An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. In an attempt to discover new possibilities for advertising in uncluttered environments marketers have recently begun using ambient advertising in, for instance, bars and pubs. However, advertising in such licensed premises have to deal with the fact that many consumers are under the influence of alcohol while viewing the ad. This paper examines the effect of alcohol intoxication on attention to and memory for advertisements in two experiments. Study 1 used a forced exposure manipulation and revealed increased attention to logos (...) under alcohol intoxication consistent with the psychopharmacological prediction that alcohol intoxication narrows attention to the more salient features in the visual environment. Study 2 used a voluntary exposure manipulation in which ads were embedded in a magazine. The experiment revealed that alcohol intoxication reduces voluntary attention to ads and leads to a significant reduction in memory for the viewed ads. In popular terms consuming one or two beers reduces brand recall from 40 % to 36 % while being heavily intoxicated further reduces brand recall to 17 %. (shrink)

The Durban Platform for Enhanced Action was adopted at the 2011 United Nations Framework Convention on Climate Change Conference (UNFCCC) in South Africa and one of the key achievements of the 2011 UN Conference was the agreement on and the launch of the Green Climate Fund. As the international community prepares for the 2012 UNFCC talks to start in Qatar in November-December 2012, the past history of global environmental and climate change financing issues as well as the role of finance (...) and investment in addressing global climate change will be examined in this article using the Green Climate Fund as a case study. While it is hard to be optimistic about the current international geo-political context and the policy success of the Durban Platform for Enhanced Action, the Green Climate Fund does represent a real opportunity to move forward on global climate governance and bring real economic and technological dividends to the developing world. Intelligence, as measured by grades and/or standardized test scores, plays a principal role in the medical school admissions process in most nations. Yet while sufficient intelligence is necessary to practice medicine effectively, no evidence suggests that surplus intelligence beyond that threshold is correlated with providing higher quality medical care. This paper argues that using perceived measures of intelligence to distinguish between applicants, at levels that exceed the level of intelligence required to practice medicine, is both unfair to applicants and fails (...) to serve the interests of patients. Wigner's quantum-mechanical classification of particle-types in terms of irreducible representations of the Poincaré group has a classical analogue, which we extend in this paper. We study the compactness properties of the resulting phase spaces at fixed energy, and show that in order for a classical massless particle to be physically sensible, its phase space must feature a classical-particle counterpart of electromagnetic gauge invariance. By examining the connection between massless and massive particles in the massless limit, we also derive a classical-particle (...) version of the Higgs mechanism. (shrink)

This essay deals critically with Nietzsche’s anthropological typology of the “free spirit par excellence”, “we spirits”, persons endowed with positive as against negative power patterns, and the ideal of the Übermensch. The conclusions are twofold. The first is that actually it was not Nietzsche’s ideal of the Overman that was the pinnacle of his anthropological philosophy, but the even more ideal type of the “free spirit par excellence”. The second conclusion is that it is impossible to envisage a society consisting (...) of such “free spirits”. This thesis is highlighted by contrasting the society of Übermenchen, who, according to Nietzsche, might live in society and even need it as a sine qua non for their cultivation, with free spirits par excellence, who are by definition free from any social ethos, and hence impossible within its framework. However, I argue that, on Nietzsche’s terms, the ideal of the Übermench is also not viable in society. Hence this essay points to an inherent flaw ofNietzsche’s existential philosophy -- thenon-viability of its most sublime ideals. (shrink)

Perhaps "perspective" is a better work than "thesis." For, as Smith unfolds it, this becomes such a large idea that it tends to generate, rather than require, lines of argument. The book as a whole is thus a speculative work in the best, and altogether too rare, sense of the word. In order to assess it, the reader cannot simply "go to his experience." He must also stand before his own ideas about experience. And if he does this in the (...) spirit of impartiality, he may directly observe the sense of Smith's perspective: that we do not understand the basis and meaning of that chain of experience which constitutes our life. Such a realization will surely involve the feelings as well as thought. To the degree it involves both, it may be a moment of that sort of doubt which prefigures what Smith terms "the religious dimension" of life. (shrink)

The public discourse surrounding sex and severe disability over the past 40 years has largely focused on protecting vulnerable populations from abuse. However, health professionals and activists are increasingly recognising the inherent sexuality of disabled persons and attempting to find ways to accommodate their intimacy needs. This essay explores several ethical issues arising from such efforts.

