The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

In an ideal democracy, people from all walks of life would come together to talk meaningfully and respectfully about politics. But we do not live in an ideal democracy. In contemporary democracies, which are marked by deep social divisions, different groups for the most part avoid talking to each other. And when they do talk to each other, their speech often seems to be little more than a vehicle for rage, hatred, and deception. -/- Democratic Speech in Divided Times argues (...) that we should nevertheless not give up on the ideal of democratic public speech. Drawing on the resources of political theory, epistemology, and philosophy of language, this book develops a sustained account of the norms that should govern public discourse in deeply divided circumstances. Should we try to find common ground when we talk to our political opponents, even though they seem unreasonable? Should we refrain from expressing anger, if we want to get things done? How can we use our speech to fight hate speech and disinformation? And is it even possible to speak to 'the other side,' in settings where different groups dislike one another, live apart from one another, and don't know much about one another? By tackling these questions, Lepoutre demonstrates that, when governed by the right set of norms, public speech can be a powerful force for good even amidst profound social divisions. (shrink)

We investigate the role of continuous reductions and continuous relativization in the context of higher randomness. We define a higher analogue of Turing reducibility and show that it interacts well with higher randomness, for example with respect to van Lambalgen’s theorem and the Miller–Yu/Levin theorem. We study lowness for continuous relativization of randomness, and show the equivalence of the higher analogues of the different characterizations of lowness for Martin-Löf randomness. We also characterize computing higher [Formula: see text]-trivial sets by higher (...) random sequences. We give a separation between higher notions of randomness, in particular between higher weak 2-randomness and [Formula: see text]-randomness. To do so we investigate classes of functions computable from Kleene’s [Formula: see text] based on strong forms of the higher limit lemma. (shrink)

If lay theories associate moral intuitions with deeply held values, people should feel uncomfortable relying on deliberative thinking when judging violations of personal taboos. In two preliminary studies, participants with siblings of the opposite sex were particularly troubled when evaluating a sibling incest scenario under instructions to think slowly and rationally, or when the scenario was presented in a hard-to-read font forcing them to employ deliberative processing. This suggests that we may be intuitive intuitionists, and opens the door for investigations (...) of people’s preferred modes of moral judgment. (shrink)

Faced with hate speech, oppressed groups can use their own speech to respond to their verbal oppressors. This “counterspeech,” however, sometimes itself takes on a hateful form. This paper explores the moral standing of such “hateful counterspeech.” Is there a fundamental moral asymmetry between hateful counterspeech, and the hateful utterances of dominant or oppressive groups? Or are claims that such an asymmetry exists indefensible? I argue for an intermediate position. There _is_ a key moral asymmetry between these two forms of (...) speech. But, this asymmetry notwithstanding, hateful counterspeech is capable of enacting serious harms—and so, contrary to what many legal theorists have argued, it is in principle an appropriate object of legal regulation. I begin by considering the central argument for thinking that hateful counterspeech is not seriously troubling. This argument holds that oppressed groups lack authority—and, by extension, “speaker power.” Yet this argument, I suggest, sits in tension with the fact that low-status members of dominant groups can, through their utterances, seriously harm members of oppressed groups. Philosophers of language have developed sophisticated arguments to explain this last phenomenon: they have argued that speaker power is relativised to particular jurisdictions; that it can be acquired dynamically in local settings; and that it is socially dispersed. I argue that, in light of these arguments, it appears that hateful counterspeech, too, can generate serious harms. Nevertheless, I show that this conclusion is compatible with recognising a crucial moral asymmetry between hateful counterspeech and the hate speech of oppressors. (shrink)

There exist two main notions of typicality in computability theory, namely, Cohen genericity and randomness. In this article, we introduce a new notion of genericity, called partition genericity, which is at the intersection of these two notions of typicality, and show that many basis theorems apply to partition genericity. More precisely, we prove that every co-hyperimmune set and every Kurtz random is partition generic, and that every partition generic set admits weak infinite subsets, for various notions of weakness. In particular, (...) we answer a question of Kjos-Hanssen and Liu by showing that every Kurtz random admits an infinite subset which does not compute any set of positive effective Hausdorff dimension. Partition genericity is a partition regular notion, so these results imply many existing pigeonhole basis theorems. (shrink)

We study genericity and randomness with respect to ITTMs, continuing the work initiated by Carl and Schlicht. To do so, we develop a framework to study randomness in the constructible hierarchy. We then answer several of Carl and Schlicht’s question. We also ask a new question one the equality of two classes of randoms. Although the natural intuition would dictate that the two classes are distinct, we show that things are not as simple as they seem. In particular we show (...) that the categorical analogues of these two classes coincide, in contradiction with the natural intuition. Even though we are not able to answer the question for randomness in this article, we delineate and sharpen its contour and outline. (shrink)

