A new approach to sentencing Not Just Deserts inaugurates a radical shift in the research agenda of criminology. The authors attack currently fashionable retributivist theories of punishment, arguing that the criminal justice system is so integrated that sentencing policy has to be considered in the system-wide context. They offer a comprehensive theory of criminal justice which draws on a philosophical view of the good and the right, and which points the way to practical intervention in the real world of incremental (...) reform. Within contemporary penal philosophy, the view that punishment can only be justified if the offender is a moral agent who is responsible and hence blameworthy for their offence is one of the few areas on which a consensus prevails. In recent literature, this precept is associated with the retributive tradition, in the modern form of ‘just deserts’. Turning its back on the rehabilitative ideal, this tradition forges a strong association between the justification of punishment, the attribution of responsible agency in (...) relation to the offence, and the appropriateness of blame. By contrast, effective clinical treatment of disorders of agency employs a conceptual framework in which ideas of responsibility and blameworthiness are clearly separated from what we call ‘affective blame’: the range of hostile, negative attitudes and emotions that are typical human responses to criminal or immoral conduct. We argue that taking this clinical model of ‘responsibility without blame’ into the legal realm offers new possibilities. Theoretically, it allows for the reconciliation of the idea of ‘just deserts’ with a rehabilitative ideal in penal philosophy. Punishment can be reconceived as consequences—typically negative but occasionally not, so long as they are serious and appropriate to the crime and the context—imposed in response to, by reason of, and in proportion to responsibility and blameworthiness, but without the hard treatment and stigma typical of affective blame. Practically, it suggests how sentencing and punishment can better avoid affective blame and instead further rehabilitative and related ends, while yet serving the demands of justice. (shrink)

The capacity to attribute beliefs to others in order to understand action is one of the mainstays of human cognition. Yet it is debatable whether children attribute beliefs in the same way to all agents. In this paper, we present the results of a false-belief task concerning humans and God run with a sample of Maya children aged 4–7, and place them in the context of several psychological theories of cognitive development. Children were found to attribute beliefs in different ways (...) to humans and God. The evidence also speaks to the debate concerning the universality and uniformity of the development of folk-psychological reasoning. (shrink)

In a world that is overflowing with journals and other outlets for scientific publication, the appearance of any new periodical requires some justification. There are already more journals than we can read and more conferences than we can attend. In the case of applied Ontology, we believe that the creation of anew journal not only is completely justifiable, it is downright exciting. For too long, workers in computer science have assumed that content comes for free. “Theory” in computer science has (...) always meant the theory of processes and of computation. We measure the complexity of computer programs in terms of how long it takes machines to execute them, not in terms of how long it takes people to understand and to represent the data on which those programs might operate. We typically describe computer code in terms of algorithms that operate on formal parameters, often without pausing to discuss where the data that might satisfy those parameters come from. This journal was founded on the premise that workers in computer science, informatics, and information science are overdue in paying as much attention to contents as they do to algorithms. (shrink)

Introduction Numerous guidelines and policies for ethical research practice have evolved over time, how this translates to global health practice in resource-constrained settings is unclear. The purpose of this paper is to describe how the concept of ancillary care has evolved over time and how it is included in the ethics guidelines and policy documents that guide the conduct of research in the global south with both an international focus and providing a specific example of Malawi, where the first author (...) lives and works, as a case study. Methods Discourse analysis was conducted on 34 international ethics guidelines and policy documents. Documents were purposively selected if they contained a set of key terms that reflect the concept of ancillary care. Following a process of inductive discourse analysis, five key interrelated text phrases relating to ancillary care were extracted from the documents. The evolution of these phrases over time was explored as they represented the development of the concept of ancillary care as a component of ethical health research guidance and practice. Results We found key interrelated phrases that represent discourses regarding the evolution of ancillary care including participant protection; provide care as appropriate; supererogation; patient needs prevail over science; and ancillary care as an obligation. Arguments for the provision of ancillary care were characterised by safeguarding the safety, health rights and well-being of study participants. However, despite the evolution of discourse around ethical obligations to provide ancillary care, this is rarely made explicit within guidance documents, leaving interpretive space for differential application in practice. Conclusion While there have been major changes to the ethics guidance that reflect significant evolution in the ethical conduct of research, the specific vocabulary or language used to explain the ethics of researchers' ancillary care obligations to the health needs of their research participants, lacks clarity and consistency. As a result, the concept of ancillary care continues to be under-represented in local ethical guidelines and regulations, with no clear directives for country-level research ethics committees to apply in regulating ancillary care responsibilities. In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. We define and investigate Heyting-valued interpretations for Constructive Zermelo–Frankel set theory . These interpretations provide models for CZF that are analogous to Boolean-valued models for ZF and to Heyting-valued models for IZF. Heyting-valued interpretations are defined here using set-generated frames and formal topologies. As applications of Heyting-valued interpretations, we present a relative consistency result and an independence proof.

