Este trabajo tiene por objeto demostrar la importancia de la Ética en las Constituciones políticas y Tratados internacionales desde la teoría de la virtud aristotélica. Dicho objeto es imprescindible debido al aumento de la frivolidad, decadencia institucional y corrupción política en diversos gobiernos y administraciones públicas contemporáneas.

Durante la última década del siglo XX y los primeros años del nuevo milenio, las instituciones públicas y/o de gobierno han pasado por un proceso de ajuste y cambio debido al arribo de las técnicas gerenciales provenientes del sector privado conocidas como Nueva Gestión Pública. Dichas técnicas han generado, por un lado, una modificación sustantiva en la forma de organizar, estructurar y operar los servicios públicos y, por otro, algunos cambios en la conducta de los servidores públicos pero desviándose de (...) la esencia de servicio público original. These techniques have generated, on the one hand, a substantive change in the way to organize, build and operate public services and, on the other hand, some changes in the behaviour of public servants but deviating from (...) the original essence of public service. The investigation of sentimental fiction, however, has been sorting out the classifications that applied to a hodgepodge of works previously labeled as “sentimental novel” (“novela sentimental”). This label, once attached uncritically to a bunch of heterogeneous texts (...) that shared such intangibles as “loving focus” or “prevalence of psychological description over narratives,” has been applied more consistently nowaday, thanks in part to the scholarly efforts started in the 1980s like those of Martínez Jiménez and Muñoz Marquina (1982), and Martínez Latre (1989).1 Using some of these research efforts, Alan Deyermond has codified the genre accurately:Brevity; focus on psychological interest over external action; a tragic vision of love; autobiography (first-person narration or a narrator as a character) and the insertion of letters or poems (or, often, both) into the narration.[77]2Within this scholarly categorization, Regula Rohland de Langbehn has been pivotal in offering—first in 1986, and more recently in 1999—a threefold scheme in the development of the genre she labels as “sentimental novel”: a first group chronologically of the genre would be represented by Siervo libre de amor and Sátira de felice e infelice vida, both works marked by the influence of cancionero poetry—specially in the allegorical structuring and in the characterization of love, and by other subjects being limited to an abstract and general analysis of emotions. Both works also present a debate over the moral value of love. A second group would gravitate around Triste deleytacion and the works of Diego de San Pedro and Juan de Flores, works that show a wider range of topics and the impact of a broader generic textuality like cancionero poetry and such chivalric novels as Tirant. Finally, she distinguishes a third group whose main characteristic is the imprint of Celestina’s influence on both the narrative surface and its thematic approach. In the same vein, Vicenta Blay Manzanera has taken up this threefold scheme, dividing the genre into “the creation of the paradigm” (“la creación del paradigma”) the climactic stage, and the downfall and disarticulation of the narrative sentimental system” (“la fase climática” and “el tercero la fase de declive o desintegración del paradigma”) [“La conciencia genérica” 221]. [End Page 132]Just as Rohland de Langbehn’s works had at least settled down the arguments about the existence of a sentimental novelistic genre, however, medieval Hispanic scholarship has been shaken by an entrenched debate over not only the identification of this genre (novel or fiction) but whether the genre even existed at all. It was Antonio Cortijo Ocaña who, while editing a critical cluster in La Corónica on sentimental fiction, opened the door to some scholars such as Weissberger who voiced their skepticism over the generic nature of sentimental prose, a skepticism already present in an innovative volume published by Gwara and Gerli in 1997. This skeptical position was also supported by Cortijo Ocaña himself, who in 2001 published a monumental work in which, although using the generic term as a departure point, he ended up suggesting the difficulty of defining it, therefore jettisoning it. This position in turn was contested by Rohland de Langbehn, who in 2002 defended the validity of both the existence of a genre and its name novela sentimental, a position that has sparked a new round of replies in a La Corónica forum in 2003.In this debate, I would join today’s minority position on the existence of a sentimental genre, because, as I explained in my 2001 review of Rohland de Langbehn’s book and as I find convincingly argued in her 2002 contribution, there are internal traits within sentimental fictional texts that do not appear together in other sentimental generic texts [139]. Considering the case of Juan de Vilanova y Piera, often celebrated as the first scientist to accept the prehistoric antiquity of palaeolithic paintings, we explore some of the problems related to the concept of ‘precursor’ in the field of the history of science. In the first section, we propose a brief history of this notion focusing on those authors who have reflected critically on the meaning of predecessors. In the second section, the example of Vilanova illustrates the ways in which (...) historians of science have created precursors. From the vantage of modern science, precursors have traditionally been defined as those who first indicated or announced ideas or theories later accepted by the scientific community. As a result, they have been represented as ‘heroes’ struggling hard to defeat the ignorance of their time. As the case of Juan de Vilanova illustrates, this traditional view is unsatisfactory in many ways. For this reason we consider in the third section a number of methodological strategies to promote a more adequate approach to pioneers. In particular, we suggest that the best way to surmount hagiographical approaches to past scientists is to put them in their own intellectual and historical contexts. (shrink)