A mass problem is a set of functions $\omega \to \omega $. For mass problems ${\mathcal {C}}, {\mathcal {D}}$, one says that ${\mathcal {C}}$ is Muchnik reducible to ${\mathcal {D}}$ if each function in ${\mathcal {C}}$ is computed by a function in ${\mathcal {D}}$. In this paper we study some highness properties of Turing oracles, which we view as mass problems. We compare them with respect to Muchnik reducibility and its uniform strengthening, Medvedev reducibility.For $p \in [0,1]$ let ${\mathcal {D}}$ (...) be the mass problem of infinite bit sequences y such that for each computable bit sequence x, the bit sequence $ x {\,\leftrightarrow\,} y$ has asymptotic lower density at most p = y$ ). We show that all members of this family of mass problems parameterized by a real p with $0 p$ for each computable set x. We prove that the Medvedev complexity of the mass problems ${\mathcal {B}}$ is the same for all $p \in $, by showing that they are Medvedev equivalent to the mass problem of functions bounded by ${2^{2}}^{n}$ that are almost everywhere different from each computable function.Next, together with Joseph Miller, we obtain a proper hierarchy of the mass problems of type $\text {IOE}$ : we show that for any order function g there exists a faster growing order function $h $ such that $\text {IOE}$ is strictly above $\text {IOE}$ in the sense of Muchnik reducibility.We study cardinal characteristics in the sense of set theory that are analogous to the highness properties above. For instance, ${\mathfrak {d}} $ is the least size of a set G of bit sequences such that for each bit sequence x there is a bit sequence y in G so that $\underline \rho >p$. A set of integers A is computably encodable if every infinite set of integers has an infinite subset computing A. By a result of Solovay, the computably encodable sets are exactly the hyperarithmetic ones. In this article, we extend this notion of computable encodability to subsets of the Baire space, and we characterize the Π10-encodable compact sets as those which admit a nonempty Σ11-subset. Thanks to this equivalence, we prove that weak weak König’s lemma is not strongly computably reducible to (...) Ramsey’s theorem. This answers a question of Hirschfeldt and Jockusch. (shrink)

Counterspeech is communication that tries to counteract potential harm brought about by other speech. Theoretical interest in counterspeech partly derives from a libertarian ideal – as captured in the claim that the solution to bad speech is more speech – and partly from a recognition that well-meaning attempts to counteract harm through speech can easily misfire or backfire. Here we survey recent work on the question of what makes counterspeech effective at remedying or preventing harm, in those cases where it (...) is effective, as well as work investigating when and why there is a duty to engage in counterspeech. We suggest that the most fruitful area for philosophical inquiry on this topic, currently, relates to the questions about efficacy. Specifically, we argue that there is a need for better frameworks for conceptualizing the efficacy of counterspeech. Philosophers have collaborative work to do, alongside social scientists, in developing these frameworks. (shrink)

Quantification has been constitutive of psychology since its inception and is core to its scientific status. The adoption of qualitative methods eschewing inferential statistics is therefore unlikely to obtain. Rather than discarding useful tools because of improper use, we recommend highlighting how inferential statistics can be more thoughtfully applied.

For Knobe, observers evaluate mental states by comparing agents' statements with the attitudes they are expected to hold. In our analysis, Knobe's model relies primarily on what agents should think, and little on expectancies of what they would think. We show the importance and complexity of including descriptive and prescriptive norms if one is to take expectancies seriously.

This article defends the democratic ideal of inclusive public discourse, as articulated in Democratic Speech in Divided Times, against the critiques offered by Billingham, Fraser, and Hannon. Specifically, it considers and responds to three core challenges. The first challenge argues, notably, that the “shared reasons” constraint should either apply everywhere or not at all, and that, if this constraint is to apply in divided circumstances, its justificatory constituency must be idealized. The second challenge contends that the resistance of hate speech (...) and misinformation to counterspeech cannot adequately be explained by considerations of salience, and therefore cannot adequately by countered (as I suggest) by “positive” forms of counterspeech. Finally, the last challenge objects that the ideal of inclusive public discourse I defend remains, as pessimists allege, excessively idealistic. (shrink)