Has the time come to put to bed the concept of a harm threshold when discussing the ethics of reproductive decision making and the legal limits that should be placed upon it? In this commentary, we defend the claim that there exist good moral reasons, despite the conclusions of the non-identity problem, based on the interests of those we might create, to refrain from bringing to birth individuals whose lives are often described in the philosophical literature as ‘less than worth (...) living’. This paper takes part in the methodological debate concerning the nature and the justification of hypotheses about computational systems in software engineering by providing an epistemological analysis of Software Testing, the practice of observing the programs’ executions to examine whether they fulfil software requirements. Property specifications articulating such requirements are shown to involve falsifiable hypotheses about software systems that are evaluated by means of tests which are likely to falsify those hypotheses. Software Reliability metrics, used to measure the growth of (...) probability that given failures will occur at specified times as new executions are observed, is shown to involve a Bayesian confirmation of falsifiable hypotheses on programs. Coverage criteria, used to select those input values with which the system under test is to be launched, are understood as theory-laden principles guiding software tests, here compared to scientific experiments. Redundant computations, fault seeding models and formal methods used in software engineering to evaluate test results are taken to be instantiations of some epistemological strategies used in scientific experiments to distinguish between valid and non-valid experimental outcomes. The final part of the paper explores the problem, advanced in the context of the philosophy of technology, of defining the epistemological status of software engineering by conceiving it as a scientifically attested technology. A common view is that self-identity is essential to objects if anything is. Itself a substantive metaphysical view, this is a position of some import in wider debates, particularly in connection with such problems as physicalism and personal identity. I distinguish between two accounts of essence, the modal and the definitional, and argue that self-identity is essential to objects on the former but not on the latter. This book investigates the relation between Durkheim’s sociology, Critical Theory, and the philosophy of social sciences. The book is organized in four sections: confronting Durkheim and other critical traditions; inquiring his social and critical ontology; interrogating the relation between social practices and justice; and discussing his relevance in contemporary politics and political theory. An international group of philosophers, sociologists, and critical theorists contribute to show Durkheim’s reflection as an important complement—or an alternative—to the Hegelian-Marxist and post-structuralist conceptions of social critique. The aim of this paper is to analyse the effects on the everyday world of actual Augmented Reality games which introduce digital objects in our surroundings from a phenomenological point of view. Augmented Reality is a new technology aiming to merge digital and real objects, and it is becoming pervasively used thanks to the application for mobile devices Pokémon Go by Niantic. We will study this game and other similar applications to shed light on their possible effects on our lives (...) and on our everyday world from a phenomenological perspective. In the first part, we will show how these digital objects are visualised as merged in the surroundings. We will point out that even if they are visualised as part of the everyday world, they are not part of it because they are still related to the fictional world generated by the game. In the second part, we will show how the existence of these objects in their fictional world has effects on the everyday world where everybody lives. The goal of Augmented Reality is not reached yet because these objects are not part of the everyday world, but it already makes our lives embedded with digital elements. We will show if these new objects have effects on our world and on how we live our lives. (shrink)

The aim of this work is to analyze the constitution of a new collective subject thanks to wearable computers. Wearable computers are emerging technologies which are supposed to become pervasively used in the near future. They are devices designed to be on us every single moment of our life and to capture every experience we have. Therefore, we need to be prepared to such intrusive devices and to analyze potential effect they will have on us and our society. Thanks to (...) a phenomenological and postphenomenological analysis, we will show how these technologies are able to generate a new collective subject with its different collective needs and appetites by merging the living body of many subjects into one. Model checking, a prominent formal method used to predict and explain the behaviour of software and hardware systems, is examined on the basis of reflective work in the philosophy of science concerning the ontology of scientific theories and model-based reasoning. The empirical theories of computational systems that model checking techniques enable one to build are identified, in the light of the semantic conception of scientific theories, with families of models that are interconnected by simulation relations. And the mappings between these (...) scientific theories and computational systems in their scope are analyzed in terms of suitable specializations of the notions of model of experiment and model of data. Furthermore, the extensively mechanized character of model-based reasoning in model checking is highlighted by a comparison with proof procedures adopted by other formal methods in computer science. Finally, potential epistemic benefits flowing from the