The question whether a constitutive linguistic norm can be prescriptive is central to the debate on the normativity of meaning. Recently, the author has attempted to defend an affirmative answer, pointing to how speakers sporadically invoke constitutive linguistic norms in the service of linguistic calibration. Such invocations are clearly prescriptive. However, they are only appropriate if the invoked norms are applicable to the addressed speaker. But that can only be the case if the speaker herself generally accepts them. This qualification (...) has led critics to argue that if an addressed speaker’s acceptance is a necessary condition for legitimate prescriptions (and reproach for failure to adhere to them), then the account becomes unable to underwrite actual normativity. Moreover, critics argue, a danger of vicious circularity arises from the calibration account. This paper shows that once a vantage point within the calibration practice is accepted, the criticisms lose their force. It then explores why a theorist might reject such a perspective and suggests, as a plausible candidate, implicit Humean assumptions about the proper explanation of (linguistic) action. The paper ends by sketching a way forward for the debate on the normativity of meaning in light of this diagnosis. (shrink)

Definition of the problemStaff and patients in institutions of organized health care experience and express a variety of adverse conditions of these organizations. Within a theoretical framework of institutional pathology we can explain some of these “miserable conditions” as effects of the activities of organizations belonging to the political system (health policy) and to the economic system (health economy). Clinical ethics committees (CECs) cannot effectively handle such adversities or even address them properly. Standard organizational ethics can address them but cannot (...) handle them effectively.ArgumentsI propose to strengthen organizational ethics by a theory of institutional pathology. Basic nosological distinctions such as disease, illness and sickness, whose primary reference is to biological organisms and persons, can be analogically extended to socially constituted entities (e.g. hospitals) in terms of functional deficiency, miserable conditions, and need for reform of such entities. A very promising focus for analysis are organizational disorders of responsibility allocation. This group of institutional pathological disorders engenders, amongst other kinds of miserable conditions, specifically morally relevant miserable conditions.ConclusionThe institutional pathology paradigm, oriented to concrete institutions and organizations, can help “clinical” organizational ethics to considerably expand, in theoretical ethics as well as in ethically guided practice e.g. for members of CECs and organizational ethics advisors, the capacities for observing, evaluating and, if necessary, amending disturbed relations of responsibility. Personal und Patienten in Einrichtungen organisierter Krankenbehandlung erfahren und bekunden vielfältige miserable Zustände dieser Organisationen. Einige „Miseren“ lassen sich im Rahmen einer Theorie institutioneller Pathologien als störende Auswirkungen der Aktivitäten und Strukturen von Organisationen des Politiksystems und des Wirtschaftssystems erklären. Deshalb können Klinische Ethik-Komitees solchen Miseren nicht wirksam begegnen oder sie sogar nicht einmal thematisieren. Organisationsethik kann sie thematisieren, aber ihnen nicht wirksam begegnen. Vorgeschlagen wird die Verstärkung von Organisationethik durch eine Theorie institutioneller Pathologie. Institutionspathologisch aufgeklärte, „klinische“ Organisationsethik kann helfen, (...) in Ethiktheorie und Praxis, etwa für Mitglieder von KEKs und Organisationethikberater, die Möglichkeiten der Beobachtung, Bewertung und ggf. Human and animal interests are often in conflict. In many situations, however, it is unclear how to evaluate and weigh competing human and animal interests, as the satisfaction of the interests of one group often inevitably occurs at the expense of those of the other group. Human-animal conflicts of this kind give rise to ethical questions. If animals count morally for their own sake, then we must ask in which cases the satisfaction or frustration of the interests of humans and (...) animals