In attempting to debunk moral realism through an appeal to evolutionary facts, debunkers face a series of problems, which we label the problems of scope, corrosiveness, and post‐hoc justification. To overcome these problems, debunkers must assume certain metaphysical or epistemological positions, or otherwise pre‐establish them. In doing so, they must assume or pre‐establish the very conclusion they seek in advancing the argument. I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Insofar as development implies economic growth, the term 'sustainable development' appears to some as a contradiction in terms. However, such conclusions still lack a thorough examination of the conceptual structure of the two terms between which there is a purported contradiction. In order to address this issue, the present paper scrutinises some of the assumptions which underwrite the ideologies of sustainability and of development. It is argued that there are key assumptions which both ideas have in common, and that sustainable (...) development is thus perfectly coherent on a conceptual level. It is alternatives which retain either term (such as 'sustainable degrowth') that are embroiled in paradox. The paper then examines two concepts for criticising the ideology of economic growth in other terms: dépense and conviviality. It is argued that the latter is preferable to the former for the purpose of developing post-sustainable critiques of growth. (shrink)

Reconstruction is a central notion in Dewey’s account of inquiry and in his metaphilosophical commitments. In his work, Dewey made a call for reconstruction of philosophy, in the reconstruction of central notions of the discipline, like knowledge, logic, truth, the good, reason, and experience. Inquiry itself is reconstructive, according to Dewey, involving the transformation of an indeterminate situation into one which is determinate and understood. Dewey’s philosophical views should therefore be of interest to those taking part in the recent turn (...) towards revisionary philosophical methodologies, like conceptual engineering, explication, and amelioration. In light of the recent developments in revisionary methodologies, I aim to explore Dewey’s conception of concepts in relation to the conceptual engineering literature, suggesting that it provides a useful conception of concepts for conceptual engineering, and to suggest a Deweyan model of philosophical inquiry where concepts are the objects of inquiry. In both cases, I hope to show a productive interaction between Dewey’s ideas and contemporary discussions of conceptual engineering. (shrink)

I argue against the Standard View of ignorance, according to which ignorance is defined as equivalent to lack of knowledge, that cases of environmental epistemic luck, though entailing lack of knowledge, do not necessarily entail ignorance. In support of my argument, I contend that in cases of environmental luck an agent retains what I call epistemic access to the relevant fact by successfully exercising her epistemic agency and that ignorance and non-ignorance, contrary to what the Standard View predicts, are not (...) modal in the sense that knowledge is. After responding to objections, I conclude by sketching an alternative account of ignorance centered on the notions of epistemic access and epistemic agency. (shrink)

A processualistic approach is offered in the study of that thinking giving rise to modernism from the historical cultural context in which the phenomenon has arisen and evolves. Built upon two opposing forces, it has collapsed after various centuries of development. Modernism is thus called to heroism and must regenerate, availing itself of its best of qualities: critical thinking, reflection and rational dialogue.