application of model checking in other areas of scientific inquiry are emphasized in the context of computer simulation studies of biological information processing. Dignity plays a crucial role as both a fundamental value and as an end state in the process of humanizing organizational cultures, workplaces and relationships. However, despite its significance, it has yet to be addressed properly in the growing discourse on humanistic capitalism and management, and indeed in business ethics as a whole. Questions concerning the epistemological status of computer science are, in this paper, answered from the point of view of the formal verification framework. State space reduction techniques adopted to simplify computational models in model checking are analysed in terms of Aristotelian abstractions and Galilean idealizations characterizing the inquiry of empirical systems. Methodological considerations drawn here are employed to argue in favour of the scientific understanding of computer science as a discipline. Specifically, reduced models gained by Dataion are acknowledged as Aristotelian (...) abstractions that include only data which are sufficient to examine the interested executions. The present study highlights how the need to maximize incompatible properties is at the basis of both Abstraction Refinement, the process of generating a cascade of computational models to achieve a balance between simplicity and informativeness, and the Multiple Model Idealization approach in biology. Finally, fairness constraints, imposed to computational models to allow fair behaviours only, are defined as ceteris paribus conditions under which temporal formulas, formalizing software requirements, acquire the status of law-like statements about the software systems executions. In this paper the importance of public affairs management in multinational corporations in India will be examined. After briefly discussing the state of the art in international business and society literature, a conceptual framework for public affairs management in multinational corporations will be developed. This framework serves as the theoretical basis for an empirical study among German multinational corporations in India. Ackrill’s Problem is a tension between Aristotle’s alleged view that the matter of a living being is a body that is essentially ensouled, and his view that the matter of a substance preexists its generation. Most interpreters solve the tension by claiming that the subject of substantial generation is not the organic body of the living being, but its non-organic matter. We understand responsible leadership as a social-relational and ethical phenomenon, which occurs in social processes of interaction. While the prevailing leadership literature has for the most part focussed on the relationship between leaders and followers in the organization and defined followers as subordinates, we show in this article that leadership takes place in interaction with a multitude of followers as stakeholders inside and outside the corporation. Using an ethical lens, we discuss leadership responsibilities in a stakeholder society, thereby following Bass (...) and Steidelmeier’s suggestion to discuss “leadership in the context of contemporary stakeholder theory” (1999: 200). Moreover, from a relational and stakeholder perspective we approach the questions: What is responsible leadership? What makes a responsible leader? What qualities are needed? Finally, we propose a so-called “roles model” of responsible leadership, which gives a gestalt to a responsible leader and describes the different roles he or she takes in leading stakeholders and business in society. After being discussed in 1929 with Husserl as referent and Heidegger as co-referent, Eugen Fink’s Dissertation “Vergegenwärtigung und Bild” has been published in 1930 on the “Jahrbuch für Philosophie und phänomenologische Forschung”. In his study, Fink works out a careful and methodic inquiry of basic notions of Husserlian thought regarding the time-consciousness. The paper analyzes the main theses of Dissertation, paying particular attention to the fist and wider part devoted to presentification, a concept that means all mental processes, which make (...) present what belongs to the sphere of the past, the future, or the possible: memory, expectation, imagination, and dream. Through a comparison with the investigations that Husserl himself addressed to the topic of not-presence and unreality, we aim at casting light on the radical detailed analyses introduced by Fink, with special focus on the original changes concerning the phenomenological status of dreaming. Die Suche nach historischen Quellen für die Leibniz’sche Philosophie scheint zunächst unerschöpflich. Durch alle in diesem Band versammelten Arbeiten wird der Einfluss der Philosophie des Aristoteles auf das Leibniz’sche Denken näher umrissen. Ein wesentliches Ziel ist es hierbei, einen Beitrag zur Analyse dieser philosophischen Beziehung zu leisten und zu zeigen, dass auch Aristoteles’ Philosophie nach Ansicht unserer Autoren entscheidend zum Verständnis des Leibniz’schen Denkens beiträgt. Die Texte befassen sich mit wesentlichen Themen der Leibniz’schen Logik und Metaphysik, z. B. mit den (...) Grundbegriffen „Monade“ (und deren „Körperhaftigkeit“), „Entelechie“, „Nous“, mit dem Problem der Individuation (Individuum, Atomismus, Einheit), mit den substanziellen Formen, mit der Wissenschaft im Allgemeinen und der Technik, mit der Transformation der Logik, mit den Prinzipien (nämlich denjenigen des zureichenden Grundes, der Individuation und der Notwendigkeit), mit Zukunft und Kontingenz sowie Vergänglichkeit, mit der Theorie der syllogistischen Folgerung, usw. The search for the historical sources of Leibniz’s philosphy initially seems to be unending. All the essays in this volume outline more clearly the influence of Aristotle’s philosophy on Leibniz’s thought. In this context a fundamental aim is to contribute to the analysis