in conflict situations is justified or unjustified from an ethical perspective. In this article, we argue that limited aggregation accounts represent a promising means for resolving interspecies conflicts. The reason for this is that they can appropriately consider the qualitative relevance of interests, their relative importance to each other, and the number of individuals affected. For our argument, we start from the premise that animals count morally for their own sake, albeit to a lesser extent than humans. That is, we accept the view that animals may be used, for example, as a source of food or in animal research. However, as we will show, many basic interests of animals are sufficiently similar to human interests and can thus be compared to them. Hence, they ought to be aggregated in cases of conflict with human interests. We illustrate our account and its practical implications with the real-world example of a human-animal conflict during the outbreak of a zoonotic disease among farmed animals. We conclude that, in many cases, animal interests ought to be given more importance than they currently receive, which includes distributing the burdens and risks of farming practices more fairly. Wir möchten der Charter on Medical Professionalism, die wir für vorbildlich halten, eine durchdachte Anreicherung hinzufügen. Wir beginnen mit einer skeptischen Note gegen das verbreitete theoretische Vorurteil, die wichtigsten Probleme im Gesundheitssystem seien Gerechtigkeitsprobleme und diese seien theoretisch gut beherrschbar. Unter Bezug auf Norman Daniels, der John Rawls’ Theorie der politischen Gerechtigkeit auf die Bewertung und Gestaltung von Gesundheitssystemen anwendet, sowie auf die biomedizinische Ethik, die von Beauchamp und Childress vertreten wird, analysieren wir das komplexe Verhältnis zwischen moralischer Integrität von (...) Strukturen und Organisationen einerseits und natürlichen Personen, die in ihnen arbeiten, andererseits. Anschließend interpretieren wir die Charta als eine Spezifizierung der ärztlichen professionsmoralischen Verantwortung auf mehreren Ebenen, die Tugend- und Organisationsethik verklammern. (shrink)

In this article, we hypothesize that leaders who display group-oriented values (i.e., values that focus on the welfare of the group rather than on the self-interest of the leader) will be evaluated more positively by their followers than leaders who do not display group-oriented values. Importantly, we expected these effects to be more pronounced for leaders who are ingroup members (i.e., stemming from the same social group as their followers) than for leaders who are outgroup members (i.e., leaders stemming from (...) a different social group than their followers). We tested our hypotheses in two studies. Results of a field study (N = 95) showed the expected relationship between leaders’ group-oriented values and followers’ identification with their leaders. A scenario study (N = 137) replicated the results and extended it to followers’ endorsement of their leaders. Overall, these findings suggest that displaying group-oriented values pays off more for ingroup than for outgroup leaders. (shrink)

In this paper we ask whether approximation for abstract argumentation is useful in practice, and in particular whether reasoning with grounded semantics – which has polynomial runtime – is already an approximation approach sufficient for several practical purposes. While it is clear from theoretical results that reasoning with grounded semantics is different from, for example, skeptical reasoning with preferred semantics, we investigate how significant this difference is in actual argumentation frameworks. As it turns out, in many graphs models, reasoning with (...) grounded semantics actually approximates reasoning with other semantics almost perfectly. An algorithm for grounded reasoning is thus a conceptually simple approximation algorithm that not only does not need a learning phase – like recent approaches – but also approximates well – in practice – several decision problems associated to other semantics. Scholars have struggled with identifying the exact reasoning that leads to the list of human rights in Rawls's Law of Peoples. This essay argues that the list can best be explained by a reasoning based on the value of self-determination of peoples. At the same time, it argues that this reasoning still has serious difficulties. In particular, it is necessary to clarify whether human rights may always be enforced by coercive means against states that violate them. However, once this has (...) been clarified, the balance of reasons on which Rawls’s argument rests no longer indisputably supports his conclusion. (shrink)