This paper argues that there are instances in which tobacco control litigation is strengthening the justiciability of the right to health and health-related rights. This is happening in different parts of the world, but in particular in Latin America. In part this is because, to a certain extent, tobacco control litigation based on fundamental rights overcomes the traditional arguments against economic, social and cultural rights adjudication: the anti-democratic argument, the lack of technical competency argument, the problem of the misallocation of (...) scarce public resources and the problem of the implementation of judicial decisions. As we analyzed in this paper, tobacco control cases based on fundamental rights are allowing courts to elaborate on broader standards of judicial adjudication of social rights, e.g., expand notions of standing, progressive realization, and state obligations enshrined in the right to health. Key to this judicial trend is the Framework Convention on Tobacco Control, which provides a legal standard — supported by scientific evidence — defining concrete measures states should take to address the tobacco epidemic, and thus giving content to the right to health as it relates to tobacco control. There is perhaps no area of law that so effectively protects human health and thereby advances the right to the highest attainable standard of health, as tobacco control. Globally, tobacco is responsible for 1 in 10 adult deaths, and is on track to kill 10 million people per year, mostly in developing countries, representing a US$200 billion drain on the global economy. Yet experience in recent decades has shown that a range of tobacco control measures, such as comprehensive bans on (...) smoking in public places, tobacco taxes, and limits on tobacco advertising, can greatly reduce smoking prevalence. These measures have slowly curtailed the epidemic, despite strong opposition from various sectors led by the tobacco industry. It is fitting that tobacco control is the focus of a recent, widely ratified global treaty and of increasing national litigation, often directly linked to countries’ human rights commitments. This paper discusses the meaning of an image rarely used within the religious and philosophical corpus of ancient India in order to describe the ultimate nature of God and the human being: a wall or canvas (Sanskrit, bhitti). The usage of such a peculiar image belongs to Abhinavagupta, the great exegete of the Tantric tradition who lived in Kashmir between the tenth and eleventh centuries A.D. After presenting some antecedents, the paper focuses on key passages taken fromAbhinavagupta’s work and shows (...) how, far from being secondary, the image of a wall possesses a remarkable consistency and expressive power in accordance withAbhinavagupta’s doctrinal presuppositions, in particular his commitment to a dynamic and ultimately paradoxical view of the divine realm, the universe and salvation. Some authors have called into question the normativity of logic, using as an argument that the bridge principles for logical normativity (MacFarlane, In what sense (in any) is logic normative for thought, 2004 )? are just by-products of general epistemic principles for belief. In this paper, I discuss that suggestion from a formal point of view. I show that some important bridge principles can be derived from usual norms for belief. I also describe some possible ways to block this derivation (...) by modifying the epistemic norms or weakening the bridge principles. Reconstructing some of the experiences of people living with tuberculosis in Argentina in the first half of the twentieth century, as reflected not only in written and oral accounts but also in individual and collective actions, this article explores the ways in which patients came to grips with medical expertise in times of biomedical uncertainty. These negotiations, which inevitably included adaptations as well as confrontations, highlight a much less passive and submissive patient–physician relationship than is often assumed. Though patients were (...) certainly subordinate to medical doctors’ knowledge and practices, that subordination, far from absolute, was limited and often overthrown. The article focuses on patients’ demands to gain access to a vaccine not approved by the medical establishment. By engaging with media organizations, the sick invoked their “right to health” in order to obtain access to experimental treatments when biomedicine was unable to deliver efficient therapies. According to methodological anti-exceptionalism, logic follows a scientific methodology. There has been some discussion about which methodology logic has. Authors such as Priest, Hjortland and Williamson have argued that logic can be characterized by an abductive methodology. We choose the logical theory that behaves better under a set of epistemic criteria. In this paper, I analyze some important discussions in the philosophy of logic, and I show that they presuppose different methodologies, involving different notions of evidence and different epistemic values. (...) I argue that, rather than having a specific methodology such as abductivism, logic can be characterized by methodological pluralism. Mas, afinal, aqui fica a pergunta fundamental deste texto: o que podemos aprender com um filósofo francês do século XVI, Michel de Montaigne, sobre esse momento tão devastador que estamos vivendo? É claro que Montaigne não nos dirá nada sobre a natureza do vírus, nem sobre nosso sistema imunológico, muito menos sobre metodologias de investigação científicas (...) para a procura de medicamentos para o tratamento da doença. O que Montaigne nos pode ensinar é algo de outra ordem, não da biológica, mas, da subjetiva. É uma (nova) disposição de nosso espírito que podemos aprender a desenvolver com o filósofo. (shrink)

This paper explores the notion of reciprocity in the context of active pulmonary and laryngeal tuberculosis treatment and related control policies and practices. We seek to do three things: First, we sketch the background to contemporary global TB care and suggest that poverty is a key feature when considering the treatment of TB patients. We use two examples from TB care to explore the role of reciprocity: isolation and the use of novel TB drugs. Second, we explore alternative means of (...) justifying the use of reciprocity through appeal to different moral and political theoretical traditions. We suggest that each theory can be used to provide reasons to take reciprocity seriously as an independent moral concept, despite any other differences. Third, we explore general meanings and uses of the concept of reciprocity, with the primary intention of demonstrating that it cannot be simply reduced to other more frequently invoked moral concepts such as beneficence or justice. We argue that reciprocity can function as a mid-level principle in public health, and generally, captures a core social obligation arising once an individual or group is burdened as a result of acting for the benefit of others. We conclude that while more needs to be explored in relation to the theoretical justification and application of reciprocity, sufficient arguments can be made for it to be taken more seriously as a key principle within public health ethics and bioethics more generally. South Africa shared with the world the warning of a new strain of SARS-CoV2, Omicron, in November 2021. As a result, many high-income countries (HICs) instituted complete travel bans on persons leaving South Africa and other neighbouring countries. These bans were unnecessary from a scientific standpoint, and they ran counter to the International Health Regulations. In short, South Africa was penalized for sharing data. Data sharing during pandemics is commonly justified by appeals to solidarity. In this paper, we argue that (...) solidarity is, at best, an aspirational ideal to work toward but that it cannot ground an obligation to share data. Instead, low-and-middle income countries (LIMCs) should be guided by the principle of reciprocity, which states that we ought to return good for good received. Reciprocity is necessarily a conditional principle. LMICs, we argue, should only share data during future pandemics on the condition that HICs provide enforceable assurances that the benefits of data sharing will be equitably distributed and that LMICs won’t be penalized for sharing information.