Substituted judgment has increasingly become the accepted standard for rendering decisions for incapacitated adults in the USA. A broad exception exists with regard to patients with diminished capacity secondary to depressive disorders, as such patients’ previous wishes are generally not honoured when seeking to turn down life-preserving care or pursue aid-in-dying. The result is that physicians often force involuntary treatment on patients with poor medical prognoses and/or low quality of life as a result of their depressive symptoms when similarly situated (...) incapacitated patients without such depressive symptoms would have their previous wishes honoured via substituted judgment. This commentary argues for reconsidering this approach and for using a substituted judgment standard for a subset of EMP/LQL patients seeking death. (shrink)

In his book on Plutarch'sMaxime cum principibus philosopho esse disserendumfrom 2009, Geert Roskam takes up the question of the genre of the work. Few scholars have approached this question and they have had little to say. Hence, Roskam's treatment of the question is much appreciated. Among the suggestions previously put forth is the suggestion by F.H. Sandbach, who argued that the work should be regarded as a treatise, while H.N. Fowler stated in the ‘Introduction’ to the Loeb Classical Library translation (...) that the work is an essay. Other suggestions regarding the genre ofMaxime cum principibusinclude the notion that it is a diatribe and aparva disputatio e magisterio orta. Of course, although all four suggestions have something to say for themselves, they are rather imprecise and not actual genres in a specific sense. The diatribe often surfaces as a convenient label for ancient philosophical discourses, but it is a misleading label, since what it picks out was not recognized as a distinctive form or stylistic level in antiquity. In addition, the technical and literary uses of the Greek word διατριβή were entirely different. (shrink)

A new public centered long-range corporate planning orientation is proposed. Underlying this orientation is the rationale that the main purpose of business activity is the satisfaction of socially desirable needs, i.e. needs that are compatible with long run public welfare. Such need satisfaction will tend to bring about improvements in the quality of private and public life. Corporate planning should thus facilitate the performance of business activities designed to achieve the satisfaction of socially desirable needs.The determination of what are socially (...) desirable needs will be based on public consensus, which corporations can periodically assess, and incorporate into their long range plans. A long-range planning procedure, incorporating social welfare considerations is developed. It is suggested that a planning procedure such as this is essential for the existence of firms in the long run. (shrink)

In previous work, I have argued that subjectivists about well-being must turn from a preference-satisfaction to a desire-satisfaction theory of well-being in order to avoid the conceptual problem of interpersonal comparisons of well-being. In a recent paper, Van der Deijl and Brouwer agree, but object that no version of the desire-satisfaction theory can provide a plausible account of how an individual's degree of well-being depends on the satisfaction or frustration of their various desires, at least in cases involving the gain (...) or loss of desires. So subjectivists can avoid the conceptual problem of interpersonal comparisons only by adopting a substantively implausible view. In this reply, I defend subjectivism by arguing that the totalist desire-satisfaction theory avoids Van der Deijl and Brouwer's objections, and briefly suggest that it may also be able to handle the problem of adaptive desires. I conclude that subjectivists should endorse the totalist desire-satisfaction theory. (shrink)