This paper deals with the question whether some morally normative content is grounded in the dialogical practice that both Apel and Habermas call argumentative discourse, and if so how to demonstrate that it is so grounded. Apel (unlike Habermas) claims that discourse has rationally necessary conceptual presuppositions; that morally normative content is part of such presuppositions; and that this can be ascertained in transcendendal reflection, i.e. by a kind of transcendental argument. I argue that these claims can be charitably interpreted (...) but require clarifications of their key concepts, i.e. “discourse”, “validity claims”, “performative self-contradiction”, and “community of communication”. I argue that discourse as a practice of reason-sensitive agents who are communicatively connected via argumentation can be explained by its normatively constitutive aim, namely fixing the true values of our reasons; that the primary level of validity claims are claims concerning good reasons; that performative self-contradictions are pragmatic-cum-logical inconsistencies that we can know apriori to be incompatible with discourse’s constitutive aim; and finally, that competent discourse participants can know apriori that they would be performatively inconsistent if they flouted a moral kernel that is intrinsic in discourse. It is well-established that policy aiming to change individual consumption patterns for environmental or other ethical reasons faces a trade-off between effectiveness and public acceptance. The more ambitious a policy intervention is, the higher the likelihood of reactionary backlash; the higher the intervention’s public acceptance, the less bite it is likely to have. This paper proposes a package of interventions aiming for a substantial reduction of animal product consumption while circumventing the diagnosed trade-off. It couples stringent industry regulation, which lowers (...) output and raises prices, with a targeted universal income at a level which would allow typical households to maintain their animal product consumption even at the post-regulation price level. The change of opportunity costs of animal products, however, would induce a shift of consumption away from animal products while enhancing – rather than diminishing – consumer freedom and welfare. The policy package, which is further designed to cohere with traditional value orderings rather than relying exclusively on progressive concerns, is politically ambitious, but psychologically pragmatic. It constitutes an attempt to socialize the endeavour of bringing consumption patterns in line with ethical demands by empowering, rather than sanctioning, individuals, and relevant groups. (shrink)

Das Buch "Ethische Wirklichkeit" liefert eine Verteidigung von zwei Grundannahmen des ethischen Diskurses, die schon immer philosophischen Zweifeln ausgesetzt waren: erstens der Annahme der Wahrheitsfähigkeit ethischer Urteile, zweitens der Annahme der Vernünftigkeit der Befolgung angemessener ethischer Forderungen. Hauptbezugspunkte der Arbeit sind dabei Ludwig Wittgenstein und Robert Brandom. Mit ihnen wird gezeigt, dass die Bedeutung propositional gehaltvoller Ausdrücke auf der fundamentalen Ebene in ihren internen Beziehungen mit weiteren Ausdrücken sowie mit nichtsprachlichen Verrichtungen besteht. Mit dieser Idee wird nicht nur der ethische (...) Kognitivismus als eine unproblematische Position ausgewiesen. Zusammen mit interpretationstheoretischen Standardargumenten Wittgensteins und Donald Davidsons unterstützt die Idee zudem einen ethischen Objektivismus. Die notwendige Vernünftigkeit ethischen Handelns wird mit der These verteidigt, dass ethische Sätze im Wesentlichen dem Explizitmachen von Aspekten des geteilten Sprachspiels dienen. Das Ignorieren eines angemessenen ethischen Urteils bzw. das Nichtbefolgen einer angemessenen ethischen Forderung erscheint damit als ein Schritt über die Grenze der Intelligibilität hinaus. The primary objective of this anthology is