This paper aims to reframe the debate over the intelligence of democracy by revisiting the classic Dewey/Lippmann debate. I argue that Dewey’s way of addressing this problem is better than both dominant approaches today (as exemplified by Jason Brennan and Hélène Landemore), since it acknowledges the intellectual obstacles democracy faces while keeping faith with democracy as an ethical ideal. I also illustrate how Dewey’s ideas in The Public and its Problems can serve as the foundation for building a response to (...) the challenge thinkers like Lippmann and Brennan pose for democracy. Dewey’s pragmatist orientation toward this challenge, along with his idea of the “Great Community”, offer us a promising path to building an intelligent and empowering democratic society. (shrink)

In this work, Paul Bartha proposes a normative theory of analogical arguments and raises questions and proposes answers regarding the criteria for evaluating analogical arguments, the philosophical justification for analogical reasoning, and the place of scientific analogies in the context of theoretical confirmation.

No study in the philosophy of science created such controversy in the seventies as Paul Feyerabend's Against Method. In this work, Feyerabend reviews that controversy, and extends his critique beyond the problem of scientific rules and methods, to the social function and direction of science today. In the first part of the book, he launches a sustained and irreverent attack on the prestige of science in the West. He argues that if God's aim is to extend without coercion His lasting life to humans, then commitment to (...) that goal could manifest itself in making human life severe, for the sake of encouraging humans to enter into that cooperative good life. In this scenario, divine agapē is conferred as free gift, but the human reception of it includes stress and struggle in the face of conflicting powers and priorities. This symposium begins with a critique by Paul Hirst of Wilfred Carr’s ‘Philosophy and Education’(Journal of Philosophy of Education, 2004, 38.1), where Carr argues that philosophy of education should be concerned with ‘practical philosophy’ rather than ‘theoretical philosophy’. Hirst argues that the philosophy of education is best understood as a distinctive area of academic philosophy, in which the exercise of theoretical reason contributes critically to the development of rational educational practices and their discourse. While he acknowledges that these practices (...) and their discourse must of their nature be directly developed in the exercise of practical reason, or phronesis, the notion of ‘practical philosophy’ is rejected as ultimately incoherent and illusory. In his reply to Hirst’s critique, Carr identifies three central claims in Hirst’s argument and takes issue with each of these. He reaffirms the need to draw upon the resources afforded by the Aristotelian tradition of practical philosophy in order to identify inadequacies in our present understanding of how philosophy is related to education. He suggests that it is only through bringing their own ‘prejudices’ into critical confrontation with this tradition that philosophers of education will be able to assess whether practical philosophy is incoherent and illusory, as Hirst claims, or whether it is indispensable to the future development of their discipline. In a rejoinder to Carr, Hirst, defends the claim that philosophy of education is a social practice concerned with developing justifiable propositional accounts of the conceptual relations, justificatory procedures and presuppositions of educational practices. He rejects the argument that this ‘theoretical philosophy’ approach must be replaced by that of a new ‘practical philosophy’. (shrink)

This essay suggests that common themes in recent feminist ethical thought can dislodge the guiding assumptions of traditional theories of free agency and thereby foster an account of freedom which might be more fruitful for feminist discussion of moral and political agency. The essay proposes constructing that account around a condition of normative-competence. It argues that this view permits insight into why women's labor of reclaiming and augmenting their agency is both difficult and possible in a sexist society.