During the Zimbabwean crisis, millions crossed through the apartheid-era border fence, searching for ways to make ends meet. Maxim Bolt explores the lives of Zimbabwean migrant labourers, of settled black farm workers and their dependants, and of white farmers and managers, as they intersect on the border between Zimbabwe and South Africa. Focusing on one farm, this book investigates the role of a hub of wage labour in a place of crisis. A close ethnographic study, it addresses the complex, (...) shifting labour and life conditions in northern South Africa's agricultural borderlands. Underlying these challenges are the Zimbabwean political and economic crisis of the 2000s and the intensified pressures on commercial agriculture in South Africa following market liberalization and post-apartheid land reform. But, amidst uncertainty, farmers and farm workers strive for stability. The farms on South Africa's margins are centers of gravity, islands of residential labour in a sea of informal arrangements. This present book explores recent advances in modeling discourse processes, in particular, new approaches aimed at understanding pathological language behavior specific to schizophrenia. The contributors examine the modeling paradigm of formal semantics, which falls within the scope of both linguistics and logic while providing overlapping links with other fields such as philosophy of language and cognitive psychology. This book is based on results presented during the series of workshops on Coherence and Discourse organized by SLAM, a project developed to systemize (...) the study of pathological language processing by taking an overarching interdisciplinary approach combining psychology, linguistics, computer science and philosophy. Without denying this claim, I contend that it fails to establish that bans, rather than counterspeech, are the appropriate response. By articulating a more refined understanding of counterspeech, I suggest that counterspeech constitutes a better way of blocking hate speech’s dignitarian harm. In turn, I address two objections: according to the first, which draws on contemporary philosophy of language, counterspeech does not block enough (...) hate speech; according to the second, counterspeech blocks too much speech. Although these objections should qualify our optimism regarding counterspeech, I demonstrate that each can be turned, with even greater force, against hate speech bans. (shrink)

The notions of perceptual normativity and optimality have generated much discussion in the last decade or so in the literature on Merleau-Ponty. Husserl’s position on the topic has been far less extensively investigated. Surprisingly, however, Husserl wrote a great deal about the question of perceptual optimality. Not only are there a considerable number of important passages scattered throughout the manuscripts, the archive also contains a few important full texts on precisely this issue. Given the role of fulfillment for Husserl’s concept (...) of intentionality, this should not really come as a surprise, since the teleological nature of the fulfillment structure terminates in an experience of the optimum. Hence, however marginal this topic might seem at first glance, reflecting on it rapidly leads us to the heart of Husserl’s project and sheds further light on his conception of intentional experience. According to an influential objection, which Martha Nussbaum has powerfully restated, expressing anger in democratic public discourse is counterproductive from the standpoint of justice. To resist this challenge, this article articulates a crucial yet underappreciated sense in which angry discourse is epistemically productive. Drawing on recent developments in the philosophy of emotion, which emphasize the distinctive phenomenology of emotion, I argue that conveying anger to one’s listeners is epistemically valuable in two respects: first, it can direct listeners’ attention to elusive (...) morally relevant features of the situation; second, it enables them to register injustices that their existing evaluative categories are not yet suited to capturing. Thus, when employed skillfully, angry speech promotes a greater understanding of existing injustices. An influential critique of anger holds that anger comes at an important epistemic cost. In particular, feeling angry typically makes risk less visible to us. This is anger’s ‘red mist.’ These epistemic costs, critics suggest, arguably outweigh the epistemic benefits commonly ascribed to anger. This essay argues that the epistemic critique of anger is importantly misleading. This is not because it underestimates anger’s epistemic benefits, but rather because it overlooks the fact that anger’s red mist performs a crucial moral function. (...) By concealing risk, the red mist helps protect the dignity and self-respect of those who live under severe and unchosen risk. This function is vitally important in non-ideal circumstances, where many are unjustly subjected to dignity-impairing risk. And it is irreplaceable, in that it cannot readily be performed by other political emotions, such as hope. Beyond providing a novel defence of anger, this argument has a broader upshot. Anger’s red mist reveals that ignorance is not always problematic in politics. Accordingly, it should not be treated—as has standardly been the case—as an unmitigated political evil. In the first instance, our efforts are better spent ascertaining when ignorance is a problem, and when, instead, it performs a felicitous function. (shrink)

Par l’obscène exhibition de la mort, l’ultime (...) tabou de la société occidentale, il brise les limites de la condition humaine : celles de la conscience, de la vie, de la civilisation. Dire toute la vérité et rien que la vérité. Vivre dans la transparence et la franchise. Ces préceptes, les chantres du vrai ont voulu les appliquer de force à ce que tout nous désigne comme une forme retorse du mensonge : la littérature. Quelle est la légitimité de cette posture? N'est-on pas amené à la suspecter, à en reconnaître la fragilité et les impasses? Car, examinant l'inlassable guerre qui a opposé les tenants de la sincérité (Rousseau, Leiris, Sartre) à leurs (...) détracteurs (Molière, Laclos, Dostoïevski, Gary, Perec), on aperçoit se profiler une autre définition de ce qu'est la littérature. En toute mauvaise foi : ne serait-ce donc pas ainsi que les oeuvres se présentent à nous et se jouent de nous? C'est-à-dire en s'inscrivant dans une structure qui n'est ni le mensonge ni la vérité, mais leur mélange incertain. Qui affirme en niant et qui dément en proclamant. Sommes-nous pourtant prêts à accepter que tout discours échappe à ce qu'il est tout en continuant de l'être, à admettre que la littérature ne produise qu'une vérité, parfois contradictoire, et non la vérité? Percevoir la manière dont l'oeuvre pose la mauvaise foi, la suscite et la défie, c'est approcher ce qui constitue sa matière même, tant le moteur de ses intrigues que sa métaphysique implicite ou explicite. Mais c'est aussi repenser son rapport au lecteur, au réel et au savoir. Car il y a un paradoxe commun au menteur et au sincère que seule la mauvaise foi permet de décrire en s'arrachant à nos routines intellectuelles. (shrink)