to make intergenerational justice an issue for intercultural philosophy, and, conversely, to allow the latter to enrich the former. In times of large-scale environmental destabilization, fair- ness between generations is an urgent issue of justice across time, but it is also a global issue of justice across geographical and nation-state borders. This means that the future generations envisioned by the currently living also cross these borders. Thus, different philosophical cultures and traditions of thought (...) should converse to re ect on what is fair to future people. Within the context of his epochal distinction between the sphere of law and of morals, of iustum and honestum, Christian Thomasius introduces a further category of conduct rules, which relate to so-called decorum, to good and proper behavior. They teach the individual how to behave socially, and have a stabilizing effect on society. As Thomasius distinguishes between a natural-law oriented, and thus for all individuals equal, natural decorum and a decorum politicum, which is oriented toward actual practices and feudal order, (...) he seems to waver between stabilizing and challenging then current feudalism. This impression weakens if one realizes that although Thomasius, in contrast to Cicero, undertook to demoralize decorum, still he accepted Cicero's theory of social roles. In the context of the actor's own interests, decorum covers those areas of social regulation that are not included within positive law seen as a means of coercive command. It is here that decorum is interesting systematically.Im Kontext seiner historischen Trennung der Sphären des Rechts und der Moral, des Iustum vom Honestum, führt Christian Thomasius noch eine weitere Kategorie von Verhaltensregeln ein, die zum sog. Decorum gehören, zur Wohlanständigkeit, welche die Menschen lehrt, in der Gesellschaft voranzukommen und für die Gesellschaft stabilisierende Wirkung besitzt. Da Thomasius zwischen einem naturrechtsnahen und daher für alle Menschen gleichen natürlichen Decorum und einem an die faktischen Sitten und die ständische Ordnung angelehnten Decorum politicum unterscheidet, scheint er zwischen einer Stabilisierung und einer Infragestellung der Ständegesellschaft zu schwanken. Dieser Eindruck schwächt sich ab, wenn man bedenkt, daß Thomasius gegenüber Cicero zwar eine Entmoralisierung des Decorum vornimmt, jedoch dessen Lehre der sozialen Rollen aufgreift. Das Decorum erfaßt unter Rückgriff auf des Eigeninteresse der Akteure jenen Bereich sozialer Regulierung, der von dem als Zwangsbefehl gedeuteten positiven Recht nicht berücksichtigt wird. The article attempts to clarify the relationship between justifying ethical norms and applying them. The first part considers the role of philosophy within applied ethical contexts. The second part discusses the long tradition of comparing mathematics and ethics and recommends a method for the procedure to be followed in an ethical discussion. This recommendation relies on Rawls' reflective equilibrium. The subsequent attempt to justify ethics is primarily based on the idea that human communal life without some form of morality is (...) not a realistic goal to pursue but still that one may choose between various forms of morality. The last part of the paper contains several indications of how to apply different ethical approaches and how to follow the procedure presented here in light of the debate regarding Peter Singer's ethics. Der Artikel bemüht sich, das Verhältnis von Ethikbegründung und Ethikanwendung zu klären. Im ersten Teil werden dazu einige Überlegungen zur Rolle der Philosophie in Kontexten der Ethikanwendung angestellt. Ein zweiter Teil enthält neben Hinweisen auf die lange Tradition der Vergleiche von Mathematik und Ethik einen methodischen Vorschlag für das Vorgehen im Rahmen der ethischen Diskussion, der sich an Rawls' reflective equilibrium anlehnt. Der folgende Versuch einer Ethikbegründung basiert primär auf dem Gedanken, daß ein menschliches Zusammenleben ohne irgendeine Form der Moral aus anthropologischen Gründen kein realistisch erstrebbares Ziel ist, daß man jedoch zwischen unterschiedlichen Formen der Moral die Wahl hat. The concept of human dignity seems to be closely connected to the idea of human rights. But whereas human rights are at least from an institutional point of view well