of this philosophical relationship and to demonstrate that Aristotle’s philosophy, in the opinion of our authors, plays a decisive role in the understanding of Leibniz’s thought. The texts address fundamental themes of Leibniz’s logic and metaphysics, e.g. the basic concepts of ‘monads’ (and their ‘corporality’), ‘entelechy’ and ‘nous; the problem of individuation (individual, atomism, unity); substantial forms; knowledge in general, and technology; the transformation of logic; principles (namely those of sufficient grounds, of individuation and of necesssity); future and contingency and transientness; the theory of syllogistic deduction, etc. These themes are regularly considered in the comparison between Leibniz and Aristotle – they demonstrate how Leibniz took over, treated or criticised Aristotelian theses. Testimony is of epistemic and practical significance. It is of epistemic significance because majority of what we know and believe comes from being told. It is of practical significance because our agency can be undermined, bypassed, or overridden owing to systemic prejudices sustained by oppressive social or cultural practices and subsequently our routes to knowledge are either hindered or distorted. Things get more complicated when we introduce and examine how groups and other collectives testify and are recipients of testimony. For (...) instance, group speakers are typically said to represent and reflect the view of the group they are speaking on behalf of. But sometimes because of these oppressive practices, a group speaker’s assertion may deprive or impair its members’ ability to perform certain actions through speech. This dissertation examines the intersection between testimony, collective phenomena, and epistemic harms. One aim is to argue for a view on the nature of testimony that can accommodate various ways collectives testify and are recipients of testimony. In particular, I argue and present a view of testimony as a norm-governed joint activity involving individual or collective participants that commit themselves to a common aim of collaboration. Another aim is to present an epistemology of testimony that tracks our ordinary testimonial practices. In this regard, I argue for a norm view where we have reason to believe what we’re told because of the rules or norms that govern our communicative exchanges. A final aim is to explore the mechanism by which collective speech ensues in an epistemic harm driven by social identity prejudices. I argue for a form of silencing that is distinctive of groups insofar as the silencing occurs because of group dynamics. I call the mechanism underlying this form of silencing “representational impairment”. This dissertation, I hope, will motivate and inspire others to pursue philosophical projects at these intersections and in this spirit, I end by offering suggestions on areas of further development and future direction. The problem of artificial intelligence and human being has always raised questions about possible interactions among them and possible effects yielded by the introduction of such un-human subject. Dreyfus deeply connects intelligence and body based on a phenomenological viewpoint. Thanks to his reading of Merleau-Ponty, he clearly stated that an intelligence must be embodied into a body to function. According to his suggestion, any AI designed to be human-like is doom to failure if there is no tight bound with a (...) human-like body. Today, we are facing the pervasive introduction of robots into our everyday life, and the problem of this co-existence raises again with new vigor since they are not mere speculations, but there are already products sold to the public. We will highlight how vulnerability has to be taken into consideration in the design of robots to create entities which are able to relate to human beings taking into consideration mainly the positions of Sartre, Habermas, Levinas, and Marleau-Ponty. A first part will focus on the vulnerability of the robots. Robots are going to be among us, but a real interaction is possible only the moment they have a “same” body of ours. Therefore, only through the realization of a “fragile” body we can achieve a cohabitation between equals. Thanks to Merleau-Ponty we will show how the vulnerability of a body is one of the most important element to found any social interaction. The second part will focus on how the robots will affect the vulnerability of the human subjects. To produce vulnerable robots is not a mere neutral introduction, but it shapes how the subjects are constituted. Thanks to Levinas, we will study how the vulnerable robots will shape the subjects. Thanks to Sartre, we will show how the creation of a different gaze in the robot changes the vulnerabilities of the human subjects. Introducing vulnerable robots is a way to shape ourselves. This article is a critical and appreciative interaction with Christopher Southgate's theodicy and theology of glory. I critique in particular his rejection of all dualist moves in theodicy. I question why Southgate can ascribe evil to some human actions, many of which are automatic and unconscious, but not to any other level or form of consciousness. I argue that he may rely too heavily on rational scientific categories, which are not sufficient in themselves to carry the weight of key theological (...) concepts. His use of poetry is powerful and suggestive, but in the end, he may not give it enough epistemic weight. (shrink)

In this work we propose a labelled tableau method for Łukasiewicz infinite-valued logic Lω. The method is based on the Kripke semantics of this logic developed by Urquhart [25] and Scott [24]. On the one hand, our method falls under the general paradigm of labelled deduction [8] and it is rather close to the tableau systems for sub-structural logics proposed in [4]. On the other hand, it provides a CoNP decision procedure for Lω validity by reducing the check of branch (...) closure to linear programming. (shrink)