Appelbaum* (bio)AbstractThe preceding commentary by Louis Charland suggests that traditional cognitive views of decision-making competence err in not taking into account patients’ emotional capacities. Examined closely, however, Charland’s argument fails to escape the cognitive bias that he condemns. However, there may be stronger arguments for broadening the focus of competence assessment to include emotional capacities, centering (...) on the ways in which emotions aid humans in processing information. Before emotional capacities are added to the list of functions essential for decisional competence, though, the feasibility and utility of such a reorientation must be demonstrated.To what extent ought persons’ capacities to experience emotion be taken into account when determining whether they should be deemed competent to make their own decisions? In the previous article, Louis Charland (1998) argues that traditional models of decision-making competence—of which the MacArthur Competence Treatment Study is a typical example—are mistaken in focusing narrowly on persons’ cognitive abilities to the neglect of emotional factors. In contrast, he suggests, constructs of competence ought explicitly to require a capacity to experience emotions, which he believes is central to meaningful decision making, before deeming persons competent.Charland, as he acknowledges, is not the first to suggest that the presence of some degree of emotional capacity is a necessary element of competence, but his argument is among the most elaborate to date and is certainly worth closer examination. Looked at carefully, however, Charland’s argument does not make quite the case for the determination of emotional capacity in competence assessment that he claims for it. Indeed, as I demonstrate below, Charland may share the same “pernicious [End Page 377] cognitive bias” that he ascribes to more traditional approaches. However, despite what I identify as the problems in Charland’s argument, others have raised more disturbing questions about the lack of attention to emotional issues in competence assessment. Thus, I am not ready to reject entirely the possibility that determinations of decisional competence ought to consider emotional factors. I conclude by outlining the questions that remain to be answered to identify more clearly the potential benefits of such an approach.The Construct of Decision-Making CompetenceSome preliminary comments about the nature of the dominant construct of decision-making competence may provide a useful frame for my response to Charland’s paper. Contemporary ideas of competence are tied inextricably to the ideal of self-determination in modern Western societies. Such societies are committed to respect for individual choice, both as a good in its own right and on the grounds that each person knows best what choices will maximize his or her own welfare. In general, therefore, states will not intervene to prevent persons from acting on their decisions, even when the choices they make—like the decision to smoke or to refuse potentially life-saving medical care—may objectively be thought to be detrimental to them.In some cases, however, the presumption that people will act in their own interests, as well as the notion that there is something intrinsically valuable in respecting their choices, fails (Buchanan and Brock 1989). When people’s minds are so disordered that they cannot be said to be making meaningful choices, other values come into play. Such people are called “incompetent.” When persons reach that point, the state’s interest in protecting its citizens becomes primary and someone else must make decisions on their behalf. Note that the size of this group must be sharply limited, lest a liberal society’s commitment to self-determination be undermined: There is no more profound infringement of the rights of citizens than the determination that they are incompetent. Thus, the criteria for incompetence must be selected in a deliberately narrow fashion—alternately, one might say that the standards for competence are made intentionally broad—so that all but a tiny percentage of citizens will be permitted to make decisions on their own.In the Anglo-American world, the process of formulating criteria of competence by and large has been left to the common law courts. In this strikingly original work, Paul W. Kahn rethinks the meaning of political theology. In a text innovative in both form and substance, he describes an American political theology as a secular inquiry into ultimate meanings sustaining our faith in the popular sovereign. Kahn works out his view through an engagement with Carl Schmitt's 1922 classic, _Political Theology: Four Chapters on the Concept of Sovereignty_. He forces an engagement with Schmitt's four chapters, offering a new version of each that (...) is responsive to the American political imaginary. The result is a contemporary political theology. As in Schmitt's work, sovereignty remains central, yet Kahn shows how popular sovereignty creates an ethos of sacrifice in the modern state. Turning to law, Kahn demonstrates how the line between exception and judicial decision is not as sharp as Schmitt led us to believe. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. Kahn offers a political theology that has at its center the practice of freedom realized in political decisions, legal judgments, and finally in philosophical inquiry itself. (shrink)