Ignorant speech, which spreads falsehoods about people and policies, is pervasive in public discourse. A popular response to this problem recommends countering ignorant speech with more speech, rather than legal regulations. However, Mary Kate McGowan has influentially argued that this ‘counterspeech’ response is flawed, as it overlooks the asymmetric pliability of conversational norms: the phenomenon whereby some conversational norms are easier to enact than subsequently to reverse. After demonstrating that this conversational ‘stickiness’ is an even broader concern for counterspeech than (...) McGowan suggests—it applies not just to oppressive or hateful speech, but also to ordinary policy-related misinformation—I argue that a more sophisticated account of counterspeech can nevertheless overcome it. First, the stickiness objection overlooks the distinction between ‘negative’ and ‘positive’ counterspeech. Instead of directly negating a distorted proposition, positive counterspeech affirms a correct proposition that is inconsistent with the falsehoods at hand. This, I contend, allows it to counter ignorant speech without triggering the properties that render it sticky. Second, the stickiness objection presupposes an unrefined conception of counterspeech’s temporality. Counterspeech should be understood as a diachronic process, which not only follows, but also pre-empts, ignorant utterances. Drawing on speech-act theories of silencing, I argue that pre-emptive counterspeech can condition the conversational context so as to prevent subsequent ignorant utterances from enacting sticky conversational norms. Thus, this theoretically-refined conception of counterspeech helps appreciate how verbal responses might overcome the stickiness of conversational norms; and, in doing so, it reveals that this stickiness need not provide reasons to prefer legal remedies to counterspeech. Public opinion research has shown that voters accept many falsehoods about politics. This observation is widely considered troubling for democracy—and especially participatory ideals of democracy. I argue that this influential narrative is nevertheless flawed, because it misunderstands the nature of political understanding. Drawing on philosophical examinations of scientific modelling, I demonstrate that accepting falsehoods within one’s model of political reality is compatible with—and indeed can positively enhance—one’s understanding of that reality. Thus, the observation that voters accept many political falsehoods does (...) not necessarily establish that they lack political understanding. I then address three worries: that voters cannot generally engage in such political modelling; that political modelling obscures facts that are crucial to political understanding; and that successful political modelling would require knowing that one’s model contains falsehoods. My responses reveal how, going forward, we should measure political ignorance; and they highlight the standing importance of participatory democracy. (shrink)

La réponse offerte ici passe par un déplacement de la discussion vers l'éthique. Exode donc hors du lieu habituel pour aborder la question. Exode hors de la dogmatique ou de la théologie fondamentale car, là, il y va de connaissance, d'appartenance fidèle, de théologalité. Mais comment déthéologaliser la religion sans la déthéologiser? Comment la (...) penser autrement que comme une expérience humaine du divin, de l'Absolu ou de l'Ultime réel? Le déplacement proposé table moins sur les registres cognitifs ou affectifs investis par les recherches sur le phénomène religieux ou l'option herméneutique du pluralisme religieux que sur un registre de l'agir ou d'une posture éthique marquée d'actes et de paroles. Comment faire travailler la notion de religion en théologie autrement qu'à partir de l'identité, de la mémoire et plus à partir de l'estime de soi? Au moyen d'une lecture du traitement de la vertu de religio et des vices s'y opposant dans la Summa theologice de Thomas d'Aquin. A partir de ce travail de lecture, une structure formelle heuristique de la religion est reconstituée dans la différence et les rapports entre religio, superstitio et irreligiositas. Une catégorie lentement élaborée, " instance éthique advenant en posture subjective ", sous-tend cette diffraction heuristique : sur une " scène de la béatitude ", l'advenir de l'instance éthique se joue dans l'inscription désirée, choisie, réitérée et énoncée pour elle-même d'un mouvement en-vers Dieu. Pour produire ce chemin de réflexion, il aura fallu opérer et proposer une inscription contemporaine d'un discours thomasien dans le champ des discussions théologiques actuelles. (shrink)

The article presents the author's edition of the thematic focus and content of the design and research assignments. As a result of the study, the empirical method proved the effectiveness of the revealed pedagogical conditions on the process of forming the research independence of cadets of a military higher educational institution.