established, the concept of human dignity is often seen as either arbitrary and superfluous or fundamen-talistic. The paper shows that human rights and human dignity had different histories for a long time but are nowadays intrinsically connected. The concept of human dignity implies a certain core of human rights and offers (...) the chance to understand that there is not one overall view of human rights for all times and places, but that human rights discourse always has to be open to modifications according to the conditions of application. After first mentions in Cicero and Seneca, more diversified uses by Aquinas and Pico della Mirandola, the talk of human dignity finds its current meaning in Kant’s philosophy, often connected to the formula of persons as ends in themselves. This seems to be one of the systematic connections to the tradition of human rights which has its roots in the semantic shift of the word ius in 11th and 12th century from an objective order to claims of different kinds. This kind of argument is used in different contexts throughout the following centuries and transformed in 16thand 17th century into claims of citizen’s rights and human rights. Another connection between the two concepts is given by Martha Nussbaum’s capability approach which is not restricted to human reason. The criticisms against the two conceptions are also different, but connected: Human rights are accused to foster individualism and egoism against the community and declared to be an erroneous development of western culture. Human dignity is seen as an indicator of human hubris towards other creature, based on metaphysical assumptions and a part of “slave morals”, contempt by men like Nietzsche. Both criticisms seem not to be adequate. In the end, the concept of human dignity gives an instrument to defend as much as possible of human integrity in situations where human rights are violated, limited or in one or the other way under pressure. John Duns Scotus deals with a question which is still of importance for modern ethical debate, namely what is the difference between a good deed which is intended but may be hindered by the circumstances and a good deed which is both intended and consummated? Scotus discusses this issue in connection with the question of whether moral goodness or badness can be assigned to the external act, which depends on physical capability. In his investigation, he determines that the imputability of (...) acts, i.e. the fact that the actor had free power of disposition over them, is a criterion for being able to morally qualify them as good or bad. His conclusion that one can clearly attribute the external act with its own moral good or evil is primarily based on his definition of the moral good as the totality of circumstances necessary according to right reason for a good act. William of Ockham expressly rejects Doctor Subtilis' conclusion and relativizes his criterion of moral goodness to the point of meaninglessness. Ockham attributes the moral good or evil of an act almost exclusively to the actor's intention. He explains the moral significance attributable to the actual consummation of an intentional action in terms of the acts of will occurring during and after consummation, which can be morally judged in their own right. He does admit, however, that a judgment made by mortals is based on criteria different from those relevant in the eyes of God. Today, the particularly interesting aspect of this debate seems to be that a moral conception similar to Kant's is confronted with a position that can still be called Aristotelian, albeit with some Augustinian influence. Yet the perceivable theoretical proximity between these two authors could indicate a possible connection between two of the most important ethical concepts in the history of occidental philosophy. Die auch für moderne Ethikkonzepte nicht unwichtige Frage, worin der moralische Unterschied zwischen einer nur gewollten, aber durch die Umstände verhinderten und einer ausgeführten guten Tat liegt, wird von Johannes Duns Scotus im Zusammenhang mit der Frage bearbeitet, ob dem äußeren, auf körperliche Vermögen angewiesenen Akt eine eigene moralische Güte oder Schlechtigkeit zukommt. Bei seiner Untersuchung ermittelt er als Kriterium für die moralische Qualifizierbarkeit in die eine oder andere Richtung die