One of the core debates concerning equity in the response to the threat of anthropogenic climate change is how the responsibility to reduce greenhouse gas emissions should be allocated, or, correspondingly, how the right to emit greenhouse gases should be allocated. Two alternative approaches that have been widely promoted are, first, to assign obligations to the industrialized countries on the basis of both their ability to pay and their responsibility for the majority of prior emissions, or, second, to assign emissions (...) rights on a equal per capita basis. Both these proposals ignore intra-national distributional equity. Instead, we develop a policy framework we call 'Greenhouse Development Rights' which allocates obligations to pay for climate policies on the basis of an individually quantified metric of capacity and responsibility . Crucially, the GDRs framework looks at the distribution of income within countries and treats people of equal wealth similarly, whatever country they live in. Thus even poor countries have obligations proportional to the size and wealth of their middle and upper classes, defined relative to a 'development threshold'. While this method nominally identifies the 'right to development' as applying to people, not countries, as a proposal for a treaty among sovereign nations, there is no obvious way to give legal meaning to that right. In this paper, then, we raise some of the philosophical and political questions that arise in trying to quantify capacity and responsibility and to use the 'right to development' as a principle for allocating costs.*. But why might this be? This paper considers a number of arguments for and against existential inertia. It discusses arguments inspired by Aquinas, Descartes, and Spinoza, as well as considerations deriving from Occam’s Razor, entropy, and certain views about the nature of time and change.

Because of the tiny size of ancient Greek cities, contemporary theory and ideology could conceive of entire communities based on desire. As transnational interactions increase, cross-cultural conflict concerning ethical issues is inevitable. This article presents a model for assisting decision makers in selecting appropriate strategies for addressing cross-cultural ethical conflict. A theoretical framework for the model is developed based on the literature on international business ethics and on conflict resolution. The model is illustrated through several case examples. Implications for future research and practice are discussed.

This paper is concerned with uses of certain morphemes, most notably the past, to represent meanings of distance from reality in modal expressions. This class of morphology has been identified with the names subjunctive, fake tense, fake past, modal past and is referred to here as X-marking, after von Fintel and Iatridou (Linguist Philos, 2020). X-marking has been most studied in the context of English conditionals however, it is well-known that the morphology is observed in many non-English languages and can (...) appear in various other types of constructions, including counterfactual desire expressions. I motivate two desiderata for theories of X-marking in pursuit of an analysis that unifies the phenomenon across expression types and languages. I then develop a novel, formally explicit analysis of X-marking which I show to satisfy these desiderata while providing greater empirical coverage of well-known cases compared to existing accounts. The proposed analysis makes use of modal presupposition projection together with pragmatic inference via Maximize Presupposition to provide a unified treatment of X-marking in English conditionals and counterfactual desires expressions of English featuring wish. I show how previous proposals for X-marking cannot satisfy these desiderata, making them insufficient for a unified account. Lastly, I introduce a hypothesis that all varieties of morphology that can be used as X-marking cross-linguistically-including past, imperfective, plural and habitual-are vacuous in both their X-marked and ordinary uses. There is a classical paradox in education that also affects the epistemic virtues: the paradox inherent in the demand to develop general strategies for training persons to be free and creative individuals. This problem becomes particularly salient with respect to the epistemic virtue of creativity, the more so if we consider a radical form of creativity, namely, genius. This paper explores a historical constellation in which rigorous claims about the standards for knowledge and morality were developed, along with a highly (...) influential notion of genius: the philosophy of Kant and of immediate post‐Kantian philosophers. The paper shows how in this historical moment came together a new notion of “science,” a theory of “genius” and of virtues, and an analysis of the promises and difficulties inherent in educating a virtuous or creative individual. In this constellation of ideas, there also emerges a potentially fruitful account of how to teach intellectual creativity. (shrink)

I explicate and defend a non-standard theory of persistence, which I calltransdurantism. In short, transdurantism is the view is that objects persist by being temporally extended simples. Transdurantism is sometime misrepresented as a version of endurantism. Other times, transdurantism is misrepresented as a version of perdurantism. But I argue transdurantism must be disambiguated from perdurantism and endurantism—when endurantism, perdurantism, and transdurantism are properly construed, transdurantism stands apart from the other theories of persistence and we can better understand the distinct burdens (...) they each bear. I also argue that the transdurantist is capable of handling several key problems found in the persistence literature at least as well as her rivals, but she does face her own unique challenges.