Hobbes believed that the state of nature would be a war of all against all. Locke denied this, but acknowledged that in the absence of government, peace is insecure. In this paper, I analyse both accounts of the state of nature through the lens of classical and experimental game theory, drawing especially on evidence concerning the effects of punishment in public goods games. My analysis suggests that we need government not to keep wicked or relentlessly self-interested individuals in line, but (...) rather to maintain peace among those who disagree about morality. Ideology critics believe that many bad social practices persist because of ideology, and that critiquing ideology is an effective way to promote social reform. Skeptics draw on game theory to argue that the persistence of such practices is better explained by collective action problems, and that ideology critique is causally inefficacious. In this paper, I reconcile these camps. I show that while game theory can help us identify contexts where ideology critique makes no difference, it also reveals causal mechanisms by (...) which ideology critique can have a significant effect. Artificial intelligence (AI) holds considerable promise for transforming clinical diagnostics. While much has been written both about public attitudes toward the use of AI tools in medicine and about uncertainty regarding legal liability that may be delaying its adoption, the interface of these two issues has so far drawn less attention. However, understanding this interface is essential to determining how jury behaviour is likely to influence adoption of AI by physicians. One distinctive concern identified in this paper is a ‘negative (...) outcome penalty paradox’ (NOPP) in which physicians risk being penalised by juries in cases with negative outcomes, whether they overrule AI determinations or accept them. The paper notes three reasons why AI in medicine is uniquely susceptible to the NOPP and urges serious further consideration of this complex dilemma. (shrink)

A speaker wishes to persuade a listener to take a certain action. The conditions under which the request is justified, from the listener’s point of view, depend on the state of the world, which is known only to the speaker. Each state is characterized by a set of statements from which the speaker chooses. A persuasion rule specifies which statements the listener finds persuasive. We study persuasion rules that maximize the probability that the listener accepts the request if and only (...) if it is justified, given that the speaker maximizes the probability that his request is accepted. We prove that there always exists a persuasion rule involving no randomization and that all optimal persuasion rules are ex-post optimal. We relate our analysis to the field of pragmatics. (shrink)

In response to the continued expansion of “red flag” laws allowing broader classes of people to petition a court for the removal of firearms from individuals who exhibit dangerous conduct, this paper argues that state laws should adopt a double-filter provision that balances individual rights and government public safety interests. The main component of such a provision is a special statutory category — “reporting party” — that enables a broader social network, such as co-workers or school administrators, to request that (...) a law enforcement officer file a petition for an Extreme Risk Protection Order. A double-filter provision would not give reporting parties a right to file a court petition directly. Instead, parties would file a request for petition with law enforcement officers, who must seek an ERPO from the court if they find the reporting party's information credible. That information is then transmitted to the court as a sworn affidavit of the reporting party. The goal is to facilitate a balanced policy model that widens the reporting circle in order to feed more potentially life-saving information into the system, mitigates the risk of erroneous deprivation of constitutionally protected due process and Second Amendment rights. The integrity of the patient–physician relationship depends on maintaining professional boundaries. While ethicists and professional organisations have devoted significant consideration to the subject of sexual boundary transgressions, the subject of non-sexual boundaries, especially outside the mental health setting, has been largely neglected. While professional organisations may offer guidance on specific subjects, such as accepting gifts or treating relatives, as well as general guidance on transparency and conflict of interest, what is missing is a principle-based method that providers can use to (...) assess non-sexual interactions with patients that transcend norms of practice. This paper attempts to offer an operational model for such assessment that considers not only the traditional emphasis on beneficence, but also incorporates concerns over entanglement and concordance. Zusammenfassung Der Aufsatz untersucht die „Horizontalität“ bzw. „Vertikalität“ des Themas „Sport“ im EG/eu-prozess der letzten dreißig Jahre. Die Unterscheidung Horizontalität/vertikalität bezieht sich hierbei auf interne Strukturen der Union und nicht auf das Verhältnis Union/mitgliedstaaten. Anhand genereller Entwicklungslinien wird gefragt, ob Sport ein horizontales Thema darstellt, das in andere Themenfelder eingreift, oder aber ein eigenständiges, vertikales Thema ist. Der Beitrag kommt zu dem Schluss, dass die Realität nach wie vor eine Mischung aus Horizontalität und Vertikalität ist, dass aber das Prinzip der (...) Vertikalität verstärkt wurde. Es wird auch klar, dass die Rechtsprechung als Motor der Entwicklung eine herausragende Rolle spielte. (shrink)