Zurechenbarkeit von Handlungen, d.h. den Umstand, daß sie in der freien Verfügungsgewalt des Handelnden stehen. Das Resultat seiner Überlegungen, daß nämlich der äußeren Handlung sehr wohl eine eigene moralische Güte oder Schlechtigkeit zugesprochen werden kann, basiert wesentlich auf seiner Definition der moralischen Güte als Gesamtheit der gemäß der rechten Vernunft für eine gute Handlung erforderlichen Umstände. Wilhelm von Ockham weist das Resultat des Doctor Subtilis ausdrücklich zurück und relativiert dessen Kriterium moralischer Güte bis zur weitgehenden Bedeutungslosigkeit. Er führt die moralische Güte oder Schlechtigkeit eines Aktes ausschließlich auf die Intentionen des Handelnden zurück und erklärt die eigene moralische Bedeutung, die der Ausführung einer willentlichen Handlung zukommt, durch die während und nach der Ausführung stattfindenden Willensakte, die ihrerseits moralischer Beurteilung unterliegen. Allerdings gesteht er zu, daß die Beurteilung durch die irdische Gerichtsbarkeit z.T. anderen Gesichtspunkten folgt als die vor den Augen Gottes. Heute scheint an dieser Debatte vor allem der Umstand interessant, daß eine der kantischen nicht unähnliche Moralkonzeption mit einer trotz aller augustinischen Einfüsse noch aristotelischen Position konfrontiert wird. Die dennoch feststellbare theoretische Nähe beider Autoren könnte Hinweise für eine mögliche Verknüpfung dieser beiden wohl wichtisten Ethikkonzepte der abendländischen Philosophiegeschichte geben. Ryles Concept of Mind gilt als ebenso überholt wie logischer Behaviorismus und sprachanalytische Philosophie, denen er zugerechnet wird. Ryle betreibt jedoch keinen logischen Behaviorismus, da er das mentale Vokabular nicht zu beseitigen versucht. Für die sprachanalytische Philosophie bilden sich die Begriffe der Umgangssprache in der Auseinandersetzung mit der Welt, spiegeln daher auch die Weh wider. In den von Putnam gegen diese These konstruierten Situationen mit veränderten Wortverwendungsweisen sind auch die Referenten verändert. Putnam hat in der philosophy of mind eine ähnliche (...) Position wie Ryle. Hauptunterschiede sind seine unhaltbare Stilisierung der Turing-Maschinen-Analogie zum Funktionalismus und die Ablehnung des Common-Sense zugunsten der Wissenschaft. Diese läuft leer, da v.a. Begriffe, die sich auf unser Erleben der Welt beziehen, ihren Ursprung in der Grundbefindlichkeit des Menschen haben. Ryle hat gezeigt, daß auch diese öffentlich, d.h. rationaler Argumentation zugänglich sind. (shrink)

Using an analytical and historical approach, this article indicates that democracy, as understood today, is more closely linked with human rights than many authors assume. The first section attempts to justify the approach selected, which connects distinctions revealed by linguistic analysis of various word usages with an historical investigation of the evolving meaning of certain concepts. Section two contains several systematic considerations which firstly, appeal for retention of the now commonly assumed equivalence between democracy in the classical sense and constitutional (...) democracy as it exists today and which secondly, require delimiting human rights as a special class of individual rights. It then becomes clear that much of the criticism in the literature claiming that human rights are anti-democratic, if not indeed of egoistical character, are unjustified. The third section contains an historical sketch of the relevant concepts. This sketch represents an effort to counteract commonly held beliefs that human rights originated in the group interests of the privileged class, since often conjectures about their origin are used to show that human rights are inherently undemocratic and amoral. It appears likely that canonists of the twelfth century developed the concepts of individual rights and human rights. They assumed both that individuals and groups had certain legal rights, but also that every human being had an innate right to the minimum vital necessities and a certain amount of freedom. These concepts regarding rights became absorbed into modern discourse via Ockham's political writings and Gerson's works. Under the influence of Reformation theory, scientific thought and the Enlightenment, they developed into a demand for the right to freedom for all. Der Aufsatz enthält analytische Überlegungen und historische