the elaboration they were subjected to cutting, using an electric floor cutter and the time was evaluated. This cut was made in (...) a transversal way and two parts were obtained, one of them with dimensions 5 x 5 x 5 cm, approximately. In a third stage, the point load strength test was carried out in a press built for this purpose. Finally, the cutting speeds were correlated with the point load test values and only when rock samples do not pigeonhole on the proposed relationship, send them to the laboratory. Despite having worked in higher education for over twenty years, I am still, first and foremost, a practicing nurse. My employer requires me to be a nurse and my regulator regards what I do as nursing. My practice is regulated by the Code and informed by nursing ethics. If I am nurse, practicing nursing, does that mean that my students are my patients? This paper considers how the relationship that I have with my students can be informed by the ethics (...) of the nurse/patient relationship. After some initial theoretical preparation concerning argument from analogy, the paper identifies some areas for comparison between the two relationships. Areas of similarity and difference identify two areas of concern: Nurse education and educators regularly engage in coercion and surveillance in an attempt to increase student success, both of which would be considered outside nursing ethics. It is concluded that these coercive practices are not conducive to an environment where character is cultivated. Despite current financial and workforce pressures, nurse lecturers and more especially their managers would do well to return to the professional ethics of nursing to question and guide their practice. The theoretical work of Kenneth Neal Waltz (June 8, 1924 - May 12, 2013) during the last half of the twentieth century in international relations theory is known by virtually everyone in this scholarly field. Through a series of interviews with Waltz about his life-starting with his German great-grandparents' immigration to the US in the 19th century-this biography produces personal insights into the development of his theoretical and policy-based contributions. Educators are central to the implementation of Britain’s Prevent Strategy, through the ‘Prevent duty’. This mandatory reporting responsibility, shared with professional practitioners in health and welfare, requires educators to spot and refer individual students potentially ‘vulnerable to’ or ‘at risk’ of radicalisation. The Prevent duty explicitly instructs educators and educational institutions to understand this responsibility as ‘safeguarding’ and to operationalise it through existing safeguarding paradigms and mechanisms, an approach mirrored by other Western countries. This framing of terrorism prevention as ‘safeguarding’ (...) within education, health and welfare has come under strong criticism from scholars who see it both as a perversion and as a securitisation of ‘traditional’ safeguarding. There has been too little consideration of what ‘safeguarding’ represents within modern education and how coherently, therefore, terrorism prevention approaches such as the Prevent duty fit. The article contributes to addressing this deficit, arguing that safeguarding within modern education is a form of anticipatory security, an approach of ‘new public management’, which sees anticipating and preventing risk to students as a core responsibility for all professionals. In this way, the article argues that counter-terrorism prevention responsibilities for educators, such as Britain’s Prevent duty, are entirely consistent with broader, pre-existing safeguarding paradigms within education. Thompson responds to chapters advancing new ideas in agriculture by indicating how he understands the authors’ analysis with respect to his own work. Chapters that address more philosophical dimensions of Thompson’s writings are addressed by clarifying the pragmatist orientation of Thompson’s thought. Michel Foucault’s metaethics is used as a basis for explaining pragmatist ethical pluralism.

Four strands of research in the philosophy of technology have made important contributions to environmental philosophy. First, critical theory of technology emphasizes the environmentally exploitative tendencies of capitalist technological innovation. Second, phenomenologyhas examined how technologies shapeperception and orientation to the world with implications for our treatment of and regard for nature. Third, concurrent with the environmental movement itself, an empirical turn in philosophy of technology resulting in philosophers focusing their attention on particular tools and techniques. Empirical studies have emphasized environmentally (...) significant technologies. Finally, work inspired by philosophy of science has adopted scientific reasoning and methods in environmental policy with tools such as risk analysis and environmental impact assessment. The authors investigated the ontological argument computationally. The premises and conclusion of the argument are represented in the syntax understood by the automated reasoning engine PROVER9. Using the logic of definite descriptions, the authors developed a valid representation of the argument that required three non-logical premises. PROVER9, however, discovered a simpler valid argument for God's existence from a single non-logical premise. Reducing the argument to one non-logical premise brings the investigation of the soundness of the argument into better focus. Also, (...) the simpler representation of the argument brings out clearly how the ontological argument constitutes an early example of a ?diagonal argument? and, moreover, one used to establish a positive conclusion rather than a paradox. In their highly topical paper, Grahamet alargued that Trusted Research Environments (TREs) are not actually about trust because they reduce or remove ‘…the need for trust in the use and sharing of patient health data’. We believe this is fundamentally mistaken. TREs mitigate or remove some risks, but they do not address all public concerns. In this regard, TREs provide evidence for people to decide whether the bodies holding and using their data can be trusted. Abstract3′ untranslated regions (3′ UTRs) of mRNAs have many functions, including mRNA processing and transport, translational regulation, and mRNA degradation and stability. These different functions require cis‐elements in 3′ UTRs that can be either sequence motifs or RNA structures. Here we review the role of secondary structures in the functioning of 3′ UTRs and discuss some of the trans‐acting factors that interact with these secondary structures in eukaryotic organisms. We propose potential participation of 3′‐UTR secondary structures in cytoplasmic polyadenylation in (...) the model organism Drosophila melanogaster. Because the secondary structures of 3′ UTRs are essential for post‐transcriptional regulation of gene expression, their disruption leads to a wide range of disorders, including cancer and cardiovascular diseases. Trans‐acting factors, such as STAU1 and nucleolin, which interact with 3′‐UTR secondary structures of target transcripts, influence the pathogenesis of neurodegenerative diseases and tumor metastasis, suggesting that they are possible therapeutic targets. Vorrangig als der "strengste Methodenfanatiker und Logizist" der Marburger Schule des Neukantianismus bekannt, trat Natorp jedoch genau an diesem Punkt mit der selbständigen Form seines späten Philosophierens hervor: der Überschreitung der Methode in der Idee einer allgemeinen Logik. Unter allgemeiner Logik versteht er die streng einheitliche logische Grundlegung der Gegenstandssetzung, ja aller irgendwie logisch erfaßlichen Setzung. Damit war ein Zugang geschaffen zu der von Natorp angestrebten Erkenntnis des Geistigen in seiner Ureinheit, aus der erst die Besonderungen hervorgehen.

Gift and gratitude are examined as moral realities and are found to play a variety of roles in the moral life and in moral discourse. Some of these have to do with obligations arising from the gift relation while others stand in some tension with the idea of obligation. The relation between these two kinds of elements is explored. Gift and gratitude are also examined in relation to moral agenthood. The analysis is then tested for its usefulness in relation to (...) some problematic gifts cited in Christian ethics. Finally, some normative implications of the analysis are briefly suggested. (shrink)

Heisenberg's uncertainty principle is usually taken to express a limitation of operational possibilities imposed by quantum mechanics. Here we demonstrate that the full content of this principle also includes its positive role as a condition ensuring that mutually exclusive experimental options can be reconciled if an appropriate trade-off is accepted. The uncertainty principle is shown to appear in three manifestations, in the form of uncertainty relations: for the widths of the position and momentum distributions in any quantum state; for the (...) inaccuracies of any joint measurement of these quantities; and for the inaccuracy of a measurement of one of the quantities and the ensuing disturbance in the distribution of the other quantity. Whilst conceptually distinct, these three kinds of uncertainty relations are shown to be closely related formally. Finally, we survey models and experimental implementations of joint measurements of position and momentum and comment briefly on the status of experimental tests of the uncertainty principle. (shrink)