Hinweise, die zeigen sollen, daß Demokratie, wie sie heute verstanden wird, und Menschenrechte enger miteinander verknüpft sind, als dies von vielen Autoren angenommen wird. Im ersten Abschnitt wird versucht, die hier benutzte Verknüpfung von sprachanalytischer Unterscheidung verschiedener Wortverwendungsweisen und begriffsgeschichtlicher Untersuchung zu rechtfertigen. Teil zwei enthält einige systematische Erwägungen, die erstens dafür plädieren, die im Alltagsdiskurs üblich gewordene Verknüpfung von Demokratie und demokratischem Verfassungsstaat beizubehalten. Zweitens sollte man Menschenrechte als besondere Klasse subjektiver Rechte ausgrenzen. Dann wird deutlich, daß die in der Literatur nicht seltenen Vorwürfe über ihren angeblich antidemokratischen, wenn nicht gar egoistischen Charakter unberechtigt sind. Im dritten Abschnitt dient eine begriffsgeschichtliche Skizze dazu, gegenüber historisch argumentierenden Kritikern den verbreiteten Überzeugungen über den Ursprung der Menschenrechte aus Gruppeninteressen von Privilegierten entgegenzutreten, da aus den angeblichen Anfängen nicht selten ein den Menschenrechten immanentes Monument des Undemokratischen und Amoralischen gefolgert wird. Vermutlich entwickelten sich subjektive Rechte und Menschenrechte als eigenständige Begriffe bei Kirchenrechtlern des zwölften Jahrhunderts, die sowohl besondere Rechtsansprüche von Einzelpersonen und Gruppierungen, aber auch ein jedem Menschen als solchem zukommendes Recht auf das Lebensnotwendige und auf ein gewisses Mass an Freiheit annahmen. Über Ockhams politische Schriften und über Gerson gelangten diese Rechtskonzepte in die neuzeitliche Diskussion, wo sie sich unter dem Einfluß reformatorischer Theorie, von naturwissenschaftlichem Denken und Aufklärung zur politischen Forderung nach Freiheitsrechten für alle entwickelten. Wenn Kant in der Einleitung zur Rechtslehre der Metaphysik der Sitten das Recht nach dem Satz vom Widerspruch "mit der Befugniß zu zwingen" verbindet , so scheint dies den völligen Verzicht auf die für das neuzeitliche Naturrecht typischen anthropologischen Prämissen zur Rechtfertigung des Zwanges zu implizieren. Auf der anderen Seite wird in § E die Verknüpfung des Rechtsbegriffs mit gleichem, wechselseitigen Zwang nach allgemeinen Gesetzen als dessen "Darstellung in der reinen Anschauung a priori" bezeichnet, was auf ein synthetisches Urteil apriori (...) hinzuweisen scheint. In einem ersten Abschnitt wird daher gezeigt, daß es sich hier nicht etwa um eine Inkonsistenz in Kants Werk handelt, sondern um eine Anwendung seiner Methodenlehre, parallel zum Begriff der Materie in den Metaphysischen Anfangsgründen der Naturwissenschaft. Die Anschauung in Form einiger basaler Kenntnisse über menschliches Verhalten sichert die Anwendbarkeit des Rechtsbegriffs, der dann tatsächlich analytisch mit der Befugnis zu zwingen verknüpft ist. In einem zweiten Abschnitt wird dem möglichen Vorwurf, dies ermögliche eine Legitimation beliebigen staatlichen Zwanges als rechtmäßig, damit begegnet, daß Kant gerade die Gleichheit, Wechselseitigkeit und Gesetzesbindung des Zwanges in den Mittelpunkt stellt. Der dritte Abschnitt weist darauf hin, daß gerade die elementaren Wahrheiten über menschliches Verhalten, die für die Rechtstheorie relevant sind, nicht ins empiristische analytisch-synthetisch-Schema passen, daß bestimmte fundamentale Annahmen über den Zweck von Recht und Moral jedenfalls nicht denselben Status besitzen wie jederzeit falsifizierbare empirische Resultate. Nach wie vor formuliert der Hinweis darauf, wie «es in Wirklichkeit ist», einen Wahrheitsanspruch, und nach wie vor hat es eine disqualifizierende Wirkung, wenn wir jemandem «Realitätsverlust» bescheinigen, obgleich man in Philosophie und Kulturwissenschaften seit mindestens einem Jahrhundert und seit einiger Zeit auch in der Psychiatrie darüber diskutiert, ob es «die Wirklichkeit» überhaupt gibt, ob nicht viele - möglicherweise gleichberechtigte - Wirklichkeiten nebeneinander existieren. In dem Band befassen sich Wissenschaftlerinnen und Wissenschaftler aus Ethnologie, Jurisprudenz, Medizin, Philosophie, Psychologie und Soziologie u.a. (...) mit der Frage, ob das Festhalten an einer Wirklichkeit unter bestimmten Umständen sinnvoll ist und was geschieht, wenn unterschiedliche Realitätsauffassungen miteinander konfligieren. (shrink)
